Getting an indictment on Donald Trump on this Stormy Daniels nonsense, right?
Let's go through a couple things, because there's a lot...
There's a lot of information out there.
I got to tell you, folks, on both sides of this aisle, the pro-Trump side and the lunatic anti-Trump side, there's a lot of information out there that's being sent your way through a partisan lens, but it's not helping people get to the bottom of this whole thing.

So let's clear this whole thing up first.

Reason for the Trump grand jury delay.
It was delayed yesterday.
They sent the grand jurors home on Wednesday yesterday, which is very strange.
It said, hold on, time out.
There's a flag on the field.
They know the case could be in big trouble.
Bragg's office, notably, wasn't commenting on the reason for the delay.
Of course, saying we don't want to comment on grand jury matters.
You expect they're going to say that.
But sources familiar with the case told Fox News that the proceedings were canceled amid, quote, listen, major dissension within the district attorney's office.
One source claimed the DA is having trouble convincing the grand jury on potential charges due to the weakness of the case.
Holy Moses, folks.
Do you understand how bad this is?
Let's go through the rules of the grand jury fast up in New York State.
You've got 16 to 23 grand jurors.
They literally sit in a room.
I've testified in front of grand juries before.
16 to 23 because people get sick and they sit for a long time.
Grand juries don't hear one case.
They hear a ton of cases.
They'll sit for a long time.
Weeks, maybe months.
16 to 23 people.
You have to have at least 16, no more than 23. And like I said, it varies.
People don't show up one day, the kid got sick, whatever it may be.
Now, you may say, what's the process for bringing what they call a true bill?
A true bill is an indictment.
You just need 12 of them.
So think about this.
If 23 are seated, which I'm telling you, in a case like this, Listen to me here.
I've done this before.
Involving Donald Trump, a former president, with major, major implications.
Every one of those grand jurors is there.
I would venture to say there are 21 to 23 seated every single day.
Why does this matter?
Again, there's a lot of misinformation and confusion out there about what's happening.
If there's 21 to 23 of them out there, and you can't get 12...
Which is barely 55-60%, about half of them.
Do you have any idea the suck level on your case?
Do you know how almost unprecedented this is in a case like this?
To waltz it in in front of a grand jury in a liberal city like New York.
And you can't get 12 out of 23 people to say, not even that he's guilty.
That's not what the grand jury, all they're there for is to say, is there probable cause evidence of a crime?
That's it.
They don't need beyond a reasonable doubt anything.
You don't even need unanimity.
And they can't even get that?
Now, if you listen to the show and the radio show, Joe, remember we brought this up the other day.
I said to you folks, Joe heard it.
I said it is not a guarantee that he is going to be indicted.
I said this case is so bad.
Now, again, this isn't some Stygian witches moment where I was like, give me the eye and I can predict the future.
I've just sat on grand juries.
And eventually you have to produce some amount of evidence.
The problem is it's leading to a lot of kind of misinformation from the left, but some confusion on our side, too, from people who are having some trouble with the process, which I understand.
I mean, if you've never sat at a grand jury or been a lawyer or a law enforcement officer, why would you?
You know, it's not your thing.
You're an engineer, a pilot.
You do your thing.
I don't know anything about piloting a plane.
Here's where the confusion's starting on our side.
So the confusion on the left is they thought this thing was lock, stock, and two smoke and barrels.
Like, Trump's finished.
Grand jury, New York, liberal New York City's done.
He's totally done.
Well, maybe, maybe, maybe indicted.
He may be.
But that doesn't seem to be the case right now.
Sent the grand jury home.
But on our side, there's been some confusion, too.
There is a letter that emerged from the FCC to Trump's lawyer, Michael Cohen.
Just quickly, the essence of the charge is this.
The allegation is that Donald Trump marshaled this deal to pay off this porn star, Stormy Daniels, to not talk about the thing they had, the liaison, let's say.
Is that a crime?
No.
What Alvin Bragg is alleging is that Trump lied about the payment.
That his lawyer, Michael Cohen, paid Stormy Daniels, which he did.
But that Trump reimbursed him for legal expenses, which were really hush money expenses.
You get it?
And the Bragg allegation is it's a felony because it was effectively a campaign donation.
Campaign donation?
How the hell is that?
Exactly.
Exactly.
That's the point.
Bragg's saying, well, he was trying to further his political campaign by silencing someone who would make him look bad.
Folks, it's the dumbest definition of a campaign donation I've ever seen.
Hence, why the grand jury is having a real problem right now with a true bill.
The problem on our side is a letter emerged yesterday.

It's an FCC letter from Michael Cohen to the FCC. Now, Cohen and Bragg are alleging that there was a payoff from Trump to Cohen, you following the gravy train here, to reimburse the porn star to shut up in this NDA deal.
Well, here's the problem.
As you can see from this letter from Michael Cohen's lawyer that emerged yesterday, He says, quote, Cohen's lawyer said in this letter to the FCC a while ago that neither the Trump organization nor the Trump campaign was a party to the transaction with Ms. Clifford.
I think Stephanie Clifford's her name, Stormy Daniels, obviously her screen name, if you know what I mean.
And neither reimbursed Mr. Cohen for the payment directly or indirectly.
If there was ever a time...
Here it comes.

It's been a while.
I gotta keep this close.
Folks, if there was ever in the history of exculpatory evidence, in other words, evidence of your innocence, if there was ever exculpatory evidence in the history of legal cases, this is it.
This is the equivalent of me accusing Guy of a murder, and then the guy who I accused Guy of murdering shows up in court to say I wasn't murdered.
Kind of causes a problem for a murder case, no?
Hey, I was not murdered by Guy.
Well, how do you know that, sir?
Because I'm here.

The gist of the case is that Trump hid the payment to Cohen.
He paid him, Cohen, to shut this woman up.
Rowan's lawyer literally signed a letter saying that that didn't happen.
So like Trump wasn't even a party.
He said that!
Now, there's a possibility.
Hold your horses here, I'm a costume maker.
Hold your horses.
There's a possibility, fairly enough, that Cohen, who was Trump's lawyer at the time, was lying to cover for Trump and wrote the letter to the FCC to cover for Trump.
But the problem then is Cohen's a liar.
How do you trust anything this guy said?
You get the point?
So he's either a totally not credible witness who will lie to the SEC and to his lawyer, or the letter's accurate and Trump had nothing to do with it.
There's this case.
Listen, I love Donald Trump.
He's my guy.
I get it.
But I'm telling you in the most objective way humanly possible, this case is a freaking dog.
It's a dog.
It is probably one of the worst cases I have ever seen brought against, forget a politician, against anyone.
This is a murder trial where the guy who's supposed to be murdered shows up in court to say hello.
Okay, let's get to the part where there's some confusion.
It started making its way around social media yesterday.
Gosh, this is a Brady violation.
We'll get to that later, by the way.
That's another topic.
A Brady violation.
What's Brady violations?
Brady violations are when the government has information of your innocence and hides it.
If the FBI is prosecuting Guy for a bank robbery, and the bank wasn't in fact robbed, and the FBI knows that, and they don't tell Guy's attorney that, that's it.
They're finished.
You may open yourself up to civil litigation if you do that.
Brady material is evidence of a subject's innocence that the government is obligated to turn over.
It's not optional.
So a number of people, fairly enough, said, well, isn't this exculpatory information that should have been presented to the grand jury and it made its way around the Internet?
The answer is, that's a convenient argument, but no.
No, no, it's exculpatory.
I just explained that.
But folks, that is the point.
What do you mean?
The grand jury, these 23 grand jurors that sit, the government prosecutor, in this case the DA's office in Manhattan, has zero obligation whatsoever in there.
To present exculpatory information.
How did I open up the show?
What did I say, guys?
I said you couldn't die to ham sandwich.
That's how it's.
Just put it on the internet.
Put it on the search engine.
Die to ham sandwich.
People have been saying it for decades.
Why?
Because the government prosecutor goes in there and can say basically whatever evidence they want without giving the exculpatory evidence.
Now, that'll come up in discovery and at trial, but not in the grand jury.
Now let's tie it all together.
How freaking bad is this case, folks?
That the government, the DA's office, had no obligation to even disclose this.
Now everybody knows it's out there.
Didn't have to disclose it.
Should have, but didn't.
And they still, they still can't get a true bill and indictment.
Can you process the suck level on this case that they've got information sitting out there that the guy who's supposed to be murdered is still alive.
They withhold it from the grand jury while going in there making this murder case and not telling the grand jury any of the stuff about how bad the case sucks.
And they still don't agree.
Now...
If you're a sane person, unlike Twinkies in New York, right?
Because the guy's clearly been eating too much and it's polluted his frontal lobe, okay?
If you're Twinkies right now and you know this letter's out there, Entirely absolving the defendant in this case, potentially Donald Trump, of guilt in this.
You haven't yet disclosed it to the grand jury.
If you're smart, which Twinkies isn't, one of the dumbest human beings ever to occupy any law enforcement position in the United States.
Oh my gosh.
Monarch of the stupids.
Emperor of the imbeciles.
You go forward with the case.
Push through, keep going back to the grand jury over and over.
That's why I told you, folks, you think this case is going to hurt Donald Trump?
Donald Trump is going to walk out of this.
There is zero chance, zero chance, that whether through the appeals process at the end of the day, that this verdict, say it is guilty, which I'm not even sure it would be, if it even goes to trial, if they even get out a grand jury, there's almost zero chance Donald Trump doesn't come out victorious in this in the end.
You get my point here?
Don't fall for the exculpatory evidence trap here.
It is exculpatory.
However, the DA has no obligation to put that in front of a grand jury.
That starts at discovery and at the trial process, not in a grand jury.
That's why you couldn't diet a ham sandwich.
You don't have to tell the grand jury anything about the subject being, you know, potentially innocent.
That's the whole point.
And they still can't get him.
Now, even the hardcore lefties, some of them are starting to wake up that this is going to be a disaster.
Some of them.
99% of tyrannical left-wing communists are just straight-up imbeciles and want to see Trump in handcuffs, even though they know it's going to blow up in their faces, because they're idiots with no sense of response consequence.
Here's Van Jones yesterday on, I was at CNN. Here's Van Jones starting to, I mean, the guy's liberal bona fides are in question, right?
Here's Van Jones saying, dude, are we really sure we want to go forward with this?
This Manhattan DA better wake up soon.
Because this case probably isn't that great.
Take a listen.
I think that the heat is on this DA. I think he's going to make a very sober decision.
And I would not be surprised if he doesn't step back from the brain.
Now, of course, Jones, who I'm no fan of, he's no fan of mine either, Jones is just saying the truth.
You know, whereas I just told you the truth about the exculpatory evidence thing, don't go on Twitter, oh look, they withheld the exculpatory evidence from the grand jury because I don't want you to get burned.
Because it makes your credibility look bad.
He doesn't have to do that.
The left doesn't care.
They don't want the truth like I'm giving you.
They want to be told one thing and one thing only.
You guys know what it is.
Donald Trump, lock him up, hang him by his toenails.
They don't care.
Shave his head, put him in prison, mugshot.
They don't care.
So Van Jones is stating the obvious.
This case is a dog.
An absolute dog.
They don't want to hear it.

They know what happened.
I didn't figure out.

These people take Mueller seriously?
Folks, the libs are losing it.
They are completely detached right now from legal reality, from political reality, anything else.
They don't realize right now that the reason Donald Trump, I'm telling you, I'm getting this from, listen to me, listen to me quick, please.

Trump's not afraid of this case one bit.
You may think he is.
It may make you feel better.

But I'm telling you right now, Trump isn't the least bit afraid of this case.
He knows it's a dog, and he knows he's going to have his moment walking out of the courthouse, shaking his fist in the air, as he's victorious in this case.
He knows it.
And he knows you guys are setting yourselves up for failure.
Folks, the Democrats have been salivating for years, too, over an indictment of Trump.
It's really pathetic.

And then is the next shoe to drop here in this case, the White House involvement in this?
Was the White House involved in pushing Twinkies to try to charge Donald Trump?
Because then we got a real problem.

So, the Democrats, this is a hat tip Tom Elliott over at Grabian, have been salivating for years over an indictment of Donald Trump.
It shows you why, tie in this segment up, why what I just said matters.
They are completely detached from any kind of legal or political realities.
Their case is a legal dog.
It's an even worse political one because Trump is going to beat them and they're going to martyr the guy and make him look like a superhero.
Karl Rove wrote a piece yesterday at the Wall Street Journal.
Suggesting otherwise, that this isn't going to politically help Trump.
I entirely, completely disagree.
Sometimes I agree, sometimes I disagree.
Completely disagree.
I think he is totally misreading this situation, and I say it as a guy who really loves a Florida governor, and I like the former president a lot.
I'm being objective as possible.
I think he's totally misreading this.
This is what the Republican base sees when they see Trump fighting the deep state.
And when he wins this, they're going to see it as a victory over these people.
Take a look.
It's clear that Trump is the target and he'll be indicted eventually.
On the day Donald Trump leaves office, the Justice Department may indict him.
Now there is talk of jail time for the president.
That Mueller could indict the president for obstruction of justice.
Donald Trump should be indicted for calling a cooperating witness a rat.
He should have been indicted.
A sitting president can be indicted by the Justice Department.
Why aren't we at the target, Trump, having committed crimes to get the presidency?
So why aren't we at an indictment yet?
I think there's generally consensus that the president has probably committed indictable crimes.
It's very strongly in favor of indicting the president when he is out of office.
That there may be enough evidence to indict Trump.
Is Donald Trump going to be indicted?
Maybe it'll happen.
Maybe he'll go to prison.
You know?
Will he ever see the inside of a prison cell?
DA could get a ham sandwich indicted.

Even if Donald Trump himself is not ever indicted, there is another way that prosecutors can actually indict the entire Trump org.

They have lost, they have totally lost their bearing.
They're in the matrix now.
They're in this false reality where they think they're going to legally or politically hurt this guy.
They may legally cost them a lot of legal bills, but the cases against them, whether it's Georgia and classified documents or this, are all dogs.
The classified documents case only brings attention back to Joe Biden, who has got a far worse scandal.
The Georgia case keeps bringing attention back to people who have a lot of questions about what happened to Georgia.
And this case just keeps highlighting Trump's war with the deep state.
None of this is working.

They're afraid of a military crackdown or the FBI investigating them.

We don't want civil war in the streets.
You want people killing their neighbors.
Obviously.
I mean, does that even require us saying that?
But you have faith in institutions.
And you believe, like, your neighbor's not going to come after you either, even if they're a Democrat and you're a Republican, because we have laws.
And we have what?
Faith in institutions.
When you see societal upheavals, people lose faith in institutions.
Oh, the FBI's not going to protect me.
Matter of fact, not only are they not going to protect me, they're going to target me because I'm a MAGA supporter.
That's happening now.
I just described to you how nobody has any faith in this justice system anymore.
New York City, you're a sitting duck if you're a conservative.
Why you'd stay there is beyond me.
The second part you need is not just faith in institutions collapsing.
You need economic collapse because you need to make people desperate.
Once they're desperate, only four missed meals away from chaos, right?
That's the old line.
Civilization's a thin crust on a volcano, right?
It's been said before.
Once you get to economic collapse, you've got this witch's brew for dangerous societal upheaval.
Folks, it's happening right now.
You've got this perfect storm going on right now.

The economy is teetering on an edge.

We have a lot of trouble.
But back to the faith and institutions part in a second.
This has been a multi-day part.
I've been covering these over the last couple of days and I'm very worried about this.
You want to see why faith in institutions is collapsing?
Well, you're probably saying to yourself, oh, well, you know what?
Even if Twinkies indicts them, our institutions will hold, Joe.
You know, we got courts.
We got judges.
I mean, judges are just, you know, guys and ladies in black robes, and they're not partisan at all, and they know the law, and they understand the law, and they'll back us up.
Of course, that got thrown out of the way with January 6th, where guys have been sitting in gulags for two years, despite habeas corpus.
Oh yeah, they've had initial appearances, but they've been kept in prison for absolutely absurd, absurd reasons.
Nobody has faith in the judicial system anymore.
People are losing him.
How do you expect to get a fair trial as a conservative in front of this guy?
Let me introduce you to a man named Cato Cruz, who is being nominated for a court seat by Joe Biden.
He is a federal magistrate now.
He's asked a pretty simple question about Brady material.
Brady material.
You know, like we've been discussing for the last three weeks and everyone else has been discussing in the media.
It's evidence of a defendant's innocence that's not presented to him.
I.e.
the FCC letter from Michael Cohen's lawyer to the FCC about the payment Donald Trump didn't make according to the letter.
Brady material is a concept.
Taught to a law enforcement officer and a 101 law student in college.
This is not a complicated thing.
So a federal magistrate, you guys think they know a little bit about Brady material?
It's like asking Joe, Joe, you know anything about processing sound?
No, no, nothing.

The January 6th cases, the Mike Flynn case, the Michael Cohen, Donald Trump case.
If this guy, Cato Cruz, his judicial nominee, just turned the news on, Joe, hit the power button on the remote, he would have learned what Brady material is.
Now, this is coming up again.
Because one of the defendants in the January 6th case, who was charged with all kinds of things, you know, felonious mopery and the umpteenth degree and all these other charges and everything else, one of the defendants, his legal counsel, just filed a motion, and he makes a suggestion in here that, I gotta tell you, I was communicating with Former FBI friend of mine yesterday about this, and he said to me, I have never heard anything like this.
It reminds me of that scene in that movie Seven with Morgan Freeman and Brad Pitt.
They're investigating the serial killer, and he whispers in his ear, have you ever seen anything like this?
The answer is no.
The lawyer for one of the defendants in the January 6th case Is implying that an FBI confidential source?
Doesn't mean it was an FBI agent.
It could have meant it was someone who had infiltrated their group or someone they flipped.
Quote, participated in prayer meetings with members of one or more of the defendant's families?
The CHS, Confidential Human Source, also engaged in discussions with one of the defendant's family members about replacing one of their lawyers?
The above may not include all the communications that were initiated by or engaged by the CHS. Folks, listen, again, please, I promise you objectivity in this matter.

The Fed's got to raise interest rates because they've got to dry up the money supply.
Interest rates go up.
It makes money more expensive, right?
Everything has a price.
Bagels, cars, money has a price, too.
For you to get money at a bank, you've got to pay an interest rate, right?
The higher the interest rate, the harder the money is to get.
I can't afford a 9% loan, but I can afford a 5% loan.
Think of an interest rate as a price of money.
Kind of the price of capital, but for the sake of argument here.
In order to dry up the money supply and make money harder to get, the Fed raises interest rates in inflationary periods.
Okay, that's a great idea.
We're in inflation.
What's the problem, Dan?
The problem, as I've said for the last week, is as the interest rates go up, the banks all have a bunch of bonds on the books that lose money when interest rates go up.
No one wants a bond paying 2% if I can get a 5% bond because interest rates go up.
Very simply stated.
So what you're saying, Dan, is as the Feds keep raising rates, banks are going to continue to lose money?
Isn't that going to cause a banking crisis?
Yes!
That's the point, man.
So there's a third answer here.
The third answer is to do what Reagan did.
And to juice the economy by cutting government spending and massively cutting taxes.
Letting the economy grow, which would produce more products, which, like a sponge, would suck up all the money.
Because it'd be chasing more products and prices would come down.
That's out of the question.
Biden's a communist, doesn't want to do that.
So what's going to happen, folks?
Well, I'm telling you, either hyperinflation is going to happen or you're going to see more banks going down.
Here was a guest, Eddie Gabor on Fox yesterday, explaining exactly the problem we're in now.

Eddie, does backing up the banks make any difference to your bearish outlook for stocks?
It does not.
Look, the fact that Yellen has to even come out and say that there's a potential to need to backstop more banks, in my opinion, gives people less confidence in these smaller banks.
And so we have a banking crisis, unfortunately.
And look, this goes well beyond the banks, right?
Think about the financial institutions that aren't backed by FDIC, the shadow banking that have these same types of high-risk loans that are out there.
They're going to start to see defaults there, and there won't be any government backing.
Look, at the end of the day, the government can't backstop every business and every bank and every depositor.
This is a function of poor monetary policy and loose and zero interest rates for over a decade.
And we just started this banking crisis a couple of weeks ago.
Just because Yellen comes up and speaks about it doesn't mean it's going to reverse itself overnight.
This guy just absolutely nails it.
He absolutely nails it.
It's not just the banking system that's in trouble.
It's a shadow banking system.
What's the shadow banking system?
A lot of these companies that aren't going to be able to get loans from standard banks, Joe, because they got a product that may or may not work and they're new and they have no reputation in the space.
They go to this venture capital angel investor space who lend them money too.
A lot of them are going to have problems as interest rates go up too and money starts to dry up.
This entire shadow banking system that's interest rate sensitive has the same issue the banking system does.
A lot of these companies that were going to go public are not.
A lot of these companies that are public and have been borrowing money at low rates and have bonds on their books.
Their bonds are going to be worthless.
Now you see why I'm a little worried?
I'm worried very simply because the witch's brew for social revolution and this economic trouble at the same time faith in institutions collapses.

Now, Joe and I and Guy don't hang around with racists, but in our effort to stop them, I've researched a lot of their stupidity.
And one of the arguments is that people of a different race are stupid and dumb and have some genetic limitation.
Doesn't sound that much different from that one right there.
