He was joined by Justice Clarence Thomas.
Called out the reckless and legally dubious move made by the court's liberal majority to block President Trump's lawful efforts to deport dangerous foreign nationals under the Alien Enemies Acts, and he talks about it.
I mean, according to the order, he says, it says, There is before the court an application on behalf of a punitive case of detainees seeking an injunction against their removal under the Alien Enemies Act.
The matter is currently pending before the Fifth Circuit.
Upon action by the Fifth Circuit, the Solicitor General is invited to file a response to the application before this court as soon as possible.
The government is directed not to remove any member of punitive class of detainees from the United States until further order of this court.

Justice Thomas and Alito dissent from the court's order statement from Justice Alito to follow.
And he basically called them out for what they did.
The argument was very clear.
He said the court has had jurisdiction only if the court of appeals had jurisdiction of the applicant's appeal.
And the court of appeals had jurisdiction only if the supposed order that the applicants appealed amounted to the denial of preliminary injunction.
But here, the order that applicants appealed was what they viewed as a district's court's constructive denial of their request for a temporary restraining order.
So he basically believed that the Supreme Court intervened before the Fifth Circuit had the chance to weigh in and that it violates the normal hierarchy of judicial review.
So you've got the ALCU that was sitting there trying to play this little chess match and was able to pull one over the Supreme Court.
And Justice Alito said, no, no, no, that's not the way it's supposed to go.
They jumped the cart.
So yes, he called them out on it.
He also noted that the government had not even been allowed to file a response either in the Supreme Court or the lower courts before the injunction was granted.
He emphasized that the court acted solely on claims made by the applicants, illegal alien detainees, without any concrete evidence of imminent danger of removal.
So he absolutely laid it out.
He knows exactly what they did, and the others were just completely fooled by it.
I mean, this is just ridiculous.
To be at this level and not see process and protocol and how it's supposed to go, this was a huge error.

I mean, I think we're going to see something come of this because too many people are outraged on how it was allowed to go forward.
