Is There Enough Evidence to Convict Brian Kohberger?
| Copy link to current segment

Time Text
Okay, so I really want to get back into this Brian Koberger case.
I am going to jog your memory on this.
It's obviously something that you can't forget.
It was just so horrific. We had never seen anything like it.
There were four roommates.
They were students that were slaughtered in their home at night.
Maddie Mogan, 21 years old.
Kaylee Goncalves, 21 years old.
Zanna Kurnodal, 21 years old.
and her boyfriend, Ethan Chapin, also 20 years old.
And that was last November.
It happened in their off-campus home in Moscow, Idaho.
We were all seized by this.
We remember the horrific images.
There was blood seeping out of the house.
And then it seemed like there was a really long time for police to catch the person.
And we all wondered, how on earth could you stab four people?
One roommate saw the person, said his face was covered, but she recognized the bushy eyebrows.
It was a surviving roommate who chose to call the police the next morning.
We don't really know any details about that, whether she was in shock.
And I've been following this case obviously because I'm a parent and it's a very scary
concept for any parent to know that this tragedy could have taken place just outside of a college campus and
It's very scant on Details what I have been amazed by with this case is that
we know that Brian Koberger was arrested We were told that in June we were going to be able to see
what evidence was being used to indict him And then they cited to use a grand jury to indict him and
we weren't able to see any evidence and that really is Bothersome to me because this is a case of high public
interest obviously for parents in general Well things are taking an even stranger twist. There's been
a lot of weird elements to me first and foremost They wanted to tear down the house
But his defense filed something asking for them not to tear down the house so that they could go in and get their own
Evidence which seems really bizarre to me. I'm thinking you just stabbed four people
Are you really gonna try to get away with it or pretend that you're not guilty?
Or do you actually think that you have a chance?
Are you actually alleging that you are not guilty and you think that somehow you are going to be able to prove your innocence, right?
So that element was fascinating to me.
The fact that he's been meeting with a pastor in prison, definitely not following what I would say is a standard criminal profile.
But of course, if you stabbed four people, you're probably clinically insane.
You probably don't follow a standard profile anywhere.
Well, listen to this, right?
Another thing that I had said to my producers as we were following this and why I said that we should wait for more details to come out on this case before we report on them was because I felt that the media kept doing hit pieces on him referring to his heroin addiction back in 2014.
I kept remarking on how strange and unnecessary it was to do hit pieces on a person that stabbed four people.
He's not likable.
You don't need to do a hit piece on this person.
We're all thinking he's a murderer, he's a maniac, he's killed more people.
We don't need you to dig into a heroin addiction that he had in 2014.
They were talking to people that he went to middle school with.
And I was going, all I want is the details regarding how he killed four people.
I'm already going to hate him.
You don't need to dig back into his history.
Well, this piece has completely thrown me for a loop.
This is insane to even consider.
Ryan Kohlberger's lawyer, and mind you, very few people are allowed to say anything about
this case because also, which seems extraordinary, the judge has issued a gag against the victim's
families.
So the victim's families are not allowed to speak out about what's happened.
And they are fighting that gag, right?
The court has been so hush-hush about this case that even the victim's families are fighting the court saying, hey, we want to talk about what happened.
I want them to have the freedom.
Could you imagine suffering that tragedy and then having a court gagging you?
I don't see what the upside is for the court because I'm assuming there's so much evidence to convict him.
That it doesn't matter. Let them speak.
It's not going to save him from a prison sentence if they're talking about what they've suffered.
But a gag remains in place.
The update to this case now is that in documents filed on 30 on Thursday
Pardon his attorneys have said that there they have established
No connection between the 28 year old suspect and the students that were fatally stabbed in their off-campus home
They said quote there is no connection between mr. Kober and the victims
There is no explanation for the total lack of DNA evidence from the victims in mr. Kober
Apartment office home or vehicle and let me tell you why I find that to be very strange
The first thing that I had said and again, I know nothing about this
But if you stabbed four people, I would assume that you would have cuts on your hands
And the media had leaked that when he drove back to Pennsylvania from Moscow, Idaho, with his father, that police officers had stopped him and had taken pictures of his hands.
So I was waiting for that to be a big piece of the evidence that obviously you stabbed four people, you're going to have some cuts or some bruises on your arms, on your hands.
It's four people that were butchered.
We saw blood seeping out of the house, where apparently there is no DNA evidence from the victims in his apartment, in his office, in his home, or in the vehicle.
So that registered to me as very strange.
Now, what did they have?
Well, we all heard about the sheath, right?
They had the sheath, which fit a knife that they found left behind on the bed.
He's a criminology PhD student, so it seemed like a very sloppy thing for him to have left the sheath on the bed.
By the way, I want to be very clear.
I'm not saying he's innocent.
I'm just saying to you that I do not think that the state has a very strong case against him, and they have not yet presented any other aspect other than this sheath.
Now, what's interesting about the sheath and why I found this lawyer's statement to be very compelling is they're saying that the FBI... We're good to go.
The prosecutors previously argued that Koburger had no right to FBI data that was uncovered from the method.
And obviously the defense team is saying, no, yeah, we do not accept that.
We need the information because they are saying that it's a fluke and that however they got this is obviously a fluke.
And they're also stating that a second male's DNA was found inside of the Moscow home and that police allegedly found DNA from a third man on a glove that was discovered outside of the home.
And so this case is just incredibly interesting because it all seems, of course we haven't been told anything, that it's hinging upon this sheath.
And if it is in fact that they tied him to this sheath and they still do not have a murder weapon and all they have is this sheath and a 23andMe FBI type data which tied him to it, I would say that it is a very shaky case.
And that upsets me.
It shakes me to my core because four people were slaughtered in a home.
How is there not more DNA evidence?
And you could say, I know some people have been saying on Twitter, well, he was a criminology major.
who would have known what to do.
How brilliant could this individual have been?
We're talking about four individuals.
You remember those photos of blood that was literally seeping outside of the home.
This wasn't like they were stabbed one or two times.
And so I have been following this case, and I have said, if you are a lawyer,
and I know that people have pointed me to a few feeds, I'd like to hear what your take is on this,
because right now, my suspicion is that the state does not have a strong case against Brian Koberger.
And as I said, that's very chilling, because, and I'm, again,
not saying he is innocent or guilty.
I am not there to comment on that.
All I do is interpret the facts of this case, and there have been so few that it doesn't seem like this is actually a very strong case.
So I would love to hear what you guys have to say about that if you have been following it.
And don't—please don't comment and say, oh my god, I feel like he's guilty.
He looks guilty. People say that.
I'm like, that's not a thing. You can't just say— He looks guilty.
I feel like he's guilty. Obviously we all want the person behind this hideous murder to be captured
I am asking you to actually assess whether or not you think that based on
Cellphone data which ties him to the general area which he lived around by the way. He lives around their home
I think within 10 minutes or 15 minutes from the home. He lives around there
And a sheath in FBI statistical data, if they're actually going to be able to get him for this crime, do you actually feel that that is enough to convict him?
Or are we all just really emotional because of how horrific this crime is?
All right, guys, if you like this video, you're going to like the full episode even better.
