Joining us now is Jenny Beth Martin to talk about a new movie called Innovation Race.

Jenny Beth, welcome back to the program.
Thanks so much for having me again, Charlie.
Tell us about the movie.
So we've done this documentary and it really sets up the dynamic with America and China in the innovation and technology race, comparing it to what America and the Soviet Union went through in the space race back in the 60s.
And we make the case that we have to make sure that we win when it comes to the innovation race.
America needs to have more inventions, more inventors, and we need to stay on the cutting edge when it comes to innovation in order to outpace and beat China.
And we've got a real problem right now in America.
We used to have very strong laws that would protect intellectual property and patents.
During the Obama administration, a Republican-controlled Congress passed a bill that Obama signed into law that weakened our patent system.
And we make the case in the movie that we need to go back and strengthen it.
It's a bipartisan issue.
Even Senator Chris Koons is in this movie.
And so is Congressman Thomas Massey.
It's really an America-first movie making the case that we need to strengthen our intellectual property system so that we can beat China in the innovation race.
So walk our audience through that.
So what are the current patent laws and what changes do you think should be made to them?
So prior to 2000, around 2010, maybe a little bit before and going into about 2012, prior to that time period, we had pretty strong patent laws in America.
And the patent laws are actually protected or the patents and the right to hold your own intellectual property is protected in the Constitution in Article 1 of the Constitution.
So this actually was a revolutionary idea that our founders had that an inventor and a person who thinks of things with their mind, that intellectual property belongs to the person who thinks of it.
And if you come up with a brand new idea, you share it with the whole world through the patent system.
So you put it all out there for the world to see and the world to benefit from, you get exclusive use of that patent for a fixed period of time.
In this case, it's 20 years.
The problem right now is that a new court was set up back in 2012 that is an administrative court called the PTAB.
I really call it the death panel for patents.
And so now instead of going through the regular court system, if your patent is challenged, you're going through this court of lawyers who are experts.
And you and I both know when experts start making decisions, usually it's not the right decision.
But the very same office, the U.S. Patent and Trademark Office grants patents, and then they have the P tab in the same building and invalidate the very patents that they granted.
It's a real problem right now, and it's preventing innovation from happening here as it should.

For over a century, America has been the world's inventor, a country whose ideas and innovations transformed mankind.
But today, our nation faces challenges at home and abroad.
Challenges that threaten our economic and military security and the very idea of American greatness.
China is investing heavily in its own innovation, in its own military.
They are serious competition for us.
We need to up our game.
So that's just a little taste of the trailer.
I mean, talk about the implications of what happens if we do not address this.
Well, I think that if we don't address it, then China is going to be better at innovation than we are.
Right now, as America has weakened its patent system, China has strengthened its patent system.
Now, we understand that China, we can't completely trust them.
They don't respect individual rights or they're run by the Communist Party of China.
So they have a different take on human rights and individual rights and even property rights than we do in America.
But right now, they've strengthened their patent system.
And so people are going to China to get their inventions protected and they're not coming here.
Or when they are coming here and they are getting patents here, then the patents wind up getting invalidated.
And that is very discouraging because you come up with this great idea.
You think you're going to be able to benefit and profit from your idea.
And then you cannot do that.
I've heard inventors who are inventing tomorrow's technologies.
It could be for something that is a medical device.
It could be for a national security type system.
It could be just for a jump rope or water balloons.
But I've heard from inventors who have said that it's better to just take the idea and put it in a filing cabinet and lock the filing cabinet and keep it safe in there rather than letting the world see your invention because America is not protecting those property rights.
That is not a good place for us to be when China is trying to be very innovative in the technology space and trying to control the future.
We have to be able to beat them at that game and be better than they are.
So what is the current law then for the patent?
Is it 20 years for a patent or what is the current law on the road?
It's 20 years and that part is not the problem.
The problem is more what they are allowing to be patents patented.
So one of the things that we think needs to happen is that if you are the first person to invent something, then you should be the person who gets a patent on it if you can prove you were the first one to invent it rather than the person who runs to the patent office and files the paperwork first.
There's also a problem with injunctive relief that our court systems have created.
So if you are able to say, no, I actually own this patent, it's mine, you should be able in normal circumstances, if somebody's squatting on your property and your house or your business, you'd be able to get them off your property or be able to charge them rent or whatever it may be.
Right now, we have a system where you can't get that relief from it, even if you find that people are infringing on your patents.
And then the problem with the P tab right now is that it is invalidating patents that should still remain valid.
Either that or if they should have been invalidated, then the U.S. Patent and Trademark Office should never have granted the patent in the first place.
Okay, so then the policy solution then is just to kind of clean up some of the bureaucracy associated with it.
Is that right?
That's exactly right.
It's cleaning up the bureaucracy.
And Senator Coons has a bill that has a lot of similarities to what Congressman Thomas Massey has in his bill.
I tend to prefer the things that are in Thomas Massey's bill because he does more and he's more freedom oriented.
But right now, even if we don't get everything that I want, there are places where Democrats and Republicans agree we have got to fix this problem.
And the problem that we're facing right now from the bill that was passed into law in the Obama administration is that big tech came in and they wanted to make it easier so that they didn't have to pay patent.
They did not have to pay for other people's patents.
So they could use the property and the ideas that other people came up with and use it in their own products without having to pay for it.
And so they lobbied, got Congress to pass laws that benefit big tech, but actually harm the small inventors in America.
And we need to go back and make sure that we're taking care of those smaller inventors.
And oftentimes, the people who are the smaller inventors, they're not at all politically minded.
They're the mathematicians and the scientists and just the people who come up with some nifty idea that would make a product better and make our lives easier.
And they're not engaged in politics and they really should not have to be engaged in politics.
That's part of the reason why at Tea Party Patriots, we want to do what we can to help them because the Constitution protects these rights or natural God-given rights in the first place.

I used to support Paul Ryan.
Boy, I was hoodwinked on that one.
I was young.
Jeez.
And Paul Ryan really is a depressing story.
It is.
I mean, Paul Ryan was always a neoliberal.
He pretended to be a conservative.
But if you want, if you want some good news, a decade ago, we didn't have shows like this.
We didn't have shows like Bannon.
We didn't have shows like Tucker.
It was all just Republican good, Democrat bad, Republican good, Democrat bad.
And yeah, there was some Tea Party energy, but they struggled.
If it wasn't for the Rush Limbaugh program or Mark Levin, there really wasn't a lot of air cover to be able to get your voice out as a grassroots conservative.
There just wasn't.
And now there's an entire infrastructure, an entire movement of media personalities, of influencers, of people that are really able to platform and expose.
And Paul Ryan now knows there's really not a lot of media allies left for him.
And that's one of the things that the establishment regime conservative, conservative in quotes, Republicans are lamenting.
There's not a lot of places left for them to go to kind of spread their nonsense.
I mean, he'll get a lot of credibility if he goes on CNN or MSNBC, but I just don't think Paul Ryan would be able or would want to do a whole hour on this program.
We'd treat him with respect.
We'd treat anybody on this program with respect.
Or if he did a whole hour with Steve Bannon on War Room or a whole hour with Tucker Carlson.
I don't think that's something they'd be willing to do.
And I think it tells you a lot.
And one of the reasons why I think conservatives more broadly have an advantage is that we invite the disagreement.
We don't hide.
It's one of the things we do on our campus tour.
Ben Shapiro does this.
Matt Walsh does this.
Candace Owens does this to their great credit.
They invite the disagreement.
Can you show me anybody on the left that has a major following that actively invites conservatives to challenge them?
Can you show me a single person on the left that actively goes into environments of which are not friendly and asks for disagreement?
Now, you might say Bill Maher, that might be a good one, but Bill Maher also does it on his home turf with dozens of writers that have prescripted jokes and one-liner is ready for him.
But no doubt, Bill Maher is talented.
He's a very talented communicator.
But the equivalent would be this: how many liberals would be willing to go to a Lincoln-Reagan Day dinner or to an NRA deal and take questions and film it?
I don't see that.
That is the equivalent of what we're about to do at Turning Point USA when I'm going to University of California, Santa Barbara, or UC Davis, or Ohio State, or University of Illinois, Chicago.
That's the equivalent to go into a hostile territory, take any question.
By the way, it's not just questions from students.
People from the community can come.
Professors can come.
Give us your best argument.
It's an open mic.
And you might prove us wrong or you might win one against us.
Good for you.
Let's have an open sport.
Let's have an open dialogue.
You don't see that on the left, especially amongst the people with the biggest followers.
And isn't it interesting?
You go Shapiro, you go to Walsh, you go Knowles, you go Candace, you go our program.
Top, top followers, like the top people, that's the top 10, top 15 in the conservative movement, according to social media followers.
And not just unafraid, but enthusiastic to go find the disagreement, embracing it.
That is a sign of a movement that long-term will win.
The left, they want nothing to do because they, for whatever reason, they know that they're not as good at defending their positions.

They don't need it because they get a huge check from the corporate-funded media in the mass distribution.
That is changing, everybody.
It's changing in real time.
Here's some interesting news coming out.
John Tester is going to be running for reelection in Montana.
That certainly is going to make the 2024 Senate race very, very interesting.
Joe Manchin refuses to identify as a Democrat in a TV interview.
If we get our act together and we build the machine, we could have a very, very good 2024.
But I'm not going to speculate it.
I think we need to talk as if we are the underdog.
I think we are the underdog going in 202024.
In fact, I think the Democrats are likely going to hold on to power.
We're currently not building that machine, so we got to get to work.
We got to go to places that we usually don't go.
It's not going to happen automatically.
It has to be an investment into that infrastructure every single day.

And you're right.
There's been some people popping up that are probably doing it out of their parents' basement.

And so just share a little bit though about how it's not just businesses, churches and nonprofits also.
We have a lot of pastors in our audience.
Walk us through that.
Yeah, I mean, almost top to bottom, people were affected during the pandemic.
So there's a few qualifications.
You know, we have this new term that somehow came about during COVID called essential or non-essential.
And so if you were deemed non-essential and you had to close or partially close, then you qualify.
If you had a revenue reduction that meets the parameters, you qualify.
And then the latest legislation change, Charlie, that's blown the hinges off the door is if you had supply chain issues, if you were affected during the pandemic, any of your processes.
Yeah, the only ones that are excluded from this really are public entities.
Like they can't, you know, obviously they can't take stimulus from themselves.
So private schools, churches, nonprofits, certainly traditional style businesses that had W-2 employees.
Even Forbes magazine came out and said the IRS anticipates about 80% of all businesses would qualify for ERC funds.
And just a little background on it.
Charlie, you know, when the CARES Act first came out, businesses could either do PPP or ERC.
They could not do both.
Well, the PPP was heavily marketed through banks and lending institutions.
And so everyone heard about it, right?
No one heard of ERC.
So they have hundreds of billions of dollars allocated for these business owners and it was not being taken.
So they changed that legislation to say, listen, even if you took PPP, you can now take ERC.
And we make sure that it's 100% compliant.
We're not double dipping funds.

But a lot of people didn't call.

Okay, I want to talk about a story that was going viral this last weekend.
But first, let me read a poll from Ras Mussen.
This Ras Mussen poll was talking about race relations in America, head pollster from Ras Musin Reports.
And polling blacks in America asked the question, quote, it's okay to be white.
53% of blacks agree that it's okay to be white, and 26% of blacks disagree, and 21% are not sure.
It's okay to be white.
72% of Americans agree.
69% of Democrats agree.
And so 26% of blacks, 26% think it's not okay to be white.
Now, that's a rather interesting question.
And why they worded it that way, not exactly sure.
But it does beg the question of, is there a growing anti-white sentiment in America?
This is something that is largely considered to be third rail.
You're not allowed to ask about it, not allowed to talk about it.
It certainly is in our laws, affirmative action, critical race theory.
It's in our curriculum.
It's in what we're teaching our kids.
It's in the media.
It's in our jokes.
It's in Hollywood.
It's all throughout Netflix and Hulu.
It seems to be that there's some sort of design behind this, but are we going too far?
Because are we over-exaggerating this?
Well, here's a piece of tape here of just some of the anti-white sentiment that is going viral online.
Let's play cut five.
What are white people superior at?
They're real good at violence.
Violence.
It's like stealing people's lives just because they feel like it.
Insecurity?
Pretending.
Fear.
Being fearful of nothing.
Being ignorant.
Blame.
Letting their egos control their every move.
Superior at being dick.
Okay, so that is a short montage from the cut, where they say whites are good at genocide, at hate, at violence, and all these sorts of things.
Could you imagine if there was a video of white people saying things about blacks in that regard?
Oh my goodness.
Now, I just want to play this out for you.
What's so interesting is the poll also asked, do you believe that blacks can also be racist?
And 76% of blacks think, yes, blacks can also be racist.
So that's promising.
But 27% don't think that blacks can become racist.
And it actually fits perfectly.
And let me tell you why.
So one in four blacks think that blacks cannot be racist.
And one in four blacks think it's not okay to be white.
That is 15 million people in our country.
It's not a small number.
It's not some sort of fringe idea.
It is a minority, praise God, but it's 15 million people.
Could you imagine if one in four white people thought that being black was not okay?
Here is a poll.
Here's the poll here.
Do you agree or disagree with the statement, it's okay to be white?
42% of blacks strongly agree that that's okay.
Only 11% somewhat agree.
21% are not sure.
They say, I don't know.
8% somewhat disagree.
And 18% strongly disagree.
Again, this is by Rasmussen Reports.
It's a rather interesting poll from the commission to even ask this question.
So 15 million blacks think it's not okay to have white skin color.
That number should be 1 or 2%, not 15 million people, 25% of 1,000 poll respondents.
So what does that show you?
It shows you with now empirical data that there is a sizable portion of the American population that is saying we hate white people.
That is what the data is showing us.
And they also think they're not being racist by saying that.
Taught in colleges all across America, they are teaching that blacks have immunity from the sin of racism.
So Scott Adams, who is the founder of Dilbert and also a very smart man and a very, let's just say, deep thinker on a lot of different issues, came out and he said, based on this data, you could call blacks, quote, a hate group.
I think that probably goes too far, but here's what he's basically saying.
He's saying, based on this data, a portion of black Americans have hate to abolish and eliminate white people.
The essence of what he was saying is totally and completely true.
The campaign against Scott Adams has been overwhelming.
It has been aggressive, same with Woody Harrelson, to cancel him, to drop him, to ridicule him.
And let me just add one more thing to this.
I am exhausted talking about race all the time.
I do not think race is determinative or predictive of your behavior.
Values is what matters.
Your melanin content is irrelevant.
What they are trying to do is make race matter.
That is why you're seeing anti-white beliefs grow and metastasize.
If you read critical theory, in fact, we have a whistleblower here of somebody who is a student in Pennsylvania at a medical school where they are teaching medical students why it's wrong to believe in colorblindness.
They say colorblindness is actually racist.
Now, I never liked the term colorblindness because obviously you're not going to be blind to it, but you could be color agnostic.
It doesn't matter.
I don't have an opinion on you at all based on your skin color.
It is completely and totally irrelevant.
Now, this poll does show, though, that while it is irrelevant to me, it is not irrelevant to one out of four blacks.
And that is worth talking about.
That's worth asking a question.
It's worth asking the question: is there a growing anti-white sentiment?
If there was a poll of whites and one out of four whites said that it's not okay to be black, I would be disgusted by that.
I would be appalled.
I would say, why would white Americans, one out of four of them, say that?
We should try and build institutions that make color irrelevant.
Maybe we can't be colorblind, but we can pass colorblind laws, colorblind admission policies.
Your ideal should supersede sometimes the broken reality of the human being.
The ideal should be colorblindness.
The ideal should be when you apply for a job or apply to go to college.
It is completely irrelevant.
The melanin content.
It doesn't tell me anything about you.
Instead, we are going in the opposite direction and we're creating neo-segregation.
It's really a sad thing that we're seeing.
And Scott Adams mentioned it and noticed it, and they're trying to destroy his life without giving him a chance to clarify why he said this or why does he believe it.
Segregation, unfortunately, makes for very good politics for the Democrat Party.
They've always been focused on segregation-type politics.
It's sick.
It's disgusting.
This is why when I go to college campuses, some of the most viral content that I have ever put out is me asking college students who pretend to be anti-racist, do they believe in black-only dormitories?
And one after the other, they will enthusiastically support black-only dormitories.
The people that tell us that they are fighting against racism want to reinstitute segregation in our country.
One after the other.
If you are so against racism, do you think that black-only dormitories are wrong?
And they'll say there's nothing wrong with that.
Blacks need their own space to be able to flourish and think.
That's awfully racist, actually.
I have so many video after video after video.
I mean, we are through this topic every way you could possibly approach it.
University of Alabama to CU Boulder, I've heard it all.
And my worldview remains the same.
I refuse to live in a country or participate in any sort of political project where I am supposed to make a value judgment on somebody based on how they look.
No sort of academic jargon or nonsense can make me think otherwise.
