Trump Indictment and NARA Docs

| We never even really talked about the affidavit last week. | |
| There really wasn't much there. | |
| There were a lot of redactions, but there was one part where a friend of the program, Kash Patel, was mentioned. | |
| Cash has been on this program many times, and we want to support Cash. | |
| And I think that the regime is very angry at Cash for a couple different reasons. | |
| We're going to talk about that. | |
| And I want to get his unfiltered thoughts here on the Charlie Kirk Show program. | |
| Cash, welcome back to the program. | |
| Hey, Charlie, thanks for having me. | |
| Congratulations on the birth of your daughter. | |
| And I hope in a year or two, when it's age-appropriate, you read her the plot against the king so she knows all about Russia gay. | |
| Oh, we will buy plenty of copies of the plot against the king. | |
| And thank you for that, Cash. | |
| We appreciate it. | |
| So, Cash, I'm still kind of processing a lot of this as far as the news that hit. | |
| Your name is in the affidavit. | |
| So, tell our audience, just so we have a recap, what is an affidavit and what is your reaction to your name being mentioned in this affidavit? | |
| Yeah, so look, you guys know I was a national security prosecutor at DOJ for Republican and Democratic administrations, mostly Democratic. | |
| And a search warrant is a search warrant, be it for a bank robbery, a murder, or in this case, going into a president's home. | |
| It needs probable cause. | |
| Probable cause is based on sworn testimony in writing by an FBI agent. | |
| That's an affidavit. | |
| They say in the affidavit under penalty of perjury that everything here is true. | |
| We have information that so-and-so is a bad person and we think they broke the law. | |
| We have probable cause, that's the standard, to tell a judge who has to authorize the invasion of the Fourth Amendment into someone's home to take things away from them because the FBI says we believe a crime's been committed. | |
| So, Peter Strzok, who struck Stroke Smirk, who should be in prison, said it's never great to see your unredacted name in a search warrant affidavit. | |
| To borrow from Eric Hirschman, quote, I'm going to give you your best free legal advice you're getting in your life. | |
| Get yourself a great effing criminal defense lawyer. | |
| You're going to need it. | |
| Cash, what's going on here? | |
| What's your reaction to all of this? | |
| You know, it's the continued weaponization, politicization of law enforcement. | |
| Look, I know, and these guys know. | |
| Remember, recap real quick. | |
| The same corrupt government gangsters at the DOJ that ran Russia Gate are now back in charge at DOJ. | |
| John Carlin, Lisa Monaco, these used to be my bosses at the Department of Justice when they authorized Russia Gate are now in charge. | |
| The same FBI agents that worked for Peter Strzok, who broke the law and lied to a federal court to illegally surveill a warrant, excuse me, illegally surveill a president, his mentees are now running the counterintelligence investigation. | |
| These guys collectively know that when you issue a search warrant, you hide the person's name that is not the target of the investigation for personally identifiable reasons. | |
| That's in the FBI manuals, DOJ manuals, and everything. | |
| And let me highlight one extreme. | |
| The DOJ fought to redact Osama bin Laden's name in a Washington Post article after 9-11, but they did not fight to redact my name, a career government official, because they wanted and needed the world to put me on blast. | |
| After the DOJ and FBI knew that I was being death threatened on a weekly basis, and the FBI was actually investigating ongoing death threats to me. | |
| They put me on blast in the single most infamous warrant in United States history. | |
| And you know the only other person's name that's not redacted there? | |
| Donald Trump. | |
| It's incredible. | |
| What is your general reaction on the affidavit, Cash? | |
| Before you said on this program, there's zero chance Donald Trump will be indicted. | |
| Do you still think that? | |
| Yeah. | |
| Look, my general reaction to the affidavit is these guys are going to do everything they possibly can to run the same campaign they did with Russia Gate. | |
| They're going to use the fake news media to put out a disinformation campaign. | |
| What they want to do is make Donald Trump not run or make him so unpopular through their media disinformation campaign that voters are turned off. | |
| What they've seen in the public is a complete boomerang effect by going in and raiding the home of a president who was cooperating with DOJ and FBI. | |
| And if for some reason they choose to go down another extreme, unprecedented path and actually charge him, they might as well be handing him the 2024 presidency. | |
| Because even if he's convicted of the crimes they are alleging, Donald Trump can still lawfully be president of the United States. | |
| So you say here the documents at Mar-a-Lago marked classified are already declassified. | |
| Then what is the dispute over this, Cash? | |
| Is it true that the commander in chief, the head of the executive branch, the president of the United States, has full authority to declassify anything that he wants to declassify? | |
| If that is true, then this entire issue is insane. | |
| Am I missing something? | |
| No, and that is the law, unless you are president, your name is President Donald Trump. | |
| As a former deputy director of national intelligence, I know the intelligence classification system and I know the bureaucratic process. | |
| And as the guy who had to put out the newness memo and jump through those hurdles to get it out, that applies to all government employees except the Office of the Presidency of the United States. | |
| Any president can declassify anything he wants. | |
| And what I've said in the past is I know Donald Trump declassified sweeping sets of documents related to Russia Gate, Hillarygate, and other national security matters that he felt were transparent. | |
| I have also said I can't say with certainty what was in Mar-a-Lago because I didn't know anything was down there until the world found out about it. | |
| And so what they're trying to do is now say Kash Patel is misleading the world by definitively saying everything at Mar-a-Lago is declassified. | |
| I've never said that, but I did say President Trump in front of me and others issued multiple declassification orders regarding whole sets of documents. | |
| And it's up to the DOJ and FBI to come in and say, well, those documents were classified, but we found other stuff. | |
| They're not saying that. | |
| And there's got to be a reason for it. | |
| Yeah. | |
| So, but he does have the ability to declassify anything on the way out. | |
| Is there a process of how that works? | |
| Why is this even in dispute? | |
| And looking back, do you think President Trump could have done something differently to avoid all of this? | |
| Or what's your thought on that, Cash? | |
| I mean, I think they would have found another line of effort to go and politicize the law enforcement and intelligence community to target Donald Trump. | |
| But yes, it's definitive. | |
| The president, any sitting president of the United States, is the sole arbiter of classification and can definitively, sweepingly declassify anything he wants. | |
| That's the way the Constitution and our Intel community works. | |
| And what should have happened afterwards is his White House counsel's office should have come in and said, okay, here's the paperwork that shows on this day Donald Trump declassified X, Y, and Z. | |
| But whether or not that's been done, I don't think it did because I haven't seen any paperwork to that effect. | |
| But bureaucrats cannot undermine a presidential decision. | |
| And Charlie, let me just give you an example. | |
| I was the head of counterterrorism for President Trump when we took out Baghdadi, and I was in the situation room with him. | |
| When the commander-in-chief authorized the raid strike force that killed him, we didn't wait for some rube to gin up paperwork before the order was executed. | |
| It was executed the second he said it because the commander-in-chief has that authority, just like he has that authority when it comes to classified documents. | |
| Yeah. | |
| And so then there's this idea of the Presidential Records Act. | |
| Does it have to run by some run through some other board or some other kind of national registration office? | |
| Is there some other bureaucratic loophole that is being missed here really quick here, Cash, 30 seconds? | |
| Yeah, no, I think what they're trying to do with NARA, and that's another reason my name's out there, because President Trump named me as representative to National Archives, is simply we've been trying to get the declassified documents out and bureaucrats at NARA referred the matter to DOJ, even though they gave Hillary Clinton a pass for the same thing. | |
| And now they are saying, oh, we don't know where anything is. | |
| It's all with DOJ. | |
| Open counterintelligence investigation as a result of the search warrant. | |
| So they don't ever have to turn anything over. | |
| That was their end result, just like it was during Russia Gate. | |
| And the FBI will hide behind that now. | |
| Cash, I don't know if I agree. | |
| I think they are going to try to indict Donald Trump, not based on facts or him doing anything wrong, just based on pure desperation of trying to stop the MAGA movement. | |
| Is there anything you think Donald Trump should do? | |
| Do you think he should announce for a second term now? | |
| What are your thoughts on that, Cash? | |
| I mean, look, you may be right. | |
| I'm not the political wizard here. | |
| I'm more of a national security law enforcement guy. | |
| It's, you know, I think it makes sense with the midterms coming up and so much going in our direction to secure the House and the Senate with great candidates, you know, like Blake Masters out there in Arizona and JD Vance and company. | |
| And so if we can take four of those five Senate seats that we had no business taking, then let's do it. | |
| And if that means Donald Trump has to wait a month before he announces, so be it. | |
| So I think it's, you know, maybe he waits till right after the midterms. | |
| But I think you're right. | |
| They're going to do anything they can to stop the MAGA movement. | |
| Yeah. | |
| And so, you know, if Republicans take back the House and the Senate, Cash, what can possibly be done to hold this fourth branch of government accountable, the unelected, unknown, unchecked branch? | |
| It just seems like there's so many different scandals, so many different things they're doing or not doing or intentionally not focusing on what is it, Cash, that they need to do going in January, more than just writing letters. | |
| I mean, I think it's time for a church and pike committee equivalent. | |
| What are your thoughts, Cash? | |
| You're not wrong. | |
| They need a committee, whether it's select or otherwise, to run a Russia Gate-style investigation that Devin and I ran, but they need to go 10 times harder. | |
| And here's why. | |
| You're right. | |
| Issuing letters is meaningless. | |
| Go get subpoenas, go get the documents, make sure the American public are shown the documents that expose the government corruption at the FBI and DOJ. | |
| And I've said this since the beginning. | |
| I think the reason the FBI went down there and raided Donald Trump's home was because they knew this political leadership that was in place that started Russia Gate knew that Devin and I only got out 60% of the Russia Gate documents during our investigation. | |
| That means 40% were left. | |
| Why do you think President Donald Trump declassified them? | |
| Because it showed their extreme levels of corruption and illegality against the sitting president of the United States and others. | |
| So they come in and sweep up under the counterintelligence investigation umbrella to prevent their disclosure. | |
| And this Congress is the only mechanism that can go in there and force the disclosure of the documents. | |
| And then they must call these people up to testify publicly, Chris Ray, Merrick Garland, John Carlin, all these people, and without time limits and without private jets waiting for them that are paid for by the government to answer hard questions as to why did you allow this investigation to occur when you knew the people and the personnel operating it had already broken the law during Russia Gate. | |
| And some of these individuals are supposedly under investigation at the FBI themselves. | |
| How is it possible that they can work on an investigation of this magnitude? | |
| Congress must act big time. | |
| Yeah, and it just the Presidential Records Act is supposed to protect the president. | |
| I mean, Cash, this is so unprecedented. | |
| It's so a far reach of power for obvious political purposes. | |
| I mean, from Obama to Hillary Clinton, they're going to go and try and indict the former president of the United States when Hillary Clinton was smashing cell phones with hammers. | |
| And then you have the smugness and the arrogance of people like Peter Struckstroke Smirk and Lisa Page that are then kind of taking a victory lap around all this and Andy McCabe. | |
| Cash, this is not just two standards of justice. | |
| There's only one standard of justice. | |
| The one standard of justice is that if you are on the political right, we are going to throw the federal government of the United States after you wholly and completely. | |
| I want to play this piece of tape here from Lindsey Graham. | |
| I'm not really sure what to make of it. | |
| There's a couple different takes here potentially of what this means. | |
| Play cut four. | |
| If there's a prosecution of Donald Trump for mishandling classified information after the Clinton debacle, which you presided over and did a hell of a good job, there'll be riots in the streets. | |
| Cash, one minute, your thoughts. | |
| I'm not, you know, hopefully that's not the way it goes. | |
| But, you know, I think what he's alluding to is that, you know, we could have this summer of riots, quote unquote, again, and they'll all be blamed on Donald Trump. | |
| And that'll be a political victory for the left because it will drive people away from the voting booths for any MAGA first candidates and also President Trump himself. | |
| But what we need to focus on is the people that are running their mouths on TV now, baselessly. | |
| Andy McCabe, who was deputy director of the FBI, and lied and broke his oath of office and the law. | |
| Peter Strzok and the Lovebirds lied and broke their oath of office and illegally surveilled a candidate for president. | |
| The mainstream media is equally as culpable, if not more, than these dirty government gangsters for executing this unlawful raid on President Trump. | |
| And they are scaring people into submission. | |
| But I will not be taking a knee on the truth because that, at the end of the day, is the only thing that matters in terms of service. | |

| Those are the endowments of some of the universities across America. | |
| Harvard, $41 billion endowment. | |
| Yale, $31 billion endowment. | |
| Stanford, $28 billion endowment. | |
| Princeton, $25 billion endowment. | |
| MIT, $18 billion endowment. | |
| University of Pennsylvania, $14 billion endowment. | |
| These are not colleges. | |
| These are hedge funds with classrooms attached. | |

| Joe Biden decreed by executive action, he doesn't have the constitutional authority to do this. | |
| He just is doing this unilaterally and totally straightforward, that he has the power to be able to forgive student loans. | |
| That some estimates show that it could cost upwards of half a trillion dollars, $500 billion, half a trillion dollars. | |
| So Joe Biden comes in, of course, to try to use one of the F's to try to control power, but both are happening simultaneously: fear and free stuff. | |
| People that are unpopular, people that do not have support of the governed, that are unwilling to try to build consensus, they will use either fear or free stuff to hold on to power. | |
| Fear against towards conservatives. | |
| You might get raided. | |
| You might get audited by the 87,000 new IRS agents, the 87,000 new IRS agents that are going to have a centralized office that could be deployed against conservatives and middle-class Americans all across America. | |
| And then free stuff. | |
| Of course, this is a vote-buying scheme for young people going into the midterms. | |
| But it also is two other things that I want to focus on. | |
| The first of which, this is a throbbing middle finger, an insult to the muscular class in our country. | |
| For those of you that are plumbers, electricians, and welders that didn't go to a four-year college, this is a direct and concerted, just unbelievably flagrant insult towards you. | |
| As if your muscular labor does not matter. | |
| How about those of you, that's the first part, that are entrepreneurs that started businesses and didn't go to a four-year college. | |
| Where is your debt forgiveness? | |
| Do you get some of your credit card debt forgiven? | |
| How about those of you that started your business? | |
| Do you get your small business loan forgiven? | |
| How about those of you that had to go into debt to feed your family or to get necessary supplies so your kids can go back to school? | |
| But maybe you didn't go to a four-year college. | |
| Do you get that debt forgiven? | |
| That's the first thing. | |
| It is an insult to people that didn't go to white, woke, liberal universities like Wellesley or UC Berkeley. | |
| That's number one. | |
| It is a subsidy of the idea pathogens that have infected our entire society, as I talk about in the college scam, of which I put the entire college industry on trial. | |
| It's a very appropriate book right now, considering this free stuff vote buying scheme being put forward by the Biden regime. | |
| And the 10-count indictment are: number one, college universities are running a scam. | |
| College education is ridiculously overpriced. | |
| Universities have become obscenely rich at taxpayer and student expense. | |
| That's the part that no one, not say no one, but the mainstream, no one in the mainstream media has been talking about. | |
| No one in the mainstream activist press has been talking about how unbelievably corrupt these colleges are. | |
| This is a subsidy of the institution that is broken from within. | |
| If you're going to forgive student loans of reckless financial behavior, you're only going to get more reckless financial behavior. | |
| Colleges do not educate anymore. | |
| College has ruined the ability to think and reason. | |
| College indoctrinates students and repress speech. | |
| All this, of course, is with the exception of Hillsdale College. | |
| College universities breed violence and hatred. | |
| College universities have been infiltrated by subversive foreign groups. | |
| College universities have unleashed waves of woke anti-American activists. | |
| Many professors are left-wing radicals bent on indoctrinating students. | |

| So the first of which is an insult to every single one of you in the audience that have built a life without an expensive four-year diploma. | |
| But it's also an insult to the second group of people. | |
| For those of you that have built a life and responsibly went through college and took AP classes in high school, that got scholarships, that went to the less expensive college. | |
| How many of you out there decided to go to a cheaper college because you were afraid of the student loan debt? | |
| How about those of you that have been paying off your student loans the last couple of years? | |
| Sucker is what Joe Biden says. | |
| If any of you in the last 10 years have been paying off your student loans, why? | |
| That's wasted money. | |
| Do you get that money back? | |
| This is a question you should ask Joe Biden. | |
| Do you get a refund of the money you paid now that you know that forgiveness is here? | |
| Do you get a rebate? | |
| Because you were paying down student loans for what reason? | |
| It is an insult to those people who live within or below their means. | |
| It is a subsidy of reckless, irresponsible financial behavior. | |
| It is the government that is now saying, hey, look, we don't balance our books. | |
| We run $30 trillion debts. | |
| We run massive deficits. | |
| We run these overly inflated and bloated, reckless balance sheets. | |
| We might as well subsidize those of you that do the same. | |
| We might as well give you a massive handout for those of you that are also in massive debt. | |
| And if you were to even argue for a little student loan forgiveness, if you say college is a scam, which I agree, and students have been scammed, I think there is one form of student loan forgiveness that I would support. | |
| Seize the endowments and make the colleges pay for it themselves. | |
| In the current state of affairs, what we have is students that get scammed by college, and the taxpayer has to now bail them out. | |
| No, make Harvard pay for it. | |
| They have a $41 billion endowment. | |
| I think it's upwards of $50 billion now. | |
| How about Yale? | |
| $31 billion. | |
| Stanford, $28 billion. | |
| Princeton, $25 billion. | |
| MIT, $18 billion. | |
| These are GDPs of governments that they have. | |
| And the taxpayers have to come in and say, no, no, no, it's now us that have to pay for it. | |
| We're the ones that now have to get put on the hook. | |

| 40% of folks who have student loans do not have a college diploma. | |

| Most of the relief that the president has given, remember, the majority of people are going to get $20,000 in student loan debt relief. | |
| 40% of the folks who have student loans do not have a college diploma, a four-year diploma. | |
| These are people who are truck drivers and who are nail technicians and nurses' aides. | |
| They are actually going to get their debt canceled out. | |
| They're going to get their debt canceled out. | |
| Wait, hold on a second. | |
| So she said 40% of the people who have student loans do not have a college diploma. | |
| Hey, Pocahontas, why did they go to college in the first place? | |
| Why don't you say maybe the industry itself is broken? | |
| By the way, Elizabeth Warren is proving the entire argument behind my book. | |
| 40% of people that have student loans, they dropped out. | |
| They shouldn't have gone in the first place. | |
| Maybe the colleges are predatory, massive, hedge fund-style private equity institutions. | |
| Maybe they should dip into their pockets and pay for it. | |
| I want to play cut 21, Nancy Pelosi. | |
| People think the president of the United States has the power for debt forgiveness. | |
| He does not. | |
| Remember, this was last July saying, no, it has to go through Congress. | |
| Joe Biden is just doing this unilaterally. | |
| Now, to give some of you comfort, I think this will be struck down in a court. | |
| There is almost no way he's able to do this. | |
| Also, there's this incredible contradiction here. | |
| Why can Joe Biden use COVID as a reason to forgive student loans? | |
| But he also says that the COVID emergency is over to get rid of MPP and the Remain in Mexico policy, which is it, Joe Biden. | |
| Is COVID still an emergency? | |
| So you want COVID to be able to buy yourself votes because you're so incoherent and incompetent and you're nakedly corrupt, holding on to power like the last grasp of a despotic Roman emperor, morally parallel to Caligula, trying to do your best to not govern constitutionally, but using the multi-thousand-year-old tactic of I'm just going to buy people off. | |

| People think that the President of the United States has the power for debt forgiveness. | |

| He can delay, but he does not have that power. | |

| Joe Biden knows that he is in a significant vote deficit. | |
| The only thing he can do now is to try and go to younger voters, of which he is losing considerably. | |

| The share of young people ages 18 to 34 who identify as liberal has dropped more than any other age group by 10 points over the last five years. | |

| Back in 2020, Liz Warren, Pocahontas, was asked if people who save for college are going to get their money back. | |
| And she laughs and says no. | |
| Again, a government that subsidizes bad behavior gets more bad behavior. | |
| And forget it. | |
| Just don't forget. | |
| But put aside the welders, electricians, the plumbers, the HVAC, the entrepreneurs, the police officers, the firefighters. | |
| Put all that aside. | |
| So many of you in the audience might have received an athletic scholarship. | |
| You know, being a student athlete is no easy deal. | |
| When you talk to a majority of student athletes that I've spoken to, and they say, man, it's a tough life. | |
| I say, well, why do you keep doing it? | |
| They said, well, I get my college paid for. | |
| For the millions of student athletes, I think that's fair to say. | |
| There have probably been millions of student athletes since 1960, 1970. | |
| Let's just say half a million. | |
| Let's say there's a half a million student athletes since 1980 that got their college paid for. | |
| Do you get a rebate for those 5 a.m. workouts? | |
| For watching your diet, having to make the team. | |
| So also you could just get your college paid for? | |
| Do you get some sort of handout for that? | |
| That's work being a student athlete. | |
| And a vast majority of student athletes put themselves through hell so they don't have to have debt. | |
| What do you say to the kid that had to show up for 4.30 swim meets, swim practice? | |
| And he just kept telling himself, at least I don't have student loan debt. | |
| I'm not going to be the best swimmer in the world. | |
| At least I don't have student loan debt. | |
| The government says, I don't care if you sacrificed. | |
| I don't care if you made good decisions. | |
| We are now going to insult you and take money from the responsible and give money to the irresponsible. | |
| If you were to do this, make the colleges themselves pay for it for the scam that they are. | |
| U.S. taxpayer on the hook again. | |
| It is one of the most grotesque, insulting, unconstitutional moves I've seen in quite some time. | |
| We need a moral outrage against this vote-buying scheme, subsidizing the scam. | |
| and a poke in the eye to the responsible, the virtuous, and the hardworking muscular class. | |
