Here's a question that I want to begin with today.
President Ignoring Supreme Court Rulings 00:10:36
What branch of government is supreme and has the most potential power, but only if we honor it?
What branch of government has power, but only if people respect that power?
Meaning, they don't have the ability to enforce it.
In 1832, there was a famous Supreme Court decision.
It was Wooster versus Georgia, a landmark case in which the United States Supreme Court vacated the conviction of Samuel Wooster and held that the Georgia criminal statute that prohibited non-Native Americans from being present on Native American lands without a license from the state was unconstitutional.
Now, the president at the time was Andrew Jackson.
Andrew Jackson completely and fundamentally disagreed at this decision.
Andrew Jackson famously then said something that is very provocative and exposed a vulnerability in the American constitutional system.
You see, on this program, we talk about the positives and the benefits of the American constitutional system.
There is one vulnerability, and it only gets exposed if a president decides to be flippant and almost tyrannical.
Andrew Jackson looked at this decision, and he famously said, well, let Marshall send his army.
So John Marshall was the Supreme Court justice, the Chief Justice of the Supreme Court of the United States.
And what he meant by that is, make Marshall enforce this.
So what if the Supreme Court rules?
What's their enforcement capability?
What is their ability to actually make the law that they issue, the guidance they issue, enforceable?
You see, Article 1 and Article 2, the legislative and the executive branch, they have enforcement abilities.
They have checks and balances, impeachment proceedings, for example, appointments, executive control.
Each branch can check each other.
Yet the Supreme Court is only as good as the full faith and trust and confidence that we have in the U.S. Supreme Court.
The Supreme Court is only the Supreme Court if we decide to honor what it says.
If the Supreme Court were to rule, for example, on Brown versus the Board of Education, if the Supreme Court ruled on Roe versus Wade or the Supreme Court ruled on any significant court decision, and half the country said, we're not going to honor that, we're deciding we don't like that decision, the constitutional republic we enjoy will start to fall apart.
Now, on the federal level, federal agents are supposed to follow guidance from the Supreme Court.
Judges are supposed to follow guidance from the U.S. Supreme Court.
And that tradition has generally been followed.
But what happens when a president like Andrew Jackson turns to John Marshall and says, send your army, enforce it.
Come on, what's the big deal?
It's not like you're the president.
You're just the suggestion court, not the Supreme Court.
Well, in the last 24 hours, Joe Biden has pulled an Andrew Jackson.
Joe Biden has turned to John Roberts and said, John Roberts, send your army.
What are you going to do?
The U.S. Supreme Court ruled that the guidance on evictions, such as the evictions from people that are not paying their rent, can expire on July 31st, and it's going to require legislative and congressional action to renew or extend that moratorium on evictions.
So what happened is Congress decided to go on a break.
Congress just went home, which left this big opening.
Left an opening where the U.S. Supreme Court, Article 3, said, hey, this thing's going to expire, and you need to do your job.
Article 1 went home and didn't do their job.
That's the legislative branch.
So then Article 2, Joe Biden, decided to do something that is an impeachable offense.
Let me say that again.
It is an impeachable offense.
In fact, what Joe Biden did and is doing right now is constitutionally worse than anything they ever accused Donald Trump of.
And almost no one in the media is covering this.
So Joe Biden saw that the Supreme Court had a certain ruling about evictions and moratoriums.
The correct branch to solve this, the legislative branch, went home.
And what did Joe Biden do?
Joe Biden announced yesterday, I'm sorry, on Tuesday afternoon, that the Center for Disease Control issued a new order imposing a moratorium on certain evictions.
The CDC's new order is substantially similar to previous eviction moratoriums that expired at the end of July, but with one exception.
So what does that mean?
This means that Joe Biden can issue an executive order confiscating all your weapons and he doesn't care what the Supreme Court has to say about it.
What's this?
Let Roberts send his army.
Make Kavanaugh enforce, make Amy Coney Barrett enforce it.
What Joe Biden has just done and his administration is they have just said that we do not have three equal branches of government.
And they say, well, it's a crisis.
It's public health.
There's people that need help from eviction moratoriums.
That's not the way this works.
Congress, go do your job.
Go fix it.
They're not.
It's not a priority to Congress.
And it's outside of the constitutional authority and purview of the executive branch of the United States.
I cannot emphasize enough how unprecedented this is.
To have a president ignore what the U.S. Supreme Court has said and do it anyway.
So what's the Supreme Court going to do?
They're going to issue another ruling.
Joe Biden will just ignore it.
The Supreme Court will say, don't do that.
And Joe Biden will say, what's your enforcement capacity?
You don't have handcuffs.
You write papers.
Joe Biden will basically look at Article 3 and say, that's funny.
The Supreme Court is just a bunch of suggestions.
Donald Trump never did anything close to this.
When the Supreme Court spoke, Donald Trump always followed their guidance.
When circuit court judges spoke, Donald Trump followed those guidance.
Remember the travel ban?
Remember the emergency use of funds for the wall?
Joe Biden, in broad daylight, with the cover of the media, in a very technical and albeit wonky and kind of under the radar way, has just done the most blatant, unconstitutional measure via executive order of a president.
I would say sense FDR, because FDR did some really wacky and tyrannical things, and that's probably right.
Definitely Woodrow Wilson or FDR.
This is impeachable.
And yet Republicans are talking about negotiating infrastructure.
Republicans are like, yeah, let's go negotiate infrastructure with the Democrats.
While Joe Biden is ignoring and defying the U.S. Supreme Court, the kind of attitude that Andrew Jackson had towards the Supreme Court never materialized.
But guess where that attitude did end up manifesting?
Ended up manifesting in the Civil War.
It ended up manifesting in a schism of the country.
If you don't believe that the people who interpret the laws have ultimate and supreme authority, if they're nothing more than just kind of like the New York Times editorial board, oh, that's nice.
That's a nice opinion.
They're nothing more than just a bunch of talk show hosts on CNN where they have that big 95-person panel and they're all saying the same thing.
If you think the Supreme Court is just a bunch of talking heads and not the people that issue the guidance on the laws, the country is broken.
This beautiful document, the Constitution, becomes nothing more than a bunch of suggestions and we're in chaos.
I cannot emphasize enough what Joe Biden is doing here is unprecedented and it's very disturbing.
And where are the Republicans?
Oh, they're negotiating infrastructure with Joe Biden.

Marbury Versus Madison Explained 00:03:25
Article 3 of the Constitution is an article built on trust.
It reads, as I read from my turning point, USA Constitution.
The judicial power of the United States shall be vested in one Supreme Court.
Now, let me stop.
Just so you know, that it does not say in the Constitution you have to have circuit courts or any of that.
It does say they can create them, but only the Constitution created the Supreme Court.
It's interesting.
And such inferior courts as Congress may from time to time ordain and establish the judges, both of the Supreme and Inferior Courts, shall hold their offices during good behavior and shall at stated times receive for their services compensation, which shall not be diminished from their continuation in office.
Section two: the judicial power shall extend to all cases in law and equity arising in this Constitution, the laws of the United States and treaties made or which shall be made under their authority to all cases affecting ambassadors and other public ministers.
Continues by saying that the Supreme Court of the United States is the final decider.
It is the final arbiter.
Now, that wasn't always certain.
In fact, disputes amongst branches of government is to be expected.
In fact, judicial review was established in a very specific case called Marbury versus Madison.
And in Marbury versus Madison, it was a disagreement over a specific selection to a cabinet, I believe, in the Madison administration, which is why it got that name.
Now, actually, it was the predecessor, actually, if I'm not mistaken.
So it was Washington, Adams, Jefferson, Madison, Monroe.
So it was Jefferson who appointed this person, right?
And therefore, Madison wanted to remove him.
There was some tension over that.
But what happened is that this went up to the U.S. Supreme Court, where I believe John Jay was still the Supreme Court justice at the time.
Actually, Marshall might have been there at the time.
I don't know.
Jay was first, and then Marshall came.
And this idea of judicial review was established, which meant that the Supreme Court speaks.
It is final.
Marshall was chief.
Okay.
So John Jay was first and then John Marshall.
Marbury remains the single most important decision in American constitutional law.
And it basically said, once we rule, the conversation is over.
Now, mind you, sometimes the Supreme Court can rule incorrectly, like the Dred Scott decision.
That was an awful decision.
But one of the reasons why our country has remained intact is because our leaders, whether they agree or disagree, they back down once the Supreme Court speaks.
Biden even admitted this in Cut 86.
He said, look, I've sought constitutional scholars to depend to find the best outcome.
But honestly, it's not going to pass constitutional muster.
So Joe Biden admits this is not constitutional.

But I'm going to do it anyway.

I've sought out constitutional scholars to determine what is the best possibility that would come from executive action or the CDC's judgment.
What could they do that was most likely to pass muster constitutionally?
The bulk of the constitutional scholarship says that it's not likely to pass constitutional muster.
Number one.
But there are several key scholars who think that it may, and it's worth the effort.
It won't pass constitutional muster.

This is a president who really understands the heartbreak of eviction.
The reason why he is pressing and pressing, even when legal authority looks slim, is because he wants to make sure we have explored every potential authority.
And they're just going to ignore it.
What are Republicans going to do?
Give a strongly worded speech on the Senate floor and then go agree to a big bipartisan infrastructure bill that bankrupts our country.
It's not like Republicans control the FBI or the CIA.
This is how criminals act.
We run the government.
You don't.
Supreme Court, whatever.
You're like the New York Times op bedboard.
We do what we want.
There's no doubt in my mind that Americans trust in the media is at an all-time low.
I mean, when you turn on so-called respected news channels, all you get is propaganda, shameless virtue signaling, and blatant disregard for the truth.

Well, this eviction moratorium, basically ignoring the entire U.S. Supreme Court and its decision, basically nationalizes rental properties as we know it in our country.

Why don't Republican governors start defying Supreme Court decisions?
You know what we should do?
Just go start building the Keystone XL pipeline.
The governor of North Dakota should just mobilize the North Dakota National Guard and say, hey, federal government, you got to intervene.
We're going to build these pipelines whether you like it or not.
What does the federal government have to say?
It's not like we're a nation of laws anymore.
We're a nation of political will.
We're not a nation of strict interpretation of the Constitution.
Now, that's what Republicans would do if they actually were serious about saving the country.
Instead, they're too busy instituting mask mandates, mandatory vaccination measures, having your six-year-old wear a mask when they go to school, keeping the southern border wide open, and oh, yes, that's right, negotiating multi-trillion dollar infrastructure with Chuck Schumer and Joe Biden so we can have more electrical vehicles across our country.
Now, it's not all negative.
There is one Republican that is fighting really hard that deserves our credit, deserves credit and our support, and we are going to give it to him in just a little bit.
But I want to play this.
Tucker, in a couple segments here, just he's the man.
That's all I have to say.
The way he words this is poetry.

Walensky announced today that she has decided to nationalize America's rental properties.
Tenants are no longer required to pay their rent.
Property owners cannot evict them under any circumstances.
Making someone pay to live on your property is now a federal crime.
At the same time, you should know, property owners will still be required to pay the banks that hold their mortgages.
There is no moratorium on mortgages.
Cut 82, he continues, Joe Biden appointed Rochelle Walensky to run the CDC in Atlanta.
It doesn't seem like a big deal, but now the CDC is a legislative body of the United States.
Because everyone bows to the altar of public health.
And let me just say this.
I don't like the I told you so thing.
I don't like that.
But on this program here, in April of last year, we were warning you that if we do not get a check on the fourth branch of government under the guise of public health, stuff like this is going to happen.
And some conservatives said, Charlie, that's a slippery slope argument.
Some people in the media said, oh, power will never be abused.
You could trust us.
Well, now we have a new Congress.
The Congress is headquartered in Atlanta, and they do whatever they want because they say people are going to die, so then they can make laws.

Joe Biden appointed Walensky to run the Centers for Disease Control and Prevention in Atlanta.
At the time, it did not seem like a huge deal.
The CDC is not a legislative body.
It's a public health bureau.
The CDC does not make laws in this country.
It's not allowed to.
Under the U.S. Constitution, making laws is the exclusive role of the Congress.
You vote for your senators and your congressmen, and they decide what the rules are.
That's known as representative democracy.
It's been our system for nearly 250 years.
But apparently, it's now over.
He's not exaggerating.
It's over.
Basically, the government of the United States does as they wish, and the promise of separation of powers and consent of the governed and checks and balances has now been put in permanent jeopardy.
Cut 84, Tucker says, if you're wondering how all of this can be legal, well, it's not even close to being legal.

If you're wondering how all of this can possibly be legal, rest assured that it's not legal.
It's not even arguably legal.
We know that for a fact.
The Supreme Court has just ruled on this specific question.
The court found that the CDC does not have the right to institute a nationwide eviction moratorium.
Period.
Only Congress can do that.
Now, the court didn't make us guess on their view of this.
The court put this in writing in the clearest possible language.
There's no debate about that.
The Biden administration just ignored what the court said.
Just ignoring what the court says.
I want to get to Ron DeSantis.
I think we can get that tape because he's actually one of the few Republicans, quite honestly, that's fighting and he's challenging Joe Biden.
Joe Biden just says Article 3 of the U.S. Constitution doesn't matter.
Where's these Republican governors that talk such a good game?
Not just in North Dakota, but how about Republican governors in the American Southwest, in Arizona?
You have Joe Biden just saying the Constitution doesn't matter, and we're going to issue press releases.
Ooh, please don't do that.
Please reconsider.
Consent of the governed, separation of powers, and checks and balances.
These are unique characteristics and attributes of the American system.

Joe Biden has done the most flagrant, flippant, and brazen move against the U.S. Constitution that we have seen, probably in modern American history since Franklin Delano Roosevelt.
Ron DeSantis is one of the few Republicans that deserves to be praised, defended.
If your Republican elected official is not fighting like Ron DeSantis, you need a new Republican elected official.
For example, Ron DeSantis is basically holding the line against Joe Biden saying, I am going to defy you.

Ron DeSantis said we will not be doing lockdowns again.
We will not ever lock our children down.

But in terms of shutting down, we're not shutting down.
We're going to have schools open.
We're protecting every Floridian's job in this state.
We're protecting people's small businesses.
These interventions have failed time and time again throughout this pandemic, not just in the United States, but abroad.
They have not stopped the spread.
And particularly with Delta, which is even more transmissible, if it didn't stop it before, it definitely ain't going to stop it now.
And then Cut 72, Ron DeSantis says, I leave it to parents if they want their children to wear masks.
People like Joe Biden think the government should force kindergartners to wear masks.
You know what the positive of Ron DeSantis is?
It shows that there's some people with courage.
You know what the negative is?
It shows how awful and weak the Republican Party is.
Why don't we have coalitions of governors standing up to this together?

How about Mike DeWine?
Oh, I know.
Mike Dewine is too busy trying to have four-year-olds wear masks.
Unbelievable.

In Florida, though, we think it's really important that parents make decisions about whether kids go to school with masks or not.
So if certain parents feel that they want their kids doing that, we're not going to prevent that.
We have a lot of parents, including me, who doesn't think that's healthy for our kids to be wearing masks all day.
And I know people like Joe Biden think the government should force kindergartners to sit there under these masks for six, seven, eight hours a day.
It should be the parents' decision, and it shouldn't be mandated by the government.
Many Republicans, except Ron DeSantis, are living in a 1980s America where we were a nation of laws.
We are now a nation of courage and political will.
Ron DeSantis is going to keep his state open regardless of the threats that Joe Biden throws at him.
Ron DeSantis, who's up against a tough election, by the way, with Charlie Crist, is saying, I am not going to pander to the CDC and this new government agency that thinks they're a legislative body in our country.
Ron DeSantis went off on Joe Biden, cut 99 play tape.
Why don't you do your job?
Why don't you get this border secure?
And until you do that, I don't want to hear a blip about COVID from you.

That's what leaders do.

And I want to thank him for that.
He was wonderful.
He was very, very busy.
Obviously running a major state and dealing with all this nonsense.
The news today, with Joe Biden issuing this eviction moratorium in defiance to the U.S. Supreme Court, just creating their own laws, is the beginning of the end of the Constitutional Republic.
This will get to the point where what happens if Joe Biden says, you know, the CDC says that gun violence is a public health issue.
What if they sign a executive order in defiance to the U.S. Supreme Court that says gun ownership is illegal?
Under public health?
That's the precedent we're taking.
We don't care what Article 3 says.
Yeah, okay, Amy Coney Barrett.
Okay, John Roberts.
It's not like you control the intel agencies.
We're in charge.

Why wouldn't Joe Biden just be able to sign an executive order saying, you know what, no new guns because of public health?

Joe Biden is putting the U.S. Constitution through a shredder.
Just doesn't apply anymore.
A new lawsuit has been filed trying to challenge the CDC again on the decision, even though the Supreme Court has already ruled on this.
And remember, these people take an oath to the U.S. Constitution.
They are violating their oath.

And what are Republicans doing?
Well, you're going to get a multi-trillion dollar infrastructure bill that will be a handout to Joe Biden and the Democrat Party.
What's going to stop these people?
That's a legitimate question.
The courts are no longer an option.
We can sue and get decisions.
You know what Joe Biden's basically saying?
Okay, Donald Trump.
So, what if you got three Supreme Court justices?
Who cares if you got 200 circuit court judges?
I don't care.
I'm going to do what I want.
Let him send his army.
And of course, when they continue to push it this way and go this way, Republicans are not really sure what to do.
So, how about this?
If I'm not mistaken, this Keystone XL pipeline goes through nothing but Republican states.
Am I right?
You can double check.
I think it goes through nothing but Republican states.
Why don't those Republican governors go find a backbone and a spine, mobilize the National Guard and say, we're building the Keystone Pipeline?
Screw you, federal government.
We're going to nullify this.
That's what you're doing with these eviction moratorium.
How about any state-based agency that's working with a federal agency right now in any red state suspends doing so?
We're not going to allow federal agents in our state.
Get out.
That's what Joe Biden's doing.
Joe Biden's saying that the laws of the nation do not apply.
Joe Biden saying we could just make up our own stuff as we go.
He admitted in a press conference that this is not constitutional.
He admitted the Supreme Court spoke against him, and he does it anyway.
Well, it's because it's necessity, because I have a heart for the people.
Yeah, of course.
Good intentions lead to direct, to tyrannical decisions far too often.
Now, some people don't like talking about this, like, oh, it's too dramatic to try to push back against it.
If you then become a nation where it's just a matter of who's willing to use political power, then the promise of the Constitution is null and void.
The promise of the Constitution that binds us together goes away.
So, yes, the Keystone XL pipeline, I'm just using this as one example, just to be clear, okay?
One example of 100 that could happen.
It goes to Montana, South Dakota through North Dakota, Nebraska, Kansas, Oklahoma, Texas.
So, why do you need the federal government?
They say, oh, well, you need federal permits.
No, hold on a second.
Who cares?
We're not a nation of laws anymore.
I thought it's about jobs and necessity.
I thought we're allowed to do whatever we want to do now if people are suffering.
Well, guess what?
Joe Biden signed an executive order saying that people are suffering because they can't get, they're not paying their rent.
We're going to nationalize rent.
Okay.
Well, we want energy independence.
We want people's jobs.
Governors are going to come together.
Forget the courts.
That's where we are.
Now, some people might say, well, Charlie, we can't forsake the process just because Joe Biden is.
He's ignoring the process.
You think these people are going to stop?
You think that Joe Biden is going to read a strongly worded opinion from the Supreme Court and then back down?
No, he doesn't care because they know there's no recourse.
They also know the media will cover for him.
They know that the people in charge in the Apparatchik media class, the communication class will say, oh, well, it's under desperate times and desperate measures.
A constitutional republic only works if the stakeholders believe in that form of a system.
It ceases to exist and ceases to thrive when leaders, people we put in power, actually think that the Constitution has any sort of weight, has any sort of bearing.
Instead, it's, I'm going to get what I want because there's 3 million voters that aren't paying their rent.
And so what if the courts have to say that?
You remove impartiality.
You remove the idea of wise rulings with the law.
You enter the third world.
You know, we use that word dictator and tyrant quite often.
And what that means, going back to the original Greek words, meaning making decision without another one looking over, unchecked authority.
America has survived this long because we all believed in this system.
It's about time for Republicans to start to stand up against the people that wish to break it and shred it.
