We've got breaking news.
We're going to go right to the Viceroy, Mike Davis, who joins us by phone.
Mike, update on the NDAA and the AI amnesty, sir.

Well, it looks like the War Room posse has delivered once again, teaming up with the Article III project, because the AI oligarchs look like they are in retreat on AI amnesty and the must-pass Defense Authorization Act, the NDAA.
And this is the credit goes to the War Room Posse for lighting up both of their home state senators and their U.S. House rep at Article 3 projects action page.
This was on a glide path to pass again, like it was four months ago when Ted Cruz tried to put this in must-pass legislation.
And in about five hours, the war room posse changed the politics and it went down 99 to one four months ago, including Ted Cruz voting against his own legislation.
They thought they were going to run the same play again this time and the NDAA must-pass national defense authorization bill.
And the war room posse got them to got the House proponents basically waving the white flag of surrender.
You start to see those news reports coming out saying, this is important, Steve.
We've gone on your show.
We finally have their attention.
We've had crucial meetings with the administration on this where they understand if we're going to pass this federal preemption for AI, if we're going to let the federal government block the states and local communities from regulating AI so they can compete against China as they claim, we're going to do it the American way.
We're going to protect the four C's.
We're going to protect children from predators.
We're going to protect communities from AI data centers going in residential neighborhoods, for example, or water and electric rates getting jacked up to subsidize these AI platforms.
We're going to protect conservatives from online censorship, from being canceled by these AI oligarchs like Google and Meta.
And we're going to protect creators.
We're going to make sure that our content creators, our conservative media outlets like Steve Bannon's War Room, don't get ripped off to feed these AI machines.
We're going to do this the America way, not the Chinese way.
We can beat China the old-fashioned way.
We've done it for decades and we're going to continue to do it.
This is a huge win for the War Room posse and it's a huge win to the American people.

Mike, are they finally, is it too cumbersome to go through regular order to actually have committee meetings and have testimony and to kind of do things when you have massive, when you have a bill or when you have, excuse me, something like this would have an impact across American society.
Normally, you have hearings, you've got people pro and con, you've got witnesses for and against.
It goes through, you have committee markups.
I mean, it's a cumbersome process, but it's a process of how we've kind of governed this country with a balance of power.
They've tried twice to slip a couple of pages in, and it just shows you they don't understand the American people.
They have no understanding of the process we have here in this country.
But it's also an arrogance that they can just get their lobbyists and just power through here.
Do you think now they understand after trying this twice on the only two bills that had to be, you know, the big beautiful bill and the NDA, the authorization for the entire Defense Department, trying the same trick twice that now, particularly Scalise and people that are not normally on our side are coming on and saying, you know, this is not the right vehicle to do it.
Do you think we finally gotten people's attention that if you're going to do something this profound, it's got to be inclusive, at least in the debate of people pro this, against it, and in the middle?

Yeah, I mean, absolutely.
And I have been working at the Article III project with a coalition.
And we have drafted a 100-page plus piece of legislation that provides the federal preemption that these AI companies think they need so they don't get beat up by California and other blue states, but it does it in a way where it protects the four seats, children, conservatives, communities, content creators, right?
We want to make sure we're doing this the American way.
We're going to get this to the Trump White House this evening.
And you're exactly right, Steve.
This is a big piece of legislation.
This needs to go through the regular order.
It needs to go through the committee process.
It needs to go through amendments.
We need to have debate.
We need to get 60 votes in the Senate.
Look, if everyone agrees that the legislation, the proposed legislation the Article III project is drafting is good and you can get 60 votes in the Senate and a majority in the House and the President sign off on it, great.
But it's probably not going to work that way.
It's going to require debates.
It's going to require amendments.
It's going to require votes.
And, you know, that's the American way.
And that's how you're going to get the best legislation possible.
And no one's going to be ecstatic when the legislative process is over.
People are going to have some wins.
People are going to have some losses.
But that's how our process works.
That's how our legislative process works under Article 1 of the Constitution.

Now, I just want to make sure people are not resting on their shovels here and their axes.
Should they still go to Article 3 and still lay a call in or a text message or an email to their senator and their congressman just to reinforce that, hey, here's what I'm hearing, but I want to make sure that you're 100% against and that we kind of restart this process?
What do you recommend right now?
Because I don't trust these tech bolegarks at all.

No question, Stephen.
That's exactly right.
We should run through the tape on this one.
So people should go to article3project.org, article number3project.org, take action to go after the AI amnesty and the NDA.
It can't go in there.
We cannot have AI amnesty.
If they want federal preemption, if they don't want the states and local communities to be able to regulate AI companies, then we need to have federal rules of the road.
And that includes the four C's that the Article 3 project just is proposing in our 100-plus page legislation.
It is crucial.
But look, they tried to sneak it in.
As you said, Steven, the big beautiful bill, they tried to sneak it in the NDAA, but we've been on their game for months on that.
That's why this is dead on it.
It appears to be on life support right now.
They're going to find any opportunity they can to sneak this through instead of having debates.
And so it's crucially important that people light up both of their home state senators and their U.S. House rep and make them understand we're not doing AI amnesty.
We're not going to repeat the mistakes we made almost 20 years ago with Section 230 amnesty, an antitrust amnesty that created Google, Amazon, Facebook, and Apple, these trillion-dollar big tech oligarchs that crush competition, cancel conservatives, and shutter small businesses.
We can't do that again.
This AI amnesty would be Section 230 on steroids, and we're not going to make the mistakes from Section 230.

The head of the House Armed Services Committee, Mike Rogers, as Mike Rogers said today, was not, had lost momentum, wasn't going to be in the bill.
He's going to put language out on Thursday on the NDAA.
It's not going to include the AI amnesty.
Scalise just reconfirmed that.
And Scalise, you know, in a moment of, you know, enlightenment says, hey, maybe this wasn't the best venue to put it through.
You damn right it wouldn't.
And no offense, this is, I think, why it's, you know, and we're going to go to Tennessee.
We're going to go to Michael Patrick Leahy in a moment.
And I think, and what Leahy's saying is we're hearing that, I think turnout's great.
We've got to run through the tape there.
You still got a couple more hours in Tennessee.
But the reason that people are angry is the people in the House and the Senate fully understood what they were doing here.
They were trying to slide something in, like they changed the Electoral Count Act of 1887, unconstitutionally, I might add, to try to fool people.

We're going to get down and get the receipts and we're going to find out, understand, and we've now beaten you twice, or we're close to beaten you twice.
I don't want to get too cocky on this one because they're so duplicitous, they tried it again, a couple of pages, to give them, to take away all your rights, all your controls, all the safety of your children, all of it.
And we don't even know what's going on in these frontier labs, all of it for them to give it to the oligarchs.
Scalise knew this.
Mike Rogers knew this.
Everybody in the House knew the speaker knew this.
Guys in the Senate knew this.
Ted Cruz, Ted Cruz knew this.
They all knew it when it was getting slid in there.
If it hadn't been, once again, for Mike Davis and Article 3, the Joe Allen's of the world, getting people worked up and getting them worked up by looking at the facts where they came and said, no, this is not acceptable.
This is not right.
We're not going to have this.
And dig in and make enough phone calls and think that folks understood: well, hey, if I vote for this and my constituents know this, I may not be around here.
This is not the way it's supposed to work.
You're not supposed to play hide the football.
You got defeated back in July trying to do the same crap.
And even Ted Cruz was too embarrassed when he put the spotlight on that rat.
He didn't even vote for his own recommendation.
And we're going to go to Tennessee in a second.
And Marsha Blackburn led the fight on that.
Remember that?
President Trump kind of told him, said, hey, I don't think you guys, I don't think this is going to work.
It was like two o'clock in the morning.
I think the vote was at three, 99 to 1.

China's catching up to us.
Until somebody can show me, and maybe it's got to be the intelligence guys in a declassified setting, that the Chinese Communist Party, if we cut them off from chips, we cut them off from knowledge, we cut them off from technique, we cut them off from education, we cut them off from all capital markets, access to everything, that they can do this, that they're competitive in the sputnik moment.
And they're going to try to make that case.
The arms dealer, Jensen Wong, the arms dealer, he makes that case.
He makes the case that, hey, if China wins, not a problem.
If Chinese companies win, not a problem.
We're all going to have a group hug.
Yo, dude, not going to happen.
He's pitching all the time to sell everything to them because he's an arms dealer.
He's Khashoggi.
So this looks like a huge victory.
Once again, the pitchforks showed up and the Lords of the Manor said, hey, maybe we should rethink this.
These people look angry.
You damn right they're angry.
It just goes on and on and on and on.
No respect.
And beating them once again, they're going to try.
Hey, they're going to try to hold their lobbyists are going to be working.
They're going to be trying to hide the football in a million different ways.
And they're partnered now with the Tech Bros, a lovely group.
You got the ruling elite, the Republican establishment, the Tech Bros.
That's a witch's brew.

I'm going to have, we are going to have Paul Lagerman from Heritage Action is going to join us at the bottom of the hour.
I believe that the House in Indiana has just voted out of committee a 9-0 map.
And we're going to talk about that.

It's a free, it's a total fracas right now in the House.
I think Elise Stefanik has gone to the floor of the discharge petition about House members trading stocks on inside information.
This has been something, and Leahy knows this from the old breitboard days.
Peter Schweitzer, myself, the people at Peter Schweitzer's, at the organization we had at the time on the insider trading, because it actually is technically true that House members, it was true before.
We stopped it.
I think it's back.
They can trade on non-material, on non-material information, or excuse me, material, non-public information, which you would go to jail if you were at some company and heard some tip coming from the boardroom or if you saw some sales document and sales were down and you went and shorted the stock or dumped the stock, you would go to prison.
But House members, members of the House and Senate can actually vote on that.
Elise Stefanik, I think, is out there.
And the reason is she and Johnson, Speaker Johnson, are in a range war right now about the NDAA, but a different topic about Jamie Raskin and some things our intelligence is being rolled in, Arctic Frost.
It is, we're going to get into tomorrow, but it's a big, big, big, big fight.

This is a must-win.
President Trump won it by 22 for a whole host of reasons.
The polling got very tight here, and then everybody kind of pulled together.
You've got some breaking news for us, brother.
What do you got, Michael Patrick Leahy?

Very strong Election Day turnout today in all 14 counties that comprise the 7th district here in Tennessee.
And I've talked to some key sources that are familiar with turnout numbers.
And it looks like the projections are election day turnout may equal or surpass early voting.
Early voting, remember, 84,000 votes.
We thought that was pretty much a wash between Afton Bain and Matt Van Epps, looking at the counties involved.
But Election Day, you're going to have more Republicans turn out.
And so my projection had been we'd have a lower than early voting turnout.
I thought we'd have 68,000 turnout on Election Day.
It looks like we'll have 84,000.
As a result, I told you privately that I expected, anticipated that Matt Van Epps would win by five to six points.
With this higher Election Day turnout, so far, I think right now we're on track for a 10-point victory by Matt Van Epps tonight.
But Steve, if you are listening in Tennessee right now, two hours and 40 minutes, run through the tape.
If you haven't voted, go and vote for Matt Van Epps.

There's two hours and 40 minutes left for the polls to be open in Tennessee.
This is an absolutely critical seat.
Let's leave aside how we got here.
We got here and we're here.
The only thing that matters now is victory.
There's no substitute for victory.

People have come together and we should give hat tips to Speaker Johnson and others that have piled into here.
All the conservative media, war room posse, people have piled into this over the Thanksgiving holiday.
And since early voting stopped, I think on Wednesday afternoon, about 4 o'clock local time, people have pounded about getting folks ready, assisting people if they needed to get rides out to vote.
It was supposed to be inclement weather today.
I understand it was quite cold, but it was clear.
So, Michael Patrick, everybody did kind of come together, but we still have to run through the tape.
You know, after work voting is always very strong, particularly among working-class people that can't do it before work.
So, we need everybody.
We've got two hours, over two hours and a half.
This thing could hang in the balance right now.
But I think people did respond, it looked like, to they needed to get out and vote today, sir.

It's clear and cold here in Middle Tennessee in the 7th congressional district.
Temperature hovering around 32, 33 degrees.
There has not been precipitation yet.
It may get colder.
It may start to rain or sleet or snow between now and the closing of the polls.
So it's very important if you live in the 14 counties that comprise the 7th congressional district and you have not voted, turn your car around right now, go to the polling place and vote for the GOP nominee, Matt Van Epps.

Indiana State Senator Michael Bohachek is opposing redistricting, and Indiana's been an interesting place because the lawmakers there have not wanted to do this despite the president's push and despite the governor's push.
Here's what the state senator said about it.

Many of you have asked my position on redistricting.
I have been an unapologetic advocate for people with mental disabilities since the birth of my second daughter.
Those of you that don't know me or my family might not know that my daughter has Down syndrome.
This is not the first time our president has used these insulting and derogatory references, and his choices of words have consequences.
I will be voting no on redistricting.
Perhaps he can use the next 10 months to convince voters that his policies and behavior deserve a congressional majority.
He was talking about the president, by the way, using the R-word about Governor Tim Walz of Minnesota.
But that last line, perhaps he can use the next 10 months to convince voters that his policies and behavior deserve a congressional majority.
That says a lot about at least one Republican who's looking at the landscape, Jake, and seeing the poll numbers and seeing the dissatisfaction.
The approval rating is in the gutter and saying, this is not on me to make it easier for you.
You should take a hard look at yourself.

You know, I was talking to somebody yesterday up here who made a really good point to me.
A lot of people are seeing the, are becoming aware, let's say, that Donald Trump's tenure will come to an end.
It's not going to be in 26 or 27.
It's going to be like 2028 is not very far away.
And the fact that Indiana, a state that Trump reminds people, he won many times.
He has sent JD Vance there twice to lobby people on these congressional maps.
He has called in to Republican caucus meetings in the state.
He has done everything he can.
He had Mike Johnson talk to them.
He has done everything he can to push Indiana to redraw this map.
And the state Senate is just not interested, whether it's this state senator who didn't like Trump's, and rightfully so thought the name calling of Tim Walz was inappropriate, or it's just people who are like, yeah, I don't think we should be redrawing the map to rig the election for Republicans.
Like, that is what this is.
And that's not like a, it's not, they have the power to do this, but they are doing this to get more Republican seats.
Like, they are getting rid of a Democratic seat in Indianapolis, a big city that has had Democratic representation for a long time.
The other seat, Frank Mervan, in the Gary area in the states, in the Chicago excerpts.
I mean, these are seats that are, they are Democratic, and they are redrawing the map to give themselves an advantage in 2026.

We just, despite MSNBC, we just had very good news come out of Indiana, and that is the committee, I think, voted eight to five to put forward a map that is 9-0.

Absolutely.
So this began, you know, months ago.
The fact that we talk about this happening overnight in Indiana is absolutely incorrect.
This conversation has been ongoing for months, talking about redistricting, talking about these maps, talking about the inequity that we have in Indiana, where we have, you know, the 7-2 majority within our congressional delegation in a state that's deep red.
Every statewide elected official in the state is a Republican and has been for the last few cycles.
And we haven't had a Democrat here in quite some time.
The numbers just bear this out.
So today, what happened, the exciting part of today is this was the first actual legislative step.
The House came in early.
This is special session light in that it isn't the exact special session.
This is an early start to the actual session.
So the House came in.
The bill was introduced yesterday on the floor of the House.
Committee hearing lasted all day today.
I can say that Heritage Action, we were about the only folks that testified in favor of this bill.
And it was just person after person from about 9:30 in the morning till about 3 o'clock in the afternoon that didn't like to see it, that didn't want redistricting.
And as you said, the vote came out favorably in the committee.
Now it moves on to second reading.
Second reading will happen tomorrow.
On second reading in Indiana, there's the opportunity to amend the bill, to discuss the bill, to debate the bill.
This is sort of the big hit, right?
And you're going to see tomorrow just everything in the kitchen sink come at this bill in the form of amendments, trying to tear it apart, adding poison pills.
Those are all going to be defeated tomorrow because we know going into this that the House numbers are there.
The votes are there in the Republican caucus.
Remember, in Indiana, it's a 70-30 house, right?
Quite literally.
There's 100 members, 70 Republicans, 30 Democrats.
The House can conduct business without the Democrats showing up.
They don't have to worry about quorum or that sort of thing.
So tomorrow is the big day for all the amendments and then third reading on Friday at the same time as Turning Point.
We'll be hosting a very large rally in the state house right next door to the House of Representatives on one floor down.
So it's a big, beautiful granite building.
So you're going to hear this pro-redistricting echoing through the halls.
So it's going to be pretty exciting.

Yes, sir.

I mean, this is a very, look, it's just, it turns out that the Hoosier state is very red.
It's been conservative a long time.
It's quite, it's MAGA.
There have been some of the Pence conservatives teaming up with the Democrats to do this.
But when you said you had witnesses all day, the Democrats, because they're very smart, they understand the fight's just simply not here in Indiana.
They need to send a message to their other troops because they're trying to force one in Virginia.
They're trying to force something in Maryland.
They think they got another bite at the apple in Illinois.
They're going to go full on to even gerrymander worse than they gerrymandered states like California and Illinois right now.
So it is imperative.
That's where this fight, this fight's not simply about an 8-1 map versus a 9-0 map.
It is about this is a war.
This redistricting sets the predicate for the 2026 election.
If Alison Gross had not come to War Room in 2021 and we got revved up with him and others, we would have never picked up those eight seats in 2021 that are really the balance of what's in the House today.
Do people that do the grassroots and the Republicans in Indiana understand the national importance and the national scale of this fight?

I think that is the real struggle that we're running into.
And it's not in the House.
It's in the Senate and in the Senate today, that's where we're seeing the pushback.
That's where the vote count is in difficult territory.
We have to move five more votes over to make sure that we can be successful in the Indiana Senate.
So in the Senate, the body's 50.
It's 40, 10 Democrats.
But you got to remember, you've got Republicans teaming up with Democrats to kill redistricting in the Indiana Senate.
So this is the real difficulty.
Now, a couple of weeks ago in what we call Organization Day, this is the day when the committees are assigned, when the rules are adopted, all the things for the upcoming session are happening.
An unscheduled vote occurred in the Senate, and that was to not do a special session and not deal with redistricting.
And it passed.
Okay.
So now that was Democrats and Republicans, Republicans light, maybe, I guess we should say, teaming up to say we don't want to deal with the process.
Well, the House countered that.
And when Speaker Houston opened up this session early, he forced the issue.
And up until just a few days ago, the Senate was not ready to come back in.
The Senate has announced that they will be back in on the 8th.
So as this process concludes this week, the Senate will return and the Senate will have to deal with this issue, I think, in a meaningful way.
Now, what we've seen is an amazing amount of pressure from the grassroots, from the base of the, you know, the conservative base is, I guess, the best way to say this, across the state.
And so folks from every district are calling their legislator, the folks that they, you know, and in Indiana, it's a part-time legislature.
So they're not there all the time.
They have a real job at home for the most, you know, in most cases, unless they're retired, you know, or they're a teacher.
And so those folks come home, they see their constituents in the grocery store.
It's not like Congress.
There's not a barrier of staff.
There's not a lot of those people.
So they have been bombarded with calls and text messages, you know, and people stopping by their house and all their friends are really kind of hitting them up.
So we feel this momentum building.
We feel the momentum building for the vote.
We feel like we're in a good place.
We've seen a couple of folks break from a no to a yes.
And, you know, like I said, we still have five votes to go right now in the Senate.
And so I think this House pressure is really making a difference in a very positive way.

And you're going to see, you know, members from the congressional delegation represented there.
You know, I know at least our Senator Jim Banks, who has been just a stalwart conservative in the state.
I know he's going to have some folks on site there.
He's dealing with the defense budget.
So I don't know that he'll be able to be there in person, but it's going to be, I think, a really terrific thing.
Now, the one thing I do have to mention is the onslaught of folks today and the hits that we took, the questions that came from the Democrat side of the aisle were pretty intense.
And it was great.
Representative Ben Smaltz of Auburn, Indiana, handled it with grace and charisma.
He did a fantastic job of getting, you know, 70 or 80 of the same question repeatedly hit at him.
He didn't lose his temper.
He handled it very well.
And, you know, and just kept saying, look, this is a response to a political reality.
You know, and the Democrats kept saying, but Texas, but Texas.
And, you know, the reality is in Indiana that California made the move.
And if we don't respond, then, you know, we lose the house.
