Turn now to the Trump administration standoff with a federal judge, U.S. District Judge James Boasberg, now saying that the government appears to have acted in bad faith.
This comes after the hearing wrapped just moments ago to determine whether or not the government violated his court order to stop the deportation flights, two of them, with alleged members of a gang to a mega prison in El Salvador.
President Trump invoked the Alien Enemies Act last month.
It's a wartime authority used to deport non-citizens with little to no due process by arguing that the Venezuelan gang is a, quote, hybrid criminal state that he says is invading the country.
Joining me for more is ABC News Justice Reporter Alex Mallon and ABC News Senior Washington Reporter Devin Dwyer.
Gentlemen, thank you for being with us.
And Alex, the hearing just wrapped here.
What are your main takeaways?
I mean, it was really a fascinating hearing, Kena.
I mean, Judge Boasberg really laid it on the government, and it really seemed like he's leaning towards initiating contempt proceedings.
Now, what that's going to look like, we don't know.
But he basically tried to drill down the timeline of the government, and that March 15th, that Saturday hearing where he initiated this verbal order to the government to say, if there are currently any planes in the air with migrants that are being deported under the Alien Enemies Act, you need to turn those around.
The government has maintained both that they comply with a written order that was later issued by Judge Boesberg.
And also they said that his jurisdiction was largely moot once he the.
This hearing, though, Judge Boasberg said that the rushed process that the administration engaged in to put those over 200 migrants on those planes and get them to that Supermax prison in El Salvador seemed to be deliberately and done in bad faith.
He said that it seemed to be designed to basically dodge any court order that he issued that day.
And so he said that at the conclusion of that hearing that he was going to consider whether the...
The administration, there was a probable cause that they did violate his order deliberately.
He said he will be issuing some kind of written order on that sometime likely next week.
Okay, so Devin, depending on what that written order says here, if they do decide that they violated his orders, what's the consequence?
Well, the judge in this case, Kena, has limited options and judges in general don't like big divisive showdowns with the federal government as we see here.
And that was every indication we received from Judge Boasberg today.
He was really using the levers of his ability to question the government, name, have them name names, get down to the facts, scrutinize the truth.
But at the end of the day, judges have...
Pretty limited tools at their disposal when it comes to holding the government to account for an alleged violation of their order.
Sure, he could issue jail time, he could issue fines for any officials involved in this who disobeyed him, but judges typically don't want to do that when it involves an agency that those sorts of things can also be challenged in court.
So Boasberg is really limited and it does appear, Kena, that he's simply trying to use the power of the bench to extract more information more than anything else.

You are a cadre at the tip of the spear of, quite frankly, a revolutionary movement.
That movement is to bring America, return America to her greatness.
And if you see this whole thing we're getting into with judges, the five victories we've had and the attention we're getting now in the legal community, you see this on MSNBC and the New York Times every day.
The anger that they're coming up with every night that we're actually questioning the judicial system about a judicial insurrection, and you look around the world at how that's happening all the way from Israel to Brazil to France to South Korea and here in the United States.
It's all moving.
Also, the people.
This audience, this show attracts a certain type of contributor that goes after a certain type of information.
Julie Kelly is a perfect example.
Julie Kelly is not a lawyer.
Julie Kelly was a concerned citizen and an activist that got involved in going to courts on the J6, on everything related to J6, and now she is kind of the axe in the space.
For all this, the Mike Davises of the world, right?
The Todd Benzons of the world, the Ben Berquams, Oscar Blue Ramirez, wherever there's a tough issue, you have these people that are contributors that really get in and show the receipts and are not just sitting there to give you commentary.
They're there to give you actually the facts of what's going on and you make up your own mind and then people can get activated around that and actually make a change.
That's in the last hour.
So frustrated about...
This thing about the southern border and the invasion, it is so outrageous and at such a scale.
We've got to have responsibility.
We've got to have accountability.
This is what Julie Kelly sees every day if you go to her substack or support her reporting.
Now she's on to a whole different thing, President Trump and how the federal judiciary is actually in an insurrection right now.
Now, because of you guys getting up and getting on Article 3 and going, and now Mike Davis has got you tasked with two things.
Number one, take the $2 billion that they're forcing the president to pay the consultants for the work in foreign policy for USAID.
Get your congressman to say, hey, we're taking in the appropriations.
We're taking it right out of the federal $10 billion because of federal judges.
The other is impeached Bozeman.
One of the most important is this contempt trap that she's very focused on.
Remember, Peter Navarro and Steve Bannon went to prison on contempt.
This is one of the ways they try to go out and get it.
They try to sit there and they try to lay out the fact that if you're going to support a certain thing, they're going to lay it out to make it impossible for you to do unless they try to get you in a criminal charge and go to prison.
I happen to believe that you're seeing Boasberg, who I think is totally evil and obviously a Trump hater and a MAGA hater, try to do on this.
Julie, I realize you've got a lot to go through tonight.
I do want to start with the Boasberg stuff.
I mean, in fact, we pulled different clips to kind of I thought that was great because there are actually people out there that kind of agree with you that are not on our side of the football.
Can you give us the latest?
I know you're going through a very detailed timeline for your sub stack.
What's up with Boasberg?
Because Boasberg is the guy as the head judge of the first level of courts, the district courts.
He's got a target on Trump.
He is coming for President Trump.
Of that, there's no doubt.
He's coming for Trump.
And you've actually exposed how he's trying to do it.
So take it away, ma'am.

So what I just posted, and this is a very detailed timeline of what went down on March 15th and how Jeb Bosberg not only just decided to pursue a contempt case against the Trump administration, but he actually set it up starting in the early morning hours of March 15th when that ACLU lawsuit was filed representing the illegal Venezuelans who were going to be covered.
By the Alien Enemies Act.
And I go through all of Bosberg's movements and decisions that day, comments that he made during that hearing, comments he made afterwards to tip his hand that this was specifically, it appears, taken by him as the chief judge,
not assigned to him, that he took this case early that morning, continued to make these decisions.
And lure Trump officials into a contempt trap.
Now, what does that address?
What you just played in the cold open, this so-called oral ruling, he calls it, to turn planes around, knowing that when he set this hearing at 5 o'clock on March 15th, he already knew that two planes carrying these illegal Venezuelans would be taking off during the hearing.
So he set the hearing time specifically to coincide with the departure of these two deportation planes.
He then called a brief recess in the hearing, directing the DOJ attorney to go try to find out details about these flights, which of course the DOJ attorney couldn't do because it was a Saturday night.
Bosberg knew that.
When the poor DOJ attorney comes back at about six o'clock, says, I have no details.
Bossberg and the ACLU knew these flights had taken off.
He then enters what he called this oral ruling at about 645.
The planes had already been long gone over an hour.
Out of U.S. airspace, they took off from southern Texas to Central America, ordered those flights back.
Now, what's interesting, Steve, is what he said verbally.
He did not include in a written temporary restraining order.
That he filed about 40 minutes later.
But now this verbal ruling is the basis of this contempt investigation.
We're expecting this opinion to be issued tomorrow in what he has called probable cause for contempt, accused the Trump administration last week of acting in bad faith and disobeying at least this order.
Now, his other two written orders, of course, have been vacated by the Supreme Court.
So they're not even active anymore.
So any contempt investigation inquiry that he wants to proceed with will have to be based on this verbal ruling.
So, so sketchy.
And so my new piece really articulates almost hour by hour what happened that day as he created that contempt trap for the Trump administration.

Okay, Kate, help me out here.
And this is in the previous hour, folks.
I'm not saying things against the Trump administration.
You've got to remember, every department of theirs, like Fort Apache, you have the administrative state that still has 90% of the bodies.
You're, like in Saigon in 1967, you're trying to manage something that the enemy's inside the wire.
Constantly, people, they're understaffed.
Right? There are not enough people gotten through.
They're in confirmations and all of it.
They're overwhelmed in everything they're trying to do.
If you talk to these people after hours and some of the relationships, and that's back to the thing I was saying at the beginning of this.
Think how many people we've had on this show, either as contributors or guests all the time or co-hosts that are now in the administration.
And more of the contributors, I think you will see the Julie Kellys and the Mike Davises and the E.J. Antonis and the Todd Benjamins.
There'll be a whole other second wave.
I'm not saying those specific people.
There's going to be a whole other second wave that go in there because these people are fighters and subject matter experts and they won't back down.
They have the courage.
But here's what concerns me.
When I read your thing and I see it, Shouldn't the Justice Department lawyer that's actually representing the government and President Trump and DOJ and the people that are involved in DHS...
Shouldn't they have known?
When you lay it out, it's pretty obvious what was going on.
Why wouldn't a skilled lawyer have seen this and start combating that in the courtroom and try to shut down or at least expose it and say, hey, judge, I know what you're trying to do here, and we're not going to play games.
We're not playing this game.
We're not going to be party to this.
Ma'am.
julie kelly
Well, I think this was part of how everything, and Judge Jeb Bosberg, as I say in my piece, he admitted.
Everyone's working on the fly here.
He said, I haven't had any time to research this.
He verbalized many times how quickly he was rushing.
He said at one point in a later hearing, this was out of the norm.
This was not the common way that lawsuits like this were handled.
So they rushed this on purpose to put this DOJ attorney dragged into this on a Saturday, had no idea that this was coming.
That's how they really caught this guy off guard.
And then knowing it was a Saturday evening on March 15th, and that he wouldn't be able to get in contact with the right people and give Judge Bosberg more details.
Now, I will say, Drew Ensign, who is the DOJ attorney, I think he did what he could in this particular hearing on March 15th.
I was not impressed with his subsequent performances.
Especially on April 3rd, when he started voluntarily giving up names of Trump officials he talked to after that hearing, who might have been listening in to the March 15th hearing.
So that's just sort of...

But in his defense, when you used to cover J6, and I know this from my own trial, You would have the most senior guy show up in the department.
People were in shock for a misdemeanor.
They were bringing the heavy artillery out when they had me.
And I understood it.
Hey, if we can get Ben and we're going to send a message to all these people on a misdemeanor and send him to a federal prison, we'll do it.
Same with Peter.
The second or third time the guy goes in court, he's one guy.
I understand they are strapped over there, but wouldn't this rise to say, hey, look, They're trying to get us on a criminal contempt charge, and they're going to try to throw some DHS people, maybe some military people, and they're going to go all the way up and try to do something with Trump.
Wouldn't you have like this three or four scenes?
Shouldn't Pam have maybe showed up that day symbolically like the Biden Justice Department used to do all the time to send Lisa Monaco and those people to send their highest and their most seasoned prosecutors?
julie kelly
Well, I think what happened that evening and when Bosberg made that ludicrous statement about turning planes around.
First of all, I don't think the DOJ attorney thought that that was really serious, but Judge Bosberg also said, I'm going to put this in a written order.
And he actually said, no one has to write anything down.
I'm going to put this in a written order.
So then when he filed his written minute order at about 726 that evening, he did not include his comments about returning the planes.
So at that point, I'm sure the DOJ thought that that verbal command was not in play because it wasn't reflected in the written one.
And then that became an argument later.
And there's case law in common practice that says verbal, it has to be a written order.
It has to be on the docket, like the other two temporary restraining orders issued that day were on the docket written.
And the verbal one was not.
So that's been an ongoing dispute.

But what I didn't like was coughing up names when the judge goes, who, well, I can't really know.
I don't remember.
No, tell me who.
And you're coughing up names.
That to me should just tell the judge, hey, we'll get back to you.
And then you stonewall it or you drag it out.
You play hardball.
That's when you know the judge has got the fix in for you.
This thing stinks to high heaven.
And my concern is this is going to metastasize because MSNBC is driving this every night.
This is like the one they fantasize about because they see Trump going to Danbury on a contempt charge.
Trust me, these people are so deranged on Trump hatred, they're twisted.
And Bosberg's one of them.
And this also makes, which I think is Mike Davis' impeachment thing, is absolutely justified because of what's happening here.
Where do we stand?
I thought papers were supposed to be filed.
Is this thing actually going to move forward or since he was kind of overruled?
julie kelly
No, what he did, Bosberg did very brazenly after the Supreme Court ruling came down Monday night.
Tuesday morning, he canceled a hearing that was set for that day.
So this is April 8th on a preliminary injunction.
So this is the natural next step after a temporary restraining order.
So he was going to hold a hearing.
He canceled it.
But what he's told the ACLU, representing these illegal Venezuelans, is, hey, by April 16th, I want you to file another memo or notice as to why you think that this courtroom is still the proper venue to seek a preliminary injunction.
Well, how ballsy is that?
I mean, the Supreme Court had already said in its opinion that the Washington jurisdiction was improper, that you should seek habeas and it should be in the jurisdiction where the defendant is in custody.
And in this case would have been Southern Texas.
Texas, at least at that point.
So he's still challenging now, not just the Trump administration, but now the Supreme Court.
So we'll see next week what the ACLU comes back with.
Now, can he proceed with preliminary injunction hearings?
I mean, I suppose so.
He'll probably be smacked down by the Supreme Court again, but he is not done pushing the envelope on this.
He took this on as a crusade.
Look, this is the guy who has called January 6th an insurrection.
He said this over and over in J6 cases, that that was an insurrection incited by President Trump.
So this is a longtime grudge that Jeb Bosberg has had.
And so this is why he's going to keep pushing this as long as he possibly can.

Just to make sure I understand, if ACLU decides they're not going to file, I know they are because they're going to try to get this, figure out this Texas thing.
Is the contempt thing still a thing?
Is he still going to push that separate and above everything else?
Or because the Supreme Court ruled it, that just dies and President Trump and his team are off the hook?
julie kelly
No, I think he will definitely pursue the contempt case.
Now, the ACLU, I believe in the five...
Original plaintiffs, they've already sought habeas in, I believe, New York and Texas.
So I'm not really sure what the ACLU will do with a preliminary injunction, except for the fact that Judge Bosberg turned those five unnamed illegals into a class action, into a class.
So he did that in one of the temporary restraining orders that has been overturned.
But this demonstrates how messy all of this is.
He still believes or wants to believe that there's a thread he can hang on to to keep this matter in his courtroom.
But that's separate from what would be a contempt inquiry or contempt allegations related to the verbal order that was not on the docket and not reversed by the Supreme Court because it wasn't even an issue or a question in that litigation.
But we will know tomorrow because he said last week that he would issue his opinion on contempt this week.
So I'm sure we will have it at some point tomorrow.

We've got five wins at the Supreme Court.
The court never wanted to get involved in the steal of 2020.
They only got involved years later, I think, on Fisher and J6. Is it pressure that's been put on them?
Why are they now responding?
It looks like they're in some of this to tamp down, at least to tamp down somewhat deep.
Well, to your point, they have.
julie kelly
They've made a few decisions, put a hold on some lower court decisions, obviously here, vacated the temporary restraining order.
So I think they're just slowly, bit by bit, kind of, you know, Disassembling little parts of this lawfare.
Is it late in the game?
Yes, because so much damage has already been done.
And to your point, distracting the Department of Justice and the President and the entire Trump administration, sabotaging the agenda of the President and his White House team.
Because this is all anyone has really been talking about is what's happening in these various lawsuits and taking away resources and time that I know the DOJ wants to use in other areas, including investigations and prosecutions of what we would like to see.
They have been completely stretched thin.
They've had to depend on career prosecutors like they had in this case, a career immigration lawyer.
And keep it also of interest, two of the immigration lawyers who were involved in the Bossberg case were also in the Maryland father, Rego Garcia, I think is his last name, the El Salvadoran who was removed, a suspected MS-13 member,
and then deported to El Salvador.
Two of the lawyers in that case were...
Removed by the Department of Justice for saying that they were not arguing on behalf of the government and the administration.
Two of those lawyers also involved in the Spassburg case.
So this is what Pam Bondi and her team are up against.
This is a formidable challenge.
And in some ways they're flying blind because you have to rely on career lawyers who have been there that you trust will do their job.
And you have them, in some cases, openly sabotaging them, like we saw in Eric Adams' prosecution.
Prosecutors coming out denouncing their bosses at the DOJ for trying to drop that indictment.
And then you've got just either they're really bad at their jobs, or they are also working to undermine the will of Trump's Department of Justice and the president in the process.

Now, what is the situation regarding Jensen?
julie kelly
Right. So this is a controversy this week.
News that Kash Patel and Dan Bongino have moved Steve Jensen, who was head of, I think, the Columbia, South Carolina, or a few field offices in that area, moved him to the Washington field office.
So you had Tom Fenton on the other day discussing this.
This has led to, I think, understandable.

Tom Fenton and the guys were all worked up about this.
What's your take on it?
julie kelly
So Jensen, there's no question, his hands are dirty when it comes to January 6th.
He was head of FBI domestic terrorism unit and held calls and apparently was promoting the prosecution of J6ers because the FBI, Chris Wray, had designated January 6th an act of domestic terror.
So certainly understandable that people would be outraged and questioning this move.
However, you have to have people with their hands dirty, To show you where the dirt is.
And it's not, certainly not questionable or out of the ordinary when you're trying to get information to have people who might have that information show you access to it.
It's not like Chris Ray put all of the evidence to all of the unanswered questions that we need in neat little piles on Kash Patel's desk.
Right. That did that didn't happen.
You saw what Tulsi Gabbard said last night on Fox News.
As far as the intelligence community, they've buried stuff everywhere.
And she said, the more we dig, the more we fight.
But they've set up and we know this barriers to access that.
So do you have someone like a Steve Jensen?
And I could be totally wrong.
And I gladly take a backseat to Tom Fitton, my friend Miranda Devine, who we were with last week, who also has a column up criticizing the Jensen move.
I'm just saying that I trust Cash and Dan.
I believe that there's a reason why they kept Jensen, who is in daily communication with Chris Wray, with Stephen D'Antuano, who is the former head of the Washington field office.
That's where everything is buried at that field office.
Also, Tim Tebow, the dirty, former, corrupt, disgraced FBI agent.
So he was in communication with all of them.
So could he have valuable information that they need to lead them where they need to go?
Probably. I don't think this is a reward for what he did for January 6th, but I think this is how sometimes these things go.

Julie, this gets back to this issue we were talking about in an understaffed administration that's under siege because they're coming at him from every different way, folks.
It's actually more intense, I think, than the first time because President Trump's actually getting more done.
He's coming up with a plan, bang, bang, bang, and they're trying to chop block him every step.
Is the controversy about Jensen the fact of, why don't you just get rid of these guys?
I guess cash for the people at FBI and Jeff Smart wanted to get rid of them because they had past bad actors, but you, Fenton, and Miranda are arguing, you're arguing, hey, he may have relevant information, and that information may make things quicker.
They're arguing he's a bad guy because he worked.
He worked for these guys.
And where do we come out on this?
Is it more that we got to get investigations done and people like this help us or that they had anything to do with January 6th and other things like that they should just be gotten rid of and maybe charged themselves?
julie kelly
Well, and I want to just reiterate, Steve Johnson's hands are dirty on January 6th.
There's in some cases in some ways dirtier than others because he did take a lead role.
So I'm not diminishing that.
I'm not excusing it.
I'm not justifying it.
But when you're looking for people who know where the dead bodies are buried, who knows where this information could be housed, who can explain how everything went down and who was really responsible for it, you have to have those inside sources to do that.
And so Look, I was defund the FBI, you know, burn down the building.
I mean, I don't think I said that, so I don't want to be in trouble for that.
But that was when the Democrats were running it.
So, okay, now we can shut down the FBI.
Sounds like a swell idea.
Okay, I'm sure we can survive without it.
But with it goes all the answers to the questions that we have.
How many FBI informants and undercover employees and other assets were involved in January 6th stoking the events of that day?
Joe Kent so admirably talked to Mark Senator Mark Kelly about that yesterday and saying that the intelligence community is looking into that.
Where is the pipe bomber?
What happened to that?
How after more than four years did that remain unsolved?
So many people.
Questions that we still don't have answers to.
Were there members of Congress who were involved in the plotting and planning of January 6th?
There certainly is evidence to point to that.
So, again, Chris Wray didn't leave all of this information and evidence and material and records on Kash Patel's desk.
To the contrary, it is hidden who knows behind how many locks.
And this is what Tulsi Gabbard, again, was referring to in her interview last night.
So, with great respect to Tom and Miranda.

And Miranda was with us at the Justice Department last week.
Let me ask, does the president signing the executive order on Krebs last night to essentially put forward an investigation of the machines in the 2020 election?
Is that the first one that we've seen?
Let's get down to it.
Because I've always said the railhead of all this gets back to the election in 2020.
We can go back to pandemic and there's plenty to do there.
But if we start the election in 2020, that'd be a good place to start and then go right through January 6th.
Do you think his signing of the executive order on Krebs is at least the first thing of movement we've seen with the president saying, let's get on with this and I need to see some movement here, some action?
julie kelly
I believe so.
And I think that was such a bold move.
And you saw the reaction, even from Chris Krebs.
And Steve, I pulled up Chris Krebs' January 6th select committee, and I'm sorry to laugh.
He is a clown.
And I'm going to be posting some of the things that he said in this interview, including that the Iranians were working with the Proud Boys in October of 2020 to send out emails to people who are registered Democrats and threatening them.
If they voted Democrat.
This is the most far-fetched thing I've seen.
And I have to laugh because, of course, I know who the Proud Boys are.
I covered parts of their trial.
It's preposterous to think that what Enrique Tarrio was working with the Iranian regime to send out emails to Democrats in Florida.
This guy is a total joke.
And so I'm going to be posting parts of that transcript later tonight.
But I do think that this is another signal from the president and his team that they are going to, and of course he said this, look at the 2020 election, what happened there, but more importantly, who covered up all of the fraud that we know happened and whitewashed it away and would not take responsibility for looking into what we know was...
Decisive voting fraud in that election.
So I think Chris Krebs is an ideal person to launch this investigation about.

I think the key here is to counter Chinese Communist Party is we need to find out who is our real enemy.

We need to talk with them.

And the Chinese Communist Party is the real enemy.

It's about life and death.
So that's how important it is.
I would like our audience to understand this.
So I think what I just said, President Trump tried to ally with European countries and also probably market-driven countries in Asia, like Japan, like Taiwan, like Vietnam,
to work with Americans to counter the Chinese Communist Party.
Of course, the Chinese Communist Party has their weakness, which we can talk about here.
Their biggest weakness is their state-owned enterprises.
The state-owned enterprises contribute a significant part of the Chinese Communist Party's GDP.
They are the biggest weakness point.
I can give you some numbers.
Back in 2019, Almost 30% of the GDP is contributed by those SOEs.
After pandemic, this number rose to more than 40, even 50%.
That tells you how much economy is relying on those state-owned enterprises.
But those state-owned enterprises, they are heavily relying on the monetary policy.
Meaning if there is any fluctuation in the currency, they will have trouble.
Because all their employees rely on their wages.
If there is any fluctuation in the currency or if the RMB devalues, then it will impact their purchasing power.
It will impact their operation.
So we all know CCP manipulate their currency.
They have a dual system, which has an onshore and offshore.
Currency. That's where they manipulate the currency with US.
They have done internal studies.
If that value gap more than 35%, then CCP is over.
With the current tariff, basically we reduce their dollar income rapidly.
So I don't think the Chinese Communist Party will survive.
This is the key.
So if their SOE has trouble, then it will start the social unrest and also the people.
And also, one more thing is, they have done studies.
More than 80% of the Chinese people, even high percentage of the officials, CCP officials, actually...
They believe in the US.
They admire the US system.
They basically have an American dream.
So if this decoupling happens, if there is devaluation of the Chinese yen, then they will have internal change, which will undermine or dismantle the Chinese Communist Party.
