But the flip side is also true.
And the flip side is that 2020 was a dress rehearsal.
2020 was the middle school musical version of an insurrection.
This time, as Neil Katchel's piece that you led with in this segment indicates, this time they've professionalized the strategy.
This time, the other side is prepared.
And the preparation is to create chaos now.
Mark talks about three different stages of this process, and I think of it as a before, during, and after.
And if you think about the before, where we are right now, all of these lawsuits, the RNC has filed something like 126 lawsuits in 26 different states, or it's involved in 126 lawsuits.
Those are designed primarily as press releases.
They're designed to plant the seeds of doubt now, to sow those seeds of doubt, then to, in the during, intimidate the voters, manipulate through what used to be nonpartisan processes of election administration.
And which are now installed with political partisans who believe in that lie that Mark was just describing about 2020.
And then the after.
The after is to build on the foundation of all of those seeds that you've planted and that you've frankly curated between now and the election.
And so we're in a better position because teams like Mark's are prepared.
But we're in a worse position because those who are seeking to derail the process.
You know, courts are going to play a role.
Lawyers are going to play a role.
But the reality, the optimistic take here, is that voters get to fly the plane.
And unless we get 537 vote margins, like we did in Florida in 2000, voters, more than courts and lawyers, are going to decide this election.
They have the potential to decide this election.
We've seen extraordinary turnout already.
But the reality here We cannot have rose-colored glasses.
The reality here is that 2020 was disorganized.
2024 is organized.
The attempted revolution may not be as televised this time, but it is going to be organized.
This is really straight out of Mein Kampf, the parts where Hitler is talking about American immigration and American restrictions on non-white immigration.
And really, I think the philosophical question, as a philosopher, What I wonder and what I ask is, why aren't people more alarmed?
Why aren't people more alarmed by the rhetoric that we're seeing?
This would have been disqualifying in 2016.
And we've read this again and again about the history of fascism.
We read this from Victor Klemperer's work on the language of Nazism.
It becomes normalized.
You become inured to it.
And the function of this normalization is to normalize the practices.
Now the rhetoric has been normalized.
The next move history tells us is for this rhetoric to normalize the practices.
It's far past time to label this what it is.
And what we're seeing is a fascist social and political movement.
There are many varieties of authoritarianism.
The kind of authoritarianism that vilifies LGBTQ plus citizens, that is based around immigration and immigrants as criminals and vermin, That labels any supporter of democracy with a small d as a Marxist.
That claims that Marxists are controlling the institutions and says that we need violence to root them out.
The kind of extortion that we're seeing.
Essentially, Trump is saying, if you don't elect me, this country is going to plunge into violence.
When he says bloodshed, what does he mean?
One of the things he means is he's Encouraging his supporters to plunge the country into violence.
That's a kind of extortion that we're familiar from our fascist past.
So authoritarianism doesn't identify the target narrowly enough.
What we're dealing with now is fascism.

Jenny Beth, hey, I can see you've got a huge group of people around you.
Welcome all to the Warren folks.
Jenny Beth, I know you're deeply engaged now in getting out every single MAGA vote ahead of November the 5th.
Tell me, give me some updates.
How's it going down there?
jenny beth martin
Well, Ben, thanks so much for having me.
I think over a million people now have voted in Georgia already.
But these Trump supporters behind me and all around the entire state are not leaving anything to chance.
We are doing everything we can to get out the vote for Trump.
This morning, these people are going walking with our super PAC, Tea Pretty Patriot Citizens Fund.
Turning Point Action is on the ground here.
America First Works is on the ground.
I believe that Elon Musk, America PAC is on the ground.
And then, of course, the Trump campaign is on the ground.
Everyone is committed to doing everything we can to get out the vote for Trump.
And that means talking to people who always vote and making sure they go ahead and vote and bank that vote.
And then the people who maybe vote sometimes, but not all the times, making sure they go vote And then the people who are still undecided talking to them about why Trump is the right person to lead our country for the next four years.
And the people who are with me right now are committed to doing that.
We've got somebody who has never done anything with activism with me.
We have a state representative, Charlize Byrd, who is with me.
We have a man who moved to Georgia, whose son goes to Georgia Tech, We are all committed to doing everything we can to get out of the vote for Trump.

On the first day of voting, I think 300,000 votes were cast up until yesterday.
I know you just said it in your introduction, let's hit that figure again.
One million votes now have been cast.
Let me talk to some of the people who are, perhaps Charlize, let's start off with her.
Let me talk to some of the folks that you've got there with you.

Tell me something about the momentum that you're picking up down there.

Ben, it's important to note that Charlize was one of Trump's first supporters in Georgia back in 2015 and has been with him the entire time.

And then what are you hearing from people around the state?

They are quite excited to get out and vote, and particularly for Trump.
Which is quite exciting.
It certainly is exciting here in Cherokee County as the reddest county in all of Georgia.
And we are thrilled that all of these people are here to get out the vote.

Now, Charlize, I was particularly interested in the fact that you were supporting Donald Trump right back from the moment when he descended the golden escalator.
Just tell me, what was it that first attracted you to him?
Absolutely applaud for that.

It was.
So I have been serving in the House of Representatives, and we have seen presidents come and go.
And for a change, we were going to have the ability to vote for a businessman so that he is...
To elect as president.
And we have been doing the same thing over and over again and getting the same results.
And I made the decision to jump on board at the very beginning with Trump.
And of course, as a conservative, it was highly unusual.
And many people asked me, what are you thinking?
And I said, we have to make a change.

Superb.
Absolutely superb, Charlize.
And finally, my question to you, what first attracted you to him?
You're still obviously clearly 100% in favor of Donald Trump as the nominee, as the next president of the United States.
Just any doubting Georgians who are listening to the show today, what would your message be to them?

He loves this country of America.
The United States of America means everything to him.
And that was the number one draw because that's what we need.
Someone that wants to be right here and take care of our own citizens as opposed to globally.
So that's what drew me first and then having the opportunity to meet him.
He is a kind soul for sure and certainly enjoyed meeting him.
He had a smile and a rarely very warm handshake.
Which really drew me to him.

But I tell you what, where we have a chance to really move the needle or keep things kind of roll back things a little bit is here in Georgia and some of the other southern states, as I see it.
So, yeah, we're here, my wife and I and one of my sons is here as well.

I think there are 18 days left now before Election Day.
What's your appeal to them?

There are three different things that you can do.
If you are in Georgia or one of the swing states, you can get involved and go knock on doors.
If you're in Georgia, go to knockfortrump.com.
Then if you are outside of Georgia and in a swing state, you can help us.
We'll connect you with Turning Point Action or with America First Works.
So we will do that.

So we've got two different websites.
Winelections.com is for swing seats, and then March to Victory is anywhere else.
If you're outside of a swing state, then what we can help you do is make phone calls and send text messages to voters inside the swing states.
We've still got to reach the voters who have absentee ballots or mail-in ballots and have not turned those back in, urging them to turn them back in.
And then people who have not voted yet and are undecided, we need to be talking to them and letting them know why normal, everyday Americans across the rest of the country Are supporting Donald Trump.
We understand he cares about America first.
And he cares about Americans first.
It's not to say he won't.
We aren't going to be a country that is a superpower.
We're still a superpower and have those obligations.
But we can't take care of those obligations if we don't take care of America and Americans first.
And we need to communicate that to our fellow Americans who are undecided.

There are a variety of attacks underway on Georgia's elections.
Many of them are coming from within.
For instance, one of the cases, Adams, was filed by one of the superintendents who's charged with counting and protecting and certifying Georgia's elections.
And so far, the courts have been resilient, giving a firm message back that says, we mean it when we say you can't make changes to these elections too close to Election Day, because that would cause chaos.
So look, Mika, the real risk here is that voters will hear some of these stories, see about the 120 plus lawsuits that the RNC has filed nationwide, and they'll begin to question the integrity of our elections.
And the answer is this.
Our elections are conducted across the country in a very decentralized way by highly trained, dedicated people, many of them volunteers.
And in state after state, we've seen officials say, we've looked at our machinery, we've conducted our training, we are confident in the process.
And that's the message Americans should take away, not these lawsuits raising claims that aren't true that end up being rejected by the courts.
But that, of course, takes a little bit of time.

For now, however, let's go to another battleground state, a key battleground state in this race, North Carolina.
We heard before that Georgia had broken its record when it started early voting this week, had bagged 300,000 votes.
Early votes on the first day of voting.
Another record has been broken in North Carolina.
350,000 ballots were cast on Thursday.
Cleta Mitchell, you're there in North Carolina.
I gather you've added to that vote count today.
cleta mitchell
Yes, I went early this morning, Ben.
Nice to see you.
I went early this morning and my husband and I were in line 20 minutes before the polls opened and we were in line.
There was a line, and it took about 45 minutes to get through the line after the doors opened and able to vote.
And I was almost number 3,000 in one of two polling places in my county.
And the thing that is happening is that Trump voters are all going to the polls early.
And I cannot stress enough how important that is.
Historically, it's been the Democrats who go and vote early.
And for the first time, Republicans in North Carolina were matching the Democrats in terms of turnout in early voting.
And it's such an important thing to do to vote early, bank your vote.
Because apparently there's about a 10% drop off of support of people who say, I'm going to vote for this candidate.
But if you wait until election day, things happen.
Your kids get sick, your car gets a flat tire.
Only 90% of those supporters actually get to cast their vote.
So it's really important to go early.
Vote in person.
I'm a big believer in voting in person, ladies and gentlemen.
I do not believe in putting a ballot in the mail unless there's no other alternative.
But I had a friend yesterday, a neighbor, who voted at a different polling place in our county.
And she said that the whole line was full of Trump supporters.
Took her two hours.
And that they all said, President Trump told me to come and vote early, so that's what I'm doing.
I'm not leaving.
I'm staying in this line until my vote is in that tabulator.
So it's great.

Let me ask you this.
Hurricane Helene, which shook North Carolina, shook the country as well emotionally.
Tell me, has that had any residual effects in voting turn up that you have been able to discern?
cleta mitchell
Well, there are apparently big turnouts, even in those red counties in Western North Carolina.
Most of the counties are big Trump country.
There's one area, Asheville, North Carolina, is pretty left wing.
But we are worried about that.
I was just asking this morning if they were from the state Republican Party if they were recruiting people to send to Western North Carolina because there are places that were polling locations that just don't exist anymore or that you can't get to them.
And we have to remember that all of the election boards in North Carolina are controlled by Democrats because the state election board and the local election boards are controlled by the party of the governor.
We have a Democratic governor.
That means every county election board is controlled by Democrats.
Well, we've had a couple of Democratic county election boards, Democrat-controlled, who have violated the emergency election law that was passed by the legislature a week ago and have not added additional polling places because these are Democrat-controlled counties, county election boards, but the counties themselves are Republicans.
So we're trying to figure out what to do about some of the ways that the Democrats manipulate the election, but There are a lot of people, the head of the North Carolina Election Integrity team is on the ground this weekend just trying to find out what's going on in those different counties and what we might need to do in terms of sending volunteers there to make sure that we help make certain that those people who've lost everything, we hope that they won't lose their right to vote.

I know you're deeply engaged now in making sure every vote comes out in support of President Trump, the MAGA movement generally.
What are you asking people to do right now in the 18 days left, I think, before Election Day?
I know you've got a new website to assist in these efforts.
Tell us about that.
cleta mitchell
We have a new website that just went live on Wednesday.
It's called VoteFair2024.com.
And it has something really important.
Jenny Beth mentioned it, and I want to tell everybody, vote your whole ballot.
Look at a sample ballot before you go vote, because this map shows all of the election-related ballot issues that are on the ballots in various states.
I just voted in North Carolina.
We have a ballot measure that I voted for that says, it's a constitutional amendment that says only citizens can vote in North Carolina elections.
All of these states that you're seeing, there are multiple, there are about four categories of election-related ballot issues.
Ranked choice voting is something that the left wing is putting on the ballot in several states, Idaho, Arizona, several different states.
Go to that website, click on your state, learn about if you've got any of these ballot issues and we'll tell you whether it's good or bad.
Because the left wing spends hundreds of millions of dollars putting these terrible ballot issues on.
We do have in eight states ballot issues like the one I just voted for in North Carolina saying only citizens can vote.
And we want to get that in every state constitution, in every state in the country.
But do go look that up.
Go study this and know what's going on in your state.
And vote your whole ballot.
Like, for instance, in North Carolina.
It was very, very important for us to elect Donald Trump and make sure that he gets North Carolina's electoral votes.
But I gotta tell you, we have an attorney general's race.
Congressman Dan Bishop, who is a great MAGA Republican who's coming home to run for North Carolina's Attorney General.
He would be the first Republican Attorney General since Reconstruction.
It's really important for Dan Bishop to win because he's running against a fellow U.S. House member who voted against protecting women in sports.
He voted against the SAVE Act to say that only citizens can vote.
He is a very left-wing person, and if he gets elected attorney general, that's bad for our state.

That impacts how the elections are run.

Colonel Harvey, let's pick up from what we're saying here.
Firstly, let's discuss this drone thing in Israel.
And then I want to underline here that on staying on the same subject of drone warfare, this is now starting, the shadow is now starting to reach over the United States itself and the United States mainland.
Colonel Harvey, just tell us again about what has happened in Israel with regards to the official residence of Prime Minister Netanyahu.

There was a strike today, a large volley of drones and missiles fired again at Israel, but three were targeted at the home of the Prime Minister, Bibi Netanyahu, and two of those drones were intercepted and one did land.
The Prime Minister and his wife were not home and did cause some damage on the ground, but no one was injured.
But this is a significant escalation.
Keep in mind that after the death of Sinwar, you know, the Vice President, the President of the United States, Secretary of Defense, others in Europe have called for this as an opportunity for a ceasefire.
Misguided for sure.
The leadership through and through of Hamas and Hezbollah, which Hezbollah is now being led on the ground by an Iranian general, is these people are determined to destroy Israel.
And any pause, any ceasefire would only be to the advantage of them being able to recover and then plan to start An attack once again.
You don't have a partner to negotiate with there.
Now the issue here is that, you know, Iran is directing the operations in Lebanon.
So this goes directly back to Tehran.
And they have targeted the Prime Minister.
And this is just going to feed into the need to retaliate and defend Israel in order to re-establish deterrence.
It's an important element.
Additionally, the new Hamas leader, Khalid Mashal, who resides in Qatar, is refusing to consider a ceasefire on his end.
And I don't think we want one.
From my perspective, it's not a good strategic outcome at this point in time.
But importantly, everyone should know that The leader is in Qatar, he's protected by the Qatari government, and the Qatari government can survive only because the United States provides it the protection.
We got the largest base in the Middle East there in Qatar, and we are not making any demands on Qatar to turn over any of these leaders that are there, these multi-billionaires that are living there and directing this onslaught against Israel.

Colonel Harvey, let's come to the United States.
Now, there's a development here over Langley Air Force Base, right, which has resulted in the fact that they've actually stopped doing the F-22 nighttime training flights Launching them from a different base.
This is how serious this is.
And it's the same thing about the drone warfare.
Tell me what is going on on United States territory with these drones over military installation.
derek harvey
Well, it's not just at Langley Air Force Base, which is a U.S. Air Force fighter wing base that covers the eastern seaboard.
We have a lot of military capabilities, state-of-the-art aircraft there.
And for this whole year, there have been drones flying around.
A periodically over the base.
Now, these are not just small hobby drones that you might see with, you know, a real estate agent filming with some cameras on it or a small drone that might be over a football game and taking some, you know, video.
These reportedly, according to the commander at Langley Air Force Base, 20-foot-long drones.
Now, they may be off because of some visual problems, and they're flying in swarms with a dozen or more of these large drones, and they show up for a while, they seem to be orchestrated, and then they leave.
And we're just now finding out about this in reports this week.
But, you know, there's been nothing done about it.
There have been meetings.
They haven't shot any of these down.
They haven't been able to follow them.
And, you know, there's a lot of uncertainty.
But given the state-of-the-art warfare that's going on, you know, we have enemies that have infiltrated this country.
You've got China.
You've got Iran.
You've got terrorists.
These capabilities are very important, and they could be lethal.
And I don't think we're taking this seriously enough.

Colonel Harvey, the first question has the answer, I guess nobody knows.
And the first question is, Who's behind this?
But the second question is even more bizarre.
As you point out, these are 20 foot long military drones.
They're not hobby things.
They're not something that you or I could buy off Amazon for a couple hundred dollars.
Why haven't any of these things been shot down?
derek harvey
Well, the lawyers say that it's risky, that you could have some collateral damage falling on a home or something because these are relatively large, so you have that issue.
You would think you might be able to track those and follow them to a bed-down location because there's a dozen or more of them flying.
I would think that we have that capability here domestically.
The FBI, the Federal Aviation Administration, and the Defense Department, Air Force, have all met and tried to consider what they could do.
Nets don't work because they're flying at 3,000 and 4,000, 5,000 feet up in swarms.
I don't think they're taking this seriously enough.
I don't think enough assets have been directed at it.
But they're keeping us in the dark.
But we know this continues to be of concern to the military, and it's of concern to the FBI, but they haven't resolved it.

One of the judges, or the judge in charge of one of his cases, Tanya Chutkin, the most evil person, because she has ordered the release of 1,889 pages, a little over two weeks before the election.
Now, you might be thinking, well, hang on, how can they do that?
Isn't there a 60-day...
There's a rule here to stop either the prosecutors or the magistracy from doing such a thing against a political player in an election.
There is that rule.
Mark Perletta, thanks for coming on the show.
Tell us a bit about the 60-day rule, what it's supposed to achieve, and what is Judge Chetkin's explanation for riding roughshod over these legal protections?

Ben, thanks for having me on.
Good morning.
President Trump has every right to be furious.
This has been going on for years.
The 60-day rule is to make sure that, you know, there's no political interference with an election, right?
60 days out from an election, if you haven't kind of got your case together, you're gonna hold off until after.
What Chudkin does is kind of Orwellian speak, right, to say, No, if I held it, it actually is election interference.
It's just complete garbage, right?
And you can see from all of her conduct this entire case.
This case should have never been brought.
President Trump didn't do anything wrong, right?
And then the Supreme Court.
Slaps down Jack Smith, says that there's this very broad presidential immunity, which everyone knew about.
Because of the posture of the case, they didn't have to rule very, very broadly.
They basically said there is this sort of core immunity, and then presumptive immunity, and then private conduct.
What Jack Smith does, right, is he rushes back into court, right, with a new superseding indictment, keeps in the case, Two of the charges that the Supreme Court had ruled in the Fisher case had twisted the law, right, in terms of an official proceeding, interfering with the official proceeding.
And then calls all of his presidential conduct Private conduct to get around the Supreme Court ruling.
And then to kick it off, to show how much of this is kind of election interference, how much Jack Smith and the judge are hellbent on ruining, trying to impede President Trump's re-election is that usually when you do a superseding indictment or an indictment, the defendant gets to answer and say, this is wrong, this is why this is wrong, this is my objection.
And then the defense files a response.
What she allowed Jack Smith to do, right, was to file a motion on presidential immunity, which was this filing, this 165-page filing, and then these documents that she just released, as you said, 1,800 pages.
Which is clearly election interference.

Mark, let me read her the sentence, the killer sentence here, of her so-called justification.
And the Warren posse can decide for themselves.
She says this, if the court withheld information that the public otherwise had a right to access solely because of the potential political consequences of releasing it, That withholding could itself constitute or appear to be election interference.
Give me 30 seconds, Mark Peter, because that sounds to me like an attempted October surprise in judicial garb.

It is an October surprise.
There is no right for the public to have anything, right?
The defendant in a criminal trial is the defendant who has a right to a fair trial.
So this idea that the public has to know this information is nothing other than we wanna get this information before the American people so that we can try and ruin Donald Trump's chances.
As we know, We need to keep focus, but this is not going to work, right?
They are throwing everything at Donald Trump.
They are trying to stop him, and it has failed repeatedly, time and time again.
And there needs to be an investigation into this.
President Trump needs to shut this down.

Can the war room posse reasonably conclude that this Is this unprecedented release of documents, and of course in the United States, as in the UK, a man is innocent until proven guilty, is this unprecedented release of these simple accusations,
never been determined yet in court, might it be reasonable for the Warren Posse to assume that the DOJ specifically Garland might be behind this.
And then my follow-up question to answer is, slightly anticipating your answer, of course, is does this not corroborate everything you said on this show earlier on in the week about the absolute necessity for Donald Trump to exert operational control over the DOJ from day one?

Yeah, Ben, Jack Smith works for Merrick Garland.
Merrick Garland is behind all of this and is fine with all of it.
It's unprecedented in so many ways.
Even left wing commentators like Ely Hon has said that this is outrageous and Jack Smith is breaking every rule to get to Donald Trump.
So yes, this is the Biden DOJ. It's been weaponized and weaponized and weaponized against the American people and Biden's political enemies in its It's unprecedented and it's despicable.
Yes, Donald Trump, as I've written, as we talked about yesterday or the day before, the president is the chief executive who supervises and controls the Department of Justice.
And on day one, my recommendation is the president should fire Jack Smith, kind of completely terminate this January 6th office.
Right?
They should set up a special task force to review all the convictions that have come about because of this attack.
And whether there's pardons or commutations of the people who have been unjustly convicted or sentenced.
And the president should, as I said, and as every other president has done, assert operational control over the Department of Justice.
This goes all the way back to our foundings.
George Washington, Adams, Jefferson, but even in the modern day, presidents are required to, under the Constitution, supervise and direct the Department of Justice.
The Department of Justice works for the president.
The FBI works for the president.
And so this has been just the weaponization that we've seen to go after the American people and political opponents is unprecedented.

Some people listening to this show, Mark Peleta, will be saying, you know, at the end of the day, I don't want to see a politicized, weaponized DOJ. And to that end, I don't think Donald Trump should continue to use it.
And my question to you is, have we...
In answer to that question that people will be posing, has America not moved beyond that stage now?
And isn't that the appropriate thing for President Trump to do in coming into his second administration, to do exactly what you said, to keep this weaponized DOJ and turn it on the very people who've been responsible in the present administration for its weaponization?

Yeah, the way I look at it, Ben, what the Biden people have done has been to contort the law, to make up violations, to get smacked down by the Supreme Court for inventing things or breaking all norms.
What I'm talking about are people who have broken the law, people who have conspired to use the law to take out political opponents.
That's completely different.
Right.
That is enforcing the law.
That is making sure that you have your priorities of what is important.
OK, to look at going after the Department of Justice is nothing.
Right.
When you when you saw pregnancy clinics getting attacked and desecrated and threatened.
And the Department of Justice does nothing.
As president of the United States, President Trump should say, yes, I'm gonna look at that.
I will prosecute those people.
On the anti-Semitic attacks across the country where the Department of Justice has done nothing, the president can say that is a new priority, okay?
So on this stuff, with this election interference, with this election attack, you know, Jack Smith, Right, has been violating Department of Justice procedures.
He had been conspiring, right, to bring these charges against the president.
So that's not weaponization, in my view.
That is applying the law, okay, that's been broken, or at least investigating it and looking into people in that regard.

My final question to you is, looking at Judge Trutkin's I don't know if there's no reasoning here on releasing this information.
It would appear to me that if that logic were to be applied generally, this six-day rule would not exist at all if withholding it might affect the outcome of an election.
What can Donald Trump do to Judge Chupkin?
What would be a legitimate response on behalf of the President of the United States to do on day one of his new administration to a judge who has done something like this?

Well, again, I think judges can be impeached, right?
So that would start in the House of Representatives.
He could ask the House of Representatives to look into her conduct.
If you look at all of her conduct, it's clear that she is trying to get Donald Trump and use the criminal justice system to get Donald Trump.
One quick, going back through history, right?
Cuz I've been around a while.
I think I've mentioned this before, but an independent counsel, right, indicted Cap Weinberg on the Friday before the 92 elections to get George Bush and a judge, a different judge, after the election dismissed those indictments, okay?
He believed in the rule of law.
But the point is, is that I think Judge Chuckin has been arm in arm with Jack Smith Trying to get Donald Trump changing the procedures of how criminal trials are done in order to get the Smith information out there to try and harm Donald Trump.
But I think judges are appointed for life.
They can be impeached if the president wants to go to the House of Representatives and say, look into this election interference that this judge engaged in during this past election cycle.

Mark Pelletta, most people think the conventional view is that the Republican Party will take the Senate but lose the House of Representatives.
I like your idea of an impeachment against Judge Trickema here.
Folks, to make that happen, you need to have also control of the House of Representatives.
Republicans need to take both houses.
Those down-ballot elections couldn't be more important if something like this might have hope of going ahead.
