Simply stated, there is no doubt that Saddam Hussein now has weapons of mass destruction.
There is no doubt that he is amassing them to use them against our friends, against our allies, and against us.
The House panel investigating the Capitol riot has enough evidence to refer former President Donald Trump for criminal charging.
That is according to Congressman Liz Cheney.
During an appearance on CNN's State of the Union show, the Wyoming Republican called the January 6th attack a well-organized and well-planned effort to try to overturn an election.
Dick Cheney and Dick Cheney in drag, which is his daughter.

It's Wednesday, October 16th in the year of our Lord, 2024.
On full display, is that lying, I guess, is a birthright of the Cheney family, though I guess their, shall we call it, America's last genealogy is best seen on foreign battlefields where you guys, the war room posse, your children have to fight their wars that line their pocketbooks, and of course, a banger from Stephen K. Bannon.
But in the same way, right, they found evidence of the weapons of mass destruction, just like they have evidence that President Trump plotted a coup, insurrection, right, all those nasty, nasty words.
So we're only surprised they didn't accuse Saddam Hussein of trying to, you know, grab the wheel like Cassidy Hutchinson did, right?
Well, here's the thing, right?
In the same way that they lied about the WMDs, that's what they're doing now with January 6th.
And it's quite telling, right, when people like Dick Cheney, who you could argue, in some ways were the architects of the sort of new style forever wars that we see going on here in the United States.
Well, I guess it'd only be fitting that his daughter, Liz Cheney, would bring that back to the home front and declare the new forever war on you guys, on MAGA, and to lay the predicate in the same way that they looked at whether it was the weapons of mass destruction or 9-11 as the pretext, the predicate, to expand all that.
Now it's January 6th, right?
And of course, there are texts breaking last night showing that Liz Cheney was in secret, confidential communication with that star witness, Cassidy Hutchinson, for a while.
I'm sure she was probably coaching her on what to say.
I mean, she went as far as to give her a brand new lawyer, suggested that she frankly drop her old.
This was all coordinated by Alyssa Farrah Griffin, someone who conveniently escaped Trump world and now has a nice seat on The View, though I don't envy you for having to sit next to those people.
But it's quite interesting because let's play, Denver, what Liz Cheney used to say about people who were trying to intimidate, meddle, or otherwise interact with January 6th committee witnesses such as Cassidy Hutchinson.
It's projection at its finest.
Let's roll it.

So you think some of the testimony you received wasn't truthful because people were threatened?
The way that I would put it is that it gives us a real insight into how people around the former president are operating, into the extent to which they believe that they can affect the testimony of witnesses before the committee.
And it's something we take very seriously.
And it's something that people should be aware of.
It's a very serious issue.
And I would imagine the Department of Justice would be very interested in and would take that very seriously as well.
In fact, Cheney told me that the committee may make a criminal referral to the Justice Department recommending that anybody that attempted to influence witness testimony before the committee be prosecuted for witness tampering.
After our last hearing, President Trump tried to call a witness in our investigation.
A witness you have not yet seen in these hearings.
That person declined to answer or respond to President Trump's call and instead alerted their lawyer to the call.
Their lawyer alerted us.
And this committee has supplied that information to the Department of Justice.
Let me say one more time, we will take any effort to influence witness testimony very seriously.

Yeah, that person probably didn't take Trump's phone call because they were too busy on the phone with you. And my only question was, Cheney, was that one of the phone calls where you were coordinating Cassidy Hutchinson's new lawyer?
And I just want to draw a nice, stark juxtaposition. You know, we say it's a two-tier system of justice.
Frankly, it's a two-tier system of governments, of country, right?
Frankly, it's illegal aliens and everyone has to foot the bill to subsidize their lifestyles.
But remember, it's the January 6th defendants who have been slapped and stuck with public defenders who are busy assigning them books to read to essentially woke-ify them.
Make them denounce their support for President Trump, calling them white supremacists.
Denver, let's put the picture of the new beautiful profile piece that New Yorker MAG did on one of the public defenders who's been tasked with representing so many January 6th defendants.
You think she's preaching the gospel of MAGA to these people?
No, I can tell you she's not.
I watched the New Yorker little film on her.
She's busy assigning them books, making sure that Trump supporters who dared to go to the Capitol on January 6th, not that January 6th is just taken out of their vocabulary, of their memory.
She doesn't want these people to support President Trump anymore.
By the way, I will say it is funny that they did a whole glowing profile piece on her trying to paint her as like the patron saint of January 6th.
It harkens back, I don't know about you guys, but to that Atlantic Magazine piece where they called for pandemic amnesty.
Right?
They're like trying to kind of lay the groundwork.
Oh, this lady's really nice.
No, no, no.

You're not going to reframe the narrative of what you did to the survivors of the January 6th persecutions.

And those clips didn't age too well, Liz Cheney.
I'm still holding my breath for criminal referrals, prosecutions against you for doing what you outlined in those videos, right?
I know you love to ramble on about stolen votes and how President Trump is such a threat to democracy, right?
The only stolen votes...
That you're responsible for are those of the thousands of Americans that you, your father, your family have direct blood on your hands for, for killing the most promising, young, patriotic, red-blooded generation that this country has ever seen, sending them overseas to die in battles, to defend the borders of other countries, and to line your pocketbooks.
And let's be frank, that's why you don't like President Trump.
Right, just today they announced an additional, I think, $425 million in Ukraine aid.
I joked that maybe that was just, you know, a feel-good for Liz Cheney since she's so sad about her texts leaking.
So, right, when the same people who say that there's so much copious amounts of evidence that the weapons of mass destruction exist, when those same people say that there's no evidence of a stolen election, I don't know about you guys, to me it almost kind of sets the case, right, settles the case that it's true that it was.
It's also quite interesting, too, because all these text messages are coming out on the heels of continued reporting showing that senior DOD officials, Mark Milley included, refused President Trump's orders to have, whether it was the National Guard, the military, I believe the quote was, whatever you need.
To make the events of January 6th unfold, shall we say, peacefully and patriotically.
And what did he get from those Pentagon officials?
Well, to quote Tim Waltz at a recent debate, a damning non-answer.
But that's precisely the point.
That damning non-answer, that damning non-response from the National Guard, from the military.
It wasn't about optics, right?
That's what they say they were so concerned about.
No, no, no, no, no.
It was the insurance policy.
It was OPSEC to make sure that the operation that was January 6th played out in full so they could use it and turn it into the original sin of the MAGA movement, right?
That's why they have to crush MAGA. That's why we need a new domestic terrorist warfare operation that's coming for people like the man who should be rightfully sitting in this chair right now.
It's why you're stuck with me.
And frankly, Liz Cheney, I would think you love transparency and democracy so much, you should be the number one cheerleader pushing for the Inspector General's January 6th report to come out, yet I haven't heard a peep from you on that.
It's because you know that it would undercut your narrative when you're not too busy working backroom deals with witnesses to lie to you to save your failing, desperate sham of a show trial.
And here's what this all goes back to, right?
I'm sure that you could find similar messaging chats between the impeachment witnesses and all the Democrats who helped coordinate that.
I want to note, right, it's quite interesting that they're coordinating on Signal, an encrypted messaging app, right, kind of a buried lead there.
I'd also just add the two attempted Trump assassins, they also had Signal accounts, right?
But this is what it's all about.
I want to play a clip with the former head of the RNC, Michael Steele, of course beloved by this audience, and some crazy harpy, I don't even know what word to use, we'll say rambling, rambling on about the MAGA movement and what all of this, and keep in mind this clip juxtaposed it with the event that you see going on in Pennsylvania right now, the Adam Kinzinger's of the world standing up on stage with Kamala Harris holding a stupid rally that looks like it's attended by people less than 2020 and Joe Biden.
This is what it's about.
Let's play it.

Speaking to this idea that if you want your Conservative Party back, if you're like, but I am a Republican, I've always been a Republican, you're like, your party was consumed by MAGA. It is gone.
If you want your party back, you must destroy MAGA. And to do that, that's not just not voting for Donald Trump, that's voting for Democrats up and down the ballot until MAGA and election deniers and these perpetual liars are destroyed.
And then you can build a wonderful conservative party out of that.
Because like I said, there's going to be plenty of time for us to disagree about 25% tax rates versus 31% tax rates.
And do we have wealth taxes on people that made this much money?
Or do we have public school systems that are funded this way?
We can have those discussions again, but not if the government itself no longer works.
Because we gave the power to a wannabe autocrat and his oligarch backers.
We have to be smart about that.
And people like Liz Cheney and Dick Cheney and Adam Kinzinger, and those people are smart about that.
Even Mitt Romney, he's being quiet.
You know he's on the other side.

And that clip, I think, frankly, undergirds everything that that whole Vanity Fair profile piece was talking about.
This show, Stephen K. Bannon, right, forcing the conversations on issues that most elected Republicans don't want to actually have.
But let's get this straight.
Michael Steele, Liz Cheney, Adam Kinzinger, Jack Smith, all those people.
Right, the ones who put country over party, and they're too idiotic to realize that they're basically holding a party for the country being over, if you look at the signs.
I don't want to debate marginal tax rates, right, 30% versus 21%.
No, I want to debate how long prison sentences should be for people who've committed treason and are traitors and do things like Liz Cheney does.
Operating behind the scenes, lying to the American people, misappropriating your taxpayer dollars to create artificial show trials so they can lay the pretext and groundwork to come after political movements that they don't, they know, right?
They know that our movement is growing and it's so popular, I'd say just look at the polls.
And instead of trying to win the battle for the hearts and minds of Americans, because they know their ideas are so woefully unpopular, they have to crush it.
In true authoritarian style tactics, right?
I always say that's the circumstantial evidence that you know these guys are in business with the Chinese Communist Party, right?
It rubbed off on them a little too much.
Dick Cheney's probably real anger with what unfolded on January 6th is just that there wasn't another forever war that he could have deployed all of those patriots to to go and die defending the borders and frankly storming the capital of other countries besides the United States.
That's your big gripe.
And you're also mad that you're so unpopular even if you wanted to muster a mob like you guys always say President Trump did.
You don't even have enough supporters to actually do that.
Yeah, let's just look at your primary numbers, Liz Cheney.
Or maybe that's what democracy looks like, right?
No, democracy looks like you guys treating American citizens like trash.
And MAGA is when we push back.

Here's your host Stephen K. Bamm Welcome back to the war room where we are joined in studio by the one and only Jeffrey Clark Now, I wanted to have you on because I wanted you to walk through, in the detail you always bring to this show, these text messages and how...
Well, we'll get into the bar complaint stuff because there's a bunch of irony there.
But just walk us through the messages and how serious breach of conduct from the Liz Cheney side of things.

Sure.
So the text messages show that Liz Cheney is talking to a represented party.
Cassidy Hutchinson was represented by a lawyer named Stefan Posentino at the time.
And it's just the most basic ethics no-no in terms of modern lawyer ethics law, not to contact parties you know to be represented unless you do it through their lawyer or unless you get the consent of the lawyer to do that.
And this is something that the Justice Department observes.
This is something that every lawyer I know of observes.
But Liz Cheney obviously thinks that she exists in a different sphere, Natalie.
And I think that it is an amazing breach of ethics for her to be reaching out and coordinating with Cassidy Hutchinson in order to change her story.
And this is why she had so many depositions.
I think she had four.
And it's why she had errata sheets that are the likes of which I've never seen.
They're not really errata.
They're just revisions because she changed her story.
Coordinating with Liz Cheney and then we have also that she's working with Liz Cheney to change her lawyers.
And I think by extension that puts those lawyers on the hook for legal problems too because if they had any knowledge of the fact that Liz Cheney was conversing with Cassidy Hutchinson, when she was represented by Stefan Posentino, that's another no-no.
And you can't do that via a cat's paw approach, Natalie, where you sort of use Liz Cheney and then you try to say, well, it's going through Congress and somehow it's different.
And I'm entirely convinced of this, much like I've said to people many times, that if the polarity reverses against Jack Smith at some point, he is going to pull out of his back pocket the idea of prosecutorial immunity faster than your head will spin.
Which is, of course, a great irony, given the fact that, of course, he argued that President Trump has no immunity.
And he lost that big time on July 1st in the Supreme Court.
Similarly here, I would suspect that if ethics authorities started nosing around this, they're going to hear from Liz Cheney and her lawyers of, oh no, I have speech and debate clause immunity, so I can do whatever I want.
So great irony to that.
And then I have a personal stake in this as well, Natalie, because in my view, and I think it's a basic interpretation of the Supreme Court immunity case, I also partake of that immunity because the immunity, one of the key immunities that the Supreme Court discusses is the ability of the president, the need for the president to be able to consult with the Justice Department and then when he does that, he's immune.
Well, you know, that's an immunity that's not worth very much if the other side of the conversation can be penalized and I was on the other side of that conversation.
So, you know, you just have rank hypocrisy up and down the boards on this And, you know, it's just, it's such a delicious irony to see Liz Cheney, and I hope she's squirming at this point, you know, for these text messages to have been released by the heroic Congressman Loudermilk, showing the coordination between her and Cassidy Hutchinson and Alyssa Farah behind the scenes.
And I'm trying to locate this Washington Post story.
You know, you may know it.
Maybe I'll crowdsource it with the Warren Posse to see if they can find The best audience.
I'm sure they can.
And so, you know, this is something that we need to make that story evergreen and get it back out.
And maybe I can't find it because it's been memory hold.

Well, it's hypocrisy because they know they can get away with it, right?
And just for the audience, reading some of these text messages, you know that they know what they were doing was wrong.
This is from Melissa Farah to Cassidy Hutchinson.
She agreed to keep our convo totally confidential in reference to Liz Cheney.
And Cassidy Hutchinson texts Liz Cheney saying, I'm so sorry for reaching out this way, but I was hoping to have a private conversation with you soon, if you are willing.
And of course, Liz Cheney was willing.
But I think one of the buried leads, And the sort of info dump that we saw last night from the Loudermilk office was how they weaponized the bar complaints, right?
They weaponized the sort of character assassination against Cassidy Hutchinson's first lawyer.
And I think you sort of see the threat of that coming out in, like I said, the documents last night.
Can you walk the audience through that angle of the story as well?

Sure.
Look, I think that what happened with Cassidy Hutchinson turning on Stefan Posentino is really unconscionable, right?
She was getting free representation and he's a lawyer who knows this territory, the terrain, very well.
And she basically says that he was coaching her to lie and to purport to not remember things that she said she remembered.
And I just don't buy that.
I think that a lawyer who would counsel that would have to be someone with a sub-40 IQ and Stefan Posentino is definitely not in that category.
So to be willing essentially to throw someone who is – I'm sure that she told...
Anyone she interviewed with in the Trump administration to get into the White House apparatus, whether it's Mark Meadows or other people, what she did with Liz Cheney is just more than – I know that it's a circle, right?
But it's more than a 180-degree turn because it's like a turn 180 degrees and then a descent into hell.
I don't know how someone can really be that base and low.

And walk us through the latest assault ties, like you were saying, back to the Jack Smith stuff.
We'll hold you through the break, but we've got a few minutes to start going through the latest on the Tanya Shutkin hearing decision.
Obviously more election interference.

So, look, here's what's happening with that.
President Trump wants discovery into various documents, and here's the rough list of those.
You know, a report of the intelligence community from 2016 on Russian interference, and then there's also a 2020 report on election interference.
Magically, of course, the intelligence community concludes that there was Russian election interference in 2016, but there was no significant election interference in 2020.
President Trump wants to see those things and wants to explore whether they were properly treated differently and whether that bears on his state of mind.
These are all very key elements potentially of a defense that he had no criminal intent.
He just thought that the election was corrupt in various ways that I also believe that the election was corrupted and he had that good faith belief and therefore this whole fake January 6th narrative should collapse.
And instead, the judge is upholding what Jack Smith wants to do, which is to artificially constrain what the universe of documents is that Trump can see and use in his defense.
And I think that is a flat violation of constitutional due process in the Fifth Amendment.
That is not going to survive appellate review, but it's designed, I think, to dirty President Trump up in the lead-up to the most important election in our lifetimes.

I'm just reading Julie Kelly's always ahead of the curve on this stuff, but that a lot of the phones that they obtained from Secret Service agents to try to, you know, get information that those phones, oh, conveniently had been wiped.
So just for the audience, what is sort of the time frame that we should be looking for?
I know they were saying that the appendix to the 165-page filing was set to come out in the next few days, but what are we tracking on that?

I think that's the next big shoe to drop, Natalie, is when will that appendix drop?
So we're talking about all of the...

And what exactly is the significance of the appendix?

The appendix includes all of the backup documents for the 165-page brief.
So we're talking about excerpts of grand jury testimony.
We're talking about FBI interviews.
We're talking about documentary evidence.
We're talking about evidence seized through warrants for things like people's phones or government phones.
And you'd be able to read the entire narrative behind it.
The number of pages that's going to comprise is going to be a lot more than 165.
And it's just going to cause another feeding frenzy of the MSNBCs of the world to say, oh, here's what we found on page 62 of this grand jury bit of testimony.
Especially if they find something from Vice President Pence, they're going to highlight the heck out of that and try to use that to bash President Trump.

Jeff, before you bounce, we know that Kamala Harris does not want to indulge or engage with you on the fact that you've been exposing her abysmal, shoddy—I don't even know if it's a track record because there is none—in terms of her prosecutorial genius.
So give us the latest on where we stand.

So the latest is that the New York Times is running away from me now, too.
I had seen a story by Robert Draper, who is interestingly enough the grandson of Leon Jaworski, the special prosecutor, the second one against President Nixon.
And he quoted someone who was a colleague of Kamala Harris in San Francisco saying, I watched her do an argument and it was textbook.
I've never seen anything like it.
I've never seen anyone do better.
So I contacted Mr.
Draper on Saturday afternoon and I said, you know, do you have a transcript?
Did you check out what your source was telling you before you printed his quotation?
And the answer to that was crickets.
No response from Draper whatsoever.
I can only conclude that he did not check it out, that he got a favorable quote about Kamala Harris propping up the mythology that she was a wondrous prosecutor, and he stopped.
And that's just not responsible journalism.
And I think that the New York Times needs to be called out for it.
You know, these folks think that basically they are entirely unaccountable.
And yet, you know, what they do drives what MSNBC does.
And then it turns into all of these crazy lawfare podcasts, like the clips you showed from Michael Steele and the various guests he has on, right?
It's all downstream of the New York Times.
And if you find the New York Times isn't doing a good job, that's pretty damning.
And I still challenge anyone, produce a transcript for me of Kamala Harris Giving an argument that is at all complex and being the first chair in a criminal trial.

Pennsylvania is such a mess. Inside Team Harris's unusual levels of finger-pointing.
You're obviously on the ground in Pennsylvania a lot.
I want you to kind of walk through this story, what you're seeing on the ground in Pennsylvania unfold.

And as people know, I spent the entire weekend driving all around the state of Pennsylvania and specifically spent some time in Philadelphia.
I just did the show there from Philadelphia a couple of weeks ago when they had the debate.
And look, Holly Otter being over at Politico.
I know Politico is largely Pravda.
Certainly Playbook is Pravda.
It has become and devolved into that.
And Ryan Lizza is a little bit indisposed at the moment.
I'm not really sure What he's getting into, I guess you'll have to check the tabloids for that one or maybe check with RFK. But when it comes to this report out of Holly Otterbein at Politico, look, she's done the reporting.
This is highly and deeply sourced.
She's got the actual information from Kamala's team right there and from people in the Democrat Party in Pennsylvania saying, what is Kamala She's not going into the city.
She's not meeting with local leaders.
She's not talking to anybody who's actually on the ground or has been part of these union channels or the religious channels.
The big pastors there in Philadelphia.
She's not interfacing with any of them.
Now, what's interesting is a lot of these same complaints you actually heard all the way back in Philadelphia and Pennsylvania in 2008 when Barack Obama ran.
The difference was that Obama built his own separate parallel institutions to the Democrat Party of Pennsylvania in 2008 when he ran.
Kamala Harris has none.
She has nothing like this.
And this campaign manager, Nikki Liu, that she has, who's really at the center of all these allegations, has no clue what's going on.
So you pair this with the Philadelphia Inquirer article that came out just a couple of weeks ago, saying that in these working class wards, the city wards there in Philadelphia and the precincts, where it's black working class, Hispanic working class, and white working class, like Northeast Philly and South Philly.
South Philly is basically Rocky Philly.
I always tell that it's like Rocky, Philly, Kensington, by the way, is where Adrian's pet shop used to be in the movie.
Those areas are all breaking Trump.
You know why?
Because people are sick of the crime on the streets.
People are sick of the fentanyl zombies running up K&A at the boulevard there.
And people are sick of how the city is going.
And they're blaming it all on the people who are currently in power.
They know that Biden and Kamala Harris want nothing to do with them.
And they're all sitting there going, you know what?
We don't necessarily like Republicans, but we're going to give this guy Trump a real big shot.
So if that machine in the city of Philadelphia doesn't turn on for Kamala Harris, it's going to be very, very hard for her to win Pennsylvania.

Anytime you hear in the mainstream media them sort of starting to normalize the idea of election delays, it always seems like they point to Pennsylvania as one of the prime examples, right, of the red mirage turning into the blue victory.
So when you see stories like this of the Harris campaign seemingly not really taking their ground game in Pennsylvania all that seriously, does that in some ways alternatively raise a concern that you think that they're prepping ballot fraud operations or stuff like that?
How should the war room posse interpret this story from the lens of election integrity?

Well, look, it really comes down to what Josh Shapiro wants, because if Josh Shapiro wants the machine turned on in Pennsylvania, he will turn it on.
If he wants it turned off, he'll have it turned off.
Remember, Josh Shapiro was humiliated by Kamala Harris just prior to the DNC when she passed him over for this Interesting character, Tim Walls, out of Minnesota, predicated mainly on these ideas that this was the guy that the unions wanted.
The unions wanted nothing to do with Mark Kelly out of Arizona.
But now, Natalie, what I'm hearing from my internals is that we've got people pointing the finger at Kamala Harris and her leadership team, like Tony Harris and so many others, saying, look, you know, these people are...
They suggested that we could have picked a governor or a senator from a swing state.
They didn't do so.
And now they are going to be the ones who pay the price.
Really, though, something that I think the war room posse should be focused on when it comes to these ballot operations is Michigan, because Michigan is the state that the Harris campaign has gone all in on in the Rust Belt.
That's where they post just pound for pound.
That's where they put the most bodies.
If you look at Detroit, Detroit is already starting to overperform what a lot of people looked at in terms of the numbers for their ballot return operations.
Why is it that Detroit will be running ahead of ballot returns?
It's very interesting.
Well, I think we all know what that is.

There was a wonderful moment in the most recent presidential debate between Trump and Kamala where he said this.
He was, of course, fact-checked by David Meir, but...
Trump was right again.
Trump vindicated as usual.
Now, the top lines that they're running with, they're saying that crime actually increased by 4.5% in 2022 instead of dropping 2.1% per the FBI's stealth edit revision.
But Jonathan, it's almost worse than that.
Walk us through the numbers.

For this segment, I'm going to have to put on my noticing hat here, okay?
We're going to get deep into the numbers here.
If you dig in, when you look at the revised stats, you're talking about a difference of almost 80,000 violent crimes, 1,700 murders, 8,000 rapes, 33,000 robberies, and 37,000 aggregated assaults that went unreported in the initial data.
And by the way, the FBI, when they did this revision, they did it in a totally stealth manner.
Make any announcement about it at all.
It was only because of the reporting by RealClear Investigations and John Lott and his team that they were able to uncover this new data.
And by the way, it's even worse than that.
The scandal is much, much worse than that.
For a long time, the FBI has been juking their crime stats.
And by the way, the Democrats have been using the FBI crime stats as talking points.
You mentioned David Muir fact-checking Trump on this.
They've been running headlines in AP and elsewhere touting the success of the Biden administration and fighting crime.
And according to the FBI's numbers during Biden's administration, crime has fallen by 5.8%.
But none of that is true.
If you look at the National Crime Victimization Survey, which by the way is a much more thorough database, Total violent crime over this three-year period has risen by 55%.
And I think it's really important to dig into the numbers here.
So rapes are up 42%.

This is a systemic problem issue that they've been doing for so long.

Violent crime is way up across the board.
If you look at the NCVS data, it's double the next largest rise in crime in any three-year period.
And the truth is people aren't dumb.
People see this.
And despite the lies about it, despite the attempts to gaslight people into thinking that crime isn't a problem, people see what's in front of them.
And it's the same with inflation.
It's the same with immigration.
It's the same with, you know, what they did with the labor statistics and revising their jobs numbers by a million people, revising down the numbers from last March.
I think people are just fed up with this.
People are fed up with being lied to.
I previously was in academia and I still have one foot in the liberal milieu.
