The appeals court is going to rule however they rule, and then it's going to go to the Supreme Court. | ||
And so they're going to have, the Supreme Court is going to get another look at this, at the way Jack Smith has presented this evidence. | ||
But importantly, when they do that, they will at least be unable to run away from the factual contentions as laid out by Jack Smith, right? | ||
I mean, one of the things that was most enraging about both the oral argument and the ruling by Chief Justice Roberts in the immunity case was they kept saying, whatever the facts are here. | ||
We don't need to engage with what actually happened here. | ||
This is just high-minded constitutional thinking that we're doing here. | ||
We don't need to get into the specifics of what actually happened. | ||
Well, yeah, you do, because your ridiculous immunity ruling makes us have to parse every individual action to decide whether it's capital O official or lowercase o official or not official at all in this bizarre system that you made up. | ||
But that means we need to go through the facts of every single one of these things. | ||
And here's the factual record and him saying so what when he was confronted with the physical peril that he had put his vice president in. | ||
Here's him saying the details don't matter when he's told by his own legal counsel that what he is proposing is illegal and will not stand up in court. | ||
I mean, the factual record here is for the public, but it's also to, I think, ultimately embarrass those justices if they want to keep the charade going through another round of appeals. | ||

The latest attempt from Jack Smith looks like they're getting real clever with the language. | ||
They're going after President Trump as a guy that's not president, but who actually is president, and that looks like the basis of their case to a non-lawyer. | ||
But that's why we have Julie Kelly on. | ||
Julie, what is the latest move here? | ||
Does it have any footing or strength to it whatsoever? | ||
Good morning, Dave. So as I have written, and you know I've covered this case from the very beginning, This dirty dossier. | ||
We had the Steele dossier in 2016 and 2017. | ||
Now we have Jack Smith's Dirty J6 dossier for 2024. | ||
And that is what this 165-page quote-unquote motion represents. | ||
It is nothing more. | ||
A lot of it, Dave, is rehashed from the January 6th Select Committee. | ||
But okay, that was a political document. | ||
In a political partisan process. | ||
There is supposed to be some boundary to protect, to process the rule of law. | ||
And what we expect from our top law enforcement agency, the Department of Justice, to not turn a political document into a legal motion or an indictment, which is, of course, what Jack Smith has done again here. | ||

statements in her courtroom in J6 cases. | ||
So all this is, Dave, is more cherry-picked evidence from grand jury testimony, from FBI | ||
documents, from records that they took from the J6 committee, to now seed more damaging | ||
J6 stories in the media. | ||
You saw this yesterday. | ||
The sets of CNN and MSNBC, it was like New Year's Eve to these people. | ||
I mean, Jake Tapper is on CNN. He's waving this 165-page dossier. | ||
So excited. | ||
You know, there are smiles all around the set because they finally have something they can sink their teeth into. | ||
And this is an egregious, probably the most brazen, Example of DOJ election interference, and you know there's a lot of examples. | ||
This is the worst example. | ||
A rogue, unconstitutional special counsel advancing a case that will never go to trial, never get to trial, even if Donald Trump loses. | ||
This is his opening argument in a paper trial against former president. | ||

For the non-lawyers out there, if this thing gets to the Supreme Court or whatever, what do they have to rest on? | ||
Do they have anything? | ||
Or are we just doing lawfare right out in the open so they can cede the press, as you just said? | ||
Well, Jack Smith knows this case is going nowhere. | ||
And let's remember what this new indictment, superseding indictment, is. | ||
It is a four-count indictment. | ||
Three conspiracy charges, conspiracy to defraud the U.S., conspiracy to deny rights, obstruction of an official proceeding, and conspiracy to obstruct. | ||
Now, Abe, this is important. | ||
Those last two counts that I mentioned were overturned by the Supreme Court in the Fisher ruling, the landmark 1512C2. The Supreme Court on June 28th reversed how the DOJ They had intentionally misinterpreted the language in that statute that represents the most common felony in J6 cases and half of Jack Smith's J6 indictment. | ||
They said the way that the DOJ has been using it is illegal, unlawful, and kicked it back down to the district court and now here. | ||
So the way Jack Smith is again misinterpreting it, which will force the DOJ to prove If Donald Trump somehow destroyed or impaired records or evidence, he's not going to be able to do that. | ||
So take the Fisher ruling. | ||
Half of his indictment is already illegal. | ||
Now add the Supreme Court immunity opinion that said both of these communications, especially the Mike Pence communication, and this is really crucial here, Chief Justice writing for the majority said that those communications between Donald Trump and his vice president are presumptively immune. | ||
And that the government, the DOJ, Jack Smith, they bear the burden of proof how it's not immune. | ||
So this is what is mostly in his new dossier, his motion that was unsealed yesterday, trying to explain how what Donald Trump did in office was purely private and political, that his communications with Mike Pence were political and private, not in his official capacity as president. | ||
What this represents And because they only see this through the lens of Donald Trump, if they get their way, which they won't, is criminalizing any political activity by a president in the White House. | ||
That's what this would be. | ||
So this is why it's a folly, Dave. | ||
That's why it's not going anywhere. | ||
Jack Smith knows it. Tanya Chutkin knows it. | ||
Everyone knows it. This is a purely political, partisan move. | ||
The press is eating it up. | ||
And at the end of the day, this will all go away in the higher courts, whether appellate, certainly the Supreme Court. | ||
But it doesn't matter because they're going to get their headlines. | ||
The fake ones we saw last night and today that Donald Trump called for a riot is not what that document says. | ||

The folks at the lower end of the distribution are starting to figure out what's going on | ||

For people that are here illegally and so the people that are the citizens that actually have the right to vote say look we've had enough of this we can't we're not allowed to live in our homes we're not allowed to live in our neighborhoods and even if we are they are unsafe and not to mention we can't afford groceries we can't afford rent we can't we can't afford electricity bills or daycare payments because we don't have a job and even if we did the prices are so high That it's just unaffordable. | ||
And this has all happened in the last three and a half to four years. | ||
And they say, look, when Donald Trump was president, at least we know he was for America and he was fighting for the things that we believed in, which is America and reasonable prices and freedom, where we could just find our way out and make a better life for us or our children. | ||

For the sake of these people that are here illegally, and that's of course done for political reasons. | ||

I see millions of more dollars coming in just to my race alone from across the country, San Francisco, New York, Los Angeles. | ||
None of these people live or work here, but they're pouring in the millions of dollars to try and flip this seat and make sure that Pennsylvania goes blue instead of red. | ||
People in Pennsylvania get it. | ||
We are energized. We just don't know if we can outperform all this huge amount of money. | ||
It's just an unbelievable tidal wave of money and leftism and leftist messages pouring in | ||

How did we get here? | ||
What's going on? Well, look, the first thing people need to understand is that when you're talking about the Biden administration, which I guess we can use that expression for shorthand, even though he's functionally in charge of nothing. | ||
Look, this is a continuation of the Obama administration. | ||
You walk through like every key position, particularly on national security. | ||
Anything to do with intelligence, the military, national security, this is Obama's team and its policies. | ||
So what have those policies been toward Iran? | ||
You know, people say things like weak-kneed, spineless. | ||
I think, honestly, Dave, that's too kind. | ||
And it misses the fundamental point. | ||
The point is not that these guys understand the threat from Iran and that they're bad guys. | ||
And again, as General Perry said, and by the way, I have nothing but immense respect for him. | ||
Amen. As he said, look, they've... | ||
This is not just a case of being weak-kneed or spineless. | ||
This is a case of folks not enforcing sanctions, knowing precisely what they're doing, as an example. | ||
In other words, they let the Iranians sell oil all over the world, even though We theoretically have sanctioned them. | ||
That's at least, while Joe's been in office, at least $100 billion to the Iranians. | ||
These people may be a lot of things. | ||
I'm talking our administration. | ||
They're not stupid. They understand what happens when you hand these guys who are radical Islamists and have an apocalyptic view of the world. | ||
100 billion dollars. | ||
They're gonna do exactly what they've done. | ||
They're gonna pump up Hezbollah and Hamas on steroids. | ||
Every missile and drone that's being fired at Israel, in effect, is money we gave to the Iranians, one way or the other. | ||
We're paying for it. Again, it's not that these folks in national security positions don't understand that. | ||
It is, in my view, We're good to go. | ||
What they want. | ||
Now, will they say that out loud? | ||
Of course they won't say that to the American people. | ||
But that's the reality. | ||
I mean, we have said the Middle East is on fire. | ||
And we did it. Yeah, let me ask you right there. | ||
Because I think you're spot on. | ||
You just set it up just right. | ||
What they're doing, it's obvious. | ||

But... The obvious question is, what do the American people think? | ||

It's a 50-50 country for folks who hate our own country. | ||

Well, I think the explanation is essentially what you just said, which is, look, we always understood that the news media writ large was biased, a certain amount of spin. | ||
Back in the day, right, there was a Democrat paper and a Republican paper in every big city. | ||
Okay, we left that world a long time ago. | ||
Now we have massive news networks that are propaganda arms for the Democratic Party, and they lie bald-faced, and they also cover up Stories. | ||
So we're, as the general said, Scott said, we're at war in the Red Sea. | ||
We got Navy ships being attacked with drones and missiles every day. | ||
But for the grace of God, one of them would be at the bottom and hundreds of Americans would be dead. | ||
Nobody's talking about that. | ||
And nobody's talking about, maybe more fundamentally, the fact that we got guys firing on our people trying to kill our personnel. | ||
And we are... | ||
Shooting down $50,000 drones with $3 million missiles and then taking no other action. | ||
And we're losing the war to the Houthis. | ||
The U.S. Navy is losing the war to the Houthis who work for the Iranian Revolutionary Guard Corps. | ||
Now, I defy—90% of Americans are completely unaware that that's happening. | ||
And that's not because they're stupid or ignorant. | ||
That's because there's no source of news that they're touching on that tells them that. | ||

Just the threat to this dominant global establishment And so, Sam, if you just want to keep going on the China-Russia-Iran piece, what we need to know and what can we do about this? | ||
Yeah, well, as you will know, Dave, one of the hard things, I think, for the average American who, by the way, is trying to pay the rent and figure out a way to put groceries on the table is to try to keep track of all this stuff. | ||
It's easy to get just kind of overwhelmed. | ||
And you start tuning it out, which is, hey, you got... | ||
You've got to feed the kids, man. | ||
You've got something else to do. | ||
So I always try to grab ahold of something concrete here to just establish to people how bad this is. | ||
So you're talking about $30 million from the Chinese to the Bidens, including Joe. | ||
$30 million from not just the Chinese Communist Party, but all of the key people here are Chinese intelligence, Chinese spies, Chinese intelligence officers pumping tens of millions of dollars to the Bidens. | ||
Okay, I was a case officer, an ops officer, a spy in common parlance. | ||
My number one job was to recruit sources. | ||
I did a bunch of other stuff, obviously. | ||
But that's what you really get paid for. | ||
Spies don't give you money out of the goodness of their heart. | ||
And spies don't give you money hoping that maybe you're going to think kindly about their country. | ||
Maybe diplomats do that. | ||
You know, espionage is a hard business, man. | ||
When you start handing people tens of millions of dollars, something comes back the other way. | ||
You don't keep throwing good money after bad, to use an old expression. | ||
You might hand somebody a chunk of change up front to kind of prime the pump and see what we got here. | ||
But if you keep handing them money... | ||
You are getting something concrete in return. | ||
Now, just to everybody listening, absorb that. | ||
That means you've got a guy now sitting in the Oval Office, who was previously Vice President, who's taking money from Chinese Intelligence Office. | ||
What are they getting in return? | ||
We could move on to Walls. | ||
You don't make 30 trips there to Communist China and take groups of students around and show them the country And preach democracy. | ||
You don't go to Communist China and criticize the regime. | ||
You certainly don't get invited back. | ||
If you're going there, in effect, in partnership with the Chinese Communist Party, it's because you're doing their bidding and you're following their party line, quite literally. | ||
So, you know, the whole Russia-Trump thing Complete, as you said, fabrication and distraction and deliberately intended to distract and to tar, you know, basically, nothing to see here, folks. Don't pay any attention to the tens of millions of dollars flowing to the Bidens. | ||
Let's chase this ridiculous Russiagate nonsense. | ||
Yeah. And then what is the linkage? | ||
What's the geopolitics, as Steve Bann would say, why are they buddying up with Iran? | ||
Well, look, it's a confluence of interest. | ||
I'm a big believer, and Steve and I have had this conversation many times, in kind of a toxic mix or a witch's brew of interest. | ||
We don't have to have, you know, everybody is totally aligned on every aspect of this. | ||
Clearly the Communist Chinese and the Iranian Ayatollahs don't see eye to eye on a lot of stuff. | ||
But what do they see eye to eye on? | ||
Taking down the United States of America. | ||
And we're not just weak now. | ||
We're not just feckless now. | ||
We got people in key positions who aren't playing for our team, to put it as bluntly as I can. | ||
Right? They're playing for the other side. | ||
Yeah, that's exactly right. | ||
And so, Sam, one minute to go. | ||
What types of action? | ||
Who can we call? | ||
Who are the relevant folks on the foreign affairs committees? | ||
Or what can we do to take our country back? | ||
Well, the first thing we can do is get Donald Trump in the White House, obviously. | ||
That's the key. | ||
That's the job of the moment. | ||
But look, we are looking past, just to grab a hold of the China threat again, we've been looking past this for a long time. | ||
And even those folks who are not recruited assets are formally working for the Chinese. | ||
Why? Because they're making a boatload of money. | ||
Because they threw in with this whole idea of getting rich by cooperating with the Chinese totalitarian regime. | ||
We've got to have a fundamental change in policy. | ||
Call it decoupling, whatever you want. | ||
That whole business 30 years ago, 40 years ago now, of lashing up with communist China, the biggest strategic mistake we ever made. | ||
