| I am Monica Crowley, in for my good friend, political prisoner Stephen K. Bannon, and it's such an honor and a joy to be here. | ||

| Joining us once again on the line is the amazing Julie Kelly of Declassified with Julie Kelly talking about the latest superseding indictments leveled by Jack Smith against President Trump. | ||
| Again, they are relentless. | ||
| You're dealing with communists. | ||
| They have no shame. | ||
| They have no guardrails. | ||
| They have no rule of law. | ||
| There's no constitution. | ||
| That keeps them in check. | ||
| They just do whatever the hell they want. | ||
| Julie Kelly has been on top of this from the very beginning, along with the entire January 6th saga, and she's been a huge champion of the J6 defendant. | ||
| So, like I said before, she is an American heroine. | ||
| Julie, let's get back into our couple of minutes here. | ||
| Let's get back into these indictments. | ||
| Apparently, Jack Smith impaneled a brand new grand jury in Washington, D.C. | ||
| Is that correct? | ||
| Yes, he had to because the original indictment, the whole proceeding actually, Monica, is tainted. | ||
| And that is because the Supreme Court said in its ruling that any immunized conduct Um, cannot be used in any stage of the investigation or prosecution. | ||
| So because they used the Department of Justice and they had witnesses from the DOJ testify who were subpoenaed in this investigation, now that the Supreme Court said, of course that's covered by immunity. | ||
| This is completely within his presidential authority and purview. | ||
| So he had to dump all of that proceeding, we think, go back to a new D.C. | ||
| jury, get a new indictment, That's as easy as, you know, as I said, cutting butter in a summer afternoon in Washington, D.C. | ||
| Of course, they signed up on a new indictment, a grand jury made up of the same tomcating Democrats who make up the trial juries in Washington. | ||
| So he got this indictment. | ||
| As I said, it was gutted. | ||
| But there's more problems, big problems for Jack Smith, even with this new indictment. | ||
| Number one, he did not address the Fisher decision by the Supreme Court, which reversed how DOJ Has applied 1512 C to obstruction of an official proceeding which represents two of the four counts. | ||
| Jack Smith did not even address this in the new indictment. | ||
| The court said you have to prove that the individual charged either tampered with or destroyed evidence or documents. | ||
| How DOJ and Jack Smith have applied it is saying, just basically interrupting what was happening on January 6th. | ||
| The certification proceeding in itself represented this crime, this felony, punishable by up to 20 years in prison. | ||
| Supreme Court said, no, no, no, no, no. | ||
| That's not the intent of the statute. | ||
| You have to demonstrate that this person destroyed records in an investigation. | ||
| Jack Smith didn't address this at all. | ||
| Furthermore, the Supreme Court suggested that Donald Trump's interactions with his own vice president, Mike Pence, related to what he could or couldn't do on January 6th, is presumably immune. | ||
| Now that means that Jack Smith kept that in the new indictment, knowing what the Supreme Court said, knowing that if this ever got back to the court, they would probably cut that out as well. | ||
| He doesn't care. | ||
| The DOJ and Jack Smith don't care about any of this. | ||
| Neither does the judge. | ||
| This is all about optics. | ||
| It's all about injecting J6 back into the headlines as people are preparing to vote before the election. | ||
| You know, sustaining the insurrection lie that we all now know is not true. | ||
| And, you know, whatever happens in the future with Jack Smith or this case, be damned. | ||
| They're going to get as much mileage out of it now as they possibly can. | ||
| Yeah, I mean, this is what communists do, right? | ||
| It's all hit and run. | ||
| And the process is the punishment. | ||
| So while they would love to see President Trump in jail, and you may have Judge Murshan | ||
| actually do that come September 18th, for Jack Smith and Merrick Garland and Lisa Monaco | ||
| and Kamala Harris, this is all about trying to punish President Trump, trying to distract | ||
| him again in the waning weeks here of the presidential election cycle, drain his resources | ||
| more. | ||
| But we know the posse is not distracted. | ||
| We need total focus on this. | ||
| But this is what they do. | ||
| It's just a giant hit and run operation for political purposes to try to stop Donald Trump, | ||
| but also to try to stop the rest of us too, right? | ||
| The America First movement, which is what all the J6 prosecutions are about, Julie. | ||
| And you've been talking about this since day one. | ||
| These are messaging events. | ||
| They're literally, you know, railroading these nonviolent J6 defendants. | ||
| You've been all over this. | ||
| Such a heroine on this. | ||
| But they're messaging events to the rest of us for the future as well. | ||
| Do you even think about questioning election results or we will do to you what we have done to your neighbors who were there on January 6th and what we're doing to Donald Trump? | ||
| Correct. | ||
| Mayor Garland just basically said that last week in a press conference the day after the DNC was over and he said just that. | ||
| Look at our J6 prosecution. | ||
| 1,500 Americans rounded up. | ||
| This will happen to you if you dare come to this Capitol and protest the 2024 election results. | ||
| Yep, messaging events. | ||

| You just heard Julie Kelly break apart the Jack Smith latest superseding indictment against President Trump. | ||
| I spoke to him this morning from my podcast. | ||
| Again, it's going up later today around 3 p.m. | ||
| Eastern Time. | ||
| He breaks a lot of news on my show, I'm grateful to say. | ||
| And we did talk about this and what he is going to do once he is re-elected with regards to the DOJ and the FBI. | ||
| But before we get to that point, he's got to deal with this new wave of lawfare. | ||
| Your response to what you have seen come out of this latest Jack Smith filing? | ||
| Well, first, let me just say this about Julie Kelly. | ||
| She is the all-star hero of this Trump lawfare and election interference. | ||
| It was Julie Kelly who went into the trenches every day in these courtrooms in D.C. | ||
| and Florida and exposed the Biden-Kamala Justice Department's political persecution of these January 6th defendants. | ||
| And I'll tell you, as a former Supreme Court clerk, The Supreme Court would not have taken these cases and | ||
| ruled the way that they did, but for the fact that Julie Kelly exposed this. | ||
| And so she deserves a tremendous amount of credits for that. | ||
| And I would say this about this law fair. | ||
| You're seeing what. | ||
| We have Biden and Kamala. | ||
| They tried to bankrupt Trump. | ||
| They tried to throw him in prison for life. | ||
| They tried to take him off the ballot in Colorado and Maine. | ||
| The Supreme Court stopped them because these are Republic-ending tactics. | ||
| They're unlawful. | ||
| They're unconstitutional. | ||
| So what was Biden and Kamala's response? | ||
| They are now trying to destroy the Supreme Court that got in their way, and they underfunded Trump's Secret Service detail. | ||
| They denied many requests and then Biden said to put a bullseye in Trump's head, right? | ||
| So what do you think was going to happen in Butler, Pennsylvania after that happened? | ||
| By the grace of God, a millimeter and a millisecond, Trump's life was spared, and he seems unstoppable. | ||
| We have Kamala Harris, who didn't get her post-convention bounce, and then Trump and RFK and Junior and Tulsi Gabbard stole that bounce, and so now they're getting desperate. | ||
| In the Biden-Kamala regime, they're getting very desperate. | ||
| And you're seeing that with this superseding indictment by Jack Smith, this Biden-Kamala special counsel. | ||
| He is the Freddy Krueger of this lawfare and election interference. | ||
| The Supreme Court and Judge Kennedy have taken off his ear and arm and leg. | ||
| And this Jack Smith does not give up. | ||
| He's bloody. | ||
| Coming back into court with his face blown off legally. | ||
| And he's not going to stop. | ||
| And it just shows you how determined they are to defeat President Trump with lawfare because they know the American people are going to put President Trump back in the White House after November 5th, 2024. | ||
| And you look at this superseding indictment. | ||
| Julie got into this and she's the smartest non-lawyer I know. | ||
| Look at what Jack Smith did. | ||
| Jack Smith got smacked down by the Supreme Court in June on two monumental cases. | ||
| The Fisher case, where the Supreme Court said that the other part of the Biden Kamala Justice Department Matthew Graves in the DC U.S. | ||
| Attorney's Office politicized, weaponized, contorted a post-Enron obstruction of justice statute dealing with corporate fraud to go after Trump and his political allies, Biden and Kamala's political enemies. | ||
| The Supreme Court said you can't do that. | ||
| The Supreme Court also said you can't charge the president for his official duties, including the outer perimeter of his official duties, and that includes, presumptively, his discussions with his vice president. | ||
| So what did Jack Smith do with this superseding indictment? | ||
| Jack Smith ignored Both of those Supreme Court rulings from June and Merrick Garland signed off on this indictment, right? | ||
| So you have Merrick Garland and Jack Smith blatantly ignoring two Supreme Court rulings. | ||
| The Biden-Kamala regime blatantly ignored the Supreme Court's student loan ruling. | ||
| These are the people who are trying to destroy our country. | ||
| They're trying to destroy the Supreme Court. | ||
| They're trying to destroy our country because they fear American voters. | ||
| They fear that Kamala Harris is going to get beat like a drum on November 5th. | ||
| So they are doing this last desperate attempt to take out Trump with this law firm, | ||
| with this superseding indictment by Freddy Krueger, Jack Smith, | ||
| and then this corrupt judge, as you said, Monica, this corrupt judge, Democrat donor judge, | ||
| who illegally donated to Biden and Kamala, whose daughter, Lauren Michon, | ||
| is raising millions of dollars off of this unprecedented criminal prosecution | ||
| of President Trump, the former and likely future president | ||
| over which her father, Judge Juan Merchant, is presiding. | ||
| That requires his recusal under New York statute. | ||
| It's very clear. | ||
| Six degrees of separation under New York statute. | ||
| The daughter's within the first degree. | ||
| Even a former Clinton judge said this on Caitlin Collins' show on CNN on April 5th. | ||
| What was Marchand's response to Trump when he raised this recusal issue? | ||
| Judge Marchand said that he's going to throw Trump in prison if he merely mentions Lauren Mershawn's name. | ||
| So on September 18th, is this corrupt judge gonna move forward and sentence Trump? | ||
| You know, selfishly, politically, I hope that Mershawn does put Trump in jail for an hour | ||
| because the Supreme Court of the United States will step in immediately and stop this, | ||
| and it will make Trump- Is that true? | ||
| Can I, can I stop you there, Mike? | ||
| Is that true? | ||
| Even though it's a New York state, it's going through the New York state judicial system and legal process, so state case. | ||
| If, if Juan Marchand sentences him to prison and then remands Trump immediately into custody, how fast can the Supreme Court act? | ||
| And can they act? | ||
| Very fast. | ||
| So you try to get relief through the New York system and if they deny the relief you go right to the Supreme Court of the United States through the emergency docket. | ||
| I have zero doubts after the Fisher decision and after the presidential immunity decision where even the Chief Justice of the United States No fan of Donald Trump, no MAGA signs in his yard, is clearly onto this Biden-Kamala game, this lawfare, this election interference. | ||
| And I think the Chief Justice made it very clear in his rulings that this is, and he's right, this is so much bigger than Donald Trump. | ||
| This is about destroying the presidency and therefore destroying our country. | ||
| And these are Republican tactics by Biden and Kamala, and they are taking us to the brink. | ||
| As a country, these are very dangerous times, legally and politically. | ||
| And this is how the Roman Republic felt. | ||

| There are circuit justices who handle the federal circuits. | ||
| With the state system, I'm not quite sure if it goes to one judge, but it always gets referred to the entire courts. | ||
| And I imagine that the court would, I have no doubt the court will grant an emergency stay of the execution of judgment if this corrupt Democrat, Manhattan Judge Juan Marchand, whose daughter is raising millions off this case, if he actually goes through and takes our country over the brink and sentences the former and likely future president of the United States to incarceration in Rikers Island, When we don't even know what the crimes are after this bogus trial by this Soros-funded Manhattan D.A., Alvin Bragg, and this Matthew Colangelo getting deployed from the Biden-Kamala Justice Department, this 95% Democrat Manhattan jury pool, and these totally lying witnesses, Stormy Daniels and Michael Cohen. | ||

| Yeah, so basically what's happening is that operationally the election integrity project for the RNC and the campaign is firing on all cylinders. | ||
| We've had tremendous signups and we're beginning to hit some great numbers, but we still need more. | ||
| And this is going to be really critical in the battleground states, like you said, in Nevada, Arizona, Wisconsin, Michigan, Pennsylvania. | ||
| I would throw Virginia and Minnesota in there and including Georgia. | ||
| We really need to have eyes and ears in all the rooms. | ||
| But as we've discussed before, get out the vote and election integrity are two sides of the same coin. | ||

| And one of the things that I wanted to say right before the break is that, you know, you know, historically, we've talked about, you know, the Republican candidate, the RNC, the state parties versus the Democratic candidate, the DNC, and their state parties. | ||
| But what we've really seen in this cycle, especially since the Biden-Harris campaign, | ||
| or our administration came into power, now it's the Harris campaign, the DNC, | ||
| about $2 billion in dark money. | ||
| But because of some of these programs that Joe Biden put in place, | ||
| they're now trying to use our tax dollars to try and do voter registration | ||
| and get out the vote programs through the federal agencies. | ||
| And there's actually some lawsuits that have been coming on this | ||
| because we think tax dollars should be left to do what the administration, | ||
| what the departments and agencies are supposed to be doing, which is serving the American people, | ||
| not advancing a partisan political agenda for the incumbent. | ||
| And so that's why what you said is incredibly important. | ||
| The great equalizer in politics, how you combat two billion dollars in dark money, is you have that army of the awakened. | ||
| And you know, everybody has their circle of friends, family, and neighbors, and you need to activate them as well. | ||
| If we all do that, and as you said that the election is starting, there are some states, and as I come out in the coming weeks, we're going to talk about some of the states Where the election is underway because absentee ballot requests are currently being received. | ||
| This is part of the election process. | ||
| So we're out of time. | ||

| What they're doing in fighting the system is really fighting for you. | ||

| And that's why the non-citizen voting issue is such a primary and significant issue. | ||
| It's because the Biden-Harris administration abandoned the border, ceded control of it to the transnational criminal organizations, the cartels, For human trafficking and fentanyl trafficking. | ||
| And now all those people there, the Democrats, don't have the safeguards in place. | ||
| You've seen a number of Republican states actually lead by example, take the extra step to make sure that their voter rolls are as clean as possible. | ||
| Why? | ||
| Because that preserves the integrity of the vote for Republicans, Democrats and Independents on November 5th and during early voting. | ||
| And the challenge to the Democrats is, go the extra step, help make sure that the elections are transparent, make sure that they're fair, and make sure that they're secure so everybody can have faith in the process and confidence in the results. | ||
| This is critically important for this country, but it's also critically important because Donald Trump and J.D. | ||
| Vance are going to be victorious on November 5th, and we all have our part to do. | ||
| It's time for all of us to step up and put our sweat equity into this election and deliver a victory. | ||
| That's it. | ||
| I mean, we have less than 70 days between now and election day. | ||
| But as you point out, it's not just election day, although it should be, but it's election months. | ||
| I mean, in some cases, states are voting over the course of two months. | ||
| If they're starting on September 6th and the election is November 5th, it's a two month period of time. | ||
| So the sand in the hourglass is gone. | ||
| This is it. | ||
| The country hangs by a thread. | ||
| We need every single member of this posse. | ||
| We need every single American. | ||
| Talk to your friends. | ||
| Talk to your neighbors. | ||
| That's it. | ||
| We need everybody mobilized. | ||

| So everything seems really rushed on their side in order to finally extinguish the United States. | ||

| So if we lose this election, if we do not get it right, the country is gone for good. | ||
| And I don't want any member of the posse sitting back on November 6th, I'm assuming we have results on November 6th. | ||
| I don't want anybody sitting in regret saying, yeah man, I heard Monica and Bill McGinley and Steve Bannon talking about Army of the Awakened and we need to mobilize and Trump Force 47 and protectthevote.com and I didn't do anything because it was the end of the summer when I heard them talking about it. | ||
| I got lazy. | ||
| I like my couch. | ||
| No, if you love America, if you like your freedoms, Well then you really have to step up and activate yourself and everybody around you in order to save America in the 68 days that we have left. | ||
| Bill, where can everybody find you and where can everybody find your great work and find the resources that they need to do what we're asking them to do? | ||

| How many communities are riddled with crime because of local DAs who will not enforce the law? | ||
| Who, when you have recidivist violent criminals, will not prosecute and incarcerate? | ||
| We need them to enforce the law so it's everybody up and down the ticket who we need to be supporting to save this country and really to make communities safe and prosperous again. | ||
| That's right. | ||

| And this is why the left has understood this from the beginning of time. | ||
| This is why Saul Alinsky created community organizing, where Barack Obama was a graduate. | ||

| We have to do our own community organizing. | ||

| Tell us about your organization and talk to us about the work that you're doing. | ||
| United Sovereign Americans is a citizen-led, citizen-organized movement to fix our election problems all the way down to the root. | ||
| We have top analysts and auditors coming in and volunteering as experts inside of our | ||
| system using the state registration lists, which constitute the official list of registered | ||
| voters as well as the official list of voter participation history for the 2022 midterm | ||
| election is the one that we specifically audited. | ||
| Reason being that's the most recent federal election. | ||
| And what we wanted to do fundamentally was show America that we have one problem across | ||
| the country. | ||
| And that one problem is that officials, election officials everywhere are violating the principle | ||
| upon which this republic was founded. | ||
| They are authorizing invalid registrants to have equal access to the ballot as you. | ||
| They are giving them the... | ||
| They are counting votes that don't track back to any voter in their system, and they are trampling the accuracy requirements laid out by Congress as necessary and proper for a reliable, constitutionally valid federal election. | ||
| And you have to say what we're doing basically is we're just we're just getting these measurements. | ||
| We're taking the measurements. | ||
| And then what are we doing next? | ||
| We're filing lawsuits. | ||
| Because the American people have exhausted themselves over three and a half years trying to get this fixed through the, you know, administrative process, trying to work with the states, trying to work with the officials. | ||
| And guess what? | ||
| They don't want to fix it. | ||
| They want to wave a magic wand and tell you that in 20 states, Representing 338 electoral college votes, that 29 million facially invalid voter registration records are clerical errors. | ||
| Well, the Department of Justice doesn't call them clerical errors. | ||
| They say that looks like 29 million potential felony violations of the right to vote, the fundamental civil right of every American. | ||
| So we're done. | ||
| And these 29 million facially invalid potential felony registrants, they cast, and officials counted, 10 million illegal votes from these people in 2022. | ||
| This has to end. | ||
| The only way to fix this is to start to hold these people accountable. | ||
| And our litigation process, fundamentally designed by James Madison himself, Well, you guys are total heroes for doing it, and the fact that it's citizen-led and citizen-mobilized makes it even more important because there's no heavy hand on it. | ||
| It's just all of you patriots getting together because you love your country and want clean voter rolls. | ||
| We're coming up against a break, Marlee, but I want to hold you over because There have been big states like, for example, Texas just recently announced over the last week or so 1.1 million names on their voter rolls that they purged, that were not entitled to be there, were either dead, illegal immigrants, you name it. | ||
| Ohio is doing the same thing. | ||
| But they have critically important, very smart and fearless secretaries of state in those states. | ||
| Whereas swing states, for the most part, have Democrats, Secretaries of State, Pennsylvania, Michigan, Wisconsin, and we see what happens there. | ||
| So let's hit a quick break with you, Marlee. | ||

| I am Monica Crowley in today for Stephen K. Bannon on The War Room, and we are rejoined by Marlee Harnick of United Sovereign Americans. | ||
| Marlee, right before the break, I was asking you about secretaries of state who are not particularly on our side, who are encouraging this kind of fraud and abuse of the system. | ||
| How do you guys deal with them? | ||
| Well, we are dealing in the same way across all states, which is we are going straight at the chief election official in every state and the attorney general in every state where we look at these findings. | ||
| And unfortunately, although we'd like to think that a red state or a blue state or a purple state might have a better record, what we're discovering is that these problems are filling the state registration lists and the voter participation histories and the reconciliation of these elections everywhere. | ||
| And we find a 13% error rate in the vote across these 20 states on average. | ||
| And so to that end, United Sovereign Americans, again, totally citizen-led movement, now represented by Bruce Castor Jr., who was not only the former acting Attorney General of the Commonwealth of Pennsylvania, but he's also the winning counsel In the second impeachment trial of President Donald Trump in front of the U.S. | ||
| Senate. | ||
| So this is a legitimate constitutionally based effort led by a top-tier attorney. | ||
| And we have filed now in Maryland, Pennsylvania, Ohio, Florida, Texas, Michigan, North Carolina. | ||
| And we anticipate filing in Colorado and Georgia as well by the end of this week. | ||
| We are determined everywhere in America to make sure that the vote is accurately and legitimately counted according to what Congress decided was necessary. | ||
| Now, regarding a specific outcome, like you were saying, hey, you know, let's take a look at some serious problems. | ||
| Let's look at some of the worst problems. | ||
| And I was listening before when you were on with Mike Davis. | ||
| You know, this person, Tish James, that a lot of people are really frustrated about her actions against the American people and against our system of justice. | ||
| Her election had a 9% margin of victory in a state that had a 12% voting error rate. | ||
| So what we're basically doing right now in regards to her actions is taking the word for, you know, taking the New York State Board of Elections at their word. | ||
| That a quarter of a million people who registered to vote on January 1st are legitimate, provable United States citizens who are eligible to vote. | ||
| And if they were inclined to, they could ostensibly produce the documents to prove that. | ||
| Honestly, I don't know why we listen to these people at all anymore. | ||
| They have to be held accountable. | ||
| And this litigation strategy designed by James Madison, it's like this. | ||
| It's like one of these traps where, you know, the officials, they stick their fingers and they think, oh, this is going to be easy. | ||
| This looks fun. | ||
| This is going to be easy. | ||
| The harder they pull and the harder they try to get out of the trap, the better our standing gets and the bigger their accountability. | ||
| And it ends with the 1983 actions against officials who refused to uphold congressional standards for reliable elections. | ||
| The American people weren't We're done. | ||
| We have to take this all the way down to the mat with these crooks. | ||
| They do not have the right to sit in these offices, wave wands, and tell us who won elections. | ||
| They have to prove it. | ||
| Well, that's exactly right. | ||
| And you guys are doing yeoman's work at the ground level, which is exactly where it needs to be done. | ||
| You're true heroes. | ||
