When it's this high, and your job approval is 38%, and you already, as Abby pointed out correctly earlier, having trouble with your own base, and now they're in a total panic.
How do you get out of this morass with so little time to go?
Let me just take the other side of this Kamala Harris debate.
It is a fair question to ask right now.
What is going on inside the White House every day?
Is she currently making more decisions in the White House than we know?
Who is making decisions in the White House right now?
We're talking about this in terms of can Joe Biden win an election and serve for four years?

I want to know what's happening on a day-to-day basis.
To me, she is the big story tonight because her position in this administration, in this campaign, has become magnified by a thousand right now.

You're going to see Gretchen Whitmer out more.

And they're going to be campaigning for Biden, but they're also showing the chops that they have, because there is a non-zero chance after the performance tonight that a change has to be made if the president were to step aside.

Dems actually have a very strong bench, but not the strongest person at the top of the tech.

And how the media, if you can pull that, my getter, go to getter and pull up, and I think I sent it to you guys, the New York Times today, the five lead columnists, the heavies of the heavies, Tom Friedman, Frank Bruni, Nicholas Kristof, all with articles saying, this is terrible, Biden's got to go.
You're telling me Tom Friedman didn't know this?
You're telling me Frank Bruni with his connections didn't know this?
You told me when you came to MSNBC last night and it looked like a wake or sitting Shiva?
Are you telling me that they haven't known what's exactly going on when the White House, uh, when the White House, the Zen master, Jean-Pierre tells us, oh no, these are all doctored videos.
They don't know exactly what's going on.
Number one, this is politics aside.
What President Trump did last night was for the nation.
He put that no politician, no strategist would ever have done this for the politics of it.
Because obviously you're giving them the option to change it out and they will change it out.
He did it for the nation.
He did it to come front and center and see exactly, with no intermediary, exactly what the situation is with the so-called commander-in-chief.
The issue before us right now is quite simple.
It's not about who's going to win in November.
Because currently, if you go on, Trump's going to win by 10 or 15 points.
It'll be 400 electoral votes and a blowout in the Senate and a wipeout in the House.
The question for the citizens of this country is quite simple.
How and with whom do you get to January?
How do you get to Donald J. Trump hand on the King James Bible at high noon on the 20th of January 2025.

Where would you like to be last night and this morning?

And there was a story the other day in the totally non-credible, in many respects, Daily Mail, I think.
A couple weeks ago, on Monday, they said that the Clintons, the Obamas, Schumer and Pelosi were going to watch this debate, and if it did not go well for Joe Biden, they were going to go and try to have the talk with him about stepping back.
Many people laughed at that.
It was not an incredible report.
You look at the Daily Mail, the British tabloid, whatever.
I had about six good sources after that who said, that's not totally false.
And the interesting part of that was the Schumer and Pelosi piece because no one thinks Joe Biden
would listen to the Obamas, the Clintons on the subject.
But because he cares so much about Democrats in the House and Senate, there was some discussion
about whether Nancy Pelosi and Chuck Schumer privately were at least taking soundings on this question.
I don't know what will happen now going forward.
But I will say, these are the kinds of conversations people are having now in the Democratic Party as we speak.
What to do, because the level of panic is... For me, in my time covering politics, I've never seen a level of panic about this on this scale.

Mike, I want to get to the 25th Amendment.
You're an expert on all this stuff and the crisis we're in, in the governance, because all I'm worried about is how you get to, how this country holds it together in a world that's starting on the 110th anniversary of the assassination of the Archduke in Sarajevo by Serbian nationals that led to the greatest slaughter in mankind's history.
A war that didn't really end until 1989, essentially.
In bloody 20th century from 1914 to 1989.
Mike, but I gotta tell you, a monumental day.
We would be talking, we were led with you at the steps.
All we'd be talking about for two hours is the Chevron deference.
Can you walk me through what happened?

The Supreme Court 6-3 reversed a 40-year-old precedent, the Chevron case, where courts for the last 40 years have unconstitutionally deferred to executive branch agencies when those executive branch agencies interpret their own power, interpret statutes that give them power.
So, of course, these executive branch agencies always interpret that they have more power and the courts are supposed to
defer to that interpretation so long as that interpretation is reasonable, whatever the hell that means.
And so you had, you have Congress giving too much legislative power to these executive branch
agencies that are unaccountable to the American people. It's very hard to remove these
people. And then you have judges giving away their judicial power by deferring to these agencies on
their interpretation of their own Well, that ended today in this 6-3 case.
Of course, the three liberal justices dissented, as we expected, but this just shows you how important elections are and how consequent How consequential President Trump's first term was.
He transformed the left of center Supreme Court to the Clarence Thomas Supreme Court with the appointments of Justices Gorsuch, Kavanaugh and Barrett.
And this means a lot for real Americans and real America.

And what we need to do with this court over the next 20 years is continue to roll back these administrative agencies, the federal government, and put them in their proper place, as intended by our founders in the Constitution.

Well, I clerked for then-Judge Gorsuch on the Tenth Circuit when he wrote a powerful opinion on why Chevron was wrongly decided and why it must be reversed.
And you were on the selection committee for Justice Gorsuch, Steve Bannon, and you saw that opinion and you know how impactful it was.
I also clerked for Justice Gorsuch to help him get set up on the Supreme Court.
This is critically important to him because Justice Gorsuch understands, like the founders understood, the dangers of an all-powerful executive branch, the dangers of an all-powerful federal government.
And what the Supreme Court must do is follow the loan agreements that is our U.S.
Constitution.
We the people loan our federal government Specific, enumerated, meaning spelled out, and divided powers.
In exchange, that government is supposed to protect our liberties.
And this federal government over the last 90 years has violated that loan agreement.
The switch in time that saved nine.
The federal government has way too much power.
That the founders never intended and then that power has been Consolidated in the executive branch and then those executive branch agencies have been insulated from accountability From the American people through our elected members of Congress and our judges and this Chevron decision Changes that and says you guys do you guys do not get to decide your own power?
Your statutes are interpreted by courts, not the Tony Fauci's of the world.
Because the Tony Fauci's of the world are always going to interpret their power to give
them more power.

There is a case out of Oregon that my former boss, Neil Gorsuch, wrote.
It's a 6-3 decision.
The 9th Circuit held that a town that banned homeless camps on public property violated the cruel and unusual punishment clause of the United States Constitution.
So if you don't want homeless people with their tents and their drugs and their trash and their other filth in your public parks, According to these liberal judges on the Ninth Circuit and three leftist judges on the Supreme Court, that would be unconstitutional for a city to end homeless camps in public parks.
That is absolutely insane.
Justice Gorsuch obviously reversed that nonsense 6-3, but it just shows you, Steve, just like you said, if Trump didn't win this election, you would have leftists locking us up with our COVID masks still.
And we would just have to defer to them at the CDC and say, yeah, we have to wear COVID masks the rest of our lives, and schools have to be closed, and remote learning, and homeless people can overrun public parks because these left-wing judges are insane, and they just proved it today with these three judges, these three liberal hens, on this homeless camping ban decision.
Somehow that's cruel and unusual punishment.
Maybe we should put these homeless people in the parks in these three liberal hens neighborhoods.

Interestingly, you had Justice Barrett writing a dissenting opinion, joined by Kagan and Sotomayor.
So I don't know where Justice Barrett's head is on this one.
I have to read her dissenting opinion.
But this is a win for the January 6th defendants, as we've been predicting since the oral argument.
And this is a big win For the Constitution, because the Biden Justice Department... Hang on, hang on.

Sure, so Fisher's great, Steve.
It's a tremendous statutory interpretation case, and it was the obvious statutory interpretation all along.
It's a statute that's directed at obstruction of justice.
That's even in the title.
It's all over the place.
It was only designed to be changed after the Enron debacle because of the so-called Enron loophole.
And it's easily construed that addition to the statute to mean that you're talking about forms of obstruction that are like the existing forms of obstruction, like tearing up a document, like hiding a document, etc. or, you know, witness intimidation and the like. It's
not designed for protests.
And so the Supreme Court says, you know, that that's not what the statute is for. And they
apply, you know, I'll give your audience two quick little Latin lessons that applies these
two classic ancient canons of interpretation, Nostra Aetora Socius and Iustem Generis.
And they mean that words are known by the company they keep.
And that if you have a list of things, the list you construe it to mean that
everything on the list is of a like kind or character. That's what the Latin means. They apply
those canons. They say that outlaw outlaws what happened with these January 6th prosecutions.
And, you know, that's that's the end of it. They made short work of it, Steve. It's a
big victory for justice for the J6ers. But it's a great upholding of the rule of law
because the Biden administration, Garland Justice Department. They weaponized this statute.
They totally misinterpreted it.
They abused their prosecutorial discretion and the Supreme Court smacked it down.

And this is the kind of interpretation of this statute, 18 U.S.C.
1512 C.2, that if one of my law students came up with it, I would say like, you know, oh, you're very clever.
You're trying to use the text of the statute, but come on, you know, remotely, that's not what this statute is intended to do.
You're forgetting about these two canons that I just described.
You're forgetting about the fact that this was designed to plug a specific loophole.
You're just trying to use the statute in a cynical and results-oriented way to go after
people who you think you should be able to put on the hook, even if it destroys their
families, even if you're not using the statute against the same conduct by the left, right?

Did they get special treatment under the statute?
Did they see themselves sent to jail for long periods of time?
