It's important to add that President Biden said in an interview that he would not pardon his son, Hunter Biden, now convicted of three felonies. | |
And it's just important to note that this was the U.S. | ||
Justice Department, part of the Biden administration, that convicted the son of the sitting president. | ||
Without interference from the White House or the President. | ||
Merrick Garland, the Attorney General, an independent Attorney General who's often earned the ire of the White House for certain decisions that he's made, appointed a special counsel who had been a Donald Trump-appointed U.S. | ||
Attorney, David Weiss, in the state of Delaware. | ||
To oversee this case and they brought it without fear or favor. | ||
They presented overwhelming evidence in this courthouse behind me that Hunter Biden was using drugs and illegally purchased a firearm during that time. | ||
And Hunter Biden's stab at a defense, which was trying to raise reasonable doubt about some of that drug use. | ||
I did not pass muster with this jury which returned a verdict within three hours of deliberation, sooner than many people had thought. | ||
There was some speculation perhaps Hunter Biden's team was appealing to a hung jury trying to find one juror who would be sympathetic to Hunter Biden. | ||
That was not what happened here. | ||
They may have been sympathetic to him but they clearly saw that the evidence was overwhelming in this case, that he violated the law. | ||
And they didn't get to hear the context, which is that this is a charge that is rarely brought as a standalone case, as many legal experts have said. | ||
And for that reason, it may be unlikely that he serves any jail time in this case. | ||
But it's an important piece of context because this case may never have happened had not a plea agreement that Hunter Biden had reached with the special counsel a year ago, had not that agreement collapsed. | ||
First in open court and then behind the scenes in plea negotiations that failed because Hunter Biden's team was not satisfied with the level of immunity that they were offered by the Justice Department. | ||
In retrospect, that seems like a questionable decision because now Hunter Biden stands convicted of felonies and he's facing another trial in September on tax charges. | ||

The judge did not incarcerate him today. | ||
She's going to schedule a sentencing hearing at a later date. | ||
Usually that comes two to three months from the time of conviction. | ||
And in the meantime, he'll undergo a pre-sentencing report, which includes an interview by the | ||
federal probation office. | ||
They will delve into many, many issues, including the extent of his remorse and his acknowledgement | ||
of guilt, which may be complicated by the fact that he's considering an appeal in this | ||
case. | ||
And then the judge will, at the sentencing date, will pass a sentence. | ||
And as we've been telling you, the maximum in this case, the practical maximum here is | ||
10 years in prison. | ||
But that is not, that would be extraordinary if that was applied in this case. | ||
That is not likely to happen here. | ||
In fact, our legal analyst Danny Savalas has said his back of the envelope calculation is that federal sentencing guidelines would call for a year in prison in this case. | ||
In the particular context here that Hunter Biden has no criminal record, that this charge is rarely brought as a standalone, the judge may well go below that. | ||
There may not be any prison time at all, but a lot of discretion in this case is given to this federal judge, a Donald Trump appointee, who is the one who raised questions about the initial plea deal which led us here to begin with. | ||

attorney who would handle their criminal prosecution, the district court judge who would oversee The trial in the U.S. | ||

And it seems like every scumball Biden that has taken almost $20 million from our worst enemies, gone from China, from Russia, from Ukraine, Kazakhstan, every trouble spot in the world has sent money to what seems like every Biden member's bank account. | ||

I would say to Nicole Wallace that if you look at, this isn't right-wing MAGA propaganda, this is the United States Sentencing Commission, and I'm reading it right here. | ||

Here's what it says. | ||
Most offenders convicted under 18 USC 922G were sentenced to imprisonment. | ||
That's 97.3%, right? | ||
So maybe if you have white privilege, Like Hunter Biden, you're not going to be sentenced to imprisonment, but the other people who are charged and convicted of these federal gun charges, 97.3% of them go to prison. | ||
And I'm looking at this. | ||
It says the average sentence for all section 92, 922 G offenders was 72 months. | ||
However, one quarter of these offenders had an average sentence of 30 months or less while one quarter haven't had an average sentence of 90 months or more. | ||
So, I mean, it's, These are pretty serious sentences. | ||
These aren't a slap on the wrist. | ||
These aren't five days in jail like you're a drunk driver on the George Washington Parkway. | ||
