So the Appeal to Heaven flag recently gained some notoriety because it also hangs out the office of the Speaker of the House, Mike Johnson. | ||
You see it there on the right. | ||
Now, it's been around since revolutionary times, but over the past decade or so specifically, it has grown closely associated with the Christian nationalist movement, including as the title of a book by a guy named Dutch Sheets. | ||
He's a Trump supporter, an election denier, and one of the most influential Christian nationalists in the country. | ||
As one former Christian nationalist told PBS early this year, he helped turn the flag into a rallying symbol among right-wing groups in this country. | ||

The Appeal to Heaven flag goes back to the Revolutionary War, George Washington, it was inspired by John Locke. | |
But over the last 10 years, the Appeal to Heaven flag has been popularized by Dutch Sheets. | ||
Dutch Sheets sees the Appeal to Heaven flag as a symbol of Christian revolution. | ||
If you look closely at January 6th, you will see dozens of Appeal to Heaven flags. | ||
It may have a long history, but in the contemporary context, it has a very specific meaning. | ||
And he is right. | ||
It was indeed all over the Capitol on January 6th. | ||
Just look. | ||
And while I don't think it is quite as vile a symbol as the inverted flag flying over the wreckage of the sacked Capitol, still I think it's fair to say an explicitly political statement, right? | ||
And unlike the first case where one can take a normal American flag and turn it upside down because you, I don't know, got into a fight with the neighbors, still working on that, In this case, Alito has to first acquire the Christian Nationalist Appeal to Heaven flag, and then take the action to fly it at his vacation home. | ||
Not so easy to explain away because you got into a tiff with another set of neighbors? | ||
Or to blame on your wife? | ||
This, on its own, would be cause for sanction for any federal judge who flew it. | ||
To be clear, if you're not in the Supreme Court and you did this, you'd get into a lot of trouble. | ||
Now this time, Alito did not offer a statement to the New York Times. | ||
He clearly thinks he can get away with this, and anything else. | ||
Much like the ex-president, who he seems to want to bail out of trouble. | ||
Alito believes he can act with total impunity. | ||
He thinks of himself as covered beneath the veneer of non-partisan jurisprudence, and protected by lifetime tenure, and who's going to find enough Republican senators to impeach him. | ||
What this story reveals is what we've already known about Alito. | ||
He is, indeed, An ideological zealot and a flagrant partisan who puts his own personal politics before the law. | ||
And apparently, he thinks so little of us, the American people, he does not even have the decency to pretend to hide it. | ||

Karl Marx and Foucault and Derrida, all these modern folks on the left better read a book called Return of the Strong Gods. | ||
There are choices to be made. | ||

Every minority right ought to be protected. | ||

And every spring, as they get closer to these biggest opinions, right, at the end of the | ||
term, the left goes into overdrive to try and delegitimize the court. | ||

This is such a silly story, such a stupid story, such a window into the left. | ||
But the gaslighting that they do by covering it all night on MSNBC and CNN shows you what they do, what their tactics are. | ||
If you remember, Dobbs was in 22. | ||
Affirmative Action was in 23. | ||
Now you have these Trump cases with the election coming up in June. | ||
And they want to delegitimize the court. | ||
So it's all about power. | ||
It's not about ethics. | ||
But the interim, they want to force him to recuse himself from the Fisher decision and particularly from the immunity decision. | ||
Their tactical play now is to try to get him off of those decisions. | ||
Am I wrong there? | ||
No, that's right. | ||
They're inventing recusal standards. | ||

They're saying there's flag, inventing all these things about this flag. | ||
and then therefore he has to recuse. | ||
There's no basis to recuse. | ||
And it's funny, right, because, so to stay with that, they want him to recuse right now to shrink the court, | ||
right, so that they get more liberals kind of on a, | ||
if it's an eight person court, it's a seven person court, they've been going after Justice Thomas, | ||
they get a better chance of winning in their mind of whatever these issues that are coming up are, right? | ||
The longer term is as they continue to raise questions about the court, now I just saw a poll that showed the | ||
court at 52% approval rating, okay, far above Congress, right? | ||
It's gone up, I think 10 points in the past few months. | ||
But they want to then sort of say, we need to pack the court and have a number | ||
of liberal justices that Biden would appoint if he wins a second term, so that they get to, again, | ||
That's what this is about. | ||
Shrink the court in the short term and then raise questions about it so that they can pack it in the future. | ||
They don't believe in an independent court. | ||
That's what this is about. | ||
You know, they never had these complaints when they controlled the court. | ||
Now, all of a sudden, it's a huge deal. | ||
This is this is part of the 30 front war. | ||

Look at Ruth Bader Ginsburg. | |
She had very negative opinions about Donald Trump and voiced them, right? | ||
And yet she did not recuse herself in Trump versus Mazars or Trump versus Vance, the two 2020 cases in which the high court ruled against Trump both times. | ||
On the other hand, she was an ardent feminist and spoke before women's groups, women's rights groups often, but she did not recuse herself from United States versus Virginia. | ||
In fact, she wrote the ruling opinion in that case, striking down Virginia's law that restricted access to Virginia Military Academy Institute just to men. | ||
So we have a recent example to show that having political opinions, even about very current | ||
issues, does not disqualify a judge. | ||
And we can, contrary to what Congressman Cohen said just a minute ago, I was shocked when | ||
he said it, that Supreme Court has demonstrated that it can be very fair in deciding the law, | ||
to Donald Trump. | ||
The court has already heard four cases involving Donald Trump and has ruled against Trump in the first three of those four. | ||
The fourth, of course, they ruled unanimously in Trump's favor because of the preposterous notion that he was disqualified by the 14th Amendment. | ||
But in the first three cases he lost and so the justices that have been appointed by Trump, Alito wasn't of course, he was appointed by Bush. | ||
These justices are doing their best to decide what the law is regardless of their political opinions. | ||
One of the big distinctions here between Ruth Bader Ginsburg and what Justice Alito is dealing with is that In the case of the cases that are before the court now, that has to do with the very heart of the United States Constitution, the peaceful transfer of power and accountability for flouting that. | ||

That VMI opinion that Betsy was talking about, she donated that signed opinion for an auction to raise money for NOW. | ||
A Supreme Court justice donating an opinion to raise money for a pro-abortion group. | ||
And guess what? | ||
Nobody, nobody says, I think you should recuse from these cases going forward on abortion or when NOW or NARAL appear before you. | ||
So, you know, I also uncovered that she had received an award from the Women's Democrat National Party, the Eleanor Roosevelt Award. | ||
And guess who emceed the event? | ||
Nina Totenberg. | ||
Okay, never reported on until I came upon a website of this group and showing her receiving this Democrat award. | ||
So if you look at the Democrat platform, abortion on demand, take your pick, right? | ||
She was a very, very partisan and political justice. | ||

She trashed President Trump during, or candidate Trump during the 2016 election, right? | ||

When she, when she, this is near the end of the term, I think in 2016, she trashes Trump. | ||

She says all this stuff to him and his responses in this newspaper article that he writes is, You know, most justices don't talk this way, but she does. | ||

I saw another report where somebody said, oh, well, she apologized for those remarks. | ||
Well, she did. | ||
She knew what she was doing. | ||

And in fact, the Mazar case, which is on the Trump taxes, the district court judge ruled against President Trump in 20, I think it was 2019. | ||
Uh, that went up and her husband, David Cole, wrote a blog, wrote an article praising the judge saying that Trump doesn't want any accountability. | ||
And guess what? | ||
His wife sat on a panel to review that. | ||
So the exact case going up to her, to the spouse, she didn't recuse on. | ||

And, of course, this flag was at all the Tea Party rallies I ever saw. | ||

It was a Naval flag also used. | ||
On Ruth Bader Ginsburg, the irony is, for really smart people on the left, she outstayed her welcome, didn't she? | ||
She was so egotistical, she stayed all the way to the end instead of retiring when she should have, and it gave us another billet, another slot. | ||
Yeah, Steve, you and I went through the process of interviewing justices. | ||
And, you know, it's interesting, right, that she stayed until 2020 and then President Trump got to appoint Amy Barrett to the court. | ||
I also found, I looked back at this Adam Liptack story on Ginsburg in 2016. | ||
And one of the things she talked about was there was a case called Fisher that had come down that term. | ||
in 2016 that upheld race-based affirmative action in colleges. | ||
And she said, quote, that's a decision built to last. | ||
And a couple of short years later, because of President Trump's appointments and led | ||
by Justice Thomas, who's been doing this for 30, 32 years, they wiped out Fisher in the | ||
Harvard case. | ||
So her prediction was spectacularly wrong about it. | ||
So yeah, she's the little partner there, trashing President Trump, really going out of her way, | ||
just really, I think it's the most unethical act in modern times of a Supreme Court justice. | ||
And there were articles praising her for using her political capital to go after Trump and | ||
try and stop him from being in the White House. | ||
