The attack is unlike anything we have ever seen.
The Capitol was taken by force and the government could not conduct business that was required by the Constitution to conduct.
Members of Congress and their staff were forced to flee, and those who could not flee had to hide.
Officers were assaulted on a scale we have never seen, and many of those officers continue to suffer from the injuries they sustained that day.
There was a range of criminal conduct among those who were in the mob.
At a high level, though, members of the mob, who knowingly trespass onto Capitol grounds, can be divided into two categories.
Those who use violence, and those who rode the coattails of others who used violence, using the access they were provided to commit their own crimes.
As with all criminal matters, those charged with a crime are presumed innocent, unless and until the government has proven their guilt beyond a reasonable doubt.
This unprovoked and relentless attack overall has been proven in court again and again, in trial after trial, with evidence like the evidence I have shared with you today.
The United States Attorney's Office for the District of Columbia Along with many Department of Justice colleagues and law enforcement partners from around the country have been working tirelessly to bring to justice individuals responsible for the siege of the Capitol.
We have worked closely with law enforcement to review thousands upon thousands of hours of video and an enormous number of digital and social media to determine who committed these crimes and the appropriate charges to bring against each defendant charged.
This process is arduous, painstaking, and thorough.
It is also done appreciating that while the mission is important, protecting the rights of witnesses, victims, and defendants is paramount.
The department's work is not to win at all costs.
It is to do justice for all.
And relatively few in number, the mob quickly and brutally overwhelmed the dozen or so officers guarding this first fence line.

What drove it, what happened, how the narrows have shifted, and what we're going to do to get to the bottom of what really happened.

Julie Kelly, tell us who was that, and what was that, and why did it just happen?
I'm totally confused.
Why on the eve of J6 would this take place?
Who was that speaking?
What was he talking about?
And what's the timing of this, ma'am?

So that is the U.S.
Attorney for the District of Columbia, Matthew Graves, a Biden campaign advisor who was appointed by Joe Biden to take over arguably the most powerful attorney's office in the country.
So that is Matthew Graves.
He took over that office in November of 2021.
He then proceeded to accelerate the criminal prosecution of Jay Sixers.
You should know him well, Steve, because a week after he took over the office, guess who his very first indictment was against?

It was some talk show host.

So you were his first indictment, and after that, he accelerated the prosecution, criminal, wide-ranging, unprecedented criminal prosecution of January 6th.
He is the one.
who started bringing seditious conspiracy indictments against members of the Proud Boys and Oath Keepers.
So that's sort of what he was tasked to do.
He continues to round up.
He told the Washington Post that he planned to charge at least 2,000 individuals for their involvement in January 6th.
What Matthew Graves did so egregiously on January 4th of this week The same day that Joe Biden released his campaign ad that talks about show clips of January 6th and how he's running for president to stop reelection, to stop extremism.
Matthew Graves spent one hour in front of a handful of reporters in Washington.
I didn't get the invite by the way, going through the events of January 6th once again.
Reiterating, regurgitating what we already know from the January 6th Select Committee, talking about how this was a plan to thwart the peaceful transfer of power, regurgitating the Oath Keepers and the Proud Boys cases.
What this resulted in, and you saw there, is an example of jury tampering.
This is 60 days.
This happened 60 days From the March 4th scheduled trial date for Donald Trump on January 6th matters.
Now that trial date very likely is not going to happen.
Um, but to stand there for an hour with this video montage talking points, bringing up Donald Trump's name, by the way, um, this is brazen politicization of an office.
We already know is politicized talking about an ongoing investigation, ongoing prosecution.
And threatening that Matthew Graves is going to charge thousands of more people because they were on government public property on Wednesday afternoon.
After all the signage had been removed, after undercut, there's law enforcement everywhere.
He is still rounding up people.
They announced on Friday, January 5th, the arrest of two other men from Florida on charges.
This is not stopping.
And this is why this is such a political partisan selective prosecution.
I don't know why Republicans have not shut down this office, defunded it.
I don't know why they're not impeaching Matthew Graves.
But this is why he can get away with performances like that.
A solid hour.

But you know, have you gotten any, has Capitol, with all your amazing reporting, Have people from Capitol Hill in power, have they called you up to be briefed?
Have members of Congress say, hey, can you come over and talk to me or just come by and have a cup of coffee and tell me what's going on?
Is it not true that the Republican Party stemmed the sternness of, for a few brave individuals, are absolutely petrified, their consultants tell them you can't touch, it's the third rail of modern American politics, and therefore they cower at the very phrase, J6, ma'am?

I definitely have been in contact with members of Congress over the past few years and recently about January 6th and the investigation, but why they're not taking more aggressive steps, not only this, but Capitol Police, who have been in on this since the beginning.
You now have Harry Dunn, this lying, who's lying under oath.
He should be charged with perjury.
I'll tell you what, and I'll tell you when I can, if we have time, my confrontation with Harry Dunn at the court, DC courthouse a few months ago.
He is taking paid time off to give victim impact statements during these trials and these sentences.
He is lying about his involvement of January 6th, not only under oath before the January 6th Select Committee, but also in these sentencing hearings, where he goes and tells his phony sob story about what happened, so he can make sure that judges over-sentence January 6th defendants.
Based on this cop getting up there, Capitol Police officer, pretending to cry, Pretending he was so traumatized when actually he was the agitator, as we know from other reporting, on January 6th.
Steve, I can't tell you how much video I have watched and seen, especially body-worn camera footage.
Surveillance video has no audio.
The body-worn camera.
I have not heard one person use a racial slur at Officer Dunn or anyone.
He has told the American people, and he's running for Congress now based on this, that he was called racial slurs By so many Trump supporters.
It's a lie.
It's another lie.
But he doesn't care.
He's been propped up.
He's gotten book deals just like the other J6 celebrity cops, I call them.
They've all lied under oath.
They've all misrepresented what happened to them.
And now you've got this guy running for Congress.
Actually, he'll be a perfect Democratic congressman as a known liar and drama queen.

Why has no one, like Loudermilk, talk to me about the destruction of the J6 committee, the destruction of evidence.
And Loudermilk's a nice guy, but he's kind of wandering around as a subcommittee head.
He knew about this with Benny Thompson back in March of last year, almost a year ago.
Why has none of this come forward?
Why are none of these staffs pushing it?
Why are none of these congressmen?
They may be talking to you behind the scenes, but nobody's stepping up to the sticks.
Nobody's demanding to go on Fox, Murdoch News and talk about this, ma'am, are they?

Well, look, Fox is not going to have anyone on.
I have been completely blacklisted from Fox since they let go of Tucker.
No one on the right can cover this or explain this like I do.
I haven't been on Fox since, when was Tucker taken off the air?
April or May.
They won't have me on to discuss this.
So they won't cover, certainly Barry Loudermilk or anyone else talking about it.
I do know that his House subcommittee is accelerating and ratcheting up the investigation, not only into J6, But also the committee.
So I do believe that that is going to happen.
I do think that Kevin McCarthy was part of obviously putting a brick on moving forward on any of this, including the release of the video, which Representative Laudermilk is doing.
What's interesting, Representative Laudermilk gave an interview last month.
He suggested that they have J6 committee investigators, staffers coming forward To his office to express deep concern about how that committee was organized and conducted its work.
So it will be very interesting to see if we get more revelations from, you know, quasi whistleblowers who said, look, we tried to investigate certain areas of this and we were told, no, we were shut down.
We wanted more evidence.
We didn't, we couldn't get it because as we know, Liz Cheney made the entire report about Donald Trump.
They never interviewed FBI Director Christopher Wray.
They never interviewed Washington Field Office Director Stephen D'Antuono.
The FBI refused to turn over lots of records.

That was the first name I searched when that report came out.
Christopher Wray.
I think his name is mentioned four times.
There's no transcript of him.
He was never interviewed.
There's no reference to him except a few passing ones.
Then I looked up Stephen DeAntuano, head of the Washington FBI field office, that we now know because Republicans interviewed him.
He was collecting intelligence.
He was really the guy on the ground who knew about the informants, who knew about undercover officers from other agencies who were there.
He was in constant communication with Michael Sherwin, the U.S.
attorney for D.C.
at the time, who, by the way, was walking around in an undercover capacity himself at the Ellipse with street clothes on.
Why is the prosecutor out acting like a detective or investigator?
They were in constant communication.
The J6 committee never interviewed Stephen D'Antuano.
So they intentionally covered up the role of the FBI, either their culpability for getting intelligence and not sharing it with their law enforcement partners.
We're certainly not asking them, what did you guys do?
What other informants, what other assets did you have?
So no, they did not interview the top two FBI officials who would have been in charge of overseeing what happened January 6th before and on that day.

We've had some great ruling with judges of late, where they're saying, hey, you're not a conspiracy theorist if you question these computers and our election platforms.
I think it's been the biggest cover-up to the biggest crime in history.
That's it.

But with everything that's been revealed, I believe the 2020 election will go down as the most important election in history because of everything that's been opened up, the eyes that have been opened, the platforms.
We learned what a uniparty is now.
We learned so much of the corruption in our whole system.
And I think it'll end up being when we get through it, you have to have all this bad stuff happen in order to get to this great place we're going to get to.
You know, Steve, one of the things, all the bad things that are going on, I told our great real president the other day, I said, you got a bucket here and people are jumping in from both sides.
They remember December of 2019 where great decisions manifested to a great physical, everybody's lives that went up improved.
Highest consumer confidence in history, things like this.
Well, we, um, they also know as things are getting destroyed in our country, more and more people are jumping in this bucket.
I told our great real president the other day, I said, you know, you keep, uh, they keep attacking you and attacking you and doing these, these things that don't even make sense.
I said, you're going to end up having more votes than voters like Pennsylvania.
I mean, everybody's pouring into this bucket from both sides.
And, um, so, You know, it might have been, you know, back then if they would have uncovered everything right away or flipped it back to Donald Trump, we wouldn't know what we know now.
And I believe we would have lost our country forever.
So the way it's, it's all been on God's timing.
And I think everybody doing what we can do, I believe it's going to be, and things are going to happen just the way it's supposed to.

by Democratic Judge Amy Totenberg, who is going to be vetting, finally, the vulnerable and unreliable electronic voting systems that were working there.
And what happened with Secretary of State Brad Raffensperger, who hasn't shut his trap in the past three years?
What did he do?
He ran to the court and said he did not want to testify in that trial.
The plaintiffs, who are voters in Georgia, suing Raffensperger.
and others for allowing this very unstable, vulnerable voting system to be used in this predated 2020, but certainly during 2020.
And now all of a sudden the guy wrote a book, he's on cable news, testified to J6 committee, et cetera, et cetera.
Now he wants to clam up finally when he's under oath.
Very interesting.

I mean, is it the individual stories?
Is the 1,000 people still charged?
The hundreds that are in prison right now?
Is it the families?
Is it still the feds' direction?
What we don't know.
When you look at this entire thing and you plan out your battle map, where's Julie Kelly putting her time?

So aside from the Trump trials, both in Florida and Washington, I am very focused on the Supreme Court and what is happening there.
Especially the 1512 C2 obstruction of an official proceeding matter that is before the Supreme Court and could be overturned.
The DOJ and this federal courts, every single judge except one, Carl Nichols, who refused to dismiss the weaponization, bastardization, bastardization, sorry, A 1512c2, the post-Enron tampering with evidence statute that has been slapped against not just Trump, represents two of the four counts in Jack Smith's indictment, but more than 320 January 6th defendants, people sentenced to years in prison.
Steve, if the Supreme Court comes back and rules that this statute should never have been applied to these defendants, that the DOJ and the courts erred, And allowing this count to stand, this is going to be a massive scandal.
This will be an irreparable black eye against DOJ, Matthew Graves, who you just saw there, all of these DC court judges, including Trump appointed judges.
If the Supreme Court comes back with that, we need to call for mass resignations and retirements from every judge, Matthew Graves, his line prosecutors who fought to keep this count, that they knew they were using erroneously, that they were abusing this vague language.
You had the appellate court judge, Florence Pan, a Democrat, Obama, a Biden appointee, actually.
And she admitted in her appellate court ruling that this was a novel use of 1512c2.
It had never been used this way.
So I'm watching the Supreme Court for that, more importantly.
Also, a lot of these other appeals of J6 convictions are finally making their way to the appellate court and then hopefully some of them to the Supreme Court.
So I should say I'm watching the appellate court and also Supreme Court.
Of course, on Tuesday, we have the oral arguments for Judge Chutkin, another Obama appointee, for her unprecedented ruling that denied President Trump presidential immunity protections in this criminal matter.
Oral arguments will begin there on Tuesday.
I'll be covering that and then whatever ruling comes down after that.

I mean, this is so technical.
Before we go to break, I remember, Julie, you came to me the first time about the procedure of the official use, and you said, this is completely bogus.
And I go, what is it again?
And you explained it to me, and I go, are they actually going to try to charge guys with that?
And you said at the time, this is what they're going to try to use.
As basically a dragnet to throw over, but it's totally illegal.
And that was at the very first.
How did you know that?

How have you been so right on so many things when you're not a lawyer?

My first article on 1512c2 is March of 2021 because it was very clear how DOJ, and keep in mind, that was the charge they had in the Mueller report.
That's the count.
Robert Mueller and Andrew Weissman wanted to go after Trump for a 15-12 C2.
They've been dying to use this.
So I first started covering this in March of 2021 when they were charging people like Jacob Chansley with the obstruction of an official proceeding.
Just insane.
So this will be very gratifying if, and many people expect the Supreme Court to overturn R.P.O.J.' 's decision.
It'd be very gratifying, not just for me, for everyone who's been in prison on it.

Another one of the heroes, another one of the patriots of this has been Tom Fitton over at Judicial Watch.
Tom, I've had the honor of knowing you for years.
We made a movie about Judicial Watch almost a decade ago.
I think it was the People's Justice Department.
You've done such an incredible job.
Tell me about Ashley Babbitt, you've taken a particular interest in things around J6.
Why is that institutionally you guys have been so focused?
And talk to me about the filing you just made, a wrongful death filing, I think, lawsuit, because Fenton loves going on offense.
It's just not about FOIA requests, it's about going on offense.
Tell me about the Ashley, Sergeant Ashley Babbitt situation.

Yeah, she was an Air Force veteran, 14 years, and she was shot dead in cold blood by U.S.

Capitol Police Lieutenant Byrd.
tom fitton
And no one who's looked at that video would consider it to be a good shooting, a lawful shooting.
So we represent her widower, Aaron Babbitt, her estate, in a $30 million wrongful death lawsuit against the U.S.
government.
So this is the government being responsible, specifically Congress, the Capitol Police, etc., for Uh, this, uh, wrongful death, uh, this improper shooting of Ashley Babbitt.
There was no, uh, there was no justification for the shooting.
And, uh, as the lawsuit alleges, they should have known the folks running the police, uh, that Lieutenant Byrd had issues.
Indeed, uh, we disclosed in this lawsuit, I want to be specific here, uh, that, um, This is the language we use.
...knew or should have known that Lt.
Byrd was prone to behave in a dangerous or otherwise incompetent manner.
And many of your listeners and viewers already know about how Lt.
Byrd's loaded Glock was discovered during a routine security sweep, because he had left it in the bathroom at the Capitol Visitor Center there, where thousands of people walked through.
But what people don't know, and which we're disclosing or alleging in our lawsuit, For the first time, that Byrd's police powers were also revoked for a prior off-duty shooting into a stolen moving vehicle in which the occupants were teenagers or juveniles.
The vehicle was Lieutenant Byrd's car.
He fired multiple shots at the fleeing vehicle in a suburban area.
Stray bullets from Lieutenant Byrd's firearms struck the sides of homes nearby.
An official investigation found that Lieutenant Byrd's use of force was not justified.
So, you know, I'm not aware of anything happening to Lieutenant Byrd after that.
And, you know, we have this shooting death.
I can't imagine any honest police officer, senior police official, use of force expert, or even honest politicians, to the degree there are any in Congress, who thinks that shooting death was appropriate.
But the left was desperate, the Biden Justice Department, the Pelosi Congress, To roll over the concerns about her shooting death because to admit that a police officer improperly killed a Trump supporter would blow up their narrative on January 6, which is that it was an insurrection.
All the misconduct was on the side of Trump supporters.
And therefore, everything that we want to do against them—censor them, jail them, jail President Trump for daring to dispute the election, take the phones of a member of Congress who also objected to the election, try to jail him for objecting to the election in Fulton County and obviously here in Washington, D.C.—all that's justified.
But this shooting death, we should know, that's the only homicide that happened that day.
This poor woman.
And we're honored to represent Aaron.
We've been working hard on this case, investigating it to the hilt, and I tell you, $30 million, in my view, that should be just the beginning.

Tom, you said the Pelosi Congress.
Look, you've built Judicial Watch into a powerhouse.
You know, my dad just passed away about a year ago, and he was at 100 years old, and he would always tell me – he wasn't a huge donor because he was just a blue-collar guy, but the check he liked writing the best was to Judicial Watch.
And when he told me, he says, Tom Fenton gets stuff done.
No, he says, Tom Fenton's a doer.
He says, there's so many people talk there on Fox, all this, he says, this guy gets stuff done.
He says, I'd love writing him a check.
Fenton, why is it you always, I mean, we've had a Republican Congress for a year.
Why is this stuff still not investigated?
Why is that old committee now thrown at a new committee?
Why does it have to be Tom Fenton, the team of Judicial Watch, your donors on offense?
Where is the Republican house in this, brother?

Well, the leadership obviously doesn't like any of these issues.
They're generally anti-Trump.
They have been.
So anything that they see inuring to his benefit or his supporters, they don't like to pursue.
And then, frankly, too many of our friends on the Hill, people who understand these issues, are hapless.
They haven't figured out either tactically or politically how to advance the ball.
I mean, for instance, one of the first things they should have done was to retract the Pelosi January 6th They didn't need to do another commission or hearing or just retract it.
And, you know, you exercise the powers the American people blessed you with to advance the cause of justice and to protect Americans from this wild abuse by the Biden administration.
And they haven't done it.
And, you know, broadly, I am exceedingly frustrated that we have another speakership where, you know, they're talking a good game.
But where the rubber meets the road, they're not there.
And they're down on the border while fully funding what Biden's doing.
They're complaining about Hunter Biden being in contempt of Congress, but refusing to arrest him, for instance, as they're able to do under precedent.
You know, there are all sorts of things they can be doing much more aggressively that they don't want to do.
And I understand politically sometimes why they don't want to pick fights on everything.
I'd like them to pick a fight on one thing.

But, Tom, these are winners politically.
Let's go back and stay on J6 for a second.
You've actually put together the resources at Judicial Watch.
You've put in a wrongful death.
This is going to blow up, not just shatter their narrative.
It's the right thing to do.
What are the two or three other things just related to the J6?
Because, as Mike Lindell said, this is the greatest cover-up of the greatest crime in the country.
This makes Watergate, it's Doris Watergate.
What do you recommend should be done?
Because if people know what Fentons want to do, they're going to get in back of that and say, this must be done.

Well, we have to recognize that January 6 is the date that's been weaponized by the left to try to accelerate the destruction of our country.
I mean, right now we have Democrats and leftists urging essentially a one party state Using January 6th as the pretext.
And by one party state, meaning when you go to vote on election day, they want only one candidate on that ballot for all intents and purposes, right?
Joe Biden.
They want to remove Trump from the ballot based on this January 6th narrative.
They want to jail not only Trump, but Republican Party leaders throughout the nation based on the January 6th narrative.
Citizen activists who wanted to challenge the election and participate in the processes they're able to do under their God-given rights under the First Amendment and the Constitution, federal law, etc.
They want to jail them.
And obviously harassing other Americans as well.
I know I've been harassed by this Justice Department and Jack Smith's team as a supposed witness.
So, you know, January 6th is the fulcrum that they're using to undo the Republic.
So, you know, my recommendation is maybe those who purport to be conservatives oppose this, purport to be opponents of this, when they call themselves Republicans in the House, that they focus on this and aggressively push back.
And in this case, we have this shooting death by a police officer that works for Congress.
And it's been met with virtual silence by most of the members.

In a Republican Congress, now with a second speaker for one year, correct me if I'm wrong, you filed your suit on Friday.
He's still an employee.
I don't think he's had even a review of the situation.
He's an employee in good standing with pay and bonuses and everything, or benefits and everything associated with that, in a Republican House, sir?

My understanding is he still works there.
Uh, my understanding is that, uh, well, it's not my understanding.
You know, the question is who's going to be the, who's going to be running this debate, this, this lawsuit, right?
Is Mike Johnson, the speaker, is he going to say we should fight Judicial Watch here?
I mean, to me, that's a test.
You know, by the way, Congress, um, the, the U.S.
Capitol police, FOIA doesn't apply to the U.S.
Capitol police.
We're fighting.
This Republican Congress to gain access to all the videos.
They don't want to give us any videos under law.
We appreciate that he's releasing videos.
I'm not sure what he's doing or how quickly it's being released because there's no way of checking it because it's being done just based on what he's decided to do recently.
But they're opposing a federal court working with the Biden Justice Department to oppose us getting these records.
There are emails showing there were communications from members of Congress about January 6th.
We know they have them over at the police board.
They don't want to release any of them to us.
It's not even a question.
You know what's frustrating, Steve?
You don't even have to do much, you know?
Just release the emails.
Just release the videos.
Retract the January 6th smear operation, that report that was put out there by the Rump committee.
bring in and just conduct a hearing or two about who knew what and when about the January 6th disturbance.
I mean, one of the big things that we uncovered is that they all knew tens of thousands of people were going to be there and nothing was done.

And the left wants it to play out with the end of the republic.
And those of us who want the rule of law to prevail want a full understanding of what happened and full accountability of what happened.
Full accountability.
And so when a cop shoots a poor woman crawling through a window that he barely can see, recognized as unarmed it looks like, in what universe would that be seen as a proper shooting with no accountability?
And I don't, you know, Justice Department didn't want to do a criminal investigation, a criminal prosecution.
The Capitol Police, which is about as a political organization as you can get, I gave him a get-out-of-jail card there as well.
Didn't do anything administratively.
But we're going to get some accountability, I hope, through this federal lawsuit, which we filed out in the Southern District of California in San Diego.
So hopefully we get some fresh eyes here.

We're still waiting for transcripts that the Biden White House is holding onto for more than a year.
So I will be covering that as well.
Releasing more footage, interviewing more J6 defendants.
Some of them, believe it or not, are getting out of jail already from being sentenced, especially in obstruction.
And so there's going to be a lot happening.
I know I'll be talking with you a lot more, but there's a lot that's going to happen in 2024, which I anticipate in my new piece, I said the great unraveling of January 6th.
