The federal election interference case has turned into a race against the clock.
Ever since charges were handed down in this case four months ago, the ex-president has seen returning to the White House as his best defense.
No one is more aware of this dynamic than the special counsel, Jack Smith, which is why the Justice Department today took a major step.
Just a few hours ago, Jack Smith asked the Supreme Court to rule on Donald Trump's bid to have the charges thrown out because the alleged crimes took place while he was president.
Now, this is not new.
You'll recall that Judge Tanya Chutkan had rejected that claim and Trump has appealed.
Now Jack Smith is asking the nation's highest court to leapfrog the appeals court that is currently set to decide the issue and settle the matter once and for all.
The special counsel's move potentially setting up the first, but maybe not the last time the Supreme Court plays a role in United States versus Donald Trump.
Prosecutors say, quote, this case presents a fundamental question at the heart of our democracy.
Whether a former president is absolutely immune from federal prosecution for crimes committed while in office Or is constitutionally protected from federal prosecution when he's been impeached by the House but not convicted by the Senate before criminal proceedings begin?
It is of imperative public importance that Respondent's claim of impunity be resolved by this court and that Respondent's trial proceeds as promptly as possible if his claim of immunity is rejected.
Respondent's claims are profoundly mistaken as the district court held, but only this court can definitively resolve them.
As the New York Times reports, the request was unusual in two ways.
Mr. Smith asked the justices to rule before an appeals court acted, and he urged them to move with exceptional speed, end quote.
It goes back to Trump's defense strategy, which is fundamentally more about politics than it is about the law.
As the Times notes, quote, if the trial were to be put off until after the 2024 election, and Mr. Trump were to win, he could just have his attorney general simply dismiss the charges.
Holding a trial after the presidential race would also mean that voters would never hear any of the evidence that prosecutors have collected about Mr. Trump's expansive efforts to reverse the results of the last election before weighing in on whether to re-elect him, end quote.

Welcome to the late afternoon, early evening edition for two hours of The War Room.
I want to start immediately with Mike Davis.
We're going to do a one hour of Mike Davis.
Natalie Winters, Mike Davis at six o'clock.
You're not going to want to miss this about really what needs to be done over at DOJ.
It is going to shock you about what we need to do.
But Mike Davis, I had to get you and Julie Kelly at the top.
Pretty extraordinary activity today by Jack Smith.
Can you explain exactly what in the hell is going on?

Yeah, Jack Smith filed an extraordinary petition for the Supreme Court to hear the issue of whether President Trump has presidential immunity for what he did on January 6th.
Jack Smith wants the D.C.
Circuit, which is the appellate court, to not hear this and just go right to the Supreme Court, and there's a very sinister reason for why he's doing this.
Remember, the Biden Justice Department waited 30 months to bring a criminal indictment against President Trump, and then they timed these four different indictments Back-to-back-to-back to interfere in the presidential election.
Trump is sitting through Tish James' civil fraud trial right now for the last two months for the non-fraud of paying back sophisticated Wall Street banks on time in full as agreed with interest.
And then Jack Smith has his January 6 trial in front of Obama-D.C.
Judge Tanya Shutkin scheduled to start on March 4.
And then Alvin Bragg's is on March 25th.
And then the Mar-a-Lago case with Jack Smith is May 20th.
And then Fannie Willis' January 6th case in Georgia is August 5th.
It's just back to back to back.
This D.C. case, Jack Smith's D.C. case, in front of Tanya Shuckin starting on March 4th, has like 13 million pages of documents that Trump's lawyers need to get through.
They need to prepare for hundreds of witnesses.
There's no chance that this can go to trial on March 4th and Trump get a fair trial.
President Trump filed a motion to dismiss saying that what he did is protected by the First Amendment if he did it within his personal capacity or presidential immunity if he did it in his official capacity as the President of the United States.
When you file for presidential immunity or any government immunity, you're supposed to stay the proceedings until these legal issues are resolved.
And Jack Smith knows that if this goes through the regular process, through the D.C.
Circuit, and then they hear oral arguments, they take the briefs, hear oral arguments, put out a decision, and it goes through the regular process, and it goes to the Supreme Court, there's no way that Jack Smith can start this trial on March 4th, and that trial is going to be several months, six, seven months of President Trump in a DC courtroom with Obama judge Tanya Shutkin instead of being on the campaign trail.
This is blatant election interference by Jack Smith.

No, I mean, look, they're trying to jam this trial through.
They waited 30 months to bring these charges.
Why is it so urgent that they have to have this trial before the election, other than the fact this is obvious election interference?
Why can't they wait to do this trial And so after the election, and it's because they are, they know that president Trump is going to beat president Biden, like a drum on November 5th, 2024, they are panicking.
And Jack Smith through this legal Hail Mary today to the Supreme court, generally the Supreme court, it takes four votes for the Supreme court for the nine justices have to decide to take a case.
They have discretionary review.
They don't have to take these cases with this case.
This type of a case where you want the Supreme Court to grant cert before judgment, cert before judgment with the lower appellate court, it takes five votes. So if you get the three liberals voting for this, you might get two conservatives and they could get this. I don't think the Supreme Court's going to grant this petition because it's so extraordinary and it's so unnecessary, but who knows?
Let's see if these conservative Supreme Court justices cow to the political pressure.
The only reason you would grant cert and hear this case is so you can go along with Jack Smith's political lawfare against President Trump and his blatant election interference.

Is this a panic move and trying to throw a Hail Mary here, ma'am?

Well, Mike just provided such great information and not that you need four justices to grant cert like you do in a normal case, but now five as they are going to leapfrog over the D.C.
Appellate Court.
So as I'm sort of sorting this out and doing some interviews and thinking about it, Um, Jack Smith probably knows what that the appellate court, obviously this take takes time.
Everyone has to file briefs and then they file reply briefs.
And then there's an oral argument and it could be weeks or a few months before the panel on the appellate court renders a decision.
Even though now he has asked for an expedited schedule there as well.
To me, it's starting to sound like Jack Smith wants the Supreme court, which of course is constantly under fire by the left.
Including the Biden regime and the media to wear the jacket as to why this March 4th trial date is going to have to be moved.
Now, it's important to emphasize this is a scandal.
This is a crisis of Jack Smith and Tanya Chutkin's own making.
Jack Smith is the one who wanted this expedited trial schedule.
And Judge Chutkin, an Obama appointee, with a long record the past few years of saying really inflammatory things about Donald Trump.
In other J6 cases, instead of going the normal 12, 14, 16, 18 months between indictment and trial for January 6 cases, she expedited this and set a seven month trial schedule, knowing that all of this litigation on this unprecedented criminal case would have to be fleshed out over the course of just a few months.
So now they've created this, it looks like probably intentionally, and it Does not look like, and it hasn't looked like, the March 4th trial date is going to stick.
There are going to be other appeals as well that they will have to consider because there's still two other motions to dismiss.
Now, the immunity one, to Mike Davis's point, is an automatic appeal.
All of the pretrial deadlines right now are on hold.
And jury selection is supposed to technically begin on January 9th.
And then we've got the holiday season.
I mean, the Supreme Court doesn't have a conference day scheduled.
Until January 5th.
So even in the best case scenario where they expedite this at the Supreme Court, you're still talking about, and I'm not exactly sure how this works, I'm not an attorney, expedited oral arguments, which their term is ending and they've already got a bunch of oral arguments and matters already on their docket, which closes at the end of June.
So I know this is a lot to throw out there.
I just put a piece on my Substack Declassified with Julie Kelly.
Sort of talking about this collision course and also another Supreme Court issue that came was handed down today, which is the relisting of the 1512 c2 appeal before petition before the Supreme Court that also could be taken up by the Supreme Court and that affects two out of the four counts in Jack Smith's criminal indictment.
This thing is imploding so many directions.
So it is a desperate move by Jack Smith.
He wants the Supreme Court to blame for delaying this trial.
And then what do they do?
How can they put it off until what, May, June, July, when he's accepting the Republican nomination for president?
I mean, we're all in unchartered territory, but this totally flies in the face of Jack Smith and Judge Chutkin's protestations and assurances that Donald Trump is being treated like any other criminal defendant.
What Jack Smith did today proves that they are treating him differently.
That he is a political target of this regime and this DOJ, and they will stop at nothing to force this criminal trial, not just out of Donald Trump's throat, but all of us as well.

Devouring resources, really, that we are not able to have access to.
They live in community colleges that we can't afford to go to.
They have open-air black markets and things like that, and we have to pay an 11% sales tax just to get a loaf of bread.
So, I think we completely understand and have understood.
I think finally people are listening to the cries and the complaints of black Chicago and what's been going on with this progressive city.

Before I go to Mark, real quickly, how bad is it in the neighborhoods with illegal aliens there, many of whom turn into petty criminals?
How bad is it actually for black American citizens, working class citizens in Chicago now to live in their neighborhoods?

Well, we already had limited law enforcement resources.
You know, crime has been, I would say, through the roof in Chicago, especially in many black neighborhoods.
And now what you have are these transnational gangs that are compounding that issue.
And our law enforcement apparatus is hampered.
There's little to no accountability.
And so these people are allowed to—this is just inhumane for black residents and all residents of the city of Chicago.
It's also inhumane for the people that they're bringing up here, when we know there's no real houses, no real jobs.
There's nothing for them here.
So it's terrible all the way around.

Why is the federal government pushing illegal alien invaders who, it's not their fault, are not ready for a Chicago winner?
Why are they pushing them into a town like Chicago that's got enough problems with poverty, enough problems with lack of economic opportunity, enough problems with crime, enough problems with schools not serving the people?

Yeah, and before I do that, Steve, I just want to show you, set the stage here real quick.
We're actually outside of this warehouse.
This whole thing behind me right here, and when we pulled up, there were hundreds of people walking the sidewalk.
You can see a few of them over on the corner right there.
There's a black market right across the street right here.
And as we pulled up, there were hundreds walking down the streets here.
This is one location, just to give you a perspective of how bad this is, this is one location with 2,700 illegals being housed in it, and over 50 locations across the city, and there are places like the police station where they still can't fit them.
They are not prepared at all.
Mark, that's the question to you Steve's asking.
Why do you think they're doing this?
Why would they be bringing in these tens of thousands of people, 20 buses a day, a thousand more per day, in a city where you already have crime skyrocketing.
You had 11 homicides last week, 555 homicides so far this year.
Our kids are undereducated.
Why would they be doing this and what's your message?

Well, when you look at what's called the Office of New Americans, the Office of New Americans, the only reason that I can see that they would be doing this is to replace us.
And we say Trump 2024, because Trump is the only one who's going to do something about this and partner with all of America.
This is where all of America has got to come together and put a stop to this.
We have to send these people back where they come from or this is going to explode violently.
It's going to explode on multiple fronts and the mayor and his governor doesn't care.
And since they don't care, then we must go red.
We must link up with all of America.
And we care, and we have to do something about it.
So look up that Office of New Americans.
This is what you really have to pay attention to.
It's called the Chicago New Americans Plan, actually in the city.
But when you go national, it's called the Office of New Americans, and there's a national Office of New American headquarters out of the White House.

We just had one person on the ballot, and so they win by default.
And so that's going to change this time around.

It's going to be 2026 and 2028.
We are done with being disrespected in a country that we work so hard We're done with having our generational wealth raped and pillaged.

We're coming for every politician and we have the numbers.

When that Democratic National Convention get here, you're going to see so many red t-shirts that you're going to think you're in Texas.

Ronna McDaniels could care less about what's going on here.
She's not doing a damn thing about it.
The reason why so many people are stepping up in these communities, they saw what President Trump did.
Not what he said, not the lies about what all of these politicians have done for years.
It's what he did.

That's why they support him so much.
And we're starting to see that.
The key to this, to the Republican establishment across America, you've got to show up.

Bring them out.

Senator James Lanford just told him that nothing Ukrainian President Zelensky could say to the senators on Tuesday would change Republicans' demands that Congress strike a deal to tighten U.S.

He said there won't be a deal this week.
He then continued, maybe if they stayed through the Christmas holidays, there might be something, but the House is not there.
I want to make sure everybody understands Zelensky here today talking the military over the National Defense University.
Absolute disgrace for Zelensky to come over here and be invited by the Biden regime because this gets back to the streets of Chicago.
You have American citizens of African-American descent That have built this country and built the great city of Chicago.
They are the broad shoulders that built this city and they are being disrespected, disrespected by the Biden regime, the entire unit party, the globalist, because now they're forcing illegal alien invaders into a city that doesn't have the resources to care for its citizens in health care, in education, And police protection, and economics, and anything, and now they have to bear the brunt to it.
And they're too gutless.
These progressive whites that run this deal are too gutless to have them in there.
Just like they're not in the Upper East Side of New York or the Upper West Side, they're not out by Northwestern University.
If the progressive white liberal progressives want to continue to force this, why don't they have the 20 to 25,000 people out there?

They're tired of these white progressive liberals that have no respect for the black community.

Another group that's had a belly full of it, and all the polling's shown us that, is young people.
Jane Zirkle joins us.
Jane, the polling is pretty dramatic.
It's about economics.
Tell me what's driving it.

100%, Steve.
Well, you preach all the time about how the lived experience of young people is that everyone under 30 is a Russian serf, and I think it's clear that the young people of this country are starting to recognize this.
I mean, they are overwhelmingly concerned with the economy.
Now, nationally, the economy takes the top issue by 38%, but when you're talking about Americans, Under the age of 30, it goes even higher, all the way up to 44%.
Now, there is still some work to be done with the youth vote when we're talking about a Trump versus Biden matchup, but I do want to distinguish here between those over 25 and those under 25, because when we talk about those over 25, the 25 to 30-year-old age group, President Trump is actually leading by two points, which is absolutely huge for him.
Keeping in mind, this is a demographic that back in 2020 propelled Joe Biden to victory when they voted for him 2-1, so this is a major hard knock for Joe Biden.
I also want to highlight that this poll pulled young Americans who did not vote in 2020.
And amongst those first-time voters, President Trump is taking their vote by 43% to Joe Biden's 21%.

This is absolutely amazing.
The line of demarcation for the under-25s is they just get more information, they find out more about the world, because the flip in the numbers is pretty dramatic.
What do you think?
I realize you're on the short side of 25, but what is your idea?
Because obviously there's something that happens to young people in that time frame that all of a sudden makes them open to the MAGA message, open to President Trump.

Well, this data set was really interesting because those under 25 still are supporting Joe Biden.
They are the ones that are most critical about his performance.
He only has a 35% approval rating amongst this group, which is a drop from those over 25 at around 41% nationally.
And especially when we're talking about issues like Joe Biden's handling of Israel, they are incredibly dissatisfied with the job he has done.
But I also want to focus on the difference between the Republican primary and the Democrat primary because it really is these young voters that is propelling President Trump to victory.
He's seen 73% of the Republican primary base under 30 support him versus Joe Biden is well below the average with under 30 at 56%.
So the more young voters are moving away from Joe Biden, the more they are supporting President Trump.
And of course, you know, there's still a lot of time before the election, and the economy is only getting worse, and with this issue being the top issue, President Trump has a huge opportunity to gain even more traction amongst this group.

It's going to be a direct correlation between credit card defaults and this, because right now young people are gapping their paychecks with these credit cards.
It's killing them.
I keep telling them, saying that if they're like Russian serfs, they don't own anything, they're not going to own anything, and if they like those policies, they should keep voting for them.
I think you're seeing the great awakening of young people in this country and wising up to the fact that the uniparty globalists have a set of economic policies that don't put them first, that don't prioritize them as American citizens.

I want to ask you about Facebook, but given the last two, the black community in Chicago and youth, what's happening here?
I mean, you caught it full force about the vaccines and about the arrogance about the biomedical industrial complex.
But this now revolution, this awakening seems to be seeping into other groups.
Any observations of that?

It's exciting, and I think that it means that That essence of what Americans are, you know, in spite of all the beatings we've taken over the last three years, and certainly African American community for many hundreds of years before that, it hasn't beaten out of us all what our instincts are as Americans.
I think that the vaccine issue is just one part of it, of course, but the way that the Democrats, and as a lifelong Democrat, formerly, I'm listening to this with shame and horror, you know, These gentlemen are right.
The gentleman from Chicago, they are being treated like they don't count.
They are being treated like there's literally nothing the establishment has to do because that community, the Democrats are counting on it, will just keep voting and voting and voting for the Democratic Party.
And I've been in those rooms, I'll confess, you know, where, okay, well, we don't have to worry about the African, I mean, they don't say this in those words, but we've got African Americans, we've got, you know, suburban women, right?
We've got the working class, we've got the unions, we've got the retirees.
All right, all we have to worry about is that tiny sliver in the middle.
And because the leaders of the Democratic Party are so sure they have those populations, and as those gentlemen rightly pointed out, the assumption is there's nowhere else to go.

They make sure there's nowhere else to go.

They have no leverage.
Those gentlemen's analysis was spot on.
There's no leverage.
So actually, paradoxically, the best thing The African American can do is scare the Democrats.

And same with young people.

Same with women.
You know, no one... People have to understand about the two party system that everyone is disempowered when either party assumes that they've got that demographic.

Each party should always be struggling and scrambling to secure that demographics vote.

So it's really a mistake for You know, pro-choice women to say, I will always be a Democrat or for, you know, business owners to say, or the military to say, I'll always be a Republican.

But I also think that the vaccine issue is symptomatic of what these gentlemen were talking about, not just with representation on a kind of governance level, but also economically, you know, that everyone's noticing, as you put it, that serfdom looms.

And I'm really impressed that with James Urkel's analysis too, and I'm happy to hear, I hadn't known that young people were kind of putting the pieces together and realizing that these people may have the most right on soundbites, but everyone had more money, you know, when our money was not being sent to Ukraine, and everyone had more jobs when our jobs were not being sent to Ukraine.
