They are dusting off a 155-year-old provision of the Constitution, Section 3 of the 14th Amendment, that was enacted to get rid of Confederate sympathizers who engaged in insurrection or rebellion during the Civil War. | ||
They were undermining the post-Civil War reconstruction effort. | ||
They were undermining the Union because they were getting elected to places like the House of Representatives. | ||
So you can disqualify him, right? | ||
You can disqualify someone who did this. | ||
There is an 1869 case that is controlling. | ||
The only one that's on point is by Chief Justice Samuel Chase, and it held that if you want to disqualify someone for insurrection or rebellion under the 13th Amendment, Section 3 of the 14th Amendment, Congress has to pass a federal criminal statute for insurrection or rebellion under Section 5 of the 14th Amendment, which Congress did in 1870. | ||
It's still in the books. | ||
It was last updated in 1948. | ||
If you want to disqualify Trump for insurrection or rebellion, you have to have a federal prosecutor like Jack Smith charge him for insurrection or rebellion under this criminal statute. | ||
The jury has to unanimously find him guilty with evidence beyond a reasonable doubt that The judge has to convict and that conviction must be upheld on appeal. | ||
That's the only way you can disqualify. | ||
But the Democrats are trying to use a bogus theory of insurrection or rebellion. | ||
They're saying that January 6th was an insurrection. | ||
How many insurrectionists Come to an insurrection and don't come armed. | ||
How many insurrectionists get to the Senate floor of a nation's capital and walk through velvet robes, follow police direction, and don't burn down the damn place? | ||
How many insurrection leaders, like they think Trump was, tries to send in the National Guard to put down his own insurrection, but Nancy Pelosi and D.C. | ||
Mayor Mario Bowser objected to those National Guard troops, as Kash Patel clearly testified. | ||
This January 6th was a protest A lawful protest permitted by the National Park Service that got out of control and turned into a right. | ||
It was not an insurrection. | ||
The Democrats have spent tens of millions of dollars with Jack Smith and the Biden Justice Department and that goofball January 6th committee. | ||
They couldn't find any evidence because it doesn't exist. | ||
And if this Democrat judge in Colorado, Sarah Wallace, who was biased, she donated to an anti-Trump January 6th PAC. | ||
Last year, before she became a judge in January, the Trump lawyer said, hey, you can't decide this case. | ||

She said, no, I can sit on this anti-Trump January 6th case because I don't remember making this donation a year ago. | ||

She's going to take him off the ballot here in Colorado. | ||
The Colorado Supreme Court will affirm that. | ||
And so the Supreme Court of the United States is going to have to put on their big boy pants and actually do their job and follow the Constitution. | ||
Because what they're going to do, they have this deep blue state in Colorado that they're going to take them off the ballot and they're going to use that as precedent everywhere. | ||
Yeah, and folks got to remember that this has now got to happen now because the primary, it's a mail-in state, 100% mail-in. | ||
Boy, you can't steal any votes that way, can you? | ||
They print the ballot for the primary in the first week of January, I think the first couple of days. | ||
So this has got to happen like right now, Mike Davis. | ||
Do you see the ability to get a stay in a federal court until it gets argued to the Supreme Court? | ||
Well, it's an election challenge in Colorado. | ||
It goes from this Denver District Judge, Sarah Wallace, who's biased, this Democrat judge. | ||
Then it goes to the Colorado Supreme Court, which is stacked by Democrat whack jobs because Republicans stopped winning elections out here in Colorado when they went to all-mail ballots and legalized weed and all the dirt balls from California and New York moved here. | ||
So the Colorado Supreme Court will uphold what she does. | ||
The Supreme Court of the United States will have to issue a state. | ||
What she may do, what you're seeing these other states do, is they're saying, we're not going to decide this for the primary election. | ||
This is only for the general election, right? | ||
So what she may do is say, he can't be on the ballot for the general election. | ||
She may say primary too, because she's so biased. | ||
