Clark, Jeff Clark, over at CRA, just once again, you read in the Federalist Society, Leonard Leo is like the end all and be all.
They curated, quite frankly, the justices, the one on the Supreme Court, the federal judges, all of it.
Maybe with Tim Kelly, some guys in D.C.
I don't know, man.
Maybe we should be rethinking some of that.
But you read the piece.
I just want to make sure the audience understands this.
From a heavyweight like yourself, the future Attorney General of the United States, and I hope Morning Joe's blowing up, their heads are blowing up, and I hope Ari Melber's head blows up on that.
First off, I'm going to get the TV rights, Clark, to your confirmation hearing.
I want to own those TV rights.
I think I can monetize those.
Clark, you've read the piece by the learned scholars at the Federalist Society, sir.
Are you telling me, I just want to make sure, on root and branch, there is no constitutional basis for what the argument they're making, the big donors are making, about President Trump and the 14th Amendment, sir?

Steve, yes, it is a completely wacky argument at this point.
Yesterday I told you, well, what do they have against the fact that the second impeachment failed?
Well, they said it will pass both houses with majorities.
Yeah, but there's a super majority requirement.
So check that off the box.
That doesn't work.
So what do they got against this textual argument?
Here's what they got, Steve.
They have one snippet of ratification history.
An exchange between Senator Reverdy Johnson and then a Senator Marle.
Reverdy Johnson was Maryland and then Marle was from Vermont.
And Reverdy Johnson's like, hey, you know, it looks like this is missing the president from the list.
And he makes the same structural argument, et cetera, that I just made.
And then Marle says, oh, but I call your attention to the clause that references federal officers, right?
Well, first of all, there are serious questions about whether the president is an officer as opposed to above the officers.
Former Attorney General Mukasey covers that in a Wall Street Journal piece.
But even putting that aside, you know, I don't think that that single snippet of legislative history can detract from the text or from the structure of the enactment.
That's what's going to take priority and precedent over like one snippet exchange between two senators.

1866, I believe.

You've seen the truth and the reality.
Now let's go back to what's exactly happening.
As I've said, and I want everybody in the audience to embrace this, This is not the left's picking it up and knew some of these guys are all going to run with it because they know that this is this is a way they're going to try to chop block President Trump.
Caroline Wren, this has been driven by the Federalist Society thing just didn't come out of thin air.
They've been plotting and planning this with the big fat cat Republican donors.
Understanding that DeSantis has failed, that Youngkin looks like a long shot, they've got no other choices, the Keebler elves are all running around Keebler-elving.
Right?
So that's not working.
The lawfare is not working.
Trump's going up.
He's selling more t-shirts on his booking photo than ever before.
That's not working.
They're looking for anything, and they've grabbed onto this.
Caroline Wren, is this not a donor-driven, Republican donor-driven tactic to chop block Donald J. Trump from returning to the White House, ma'am?

It is, but it's also, it's committee-driven.
I actually came on your show well over a year ago and was yelling about the problem we have of Republican committees and candidates paying these uniparty law firms that we basically fund our own demise.
These law firms have liberal attorneys or uniparty attorneys that do not want to see MAGA Republicans in office.
And they're being paid millions and millions of dollars by groups like the Republican National Committee to basically work against us.
There was a story yesterday in the Washington Post about how a Republican attorney at the firm Holtzman Vogel is working with Democrat Secretaries of State right now to keep Trump off the ballot using the 14th Amendment.
Now keep in mind, Holtzman Vogel is a major law firm that has been paid, at least in the last couple years, $2 million by the RNC.
They're currently being paid by the RNC.
And between Holtzman Vogel and another horrible firm I've talked to you about, Jones Day, who famously dropped Trump, in November 2020, after we paid them $36 million to represent Trump in election challenges, they dropped him after that.
Well, Holtzman Vogel has also been paid $34 million by Republican candidates and committees and is now actively working to keep the presumptive Republican nominee off of the ballot.
That is Donald Trump.
I think this is the most pressing issue that we have right now, and I love that everyone is calling their members of Congress to tell them, you know, to stand with Matt Gaetz.
Well, everyone should also be calling the Republican National Committee and asking them the question of, why are you paying a law firm that is actively working with Michigan Secretary of State Jocelyn Benson to keep Donald Trump off the ballot?
That's a very good question.
I think people should use that during their time right now.

What's the name of the, who's the lawyer?
Let's make him famous.
Who's the lawyer over at Holzman & Vogel?
Because Jones Day and Holzman & Vogel are two of the most powerful law firms in the country.
And Jones Day, I mean half of the White House Counsel's Office under President Trump's first term, Where Jones Day, including the White House Counsel, where Jones Day partners are soon to be partners, and Holtzman-Volgo has got some of the best lawyers in the country and do great work, have been paid.
How do they let a... Is this guy gone rogue, or is this just the firm looking the other way?

No, I disagree.
I don't think they're one of the best firms in the country.
I think they're terrible.
I think firms like Jones Day and Holtzman Vogel represent corporations that actively are against the populist movement, the MAGA movement.
And so when it comes down to it, if they care about helping Trump challenge what are very broken election laws, they don't.
They care what Apple, Amazon, BlackRock, BlackStone, these companies are paying them.
The Democrats do not do it this way.
They have a law firm, Perkins Coie, now the Elias Law Firm, that does not take on corporate clients.
It is an offensive law firm of over 100 Democrat attorneys that do nothing other than sue Republicans and do lawfare against us.
Meanwhile, we have combined $75 million to firms like Jones Day and Holtzman Vogel that are not good.
Fine, maybe they're good attorneys for some whatever corporate work that they want to do, but they are not good attorneys in representing Republicans in what is a very broken election system that they do not want to touch because they are profiting off the broken election system.
They're profiting off Republicans losing elections.
And this is a massive, massive problem that has to stop, and it has to stop right now.
The only way to stop it is to cut off the funding.
Why is the Republican National Committee, the National Republican Senatorial Committee, the National Republican Congressional Committee paying firms like this when they're trying to keep Trump off the ballot?

So you're calling for right now, by the way, what's the partner's name over there that's working with Jocelyn Benson over at Holtzman & Vogel, that's working with Jocelyn Benson on the ludicrous 14th Amendment situation?

His name's Jason Tchinsky, and he's actually described in the story as a longtime GOP election lawyer who represents the Republican National Committee.
End quote.
That's the quote from the Washington Post story.
Also, Holtzman Vogel is also being paid right now by Vivek Ramaswamy's campaign, Chris Christie's campaign, and wait for it, Never Back Down.
The Washington Post story writes the story in the way of, oh, it's probably these campaigns that are working to keep Trump off the ballot.
That is fine.
I don't think that is really where this is coming from.
I think it's a more systemic problem within these major Republican law firms of they are never Trump.
hate Trump and I think that their biggest revenue is not from the Chris Christie campaign, who doesn't have any money, it is from these major corporations that keep them on retainers that want to keep Donald Trump out of the White House.
And we are funding them.
We are literally funding our own demise at this point.

I want to get to what we got to do about this, but this is also the Washington Post had an article about Kudlow and Forbes and Arthur Laffer and all this crew, Steve Moore.
And I love these are good guys.
They're good men.
But they're also neoliberals.
They're up advising President Trump or talking about President Trump on corporate tax cuts to 15%.
Are you insane?
I will guarantee you one thing will never happen.
With the $2 trillion annual deficit, and you just saw the working class people are paying this massive hidden tax on inflation, we're not going to cut the big corporations' taxes down to 15%.
And Grover Norquist says, oh, we should go to 14%.
That's not going to happen.
That's a fantasy.
Right now, what corporates should be doing is de-woke your company and start paying your employees more money.
Do that first.
And then we'll think about the tax cuts.
No, they're not tax cuts.
That's another thing.
And you're right.
These firms and the law firm.
My only point is.
The Democrats have Elias.
We don't have that.
And you've got to have some of these.
If you're not going to have some of these powerful law firms, you're just not going to get the best lawyers.
Let me ask Clark.
Clark, what would be your solution to this?

We can't depend on the typical Republican law firm because they've got so many corporate clients.
They're always going to be backdooring you.
Do we need to go to what Mark Elias has done?
And remember, even Perkins Corey had to throw him out because even their corporate clients Absolutely, Steve.
So you're very big on talking about the long march through the institutions.
So he's got a whole firm that just focuses on that.

Absolutely, Steve.
So you're very big on talking about the long march through the institutions.
Well, one of those institutions is America's leading law firms, and they have been marched through with all of the wokeness, the DEI, et cetera, violating now expressed Supreme Court decisions about not racially discriminating.
We need to create our own institutions, Steve, because the institutions that we used to rely on have been corrupted.
And I agree with Caroline entirely that they're just they're wedded to a uniparty, you know, kind of view of the country, an elitist view of the country.
They're not.
They're the enemies of populism.
They're the enemies of ordinary people.
And we need to create new law firms that will actually fight for the people of the United States and not just for the well-heeled.

You're fired up on this one, and I think you should, this Holtzman-Vogel thing, and there's some good guys over there I know personally, because I know I'm going to get some blowback today.
This guy, particularly when he works for the RNC, he's being paid on the RNC, and the rest of these campaigns, you know some of them are in back of it.
What are you calling for?
What's your call to the action to the posse?

We need to start a Republican law firm.
I've been yelling about this for two years.
I said this to Rana and the RNC, and it is one of the reasons why I worked with both Harvey and Mike Wendell to take out Rana because they refused to address this.
But we need to prop up a Republican law firm that we tell them you cannot take on corporate clients.
You can only take on, you know, Republican committees and candidates and focus on offensive lawfare.
And so imagine the $75 million we pay to those two firms.
We could have propped up a very, very strong law firm.
And so that is an immediate action that I don't know how the War Room Posse can necessarily help me with.
It's something that I've just been telling anyone and everyone I could listen to.
So I would advise them to call the Republican committees, call their members of Congress, and tell them stop working with these firms.
And we need to have strong, conservative attorneys, such as Jeffrey Clark, working with us who are not conflicted out with these corporations.

Steve, I think that it's precluded as to President Trump, and I think that the argument of applying it to the President or Vice President, which has never been done before, when those offices are not in Section 3 of the 14th Amendment, is a non-starter legal argument.
And then I'll just add in this last point.
Which is, look, who could possibly have standing to litigate this and say they're personally harmed by who the president is?
This is different than Bush v. Gore.
In Bush v. Gore, the Supreme Court said that the personal right of equal protection of the laws was violated because they were doing a recount down in Florida that had a different standard at different tables.
And the Supreme Court said, we can't have that.
This is not like that.
This is an institutional argument.
That institutional argument's been wiped off the map by the second and failed impeachment trial.

Well, honestly, Steve, I happened one day across Jake Lang's documentary about the death of Roseanne Boyland.
It was actually about January 6th, but he mentioned in there that he had been one of the people that had tried to save her life and that he was in solitary confinement.
And I was shocked that I didn't know her story.
And, you know, as a journalist, I mean, I've been a journalist for more than 35 years now, and it's like an instinct, right?
The moment I heard about that, I was filled with guilt because I thought, how can a woman die?
on January 6th at the Capitol and nobody knows her name.
That's just wrong.
And then when I looked into it, you know, and found that they had lied and said she died of an overdose, which wasn't true.
And there were all kinds of cover-up stories that weren't true.
You know, I just knew I was going to tell that story.
And I can honestly tell you that as I've traveled the country, you know, telling these different stories and meeting different people, I realize that there's a complete void in the consciousness of America.
People have no idea who went to the Capitol on January 6th.
There's only one image out there which paints people, you know, as violent and insurrectionists.
And of course, the backup to that is the deplorable narrative that Hillary Clinton established In 2016, where if you're, you know, if you're not a terrorist and a white supremacist, you at the very least are misogynist, racist and homophobic and so on and so on.
But what I found was really the salt of the earth.
I found America as I traveled and that only inspired me more.
You know, I found the Aaron James, who was a Navy combat medic who deployed twice.
And literally stitched people together on the battlefield who went up there when Roseanne Boylan was dying and they were trying to save her, the protesters, and he picked up a shield that was on the ground so that the protesters wouldn't be gassed.
You know, and that they would be able to work without interference.
I mean, this man is facing decades in prison.
Okay.
And his two younger brothers with him and his elderly stepfather.
So that mother is going to lose her whole family.
And you know, her oldest son is black.
Her two youngest sons are white.
I mean, this is in just in telling these people's stories.
I discovered inadvertently how to show people how dishonest, how fundamentally deceitful the narrative is.
We know it's deceitful, but it's different when you hear it and you see it.
And these people get to speak in their own words.
And their stories have not been told.
Their faces have not been seen.
And there are people sitting in prison behind bars without being convicted of a crime, political prisoners who have been denied their right to a fair trial.
As you know, you've covered that on this show many times, but most of the media doesn't cover it.
And so, for me, there's no greater injustice than to deny people their fundamental rights for political reasons.
And we all know, you know, it's a matter of time.
They've already come for you.
They'll come for me.
They'll come for anyone who won't surrender, who won't bow.
And so, you know, I just, I was inspired by Roseanne Borland.
I wanted to know her and I wanted to do justice to her as a person, not just this, you know, this name on a page that most people had never heard of.
That was just wrong to me.

Three things.
Number one, I'm fighting to keep investigative journalism alive.
You know, really disciplined writing, scripted content.
I mean, you can see we put, you know, the investors put a lot of money behind this.
It still doesn't have a corporation behind it or a news division, the way I would at 60 Minutes, but this is 60 Minutes storytelling.
So that's one thing.
The second thing I want to do is address the injustice of what happened to Roseanne Boylan and the others around her.
Not just Roseanne Boylan, Matthew Printer, who killed himself awaiting sentencing, and also Jerry Brown, a 20-year Green Beret, who's behind bars, put there by the very men who tried to recruit him to be an informant.
and to snitch on the Oath Keepers right before January 6th, when he had just joined.
You know, and what I want people to understand though is, you know, January 6th is vast.
There are so many stories that we could have told, and we may still tell more.
But we, this is not trying to address every single aspect of January 6th.
This is not some, you know, we're not judging jury here.
I am a journalist and my job is to try to tell the truth because I truly believe the American people have been deceived.
And that I just want, I don't want to convert people.
I'm not trying to, you know, convince people of anything.
I'm not an attorney in a court of law trying to prove a case.
And I am most especially, I am not an activist.
What I believe is that when people have the truth, they do the right thing, they make the right decisions.
So I want people to take that away.
And then the third thing that I want to do is I wanted to bring these people to life.
You know, Philip Anderson is a young black man who almost died next to Roseanne Boylan.
He was saved by Jake Lang, who's been sitting in prison for years now without trial.
And Philip Anderson tweeted out that he was going to be in this series, and he was arrested the very next day.
After years, right?
After years.
And so we just don't know, you know?
Is he being punished because they want to silence him?
They don't want him speaking out?
You know, it's impossible to prove that kind of thing.

But the very, the very last thing I want people to get out of this is to learn what we learned as we embarked on this journey about how the protestors were set up, about how the American people were set up, about how the Capitol Police and Metropolitan Police You know, most of them were set up.

There's clearly, as you watch this unfold, there was clearly an effort made to set the conditions for chaos.
Because in those conditions, good people get hurt, bad people do things they shouldn't, people who witness terrible things, you know, they go too far, they get emotional.
And so all of this kind of came together.

It was an act of men.
Right?
Men and women in positions of great power.
We can't name them or expose them all.

And there's no better example of this happening than what's been going on with the origins of COVID.
We know there's frankly been More revisionist history, I think, than the 1619 Project, at least coming from the Chinese Communist Party on the origins of the virus.
But what we discovered last night, thanks to the Select Subcommittee on the coronavirus pandemic, is that there is now a high-level, multi-decade current whistleblower at the CIA who claims that operatives and intelligence officers within the CIA Paid people offered them, quote, significant financial incentives to change their conclusion about where COVID-19 came from.
Now, the CIA committee to uncover the origins of COVID-19, there were seven people on that committee.
Six out of the seven, Steve, actually said that they felt that COVID-19 developed through a lab leak, likely the Wuhan Institute of Virology.
There was just One lone survivor who didn't believe that.
But what's so interesting is when you looked at the IC assessment, the origins of COVID that Joe Biden had required all the various agencies to put out what I would call one of the most performative displays of trying to be tough on the Chinese Communist Party from Joe Biden.
They recorded the CIA as basically not having a conclusive or definitive position.
on where COVID-19 came from. But this story has obviously been breaking. It's been catching wind because it is so ridiculous, right, that you have the CIA literally bribing people to adopt narratives about the origins of COVID that are more favorable towards the Chinese Communist Party.
But what I've really dug down and where I think it gets even more interesting is that beyond the committee asking for the emails, the communications, all those records from people who were on the committee, they actually sent a letter specifically to the former COO of the CIA.
um... identifying him as one of the key players really spearheading this effort to basically bribe the cia analysts but what's so interesting about this steve this individual's name is andrew uh... mccready's believe it or not he now is a senior advisor at beacon global strategies and people may recall this super swampy consulting firm not only the place that mike morrell of the hunter biden hard drive russin did russian disinformation letter uh... infamy
uh... he is also a senior counselor there but of dozens of the signatories on that statement really the kinda locus the center point of where that statement that now as we know fake statement originated from and has a lot of roots to beacon global strategies and of course even as you know i'd like to try everything to the chinese communist party and justly so not only the place that Mike Morrell of the Hunter Biden hard drive Russian disinformation letter infamy, he is also a senior counselor there, but dozens of the signatories on that statement, really the kind of locus, the center point of where that statement that now, as we know, fake statement originated from.

And of course, Steve, as you know, I like to tie everything to the Chinese Communist Party and justly so, because all roads lead do lead to Beijing when it comes to covid-19 beacon global strategies is the same firm that was hired by Sequoia Capital to help defend them from the ongoing probe and inquiry into their very, very, very close ties and of course, investments with the Chinese Communist Party.
So I think it's just a perfect example, not just of the CIA having their own consensus, their own opinion.
As I said, using money and leverage points to try to get a certain narrative that's more amenable to the Chinese Communist Party across.
But it's very curious that the same individual who was allegedly a key figure in this, basically what it is, is a bribery scheme to change the story about the origins of COVID to basically be more favorable towards the Chinese Communist Party.
He departs the CIA soon after and gets a very cushy gig at a Chinese Communist Party-linked consulting firm that is, of course, also linked to the Hunter Biden cover-up, the Joe Biden campaign, and I think that's how we need to internalize this COVID-19 investigation.
It's as politicized, as just bogus, and as really, I think, weaponized by the administrative state as they have done with the Trump impeachments, the indictments, and even the Russia hoax.
So when they say that we've politicized COVID-19 and the investigation into the origins, it's just accusing our enemies of what you're guilty of.
