| When the president acts within his official powers, including the outer bounds of his official powers, his actions are protected by presidential immunity. | ||
| And alternatively, if he's acting within his personal capacity as a private citizen, his actions here, his words and conduct are protected by the First Amendment. | ||

| This is a really, you know, I've been dealing with this. | ||
| I've had this 50 pound weight on my back for two and a half years. | ||
| I've had a bar complaint filed against me because I represented the president in the post election in Georgia. | ||
| And I can just tell you what I've said before. | ||
| And they want to put me in jail for saying this. | ||
| But there are more votes that were cast and counted in Georgia that violated Georgia state law than the margin between President Trump and Joe Biden. | ||
| Now, there is precedent under Georgia law. | ||
| There's a statute says that you can file an election contest. | ||
| And we filed an election contest on December the 4th. | ||
| And it was a 64 page complaint. | ||
| And with more than 1,100, 1,400 Exhibits with verified affidavits, people testifying under penalty of perjury. | ||
| I saw this. | ||
| This was a violation of the law. | ||
| Expert witnesses who reviewed publicly available documents, government records, and said these votes were cast illegally. | ||
| And we never got a judge appointed to hear the case. | ||
| So the electors, I wasn't really, excuse me, I wasn't part of that But there was a memorandum that had been prepared back in 2000 by an attorney who was one of the people indicted, Kenneth Chesbrough, he'd worked for Lawrence Tribe. | ||
| And there was a 1960 decision in a Hawaii case following the 1960 presidential election, where the electors for the Democrats, John Kennedy, met in order to preserve their rights under the election contest code in Hawaii. | ||
| And the judge said, it's a good thing that you met to preserve your challenge, because if you hadn't met, it would have rendered the lawsuit moot. | ||
| So based on that precedent, the advice was that the Trump electors should meet And there is apparently a transcript, which I just learned about on Saturday because I had, I said, don't send it to me. | ||
| I still didn't know. | ||
| I didn't know until last night if I was going to be indicted for having the temerity to represent the president and help to prepare that election contest. | ||
| But apparently they had a court reporter. | ||
| Remember all the news media, all the left-wing crazy news media have said that Trump electors met in secret, that fake electors met in secret. | ||
| Well, they didn't invite the media, but they had a court reporter who transcribed everything that went on. | ||
| And apparently they said, we are contingent electors. | ||
| We are only here to preserve. | ||
| Remember, this is December 14th. | ||
| We filed our election contest December the 4th. | ||
| A judge still hadn't been appointed. | ||
| And so they literally, it's in the transcripts, I am told, where it says we're only meeting To preserve these rights of the president in the event that the election contest is found to be valid and after the trial and a new election is ordered or some other remedy is ordered. | ||
| We're only meeting for that purpose and that purpose only. | ||
| That transcript is completely exculpatory and apparently the DA has had it for more than a year. | ||
| We need to see all of this information. | ||
| And we need to know about each of these people. | ||
| These are people whose lives are being upended with legal bills, with the pressures, with threats of being disbarred if you're lawyers. | ||
| I mean, this is an outrage. | ||
| These electors, these Trump electors, not only in Georgia, but in Michigan, where you have the partisan Democrat attorney general. | ||
| Filing indictment, criminal charges against those Trump electors. | ||
| The same thing is being threatened in Arizona by their Democratic attorney general. | ||
| And the same thing has been yesterday. | ||
| The Democratic governor of Wisconsin said he thought that the Wisconsin Trump electors should be prosecuted. | ||
| Let me tell you something. | ||
| This is, this is not legal process. | ||
| This is political process that is using the power, the mighty power of the federal government and the state government to go after people who were not, they had no criminal intent. | ||
| And my understanding, I'm not a criminal defense attorney or criminal prosecutor, but the RICO law requires there must be an underlying crime. | ||

| I thought there was another path about just what the Electoral Count Act of 1887 and the reason they change it in the dark of night, just like they filed this indictment in the dark of night, The Dark Knight in the omnibus bill with no debate. | ||
| They changed the Electoral Count Act of 1887 because the framers of this nation gave the state legislators the power to not just oversee the elections, but also the electors. | ||
| And if they had just gone back for review, as Pennsylvania had asked for, and others were about to jump in and ask for 10 days, You would have seen, I believe, not a flipping of electors to alternative electors, but saying we cannot certify this because of what Cleta Mitchell is just going to tell us in a second about what she filed on December 4th. | ||
| They were saying, hey, we can't certify the Biden electors. | ||
| The Constitution and the Electoral Count Act of 1887 says this must go back to the House of Representatives and the House of Representatives is to decide. | ||
| And it's not by individual vote. | ||
| So Nancy Pelosi doesn't control this. | ||
| It's by state party delegation, and we win 27-23, and Donald John Trump is President of the United States. | ||
| Now, maybe Liz Cheney would vote against Wyoming, okay? | ||
| And it might have been 26-24, but Trump would have been President of the United States. | ||

| Cleta Mitchell, just go back, hit rewind, and tell me about December 4th, about what you filed with 1,100 plus affidavits, right? | ||
| 1,100 documents, affidavits, receipts to your, on December 4th. | ||
| Was that outside the margin of error that was in Georgia at the time, ma'am? | ||
| We had over 30 categories of illegal votes that were cast and counted. | ||
| The margin was 11,779. | ||
| And that was the third number. | ||
| Remember, there were three recounts that all the numbers were different. | ||
| And that should give us pause, shouldn't it? | ||
| You've got to be able to get the same number more than once. | ||
| None of the numbers matched. | ||
| And so that was the third and final and certified number, 11,779. | ||
| We had found, according to government records from the United States Postal Service, that there were 18,325 votes that were cast by voters whose registration address was at an address that according to the post office records was vacant. | ||
| There were 904 votes cast from people whose registration addresses were illegally at post offices, post office boxes. | ||
| That is a violation of Georgia law. | ||
| There were over 40,000 people who had voted. | ||
| They moved out of their former address in a county to a new county more than 30 days before the election. | ||
| Under Georgia law, you cannot go back and vote in your old address. | ||
| You have to re-register and vote in your new county. | ||
