In a narrow 5-4 decision, the justices ordered the state of Alabama to redraw its congressional map, saying the current one discriminates against black voters. | ||
NBC's Laura Jarrett is here with me. | ||
Big implications and a big surprise. | ||
Big implications for 2024. | ||
Now, not only does Alabama have to go back and redraw its maps, potentially allowing black voters to have more than just one of those majority districts, but other states might have to take a second look at their maps and make sure that they now comply. | ||
with what the Supreme Court has done, which is to reaffirm Section 2 of the Voting Rights Act. | ||
This is a conservative majority that I think it is safe to describe as relatively hostile to other portions of the Voting Rights Act that it had gutted in previous years. | ||
But today they decided to maintain the status quo, said the lower court was right to follow the precedent that has already been on the books for the better part of several decades. | ||
Remember the whole point of the Voting Rights Act there was to sort of remedy the harm of disenfranchising black voters for so many years. | ||
But when you see some of these maps, they're drawn like, you know, modern art or somebody through paint against the wall. | ||
But they didn't. They took a computer and they figured out, how do I get my voters in one place? | ||
So are you saying this could open up the floodgates for a lot of other places to challenge? | ||
What Alabama had said was, yes, because we used that computer module, we didn't intentionally discriminate. | ||
The problem for them is that's never been the standard. | ||
That's never been the law. The standard has been looking at what is the impact? | ||
What's the discriminatory effect? | ||
Put aside the intent. | ||
And so because the Supreme Court again today has reaffirmed intent doesn't matter, it gives voters the power to challenge these maps when they can show the effect on the ground. | ||
Here's a question for you. | ||
Just how far are the radical left and inside the beltway bandits willing to go to stop him? | ||
They all know they hate him for winning the fight to protect life, for exposing their deep state, for draining their precious swamp. | ||

We are in a dogfight in the North Carolina and Ohio that we could shift another, correct me if I'm wrong, bro, five or six more seats, boom, just because of where the state assemblies are in the population. | ||
And all of a sudden, a bombshell. | ||
Maybe I'm wrong. Like I said, I'm not a lawyer. | ||
I'm not a Supreme Court guy. I'm not a constitutional guy. | ||
That's all you lawyers. | ||
You're my guy. What in the hell happened here, brother? | ||
Well, you know, I would say that you have four rock-solid conservative justices on the Supreme Court in Justice Thomas, Justice Alito, Justice Gorsuch. | ||
And Justice Barrett, and you have two Republican-appointed justices who are more cautious, right? | ||
They take a more cautious approach to interpreting the law. | ||
Some would call it weakness. To be fair, we'll call it cautious. | ||
And that is the Chief Justice, John Roberts, and Justice Kavanaugh. | ||
And so what they did here in this case, on this voting rights case in Alabama, there is Section 2 of the Voting Rights Act. | ||
Ben, these court interpretations of Section 2 going back decades that are just simply wrong. | ||
They're not what the Voting Rights Act was intended to do, and it's not what the Constitution permits. | ||
Under our Constitution, it's state legislatures who get to decide how we redistrict House seats every 10 years after the census. | ||
Under our case law, there is a rule For the federal government to play, for Congress to play, to make sure we don't have illegal discrimination in redistricting. | ||
It seems like Section 2 of the Voting Rights Act, as interpreted by liberal judges over the last several decades specifically allows racial discrimination. | ||
It allows these federal courts to consider all of these racial factors that they otherwise could not consider under our Constitution. | ||
And Justice Clarence Thomas writes a powerful dissenting opinion on this. | ||
Essentially what they're holding here is they're trying to reapply precedent for the last two decades that Congress can rewrite. | ||
It's very hard to change laws. | ||
I think Justice Kavanaugh's Justice Kavanaugh's concurring opinion where he says that we should just defer to the legislatures here because they can rewrite the laws. | ||
That's easier said than done. | ||
What I would say is that our judges need to quit being so fearful of what Democrats, what the New York Times, what the Washington Post, what the Democrats are going to say. | ||
Mike, Mike, you were Gorsuch's clerk. | ||
You got these guys through. | ||
Thomas, Alito, Gorsuch and Barrett don't care about the D.C. cocktail party circuit. | ||
They don't care about going to these dinner parties in Georgetown. | ||
They don't care. | ||
Roberts and Kavanaugh are social animals in this system. | ||
Isn't that what we had here? | ||
Didn't they blink because they didn't want to, oh no, these are the white nationalists, this is all the racist, etc. | ||
And this jeopardizes North Carolina and Ohio? | ||
Am I incorrect in any of this? | ||
No, I mean, I think what we see is the Chevy Chase wing of the Supreme Court. | ||
And, you know, that could cause problems when you have the Chevy Chase wing of the Supreme Court because they don't live in reality. | ||
I mean, I remember going through Chevy Chase not too long ago and seeing a bunch of deranged leftists still wearing COVID masks, right, with their weird signs in their yard about letting immigrants into our country except for not in Chevy Chase. | ||
And so, no, I mean, Maybe that's the problem when you pick Supreme Court justices inside the swamp. | ||
They are creatures of the swamp and they want to be liked by the swamp. | ||
And so, overall, I think Justice Kavanaugh has been very good. | ||
I just think that, you know, it's hard for him to escape his swampy roots from time to time like here. | ||
Is there another case that's going to bail us out on this? | ||
Is there a case coming up in the next year that could bail us out before 2024 on this? | ||
Well, I mean, remember, this is racial gerrymandering that they're dealing with with the Voting Rights Act. | ||
It still causes a whole bunch of chaos and problems. | ||
But the real case that's going to be coming up is political gerrymandering. | ||
And I think you're going to see six justices squarely behind that states can politically gerrymander. | ||
And that's just, it's a nonsense argument. | ||
bogus political theory by Democrats that you can't use political gerrymandering and redistricting. | ||
It's just the Democrats way of grabbing power. | ||
That's all they care about. Democrats do not care about racial discrimination. | ||
They care about power. | ||
And if racial discrimination gets them power, they're going to discriminate based upon race. | ||
If racial discrimination doesn't get them power, they're going to cry about racial discrimination. | ||
They are so dishonest about this issue and they've always been dishonest about this issue. | ||
Mike, I know you haven't had time to review it thoroughly, but Hugo Lowell, the great reporter of The Guardian, is about as even-handed as they can get, is reporting that, I guess, the valet at Mar-a-Lago, his lawyer has come forward and said that he was essentially muscled in his testimony. | ||
Any thoughts on that as they get close to this Espionage Act indictment? | ||
Well, it doesn't surprise me that Jay Brat's doing this, the head of the National Security Division, because he is a snake. | ||
He is the problem at the Justice Department. | ||
So if Jay Brat brings in the valet, Jay Brat, the Justice Department, is trying to get this valet to turn against Trump. | ||
And when the lawyer's talking to Jay Bratt and the rest of the Justice Department officials, Jay Bratt just nonchalantly brings up the fact that this valet's attorney had applied for a D.C. Superior Court judgeship. | ||
And guess who picks those D.C. Superior Court judgeships? | ||

So... For Jay Brat to throw that out there nonchalantly, that seems like a big problem that the Justice Department's Office of Inspector General needs to look at, or one of the ethics officers of the Justice Department. | ||
Why the hell is Jay Brat bringing up This attorney's application to the D.C. Superior Court. | ||
And then they're pretending like, oh, Jay Bratt has nothing to do with picking these superior court judges. | ||
No, his boss's boss does, the President of the United States. | ||
And Attorney General Merrick Garland has a big say on who becomes these judges on the D.C. Superior Court. | ||

He seems quite uncomfortable doing them. | ||
He seems quite uncomfortable. The tone doesn't work. | ||
The tenor doesn't work. And so you wonder who is at the back of all of these. | ||
And so people have started to go around and look into DeSantis world. | ||
One of the things that they did recently after they had one of their major donor conferences in Miami that very same day as the campaign launch, they actually tweeted a picture of the room out because they unfortunately had some leakers there. | ||
And that picture of the room has allowed people to look into, okay, so who are their donors? | ||
Who are their bundlers? The people that kind of lump other donations in together. | ||
And by the way, I can't get too much into the detail right now, but there are some major, major stories coming up about that in the next couple of days, too. | ||
So you're going to want to stay tuned. | ||
But this one today is a particularly interesting one for us because it concerns the Chinese Communist Party. | ||
And the Chinese Communist Party It's tentacles into so many major corporations around the world right now, but this isn't one of the major corporations they have their tentacles into a little bit. | ||
This is one of the major corporations that is almost fully controlled by the Chinese Communist Party outright. | ||
In 2017, this company, Tencent, was said to have 7,000 employees that were members of the Chinese Communist Party. | ||
It's a company that owns video games and WeChat and social media platforms and all around the world and uses that technology to stifle dissenting views in China, to go after dissenters in China and indeed, as we know, around the world. | ||
And this is a company that is being lobbied for in the United States by a man called Mark Lampkin. | ||
Well, Mark Lampkin is also a leading fundraiser for Governor Ron DeSantis. | ||
I'm going to read from thenationalpulse.com right now, and I hope everybody else can join us over there to read this report, see the receipts, and share it for yourselves. | ||
The firm that Lampkin is both a partner in and shareholder of, Brownstein Hyatt, Received a total of $2.13 million from Tencent over the last couple of years. | ||
And you'll remember that's the last couple of years since 2020 when Donald Trump himself issued an executive order which attempted to ban transactions between U.S. companies and Tencent. | ||
Such was the National Security Council. | ||
Case against that organization, well, we went back and looked and there have been just a plethora of payments, $800,000 in 2021, $800,000 in 2022, $330,000 in 2020, and so far this year, $200,000. | ||
The question I think that everybody has to be asking here is why? | ||
What link is there that ties somebody like Lampkin To DeSantis and what interests of the Chinese Communist Party have there? | ||
It's at the least an extremely bad look and at the most I think real reason to ask Ron DeSantis these questions. | ||
Why do you have these people raising money for you that openly work with the CCP? He's got to come forward on this, on the Griffin thing and the big donors and the oligarchs and this, and the CCP, all the bundlers and lobbyists. | ||
The bundlers, we said that day, he only had 40,000 individual donors on a huge launch. | ||
It all came from the bundlers down there. | ||
It was the billionaires' ball down there, the dial center. | ||
He's got to come forward in this. | ||
People have to know that he's totally independent, that he's not completely controlled by this. | ||
