But we're seeing this now sort of in the public eye for At least, what, eight years? Because you did have it with Hillary Clinton, the question of classified, the handling of classified information.
Certainly the handling of classified information with Donald Trump.
Now with Joe Biden, does the system need to be fixed, updated, changed? Can it be?
Or, again, is this just a matter of there's always going to be room for human error?
If that's what happened here.

Yeah, sure. And, you know, there are a lot of questions, as we've all said, we don't know yet.
But the answer to your question is maybe, and probably it should be.
And if Republicans were operating on the level, as my mother would say, and they may be in the Senate, we'll see, then that should be part of the discussion.
To my knowledge, there is not a process where somebody has some sort of certification and they go through every box that leaves the White House.
That's not typically what happens.
Because historically, public servants, high up and down the food chain, want to do everything they can to follow the letter of the law.
That means turning in classified documents.
That means keeping them in the place where they should be stored.
That means moving them from building to building in the cases they should be moved in.
Clearly, there are mistakes that are made, and there are probably mistakes that have been made, as Matthew said earlier, over the course of decades that we don't know about.
So it may be that this warrants a discussion about how this process should work during a discussion and how documents should be cleared out at the end of a presidency.

The first set of documents were found in November at the Penn-Biden Center here in Washington.
Why did it take until yesterday, until this morning apparently, for whoever it was to inform Robert Lausch that that final document was found?
Was that because there were press reports earlier this week?
And the hope was that nobody would find out?

There is a process, an ongoing process that is occurring.
We did this by the book.
And what I mean by that is the moment that the lawyers discovered that the papers were there or the documents were there, they reached out to the archives, they reached out to the Department of Justice, and they immediately, rightfully so, Reached out to them to let them know what they had discovered.
And that is the process.
That is what his lawyers did.
And again, it's an ongoing process.
As you stated in your question, I am limited in what I can say.
It is now in the hands of the Department of Justice.
They are reviewing this.
As you know, the special counsel was announced by the Attorney General, and so I will leave it there.

I'm joined today by John Lausch, the U.S. Attorney for the Northern District of Illinois, who conducted the initial investigation into the matter that I will describe today.

I've got the two individuals that I think have put the most intelligent framing on this from the very beginning.
Mike Davis from Article 3, a former clerk to Gorsuch and Kash Patel, really the president's right-hand man when it comes to intelligence and things like these.
I want to start with Mike Davis, but also just right there.
You know, the buried lead in all this, which nobody wants to talk about, why were his personal lawyers rummaging around a closet at the Penn-Biden Center?
Why do you have your personal lawyers?
Note to the audience, okay?
You can take your number two pencils out right now and write this down.
High-priced lawyers of a guy that is present, his personal lawyers.
Of guys that are the guy that's the president of the United States, or at least the regime head, because he's not a legitimate president.
That's a golden meal ticket in this town.
Okay, why are high-priced lawyers rummaging around for finding stuff?
This whole thing, and the other thing is that there's no intent in these laws.
These are compartmented top-secret documents.
Not the highest, but one of the highest classifications we have.
It is. There's no intent.
You know, they're saying he inadvertently.
Now you see Jen Psaki.
They're all coming up all, you know, gotta go back 50 years and change. This is black letter. Right.
If they're there and they're not in a skiff or they're not in a compartment, a place you can read compartment.

I kind of miss the FBI raid.
They're taking it to their word. So Special Counsel Mike Davis, you called for it.
Kash Patel has his own thoughts on that.
Davis, you were born at night, sir, but you were not born last night.
Tell us what happened this afternoon on this Special Counsel in such a hurry.

It seems like Attorney General Merrick Garland got caught in his cover-up.
He was covering up for his boss, President Biden, for two months.
He found out about the stolen classified records by Biden no later than November 2nd, six days before the midterm election.
He kept his mouth shut during this time for two months.
For two months, he kept his mouth shut about this.
Yet on November 18th, He appointed a special counsel, not for Biden, but for President Trump.
House Republicans take over.
They set up this select committee that's going to do a deep dive into the weaponization of the Biden Justice Department.
All of a sudden, these documents show up.
Here's the deal. Attorney General Merrick Garland should have appointed a special counsel immediately.
Because it is very clear that Biden broke the law by having these classified records in his possession.
And even if it was inadvertent, as you said, that doesn't exonerate him.
But it's clearly not inadvertent.
It's obviously not inadvertent here.
He moved these documents at least twice.
He moved them before he left.
Yes. In January of 2017, he moved them again when he moved into the Penn Biden Center in February of 2018.
And then he moved the documents, a separate set of documents, to his home in Delaware.
So this wasn't inadvertent.
They were found in his personal files.
at the Penn Biden Center.
It's just not believable that this was inadvertence.
And remember, some of these documents related to Ukraine.
Hmm, what oligarchs had the Bidens on their payroll?
The Chinese and the Ukrainians.

They're also talking about they need the visitor's log for the garage or the house.
Hey, I don't need a visitor's log to know that the guy that redid the Corvette for him was, wait for it, Hunter, who's on the payroll of the CCP, right?
He's sitting there with the classified.
I don't think Hunter could get a clearance.
Just saying, remember, he was a naval officer for 30 days before they kicked him out for selling drugs to enlisted men.
Kash Patel. Mike Davis brings up something in that cynical way of Mike Davis to connect something with the committees.
All of a sudden, this started coming up on the weaponization of government.
Last week, we had this big fight about it.
Then it got voted in.
What's happening here? Are these committees, Republicans now in charge, new sheriff in town?
Is that where we're seeing this movement, sir?

Yeah, look, it's great to be with you.
And Mike's right, and myself as a former federal prosecutor, a special counsel on paper is the right move.
And it would have been back in November.
But the problem is we've seen the corrupt government gangsters go out there and cover up the corrupt activities, namely the likes of Rod Rosenstein, Chris Wray, and Merrick Garland.
So when these guys are responsible, remember, Rod Rosenstein appointed Mueller, Comey's best friend, to be special counsel. And now you have a situation where Merrick Garland appoints Her special counsel, H-U-R. Do you know who Her is?
Rod Rosenstein's number one lawyer when Rod Rosenstein was the attorney general in charge of the Russiagate investigation where Devin Nunes and I sent him a dozen subpoenas and Rosenstein and Her blockaded the response to those subpoenas because they wanted to cover up the corruption at the FBI and DOJ. They were in on it then and they're in on it now, which is why I disagree with the appointment of this guy as special counsel.
And here's the most important thing I'm going to say tonight.
This guy, Her, needs to be the first one subpoenaed by the new Special Select Committee under Jim Jordan's authority on the weaponization of government.
And do you want to know why?
Because Her, we have the receipts, Steve, and we're going to release them later, was sending communications to the Justice Department and Rod Rosenstein's crew arguing against the release of the Nunes memo, saying that it would bastardize and destroy the United States national security apparatus.
This guy is a swamp monster of the Tier 1 level.
He's a government gangster.
He's now in charge of the continued crime scene cover-up, which is why the first congressional subpoena that has to go out for the Weaponization of Government Subcommittee is against her.
He's been in on it since day one.
And let's not forget Rod Rosenstein and he, her, are the two top lawyers at DOJ that subpoenaed my records in 2017 when I was the chief investigator for Devin Nunes on the House Intel Committee in Russiagate.
We only just found that out and broke that news on your show just a couple of weeks ago.
This guy, her, authorized that subpoena and advised Rod Rosenstein to do so.
What other people were they trying to get blackmail information on illegally and unlawfully so they could continue the cover-up operation?
This is a swamp monster and a swamp appointment of epic proportions.

You're telling me her is the deputy over there to Rod Rosenstein.
First off, they blocked the 12 subpoenas, number one, to get to the bottom.
Number two, they would not release the Devin Nunez memo that outed all these guys.
What was number three?
What do you say? What was the third one that he did?
Because this is the trifecta.
How could Garland possibly pick a guy that's in the middle of the Russiagate situation as one of the blockers?
How could they do that? How could they be in that face?
You know Jordan. Jordan's going to chair this committee.
Are they just throwing down right now saying, screw you.
You guys think you're going to connect dots here in the weaponization.
We're going to be upping your grill.
Hey, how about this? It's bad enough he had his Davis out of the Dick Durbin guy, the AG in Illinois.
Now they've tripled up and said, hey, Kash Patel, you've got a problem with this?
Boom! We'll put the guy, we'll put the enforcer up there.
Is that what they did? That's exactly what they did.

And the third thing was Rod Rosenstein went to the United States Congress in 2018 with his sidekick Kerr by his side and lied to Congress under oath about threatening and investigating congressional staffers.
They had already sent the subpoenas and he lied and he said he never threatened anyone.
What he did mean to say, what he should have said was, I actually have been investigating these guys because they're digging up our dirt.
And look, the special counsel, as a former federal prosecutor, I think it's a cherished apparatus that has been destroyed by this appointment and the continued appointments.
And now we've seen Mueller, Lausch, excuse me, and this other guy that's just been appointed, her and Jack Smith.
The special counsels have become the special forces operators to cover up the swamp corruption for the Justice Department and the FBI. And the only place that that can be pierced is congressional subpoenas from this subcommittee that Jim Jordan's running.
And I'm calling for him to send this guy and Rod Rosenstein a subpoena and get all the documents.
And then I can't wait for them to lie on public in the TVs and I show you the receipt about Rob Herr and his clan at DOJ sending emails arguing against the release of the Nunes memo because it was exposed to their corruption.

You know, along with Grinnell and, of course, Devin and just a small handful of others, were the reason President Trump had a first term at all?
Because remember, the nullification project started in the early morning hours of the 9th of November of 2016, just a few hours after we left.
By the time we got up in the morning, they were full force.
They were not going to let President Trump be president.
I call it the nullification project.
It had already started, obviously, in the spring before, or in 16.
But if it was not for Kash Patel, the great accomplishments...
Because I said, look, they stole two elections from Trump.
They stole 16, his presidency, and they stole 20.
And everything he accomplished, all this great stuff he accomplished, more than any other president in living memory, right? Back to Reagan.
Those types of wins were at the same time not fighting a rearguard action.
I mean, every day a combatant against the administrative state and their rogue arm, the deep state.
And you're seeing it now. Look at all the moderates you have in Congress.
Do you think they would ever have gone along with something like a new church committee on the weaponization of the government?
Do you understand the country club Republicans?
Look where we are now.
The reason is their behavior.
It's so blatant that even the controlled opposition Republicans saying, hey, this thing's so out of control.
What happened to what Church and those guys did?
Remember, they were liberals.
It's what the liberals really demanded in the 70s because, quite frankly, they were fighting more for civil liberties than other people.
They said this thing's going to get out of control.
You hear Church, you look at those things today, they're very prescient.
About the power of the administrative state, the power of the deep state and coming off of Kennedy's assassination, Martin Luther King's assassination, Robert Kennedy's assassination, Malcolm X's assassination, the anti-war movement, the Ku Klux Klan, all of it, right?
And by the way, understanding that the infiltration of the – which they did a great job in the 50s, infiltration of the communists into the State Department and other things.
So Cash, you were the tip of the spear.
So it's not like some guy – Yelling over his lunchbox.
When Kash Patel talks about these things, what I say, it's like a papal bull because he knows what he's talking about.
He's been there. He's fought this fight.
He continues to book Government Gangsters.
Listen, the fight on the publishing of Government Gangsters is going to be bigger than the publishing of the Pentagon Papers, right? They're going to fight this tooth and nail because he names names.
So you just said that you should – that Jordan – To prove that the committee is worthwhile, witness number one should be the special prosecutor for the Biden top-secret classification issue.
Sir, what did you mean by that?

100%. The first person subpoenaed by the special committee should be special counsel Her.
And here's why. All roads lead back to Russiagate, Steve.
You and I know that. And as the head of the Russiagate investigation for Chairman Nunes and the author of the Nunes memo, step one, This guy, Herr, as Rosenstein's number one lawyer when Rosenstein was the Attorney General after we issued him a dozen subpoenas, they together blocked the production of the FBI documents, the 302s, the Bruce Orr information, and the Christopher Steele information in the dirty dossier.
They blocked that information from going to Congress because we had exposed their corruption.
They, Rosenstein and Herr.
There should be two subpoenas, those guys in tandem, but special counsel Herr first.
And here's a kicker, Steve. Special counsel Herr was caught.
In the United States, a DOJ inspector general report to have had communications and knowledge about Christopher Steele and his dossier while the FBI was using that bogus information to feed it to the FISA court to illegally surveil President Trump.
Rod Rosenstein signed the third unlawful FISA warrant.
With his sidekick, Special Counsel Heard, next to him, who approved it, and who was communicating with people involved in the Christopher Steele dossier and Steele himself.
Don't take my word for it.
We got the receipt. We're going to release them later.
It's in the DOJ IG report, and we have Special Counsel Heard, who at the time was the paydag at DOJ, his own emails blocking the Nunes memo.

You can't call him as a first witness.
McCarthy, Jordan, these guys tonight should say, absolutely not.
No way that guy's going to be special counsel on this thing.
That's a joke, right?
Let's assume for the purpose of this conversation, all of that is correct.
How can he possibly be the special?
Special counsels used to be people that, like I said, were like Caesar's wife.
This guy, quite frankly, he's an enforcer.
Like in the mob, like you talk about government gangsters, he's like an enforcer in the government mob.
Is essentially that the analogy?

Yeah, he is responsible for the cover-up.
Look, as a former federal prosecutor on Russiagate guy, We went to Rosenstein and her and Chris Ray, we being me and Devin, and said, look, you guys weren't there in the Biden administration.
Help us expose the corruption at the FBI and DOJ, and you guys can be the law enforcement heroes.
We don't need to be. And instead of doing that, they doubled down and said no and flipped us the finger and said, you guys are crazy, you and Devin Nunes and Jim Jordan and everyone else in Congress.
There's no way the FBI lied to the DOJ's FISA court.
And there's no way Rod Rosenstein signed that application with Special Counsel Hearst standing next to him as his payday.
Well, all of that happened and they knew it.
And these guys are responsible for a cover-up that's been going on for as long as Joe Biden's classified documents have been in the wild.
Seven years and running.
I wouldn't be surprised if these guys and their lawyers, as you talked about in the beginning of the show, were the lawyers who went and found these so-called classified documents at these certain locations.
And as you and I, Steve, we called it, there's going to be many more locations.
And so Republicans can't go around spiking the football.
We have to carry this thing the next hundred yards for the next year and make sure we get every document from these corrupt actors.
And the one thing that This new subcommittee can do, and Kevin McCarthy, take the money from this special counsel, her, and fence it so he no longer has the authority to execute his command issued by government gangster number one, Merrick Garland, and government gangster number two, Chris Wray, who is going to handpick the investigators like he did for the cases revolving Donald Trump.
He's going to pick the Peter Strzok of the world and the Lisa Pages, and we can't have them.

You also worked for one of the great—you clerked for one of the great civil libertarians, Justice Gorsuch.

Have they turned these special prosecutors into people before that were looked at as above everything and really do something without the politics weighed in?
Have they really been turned to the special forces that protect the deep state, sir?

It's actually worse than what Cash described, because if you look at Robert Herr, go back to 2006, Robert Herr has been Chris Ray's longtime protege Going back to 2006 when they worked in the Justice Department Criminal Division together.
Chris Ray was the long-time protege to James Comey who was fired by President Trump as the FBI Director and then Chris Ray became the FBI Director and Chris Ray was also a long-time protege to Rod Rosenstein, who was the only U.S. attorney, the only Bush 43 U.S. attorney who survived eight years of the Obama administration.
So as Cash said, Robert Herr was the deputy attorney general, Rod Rosenstein's principal deputy for the Mueller probe.
So it goes back to 2006, maybe even longer.

But in the middle of all this, these investigations, this is what victory gets you.

What Seb was talking about is five years, 2017, I walked up for the really first time in front of the media since I'd taken over the Trump campaign in August.
And I said, there's three things they asked me, Matt Schlapp said, hey, what are the three things that this administration is going to be known for?
I said, one, in America first, national security, right?
National security focused on the CCP and Redo all these alliances.
Number two is a MAGA, America First, manufacturing policy economy that focuses on U.S. citizens and high-value paying jobs for U.S. citizens.
Number three is deconstruction of the administrative state.
And all the... Seb, you remember all...
They had 2000 media there at CPAC. They had the NHK and BBC and New York Times, CNN. And those guys are going, what does Bennett just say?

Exactly. All the MAGA guys in bib overalls, everybody in bib overalls, all the deplorables, they're all high-fiving each other.

And then two days later, after we've brought the heat, Gingrich has to say, no, no, no, democracy's a bit messy.

When you see who the good guys are and who are the swamp creatures and who are just comfortable in the swamp.
So let's be clear here, at the risk of being a little bit wonky.
I worked for you in the SIG, which was this genius idea for a long-range strategic initiatives group next to the president.
But because, you know, my remit was Nash Security, I got access to the NSC. And until, what's-his-face, until HR McMaster came in, I was on all the classified distros for the NSC meetings.

They're talking about arresting an American citizen for getting too close to Venezuela.
But the craziest thing that I've seen all day, I didn't, you know, you never know what you're gonna see until you actually go somewhere.
But it's this, it's the fact that, we know this, Venezuelans are starving, but they can't feed their people.
And so what you have all day long are these cart after cart after cart, full carts of food And hygiene and toilet paper and just basic necessities going into Venezuela and coming back out.
They're all empty. There's nothing that Venezuela is providing back.
And we interviewed a lot of the people that are down here, especially the ones that are fleeing, trying to get to America or anywhere else.
Some of them are going to Chile. Some of them are just trying to get out of Venezuela because of the disaster that communism is.
And that's what they said. They said they can't feed themselves.
They thanked Colombia.
Kind of the most stark comment that was said to us today was, as a guy was leaving, he said, God has left Venezuela.
And it's just the saddest thing.
You know, you think about the Venezuelan people.
They're such proud people. They love their country.
It used to be the most prosperous country in the world until communism, socialism took over.
And now they can't even feed themselves.
And that is the root.
You know, you have Joe Biden and Kamala Harris.
Then the left is talking about root causes.
They are the cause. The people that are pushing socialism and communism and ignoring the corruption, they are the cause of the problem.

We were in Bogota and they have heard a lot in terms to the economy, in terms to Venezuelans going over there to Colombia to work on the low working wages that they have lowered down.
They have complicated the situation in terms of that.
And also one thing that is really sensitive, it is the minor prostitution, Mr.
Bennett has been regular.
It's something that is illegal in some parts in the borders between Venezuela and Colombia.
Sad to see that, but the most sad thing is also the health crisis that is also living over here.
You've got a lot of people coming from Venezuela to Colombia to be helped in terms of medicine.
