Here at home, Eugene, the Department of Justice says it will appeal the court ruling that ended the CDC's transportation mask mandate if the CDC says the mandate still is necessary.
A new Politico Morning Consul poll found 59% of respondents backed the CDC when it extended that mask mandate, and nearly half say it's too early to end it, with only 16% saying now is the right time to make masks optional.
We should note This poll was conducted before a federal judge lifted the mandate this week.
So this morning, Eugene, where is the White House on this?
Yesterday, I know President Biden said, when asked if people should wear masks on planes, he said that's up to them.
And now we hear the Justice Department, though, is challenging this ruling by a federal judge in Florida.

Well, the president and the administration writ large is saying that they still recommend that people, if people want to, they should, right?
Because they have a lot of worries about this rise of this COVID variant.
And the polling that you just talked about, it shows that the American voters are kind of on their side.
The polling was taken before, so we'll probably get that answer again for next week for folks to see how people are feeling now.
But the view from the administration is that the CDC wanted a couple of weeks, that's why they put this extension in, to be able to see how the new variant was going to work its way through the United States and how bad it was going to get.

I want to bring in Lesley Mnookian, the founder and president of Health Freedom Defense Fund that actually brought the suit in Florida that was ruled on by this brilliant young federal judge.
Leslie, we had you on the show last night.
In fact, even as we were speaking, it turns out that the Justice Department said that they're going to appeal this, but there's been some confusion.
Can you please help the audience understand where exactly are we in this entire thing right now?
What's the government's position?
And what's going to happen, to the best of your knowledge?

So yes, this came out last night, and I haven't gotten a chance to speak with the whole legal team about it.
I thought that our lead attorney on this was going to be on.
But to me, what I've read and what I understand is that the DOJ is saying that they are going to appeal if the CDC decides that they need to appeal.
So it's not that it's an absolute appeal.
They're not saying that.
They're saying that it depends on what happens with CDC's policy.
And my question is, If there's an emergency that warrants masking or any other measure of American citizens, can we wait two weeks to decide that there's an emergency?
It doesn't make any sense.
It seems as though they're kind of having to try to have their cake and eat it, too, that they are trying to preserve government policy or government power for future use.
And so what they really are trying to evaluate is how far they're willing to go in order to defend CDC's power and authority.
To me, that's the real essence of the issue.

And Biden, I thought we were all told to follow the science, although the science does change as evidence comes out.
But Biden just went around, do what you want to do, what thou wilt.

The Latin is Mons Capitolanus, but today colloquially amongst Italians it's simply known as the Campidoglio.

Okay, you're here today because of what we've been talking about.
This whole situation in Ukraine, and until you cut the money off to the Russians, until you really go to economic warfare, and the way to go to economic warfare, you remember, we went on offensive economic warfare.
We tried to take down their central bank.
We tried to destroy the ruble.
We swept all their reserves and all their central banks.
We really put, we weaponized the U.S.
and put ourselves at risk of being the prime reserve currency, which will have massive blowbacks on this country for generations to come.
It also didn't work. But the simple way to work is to force Western Europe to take their easy lifestyles, right, their comfortable lifestyles, that are all supported by, wait for it, very cheap Russian natural gas.
The whole structure of their economies, particularly Germany and Italy, just to put two random countries, are supported by that.
And I'm not picking on the German people or the Italian people.
But the reality is, if you want to have an outcome of this war, that's more than the nonsense you see on MSNBC all the time, and more Ukrainians being slaughtered.
The way you do it is cut off the regime in Moscow from cash.
The way you do that is stop buying their natural gas.
Now, after we talked about that, and we believe there was a piece in the Daily Telegraph that we have been talking about before in support of what they say, which is we should sanction Germany, right?
At the same time, we should sanction The oligarchs in Ukraine, the oligarchs in Ukraine should have all their wealth taken from them, and that should go back into paying for this war.
The American people have 800 million dollar arms shipment over there.
There's another one they're talking about, okay?
Instead of taking that money from our coffers that could go to St.
Louis or Detroit or all kind of things that happen here in the United States, or maybe even reduce our deficit, we got to strip all of the wealth of the oligarchs that stole it In Ukraine, it's the third most corrupt or fourth most corrupt country in the world.
It's more corrupt by the people that monitor that stuff than Russia.
Okay?
So where is on Capitol Hill all the Zelensky fanboys?
And he's just a puppet of the oligarchs?
Sorry, I'm saying that, but that's the truth.
He's the puppet of the oligarchs.
It's the third or fourth most corrupt country in the world.
Where is their money?

I'm saying, hey, strip the Russians too.
Strip the Russians to do whatever you want, however you get money out of this system so they can stop arming and stop killing people and get people to the negotiating table.
Now, as we said that, the Daily Telegraph said that, and it should be, you should sanction Germany, and I think throw in Italy there.
Until they stop buying the gas.

Now the EU's thinking of a ban.

Is this actually something that's real?
Or is this more just a puff piece?
They're going to talk about it and nothing's going to happen.
I heard yesterday, they're talking about now at the EU in Brussels, a total Western European ban on Russian gas.
What's the truth of that, Ben Harnwell?

Well, good morning, Steve.
The truth is certainly, yes, that people are talking about this, but whether this is simply performative or whether it's expected to end in real results, we're going to wait and see.
Personally, I believe it's performative.
And here's what happened yesterday then.
So the French finance minister, Bruno Le Maire, said on French radio that an embargo on Russian oil at the European Union level was in the works, adding that French President Emmanuel Macron wants such a move and he added, this is the French Finance Minister, I hope that in the weeks to come we will convince our European partners to stop importing Russian oil. And a similar sounding emerged from the Latvian
Foreign Minister Edgar Rinkovic, who told a press conference on Wednesday that the European Union is indeed preparing new measures to prevent to Russia from evading sanctions imposed over the war in Ukraine.
So what the French finance minister means when he says that he hopes that we'll convince our European partners is that he's specifically talking about, as you correctly say, Germany in the first instance and Italy
In the second, Germany is by far and away the largest importer of Russian gas, Russian natural gas, taking about 57% of its domestic gas consumption from Russia.
So here's the thing, right?
For the French to get their way in the European Union, this will require unanimity, what's called unanimity, in the Council of Ministers.
Now, If I might just open a 20-second bracket here, because it's perfectly normal that perhaps a largely American audience won't necessarily know the inner workings of the European institutions here.
And that would be to be expected, because most Europeans don't understand it either.
But there are three basic branches of the European Union.
You have the European Parliament, which works on legislation, and those MPs are elected directly Across the regions of the European Union.
You have the European Commission, which is composed of basically permanent delegates sent on a one-by-one basis by the member states.
And you have the European Council, right, which is where unanimity would have to be decided.
And the European Council is comprised of the heads of government of the various member states.
So it seems to me to be inconceivable, and I would speculate that the French know this even as they're saying it, That Olaf Scholz, the German Chancellor, will ever commit suicide on the German economy, because that's what we're talking about here, by voting.

Not only will they vote, the other day they had the Minister come out over the weekend on the Sunday shows and saying, hey, we would have major social unrest.
The entire structure of the European economy It's predicated upon dirt cheap Russian gas.
We've given them alternatives.
Donald Trump gave them LNG alternatives, all these alternatives.
Even those were always going to be, I think, incrementally higher by the time you get in the United States, liquefy it, ship it to the ports in the Baltic, unload it and get it out to Europe.
It's not as cheap as the good old cheap gas coming from You're being conned by CNN, you're being conned by the cheerleaders on Fox, conned by the fanboys for Zelensky.
to pay for it in rubles.
This is, my point is, this thing's a whole, this is a con.

If we want to stop Ukraine from looking like a current day Dresden, okay, there's a way to do that.
First, it's like, get all the cards on the table and stop a damn thing like this.
This is about power, and geopolitical and country power, okay, and territory, and money, and natural resources.
Number one, if you want to stop the Russians from continuing to shell, you must choke them down on money.
The first way to do that, and it's not our fight, it's nothing in the vital national security interest of the United States over there.
And the vital national security interests of our country is on the southern border.
They're trying to get you and distract you away from that.
Step number one, Europeans must ban, in total, any importing of Russian gas.
Number two, the oligarchs in Ukraine, the corrupt nature of Ukraine and all the money they've stolen, including a lot of American money, must be stripped from them and start paying for this before we pay for anything.
And number three, Joe Biden's got to import the War Powers Act.
He's got to come.
The Republicans have to force him to come before Congress.
They've not asked for a declaration of war, of which many of the Democrats are saying, let's get combat troops over there.
You had this crazy congressman, Republican congressman down in Florida talking about it.
Republican Congressman, he's got to come forward, at least through the War Powers Act, explain to the American people what the stakes are.
Make the case of what the vital national security interest of the United States is.
The reason nobody on Fox, or nobody on MSNBC, or CNN, or the New York Times, or the Biden regime want to do that, is they don't have an argument.

And now it's just, I think, despite the poll numbers, I think it's going to be politically unpopular to start that mask mandate back up unless we have a real surge in COVID cases.

If you got on a plane or a train, or really any form of public transportation today, you probably noticed a pretty big change.
Yesterday afternoon, a Trump-appointed federal judge in Florida struck down the administration's federal mask mandate for travelers.
Just days after the Center for Disease Control extended it through early May.
White House Press Secretary Jen Psaki called the ruling disappointing, but the White House has not yet appealed the ruling.
They claim it's something for the Department of Justice to look into.
Already the TSA, major airline carriers, Amtrak, Uber, Lyft, all others have dropped their mask requirements, essentially the second the White House decided not to appeal.
Folks, it's one thing for a Trump judge to strike down an order from the Biden White House, but it's an entirely different thing for the White House to let it happen without any legal pushback.
And it's not the first time recently that something hasn't gone the White House's way.
They don't fight back.
They don't defend their rationale.
They just give you the emoji shrug.
We saw it when the Supreme Court struck down their vaccine mandate for large employers.
We saw it when West Virginia's Joe Manchin essentially scrapped the President's entire domestic agenda in Congress.
We may even be seeing it with the ongoing intraparty fight on Title 42.
The Biden administration, with the full power and prestige of the presidency, with his party's power in Congress on the line this November, has repeatedly looked as if they're easy to roll.

Because it looks like there's just mass confusion by the Biden administration, who I thought told me they were just going to follow the science.
Where do we stand in your mind, sir, since you're the tip of the tip of the spear on this?

Well, all I've heard from DOJ is what they published publicly in the media, which is that DOJ recommends appealing, but they're leaving it up to the CDC to decide Whether the mask order has to remain in place, which is kind of a strange way of handling it.
They seem to be throwing CDC under the bus here for some reason.

So how do I interpret that in English?
If CDC, if they say CDC should handle it, I thought the judges ruled, because this is a blow, you know, our focus here is the deconstruction of the administrative state.
This is one of the most important rulings ever taking on the administrative state, right?
I thought the judges basically ruled that the CDC The judge's ruling basically broke down into three parts.
The first part of her ruling was that the CDC didn't have the statutory authority to do what it did.

The second part of the ruling was that it failed to allow notice and comment as required by the Administrative Procedure Act and failed to show good cause why it didn't provide for notice and comment.
And third, is that the rule was arbitrary and capricious because the CDC failed to really reasonably explain why it was doing what it was doing and why it drew the lines the way it did.
For example, an exemption up to two years.
You know, what was the reason for that cutoff age?
Why was it not arbitrary?
And so, just reading the tea leaves, I think DOJ may be concerned about the first part.
They can always clean up the procedural problems, at least in theory.
But the first part about the statutory authority is what has to be giving the administration heartburn.
And I think that's the reason why DOJ recommends appealing.
But they're leaving it up to CDC to decide whether to appeal.
It's a rather strange situation.

The first part is the blow against the administrative state.
But, as importantly, is number three.
Arbitrary and capricious.
There's nothing the CDC can do.
There's no data that you've looked at.
There's no information that they can come back and make it any less arbitrary and capricious.
Do you think, sir?
Isn't that also a big hang-up that DOJ is going to have in any kind of appeals?

Well, it's, you know, in my opinion, yes, I think the science on this is very problematic for them.
And I think it's very hard for them to show, and I don't think they can show, that masking people on airplanes or other transportation conveyances had any impact on interstate spread of the virus.
In fact, there was a study in Europe recently that showed that other travel restrictions, such as mandatory testing and quarantine, only delayed the peak of an Omicron wave by two to four days at the most.
And there's no doubt that you would find a similar outcome with masking.
And so they do have a problem there.
Now they could come back and try to be more thorough in their presentation on the administrative record, but one can only speculate as to what that might be or what it would look like.

Is there any doubt in your mind, Brant, that you win on appeal?

Well, you know, as lawyers, we're not allowed to guarantee results, right?
It's sort of an ethical prohibition that's imposed upon us.
But I feel very confident about our chances on appeal.
I think the judge's ruling was very thorough and thoughtful, and she left open a couple of other avenues that we could raise on appeal that she did not address.

Leslie, tell us, you're the founder and the president, you're the driving force of this, and this is David versus Goliath, where David won with the first stone, right?
You've got a bunch of other stones in the sling, too.
Walk us through your strategy of going forward here.
Am I missing it?
Is this kind of confusing to you, too, about what the administration's trying to do here?

Well, very much so, because if there's an emergency, We shouldn't be waiting for CDC to decide that there's an emergency in a couple of weeks whenever they want to review their policy.
If there's an emergency, then it should require immediate action.
And so it's a very peculiar statement that DOJ has issued because there seems to be no urgency to their statement or to their policy.
They're just going to wait and see what CDC decides to do.
And so I find that sort of confusing as a lay person.
On top of that, you have to bear in mind that CDC's own science published in May of 2020 showed that none of the measures that have been pushed on the American public in the last two years actually have any effect.
Literally negligible effect.
And I'm talking about sanitizing environments, frequent hand washing, and yes, masks.
Their own meta-analysis of 14 randomized controlled trials, which are the gold standard of studies, showed that there was negligible impact of any of these measures.
And yet their policies persist.
It just doesn't add up.
So I think from an American standpoint, most of us want to live in a country that is governed by the rule of law.
And when CDC can be Deciding a year after the crisis began that there's an emergency that warrants putting masks on people on airplanes, or in this case, now can wait another two weeks before they decide what to do or who knows how long it will be.
That doesn't sit well with the American public, I believe.
And I think it's confusing to people.
I think people are done with this.
And I think that this undermines CDC's credibility that they are sitting there waiting for some kind of new data or something, when the data keeps showing that it doesn't work, to make this decision.
And DOJ has kind of punted it.
So it's a very, very interesting situation in my view.

That's what we play the two different clips.
You know, in the first clip, I think Willie Geist was talking about the at least the current polling was at 59 percent.
And then and then, you know, Chuck Todd came out and said or in the second clip, we had Joe Scarborough saying no.
But, you know, as people really take the mask off, they're going to understand that polling is going to shift quickly.
And then you had Chuck Todd come out and saying, hey, the administration can get rolled.
This was kind of a hill they were going to die on.
They made a big deal about this.
I mean, when you filed the suit or anything like that, things could have changed.
As someone wants to deconstruct this fourth branch of government, the administrative state that's wildly out of control, and this reason Gorsuch and Kavanaugh are on the Supreme Court, it's important when Brant triages the reasons like the judge did.
Number one, about the About the the power real the true power of the administrative state to me in this situation The most important one is number three.
It's arbitrary and capricious and this you go back to the point that all the data all the science actually supports the Health Freedom Defense Fund in their lawsuit and now you have the administration and now they're jammed This is you've played this so perfectly They're caught They're caught and exposed.
They're exposed as feckless and hapless on their own agenda.
And it just signals the weakness to their own people.
And that's why I want all the people that are marginal Democrats to make sure... See, you're being led to slaughter here politically.
Okay?
Because they're getting rolled every day because they don't know what they're doing.
But even deeper and more importantly, this is going to strip the mask off Fauci and FDA and CDC and all of it because you're David versus Goliath.
The big stone, I think, was it's arbitrary and capricious.
And you just guys kind of make stuff up.
And we've actually got, we actually talk about data and science and evidence.
We're evidence-based.
We're database.
We are what is known in the West as science-based.
And that's the power of your suit.
And this is why you've got them jammed up right now.
And they're jammed up.
They have a Hobson's Choice.

I just have to say, I mean, I read a story the other day about a college professor or a graduate student professor who asked his grad students, how many of you have trust in federal health agencies?
And they laughed.
The student body, the whole classroom laughed.
They erupted in laughter.
In addition, all of the photos and videos that we're getting are showing that literally up to 98% of the people are unmasked on airplanes.
So the vast majority of Americans Are not buying the fear anymore.
They don't want to be subjugated by an unelected, unaccountable CDC, you know, a bunch of bureaucrats.
They have decided for themselves, they want to live and they've had enough of it.
And I think that if the administration keeps pursuing this policy, they're going to anger a lot of people as well as likely lose the lawsuit.
And I mentioned last night that the appellate, the 11th circuit appellate court already struck down CDC's mandate that Cruz People go on cruise lines that depart Florida, wear masks, and already struck, and the Supreme Court struck down the CDC's eviction moratorium, right?
Eviction order moratorium.
The precedent is not in the favor of the government on this.
It's in our favor, and I think this is going to be a quagmire for them if they continue.
