in terms of what we've seen in the past of Russian exercises, et cetera.
This is larger in scale and scope and the massing of forces than anything we have seen in recent memory, and I think you'd have to go back quite a while into the Cold War days to see something of this magnitude.
They do annual exercises, and we watch those closely, but this is different.
So we'll continue to monitor it very, very closely, but yes, it's a different.
Ukraine has the right to be independent, and they have been an independent country since 1991.
We're done.
Russia signed the Budapest Memorandum in 1994 with the United States and Great Britain that guaranteed the territorial integrity and sovereignty of Ukraine.
It's the policy of the United States government to continue to support an independent Ukraine and their goals.
And we are continuing our effort to enhance their ability to protect themselves.
We strongly encourage Russia to stand down and to pursue a resolution through diplomacy.
Armed force should always be the last resort.
Success here is through dialogue.
The Russian Federation has amassed upwards, at this time, of over 100,000 ground forces, air forces, naval forces, special forces, cyber, electronic warfare, command and control, logistics, engineers, and other capabilities along the Ukraine border.
Ukraine is the second largest country in Europe, with a population of 44 million.
It's divided in the middle by the River Dernipro.
Prominent terrain includes flat, open plains.
And there are abundance of rivers and lakes, and there's a high water table.
And when that high water table freezes, it makes it for optimal conditions for cross-country tract and wheeled vehicle maneuver.
The city of Kiev has a population of nearly 3 million people.
Other major population centers include Kharkiv or Kharkov, Donetsk, Odessa, Dnipro and Lviv in the West.
There are many people and highly dense population centers throughout Ukraine.
And if war were to break out on a scale and scope that is possible, the civilian population will suffer immensely.
As we've made clear, in addition to the significant economic and diplomatic costs that Russia will incur, a move on Ukraine will accomplish the very thing Russia says it does not want.
A NATO alliance strengthened and resolved on its western flank.
The United States will contribute to NATO's response forces, and we will coordinate with our NATO allies.
We will make sure that they have the capabilities that they need to defend themselves.
Article 5 is clear on this point.
An attack against one NATO member is an attack against us all.
And as President Biden has said, the United States holds this as a sacred... Ukraine has the right to be independent and they have been an independent country since 1991.

Yeah, first off, I completely agree with what Peter just said.
There was all this talk after President Biden at the press conference that was talking about maybe a small incursion or a minor incursion.
That is not the overall thinking that I find among the U.S.
government officials about where they think this is likely headed.
Or potentially headed at this point.
I mean, that actually, I think that's a really interesting point.
It's something that I had hoped to ask about today.
We keep hearing about the United States will uphold its Article 5 commitment to NATO.
That is the collective defense of all NATO allies, right?
So if one NATO ally is attacked, everyone is attacked.
You have the right, not actually the necessity, but the right to respond.
But what we are hearing here is that Ukraine is the one that is under threat.
Ukraine, coercion against Ukraine, all these forces that are potentially going to invade Ukraine.
Again, not a NATO ally.
So why is it necessary to send potentially 8,500 plus United States troops, plus the additional allied troops that will be part of this NATO response force, which will be tens of thousands more?
Why is it necessary to send them forward if, in fact, none of these NATO allies are under threat?
Which, at this point, it doesn't seem that they are.
And the reality is, yes, it's to show a united front.
It's for reassurance.
But that's a question that we really haven't had answered here.
If they're not under threat, why send forces forward?
Is there the potential that sending these forces in could actually have the opposite effect and just prove to Putin that he may have some sort of a reason to actually invade Ukraine?

We need expansion of them to pay the 2% that they're required to and have obligated themselves to and have never done, and it should be cumulative, the 2% of their GDP to pay for the common defense of the alliance.
Okay, the United States pays for all this and later he's talking about we got 80, 108 combat brigades and we got this, we got aircraft, we got four aircraft carriers.
It's all the United States!
Show me the active combat divisions that NATO could put on the field.
I mean combat divisions with equipment that are ready and trained up.
Not that it's going into climate change or health care or gender, you know, education.
No.
Combat.
We hold this as a sacred obligation.
This is all madness.

And we're going to demand the documents after we take power next year.
This is an article of impeachment.
You are stirring up a conflict.
Zelensky gives a press conference today and says they've got to stop it.

We'd like to have a balanced budget too and not spend a trillion dollars a year on our defense is what we spend.

We've got so much explosive news coming out of the Commonwealth of Pennsylvania.
I want to go to the great lawyer Wally Zimelong, who is the lead counsel on this blockbuster decision.
Wally, tell us what happened today at the Commonwealth Court.
They're basically, say, unconstitutional mail-in ballots.
I think they're 2.6 million of the 6.9.
Almost 40% of the votes were these mail-in ballots, ladies and gentlemen.
There's no way this thing could be certified.
Wally, walk us through how you got this amazing decision today.

Yeah, thanks for having me on, Steve.
It's an absolutely monumental decision for the Commonwealth of Pennsylvania.
It's a monumental decision for the Pennsylvania Constitution, the rule of law and election integrity.
So there was a similar challenge to the constitutionality of Act 77.
Act 77 was the legislation that brought no excuse mail-in voting to Pennsylvania in 2019.
And the challenge, unfortunately, asked for a extraordinary relief, which was to throw out all mail ballots that were going to be counted or had been counted in the 2020 election.
The case made its way up to the Pennsylvania Supreme Court, and the Pennsylvania Supreme Court rejected the challenge, but it rejected the challenge on what could be considered a technicality.
It just said that the plaintiffs in the case waited too long, but it never really addressed the merits, which were very good merits, which was whether or not no excuse mailed in voting was constitutional.
And in the summer of 2020, I brought a case on behalf of a election official that challenged the constitutionality of Act 77 and asked the court to get to the merits of it because we believe that was left unresolved and we followed it well in advance of any election and we made very clear the relief that we were seeking was to have it declared unconstitutional.
We weren't looking to the past.
We weren't looking to undo the results of any other election.
We were just trying to make sure that elections going forward in the Commonwealth of Pennsylvania were done according to the Pennsylvania Constitution.
So that matter was briefed and argued.
The Pennsylvania Democratic Party got involved.
The Democratic National Committee not got involved.
They parachuted all kind of fancy lawyers into the Commonwealth.
We argued the case twice before the Commonwealth Court of Pennsylvania, which is the intermediate appellate court in Pennsylvania, one rung below the Pennsylvania Supreme Court.
And finally, today we got an opinion in our favor from the court that agreed whole cloth with what we had presented to the court.
All our arguments were accepted.
And it reiterated that the law of Pennsylvania in the Constitution is that you cannot have no excuse mail-in voting.
This has been the law for at least 150 years, and it was reiterated by the court today.
So we're very, very pleased with the result.

You know, Wally, it's a little off-putting.
There's not a lot of great attorneys I know named Wally, but that's a topic for a different day.
You sound like a surfer.

So, Wally, how did you come up with this?
How did you come up and get engaged and involved in this?
This is a monumental victory for MAGA and for the 3 November movement.
How did you get engaged in this?

Well, following the 2020 election, the theory that was actually brought to my attention that I was asked to get involved with the case.
And unfortunately, I just didn't have the bandwidth to handle it at the time.
I was handling a number of different post 2020 election challenges.
And then in in the March or April the following year, I was giving a what's called a continuing legal education course for a bunch of Republican lawyers.
And I was sharing my theories and about the the unresolved issue of mail voting in Pennsylvania.
And I sort of just rhetorically said it would be something if if this case was brought to the Commonwealth Court and allowed to matriculate through the Pennsylvania court system.
And from there was a few weeks later, someone called me up and they said, well, how about would you be interested in pursuing that challenge on my behalf?
And I said, OK, that would be interesting.
And from there, the case came together and finally got to the point where in the summer of 2021, we filed the case.
And again, we wanted to file the case well in advance of the 2020.
We actually had a 2020 local and municipal election in Pennsylvania.
We filed it in advance of that.
We were hoping to get a ruling in sufficient enough advance of that election so that mail ballots couldn't be used there.
And the Commonwealth Court said, no, we're going to We're going to let this election go forward with the mail ballots because of how close we are to the election.
But the ruling is going to apply to any elections going forward.
And that's what the court ruled.
And I know the Commonwealth has immediately appealed this.
It's up with the Pennsylvania Supreme Court now.
It does have the effect of an automatic stay of it.
But still, we have finally a court, an entire court in Pennsylvania.
So it's not just like There's some state court judge out there or one judge in some county.
We have the entire Commonwealth Court of Pennsylvania agreeing with the decision, upholding the rule of law, upholding the Pennsylvania Constitution, and not getting cowed to public opinion and public pressure.
It was really, really refreshing to see, especially after what we went through the last year, year and a half.

I'm getting to the bores in this a second, but this is a 50 page opinion or 50 page document.
And it's tightly written about.
So Commonwealth Court for our for our national audience.
This is the appeals court in the state in the Commonwealth of Pennsylvania.
So this is big league.
This is like he says, it's not some county judge.
This is the real deal.
What do you anticipate?
How quickly is this going to get resolved?

Because this is monumental.
I would anticipate the Pennsylvania Supreme Court's going to give us a briefing schedule.
Our briefs will be submitted over the next couple months.
I don't think we're going to get briefs that are going to be due next week or the following week.
I do think the Pennsylvania Supreme Court clearly is going to want to resolve this before our May 2022 primary, especially how important it's going to be.
It's going to be important for both Republicans and Democrats.
Democrats, there's a Gubernatorial election 2022 in Pennsylvania.
The Democrats have a primary against two very well-funded candidates.
And there's a bunch of really, really well-qualified Republican candidates.
And then we have an open Senate seat that we absolutely, critically must keep in Pennsylvania.
And there's a bunch of qualified and exceptional candidates on the Republican side there.
And there's a bunch of challengers, very progressive challengers in the Democratic primary.
And male ballots are going to determine the results of all of those races.
And ultimately, because, you know, you're talking about a Senate race could could determine the future of the country and the future of the United States Senate.
And, you know, several important things, especially with two years remaining on Joe Biden's term, hang in the balance here.
You know, the balance of the Senate could control how this country goes, what kind of judges get confirmed, whether or not there's another Supreme Court vacancy.
I don't think I I need to list on and on and on for your viewers how important taking back the House and taking back the Senate is, and also just making sure we hold these gubernatorial seats as well.
We saw in the pandemic how much power these governors have.
In some ways they have more power over us than our elected officials in Washington.

It goes back to the founding of the Commonwealth of Pennsylvania, virtually, after almost the founding of the Republic in the 19th century.
It goes through all of it about the constitutionality of what happened.

Here's what's really important, and it's the timeline.
You know, us lawyers like to talk about the legalese, we love to talk about the law, we love to talk about Latin terms, ab initio, de novo, etc.
But the timeline here is vital.
This Act 77, that put an unchecked, they call it no excuse, it's unchecked mail-in balloting.
This isn't a situation where, oh, this has been around for 10, 15, 20 years, it's impacted, you know, 6, 7, 8 elections.
assault on election integrity in the Commonwealth of Pennsylvania. This isn't a situation where oh there's been around for 10, 15, 20 years it's impacted you know six, seven, eight elections. This impacted one election, the 2020 election.
The election that I fully believe, we fully believe, the MAGA movement under the leadership of President Trump, the war on posse, we all know was stolen and was specifically stolen in the Commonwealth of Pennsylvania.
And the biggest question- Hang on one second.

Jay Corman, on the 4th of January, read that letter, on the 4th of January, sent these guys a letter and said, hey, We want, we need you to send these back because we're very concerned about how these electors, how these Biden electors were sent.
We think there were illegalities.
We think there were irregularities.
And he specifically cites, wait for it, Act 77 in the mail-in, in the no-request mail-in ballots.
This was on January 4th.
This is what Jay Corman in the Commonwealth of Pennsylvania requested to come back and says we'll do it quickly, but we need to sort this out.

Of course, State Senate President Jay Corman sent a letter on the 4th, two days before the counting of the electoral votes.

The reason January 6th has significance It's not because of the events at the Capitol.
It has significance because that's when the big steal was codified into law when they counted the false electoral votes.
That's what Gen 6 was.
That's when that happened inside the Capitol.
So, and listen, as I've tweeted, we've said, always call within the lines.
We don't want any violence.

Violence is bad.
We've said all that.
We stick with it.

And you basically do everything you can to increase the amount of absentee mail-in ballots, which is what Pennsylvania did, at the same time you take the election cops off the beat.
This second chart is really the one that nails Ari Melber.
If you look at the last column there, Pennsylvania, what is it?
Act 77, right here in the Navarro Report.
No excuse absentee voting right here in the Navarro Report saying that's how they stole the damn thing.
So, look, I mean, look, we know they did it.

Today in Pennsylvania, you throw out those Those absentee ballots and decertified, that's done.
In Georgia, we've talked about how the elimination of Signature Match basically swung the election illegally to Georgia.
