The whole focus of it was to try to get the information to the Vice President of two types. | ||
One, the legal opinions. | ||
The majority of legal experts have taken the view now for over 100 years that the law he was operating under is unconstitutional. | ||
One of them was Lawrence Tribe, by the way, a very, very big supporter of Hillary Clinton and the Democrats. | ||
He had written a Law Review article in 2004 saying that the Electoral Count Act of 1877 was on its face unconstitutional. | ||
I won't go through the details, but it took power away from him. | ||
From the House of Representatives, it took power away from the state legislatures. | ||
And the vice president's mention of Madison is absurd. | ||
If he had followed Madison, the rule under Madison was that he could send all those votes back. | ||
What they substituted for it was this 1877 Act, which as recently as 2017, experts, a whole group of experts at Georgetown had written an article saying it's unconstitutional. | ||
Congress better change it before it has to be abrogated. | ||
So he had a reasonable, strong legal basis on which he could send votes back to any of the legislators who asked to have those votes sent back. | ||

What we're hearing from John Frederick Contacts on the ground out in the Fighting Ninth, which is the heart of Trump Country in the Southwest, they have to over-represent They've been a little behind on the early vote, but they're always been big game day voters. | ||
But what we're hearing now is 2020 type numbers, so keep grinding. | ||
I want to put this in perspective. | ||
We've got a couple of two very special guests. | ||

Doctor, I want to put in perspective the key issue here about are the parents the parents and actually In my perspective, it is a rebellion against the overreach of the government. | ||
lives or is the state in the school because that we talk about CRT and all that it's about who's the parent and who's the state's trying to co-parent you're the best public intellectual we have of putting this in perspective can you walk us through what's happening in the Commonwealth in your perspective in my perspective it is a rebellion against the overreach of the government the government is not supposed to raise and indoctrinate our children They've been doing it far too long. | ||
And I think the political left, it always overplays its hand and they have been exposed. | ||
And what I expect to happen is a coalition of parents who are coming together and who will elect a Youngkin as the next governor of Virginia. | ||
And it will be on the heels of a backlash against CRT. | ||
You laid this out in your book. | ||
You said this is a Black Eye for America. | ||
You kind of laid all this out. | ||
Tell us what you think the stakes are and what's really in back of CRT. | ||
I know that you connect this, not just biblically, but also to the founding of the country and to kind of the deep roots of the Judeo-Christian West. | ||
So what is this fight really about? | ||
Well, to me, CRT, the battle around it is a civil rights issue. | ||
And it's not just the civil rights of white people and white children, protecting our children from being shamed and bullied. | ||
It's about an effort to resegregate black people, to segregate blacks from whites. | ||
It's very demeaning. | ||
And I argue in the book that it runs counter to the 1964 Civil Rights Act with its 1972 educational amendments. | ||
And our Constitution's Equal Protection Clause, the first amendment, because sometimes people are compelled to engage in speech that violates their conscience as well as their rights. | ||
And I think the American spirit and who we are, we know that it is un-American to shame and bully people because of immutable characteristics. | ||
We also know that we came together across racial, ethnic, and religious lines. | ||
We had a civil rights movement. | ||
And right now, the civil rights of white people as well as black people are being trampled. | ||
And I see Americans coming together across racial, ethnic, and political lines to fight against CRT. | ||
Hopefully, we will see a victory today with Youngkin. | ||
And we will also see Americans coming together to fight for America, because I feel like our nation is at a tipping point, that it is teetering on the edge of a precipice. | ||
And this is an opportunity for Democrats who are unhappy with the Democratic Party, they don't recognize the Democratic Party, to come together, send a message to Joe Biden. | ||
What's so important, I came to talk to a public intellectual that has pushed higher education more, and you're an example. | ||
I mean, your advanced degrees, your doctorate, you've become a specialist, you were the co-head of what, the 1776 Commission that talked about the history of the country, but also the founding documents. | ||
Why is this fight important so we can get back to, take ideology out and talk about pushing the greatness of American education? | ||
Yes, ma'am. | ||
I'm sorry. | ||
Before all of that happened, you talk about my successes. | ||
I was a high school dropout. | ||
I was one of 12 children born and raised in rural poverty. | ||
I have a high school equivalency. | ||
My first degree is from a community college. | ||
I have been able to experience the American dream, and I was fortunate enough to come through during a time when people were patriotic. | ||
They loved their country. | ||
They believed in equal opportunity. | ||
They believed in hard work. | ||
And I grew up, despite the poverty, very imperfect, dysfunctional family. | ||
No one told me what I couldn't do because of the color of my skin. | ||
I was able to take advantage of opportunities that I see being denied to young people today. | ||
They're being told false narratives that will ensure failure. | ||
That's a crime and we should all be speaking out against it. | ||
Dr. Swain, I just want to make sure that because we had Elizabeth Schultz, who was a former senior official in Trump's Department of Education at Betsy DeVos. | ||
She said what will happen in Virginia today, if it's if it's a if it's a win based upon the Trump movement and focused on these cultural issues, doesn't just change the dynamic to the 2022 election, even the 24 election, we could change the next 10 years of American political history. | ||
Do you agree with that? | ||
You know something? | ||
If we can push back this aggressive power grab by the left, I believe we could keep Democrats out of power for the next 50 years. | ||
You may remember in 1994 when Republicans took over, it was the first time in 40 years that they controlled, you know, the House, they controlled the government. | ||
We could do that because Democrats have overreached to the point that they are repulsive to a large number of people and they're turning off members of their own party Those people that are in Washington, they show no love for country. | ||
They don't respect the Constitution. | ||
Many of them are thugs. | ||
They're corrupt. | ||
And I feel like a lot of the influences we see on our government, it's coming from foreign entities and too many politicians who are sold out. | ||
So it's greater than the next you know, 2022, 2024. And we have to be vigilant and we have to reach out across partisan lines because it's not Democrats against Republicans. This is a struggle for the Republic. | ||

Well, the reason I wrote this piece is because there are prospective voters in Virginia who will sit this race out because they're concerned that the game is already rigged, that the outcome is already decided, and that their votes don't matter. | ||
And it's perfectly understandable why they would feel that way. Because in 2019, we saw state races completely overrun with cash injections from organizations backed by George Soros, backed by Michael Bloomberg. And they very effectively flipped the Virginia House of Delegates to Democratic control, and also installed very, very inexperienced prosecutors in the influential and wealthy enclaves of Loudoun County, | ||
Fairfax County, and other parts of that area. And we've seen these officials that were installed by George Soros, by Michael Bloomberg's organizations through their donations, they've made life very, very difficult for the residents of these areas. And if we're... | ||
Unfortunately, something that we've seen happen very recently is that they've used normal, hard-working Virginians as fall guys for the failures of their fringe policies. | ||
Look no further than Scott Smith, who was the father of a teenage girl who was raped in the bathroom of a Loudoun County high school by a boy in a skirt. | ||
That was a recent, the policies that allowed this to happen, that allowed this young man to be in the girl's bathroom, that was a very recent controversy in Loudoun County. | ||
And a father showed up in June to a school board meeting to protest what was going on and to to ask the school board for accountability. | ||
And he was dragged out. | ||
He was an angry father. | ||
He was dragged out for being disruptive. | ||
And the Loudoun County Commonwealth's attorney, Buta Bibiraj, who was one of those Soros beneficiaries, who campaigned on the extreme cost of over-incarceration to Virginia residents, fought to have Scott Smith put in prison. | ||
And what happened to Scott Smith in the court of public opinion was almost as bad. | ||
He was portrayed as some type of a backwards, racist monster, as many out of state politicians have tried to portray Virginians. | ||
He was portrayed this way in the media, and the Virginia Democratic Party played ball with the national media to completely demonize this father. | ||
For weeks, the public believed that that's why he was there, to protest CRT, to make some type of a racist demonstration. | ||
And he's just one example of the playbook of the national political machine and their devices in Virginia to harass, to gaslight, to confound normal Virginians until they feel so fed up and distrustful of the Commonwealth that they don't want to participate in elections or run for office. | ||
I want you to stay through this break, but I gotta ask you, talk about gaslighting. | ||
We had it yesterday, Joy Reid, and I think they have McAuliffe on again, they sit there on CRT and once again just hammer, or I think she had a clip from McAuliffe, they just hammer that CRT is some esoteric theory from a law school, Harvard Law School, Derek Bell, it's not taught in Virginia schools and they say that's a lie and everybody that's You know, all the parents are there at these meetings. | ||
They're just white supremacists, white nationalists are being used as tools of that. | ||
We've got a minute in this segment where I'm bringing back. | ||

Is that the ultimate? | ||
And then McAuliffe comes on and says, yes, that's 100%. | ||
It's all racism. | ||
It's all white supremacy. | ||

Yes, it's absolutely gaslighting, because firstly, you have parents who've heard what their children have come home and told them. | |
And obviously, those are anecdotal stories, but the whole Virginia Democratic playbook has been to disbelieve those people, to tell them that their concerns don't exist, it isn't real, you didn't see what you saw, you didn't hear what you heard. | ||
And in addition to that, we have seen references and endorsements of CRT showing up in materials that teachers have gone through, their workshops, their trainings, their seminars. | ||
We've seen references to CRT and endorsing CRT as a new alternative style of education that's better for the children in the counties. | ||

First, regarding Glenn Youngkin vis-a-vis Donald Trump, Glenn Youngkin is not a MAGA figure per se. | ||
You're right, he has come much closer to the Trump position. | ||
But this is a message really to those voters who may not have preferred or sided with or affiliated with Donald Trump. | ||
Whatever reservations you may have about the former president or about Trumpism, those reservations do not oblige you to continue voting for a national party machine that wants to make normal Virginians the fall guys for failed policies. | ||
That's one thing. | ||
The second thing is that in the last segment, we discussed a lot of really difficult issues that everyday residents of the Commonwealth of Virginia may not know what to do about. | ||
What can they do about George Soros' money? | ||
Michael Bloomberg's money? | ||
That's okay. | ||
That's not what matters today. | ||
George Soros, Michael Bloomberg, failed candidates from out of state do not pick Virginia's leadership today. | ||
And there is no remedy for inaction. | ||
There is no substitute for you going and casting your vote at the polls today. | ||

So they're trying to lie. | ||

You know, Joe Biden came out the other day and said we have a total problem. | ||
That's a lie. | ||
What's happening in Virginia, this is MAGA coming and saying, hey, you know, a guy doesn't have to be full MAGA for us to support him because we understand, not only are we defeating McAuliffe, not only are we going to stop this madness in the schools, not only, as Deloitte Stallman told us yesterday, they're going to take apart the Virginia Department of Education, which has been so infected with this radical ideology, | ||
Right, that this is the this is what the key is, is to make sure that we represent today a stunning victory because this will change the arc and not just set up 2022. | ||
You're going to see what's going to happen in the next 24, 48 hours in Washington, D.C. | ||
