Well, John, President Trump is a master at coded language and the use of dog whistles, and there is no question that that statement included some of those same references. | ||
Simply by leaving out the comments that you've mentioned, he sends a signal to his folks to fight on. | ||
He has never come out and formally undercut the central theory of this domestic terrorist rebellion, which is the lie that the election was stolen from them. | ||

The fact that Trump is trying to run out the clock will not prevent him from being subject to the Senate's power to try and convict him and rule that he can never again hold public office. | ||

Okay, to walk us through, where are we? | ||
Because there's a lot of confusing information. | ||
Every different news service has a different take on exactly what is happening with Nancy Pelosi, what's happening with Mitch McConnell. | ||
What is the process, as far as you see it, the process for delivering the impeachment documents and actually commencing a trial? | ||
Is it going to take place? | ||
And some people, I think it was Bloomberg, had a piece that said it was going to take On Inauguration Day. | ||
Other people say it's going to take place when Schumer actually takes charge of the U.S. | ||
Senate, which I think will be Friday or the following Monday. | ||
What is your best estimate right now? | ||
As I'm looking at it, it appears that the two Georgia Senators, it's tough to say that, the two new Georgia Senators, Warnock and Ossoff, are going to be sworn in on Friday the 22nd, and then that's when Chuck Schumer becomes Majority Leader, and Chuck Schumer, the crying Chuck, has gone out there and cried about the fact, and stated the fact that he is going to hold the trial, and he is going to try to push forward with this absolutely meritless, contrived canard | ||
Of an article of impeachment against President Trump. | ||
Now, CNN's putting out articles saying that this was a planned attack against the terrible events at the Capitol were a planned attack. | ||
Well, if there were a planned attack, how could they have been incited at the speech? | ||
That's point one. | ||
Point two is the President said at the speech that people should march peacefully and patriotically toward the Capitol. | ||
No, there was no incitement. | ||
There was no incitement of violence there whatsoever. | ||
But in terms of process, it does appear that crying Chuck is going to be the one that takes over and then pushes forward with a trial in the Senate of President Trump after he has left office. | ||
Can't you file, when Nancy Pelosi actually gives the instrument, the document, to Mitch McConnell, and I think that's going to be transmitted prior to the inauguration, I think they're talking about the 19th, the day the Senate gets back, can't you file a motion to dismiss right then and Mitch McConnell, I think by a majority vote, of which they still have a majority vote with Vice President Pence, couldn't you dismiss it right there? | ||
Potentially, you could look to do that. | ||
You could look to do a dismissal. | ||
You could also make a broader appeal in terms of the constitutionality of trying a president after he's left office. | ||
Alan Dershowitz has talked about that, and that remains an open question, as you and I have talked about on the show before. | ||
But yes, that would be going to the Supreme Court and maybe that has to happen because even Tom Cotton saying, hey, I think it's unconstitutional. | ||
This is for duly elected officers. | ||
Once they're out, they're out. | ||
But my point is on the motion to dismiss, that would be fully in, that would be the Republican Party. | ||
The Republican Party could essentially make that Decision these individual senators as a party can make that decision vote it and it'd be it would be gone By it would be gone by next next Wednesday was delivered on the 19th be gone the day before the inauguration Biden would go through the process of the inauguration and they'd get on with it and no trial That's absolutely a challenge. | ||
Here's the question about that, though. | ||
Do you really think that you would get enough Republicans? | ||
Do you think you would get enough Republicans to vote that way? | ||
Because Mitch McConnell has now said that to him it's an open question which way he's going to vote. | ||
So I'm not convinced that the Republicans in the Senate are willing to do the right thing and dismiss it. | ||

Yeah, well here's what, and there's a Method to the Madness in the show, we're going to have Bernie Carrick on talking about the latest in the investigation, but you just mentioned the CNN reporting, talking about now that they're looking at this thing may have been planned in advance, been planned by some of these extremist groups. | ||
Now part of that we know is to push this whole thing of domestic terrorism, right, that the Trump movement is dangerous. | ||
But if you start to buy in that, and there's evidence of that, And, you know, Bernie Kerr is going to come on here and talk about how there's additional evidence of that in these outside groups. | ||
It had nothing to do with the speech. | ||
In fact, they were up there, some of them even before the President took the stage. | ||
And you look at Jack Max, he's going to read a letter to Liz Cheney from the Republican Party of Wyoming that is literally in your grill, right? | ||
Signed by the Republican Party of Wyoming. | ||
If you take that and the fact that Obviously the speech did not trigger this, right? | ||
Couldn't you then say, hey, upon further review, just send a notice to dismiss, a motion to dismiss. | ||
You take care of it. | ||
Hey, you know, the, the, the house ran too hot. | ||
This thing should have taken months. | ||
It should have been evidence. | ||
It was a grand jury should have been evidence. | ||
None of that was taking place. | ||
And we're out of here and let Biden get on with his confirmations and, and the normal, you know, fights and advocacy that will go on. | ||
So I think that that is a good idea. | ||
And obviously this, A completely empty political hatchet job of an impeachment article should be dismissed. | ||
But keep in mind, there was no successful motion to dismiss in the first impeachment a year ago. | ||
And that is when Republicans were standing tall, coming out strong, and Mitch McConnell was fully leading the fight against impeachment. | ||
If you think that now, that is more likely, I'm not sure how I see that calculation, because it appears to me that at least Mitch McConnell is signaling that he's open to having this trial, and that's an example of the Republican establishments coming back to bite President Trump, unfortunately. | ||
We know that President Trump beat the Republicans in 2016 before he beat the Democrat establishment. | ||
So I think it's a useful tool, it's a good tool, and it's a tool that we should push for. | ||
And then what it would do is it would put Republicans in a place of having to answer, why are you not? | ||
Voting to dismiss this. | ||
So I think it should be in the rules, because it puts them, you know, it puts them under the bright lights of, hey, this is a completely empty, rushed through, jammed through impeachment. | ||
We know it's just a political tool to try to force President Trump not to run in 2024. | ||
How can you not vote to dismiss it? | ||
So under that, I think it's a good idea. | ||
The issue is that Mitch McConnell's gonna be the one that's putting together the rules. | ||
I want to turn to, there's a saying, there are more tears shed for answered prayers than for unanswered. | ||
And for Chuck Schumer and the Democrats, you know, if you look at it, if you look at the charge of the, what is it, the instigation of an insurrection, violent insurrection, incitement of insurrection, you have both the details I know you guys are going through and there's research out there and investigators of the timeline and who was involved and all that, but the predicate, I keep coming back to page three, | ||
Talks about, and this is what the first speaker said, the lies that the election has stolen from them, that Trump went out and said lies. | ||
Since that's the predicate, the second part that you guys will argue, or the legal team will argue, will be the receipts, right? | ||
All the evidence that's out there has never really had a chance to get a full adjudication. | ||
So the trial of Donald Trump is the answered prayer. | ||
They've got to be ready to be on the receiving end of some incoming, because I've got to tell you, I think the overwhelming evidence, and you'll finally have a venue to see the riot part of it, right? | ||
And all the timelines, investigations, and with CNN's breaking, what you guys are doing, Carrick's going to be on here, but also with what President Trump has wanted to do from the beginning. | ||
Heck, it's reported in the paper he wanted to go to Capitol Hill and actually defend himself in the well of the House. | ||
Right? | ||
His advisors had to kind of talk him out of it. | ||
So, he's going to have a shot here that you can bring in witnesses, you can bring in evidence. | ||
Hey, you could take four weeks on this thing. | ||
And if Chuck Schumer even tried to jam you on the rules, that's part of the indictment. | ||
That's a grand jury. | ||

Now you're going to trial. | ||
You've got full rights to bring that. | ||

This will be the opportunity to bring out all of the fraud that we've been talking about for weeks. | ||
For months, you would talk about Wisconsin, over 200,000 ballots that were cast outside of Wisconsin law, Wisconsin Constitution. | ||
You would look at Georgia and over 400,000 allegedly unlawful ballots there. | ||
You'd look at Michigan, 71% of absentee precincts in Wayne County unbalanced. | ||
You would go through all of that and present it as evidence. | ||
And also you go back to the First Amendment. | ||
The American people are entitled to state their positions. | ||
If it is somehow seditious to do so, then Nancy Pelosi and pretty much every Democrat who said that the election was stolen, which perpetrated the Russia hoax in 2016, should be charged with that same sedition. | ||
Because the rules have to be the same for all Americans. | ||
We cannot have a different legal system for Republicans than Democrats. | ||
And by the way, I don't know if you saw this, but breaking in the last half hour, it appears that left-wing activist John Sullivan was charged in the Capitol riots. | ||
This is somebody who would have been interviewed by Chris Hayes and Anderson Cooper. | ||
Sullivan was roaming the building and can be heard in the video saying, we've got to get this blimp burned. | ||

He was filming as Ashley Babbitt was shot in the Capitol, was interviewed by Chris Hayes and Anderson Cooper. | ||
And Jack, he's charged in federal court? | ||
He is charged in federal court. | ||
This is the people of the United States v. John Sullivan. | ||
And what is his affidavit? | ||
There's an affidavit about his arrest? | ||
There's an affidavit submitted by an FBI agent. | ||
Number one, he committed or attempted to commit an act to obstruct, impede, or interfere with any fireman or law enforcement officer lawfully engaged in lawful performance, did knowingly enter or remain in any restricted building or grounds. | ||
This is just the start. | ||

Well, for about four or five days, you know, we were extremely confident that John Sullivan had planned to be at the Capitol, had put out leaflets and flyers for his followers, the BLM movement, to be at the Capitol. | ||
He put up a 17 or 18 minute training video on what to wear and how to wear it, what knife to carry, what mask to use in some of his leaflets, you know, to wear MAGA outfits. | ||
This was a guy that... Hold on, hang on, hang on, slow down, slow down, slow down. | ||
This has got to seep in. | ||
Because the President of the United States just got impeached because of this. | ||
And Liz Cheney called the deplorables and called the MAGA movement a mob. | ||
Okay? | ||
I want to just hit the rewind button. | ||
He told his followers, he put out that training videos and they were telling him to wear what and to act like and to look like what and to act like what, Mr. Bernie? | ||
To look like Trump followers. | ||
But here's the thing, Steve, whether it's Liz Cheney or any of these other people in Washington that jumped on this, let's attack the president. | ||
Guess what? | ||
In any one of these circumstances, let the investigation run its course before you jump out there and say the president was inciting. | ||
We now know that people like John Sullivan and others were planning to do this four, five, six, seven days in advance before the thing ever happened, and we now know based on the timeline that The storming, if you want, or the breach of security at the Capitol was actually happening 20 or 30 minutes before the President ever concluded his speech. | ||
And that would be impossible for the people that were there where I was to get over there within a half hour, 45 minutes to an hour. | ||
So at the end of the day, All of these people in Washington, these politicians, the pundits, these Donald Trump haters, they should have waited until the investigation was concluded. | ||
Stop speculating. | ||
Let the evidence come out. | ||
And I think you're going to see much more about John Sullivan because the charges, as they have them right now, There's going to be much more with regard to inciting, with regard to training, with regard to preparation. | ||
And keep in mind, he's the same guy, the same exact guy that was involved in a riot in Utah that actually videoed an incident there where another person was killed. | ||
He was the person here in the Capitol that did the video, had the video of the girl that got killed. | ||
He's the same guy that had another video in Utah, same type of incident. | ||
So I think the FBI, I credit them for getting him now, for taking him off the street, but I think there's going to be a lot more to come. | ||
Bernie, you've seen this many, many times in all the investigative work you've done in your career as a police officer, police commissioner, private security. | ||
They're trying to paint this as kind of, you know, a right-wing, white nationalist, white supremacist, domestic terrorism, right? | ||
And so they can paint the whole, you know, Don Lemon and these guys. | ||
There's actually quite a bit more in this about Sullivan. | ||
It's 20 or 30 pages, this charging, but here, I'll give you some of this, right? | ||
Sullivan, a resident of Utah, based on publicly available information and the information provided by Sullivan in an interview January 7, 2021, Sullivan is the leader of an organization called Insurgents USA, through which he organizes protests. | ||
On July 13, 2020, Sullivan was charged with rioting and criminal mischief by the law enforcement authorities in Provo, Utah, based on his activities around a June 30, 2020 protest in which a civilian was shot and injured. | ||
The case is still spending. | ||
Now, the next one, he's at another protest in Washington, D.C. | ||
It's not specified when. | ||
It's from a video he posts. | ||
On his YouTube page, in which while attending a protest in Washington D.C., Sullivan can be seen telling a crowd over a microphone, we about to burn this blank down. | ||
We got to rip Trump out of office. | ||
Blank. | ||
Pull him out of that blank. | ||
We ain't waiting until the next election. | ||
We about to get that mother blank. | ||
Sullivan can then be seen leading the crowd in chants of, it's time for a revolution. | ||
This is my point, Bernie, that these are not, these guys, I don't know if it's the Boogaloo group or, you know, the insurgents, but this is a network. | ||
And I'm not saying they're not, maybe not, right-wing militia groups in this VOLV 2, but you've seen it and you've investigated. | ||
It's a lot more than that, isn't it, sir? | ||
It's a lot more than that, and that's why I tell people, don't speculate. | ||
Let the investigation take its course. | ||
But I want to go back to Sullivan for a minute, Steve. | ||
This is important. | ||
What Jack was just reading, Out of that affidavit, that stuff happened when they were burning down, I mean literally, burning down Washington D.C. | ||

Sullivan wasn't taken in. | ||
I saw that months ago. | ||
I saw that video months ago, when it was going on in Washington D.C. | ||
Nobody went after him. | ||
Nobody charged him. | ||
Nobody locked him up. | ||
Nobody questioned him. | ||

But they're all over him right now, which, you know what, it's hypocritical to me. | ||
If you're going to go after these groups, if they violate the law, whether it's the Capitol, whether it's the streets of Washington, D.C., or whether it's the streets of New York, or Portland, or Seattle, or any one of these other towns where this has happened, you violate the law, go get them, lock them up, and make sure they're held accountable and they can't do it again. | ||

The left doesn't do that. | ||
They incite, they antagonize, they go out there and they burn down cities, And nobody says a word. | ||
Nobody says nothing. | ||
This guy's been hanging around for months. | ||
Bernie, let me ask you, how long would it take you, you think, to do a pretty thorough investigation and start charging people? | ||
Here, was it a month, two months, six months, a year? | ||
What would be the normal course for something that went on on the 6th? | ||
Well, listen, you have an enormous amount of information. | ||
I think the biggest thing is to go through that, sift through all of that information. | ||
The mayor and I don't have half, probably, of what the FBI does because they got the internal videos. | ||
They got a bunch of stuff that we don't have. | ||
But I can tell you this, they've already got probably more than a hundred cases that they've talked about. | ||
There's a lot more to come. | ||
It's going to take a long time. | ||
It's going to take weeks, if not months, to sort it all out. | ||
But it's got to be done, and it's got to be done right. | ||
You and Rudy and the team, you've got an investigative team looking at this. | ||
How, given the information you've seen, which is limited what you've been able to pull together, and now the charging in federal court of Mr. Sullivan, how can the head of DOJ of this investigation and the FBI in charge of this investigation stand in front of the microphones the other day and said, there's no ante for a BLM participation in this, this is all related to these far-right groups. | ||
How could they do that? | ||
You know what Steve, I don't like the Monday Morning Quarterback these guys because I never know what they're looking at or what they're thinking. | ||
In my opinion, maybe it was a premature statement. | ||
Maybe they didn't have what they have now. | ||
I would say that that sentiment is going to change and things will change as it goes on because John Sullivan wasn't the only guy from BLM there. | ||
He had an enormous following. | ||
A bunch of his people were there. | ||
He had flyers all over for people to come. | ||
I think this is just the beginning. | ||

Do you think you've got enough material right now that if Chuck Schumer tries to jam this thing in, and they're trying this case in the Senate a week from now, do you think you have enough information at your disposal to blow out the charge of inciting an insurrection, that you've got enough right now to just blow? | ||

I think this is the thing for all the deplorables, all the MAGA nation, everybody's been a little depressed, remember there's more and more information going to come out about this and the information is going to show, right, that there are certain elements of this that have no relationship whatsoever. | ||
With an even look, obviously the bad guys on the right don't have it either, but this was, you had left-wingers, you had Antifa, you had Black Lives Matter, you had these Boogaloo guys, you had what they call accelerant groups, as Rahim calls them, the accelerationist. | ||
