As we speak today, an alternate slate of electors in the contested states is going to vote, and we're going to send those results up to Congress. | ||

That means that if we win these cases in the courts, that we can direct that the alternate slate of electors be certified. | ||
The state legislatures in Georgia, Wisconsin, Pennsylvania can do the same. | ||

Whether it's the signature matching in Georgia that was illegally changed as a result of a consent decree without the legislature's approval, or whether it's the hundreds of thousands of improperly cast ballots in Wisconsin, absentee voters who never Stephen Miller, the assistant to the president, lays it down. | ||
or whether you're talking in Pennsylvania, the clear equal protection violation when Democrat ballots were cured in advance of election day and Republican ballots weren't. | ||

Are you being a traitor to the United States by demanding that only legal votes of American citizens count? | ||
Well, it would seem to me that the people who are setting forth these certifications they know are false. | ||

So if you're certifying, let's take Georgia because we mentioned Georgia. | ||
If you are certifying Georgia as an accurate vote, you know by clear and convincing evidence that that's a false number. | ||

Why are you sending electors? | ||
Why are electors going to the state capitals today? | ||
Today is the first Monday after the second Wednesday in December. | ||
That is by statute, not by the Constitution, but by implementing statute. | ||
That is where the Electoral College meets in the state capitals, and the electoral slate is put forward by the state legislatures and the state governments So, why is the Trump campaign sending its own slate of electors to these state capitals? | ||
Well, based on our legal research, the advice we've gotten from a number of professors, our own advice, we could have a gap here. | ||
If, for example, let's say the state of Georgia decides to continue its hearings and decides that the count is grossly wrong, That Trump actually won Georgia. | ||
If we don't have a group of electors selected today, there's a question as to whether we can select electors after today. | ||
So out of an excess of caution, this goes back to the Kennedy-Nixon race of 1960. | ||
In 1960, Nixon won Hawaii on election night. | ||
It was a water jam, but it was very close. | ||
It was like three or 400 votes. | ||
The Kennedy people selected their own group of electors on that day, on this day in 1960 as an alternative. | ||
And then in December of 29 of 1960, the courts ruled for Kennedy. | ||
They gave him the state by 50 votes. | ||
And so therefore, two sets of electors were sent to the Congress. | ||
And guess who picked the Kennedy electors? | ||

But had there been no Kennedy electors, all he could have done is disqualify the Nixon electors. | ||
And there's always a question as to whether you need a majority of the 271 or a majority only of the people voting. | ||

Given your time at the Justice Department, your time as the senior head of the Southern District of New York, that a special prosecutor, a special counsel is warranted to look at the election fraud and the voter fraud throughout the country, particularly in these five or six battleground states? | ||

Or is the President, as the Chief Magistrate of the country, does he have the authority, in your mind, in your understanding of the Constitution, the relationship between the Justice Department and the White House, does the President have the authority to basically inform the Attorney General that there is going to be a special prosecutor selected and he's going to have full subpoena power and a full budget? | ||
Well, yes, he's the chief executive officer of the United States. | ||
He has all the executive powers of every inferior officer. | ||
He's a unitary executive. | ||
All executive power exists with the president. | ||
No one of those cabinet officers has a single bit of the executive power other than comes from the president. | ||
And therefore, he can tell them what to do and do it for them. | ||
And it would be far better for everyone If the Attorney General would recognize the gravity of the situation, both with regard to the election, which is now At a point where we've already gone beyond that. | ||
But Mayor, Mayor, Mayor, Mayor, you have Bernie Kerik, who's a former police commissioner in New York under your administration, and also has spent his career in law enforcement, is one of the organizers of the thing. | ||
He's got binders with 2,000 signed affidavits of American citizens under the penalty of perjury. | ||
Affidavits that attest to voter fraud and election fraud and election administration mismanagement. | ||
You've got into the thousands other pieces of evidence besides just the affidavits. | ||
The Attorney General said, well, I haven't seen anything yet, right? | ||
I haven't seen anything. | ||
So his lackadaisical attitude, in addition to the fact that he covered for Biden on a national stage in a debate that globally Had hundreds of millions of eyeballs on it. | ||
The President of the United States called him out on the day the New York Post put up the hard drive from hell and he looked the nation in the eye. | ||
President Trump called him out. | ||
Biden looked the nation in the eye and said, hey, my son hasn't done anything wrong. | ||

He hasn't done anything wrong. | ||

We've had two people, two prominent people this weekend, saying that the Democrats should do the same thing to Republicans who support President Trump's | ||
Legal remedies, his constitutional legal remedies, New Jersey Congressman Bill Pascrell and The Week, that's a magazine, The Week writer Ryan Cooper, are both saying that because the third section of the 14th Amendment states that nobody should sit as a member of Congress if they have engaged in insurrection, | ||
Supporting legal remedies, ongoing legal remedies by the way, is tantamount to that. | ||
Now, that would, and by my calculation, would disenfranchise 92 million people in a heartbeat. | ||

I think a lot of people might agree with the Constitution being jerry-rigged at least, but he jerry-rigs it himself. | ||
By selectively quoting from the 14th Amendment, and you have these ellipses every time that he just leaves a chunk out there, right? | ||
But his conclusion is that nobody who supported and continues to support President Trump and his legal remedies should be able to take a seat in Congress because the 14th Amendment states that no person shall be a senator or representative in Congress who should have engaged in insurrection or rebellion against the same. | ||
Except it doesn't make sense, and I'm sure to most people I don't need to explain why that doesn't make, why a genuine legal remedy isn't tantamount to insurrection. | ||
And in fact, if anything, cheating at an election, the people who cheat in an election are insurrectionists, are people who are actively working against the Republic. | ||
But take a step back from all of that and the merits of the case, because there really are none, to the fair-minded American, and think about what these guys are doing. | ||
Think about how dangerous it is that you have a congressman demanding that Nancy Pelosi refuses to seat 126 Republicans. | ||
They talk here on Capitol Hill in very lofty terms about uniting the country, but at the same time they're planning and scheming to cut out 92 million Americans from the electoral process, to disenfranchise them, to remove their vote, to remove their say in how their government is run. | ||
And again, why? | ||
Because they supported legal remedies that are constitutional, that go through the courts, that go through the judicial process to figure out whether or not there was cheating in this election. | ||
Now, we all know that there was, and to placate YouTube, while official sources have called the race for Joe Biden, there is nothing to stop this president constitutionally from doing what he's doing, and therefore there should not be any recall. | ||
In fact, he has more importantly, he has an obligation. | ||
He has an obligation and a responsibility to do this. | ||
This is not extra legal. | ||
This is purely part of the legal process. | ||

this piece of software, this platform SolarWinds Orion. | ||
The Orion platform is basically a performance monitor. | ||
It's an analysis tool that allows for cloud monitoring and mapping and Logging of cyber information. | ||
It's an administrative tool that companies use and that government departments have used. | ||
It's not just government departments that have been affected by this. | ||
Microsoft, FireEye, they've also said that they've been involved in this. | ||
But there will be a plethora, far more than we currently know, which is I think DHS, Treasury, DOJ, DOD have been involved in this thing. | ||
This is cross Government here this is across the entire federal network that you'll see this anywhere that was connected to this software of this platform and that could be through a connection with another government department as well now that means that this is probably we're probably going to find out and and there are already people talking in these terms that this is the largest exploit Cyber exploit in US government history. | ||
They are talking about Russian hackers being involved in this. | ||
There's no doubt in my mind that we'll see other both state and non-state actors who have been involved in exploiting this backdoor in and documents that they've stolen and entire email databases that have been stolen and what's contained within those things. | ||
But the really interesting question isn't just, hey, how did this come to pass? | ||
And what's going to happen now, but under whose stewardship and under whose tutelage this occurred? | ||
