[00:02:43] Jeff, I'm going to clip this into a standalone segment. === Supreme Court Challenge (15:03) === [00:02:45] So I'm going to get around all the crappy stuff. [00:02:48] Mr. Jeffrey Eveley out of Canada, could you remind the world as to who you are? [00:02:53] Well, I am a 20 year veteran of the Canadian Armed Forces, Iraq, Afghanistan, all that fun stuff. [00:02:59] I'm also a veteran of the Convoy, Rolling Thunder, James Topp, the 1 million March for Children, the 2025 election, and the 2025 Nova Scotia Woods Band. [00:03:10] So I'm most well known, of course, for defying the Woods Band in Nova Scotia, where we actually fell back about 800 years and were not allowed. [00:03:24] In the King's Forest, Tyron Timmy Houston's Forest, for fear of wildfire. [00:03:30] My sneakers were apparently declared to be a fire hazard. [00:03:33] And I said, well, this is total BS. [00:03:37] So I'm going to violate this ban and I'm going to make sure that I get the fine. [00:03:42] And we're going to get into court and there's going to be no standing or mutinous arguments because I have a $28,872.50 fine hanging over my head. [00:03:52] And so everybody appreciates, some people don't appreciate this. [00:03:55] You did a video. [00:03:56] It was a hilarious video where you're looking and you're saying, This is a forest. [00:03:59] Can't go in here. [00:03:59] This is fine. [00:04:01] You can walk around here. [00:04:02] This was this summer when they imposed a no campfires ban, no camping ban, no electric ATVs, whatever ban, no going into the forest with your body, your person. [00:04:13] So this was crown land, so government property, although technically it belongs to the people, but maybe not in the public. [00:04:20] This had been, it wasn't the first time they did this. [00:04:23] They did it, was it back in 2023? [00:04:26] Yeah, they did it in 2023. [00:04:28] And I tried to challenge it at that time. [00:04:31] Now, 2023 was our worst wildfire season. [00:04:34] The Barrington fire was the worst in our history. [00:04:37] How that guy did not get an arson charge is definitely a mystery to me. [00:04:43] You got to fill in everybody's memory there because that was, it's amazing how the worst wildfires of the dry seasons typically tend to be arson. [00:04:51] How did that one start and whether or not it was arson versus negligence? [00:04:55] How did that fire start? [00:04:56] Oh, it was a tire fire that some guy set down in Barrington just off of an ATV trail. [00:05:01] They charged him with starting a fire on private property without permission, failing to take steps to prevent that fire from spreading, and leaving that fire unattended, but not arson somehow. [00:05:14] And it became the largest fire in Nova Scotia history, if I'm not mistaken. [00:05:19] Yep. [00:05:19] I would still have to drive eight hours to get to it from where I am right now. [00:05:25] And I'm on Cape Breton Island, which has a natural fire breaker. [00:05:28] With the mainland Nova Scotia. [00:05:30] It's called the Strait of Canso. [00:05:31] It's a piece of ocean that's two kilometers wide, and no fire in history has ever jumped it. [00:05:37] So, when they banned me from going into the woods for the Barrington fire eight hours away, I thought that was an overreach. [00:05:44] And I tried to self represent and do my own charter application that time. [00:05:50] But by the time it got to court, the ban had been lifted. [00:05:53] And also, I didn't get fined and I didn't own a business. [00:05:55] I had no financial stake in going into the woods. [00:05:59] So, the judge said, Well, you can't stand on your rights alone in a Canadian courtroom. [00:06:03] There has to be money involved. [00:06:05] So, when they came in with the ban this time, I knew what I had to do. [00:06:08] I had to go and get the fine. [00:06:11] And, like you said, I started out with my this is the woods and this is not the woods video because I was just kind of having some fun with it on the first day it came into effect. [00:06:20] And they had yellow caution tape around some of the trails in the park by my house, but not other trails in the park by my house. [00:06:28] So, COVID vibes all over the place. [00:06:32] You know, I'm surprised they didn't put arrows on the gravel. [00:06:35] Trails to let us know which direction we had to walk in in order to avoid starting a fire. [00:06:40] But, you know, I did that really just to cheer myself up because I was feeling pretty doom and gloom when they were bringing in this full scale tyranny all over again. [00:06:50] And then I made an appointment. [00:06:52] I called the Department of National Resources and I talked to the supervisor and I told him all about what happened in 2023. [00:06:59] And I said, So I have to get the fine in order to challenge this in court. [00:07:03] When would be a good time for you guys to come down and do this? [00:07:07] Let me flesh this out also for people who might not appreciate it. [00:07:10] We make a joke on the channel, you know, things are moot. [00:07:13] They're moot because you waited too long. [00:07:15] They're premature because you haven't waited long enough. [00:07:17] And they are latches because you've waited too long. [00:07:21] And so there's a joke, I forget what it is. [00:07:23] It's not ripe, no standing. [00:07:26] And then, you know, it's moot because it's already passed. [00:07:30] Initially, they said you couldn't stand on your rights, which means if you had no interest. [00:07:33] I don't know how any Canadian, anybody who's in a country, doesn't have the inherent right to challenge the legality. [00:07:38] Of any decree. [00:07:40] They say you don't have the standing to do that and you don't have injury interest to actually challenge it because you didn't get a fine. [00:07:46] And so, too bad, so sad. [00:07:49] We've lifted the ban, come back in the future. [00:07:51] So, this time you say, I'm going to get the damn fine. [00:07:53] It was $25,000. [00:07:55] It came to $28,000 and change because it's got some victims of the crime additional amount to it. [00:08:01] And there's tax and tip on the tickets. [00:08:04] I'm joking about the tip, but there's tax on the fine. [00:08:06] So, you go and you have to schedule this so you can, in fact, get the fine. [00:08:10] And that's where you're at. [00:08:11] But by the way, Jeff, let me bring it up because I want to share your comedic genius. [00:08:15] Not all of it. [00:08:16] We'll just play a portion of it. [00:08:35] Jeff Evely here out in Nova Scotia on Mountain Road in Cox Heath. [00:08:43] And as you can see behind me, this is the woods. [00:08:50] But over here, this is not the woods. [00:08:55] This is the Department of Natural Resources, where the conservation officers work, who issue $25,000 fines for going in the woods. [00:09:06] And you go into the woods, and they give you a ticket, and we have it all on there. [00:09:09] And I can remove this now. [00:09:11] And Jeff, your beard has gotten ever so glorious since that. [00:09:15] You're like a baby in that video. [00:09:18] It's a mane. [00:09:19] I don't even know. [00:09:20] Like, when does it stop growing? [00:09:22] That thing is a. [00:09:23] Okay, so you go. [00:09:25] You schedule it, they see you, they come, they issue the ticket, they're all apologetic about it, here it is. [00:09:29] And you say $28,000, they explain the compensation for victims of violent crimes that goes into all tickets. [00:09:36] And you challenged it. [00:09:38] And there's good news, I guess, coming out of Nova Scotia. [00:09:41] Which court level did you just score a victory at out of Nova Scotia? [00:09:45] It was the Supreme Court of Nova Scotia. [00:09:48] So basically, that's the court you go into anytime you want to challenge the government, right? [00:09:54] It's Supreme. [00:09:55] Relative to the government. [00:09:58] Well, it's the lowest level in Nova Scotia, much like you have the Supreme Court of British Columbia, then you have the Court of Appeals, and then you go to the Supreme Court of Canada. [00:10:08] So, though it's called Supreme, it's not the Supreme Court of the land. [00:10:12] It's actually just your first actual government court system, not an administrative tribunal. [00:10:17] And you go there and you plead the law and the Constitution. [00:10:22] Yeah, I guess I just mean to convey that family courts and criminal courts, like They work for the government, and the Supreme Court can kind of slap the government around a little bit. [00:10:34] So, yeah, we went in there. [00:10:38] So, first of all, this was not actually the hearing to contest the ticket. [00:10:43] That's not scheduled until July. [00:10:46] This hearing was three days, and we heard from the Canadian Constitution Foundation, who issued a charter challenge in the public interest. [00:10:55] We heard from the JCCF, the Justice Center for Constitutional Freedoms. [00:11:00] They submitted the charter challenge in my private interest. [00:11:03] And then we heard from the government on the third day. [00:11:06] It was pretty cringy. [00:11:08] But this was to challenge the proclamation itself. [00:11:12] So, challenging it on charter grounds, and it fell. [00:11:15] So, the proclamation was not charter compliant, violated our rights. [00:11:20] Ultra vires, I don't think he actually used those words in the decision that he rendered. [00:11:26] But yeah, effectively, it's the same thing. [00:11:29] It was not legal to begin with. [00:11:31] So, now we have to go to the Crown. [00:11:34] And say, well, in light of this decision, you should probably withdraw that $28,872.50 fine. [00:11:41] And we'll see what they say then. [00:11:44] Well, yeah, I mean, presumably the fine was issued in front of a decree that was declared unconstitutional. [00:11:49] And you'll refresh my memory if you are familiar enough with it. [00:11:53] When you're challenging the constitutionality of a decree or a law, it's a separate argument that you have to make above and beyond the fine itself. [00:12:00] There is going to be no argument on the quantum of the fine or the unreasonableness of the fine. [00:12:05] Right now, the decree in virtue of which the fine has been issued is declared unconstitutional, did not meet the Supreme Court of Canada. [00:12:13] Was it the Oakes test? [00:12:14] Is one of the cornerstone ones in this case? [00:12:17] No, actually, the one that was more a cornerstone was called Dore. [00:12:22] So, Oaks is the one that most people are familiar with, but that was for a criminal matter relating to drug trafficking. [00:12:30] So, I think Oaks had something like two or three grams of marijuana on him and they charged him with trafficking. [00:12:36] And so, that's where the Oaks test comes from. [00:12:39] It's like it was just for personal use. [00:12:41] You can't go too far like that and charge him with trafficking when he only had enough for personal use. [00:12:46] And so, they came up with the Oaks test, and that's where they come in with like. [00:12:49] A lot of this logically connected to the goal and proportionality and stuff like that. [00:12:54] Now, that does apply, but this was actually an administrative decision, not a criminal matter. [00:13:01] So the DORE was the test that they relied on the most. [00:13:06] And for that one, it's a four step test. [00:13:09] And the first step in that test is to ascertain whether the government actually considered our charter rights prior to issuing the proclamation and whether they balanced. [00:13:22] The need for public safety with those individual rights, but there is no evidence anywhere. [00:13:27] They were unable to show anything in any of their internal communications, any of the briefings provided to the minister, where they actually mentioned the fact that Nova Scotians have charter rights. [00:13:39] Even in the section of the briefing provided to the minister before he issued the proclamation, under the heading legal, there is no mention of charter rights or fundamental freedoms. [00:13:51] All they are talking about is the potential to be sued by industry. [00:13:54] So they permitted industry into the woods. [00:13:57] To avoid getting sued and just threw the little guy under the bus. [00:14:01] And so, I mean, the four criteria let me bring this back up here, but I presume it has to be reasonable, it has to be proportionate, it has to be as little of an intrusion on rights as possible. [00:14:12] I mean, I'll flesh out some of the portions of the ruling in a second, but what were the highlights, the overview in your view? [00:14:20] Well, yeah, you are hitting on it, I think. [00:14:23] And that's probably more in line with the Oaks test. [00:14:27] It has to be logically connected to the goal. [00:14:29] Obviously, my sneakers are not a wildfire hazard. [00:14:32] It has to be proportional in terms of the goal that they are trying to achieve relative to the impact to our rights. [00:14:40] And you know what? [00:14:41] I should know these, but I don't have them all. [00:14:42] Oh, it doesn't. [00:14:43] Well, here we go. [00:14:43] Paragraph 37, where it says the court must consider the decision maker's reasoning process, just to highlight a few, to assess whether, given the relevant factual and legal constraints, the decision reflects a proportionate balancing of charter rights. [00:14:54] Or the values underline them. [00:14:56] If not, the decision is unreasonable. [00:14:58] I mean, and this was, again, you know, we got to some of this in some of the COVID stuff, but, you know, in Nova Scotia as well, you know, a total ban on outdoor protests. [00:15:08] Sure, they declared unlawful at the Court of Appeals level after they've already restricted the ability, but they say that was just a total blanket, you know, banning for no better reason when there were other more reasonable constraints they could have done to allow this constitutional right of peaceful assembly to occur. [00:15:24] And it was issue specific. [00:15:25] Because they already allowed Black Lives Matter to absolutely rage all over the province. [00:15:30] And then, when somebody wanted to protest the Nova Scotia government, the strangs measured in particular, they sought an injunction to stop Freedom for Nova Scotia from protesting on Citadel Hill. [00:15:42] I got to read this just because it's so painfully stupid. [00:15:45] People could not use trails for recreation unless they were on land that the person owned or occupied. [00:15:51] They actually had talked about, or at least asked people not to go on their own. [00:15:55] Private property because of the risk of forest fire. [00:15:57] Step that aside. [00:15:58] If you need to use a relatively short trail through a wooded area to get from point A to point B, that is generally okay. [00:16:04] Use your best judgment. [00:16:05] They're telling us to use our best judgment as if using a. [00:16:09] It's total insanity, panic level, stupidity. [00:16:12] And they got away with it during COVID. [00:16:14] They got away with it in 2023. [00:16:16] And now, at the very least, a court said, no, this didn't work this time. [00:16:21] And there was discussion in court around this idea that perhaps. [00:16:28] Our public officials got a little bit too used to coming down with a heavy hand during COVID. [00:16:34] But this can't be, you know, COVID is not a precedent. [00:16:38] It's a historic event. [00:16:40] So, you know, and obviously you and I, I think, agree that they went too far even there. [00:16:45] But even the people who think, even the judiciary who doesn't seem to think that they went too far, are saying that, you know, like this is not the way the country is supposed to be governed under normal circumstances. [00:16:55] So, you know, yeah, there was a one off, a historical event, but now it's the time to get back to good governance. [00:17:03] It's unbelievable what is required for a judge. [00:17:08] A judge actually has to get involved. [00:17:09] The court system has to get involved. [00:17:10] Paragraph 60. [00:17:11] Had charter rights been considered when the decision was made, the requirement for fair notice would have been addressed and the scope of the ban could have been refined. [00:17:18] Similarly, the issue of overbreadth would have been considered. [00:17:21] Mobility rights could be impaired only to the extent necessary to fulfill the purpose of the ban. [00:17:26] Preventing people from entering the wet bogs, for example, may not have been necessary to mitigate the risk of fire, but it might have been. [00:17:32] There might have been sound reason for it, but those issues must have been considered, which they weren't. [00:17:37] So they said, willy nilly, they just adopted this without any meaningful discussion. [00:17:42] But then also, that it made no sense and it was totally, totally too broad and unreasonable and unnecessary. === Defining the Woods (02:34) === [00:17:49] My favorite section in that decision is the one that has the heading What are the Woods? [00:17:55] Let me see if I can do control. [00:17:57] Well, I'll have to go up here. [00:17:59] Okay, hold on. [00:17:59] Other issues scrolling up. [00:18:01] It's in italics. [00:18:03] Yeah. [00:18:04] Mobility rights. [00:18:05] Oh, they must have been trying to consider, trying to define what the woods actually were. [00:18:09] Yes. [00:18:10] Yes. [00:18:10] There was that whole conversation in the courtroom. [00:18:12] Like, what are the woods? [00:18:14] What do we mean when we say the woods? [00:18:16] And it's not defined in the act. [00:18:19] And so, a forest, the judge talks about this in his decision as well. [00:18:23] Like, what is a forest? [00:18:25] That a forest is a bunch of trees. [00:18:26] Well, a bunch of trees could, you know, line the boundary between two properties. [00:18:31] Is that a forest? [00:18:32] And when it comes to the woods, it's even more nebulous because it includes things like, you know, he's mentioning the wet bog. [00:18:40] That's part of the woods. [00:18:41] A rock barren. [00:18:42] There was a lot of discussion around what is a rock barren because those terms are not actually defined in the area. [00:18:48] Sorry, I can't control this. [00:18:50] I can't control PDF. [00:18:52] Designating all woods in Nova Scotia as a restricted travel zone caused an interpretation problem. [00:18:57] The terms woods in the Forest Act is not defined. [00:18:59] With the kind of precision, that's also known as not defined, that would allow it to be designated a designated area. [00:19:06] If specific areas had been designated, Nova Scotians would have been known precisely where they were not allowed to go. [00:19:11] People in Halifax, for example, were told to stay out of Point Pleasant Park. [00:19:15] They knew what that meant. [00:19:16] It is reasonably precise to define an area. [00:19:18] And sorry, I cut you off there. [00:19:19] So, what were some of the more idiotic areas? [00:19:22] Did it include Peggy's Cove? [00:19:24] Well, that was the question that the judge asked. [00:19:27] He was like, well, what is a rock barren? [00:19:28] Is that Peggy's Cove? [00:19:30] And the government lawyer was like, well, It's not surrounded by trees. [00:19:34] And he's like, it doesn't say that it has to be surrounded by trees. [00:19:37] It says that a rock barren is part of the woods. [00:19:39] So is Peggy's Cove the woods? [00:19:41] For anybody who doesn't know Canadian geography, Peggy's Cove, it's iconic. [00:19:44] I think if you like, it's like one of the defining images or locations of Nova Scotia. [00:19:49] It's the famous lighthouse on the rocks. [00:19:52] It's glorious, but there's no trees there. [00:19:55] There's not even any. [00:19:55] I mean, the only fire you could get is if wood washed ashore and then dried up on the rocks, and then you'd have to fish for it to actually try to make something of a barbecue. [00:20:04] Who is the judge? [00:20:04] Do you know? [00:20:05] Well, I can get his name, but. [00:20:06] Jamie Campbell. [00:20:07] And I say, how is the judge? [00:20:09] He has to be respectful even when he's spanking government officials, but it can't really be much more of a judicial spanking than what you got in that ruling. [00:20:19] I don't think so. [00:20:20] And he was good. [00:20:22] I thought he was pretty good. === Reasonable Limits Ruling (03:00) === [00:20:23] He was engaged and he asked meaningful questions, I thought. [00:20:26] And I could kind of see that he was always, I think, from the first day, kind of leaning in our direction, just based on the questioning that he asked and the reactions in the courtroom. [00:20:37] Like when the government lawyer was talking, it was like, oh, God, this is painful. [00:20:41] But I got to know the government's lawyer, the government's representatives, who are they? [00:20:46] Or did they send in young, wet behind the ears people to get this judicial spanking? [00:20:51] Oh my God, no, this guy's been around since Christ was a cowboy. [00:20:57] He was old as Peggy's Cove. [00:21:02] And gallingly ignorant of the law. [00:21:06] And so he was actually saying, like, he said out loud that he was just kind of lamenting the fact that people are allowed to move around, that that's what liberty means. [00:21:17] He's like, we have crosswalk signs, we have stoplights, we have speed limits. [00:21:22] So, you know, it doesn't support that level of freedom, like absolute freedom. [00:21:26] And I'm sitting there in the back of the courtroom going, reasonable limits. [00:21:30] Those are called reasonable limits. [00:21:32] So, and, you know, I thought that he got spanked really by the CCF and the JCCF because he was doing things like he would try to cite case law from 40 years ago and they'd be like, it's the living tree. [00:21:47] That's common law doctrine. [00:21:49] So these cases came out in, This century, and these are the ones that should be relied upon. [00:21:57] Those older cases should not be relied upon. [00:21:59] So I thought the CCF and the JCCF did a pretty great job calling them out on that. [00:22:06] Man, I mean, we got the win. [00:22:07] For those who don't know, Justice Center for Constitutional Freedoms, the JCCF, and I think I'm going to have one of their lawyers on Monday to go over this and talk about it as well. [00:22:16] And the CCF is the Constitutional Center for Freedom? [00:22:22] The Canadian Constitution Foundation. [00:22:25] Canadian Constitution Foundation. [00:22:26] I've had less interactions with the CCF than the JCCF, but they're two distinct organizations. [00:22:31] And the JCCF is doing the lawyer's work as well. [00:22:34] I just know the JCCF much better, and you can go to jccf.com. [00:22:38] CA to donate and support their work. [00:22:40] Three days with a JCCF lawyer. [00:22:42] The CCF was in there as well. [00:22:43] Three days in court. [00:22:44] You get a 17 page ruling. [00:22:46] The administrative waste and the financial waste on your end. [00:22:51] How were your, was JCCF doing it pro bono? [00:22:54] Oh, yeah. [00:22:55] I mean, well, they operate on donations. [00:22:58] Like, you know, the lawyers are getting paid, but there's no expense to me. [00:23:02] So, and where would we be? [00:23:04] Where would Canada be were it not for organizations like the JCCF and the CCF? [00:23:07] So, I really think that that's where the battle space is right now. [00:23:11] Protests don't work anymore. [00:23:13] You know, drag these people into court, get them involved in a process that has some teeth, donate to the JCCF, donate to the CCF. [00:23:20] And I'm more familiar with the JCCF, so I'm always going to say those guys are my favorite. === Gender Transition Debate (08:22) === [00:23:24] I think they're all great. [00:25:47] And I'll say that, in my personal opinion, the reason I think that we're so far behind the civilized world right now is because of the unanimous vote on Bill C 4, which is the one that imposes a five year jail sentence. [00:25:57] On anyone who causes somebody to go on undergo so called conversion therapy, but the definition of conversion therapy applies to helping a gender dysphoria child feel comfortable in their natural body. [00:26:10] You're not, it was the conversion, it's colloquially called the conversion therapy ban. [00:26:15] It basically allows you to talk a kid into being gay or trans, but not talk a kid out of being gay or trans. [00:26:21] And it literally, if you, I mean, it's not hyperbolic, it basically criminalizes therapy. [00:26:26] Jordan Peterson was raising the alarm about this, it passed unanimously. [00:26:30] With all of the support of the so called Conservative Party of Canada. [00:26:33] So, you're right. [00:29:13] To attend appointments for my daughter at the gender clinic after they started calling her phone directly because she turned 16, which is the legal age of consent for so called medical treatment in Canada. [00:29:23] So they're basically stalking my daughter. [00:29:26] And he went on and voted for Bill C6 in a free vote. [00:29:30] And then he was one of the unanimous consentors to Bill C4. [00:29:33] And that's the thing in Canada, if you don't toe the party line, you lose your party status and then you're not going to be an MP anymore soon enough. [00:29:42] So nobody in our Commons can really speak out on this issue. [00:29:47] Without fear of repercussions from the party old guard. [00:29:51] So we haven't even invited any politicians. [00:29:54] I have a petition that I submitted, a House of Commons petition to Garnett Genuus because I happen to know that he's engaged with some other parents' groups. [00:30:01] And I fully expect that I'm going to get to the podium at the press gallery and say, I've had this petition submitted for six weeks now and it hasn't gone anywhere because I need a parliamentarian to approve it. [00:30:11] Nobody's going to speak out on this because of that vote on Bill C4. [00:30:15] And we're going to try and get into the mainstream bubble. [00:30:18] With the, you know, I'm not counting on CBC, CTV Globalist to show up, but, you know, CPAC will definitely be there. [00:30:28] I'm sure the National Post, the Western Standard, Sun News Network, all of those folks will show up. [00:30:35] So we'll definitely get some coverage. [00:30:36] And I am hearing from my sources on the ground that even mainstream might have an interest in this now. [00:30:42] It does seem like there's a renewed interest in this subject. [00:30:46] I think, in the wake of Tumblr Ridge in particular, but that's not what this is about. [00:30:50] This is about ending. [00:30:52] Childhood transition. [00:30:53] And also, we had a win recently on the 4th of April. [00:30:58] The Finnish published a study that should be the final nail in the coffin. [00:31:01] Everything they've been telling us about these gender affirming care is absolutely a lie. [00:31:06] They are much worse off in terms of psychiatric morbidities. [00:31:11] It goes from like 9.8% to over 60% in boys transitioning to females, for example. [00:31:17] So they're six times worse off after transition. [00:31:20] Totally flies in the face of everything they've been saying to market these procedures to kids. [00:31:24] And so we had that win. [00:31:26] And we also had a National Post article there where one of the doctors at CHEO, one of the people who have been doing this to children for years now, have come out and said, you know, we probably shouldn't be doing this. [00:31:39] We need to review these policies and practices. [00:31:42] So it seems like there is a bit of a build in terms of the momentum on this issue. === Psychiatric Morbidities Data (11:11) === [00:31:46] And now would be a great time to capitalize on it.
