	We got Melinda on the line with us right now.
	And Melinda has five children.
	And these five children have been taken away from her.
	And again, there's two sides to every story, and then there's the truth.
	And Melinda, I want you to tell us your side of this story on why the government, CPS or DHS, whatever alphabet super organization has taken away your children.
	Tell us what actually happened from your eyes.
	Well, they took away my two older children because they have behavioral health problems, mental health.
	And their termination was to get them longer-term treatment that we couldn't offer.
	So they told us that we had an option of either giving them temporary custody of the two older children or giving them custody of the three babies.
	So we chose to give them the two older children, and they did let us place them in resource families.
	And then they said that the other babies would be fine.
	So a week went by.
	We had no contact, no messages, no nothing.
	And we documented everything.
	We sent the messages, even went to the office to get a petition on the known facts about the next step for my two older children.
	And we had to get the police involved to get this petition.
	Hold on, Melinda, real quick.
	Are you driving right now?
	Yes.
	Is there any way you can pull over?
	Because I don't want you to be looking down at me and you have an accident.
	Is there any way you can pull over?
	I'm not driving.
	My caretaker is driving.
	Okay, perfect.
	Keep going.
	I'm sorry.
	I just don't want you to be driving.
	Okay, keep going.
	No, you're good.
	And so what happened was they asked me to come down to the office of CYFD and they would give me this petition.
	So I went with witnesses.
	And they would not give it to me.
	She told me that I needed to leave the office, that they don't have it, that it's not done.
	And I said, well, I have in messages that you guys told me to come down to serve me the petition.
	So we had to call the police because she threatened to call them.
	So we waited and the cops came.
	Finally, we got the petition.
	And then a week went by and we didn't hear from them.
	We asked them, what are we going to do next?
	What's the next step?
	So on Friday, April 25th, It was me and my two caretakers for my children, Bryce Austin and Luz Agueta.
	And they are both New Mexico certified caretakers of the state.
	And the police came.
	It was Detective Perez and Deputy Turner.
	And there were seven CPS workers that showed up at my house.
	And they did not contact us at all.
	A whole week went by with no nothing.
	And they came knocking on my door, and I do have a gated door, and then I have a keyless entry door.
	You cannot get in or out without a key.
	So they demanded to come inside, that we had to let them in, and we told them, we don't have to open the door.
	You have a warrant.
	And they said they don't need a warrant.
	They're coming to take the kids.
	So we refused.
	We told them, we don't have to.
	It's our right.
	We don't have to let you in.
	There's no warrant.
	So we went with the children and sat into the hallway.
	And then they left, and they came back with the housing director of my public housing.
	And they told her that there was an emergency in my home, and that's why they needed her to let them in.
	So she then unlocked my gate to my apartment, and she walked away.
	And Detective Perez and Deputy Turner then entered my house unlawfully.
	They pushed my door down.
	And they all came in at once.
	And he was demanding, yelling at us, telling us that we all needed to sit down and we needed to give them the kids willingly or we were going to get arrested for interfering.
	And my caretakers, me, we all told them we need to see a warrant.
	We don't have to release the children.
	And they just said, we don't have to have a warrant.
	And we said, okay, well, then where's the court order of removal to remove these children?
	What is the reason upon removal?
	And they just kept saying that it was fleeing because...
	So we're very well known in that state.
	And they told us that that's where we're going to flee to.
	So I then said, you know, we've been here for two years.
	You know, we have not left the state.
	We haven't gone anywhere.
	We've been in the same place for two years, and we're still here.
	So at that point, he said that he doesn't have a court order removal, that he has a right as a police officer to take the children and give them to CYFD.
	So at that point, I was sitting with my children and they're freaking out because they don't know what's going on.
	You know, they're crying.
	I'm trying to console them.
	And the officer is yelling in my face, telling me that I need to get up.
	And my two options are to bring my children outside and give them my children willingly.
	Or they're going to forcibly remove my children by force from my house.
	And my caretakers have stepped in to also offer to take my children.
	I offered to leave my house so they would leave my children there.
	They did not advise by it.
	They told us to shut up and work with them.
	So what I did was I thought about my kids and I walked them to the door.
	I got to my gated door, didn't even get out of my house, and three To four CPS workers came and ripped my children by arms, legs.
	My two-year-old baby was clinging around my neck to the point where she was digging in my neck, and my two toddlers were clinging to my legs, and these people ripped them by arms and legs by force.
	And they put them in the cars, and they separated them at that point.
	We didn't hear from them from April 25th to April 30th.
	We do not know where the children were placed.
	We don't know what happened.
	They would not answer us.
	We've messaged them numerous times.
	I've had so much family and friends want to take my babies.
	They will not allow me to place my babies anywhere.
	So, on April 30th, we went in for a visit with my children.
	And my baby, my two-year-old baby, was unconsolable.
	She couldn't even control her emotions.
	She was very sad and distraught.
	And my five-year-old had a burn on her arm.
	It was the size of a tennis ball.
	And we asked her what happened, and she told us that it was the foster mom that was being mean to her.
	CPS then came in and told us that we needed to stop questioning about the case or they were going to remove the visit.
	And my daughter, Harper, she was not really understanding what was going on, so she kind of still didn't really understand it.
	She's only four.
	And my daughter, Gabby.
	At that time, she was not being taken care of in foster care.
	They did not do her hair.
	She did not have a shower.
	She had dirty clothes on, and she was scared.
	She kept questioning herself, Mommy, what happened?
	Why can't I go home?
	Why are they being mean?
	It's my fault, and I don't understand, and I can't explain it to them.
	CYFD said if I do, if I talk about it, they were going to take my visit away.
	So I was just trying to console the kids, and if the kids continue to cry for five minutes, the visit ends.
	So, at that time, we ended the visit and I documented the burn.
	I took pictures.
	I messaged them.
	I messaged the caseworker.
	I said, look, this is what I saw.
	This is the documentation I got.
	I said, what is our next step?
	What are we going to do?
	Because the placement that you got my daughter in is not okay.
	And they will not tell me where my daughter is placed.
	So, she told me that I cannot dictate this case.
	I have no rights to my children.
	That they are under CYFD custody and it's their choice where they're placed.
	And I said, well, I have family and friends that want to take them, and they said the only ones that can take them are blood relatives.
	Well, we have a lot of blood relatives here in New York and Georgia.
	Everybody has reached out.
	Even my old caseworkers from New York have reached out to take my children, and they will not allow it.
	So from April 30th, we went to May 8th.
	On May 8th, we went to court and it took And I then started, between those weeks, I started getting phone calls and text messages from teachers from my daughter's school, Gabriella's school, my five-year-old.
	And they told me, Gabriella's having a really hard time, Melinda.
	She's struggling.
	She's crying.
	She's running out of the classroom.
	She keeps asking for you, and we don't know what to do.
	And CPS is not listening.
	So I told them to make sure they document everything, and they confronted the state about it.
	I confronted the state about it, and on April 7th, they took my daughter and my other daughter out of school, out of medical.
	They have not been seen by medical since they've been in care with them.
	They have not been getting their mental health because my 5-year-old is on ADHD medication.
	She is not on it.
	I did get documentation to prove that.
	What else?
	And then we went in on May 8th to court for a hearing.
	It was a temporary hearing to see what's going to happen.
	I tried to bring my caretaker in because she was a witness upon when they removed my children.
	They said nobody can go in the courtroom besides me.
	It was an open court, mind you.
	So we went in.
	It was fine.
	They never served me this petition.
	They never served my attorney.
	And they never filed an ex parte order.
	So when I went into court, the judge said that she was dismissing this case.
	And then they brought up drugs.
	Melinda's on drugs.
	Melinda's not complying.
	There's child abuse going on.
	And they just threw everything out at once.
	And the judge said, if you have more concerns, then you may contact and make another petition.
	So then we left the court.
	It was like 9 o 'clock.
	I want to say 9, 9.30 in the morning.
	I texted CY.
	Stop, stop, stop, stop, stop, stop, stop.
	So you're saying, Yes.
	Then the kids should have been gifted back to you, correct?
	Correct.
	The kids should have been returned.
	Yes.
	Okay, so then move forward.
	9 o 'clock at night.
	So at 9 o 'clock, they should have been returned to me by 9.30 when we got out of court.
	So I texted CYFD in documentation stating I need to know where my children are because now you're kidnapping.
	You have no custody of my children.
	The custody was returned to me when this...
	They said, no, we're going to get custody back because we're putting in another petition.
	We don't have to release the children.
	So, at this point, I was like, okay, well, we're going to call the cops.
	We're going to call everybody.
	I called everybody in on this to try and get help because I'm like, I don't know what to do.
	I don't know where my children are.
	I only know where two children are.
	But my three babies, I don't know.
	So at that point...
	Melinda, how old are your babies?
	My baby is two, and my next one is four, and then five.
	Okay, so you don't know where these three children are.
	Keep going.
	I do not know where they are.
	I don't.
	And then, so we ended up going and getting, I ended up hiring an advocate.
	And I fired the public defender because...
	I couldn't talk.
	I couldn't say anything, that I needed to be quiet, that it was in the best interest.
	But I knew I had enough, that what they're doing is wrong.
	So I fired him.
	And I reached out.
	I called them.
	Stop real quick.
	Okay, again, what people need to comprehend is that when you take on an attorney, you're a ward of state yourself, because you're basically saying that you're an adolescent.
	You don't know how to talk legalese, and you can't say anything in court, okay?
	And the bar attorney works for the Crown, okay?
	He does not work for you.
	So the last thing, again, I'm not a lawyer.
	I would never practice law, but you don't ever want to bring on an attorney in any form or fashion, okay?
	This is why it's so important for you guys to tune in every Wednesday night to our call that we have on Spaces to help educate you how to be your own lawyer.
	Okay?
	To understand how to be pro se and how to go in and utilize your mouth to go and challenge their jurisdiction and to challenge all these things because once you go in with an attorney, you are basically a ward of state and they own you.
	And that bar attorney is not going to do your best interest.
	They're going to tell you to sit down, shut the hell up, which is what they did to her.
	Okay?
	And that's what they'll do to anybody.
	So keep going.
	So once I told them that I was representing myself, they stated that I can't do that, that I have no right, that I should hire the public defender back.
	And I was like, no, I'm representing myself, and that's all I need.
	I know what's right, and I know what's wrong.
	So at this point, they're still fighting until this day for me not to represent myself.
	But I've made sure that all my documentation and everything is done.
	We've got multiple copies, so...
	But hold on, it's not.
	I thought you had custody because the judge...
	I did have temporary custody.
	They returned the custody once they dismissed the case, but nobody would help us.
	We contacted law enforcement, we contacted And so what happened was is they said that the police issued a 72-hour hold to CYFD to get another petition intact for my children.
	So at this point, I still was not served this court order supposedly that the cops gave them that either, to make that clear.
	So we then went in and did the motion to regain custody and explained to them that they would not release the whereabouts of my children.
	We don't know what's going on.
	And then on May 9th, they actually decided to give me a visit with my children.
	All five of my children.
	This is the first visit from when my children have been removed that they've seen each other.
	So from April 17th to April...
	And it was only an hour visit.
	One time a week.
	So this will be the second visit that I had.
	And when I went in, my kids were pretty messed up.
	I mean, they were crying excessively.
	They didn't know what was going on.
	They were questioning each other where they were, what happened.
	And I went in and I noticed that my four-year-old, Harper.
	She has never been on medication.
	Does not have any mental health illnesses.
	She's never been on medication for that.
	When I went in, my daughter looked like she was...
	They were huge.
	She could not function.
	She looked allergic.
	She was present in the visit, but she wasn't really understanding what was going on.
	She was out of it.
	So I took pictures.
	I documented in my journal.
	We went on to my baby.
	She looked a little bit better.
	They were kind of, you know, she doesn't really understand what's going on.
	You know, she just wanted to sit with me the whole time.
	My older daughter, she just wants to come home.
	She's tired of being away from home.
	She just wants her family back.
	My son, he is placed with my dad, you know, so he's content.
	I know that he's being taken care of, and I can talk to him all the time.
	They have not taken that from me.
	But they have for my other children.
	I have no phone contact, no nothing.
	I'm only supposed to get one hour a week visit.
	And I've only gotten two since April 25th when they removed my babies.
	And my daughter Gabby, the one that I noticed the burn from April 30th, she was sitting on the floor and she looked scared.
	She was kind of rocking back and forth and I asked her, what was wrong, Gabby?
	What's wrong?
	And she said, Mommy, I had an accident.
	She says, I'm scared.
	Please don't tell them.
	And I'm like, Gabby, what do you mean don't tell them?
	It's okay to have an accident.
	It's okay, you know.
	Let's go to the bathroom and let's get changed.
	So we then went to the bathroom.
	And when I got in the bathroom, I noticed, because in the room that they have us in, it's very dark.
	And it's all in glass.
	It's all glassed in so they can watch us.
	And the door is closed.
	So we went to the bathroom and I noticed that my Gabriela had handprint bruises on her face.
	Front, from side, both cheeks.
	And she had scratch marks.
	Bruises.
	She had scratches on her stomach.
	She had scratches and bruises on her leg.
	She also had a big bruise on her hand.
	And I did document it, and I did take pictures.
	And next I began to change Gabby.
	The CYFD brought us in clothes, and Gabby said that she was having burning while she was going to the bathroom.
	And I told her, okay, well, we'll talk to the caseworker and see what they say.
	So then Gabby laid down to get changed.
	And I noticed that my daughter, I don't know if she has a UTI or she's being sexually assaulted, but she has some internal stuff going on.
	It was inflamed, it was bulging out, and it was red.
	For a five-year-old, it's unacceptable.
	I'm sorry.
	And I asked my daughter what happened.
	And she began to tell me, she started out with, Mommy, my foster mom, that was it.
	That's as far as it got.
	CYFD came in that bathroom.
	And she told me that I needed to stop questioning my daughter about the case.
	That she doesn't know what she's talking about.
	It's just a UTI.
	Yeah, she kept saying that it was just a UTI.
	And I said, how do you know it's a UTI?
	Have you taken her to the doctors?
	Do you have documentation to prove that my daughter has been seen by a doctor?
	No, she does not.
	No, she has not been to a doctor.
	And I said, okay, well I want to talk to a supervisor.
	She said, no, you still have 30 minutes left of your visit.
	You need to finish your visit first.
	And I said, okay, that's fine.
	So I got Gabby dressed.
	We went back in the room.
	We continued the visit.
	30 minutes was left of the visit.
	Mom, when the visit ended, my baby, everybody said goodbye, and then I had my 2-year-old that was left for me.
	And CYFD is not in it for the families.
	They are in it for the money.
	Okay, because when my baby knew that I was leaving, She ran for my legs and grabbed on my legs and started crying excessively.
	So I went to go console her and pick her up like a parent would.
	And this CYFD lady ripped my daughter from my arms on video camera in this session.
	And she told me that my session is over, that I needed to leave.
	And I demanded I want a supervisor now.
	I want to talk to them.
	They had five caseworkers in that office during my visitation.
	And so what happened was, is they told me that I need to leave, that my visit was over.
	That I didn't have time to talk to a supervisor.
	So I controlled myself, and I walked out.
	Because I knew what they wanted me to do, but I didn't give it to them.
	I went in my car, and I stayed in that parking lot, and I called 911.
	And I told them the conditions of my daughter.
	Show them the documentation, everything that I've seen, and what's going on.
	And they then went and spoke to CYFD.
	They took my statement.
	I did get a copy of my statement so I can have her my records too.
	Like I said, document everything because that's all you got.
	And I demanded that I wanted my daughter seen.
	I want her evaluated.
	Take her to the hospital.
	I don't even have to go.
	I just want to know that she's being taken care of.
	So at that point, um...
	The cops told me, oh, we're going to go get her checked out.
	We're going to make sure that they bring her to the hospital.
	So once the children are in CYFD custody, they tell you you don't have rights, but you do.
	You do have medical, and you also have school rights.
	So I went around, and I called all the hospitals, and I went in person to get this documentation that my daughter was seeing.
	And I went all the way to where, 20 to 30 miles out of where I live, in Artesia.
	Okay?
	They did not have any documentation about my daughter being seen or nothing.
	So, on Monday, because I also let the caseworker know what was going on, I said, look, all I want is documentation.
	I just want you to bring her to get checked.
	That's all I care about.
	And get her out of that home because she's not safe.
	So I contact.
	I didn't get any answer.
	Nothing.
	So then I contacted the CYFT hotline, the grievance, the state police.
	The governor of New Mexico, the Advocacy Center, I have, even down to the FBI, I have reported this to.
	Nobody wants to listen.
	I've even asked to get the body cam reviewed.
	They won't even let me review the body cam.
	They won't even let my advocate review it.
	Nobody.
	They didn't even file an incident report when they took my children.
	There is no incident report.
	So, at this point, it became Monday.
	And I got a text message on my phone that they took Gabriella to a Carlsbad Medical Clinic to get checked over.
	So I then called and I went in to get documentation.
	All they did was a physical.

	And also, you are not allowed to go to this graduation for your daughter because we feel like it's not in the best interest of your daughter.
	Them stating that my daughter doesn't want to see me.
	That's what they threw out me next.
	That my daughter doesn't want to see me.
	That she doesn't want to be around me.
	She doesn't want to have any visits with me.
	And I then stated, I have it in recording, that my daughter told my aunt she wanted me to be present during that graduation.
	And she said, well, we already told the school that you're not allowed to go.
	If you do go and you violate our request, You will be arrested.
	Request.
	Again, the request.
	That is a request.
	It's not an order.
	It is not a law.
	There's not an order.
	There's not an order.
	Because I then ask them, where is the order stating that I cannot be allowed around my children?
	Where is that order?
	Melinda, let's go back to where the judge dismissed the case.
	So now they've had their 72 hours.
	So where are we at on that whole thing?
	Because the case has been dismissed.
	There's still no petition.
	They still haven't served me.
	They emailed me a petition.
	But mind you, in order to understand it, they're trying to treat this as two cases.
	The two oldest were taken first, then the three babies a week later, and then they still try to intertwine everything.
	Yeah, they're still trying to intertwine both cases.
	So they're trying to throw everything that's going on with my older children in with my babies.
	Anything that's going on with the babies, they're trying to throw in with the older ones.
	And they're not supposed to intertwine them.
	They're two separate cases.
	Okay, so now you're telling me that the other older children, one is in custody of your aunt, correct?
	Yes, well, my best friend's mom.
	And then the other one is where?
	With my dad.
	It's his grandpa.
	Okay, so are you able to talk to those children?
	So, um, Olivia, no.
	And I'm not really supposed to talk to my son either because they did tell my dad I'm not allowed to have any contact with my children.
	Because they're saying that they're acting out if my children talk to me.
	Because they're poisoning them.
	They're making you hate them.
	They hate you.
	Now, the statement from my daughter, my 10-year-old daughter, stated that CYFD told her that her mom does not love her and does not want to see her.
	That was stated from my 10-year-old guard.

	Because you said they're going to have a hearing tomorrow that I think I'm supposed to attend, that you're getting an affidavit for me to be able to be there, to be able to listen to all this.

	So I filed the petition on Thursday, and they denied me my visit Thursday because they were going to let me have a visit with my babies, supposedly, on Thursday, give me an extra visit.
	So they then found out that I filed a petition in Carlsbad Court somehow.
	They knew what time I left, and they said that I'm not allowed to get a visit with the children.
	So then Friday came around, and I was supposed to get the visit with the five children, and they canceled that, too, saying that the children were transferred to a different placement.
	And I said, oh yeah, on what placement?
	Where?
	Where are my children being placed?
	And I ask them every single day.
	Still nothing.
	When am I getting a visit with my kids?
	Now they're saying that they might give me a visit this week, but it will only be on video visit for my three babies.
	But my two olders, I can see in person.
	So why is that?
	Before we close this out, what is the court hearing for tomorrow?
	The court hearing is for the custody of the babies.
	They're trying to get full custody, permanent placement for my children, and I'm fighting it saying that they're not.
