Uh Tyler Robinson, the accused in the assassination of Charlie Kirk is now he's in jail.
He's having a virtual hearing.
Let's go to it live.

I'm Judge Graf.
Mr. Scortis.
Good afternoon, Your Honor.
You're probably already aware of my presence for why I'm here, but if not, I am not entering appearance.
I'm not counsel on this case.
I'm working with the county to get counsel uh assigned, but we need you to allow for allow for the appointment of counsel.
Thank you, Mr. Scortis.
Uh it is well, I want to go through the uh uh qualifications for indigency, but that is my intent, Mr. Scortis.
Very well.
And I thank you for being here.
So, Mr. Robinson, you have a right to an attorney.
If you cannot afford one, the court can appoint an attorney to represent you.
I have reviewed your declaration of financial status and find that you are indigent.
I'm provisionally provisionally appointing a rule A qualified attorney to represent you on your case, Mr. Robinson.
Along with their filing of their appearance of counsel, the assigned attorneys must file declarations with the court that outline their qualifications under Rule 8 and Rule 8C.
I'm sorry, under Rule 8B and Rule 8C for counsel appointment in a case where death may be a sentencing option.
I'm ordering that those declarations be filed prior to the next hearing, which is set for September 29th at 10 a.m.
Uh, Mr. Robinson, I also wish to inform you of your rights against self-incrimination.
Anything that you say in court today could be used against you, and we want to protect your constitutional rights.

I do have a few points I'd like to bring up with the honor with your honor.
We have filed a pretrial protective order on behalf of Erica Kirk.
We would ask the court to review that.
It should be in your queue, Your Honor.
And sign that.

I have reviewed the pretrial protective order and will be grant issuing this pretrial protective order in favor of Erica Kirk.
Is there any other business that we need to address today, Counsel?
Just for the court's information, we did file just recently, within the last few minutes, a notice of intent to seek the death penalty that was filed by Utah County attorney Jeff Gray.
So that should be in the court's file.
Um lastly, I would just indicate uh to the court and to uh at this point, Mr. Robinson, that uh we are prepared to uh collect all of the discovery in this matter and get that turned over to the defense as soon as possible.
Rule 16 requires us to uh provide what we have relied on in charging the information and bringing these charges within five days uh once it's requested.
So that'll be prepared to disseminate to the defense as soon as possible.

Mr. Robinson, for count one, aggravated murder, a capital felony in violation of Utah Code annotated 76 5-202, in that on September 10th, 2025 in Utah County, the defendant, Tyler James Robinson, intentionally or knowingly caused the death of Charlie Kirk under the following circumstances.
The defendant knowingly created a great risk of death to another individual other than Charlie Kirk and the defendant.
Notice conviction of this offense may carry the death penalty for pursuant to Utah Code 763-207.7, a mandatory mandatory term of imprisonment for life without parole, or an indeterminate term of not less than 25 years,
that may be for life.14 sub two.
Tyler James Robinson intentionally selected Charlie Kirk because of Tyler James Robinson's belief or perception regarding Charlie Kirk's political expression.
Notice if the trier of fact finds beyond a reasonable doubt that the victim targeting enhancement applies, the sentencing judge or the board of pardons and parole shall consider the defendant's selection of the victim as an aggravating factor.
Violent offense committed in the presence of a child aggravating factor, the sentencing judge or the board of pardons and parole shall consider as an aggravating factor in their deliberations that the defendant committed a violent criminal offense in the presence of a child.
Count two, felony discharge of a firearm causing serious bodily injury, a first-degree felony in violation of Utah Code annotated 76-11-210 sub-2 and 3C, in that on September 10th,
2025 in Utah County, the defendant Tyler James Robinson discharged the firearm in the direction of Charlie Kirk, knowing or having reason to believe that Charlie Kirk may be endangered by the discharge of the firearm, and that the act caused serious bodily injury to Charlie Kirk.
Victim targeting enhancement in violation of Utah Code annotated 76-3-203.14 sub-2.
Tyler James Robinson intentionally selected Charlie Kirk because Tyler James Robinson's belief or perception regarding Charlie Kirk's political expression.
Notice if the trier fact finds beyond a reasonable doubt that the victim targeting enhancement applies, the sentencing judge or the board of pardons and parole shall consider the defendant's selection of the victim as an aggravating factor.

Count three, obstruction of justice, a second degree felony in violation of Utah Code annotated 76-8-306 sub-2, in that on September 10th, 2025 in Utah County, the defendant Tyler James Robinson with intent to hinder delay or prevent the investigation, apprehension, prosecution, conviction, or pursuant to any person regarding conduct that constitutes a criminal offense.
Conceal or remove the firearm used to shoot Charlie Kirk, and the conduct that constitutes an offense would be a capital felony or a first degree felony.
Count 4, obstruction of justice, a second degree felony in violation of Utah Code 76-8-306 sub-2.
In that honor about September 11th, 2025 in Utah County, the defendant, Tyler James Robinson, with an intent to hinder delay or prevent the investigation, apprehension, prosecution, conviction, or punishment of any person regarding conduct that conduct that constitutes a criminal offense,
destroyed, concealed, or removed the clothing he wore during the shooting, and the conduct that constitutes an offense would be a capital felony or first degree felony.
Count five, tampering with a witness, a third degree felony in violation of Utah Code annotated 76-8-508.
In that honor about September 10th, 2025 in Utah County, the defendant, Tyler James Robinson, believed that an official proceeding or investigation was pending or about to be instituted or intended to prevent an official proceeding or investigation,
and attempted to induce or otherwise cause his roommate to withhold testimony, information, a document, or an item to wit, directing his roommate to delete incriminating text messages.
Count six, tampering with a witness, a third-degree felony in violation of Utah Code annotated 76-8-508.
In that honor about September 11th, 2025 in Utah County, the defendant, Tyler James Robinson, believed that an official proceeding or investigation was pending or about to be instituted, or intended to prevent an official proceeding or investigation, and attempted to induce or otherwise cause his roommate to withhold testimony or information to wit, directing his roommate to stay silent if the police question the roommate.
Count seven, violent offense committed in the presence of a child, a class A misdemeanor in violation of Utah Code annotated 76-3-203.10 sub two and seventy-six-three-203.14 sub three A. Little double I. In that honor about September 10th,
2025 in Utah County, the defendant, Tyler James Robinson committed criminal homicide in the physical presence of a child younger than 14 years of age, with knowledge that a child was present and that may have been seen or heard the commission of crimin of the criminal homicide.

Tyler James Robinson intentionally selected Charlie Kirk because of Tyler James Robinson's belief or perception regarding Charlie Kirk's political expression.
That concludes reading the information.
Mr. Robinson, this case is set for September 29th at 10 a.m.
It will be a waiver hearing.
Uh, and I will be the judge assigned to this case.

He was in prison.
Uh sat quiet for the reading of the charges.
Aggravated murder, felony discharge of a firearm, obstruction of justice for discarding the firearm.
Same for discarding clothing, witness tampering for directing roommate to delete text, uh witness tampering for directing the roommate to stay silent, commission of a violent offense with children present.
The next hearing will be on the twenty-ninth.
Uh they did declare that the that Tyler Robinson is indigent, meaning an attorney will be appointed for him.
Uh anyway, joining us now, we have Brett Tolman is with us, former federal prosecutor, served as U.S. attorney for Utah.
Brett, welcome back, sir.

Great to be with you.
Pretty standard fair for the most part, right?
Yeah, it is.
Uh I I think there's you know, just a the outset, it's really apparent that you know he had a level of arrogance to him in his communications with others, especially with the roommate, you know, uh a statement that he didn't leave evidence at the scene except for the gun, which he needed to take care of.
There's just some some some some really unbelievable uh I I I would say it's naive, but it's not.
It's it's calculated and it's arrogant and and somewhat ignorant to, you know, w the devastation that he's caused.
Well, it is, and the judge Tony Graff in this case, you know, this is very standard fair.
I mean, laying out that he has the right not to incriminate himself, informed him of his rights.
He had the right to an attorney.
Uh they went over the fact that, and if you cannot afford one, one won't be provided for you.
Uh the word indigent was used.
I guess they're going to claim that as he is an adult.
They there would be no obligation for his family, whether they can afford it or not to provide an attorney for him.
And so the next uh I guess we'll find out more on the 29th.
Uh that will be done by WebEx as well.
It's not going to be done in person.
He will stay in custody.
There's no bail.
Um there was a protective order for Erica Kirk that was granted by the judge in this case.
The judge was clear that this is a death penalty uh case.
Uh and uh and then read the charges as he has the right to have done.
So pretty standard fair.
Uh, and by the way, for stations along the Sean Hannity Show Radio Network, uh, we're going to continue our coverage through to the bottom of the hour.

Um but um, you know, I think this is a pretty cut and dry case.
The evidence seems overwhelming, incontrovertible, and now it's a matter of how quickly justice will happen.
I think this is a good thing to see this.
I'm glad that they put it on camera.
I think the country needs to see it.
I think any copycat or potential copycats need to see it.
I need I think people need to know that there's going to be swift justice.
I go back to, you know, 33 hours.
It took five days to get the Boston bombers, five days to get Luigi Mangioni.
It took 17 years to get Ted Kacinski.
It took seven years to get uh Rudolph in the Centennial Bomber case.
So uh I think good policing, good FBI coordination, uh releasing the photos, being transparent about it, pay it off in my view.
Your thoughts.
It's absolutely right.
I've talked to law enforcement and FBI agents that are friends of mine in Utah, and they say that they haven't seen it, you know, the cooperation and the effectiveness come together in a case like they have this case.
Everyone working together, the FBI doing all the DNI the DNA evidence and and and really there's no territorialism, which is you know phenomenal.
They all have uh have a bit of a sanctity about what they're doing, recognizing the you know, sobering reality of a political assassination in their backyard, and they're working together, and I think we'll see that.
I know the prosecutors in this case.
Um they're experienced, uh one of whom I went to law school with, he's no nonsense.
He's gonna be very effective.
Um they're putting their A team on it, and I expect that uh, you know, as you indicated, there's no there's no lack of evidence in it, and it seems to be, you know, very tight, uh, the evidence that points to Tyler Robinson.
What I'm interested in, Sean, is the additional evidence that comes out that shows his competence.
There really only is a an insanity Plea out there to be concerned about, but if the evidence is sufficient to show, and I think it is that he knew right from wrong, then he's not going to be able to claim incompetence to get away with it.
Well, I think that was clear in the text messages when he's talking about, oh, my father's gonna be pissed.
Oh, he seemed to have a very keen understanding.
Uh my grandfather's uh looking for the weapon.
He uh seemed very lucid to me.
Um by the way, as a side note, MSDNC did not run this appearance in court, which I think speaks volumes about them.

How are you?
Hey, Sean.
First of all, I love your show, and I appreciate everything you do for us.
Thank you, but that's not a good way to disagree with me.
Doesn't sound like you're starting out well if I'm I'm just teasing.
That's okay.
You've made a comment of several times about how kids in college should basically go along to get along to get the grade they need to get out.
And I understand No, I said I said they have two choices.
If they make the choice, let's say your child wants to be a doctor or a lawyer, or go to uh you know, Wharton Business School, right?
Uh or the Ross Business School, very hard to get into.
And one bad grade would likely make the difference in your ability to get in or not to play the game, knowing that you're playing the game.
Uh I'm okay with it as long as they know what they're doing.
Or you can choose what I did to do in college, and that's I fought my professor.
It was it was half the in the semester.
I would say do that.
Because where does it end?
I mean, we just keep going along and killing these liberal college professors what they want to hear, then they see no problem with it, and they continue to do it and indoctrinate indoctrinate another generation, and it just doesn't stop.
And I I think you've said this a couple of times, and it I've taken pause, but it didn't affect me like it did till recently.
And after Charlie died for standing up for free speech and truth, I I can't get behind that.
I'm only saying if a kid is aware of what's happening, if a kid knows he's gonna be punished for expressing a political view, and it's gonna get in the way of his life's dream.
It is and and he knows he's doing it consciously.
I don't have a problem because he's seeing the broader picture of his life.
Now, if you can fight, I argue fight, fight, fight.
As a matter of fact, stay on the line, Rachel.
Say hi to Tracy in Louisiana, who's a teacher who said is saying it's hard to push back against left-wing rhetoric in school.
Would you respond to Rachel Tracy?
Well, yeah, I mean, I have taught I have taught high school and um I'm now teaching elementary.
And it's one of those things.
I was in the teacher's lounge today, for instance, and you have to hold your tongue.
Like I was raised, you know, in a you don't if you have nothing to say, nice, you don't say anything at all.
I was raised in that kind of uh uh uh uh house, and that's what it was.
And so I'm sitting there in the teacher's lounge today, and they're talking.
And they're saying, Oh, like we have teachers, we have so many teachers nowadays that are from Pakistan that are from Palestine, that are from Egypt, where they're from all over the place, uh Nicaragua.
And there are other teachers who are saying, Oh, nope, Trump's gonna get rid of you.
Trump's getting rid of you.
And I like Yeah, I mean, and it it's hard because you know, Rachel, the thing is is it is so competitive to get into these elite schools and the best medical schools, the best law schools, the best graduate schools, the best business schools.
One bad grade can make all the difference.
They don't want they're gonna look at a grade point average, and and if you get a uh a a C minus because the professor hates your political views, that your dream goes out the window.
And meanwhile, I don't think any professor has the right to do it, and you can't stop it.
You're not gonna be able to single-handedly stop the system.
I'll give you the last word.
Well, you can't single-handedly stop it, but if we encourage these kids, I mean, this is a generation that we have said you are more conservative than any other generation in 50 years.
This is a generation that is rising up, especially after Charlie was murdered.
And I just think it's very confusing and conflicting messages to say to them on one hand, stand up for what you believe in, but in this other case, just power.
I just would hate to see their dream shattered by one liberal professor, and they have the power to do that.
But you make a great point.

Now we have Jeff Gray, who is the Utah County District Attorney, uh announcing earlier today that in fact in Utah they will be seeking the death penalty.
And he laid out the charges, also indicating that, yeah, Charlie Kirk, as we know, was targeted because of his politics.
The evidence seems pretty overwhelming and incontrovertible.
I don't think this is going to be a hard case.
Um anyway, let's get to our busy phones.
He'll be on TV with us tonight, and we'll go through the charging document with him.
Uh, let us say hi to Howard and San Clemente out in the United Socialist Utopia of Gavin Newsom in California.
Hi.
Hi, Sean.
And that was a hell of an introduction.
I want to uh first thank you for taking my call, and I wanted to uh talk to you about a way in which I think we can honor Charlie Kirk.
And uh the bottom line is that I think we need a bipartisan bill.
You talked earlier about the difference between free speech and hate speech.
Pam Bondi talked about that today.
And I think we gotta look at our leaders who have really started the you know the hate speech like you said ten years ago.
And it's not acceptable to use the term Hitler and racist and communist and a threat to democracy, because that just incentivizes and encourages the left, people that are looking in these chat rooms, okay, for ways in which they can make a name for themselves.
And I think no different than Lincoln Riley, we honored her with a bill.
And I think if we got, for example, Burgess Owens from Utah and John Fetterman from Pennsylvania to sponsor a bipartisan bill.
I understand the difference between free speech and hate speech, but we have to get our leaders who have sworn a code of ethics and morality, And our leaders in Washington work for us.
And we can't accept them without without consequences, without accountability.
They need to take responsibility for their actions.
They're not gonna I I I wish I I I can't be Polly Anish and I can't I can't be this audience.
If you're asking me if I think the radical left is gonna adapt and change and have introspection and self-reflection and change course, I don't believe they will.
Sean and I hear what you're saying but I think if there was a bill to really delineate Okay, the hate speech, like I said, racist, communist, fascist, threat to democracy.
And if they use those terms, no different than in in you know, in the public domain, you can't allude to a female or a male's body parts in a vulgar manner.
Because there would be choice, those are choices if they made them and consequences should they do them.
And I think I hate to disagree with you.
I understand your intent is pure.
I really do.
But then we have a very sip slippery slope, don't we?
What kind of slippery slope are we on next?
All right, well, you can't say this word, you can't say this word, you can't say this word, you can't say that word.
The next thing they'll be telling us is, you know, we can't criticize transgenderism.
You know, we did a uh segment, there was a New York Post article about how people in Great Britain are being prosecuted because of quote hate speech.
I believe in freedom of speech as much as I find it repulsive and offensive.
Uh uh because I I will tell you at the end of that road, I promise you, conservatives are gonna be the ones that bear the brunt of this more than the left.
They will argue, I I really believe they've convinced themselves that we are fascist and racist and a threat to democracy.
You know, Charlie they they said this about Charlie.
Charlie helped many minority young people be a part of his organization.
He's a misogynist.
Uh why?
Because he believes in traditional marriage and that men should open door for doors for women and and and pay for a date uh and and and go to church.
I mean, it's just insane.
So I just think unfortunately with free speech is you know, like with everything in life, there's an upside and a downside, and I just think if you let these people talk, they are showing the American people where they're coming from how void of real ideas they have they are.
I think we have to win hearts and minds and win elections and put the right people in office that and let their voices dominate.
This is why elections matter.
You know, pretty soon, you know, come January of next year, I'm gonna come on this program and I'm gonna predict to you that ha what the Democrats are gonna run on, and then I'm gonna urge all of you, and I will repeat myself like monoclonal antibodies, and then nobody three months, four months later knew what I was saying.
Because by the time election day comes around, you will know everybody that listens to this program.
If you don't listen three hours a day, I'm very angry about that.
But if you you know only get to listen, you know, occasionally, you are going to hear me lay out the case of what is at stake for this country.
And I'm going to repeat it.
And then this way my hope is by the time election day comes, all of you can repeat it to your friends, your family, your neighbors, your co-workers, anybody that you run into in life, because this is gonna be a very, very pivotal midterm election year.
We have to defy historical trends to maintain control in the House and Senate.
If we do not, the stakes couldn't be higher.
We know what they're gonna do.
They're going to impeach Donald Trump again and again and again, and they will stifle and stop his agenda at every turn just because they hate him that much.
So we're either going to have two more great years of President Trump guiding this nation, or we're going to have, you know, two years of nonstop rage and hatred and and Trump derangement syndrome.
Sean, I agree with 99% of what you just said, but I look at it and say, you know, what's you have that snake there.
And in order to, you know, stop the snake, you gotta cut off the head of the snake.
And the head of the snake is the hate speech coming from the left.
So what do you do to stand up to it other than I understand?
You expose it.
You you expose it, you let people look anybody with a heart, a mind that can think, a conscience, a soul.
Here's this rhetoric, for example, post-assassination of Charlie, and they know hatred and rage and madness when they hear it.
The American people did figure out you had the entire legacy media mob, uh, the weaponization of our Department of Justice and deep state operatives.
You had everybody in the Democratic Party.
They closed out their arguments with, as I've been saying, racist, fascist, Nazi, Hitler Stalin, Mussolini.
And you had that echoed by the the legacy media.
America heard them, and America ignored them.
And Donald Trump won every swing state, and he won the popular vote.
So it look, it's still disturbing that such a large percentage of our fellow countrymen, you know, would vote for Kamala Harris, as far as I'm concerned, it would have been a disaster for the country.
Joe was a disaster.
But you know what?
I think legacy media died.
I think the Democratic Party is imploding before our very, very eyes and let them implode.
The American people, the end of the day, I put my faith in them.
I'm gonna move on, though, Howard.

What's going on?
So here's my take on this.
And I promise there's no violence in this whatsoever.
And I'm sitting here over the last few days, and I'm watching over, you know, what's going on and what happened.
And I'm reminded of something my dad used to tell me all the time when I was young.
He'd always say, don't get angry.
Right now we need to mourn.
We need to accept that what happened is sad and it's tragic, and we need to warn that anger is gonna take away from the morning.
And then he would say, Don't get even.
And I feel like if we sent this this kid to death, it's just getting even.
And it's gonna be too easy for him.
Death is too easy for him.
He deserves more than that.
And then you know You know, my understanding is probably Erica Kirk is gonna have an opportunity to weigh in on that decision.
And I'm I'm not gonna offer or give unsolicited advice.
I I I think she should just let the system play out on its own and probably stay out of that.
Well, absolutely.
And then I was just gonna finish with, you know, he'd always say, get ahead.
And the way to do that is Charlie was one person.
We need now to have a thousand Charlies out there going across the nation because they did this because they feared him.
He was taking away from their base.
That's why they did this.
They did this out of fear.
And now we need more.
Now we know what hurts them.
Now we know what gets them.
And we need we need more Charlie out there.
We need we need hundreds, thousands of Charlie's out there spreading his word.
Show them that Christ will always triumph over evil.
That's what we need to do.
Listen, you know, you overcome evil with good.
Um, but it doesn't mean that we're wallflowers either.
And I think that identifying, you know, how radicalized the left has become is a public service.
People need to understand where these people are coming from.
They're not coming from a very good place.
No, and I think, you know, a couple of your callers before we're 100% accurate.
I think a lot of this is it's evil.
It's coming out of CNN.
It's coming out of MSNBC.
And I understand freedom of speech.
But here's what I question, and maybe you can shed some light on this.
If I'm a bully and I'm bullying somebody online, and they take their life as a result of that bullying.
I can now be charged with that crime.
How does that play into freedom of speech versus what's going on?
Because first of all, calling him Hitler and a dictator and a king and all that, it's a joke.
Because if he was truly any of those, they wouldn't be on a national platform calling him Hitler a dictator.
You know, it may be rounded.
They're all over the place, doing I've got to run because of the constraints of time.
Um, but I can tell you that this is a real clear, you know, problem we have in society, and civil society needs to reject it.
And people of goodwill need to reject it.
And people need to understand.
I do believe there is a transition happening in the country away from the radicalism of the left.
I think people see it, you know, from supporting the right of men to play women's sports and open borders and putting the right so-called rights of illegals over the safety of American citizens and uh being against law and order and defund dismantle, no bail laws, reimagine the police insanity, you know, voting against the biggest tax cut in history.
All this is this is their legacy.
Anyway, my friend, appreciate it.
