Welcome both of you back to the program.
Yeah.
Well, first let's get your reaction to President Trump and his speech today.
I thought it was really, really powerful.
His tone, his pitch, his cadence, everything that the media wouldn't expect.
Uh didn't quite turn out the way they said.
And he said, I'm willing to put it all on the line, whatever it takes.
And I'm fighting for our constitution.
And I thought it was extremely powerful, Judge.
You know, Sean, I agree with you.
And it's amazing.
You could tell from the uh press release that the Biden administration uh had drafted it before they saw him, or maybe they drafted it after they saw former President Trump.
They said he was unhinged, he was hysterical, and all of the things that you and I and everyone who actually saw the press conference knew was not the case.
He was very modulated, he was very clear.
Look, uh, if they can do this to me, they can do it to anyone.
And in the end, he said, I'm fighting not just for myself, but for everyone else.
So uh it is uh the that an effort by the Democrats, just as they indicted him and convicted him on crimes that both Greg and I know are made of crimes about which we have no idea what he was ultimately convicted of in a non-unanimous uh verdict in terms of the elements of the crime.
I mean, the whole thing is crazy, but in the end, I think that the American instinct is that people will recognize that there is something inherently wrong before one president of the United States to be indicted and make no mistake that was number three from the Justice Department involved in a local prosecution, uh, you know, by the Democrats in an effort to literally interfere with the election.
Oh, it is amazing as you look at the news as it's developed since this.
Uh I could tell you, because I I had a conversation with President Trump.
I had more than one, and I could tell you not only is he not rattled, I mean, he's as dialed in and motivated as ever and unfazed by this uh to a level that would probably shock the average person, but that's he's not the average person.
We all know him personally.
Yeah, I I think you're right.
And um, you know, it may seem to some like a dark moment.
Um that moment will fade because when people uh cast their ballots, they're not going to be thinking about the opinion of twelve liberal New Yorkers.
No, they're thinking about when they go to the grocery store and they can't pay for groceries that they need, and you know, when they uh pull into a gas station and they they can't fill up the tank fully because they don't have the cash to pay for it.
Those are the things that they care about, you know.
I've always said, and uh it's not a unique statement, but people vote their wallets.
What affects them the most?
Crime in their neighborhoods when they don't feel safe, when they see millions of illegals getting preferential treatment, they're getting debit cards and free housing and free health care.
Um, and you know, Americans are struggling to put a roof over their heads and put food on the table for their kids.
Do they care that twelve people in New York who hate Trump or liberals made a decision that doesn't affect uh those voters personally?
No, they don't.
As I wrote in my column today, you know, Trump is not the loser.
Um our venerated legal system is.
And all Americans lost something precious because the failure of justice is a failure of the people.
This was a verdict that was preordained.
People know that.
They see Trump as a victim, not a villain.
But tragically, the ideals of a fair trial, impartial juries, that has now faded.
Uh ethical integrity, equal justice, the rule of law, those are the casualties of yesterday's wrongful decision.
And as I've been telling people uh since you know our coverage yesterday as we were taking this live on this radio program, Judge, is that uh the they will have the ultimate verdict.
The people that are listening to us now on what almost seven hundred and fifty stations around the country and and all over the place and all the other ways that people listen, and I'm just telling you right now, they will have the ultimate say here, and it's called voting, and it's called an election.
And you look at the amount of money that came flying into the Trump campaign yesterday, I mean, the the number of texts that I got in a single hour uh ninety minute period that extended well beyond my radio show into the night last night.
I I can't even begin to count them.
It was an my phone exploded.
Anyone that has my number pretty much wrote me, and there's not that many people that have it, but there was a more way more than I thought.
You know, Sean, there was something instinctively repulsive about what happened yesterday.
You know, people talk about the weaponization of the justice system and they talk about lawfare, but when it really happened, it was a gut punch because this case was riddled with a reversible error.
And I know this because I've been a judge like Marchon and I was a DA like Alvin Bragg.
I know the law in New York, and this jury, I want to make one thing clear.
The jury followed the judge's instructions, and the judge's instructions.
Oh, I I don't blame the jury at all, and I'm gonna tell you why.
There was so much that they did not know that they were not told things that they were allowed to hear that they never should have heard.
And and the judge, of course, you you said something really profound, Judge.
That you know, they bond with judges.
You are a judge yourself.
Yes, they do.
And you decide when they're gonna eat, what would you like to eat?
Are you guys tired?
Do you need a break?
Anything I could do for you.
Every in every jury verdict, the jurors would say to me, Judge, did we get it right?
Did we make the right decision?
They look to the judge because they're not even sure if what they did was right.
And you always say, of course, you're the jury.
But people don't uh the understand the relationship between the judge and the jury.
And as soon as Roshan was selected, the die was cast.
Yeah.
Did you ever did you ever fe have cases where you felt the jury got it wrong?
No, because I believe in the system.
I've given three decades to the system.
And you know what?
I still believe in the system because to not believe in it means that we've, you know, that that my life was was it wasn't worth the effort I put into my legal career.
But what we have now are thousands of DAs across the country who can make a decision that they're going to indict a politician, and no one can stop them from doing that.
And that is not what America is about.
Yeah, but but uh what you're not saying what I think some people might interpret it to be.
You're you're not saying that that the decision was right.
It was the decision based on only limited amount of information that they were given and false information that they were given and and false jury instructions that were given, and the fact that false statements were given in close and our closing arguments and a false novel legal theory.
I mean, they they base their decision based on what they heard or what they did not hear, and you can't fault them for not knowing absol not knowing the law.
That's not what they do for a living.
Right, exactly.
And I have no problem with what they did.
What brought what happened was this is not, as I started to say this is not lawfare, it's warfare.
And the American people in response in terms of the money that came into the uh Trump uh donation and the website crash and all that.
I mean, we're just beginning to see the reaction to this.
This is not what we're accustomed to in America.
And we have made it uh uh turned a corner, and the Biden administration has to be careful what they wish for, because they may have awakened a sleeping giant in terms of the majority of Americans.
Let's look forward, Greg Jarrett, and and let's think about okay, on July eleventh, there'll be sentencing four days before the the Republican convention, which is interesting timing wise.
Uh will the judge release Donald Trump on his own recognizance p pending appeal.
Uh will he uh I guess remand him the house arrest or remand him to prison, or what is he gonna do?
Well, this is the lowest level felony, uh, class E. Uh, a nonviolent crime, um, a defendant with no priors, um, no record, uh, given his age, given his position, uh, you know, as the leading candidate for president of the United States.
Well, he's not a flight risk.
He's got secret service around him, uh, you know, 24 7.
So I I think the routine here will be whatever sentence he imposes, and I don't think it should be uh jail.
I but whatever he imposes will be automatically stayed pending an appeal.
Uh that appeal process takes a very long time, and y so, yeah, he'll be at the convention.
Um the outrage if he were to lock him up would be deafening.
You agree with that, Judge?
Absolutely.
I think that's the worst thing they could possibly do.
And there's no question that this this trial was extended in an effort to keep Donald Trump off the campaign trail.
This was a six-week trial that would have taken two weeks if they had followed normal working hours.
I would have given that jury uh a note saying, bring your toothbrush in tomorrow morning because you're here for the rest of the the uh until you've reach a deliberation and a verdict.
But instead the judge gave him a week off in the middle of this.
I mean, that was crazy.
And the the idea was to keep him off the campaign trail.
But now, you know, Greg is right, it is a lowest level felony.
The max is a year and a third to four on each of the thirty-four counts.
They'll run concurrently.
But what the judge can do is the judge can actually say, I'm gonna give you house arrest.
I'm gonna give you a conditional discharge.
You're gonna have to clean the windows here.
You're gonna have to go on probation, respond to a probation officer every week.
You know, there's a million things that they can do to try to humiliate Donald Trump.
Whether or not that's gonna fly, I doubt it will, and Greg is right.
There will be an appellate uh uh the uh uh an appeal to an appellate court uh so that whatever the sentence is is stayed until the appeal is perfected.
And you know, Greg, one of the things today that that Mark uh Levin was talking about was taking it right to the Supreme Court.
I love Mark.
I hope he's right.
Uh, but in normal circumstances, the perfecting the appeal, taking it to the appellate division, getting both sides, it's that's gonna take months before they even get to a decision.
Yeah, I I agree, although one caveat, there is an avenue to go directly through the federal system uh based on federal constitutional due process violations.
You can do a couple of things, a writ of habeas corpus, or what's known as a common law writ.
Now, they are rarely accepted uh directly by the Supreme Court.
However, this is an exceptional case because of who the defendant is and the egregious violations of due process.
I mean, first of all, telling the jury that they don't have to agree unanimously on this mysterious second crime is you know, Sean put up on the screen the two important court cases, Ramos versus Louisiana and Andrus versus U.S. It's fundamental bedrock constitutional that all key issues must be unanimous.
And that would get the attention of the U.S. Supreme Court.
The other violation here is they never told Trump uh what this elevated secondary crime is.
That is a violation directly of the Sixth Amendment.
Every decis every defendant must be advised of the quote cause and nature of the accusations against him.

I I want to play all of Donald Trump's remarks.
We'll probably save that for the last hour of the program that he made earlier today, because I think he said a lot of things that Americans need to hear.

All right, we continue now with Judge Janine Piero.

Last quick question, it's yeah, you're next because you got to run.
Uh Judge, will they be able to to challenge Juan Mershawn and his handling in this case?
Are there any potential ramifications for him or Alvin Bragg, for example, according to Robert Costello withholding exculpatory evidence to the grand jury that was given to them before the indictment?
It's not gonna happen.
It's not gonna happen until the appeal goes through the process.
And I honestly, it's gonna take the New York Court of Appeals, and that will take over a year to get involved to deal with the issues of uh, you know, Brady and the denial or you know, to hand over refusal to hand over exculpatory material.
And you know what?
It's not just the Fifth Amendment.
Greg is right.
We've got the Sixth Amendment, we've got non-unanimous verdicts, we've got no way of knowing what the charge is.
And the crazy part of this, and I don't care if you pump gas for a living or if you shovel, you know, snow.
Uh for you not to be able to defend yourself, but know what you're defending yourself against is just on American.
I know you have to go uh and I will see you on TV tonight.
Judge, uh, real quick answer.
We've got about 20 seconds, Greg.
Same question.
Yeah, I this is uh a case that has done great damage to our system of justice.
It's it's a failure of justice, as I said, a perversion that is so grotesque that I think most Americans realize now and many more to come that Trump is a victim.
He's not a villain in all of this.
And I think it only helps instead of hurts him.

Anyway joining us now Laura Trump is with us uh you know I don't know if the timing of this is exactly perfect but uh in light of President Trump and we're gonna play his speech from earlier today uh that he gave at Trump Tower is and she's just come out with a children's book called the Never Give Up Pup.
Well I think that might I don't know if your father in law is going to like me referring to him as a pup but but he certainly never gives up and that was very clear.
It's no this is a man who never gives up obviously we know that with Donald Trump and you've seen it time and time again after impeachment, indictments, mugshots now this this nonsense obviously everybody saw in downtown Manhattan yes and it's kind of amazing because when I decided to write a children's book I said listen I want to write a book for my kids and I think work ethic is something that we're really losing in our our next generation of Americans and um you look at someone like Donald Trump and
man what a work work ethic that guy has.
Think about the four years that he was in the White House Sean and although every day he had so much incoming look at all the things he actually accomplished for us largest tax cuts in American history the USMCA, you know a trade agreement with Mexico and Canada, trade agreements with China,
um peace agreement in the Middle East, the Abraham Accords, meetings with Kim Jong-un to denuclearize the Korean Peninsula, all these things were accomplished while he had so much coming at him and it's amazing because you can only accomplish things like that with a great work ethic and so that's something that Eric and I try to instill in our kids.
So when I decided to write this book it was actually about a year ago and the timing now that it is out with all that my father in law has had to endure and quite frankly all our country has had to endure um is sort of Kismet in some sort of way.
Yeah, I think you're right.
I don't know if he would like to be referred to as a pup, but it certainly is a lesson that he wants our children to learn here in America and that he demonstrates every day with just the way he lives his life.
And I think after what we saw yesterday, it's pretty clear listening to his speech today.
I'm glad you're going to play it again for your audience.
He has no intention of giving up.
In fact, I think it has only confirmed for him and probably for the rest of the country why November 5th is such a great deal.
such an important day why he must stay in this fight despite the fact that they are literally trying to do everything include throwing this man in jail to stop him.
Nothing could be more important right now.

You know he said it would this is very important.
It's far beyond me and this can't be allowed to happen to other presidents.
It should never be allowed to happen in the future but this is far beyond me.
This is bigger than Trump.
This is bigger than me.
This is bigger than my presidency and he goes on to explain that that he understands what the consequences will be and he understood it when he got back into the race.
He could have simply walked away from politics having been the president of the United States none of these legal issues would would be hanging over his head but he he did it anyway it's been at a a tremendous cost to him personally not just financially but every other way imaginable it's been a tremendous cost for you and your family.
If I I'll be honest I feel terrible for you and your entire family Eric and Don and uh and ever and everybody in between well thank you Shauna and I appreciate that and I think he said something that um that was spot on as well in in his speech earlier today which is that he's honored to do it and and to know what this man has gone through and the hell that they they put him through,
as you point out, our whole family, and honestly, anyone who's ever had an association with Donald Trump has been in their crosshairs.
It's incredible to to hear him say that because uh I I don't know how many people know this.
He talked to all of us as a family before he ever decided to run for president in 2015.
He knew even back then, Sean, what he was going to endure and and that they were gonna come after him if he did the right things for this country.
He w he literally said to all of us, look, I need you guys to understand this is bigger than than just me.
It's not just about me running for president.
This is going to involve our entire family, and if I do the things that are needed to be done for this country, then they're going to come after us.
They're going to come after me.
And I don't think any of us really understood that it would obviously get this bad and this crazy.
But he even back then knew that if you fight the machine, if you fight the swamp, if you go against the grain in Washington, DC, and you actually stand up for the people of this country, and you're not part of their little club, you could be in trouble, and they will come after you.
And knowing all of that and seeing what he he had to go through for four years, yes, he decided to give it another go.
And I think he knew even then, Sean, they'd come after him even more, and man have they, and it's a dark, sad day for this country, but I can't help but give this man immense credit, so much credit because he didn't have to do this.
He could have gone and and enjoyed the rest of a great life with his family and uh down at Mar-a-Lago and and really just had a a great time, but he said, you know, they could have traveled the world, they could have been to every one of his golf courses.
He didn't he didn't have to do this and and it's paid great.
Now I do have one question.
Did everybody sign on to it?
Well, we naively said, How bad could it possibly get I will tell you this, I will bring you inside.
I'd warned uh I I won't tell you who I warned in your family.
And I just said that whatever you think you've experienced that's been rough in the in your business world, it is it is nursery school compared to what you're walking into.
And I I remember uh very, very precisely what I said.
And I said, You gotta understand they will want to destroy him and get as much collateral damage as as possible.
Yep.
Ow.
I never I I wish I was wrong.
Uh I knew then I wouldn't be wrong, and unfortunately, I think I've been proven more right than I ever even thought at the time.
Yeah, and unfortunately, you were totally spot on.
Uh, but it's really it's a new low for America to see the the links they've gone at this point, and and I think people have very clearly understood that, and I gotta give the American public credit.
We are a very smart country, and they have tried to be deceptive with this, and they've tried to say, Oh, Donald Trump did something wrong.
People see what this is about.
They know there was no crime here.
They understand that this has all been about politics from the very beginning.
And you know that, Sean, because our donations went through the roof yesterday.
After this verdict came in, about half an hour later, our entire fundraising website crashed because so many people were attempting to no donate to Donald Trump and his campaign at the same time.
In the six hours after the verdict was read, we raised thirty-four million dollars and fifty thousand of those people who donated had never once donated to Donald Trump or his campaign before.
The people of this country are with him, they see through this, and we will fight like we are behind every step of the way, but I think the Democrats just nailed uh put the final nail in the coffin for themselves come November 5th.
I think people are our understanding that it is going to be a necessity for us to change the way we operate if we are going to win.
I mean, you cannot continue, Sean, to do the same thing over and over again and expect different results.
It's literally the definition of insanity.
And yet as Republicans, you're right, we've been very resistant to early voting, very resistant to to doing the same kind of things that the Democrats have been doing for years, and either we are playing the same game that they are playing, or we are going to have to accept defeat every single time.
And so at the RNC, our messaging and the messaging that you'll hear from Donald Trump if you ask him today is that we want you to go vote as early as you possibly can, and and in whatever way you can.
If that means the only way you can do it is mailing in your vote, mail in your vote.
But go vote early, and then we want you to take someone with you every single day, if you need to, multiple times a day, from that moment all the way up to election day to vote.
We have to make it too big to rig.
If we all wait until election day, we all know that life happens.
And I agree with you.
We want one day of voting.
We want voter ID.
We want paper ballots, and we can get back to that day.
But we have to play the hand that we are dealt right now.
And we know the system we have right now.
So let's win with that system, and then we get in there and change it.

Let me ask you very specifically, trained partisan observers.
I think they need to be in every single precinct, watch the vote, vote all day, the vote counting all night.
Uh you know, when early voting starts, make sure that eyes are on wherever they put those ballots.
I think they should have cameras on them everywhere.
And and the and the next thing is uh that that you know how how are you doing with trained partisan observers in every district?
How are you doing with legal ballot harvesting uh efforts, which Republicans really had never been involved in?
Yeah, well, we're doing amazing.
Actually, uh yesterday I was at the RNC and we specifically had meetings about this very topic, and we went over the key swing states and key districts within those swing states and how exactly what you're talking about.
Our election integrity program is is going.
The volunteers we have so far, the people we've trained so far.
Michael Watley, the chairman of the RNC and I are going to be announcing soon that the two of us are going to show up at some of these training sessions around the country.

If you want to be part of our election integrity team, this is an opportunity for you not just to stand 30 feet away and look from across the room as a poll watcher.
You can actually be trained as a poll worker now.
We want you, if you were an attorney out there, because we intend to have attorneys in every precinct across this country that matters, so that we can be able to strike in a moment's notice.
We cannot be reactive anymore.
We have to be proactive.
We can't wait weeks on end to call on something that we've seen go wrong.
We have to deal with it right there in that moment.
Again, protect the vote.com.

Sean, we have thousands of people that we already have underway with these trainings in the most important counties in the country and the most important districts in the country.
This is the way And they're not going to be able to put you a thousand feet away like they did in 2020.
No, if you are a poll worker, you see you actually work in that polling location, you handle the ballots, you can count how many many ballots are coming in, how many ballots are going out.
You can work in the tabulation centers where the mail-in ballots come in.
Think about the advantage that gives us with transparency to have something like that.
It is our number one focus at the R and C right now, election integrity.
If you come to that office, you will see that the bulk of the employees at the RNC right now are focused solely on this.
And you talk about legal ballot harvesting.
We have a huge opportunity right now.
The FEC just made a ruling about a month and a half ago that allows us now to coordinate more closely with soft money organizations with our grassroots partners all across this country.
We are going to be using that to our advantage.
We are going to make sure that we can coordinate with them in every legal way possible to legally ballot harvest, to make sure we're reaching low propensity voters, knocking on every door out there, getting everybody out to vote.
Because if you guys didn't notice America, look at what happened yesterday.
You cannot sit this election out.
Nothing could be more important.
We need everybody there.
So come election night on November 5th.
We know with 100% certainty that Donald Trump will become the 47th president.
Well, I will say, and I'll echo what your father-in-law said is that the ultimate verdict will be rendered on election night.
And by the way, that means the days before.

You find out uh when early voting starts, how to do it, how to vote by mail, uh, what your polling locations are.
All of that's available, and we're doing it as a public service to help people uh because it's uh the mindset has to change.
