But I want to bring on Matt Whitaker, who is former acting attorney general and author of Above the Law and host of the Liberty and Justice on iHeartRadio.
Because Matt's a lawyer, he's had a high cabinet position as acting attorney general.
So we could talk the law a little bit here.
I'll be the understudy.
And Matt, first of all, welcome.

Glad to be with you.
Matt, I want to pick your brain on a variety of subjects.
This situation involving Twitter, just in the last 24 hours, there was an FBI former counsel who wanted Trump off of Twitter because he made a comment like, hey, keep living your life as you are.
Don't let COVID stop you from living.
What you have seen the last three or four weeks with Twitter gate and the files.
Can you give an assessment from a legal perspective of the relationship between the FBI and Twitter and what type of harm that has done to the average American?
Yeah, well, it's been extraordinary.
And I think, you know, the first two comments and thoughts I have is one is the government was using a private company to suppress Americans' First Amendment rights.
And the second more concerning thing is we've only just seen Twitter.
Can you imagine what they were doing with Facebook, with YouTube, and all of the other social platforms that the government was completely infiltrating social media and using those relationships to suppress Americans' right to free speech?
I just think it's if they had done the same thing in the public square, like and you saw it play out before your eyes, I think most Americans would be outraged.
And I'm surprised that they're not outraged as much as I would expect based on what the government was doing through Twitter and I'm sure these other social media platforms.
Talking to Matt Whitaker, former acting attorney general, I'm going to go to your two points.
Matt, this is what we're seeing from Twitter.
So just I'll ask you for a hypothetical.
You're the attorney for Americans and we learned about Twitter.
How do we find out or is it impossible to find out what was going on at Google, Facebook, and these other social media platforms?
Are we just fortunate to learn about Twitter because Musk purchased it and we're not going to find out what was going on between the government and these other social media agencies?
Well, and this is what's going to be the benefit of having Congressman Comer and Congressman Jordan as running these committees is that they can now ask, based on what we see with Twitter and the pattern, they can now ask these social media companies for, through subpoena, for those records.
And I think we're going to get a much broader picture as to how this speech suppression operation was working during Joe Biden's first two years.
Talking to Matt Whitaker, he's the author of the book Above the Law and host of Liberty and Justice on iHeartRadio.
Encourage all of you to listen.
So do you anticipate the House takes over, the House Republicans take over, Jim Jordan, they're going to be in charge?
What type of cooperation do you think they're going to get?
Because those subpoenas are going to be referred to the Department of Justice.
I mean, are they going to be stonewalled?
I mean, I just, I don't want to get my hopes up.
Americans get their hopes up, and then they're going to be stonewalled because they're battling the Department of Justice, which is under the Biden administration.
Well, that's a good point, Leo, and it's something that I'm probably watching closely more than any other issue, and that is when these subpoenas are issued, and if these ordinary citizens defy the subpoenas and are held in contempt by the Republican House, what will the Department of Justice do?
Will they treat it like they treated, for example, Steve Bannon's subpoena and prosecute, or will they ignore it?
And so I think that's going to be a really interesting thing.
And it's going to put Merrick Garland in the crosshairs of the law because ultimately the law is, if nothing else, blind.
We are told that it's the scales of justice and they balance out and that nobody's above the law.
And here we're going to see exactly how partisan this Department of Justice is because right now a lot of Americans think there's a two-tier system of justice.
And I've seen you talk about that a lot, Leo.
Yeah, I got my hand up.
I think there's a two-tier system.
In looking at the way Twitter, tweeted, treated conservatives and Republicans who were basically shadow banned, you have the flip side of this, the FBI working with Twitter and the Hunter Biden laptop.
Can you sort of give a perspective what you see might happen with the Hunter Biden laptop investigation with the new Republican House?
Yeah, well, unfortunately, you can't unring that bell.
If you remember, that story hit just a couple weeks before the election, and it was suppressed.
And the New York Post was de-platformed, shadow banned, all the things that we're talking about.
And, you know, that cannot be undone.
That effect that it had on the election cannot be undone, where people couldn't learn about how corrupt the Biden family was because that information was being suppressed.
But that being said, I think we're going to continue to learn more and more about how that was a coordinated effort led by DHS and the FBI trying to essentially put their thumb on the scale of an election.
Talking to Matt Whitaker, Matt, what's the end game for social media and their interplay with the government?
I mean, you hear all the time about Section 230.
They're going to put some more maybe possible restrictions.
Do you see anything changing from your perspective, given I don't know how much money has floated around Washington regarding to both parties regarding some type of reforms that would sort of keep some form of independency of the social media giants from government?
Or what do you see happening?
Yeah, Leo, I think what we've learned is we definitely need to reform the laws.
What was put in place at the dawn of the internet, no one expected that these tools would be used as both a shield and a sword.
So I think we do need some reform.
We also need competition.
be honest with you.
I think one of the main problems is that there's been this concentration among social media companies.
You see Facebook owning Instagram, YouTube and Google are the same company.
And you just have really a consolidation of the biggest platforms.
And then it's very easy for them to coordinate and suppress speech that they don't agree with.
And the scary thing is it's oftentimes political speech, which is the most protected type of speech in our country and always intended to be.
So, you know, that's the problem, Leo.
But I think ultimately it's going to take some, you know, some statesmen and stateswomen to come together on Capitol Hill and pass some smart legislation that allows the competition to flourish and to make sure that free speech is always canomile.

I'm going to pick your brain because you're a lawyer and you saw, I'm pretty sure, what happened the last 24, last hour.
The Supreme Court has decided to keep Title 42 in place given this crisis at the southern border.
We don't have a border at all.
How do you see that happening?
How do you see that working out?
And what did that benefit?
Well, I don't think it's going to be forever, but what I know is that the Supreme Court just saved Joe Biden from his own policy.
I mean, I've never seen anything where the Supreme Court wants to bail out a president, but I mean, they knew it was going to be a disaster, a catastrophic human, just misery and misfortune.
This administration isn't serious about protecting our border.
They're not serious about actually running an asylum program that gives legitimate asylum claims, permits them, but then screens other ones that are never going to have a chance to apply or receive asylum.
And so the system's broken.
Joe Biden broke it.
And I can't believe the Supreme Court bailed him out.
But I think Americans are better off, at least in the near term, because of that.
Last question on that subject.
Is there an end game for the Biden administration or do they just want the status quo to remain in place until the next election?
Yeah, this is a great question.
It's something that I keep asking people that were at DHS, in the Trump administration, especially.
And they keep coming back with it.
The obvious answer is that they want more illegal immigration.
They believe that, like birds, that people migrate, I guess, with the seasons.
And so they just don't feel that they can have the moral right to regulate that.
And it's insane because, you know, we are the most generous country in the world.
We admit over a million people a year legally.
And, you know, we need a system that serves our interests as a nation and not just whoever wants to come here and can pay these smugglers the most amount of money can come here.
I mean, it's just that we have to get control of this.
We have to stand, as you know, Leo, we have to stand for the rule of law.
Yes.
We have to stand for law and order because if we don't have the rule of law, we really, the American experiment has failed then.
And that's what you're seeing in the southern border, just a de-emphasis of the rule of law and not allowing people to jump in front of others in line to come into our country.
And it cannot be sustained.
But maybe we do have to have another national election in 2024 to put the right policies in place.

We've talked about the border and Twitter and this $1.7 trillion wasted spending.
But, you know, there's another issue related to crime, this homelessness.
And let me tell you why I want to bring this up.
There's a lie going on by the Democrats.
What else is new?
The Democrats like to lie.
And they lie about the homeless issue.
Just like they lied that there's still systemic racism.
I want to be clear.
Thank goodness I got time to say this.
There is no systemic racism in America.
There is no systemic racism in America.
I got to bring this up.
I'm a civil rights attorney.
I challenge anyone It's fine.
Systemic racism in America.
Does racism exist?
Yes, individuals.
But you're not going to find a government having a systemic racist policy.
That is a Democratic lie.
That's a lie.
Okay, you know, Chicago, systemically racist.
We got black people running the city or New York, systemic racism.
So when you hear that, that is a Democratic lie to have people fight against each other.
That's a big lie.
I challenge anyone in this country to show me a governmental agency that is systemically racist.
That went out 35 years ago.
It is a Democratic lie, but they use that lie to divide us for them to raise money.
That's a game they play.
And they're never going to give up the race card.
The Democratic Party will never give up the race card.
It is in their back pocket.
Here's another card they will never give up.
The homeless issue.
And I want you to hear this because you will not hear it in other places.
The homeless issue, we got in California.
You don't want to come here.
It's all over the place.
Homelessness under freeways, on the streets, in the parks.
The only time there's no homeless problem is if there's a Super Bowl.
They clean out the streets.
Or if we got a new mayor.
We have a new mayor in Los Angeles.
She's black and female.
That's all she wants you to know.
She's a black female.
First time we've ever had a black female mayor.
Homeless problem will never go away.
Why, Leo?
Because the Democrats raise money from the homeless issue.
Now, I want you to hear this.
Just like there's no systemic racism in America.
The homeless problem is not a homeless problem.
Yeah.
This one-size-fit-all is a lie.
The homeless problem is a crime problem.
It's a mental health problem.
It's some people who have some bad luck and some people who need a second chance.
Did you hear what I just said?
I broke it down.
I want to be very clear.
The homeless problem is not just a homeless problem.
It is a crime problem.
It is a mental health problem.
But the Democrats want you to believe that's just a homeless problem.
You know why?
The millions of dollars they raise, the taxes that they impose.
People are generous in this country.
And they don't want anyone on the streets.
Cold weather.
But the Democrats will never, ever, ever, ever, ever.
I want to make sure you hear this, ever solve the homeless problem because they don't want to.
Because they don't want to lose a talking point.
Just like the race car doesn't exist, but they'll keep lying about it.
They like it because they raise money and it's a form of power and control.
So we're going to talk more about this.

I want to give you some news that I broke earlier today on the show.
And the Supreme Court has kept Title 42 in place.
And I'll tell you right now, that's a life preserver for the Biden administration, which gives them a mechanism to keep certain people, illegals, out of the country.
Title 42 has been maintained by the Supreme Court.
That's really a sort of a legislative decision, but Joe Biden is in the Virgin Islands.
He probably doesn't even know about it.
But I want to make sure you're aware of it.
If you want to know what's going on in this country regarding the southern border, just turn on Fox News.
Turn on any program.
Just Google up Southern Border, and you'll see a disaster every day.
Thousands and thousands of people illegally crossing the border, drugs coming into this country illegally.
The cartels are making a fistload of dollars every day, and nothing's being done by the Democratic Party except lying to us.
Mayorkas, the White House press secretary, the vice president.
They're claiming that the border is secure.
Really?
Outright lying.
Let's take some phone calls.

I love watching you on the Hannity show at night when you're on there.
Hey, my comment is you're spot on about California.
I lived in California most of my life, and it got to be so crazy, it wasn't where I grew up anymore.
So we packed up and got out of there about three years ago and moved to Boise, Idaho.
The homeless, we lived in Palace Verdes and we were surrounded by homeless.
Yes.
And it's funny you called, Dennis, because for the first time in my life, I'm thinking about leaving California.
And you know what made me think about it?
I spent a week in Boise, Idaho.
It's day and night.
And it's just funny you said, oh, yeah.
I was there.
I'm not making this up.
It is amazing you call.
I didn't know what you were going to talk about, but it is shocking.
And the homeless problem is a problem that the Democrats love.
And I thank you very much for your call because I want to take as many calls as possible.
The homeless problem is something the Democrats want to keep in place.
And I want people to hear what I said.
The homeless problem is not just a homeless problem, it's a crime problem.
If I was mayor of Los Angeles or the governor, this is what I would do very quickly.
I would have a special 711 number.
I would bring, if you see homeless people living on the streets or under a freeway, I would bring a sanitation worker, a counselor, and law enforcement.
If there's criminal activity, they don't get any choices.
They're going to jail.
If they are seeking a place to live, we'll give them temporary housing outside of the city.
If they don't want to take the temporary housing, they can walk all night.
But the moment we catch them sleeping on the streets, we're taking them to jail.
The ACLU can sue me day and night, tie me up in court, but the streets will be clean.
That's if I was the governor.
That's if I was the mayor.
Homeless problem is a combination of a series of issues.
It is not just a homeless issue.
Let's take another phone call.

Listen, I'll tell you what the new house, and I'm going to have you hang up, and I'm going to have you listen to the answer.

That's a great question.
What can this new House Republican majority do to free those who are incarcerated for well over a year of January 6th?
Tell you what they could do.
They got the tremendous power.
Nothing can be passed by the Biden administration and the Democrats and the Rhino Mitch McConnell without the House.
They hold any additional funding hostage, hostage.
Oh, you want us to approve something?
Secure the border.
You want us to approve something?
Give these people who are incarcerated due process, the January 6th people.
Give us due process.
Let me tell you right now, that's a great question.
If the House Republicans give in to the Democrats in the Senate and to Joe Biden and to the Rhinos, that I have, I'm through with the House Republicans.
House Republicans, you better walk the walk and talk the talk.
You better be the stone wall to block this crazy, wacko Democratic administration plus the rhinos.
I'm telling you, they have the power of the purse.
Nothing could be passed without the House.

I was a correctional officer in Arizona for 11 years.
I was also a staff instructor.
Your comments about institutional racism are dead on.
It does not exist.
It's a ridiculous notion.
Yes, individual racism exists, and that's a sad reality.
But in the institutions that our government has set up, it does not exist.
Yeah, you're right.
You're absolutely right.
And I want you, and thank you for your call.
Let me respond to that.
Listen to my follow-up.
Vic, he's absolutely correct.
People, the Democrats, I've been a civil rights attorney for 30 years.
I'm a truth teller.
I'm never going to lie to you.
The one thing about being on the radio, people will call you out on the radio.
I have been a civil rights lawyer for 30 years.
I take second to no one on knowing the law.
I know what systemic racism is.
Systemic racism is when the government has a policy or a practice where they discriminate based on race, sex, gender.
It cannot happen any longer.
Did it happen in the 50s, in the 60s?
Yes.
Is it happening in 2022?
No.
But who do you hear calling that?
New York City.
You got a black mayor.
You got a black police chief.
Chicago.
Black mayor.
L.A.
The cities and the states that are yelling systemic racism are run by people of color.
I can't say anything.
I will debate anyone.
Show me the department.
Show me the white boogeyman.
Systemic racism does not exist.
It's old.
It's history.
Individuals, yes.
The government, name me a government right now.
You hear it all the time.
You hear Democrats, systemic racism, systemic racism, institutionalized racism.
You hear that on those liberal, liberal cable stations, liberal media news outlets?
They're lying to you.
You know why?
Because they want us to fight each other.
Critical race theory.
That's BS.
I'm a school teacher.
1619 project.
BS.
Lies.
But I'll tell you, the Democrats will never give up the race card.
Won't you understand?
I'm being truthful to you.
They'll never give up the homeless card.

It's power and control.

And they have now said, we can lie.

The Democrats in the 60s and the 70s and the 80s and the 90s, they're not like this group now.
They're crazy now.

I am a happy person.
I made the smartest decision in June of 2020 when I left the Democratic Party.
The Democratic Party that I belong to, they supported the police.
They believe in law and order.
This party is crazy.
This party, the Democratic Party, is racist.
It's a racist party.
I'm not part of that.

Dr. King would not be part of the Democratic Party.
They're off their mind.
Like President Trump said, maybe they're crazy.
I don't know.
He didn't say they're crazy.
I don't know what they are.

I have a question for you, and it's very, very frustrating because I listen to the radio all day at work.
But, you know, we keep hearing, you know, we have to hold them accountable.
We have to hold these Democrats accountable.
And Leo, nothing happens.
We don't do anything.
Why is that that we do not, if it was, if it was a conservative, a Republican that, you know, was accused of something, they'd be locked up.
You're right.
It's very, very frustrating to hear this every day that we have to do this and we have to do this and nothing is done.
I shouldn't say maybe nothing is done.
It's just it's a slow process of the Democrats.
I mean, you know, look at the Hunter Biden thing.
I mean, come on.
I mean, how long have we known this and nothing was done?
Well, hopefully now that, you know, we took over the House, we'll do something, but it's just very, very frustrating.
That's an excellent call.

Because these individual politicians, and you heard me during the show, rhinos.
That's why they hate Trump.
He doesn't play the power game.
You cannot buy off Trump.
K-Street, Washington, D.C., that's why Republicans like Mitch McConnell and Liz Cheney, they hate him.
Because what this man is saying, we want someone to back up their talk.
President Trump accomplished what he said.
The guy told you what he was going to do.
People didn't like it.
And I'm telling those House Republicans who take over, you better keep your word.
You better keep your word, or you'll hear me trashing you just like those other rhinos.
We know the Democrats are bad.
But you know what?
Republicans are frustrated because they see rhinos and they say, oh yeah, we're going to change it.
And when they get in, they become just like the Democrats.
The only exception is President Trump.
That's why they hate him.
I want people to understand that.
Americans love President Trump.
Washington hates President Trump.
The Republican establishment hates President Trump.
The Democratic Party hates President Trump.
The left-wing media hates President Trump.
Why, Leo?
Because he won't play their game.
Because he cares about Americans.
If President Trump wanted to have a rally tomorrow night on short notice, you'll have 40,000 people out there because Americans know he will back up what he says.
That's the difference.
And there is no substitute for President Trump.
There is no clone of President Trump.
That is an original.
He is an original.
That last caller, I'm frustrated too.
I've said numerous times, if Trump was not running for office, I would be on the sidelines.
I would be on the sideline because I'm frustrated too.
I'm totally frustrated.
