America trapped behind enemy lines.
Day number 89.
89 days.
Joe Biden abandons Americans behind enemy lines.
Only a few weeks ago, we found out that there are hundreds and hundreds of Americans left there.
Yesterday, we found out the Pentagon saying, yeah, also, we know dozens of family members of U.S. troops have been Yeah, we abandoned them also a hundred and two days after Joe Biden said he wouldn't do it.
And on this Veterans Day, we're going to honor Vets later in the program today.
On this Veterans Day, you would think that maybe they would mention the people that they abandoned now that we know that dozens of family members of our own troops were left behind for the Taliban and every other extreme radical uh crazy terrorist group that that is in the Islamic emirates of Afghanistan.
It's unbelievable, unforgivable.
I uh I never thought this could happen in our country.
Um we are loaded up today.
Jim Jordan is going to check in with us.
The mother of Kyle Rittenhouse.
Um we're gonna get her thoughts on this trial that's ongoing.
I'm this is one of the most fascinating trials ever.
And let me start by, you know, I've told the story about Richard Jewell.
Maybe I'll retell it later in the program today, but I've learned a lesson about not rushing to judgment in that case because I was on the air and I said just because he lives with his mother doesn't mean he is a terrorist and uh an Olympic park bomber.
I didn't know that Richard Jewell was listening that day.
And he told me at a later date that I was the only one that gave him the benefit of the doubt.
And learning that lesson at that point in my life when I was a local host in in Atlanta, you know, over 25 years ago.
Um that has served me well.
We see this with all these high profile cases.
You saw this a lot with Barack Obama, you know, weighing in on Cambridge police acting stupidly, you know, uh Trayvon could be my son or uh whatever he said about Trayvon Martin in that case.
Um we saw what happened in Ferguson, Missouri.
You know why I knew Ferguson, Missouri was never gonna turn out the way the media mob was saying it was gonna turn out?
Because I actually made phone calls, and I had sources that told me very early on that there are numerous people that will corroborate the story of Officer Darren Wilson, that in fact it was Michael Brown that reached into the police officer's car and fought him for the gun.
That's when the first shot went off.
And that people corroborated Darren Wilson's story that Michael Brown charged at Officer Darren Wilson.
But there was an expectation, you know, people make these comments and the media makes these comments, and politicians weigh in and make these comments.
They create an expectation in the public of a of a certain result or verdict, and almost always they turn out to be wrong.
Another case we were right on was Ferguson.
Uh not just Ferguson, Baltimore, Maryland, the Freddie Gray case.
Another rush to judgment example.
And I remember saying at the time, not one of the six officers is going to be found guilty of anything.
Um We had the same case with the Duke LaCrosse case.
Now we were right about that.
Why were we right about that?
Because I actually took the time, got in contact with the families of the players, went to where one of the families lived, met several of the parents and several kids, and I learned very early on that there was exculpatory evidence that would be brought into the case that would prove that they weren't even there at the time of the alleged assault.
And it turned out to be right.
Same with the UVA rape case.
Now we have it once again, the same group, same cast of characters rushing to judgment yet again.
And I, you know, based on what I can see, I never like to go out on a limb.
You just really can't predict what juries are going to do, but it was devastating.
The prosecution in this case seems to be flailing, and on top of that, failing as well.
I think Kyle Rittenhouse did particularly well under cross-examination of the prosecution.
Uh it was devastating when their star witness had to admit on the stand under oath that before Kyle Rittenhouse shot him, that he pointed a loaded gun at Kyle Rittenhouse.
You can take that charge and say goodbye because the law is very clear in the state of Wisconsin.
If someone aims a gun at you, you're allowed to shoot that person as long as you are in reasonable fear of imminent death or serious bodily injury.
Then we've got all these witnesses and a video tape on top of it.
What are the video tape show?
I I aired some of it last night.
Videotape evidence of Kyle Rittenhouse running as fast as he can as he's being chased by I I don't know what word you by a group of people that clearly want to bring harm to him.
First person gets to him, knocks his hat off.
Then he's on the ground, and you have a still image of a guy that literally has his foot up in the air about to pound it right into his face into the pavement, which would cause severe bodily harm.
So if I had to look at it objectively, if I'm on the jury, that's pretty compelling evidence that he acted within the law.
Always comes down to the law and what it means.
He was on my show and um on Hannity with Greg Jarrett, and he he made a great point.
When the judge rightly berated the prosecution, what look, the everybody knows you have the right to remain silent.
This has been established law now in this country for decades and decades.
And what the judge in this case said, warning the prosecution that, you know, why didn't uh why Mr. Rittenhouse did you choose to remain silent about the incident?
The judge went nuts.
The problem is this quote is a grave constitutional violation for you to talk about the defendant's silence.
The judge continued continues.
He goes, You're right on the borderline, and you may be over it, and it better stop.
And then later in cross-examination, the judge admonished again the prosecution after the defense attorney accused the prosecution of trying to provoke a mistrial.
By the way, that's what the Alan Dershowitz concluded, too.
They may they know this case is going so badly for them that if they provoke a mistrial, they get a do-over.
By the way, not it's not uncommon.
Um anyway, then an argument ensued with the defense attorney and the judge and the prosecution, and now the judge has before him the idea of a mistrial with prejudice, which means that Kyle Rittenhouse would walk out of there and there won't be a second trial.
It is the equivalent of not guilty.
Um then the judge went even further.
An argument ensued as as the defense rightly brought the matter before the you know jury that that the judge had previously was inclined and had said so not to allow in front of the jury.
Judge says, quote, I was astonished when you began your examination by commenting on the defendant's post-arrest silence.
That's basic law, the judge says.
It's been basic law in this country forty, fifty years.
I have no idea why you would do something like that.
Then the defense responded.
He filed another motion on the issue, arguing that it was relevant to the discussion, and the prosecutor now said he wanted to impeach Rittenhouse on his belief about protecting property with the prior intent, which involved the same gun.
Uh, then it was explained by the judge that he had allowed that kind of testimony in other trials, but had not allowed it in this case.
He said just hours ago, I said I heard nothing in this trial to change any of my rulings.
That was before the defendant's testimony, says Your Honor.
And then that's when he shot back, don't get brazen with me.
Now the funniest part of this is that like it's gone viral.
Um it's almost like let's go, Brandon at this point.
You know very well attorneys can't go into these types of areas when the judge has already ruled without asking outside the presence of the jury to do so.
Don't give me that, and then said, I don't believe you.
I mean, just so there the prosecution's chief, number one witness, devastatingly has to admit, yeah, I pointed a loaded gun before he at Kyle Rittenhouse before I shot him.
Then you've got the eyewitnesses saying, yeah, his life was in jeopardy as he was being chased by a large group of people on the ground and people, you know, stomping on him, and and that's when he defended himself.
That fits within the law.
You know, the the prosecution's case is melting.
You know, uh my friend Greg Jarrett, you know, wrote a great column about this.
He said cross-examination is known as the engine of truth.
If done effectively, deceptions are shredded, lies unravel, and the truth emerges, and so it happened in Kenosha, Wisconsin, in a courtroom in the murder trial of Kyle Rittenhouse, who stands accused of fatally shooting two men and wounding a third on a night of destructive protest in August of 2020.
Of course, where by the way, where's Liz Cheney's committee on that?
Why do we only I I've been very outspoken?
January 6th can't happen, but neither should it happen the 534 riots where dozens of Americans were killed, where that were where literally thousands of cops injured, pelted with bricks, rocks, bottles, Molotov cocktails, where police precincts were burned to the ground, where looting and arson were rampant, where city blocks were taken over.
Why aren't we investigating?
Why isn't there a congressional committee on that?
And where are the arrests of the people that we know that were involved in those incidents?
You can't have a two-tiered system of justice.
If riots are wrong and they are, then the people involved should be arrested and punished.
And I and no interest at all from Democrats.
You want to know why?
Because it doesn't involve Donald Trump.
It's pretty unbelievable.
Now it gets even more interesting on Laura Ingram's show last night, and we'll ask Kyle Rittenhouse's mom, who's going to join us later, uh, the Rittenhouse family spokesperson, David Hancock, rightly slammed Joe Biden.
Why?
Because, you know, the candidate, Joe Biden himself, prior to the election, called Rittenhouse a white supremacist.
Now, correct me if I'm wrong.
I I I don't know of any minority that was involved in the shooting with Kyle Rittenhouse.
Am I right on that fact, Ethan?
I think I am.
You are.
Um, and the media is absolutely irresponsible.
In other words, when a politician, when activists, when people rush to judgment, and there's been a lot of it, and I'm gonna go over a lot of it with you.
Um prominent people, when they rush to judgment without hearing evidence, without allowing The presumption of innocence without allowing due process.
They create an expectation among the population.
Now we got this headline.
It's out there on Fox News.com.
Police are bracing for riots as the case against Kyle Rittenhouse collapses.
Who created an expectation of guilt?
The media mob again and Democratic politicians.
They do it every single solitary time.
It has served this program and my television program well, not rushing to judgment.
And I don't rush to judgment.
And I apply it equally across the board.
Democrat, Republican, it doesn't matter.
I believe in due process.
Unless you got a video, like in the case of George Floyd, the video's so damning.
Short of that, though, it's it there are there are real witnesses.
There's real video tape.

All right, as we roll along.
You know, when you have CBS morning news on Twitter, putting out their Kyle Rittenhouse testified in his own murder trial yesterday, breaking down in tears as he told the jury he murdered two men.
No, he did not.
He told the jury that his life was in jeopardy, and he felt great bodily harm was coming his way.
And he defended himself.
You have, and this is where everybody creates an expectation, which leads to the headline that I read to you before.
Police are bracing for unrest post verdict in this case.
You have, for example, uh Democrat Hakeem Jeffries blew a fuse yesterday watching the prosecution case against Kyle Rittenhouse becoming it's it came unraveled, saying that the former lifeguard deserves to be imprisoned for life.
You know, panned on social media.
Why do we why do these politicians, why do these people in the media mob, why do they always, always, always do the same thing, knowing the consequences of creating the expectation of a result that was never gonna happen.
Now, I don't know how the jury is gonna rule here.
I know that the evidence is very compelling for the defense within the law as stated that I just read to you in Wisconsin.
That is incontrovertible.
Now, what a jury ultimately ends up doing is gonna be up to them.
But I would imagine when the judge gives them instructions, I would expect that it's gonna be very clear if you have a threat of bodily harm or death, you have the right to defend yourself.

So, you know, all these incidents over the course of my career, starting with Richard Jewell, I learned a valuable lesson.
When Richard Jewell told me you were the only one that didn't buy into, I fit the profile of the lone uh bomber because I live with my mother.
The media ran with that.
And by the way, the media, I have no idea how much money that Richard Jewell ever got, but he got a lot.
Remember the case of this kid, Covington High School kid.
Remember that case?
The rush to judgment in that case.
The media never learns.
Ferguson, Missouri, you know, how is it that we get this right on this program?
Because we work at it.
We were proven, vindicated completely on the issue of the Russia hoax, the conspiracy theories, all the media mob went with it.
Three long years of never ending lies, propaganda, misinformation, slander, smear, besmirch, attack.
That's what they do.
And in these high profile cases, when either politicians, I don't care if it's Obama or Biden, whoever it happens to be, Hakeem Jeffries in this case, when they speak out definitively, either before the case is even tried or during uh a trial, they are people are hearing them.
They're supposed to be leaders.
And people expectations get built up.
In the case of Kyle Rittenhouse, you had Joe Biden inferring that he was a racist.
Well, there were three people involved in the sh that were shot by Kyle Rittenhouse.
In each case, by the way, none of the three are minorities.
In one case, you have the one guy that says he admitted on the stand that he took a gun that was loaded and pointed it at Kyle Rittenhouse before Kyle Rittenhouse ever fired.
Kyle Rittenhouse's testimony is in another case, the person that he shot grabbed his gun.
He said, I quote, can feel he feel it pulling away from me.
I can feel the strap starting to come off my body.
Remember, he was being chased.
We have the video of him being chased down the street.
The case of the third person, uh, he said this guy is coming at me with his arms out in front of him, and I remember he got his hand on the barrel of my gun.
You see the videos, you see that you we've heard the eyewitness testimony corroborating what what in fact Kyle Rittenhouse is saying here.
And then you've got the predictable media mob and politicians doing what they always do.
And that's rush to judgment.
When they rush to judgment, they create expectations.
What are the expectations that you're going to get a guilty verdict?
What happened in Ferguson, Missouri?
I my sources told me early on there were multiple eyewitnesses that will corroborate the story of Darren Wilson.
We were right, they were wrong.
And look at the aftermath because the expectation was set so high that it was like, oh, it's a slam dunk.
This is going to be a guilty verdict.
Or the case of Freddie Gray, Baltimore.
You know, or the case of the Duke Duke LaCrosse.
Remember all the professors at Duke, you know, signing this letter, nearly a hundred of them about the guilt of these lacrosse players.
None of them were guilty.
In that case, thankfully, they had videotape evidence.
They had ATM machine evidence of their whereabouts at the Time of the alleged assault.
I actually took the time to go meet the kids and their families.
That's why we were right there.
I had sources on the ground in Baltimore telling me the exact same thing.
And I said, not one of those six cops are going to end up being found guilty.
And I turned out to be right again.
Is it uh am I taking some magic pill that they're not taking?
No, we don't rush to judgment.
This concept of being innocent until proven guilty serves this country well.
Those that refuse to allow due process, a defense, the presumption of innocence.
There's great harm in their words, especially quote, leaders.
You know, Congressman Jeffries, Hakeem Jeffrey wants to wants this to end in, you know, to end mass incarceration, says, Lock this guy up, throw away the key.
Is that not a rush to judgment?
Does anybody not have a different perspective now when the star witness of the prosecution says he pointed a loaded gun right at Kyle Rittenhouse before Kyle shot him?
Does that not put texture, context to what happened in that situation?
You have, you know, other people in the news media, the media mob, um, you know, literally over at MSDNC, a guest dismissing Rittenhouse's tears, calling him white privilege on steroids.
I watched this kid breakdown yesterday.
Uh seemed real to me.
I think you were watching somebody that looked to me like a classic panic attack.
And the judge rightly.
I didn't hear what you said in my ear.
Did you say something to my ear?
No, I guess not.
Anyway, and then MBC News, they have a column.
If convicted, he'll become a right wing martyr.
If he's by the way, I hear Mark Simone's voice in my ear, guys.
Guys, I'm hearing Mark Simone's ear in my ear.
Are you gonna fix that?

I appreciate it.
I don't want Mark to have a private conversation and go over the airways.
Mark is a friend.
Um convicted, MBC says he'll become a right wing martyr.
If it if he's freed, it's a message to others like him that prison won't be in their future.
Not, you know, not everyone is deleting their prison.
You know, I won't even I won't even talk about what's on what's on social media.
Social media's become a sewer.
It really has.
You got the uh the ever so genius uh legal professional over at fake news CNN, uh Jeffrey Tubin, uh saying that accusing Rittenhouse of rehearsed testimony.
Is he telling the truth or giving the performance of a lifetime?
You really didn't think that was real?
Not that this guy's anyone that I would ever listen to anyway.
Anna Navarro, Kyle Rittenhouse shot and killed these these three people, an injured, injured, shot and killed two, injured one.
Think about how much their loved ones have cried real anguish and grief and not crocodile tears.
LeBron James weighing in, mocking Rittenhouse's courtroom breakdown.
What tears?
Knock it off.
Ooh.
Pretty harsh, isn't it?
Pretty predictable also.
Then the left is going after the judge.
Oh my gosh, he had a ringtone to God bless the USA.
Gee, how horrible.
We can't even agree on what the national anthem.
We can't agree, God bless the USA is a good thing.
Washington Post reporting the judge's decisions in this case have come under scrutiny.
No, not really.
The judge was right in his rebuke of the prosecution that seemingly I agree with Professor Dershwitz, they want a mistrial because things have gone so badly for them.
You have one MSDNC host demanding the removal of the judge.
Why?
Because he rebuked the prosecutor that brought up an issue that of a defendant has the right to remain silent and you don't question that?
It's standard legal 101.
It's not hard to Figure out.
Rightly, Rittenhouse's spokesperson slamming Joe Biden for casting his defendant as a white supremacist.
I love how people, you know, just rush to judgment always.
What's interesting is Wisconsin prosecutors could be barred from retrying Kyle Rittenhouse if this defense motion for a mistrial with prejudice is granted.
Judge is not decided on that yet.
Even if the jury came back with a guilty verdict, the judge would have the ability to overturn that.
And by the way, court rules, the prosecutor intentionally caused the mistrial.
That could happen in this case, too.
There's a lot of now variables in terms of the way that this can play out.
My guess is that the judge probably wants the jury, wants this to go to the jury.
That's my guess.
And when that happens, the jury is going to be instructed on Wisconsin law.
And that is the law is on self-defense in Wisconsin's clear.
Like in the case of someone aims a gun at you, you're allowed to shoot that person as long as you are in reasonable fear of imminent death or serious bodily injury.
You don't have to wait for somebody to shoot you before you can fight back.
That's kind of like a New York.
New York has the you must try to retreat law.
Mm-hmm.
Which is insanity.
But all these now that I mean, this is what makes this case now fascinating.
I can see the judge in this case declaring a mistrial with prejudice based on the prosecution's own conduct.
That's gonna be interesting.
Anyway, LeBron James, what tears he writes.
I didn't see man knock it off.
You know, then apparently he added that boy ate some lemon heads before walking into court.
Well, pretty harsh.
And Keem Jeffries, by the way, is the House Democratic caucus chair.
He's now been slammed for tweeting, lock up this guy for life.
The establishment media, you know, all are suggesting guilt in this case.
The rush to judge judge judgment, it's always the same people.
Liberal Democrats and the media mob.
They don't do their job.
The same people that lied to you for three long years about the Russia hoax.
The Hillary Clinton bought and paid for Russian disinformation dossier, the one that the highest levels in the FBI said that they they affirmed and put their signature on it that it was all true.
None of it was true.
Anyway, 800 941 Sean, if you want to be a part of the program, white privilege on steroids.
Wow.
I would say I'm a betting man.
Looks to me, this is not going to go the way the liberal media thinks it's going to go.
But, you know, I I don't like to make predictions in cases because juries are notoriously unpredictable.
You don't know.
High profile case.
They know the world is watching.
It puts a lot of extra pressure on them.
But if you're going to follow the law, the law is very clear.
Now the question is do the witnesses, the videotape evidence, and the testimony of the star witness of the prosecution, will that be enough to get not guilty verdicts?
I don't know.
To me, it's pretty compelling.
You know, I I felt that on under cross-examination, I prosecution did not put a dent in the testimony of Kyle Rittenhouse.
Under cross-examination, Rittenhouse insisted he did not wish to kill any of the three victims and was on the scene to help people, which has been widely reported.
I didn't intend to kill them.
I intended to stop the people who were attacking me.
You got video evidence of him running as fast as he can to get away from people chasing him.
Rittenhouse also said, I did what I had to do to stop the person that was attacking me.
Which is on video.
By the way, I wish I had better news on the economy.
I do not.
American family budgets get slammed by a thousand dollar Biden inflation tax.
New York State average family income, $89,000.
Biden inflation tax is going to cost you over $1,430.
Average family income in America now stands at $67,500.
If you're in that group with tens of millions of other Americans, you'll be paying over $1,000 this year for the Biden inflation tax.
Actually, $1,080 on average.
And in California, if the average family where the average family income is $91,400, you will pay an extra $1,460 thanks to Joe's skyrocketing inflation.
And it's only going to get worse.
Did you ever think you'd hear a president like Joe Biden say, Wow, you ever think you'd be paying prices for gas like this?
Listen.
Guess what?
That's in the Recovery Act.
I'm assuming that's in the Bill Back Better bill, which is not going to raise taxes one single cent.
It's totally paid for.
You hear a lot about the supply chains in the news, but frankly, not a lot of people are clear, have a clear understanding whether they have a PhD or they didn't go to school about how a supply chain works.
More products are being delivered than ever before.
That's because people had a little more breathing room than they did last year.
That's a good thing.
But it also means we got higher demand for goods at the same time we're facing disruptions in the supplies to make those goods.
There's the rest.
This is a recipe for delays and for higher prices.
And people are feeling it.
They're feeling it.
So everything you're paying this much for a gallon of gas.
Unbelievable.
