[00:00:01] Hope everyone is doing well. [00:00:04] I might just vamp here for five seconds as the connection is taking place. [00:00:12] Hope everyone can hear me and everything. [00:00:14] Well, anyway, I'll start talking. [00:00:17] So, we are forced to discuss Nicholas Jake Fuentes and his recent arrest. [00:00:26] I think he has a hearing coming up in a couple of days. [00:00:30] And I'm actually going to be brutally honest about the situation. [00:00:35] And so I think I might even sort of piss off both sides. [00:00:39] I don't think so. [00:00:40] I'm going to be definitely honest. [00:00:42] So I've seen the video of the incident that took place. [00:00:48] And this came after the election. [00:00:51] It came after Nick went mega viral with a monologue and tweet regarding You know, your body, my choice. [00:01:02] You know, look, he was obviously joking, but kind of asking for a response to that one. [00:01:08] But, you know, he was a comedian. [00:01:10] He is a comedian, of course. [00:01:12] And there were death threats. [00:01:15] There was a massive reaction to it. [00:01:18] People were singing songs about attacking him and so on. [00:01:23] I think that Nick, understandably... [00:01:28] Felt like his life was in danger to some extent. [00:01:33] That someone might very well come over and try to harm him or do something. [00:01:39] So I think his reaction is very understandable. [00:01:44] That being said, this is the problem. [00:01:47] He's been charged with a misdemeanor battery. [00:01:51] And that can go up to one year. [00:01:55] Now, I think that would be totally outrageous if that happened. [00:01:59] But if any of you guys are subscribers to our members-only talks, you can go back to the feed and listen to me talk about it then. [00:02:10] I do think he did the wrong thing at the end of the day. [00:02:13] And I'm just going to be honest. [00:02:14] I would certainly say this to his face. [00:02:19] He should have either not opened the door, or if he did open the door, don't just come out swinging in the sense of spraying mace. [00:02:31] Talk to her if you want. [00:02:32] You don't have to. === Nick's Prison Sentence? (13:10) === [00:02:33] You have a right to be in your own home. [00:02:36] So I'm just going to be honest here. [00:02:40] The whole thing was fairly funny and everything, but I think he's in the wrong. [00:02:46] Now, that being said... [00:02:50] The idea of Nick going to prison for this lapse of judgment I think would be just beyond insane. [00:03:03] A lot of people use the term anarcho-tyranny as coined by Sam Francis in Chronicles magazine 30 years ago or maybe even more than that. [00:03:13] It's the notion that The state is tolerating people whom it should arrest or prevent from being a menace to society while it goes after, with almost totalitarian intensity, [00:03:31] maybe even glee, against people who are upholding society. [00:03:37] So it's a sort of worst of both worlds situation. [00:03:42] And, you know, this arrest comes in the shadow of the Daniel Penny situation in New York City. [00:03:51] I've read about the case. [00:03:52] I've obviously not seen every detail of it. [00:03:57] Very tough situation, of course, but I definitely think that he was not attempting to kill this young man, Michael Jackson, impersonator. [00:04:09] I think he was genuinely trying to save the rest of the people in the car. [00:04:13] Actually, in his interrogation, which has been released, and I watched the whole thing, his interrogation with the cops, he said I wasn't trying to kill him. [00:04:22] I was putting him into a hold. [00:04:26] I feared for my life. [00:04:27] I feared for the lives of people around me. [00:04:29] He said, I'm going to kill all y'all. [00:04:31] I'm willing to go to jail for life. [00:04:33] I don't care anymore. [00:04:34] I mean, this character is... [00:04:36] Clearly suffering from mental illness. [00:04:41] I think there was one report that he was suffering from schizophrenia. [00:04:46] He's out of control. [00:04:47] He is a genuine menace to society. [00:04:53] Tough situation, but the idea of putting Daniel Penny away for 15 years from manslaughter seems just outrageous. [00:05:02] I don't know what's going to happen on that front. [00:05:06] But the fact that we're even thinking about putting Nick away for a year for this lapse of judgment, I think is outrageous. [00:05:18] It's the kind of thing that he doesn't have a criminal record. [00:05:23] Maybe some people consider him to be a menace to society due to his live stream, but obviously he's engaging in the First Amendment. [00:05:34] Just the idea that you need to punish him severely or take him off the streets just strikes me as insane. [00:05:42] So I don't know. [00:05:43] What I hope might happen, I hope he gets probation or it's thrown out, perhaps. [00:05:49] I'm not sure that will happen because there is a sort of crime that took place, the macing that was unprompted. [00:05:57] But the idea of punishing him severely just seems insane. [00:06:04] It just seems insane. [00:06:05] But there's all of this tolerance shown towards criminals around the country. [00:06:10] The idea that you'd crack down on Nick Fuentes, just throw the book at him. [00:06:15] That would in itself be just a miscarriage of justice. [00:06:19] It's the kind of thing that I think it's a slap on the wrist, give him some time to learn his lesson, not do it again, and let him go. [00:06:29] I think that would be... [00:06:31] Totally fine. [00:06:33] I was talking actually with someone this afternoon, and this relates to anarcho-tyranny. [00:06:39] There is a degree to which our society does have the worst of both worlds in terms of crime and justice and so on. [00:06:53] There seems to be a sort of assumption of, on the one hand, We deserve total safety. [00:07:02] And on the other hand, there are people such as the assistant DA in New York City who are talking about restorative justice. [00:07:12] There's a viral clip going around of Yuran, the assistant DA who's prosecuting Daniel Penny. [00:07:23] And she was saying, well... [00:07:28] There was a robbery at an ATM of an elderly Asian man, and it was a young black man, but he pushed him down. [00:07:36] He probably didn't mean to hurt him, but I just felt so sorry for him. [00:07:40] Let's not charge him for criminal murder. [00:07:43] Let's bring it down several notches. [00:07:47] This will sort of restore justice on some cosmic level. [00:07:51] So we have a situation like that. [00:07:55] And then we have an almost... [00:07:57] Over-emphasis on safety that I think is sort of anti-civilizational. [00:08:05] And I saw this growing up with much of the anti-bullying and so on that was taking place in school. [00:08:13] Now, again, I'm not endorsing any sort of harsh bullying. [00:08:18] Obviously, bullying can get out of control. [00:08:21] But it's also sort of part of life. [00:08:26] I don't know. [00:08:27] I can remember even when I was at summer camp, I was probably 11 or 12, getting into my first fistfight. [00:08:36] And, you know, the council broke it up and so on. [00:08:40] I actually got a good punch in. [00:08:42] The guy attacked me. [00:08:44] I mean, it's all coming from my perspective, so take it with a great assault. [00:08:49] But in some ways, like... [00:08:52] Part of life is getting into trouble. [00:08:54] Part of life is experiencing some sort of danger. [00:08:59] I don't know. [00:09:00] I mean, if two guys out at a bar get into a fistfight, is that really something that we should charge them with assault for and put them away for a decade? [00:09:13] Isn't that sort of part of life? [00:09:16] So, I don't know. [00:09:17] There is this overriding... [00:09:22] Overriding assumption of total safety, the idea that any sort of violence, even if it's very limited, is just totally something that cannot be accepted. [00:09:37] And you see this, I think that sort of spirit undergirds both the prosecution of, say, Nick Fuentes for something that wasn't a big deal, in my opinion, but also... [00:09:52] The notion that, you know, oh, that guy, yeah, he might have murdered someone, but we're just going to let him off. [00:09:59] There seems to be one sort of impulse running through all those things. [00:10:05] So anyway, just to recap, we had a number of people come in. [00:10:10] I do think, to be brutally frank here, that Nick was in the wrong. [00:10:17] When he stepped out of his house, he didn't have to step out of his house. [00:10:22] And he threw the first punch, as it were. [00:10:25] He maced this woman. [00:10:27] I mean, I'm just going to be honest. [00:10:30] That being said, it's just simply not a big deal. [00:10:34] And the notion of some sort of severe punishment of Nick just strikes me as totally outrageous. [00:10:43] Probation, suspended sentence, some light thing. [00:10:46] That's what you should do in this sort of situation. [00:10:51] Anyway, I guess that's kind of all I got. [00:10:55] I just wanted to jump on and throw out a few ideas. [00:10:59] You guys ask me a question in the comments, I'll answer it. [00:11:02] A good question, that is, not one of your typical inane comments. [00:11:08] Can you countersue? [00:11:11] Well, first off, it's not a civil lawsuit. [00:11:14] It's a criminal complaint. [00:11:16] I mean, I guess he could start suing some of these people who were calling for violence or something. [00:11:22] I don't know how far that will go. [00:11:24] I mean, again, he's a public figure. [00:11:28] There's a free speech element to this, particularly with the public figure. [00:11:34] I mean, basically say that... [00:11:36] The President of the United States is the devil himself and get away with it. [00:11:39] You probably can't say that about your neighbor who's a private citizen. [00:11:45] Would this be a big deal if it had been Pink Shapiro? [00:11:50] I hope conservatives come out in support of Nick. [00:11:55] I hope they say what I said. [00:11:57] It's best to be honest about the situation. [00:12:01] I think some people saying he did nothing wrong or something. [00:12:05] Look, it's okay to do things that are wrong. [00:12:08] We've all done things that are wrong. [00:12:10] It's best to be honest about it. [00:12:11] But again, this notion that he's going to be severely punished is what I find just totally absurd. [00:12:20] I mean, his response was understandable. [00:12:24] It's just a huge difference between someone who, say, walking around the streets of Chicago. [00:12:32] Macing people at random for the thrill of it. [00:12:35] That is totally different. [00:12:39] Getting very anxious and nervous, feeling like people are going to come to your house and attack you, and then kind of striking first. [00:12:47] And striking with a non-lethal weapon. [00:12:50] Mace is meant to get people off your case. [00:12:54] It's not meant to do permanent damage. [00:12:57] Or someone's not meant to kill anyone. [00:13:00] Do you think that Nick paying a less than 1k fine is reasonable in exchange for a deferred yes adjudication? [00:13:07] Yeah. Something like that. [00:13:11] I think that would be fine. [00:13:14] Is he free now? [00:13:15] I think he's free. [00:13:16] I think he did a live stream tonight. [00:13:18] He's just on his own reconnaissance as they say in legalese. [00:13:27] All right. [00:13:28] I'll answer two more questions if you have them. [00:13:32] If this were any other party, would charges even be pursued? [00:13:36] Good question. [00:13:37] I don't know the answer to that. [00:13:40] I would probably say maybe. [00:13:44] I don't know. [00:13:45] Just sort of imagine a different situation. [00:13:50] Your neighbor hates you or something like that. [00:13:53] You got into a big screaming match. [00:13:55] And then you walk over to your neighbor's house to apologize, and she sprays mace in your face. [00:14:03] Again, even in that situation, I don't think that person should be thrown into the jail or spend hard time, like a year in jail. [00:14:13] Is that prison? [00:14:14] What is it? [00:14:14] Over a year's prison? [00:14:15] I forgot what it is. [00:14:18] No, even in that hypothetical situation I came up with, the idea of severely punishing people without criminal records, who are not a menace to society. [00:14:27] They're not doing this all the time. [00:14:29] They're not brazenly and with depravity going around town assaulting people. [00:14:37] I mean, I just don't think that those people should be punished. [00:14:44] Severely. I think the slap on the wrist. [00:14:46] Maybe a literal slap on the wrist. [00:14:48] He should hold out his wrist, take the slap, and then go on his merry way. [00:14:55] That would be reasonable. [00:14:59] Rand Paul's neighbor got arrested for worse. [00:15:01] I forgot the details of that case. [00:15:04] Wasn't there someone who was trying to kill Rand Paul at some point? [00:15:09] Do you think this is an example of an anti-Semitic hate crime? [00:15:13] No. No, I think Nick was freaked out, understandably freaked out, and he just came out swinging, and he shouldn't have done that, as I said.
