The Rudy Giuliani Show (E13): A Glaring Problem w/ New York Trial

Part of the Anglo-American legal tradition.
Judge Mursan expelled us, moved us out, and put us into a category of, oh, I guess we could be compared to the Soviet show trials, or maybe trials in Venezuela or China now.
Not with the other implications of it, but from the point of view of trials, kind of like the Nazi trials.
I'll tell you how he did that.
He did it a number of ways, but one really extraordinary way.
And that is, he instructed the jury that they don't have to be unanimous on all of the elements of the crime.
In fact, he gave them three possible ways they could find that President Trump committed a felony, or was seeking to commit a felony, when he was part of the false statement.
Now, this gets very complicated because the false statement is not a false statement, it's true.
The evidence from the government, from the state, proves that it's true.
Cohen described four or five different items that he was paid for, 400,000 plus.
Daniel's payment is only one part of it, so the clerks and the accountants and the others that wrote down a legal retainer That was a perfectly legitimate description of four or five different items that were being paid to the lawyer on a monthly basis in a retainer fashion.
There's nothing false about that.
It hardly meets the category of false beyond a reasonable doubt.
It actually fits the category of true beyond a reasonable doubt.
And that comes right from Cohen's testimony.
So, the thing is, the thing is getting ridiculous now.
I mean, totally ridiculous.
But today was the height of really danger to the American legal system.
I practiced law for a very long period of time until I was suspended because I represented Donald Trump.
And was considered a danger of violence if I continued to practice law.
Of course, that's totally made up by the completely warped New York Bar Association, which worships at the feet of Trump derangement syndrome and wokeness.
But be that as it may, the reality is that when I first heard that he was going to tell the jury That there could be elements of this that don't have to be unanimous about.
I said to myself, I must be crazy.
I mean, I tried an awful lot of criminal cases, and I studied criminal law, and I studied it in great detail at various times in my life.
And I seem to remember that one of the cardinal rules is that a jury has to be unanimous beyond a reasonable doubt on every element and every part of every element and that that was ancient law.
Well, it is.
It's both ancient and reaffirmed very recently so that the crooked judge sitting in Manhattan couldn't possibly have missed it.
This issue came before the Supreme Court just a few years ago.
Because two states had developed a statute based on an opinion they overruled, and the statute allowed for certain cases where there would be less than unanimous verdicts in criminal cases.
One of those states was Louisiana.
Well, on April 20th, 2020, which is only four years ago, The Supreme Court decided in a 6-3 decision that the court found that the Sixth Amendment's unanimous jury requirement is fully incorporated against the states.
And that unanimity has to be found on every element and every part of every element to sustain a criminal verdict.
Justice Gorsuch wrote the opinion and was very, very adamant about the ancient and substantial nature of this.
He found that the unitary requirement applied to the states of the 14th Amendment and that it was applicable.
To every element, every single element of the criminal charge.
So he said, in explaining the history of it, it emerged as a vital common law right in 14th century England, appeared in the American state constitutions, and provided the backdrop against which the Sixth Amendment was drafted and ratified.
But that's not enough to stand up to the crooked democratic machine of New York.
Which wrote it out of the Constitution.
Who the hell do they think they are?
Who do they think we are?
Well, they think we're clowns, actually.
This is outrageous.
You can't decide, a judge can't decide all by himself that a verdict is not going to be unanimous when it's been the law for... 14th century means 1300.
Right?
So that's about seven or eight hundred years ago.
For seven or eight hundred years we've had unanimity and this acting political hack with a daughter making millions on this case decides that he's going to change 800 years of law in order to frame the date of the opposition party.
So what's going to be done about it? Everybody...
Our legal system, our legal rights are being taken away from us one by one.
And when they're taken away from Trump, they start to get taken away from others.
So, they've been taken away from me.
You go from Trump to me, to Mark Meadows, to go on and on and on, and eventually it'll reach Particularly if you don't agree with the government.
This is a direct assault on America as a country of laws by a judge whose lawless action is much worse than anything, not that Trump has been convicted of, or anything Trump has been charged with.
You're talking about an insurrection that didn't happen?
This is an insurrection.
A judge is all of a sudden going to decide that a criminal verdict doesn't have to be unanimous?
And what's the scam here?
The scam is that of course it will get reversed.
Of course it'll get reversed.
If it doesn't get reversed by the Appellate Division, which does have a fair number of political hacks, it will get reversed by the Court of Appeals, because there'll be a laughingstock if they don't reverse it.
And the Supreme Court will eventually have to reverse it.
They just announced this rule four years ago.
I'm not saying they announced it, they just reiterated it four years ago.
It's 800 years old!
But I don't understand why there isn't an outrage about it.
All of a sudden, somebody's gonna get convicted on less than the unanimous verdict?
What he basically said was, it just gets a little complicated, and the more complicated, usually, the better for the defense, because to convict, it's gotta be nice and simple.
But in any event, there's really essentially three elements to this, right?
Element number one is a false statement, entered not by Trump, we know that, entered by an accountant.
Just the problems with that, they haven't proved that Trump had anything to do with it.
There's no proof that Trump had anything to do with it.
There's no proof that he spoke to Weisselberg, there's no proof that he spoke to any of the people who came up with that description.
That is, and they never call Weisselberg as a witness, which they could have called, so you can use that presumption against them.
Where's the proof that he had entered a false statement?
And where's the proof that it's false when it was described as a legal retainer and they were all legal expenses?
Number two, they have to prove, because that's barred by the statute of limitation, it's only a misdemeanor, that it was done in order to effectuate another felony.
Now, they never bothered to tell us what that other felony was.
That alone is a blowing up of the Constitution.
We'll be back very very shortly and we will finish this and we'll see if we get any word from the court.
Here we are pretty much at the beginning of the process here at this pristine I call it a laboratory.
It's not like a factory, it's like a hospital.
This is the beginning of the process for roasting.

The second element is, it has to be in pursuance of another felony.
Now, no such felony was specified in the indictment.
That's another complete creation of a different, non-just legal system.
It's trial by guesswork.
You're charged with a felony, we're not going to tell you, we'll tell you at trial.
Reversed.
Unfair trial.
Violation of due process.
And outrageous.
I don't know if that was ever done in America before.
Suddenly no one ever got away with it except this stumbled buck.
Now, they boil it down to three.
Right?
Two are campaign and one is tax.
And the judge tells the jury that they don't have to be unanimous on what that is.
Four can say federal, four can say state campaign, and four can say tax.
And then they have to be unanimous on the overall verdict.
That's completely unconstitutional.
That flies in the face, again, of 800 years of Anglo-American history, that a criminal verdict must be unanimous in all respects.
Every element of it must be unanimous.
You can't be unanimous on the first element and unanimous on the third, but split on the second.
That is exactly what this opinion says.
This is exactly what he is directed to do.
What he is doing is blatantly lawless.
He is spitting in the face of the Constitution.
And somebody should spit right back in his face.
And nobody, no New York lawyer is willing, no New York lawyer on the Democratic side is willing to stand up for the Constitution.
Well, if somebody does this to them, who's gonna stand up for them?
Don't they understand what a nation of laws is?
Do they understand how they're destroying it?
I mean, of all the things they've done, is this the most blatant?
I don't know.
My goodness, they indict innocent people.
They've got this Fannie Ho running a ridiculous case where she's prosecuting people because they're lawyers.
They've got the other one in Arizona who may or may not have been elected.
I mean, she was elected by 247 votes.
There were 7,500 votes out.
And then she decides to indict all the people that Fannie Ho indicted, except the president, for the same garbage, acting as a lawyer.
I mean, and now, who knows what they're going to do now?
They're really panicking.
They're really beginning to believe that Biden's going to lose.
And I don't even know, I don't even know if, here I am all upset about this because, I don't know if this doesn't help Trump.
I mean, people said to me, well, is it better if he gets convicted or not?
I really don't know.
There's the possibility your conviction will go up by 10 points, because the unfairness of this case, unless you are afflicted by Trump Derangement Syndrome, which is really, you know, worse than drunkenness or drug addiction, unless you're afflicted by that, you can't miss the fact, whether you like Trump or you don't, that this is an unfair case.
This is an extremely unfair case.
And that it's a political case completely.
That it's something we dreaded in America.
The use of the criminal justice system for political purposes.
If you haven't heard any proof of it, that idiot actor showing up yesterday.
And he is an idiot.
I've talked to this guy personally.
He's a great actor, no doubt about it.
But he is completely socially special.
And imagine, the guy's got to read it.
He had to read it.
He's an actor.
He couldn't memorize the damn thing.
He has to read his ridiculous statement, which included curses.
I don't know if you wrote those out.
And who cares what his opinion is?
What the hell does Robert De Niro know about the law?
I don't think he's even play lawyer.
He thinks he knows a lot about boxing.
He wants to get into a street fight with Trump, I guess.
I don't think he's ever played a lawyer.
I don't think so. It's just it's very very frustrating to see that they get away with it.
And it's frustrating to see how the press just acts like this is not normal.
This is highly unusual, abnormal, extraordinarily dangerous behavior for a country of laws.
To have a judge make up fundamental laws, throw out Hundreds of years of requirements so that a criminal conviction can be fair and therefore create one that will be unfair should it take place.
And all done because they've got themselves all ridiculously worked up.
Ridiculously worked up over Trump.
So they've asked for certain things.
They've asked for a reread of Pecker's call with Trump.
They want Pecker's testimony on Karen McDougal, Pecker's testimony on the Trump Tower meeting, and Cohen's testimony on the Trump Tower meeting, probably wanting to compare those two things.
So what does that tell you?
It tells you that they are going through the testimony, and it looks like they're going through it.
Again, you know, you can always be wrong.
This is everybody's guess, but I mean, I've had years of experience making these guesses, because this is all you do when you're waiting for a verdict, because you are nervous.
It looks like they're going through it in order, right?
So, Pecker was one of the first witnesses, one of the first witnesses that ended up being, supposedly a state witness, ended up being a defense witness.
It's going to be very interesting, and they want McDougal.
Now, they've actually re-read the Pecker call.
The testimony on McDougal, they probably are trying to figure out how much of this has to do with campaign activities and politics and how much is actual business.
Remember, Pecker said there's nothing abnormal about this.
I did it for business reasons.
I did it for Trump many times and I did it for other people and it is not connected to It's not connected to politics.
Now, that could mean that they agree with his testimony, they could disagree.
The fact that they asked for testimony, whether the witness has been favorable to the state or favorable to the defendant, doesn't tell you that much because It could be somebody who's questioning it that's asking for it, not somebody who wants to hear it because they agree with it.
So, one never knows.
Pretty clear they're going through the testimony, though, witness by witness.
We'll see.
If the next request, either today or tomorrow, is about Stormy Daniels' testimony or Interesting to see if they request the liar-in-chief's testimony, right?
If they request any testimony from really the guy I thought they completely destroyed.
But in any event, this situation with regard to the anonymity of the The verdict is beyond extraordinary.
The letters to the editor today in the New York Post talk about what a kangaroo court this is.
We've got to find a stronger word than kangaroo court.
This is a Soviet court.
Soviet court.
Red Chinese court.
Nazi court.

Michael Cohen is a big hit in the Hamptons.
It'll give you an idea of how frivolous and lightheaded the Hamptons is.
He was all over the Hamptons this weekend, and he was described by Page Six, which is the gossip column of the New York Post, as the talk of the town.
And he's He's doing a, he's planning a walking reality show.
And he's going to, he's thinking about a run for Congress and had one wealthy guy allegedly say he'd raise millions for him.
And we better watch that or he'll steal it and run away with it.
And he was greeted very nicely by Jimmy Fallon at a restaurant in the Hamptons.
And he's apparently having a great old time after having been named as a gloat, the greatest liar of all time.
And not an unfair description of a guy that lied before he changed his mind and cooperated with the government, and then after, probably even more after.
So we'll have to see.
I doubt that the verdict is coming back today.
I think, I think they're going, is it the 4 or 5, Ted?
Do you know?
Are they, is their schedule to 4 o'clock or 5 o'clock?
Yeah, let's check again, but I believe he wanted to get him out by, was it 4 or 4.30?
I'll check that.
Interesting thing is if we get there, does he, does he keep him over the weekend?
He strikes me as a fairly lazy judge who will not keep him over the weekend.
Right.
He really is a judge.
I can't imagine that a judge will come up with the idea that elements of a criminal conviction can be other than unanimous.
Two states tried it and just got reversed four years ago by the Supreme Court.
And as definitive an opinion as you can read, and the majority They got rid of it, included the three court liberals.
Although it was written by Gorsuch and joined in by Thomas.
So that's a pretty broad spectrum of the court.
And what the dissent said was that states would have a right to allow for less than unanimous verdicts.
But New York has no such law.
New York does it.
So where the hell is he getting this from?
He's getting it from probably the Democratic boss somewhere who's making up the law and saying, you know, if we're going to get him convicted, we better change the law dramatically because he's obviously innocent.
Well, the Biden people apparently are in a state of complete absolute panic.
Uh, and, uh, all kinds of things behind the scenes are being talked about.
One of the reasons they're in panic, uh, at first they, they were ahead or, or tied in the polls.
Now, almost everywhere except where they can find, you know, crooked pollsters, they're behind and they're starting to get behind by, in some cases, big numbers.
Yes.
Worse than that is they're behind in popular vote.
Now, you know, They can win the popular vote and lose the election.
They won the popular vote in 2000 and lost the election.
They won the popular vote in 16 and lost the election.
So if you see a poll where Trump is behind by two or three, and then you see how it falls down into the states, normally, unless there are some cheating going on, Trump's going to win.
Just given the electoral college distribution.
But when he's ahead by three, four, five, six, then things look really, really bad.
And then you go into the swing states and he's leading in all of them.
And what really is fascinating is he's leading in all the ones they stole.
Yeah.
Which really kind of indicates the legitimate vote there was for him, not for Biden.
But, you know, we'll leave that to another day.
You know, that's why I'm no longer on WABC because I'm not allowed to say things like that on WABC.
I did anyway.
I did anyway, but then all of a sudden they got tired of it.
I guess they got scared that one of the people suing them or somebody is going to sue them.
I think I know exactly who, but I won't talk about it.
It sure wasn't a decision of principle.
Let's put it that way.
But here's the thing that is now happening.
Trump is beginning to out-raise him.
Silicon Valley, big switch.
Estimated as, right now, about a third.
Moving over.
Big fundraiser in Silicon Valley.
At first, when his maybe two or three people there tried to raise money, they had nothing to do.
And now, looks like they could have a record fundraiser in Silicon Valley.
And they've been Democrats for quite some time.
Bye-bye!
The Palm Beach fundraiser has them maybe with more money on hand than Biden.
And Democrats are now begging.
They're going back to the well.
They're going back to the people that donated money in the past and asking them to please do it again because things are getting very, very tough.
So they are panicking.
And they really are stuck.
They don't know what to do.
First of all, who says you can't dump Biden?
He doesn't sound like he wants to go.
And even if it matters whether he wants to go, I don't think the stepmother-in-chief wants to go.
She, I think she likes being a first lady, gives her a chance to be mean to her grandchildren, like really mean, like not put up stockings for the ones that she doesn't like.
She's created all kinds of problems for Hunter, which Hunter is very, I mean Hunter's pretty open about the mother-in-law.
So she may be the reason why he's Hanging on, I don't know.
I think she likes being, you know, a queen.
So getting rid of him isn't going to be easy.
But then, of course, there's Harris.
And Harris is still more unpopular than he is.
And he's getting real unpopular.
And her little campaigning tour where she was supposed to fix it, she made a complete jackass out of herself.
Well, she is a jackass.
Well, I mean... There's something obviously wrong with it.
Nobody laughs like that at inappropriate things unless there's something wrong with them.
One Democrat here in New York is panicking over the reaction of Democrats in New York.
They seem to be moving over and supporting Trump.
Now, I don't want to go too far with that, because that could be a little bit of a reaction to the enormously popular appearance that he had here.
But, I mean, I have detected for some time, and I guess, you know, you go through this so often, you're not sure whether it's solid or not, but I've detected for some time an unusual amount of support among blacks in New York for Trump.
More than in any other election, they'll approach me and tell me that they're going to vote for Trump.
I mean, I don't know.
I mean, it could just be a small sample.
It could just be a... But that didn't happen before.
And if anything, there may be more blacks that approach me about that than whites.
So he may really have a problem, and I think there are several articles the last couple of days and studies saying basically the Hispanic thing is done.
I mean, it's baked.
Because it goes right to the key questions that Hispanics, even more than whites, for example, the biggest issue among Hispanics is the economy and inflation, by about 10% more than whites.
And if your biggest issue is the economy and inflation, Trump leads by about 20%.
So it isn't just like surface appeal, there's an issue attachment that's going on.
Meanwhile, Biden is beginning to look like he's panicking internationally.
I guess like Putin and basically just going ahead.
He hasn't really given him whether America supports him or not.
He's going to end Hamas.
Well, he's got to.
And that whole thing about they attack children could have been set up.
Yeah.
And Biden could be part of it, hiding it.
They are.
This is extraordinary.
They are pressuring Europe.
Not to put additional sanctions on Iran, even though Iran is violating the agreements that exist and the protocols that exist with regard to developing a nuclear weapon.
Both England and France want to put additional sanctions on them, and the article today that I saw describes the Biden administration as begging them not to do it in order to help their friend Iran.
It is quite clear that they are more favorable to Iran than they are to Israel.
Well, I mean, hasn't that been true for some time?
Hasn't that been true since Obama gave cash to them in the hundreds of millions?
I mean, it's...
I mean, it really is very, very hard to even justify the fact that when he says he supports Israel.
And it's really weird when you see the protesters.
I mean, it really is a testament to their complete lack of education and stupidity that they're protesting against him because of the war in Gaza.
He's doing everything he can to end that war.
And, well, maybe the protesters feel that'll push him to be more effective in ending the war.
I don't know.
But, I mean, he, in some ways, he's on their side and they're protesting.
So, I don't know what good his begging is going to do with regard to these sanctions on Iran, but why do we have an American president that wants to be more favorable to Iran than to Israel?
The Israeli protesters caused CUNY at least a million dollars in damages that they caused.
And I just want to compare this to January 6th for a minute.
Because these protests had some fires attached to them, didn't they?
Didn't they?
Didn't they?
Here.
Didn't they?
You remember any fires on January 6th?
You remember if any of those people that have been put in solitary confinement, held without bail, and put in jail for ridiculously lengthy periods of time?
You remember if they had any fires?
Zero.
And they're in jail for like 15, 20 years, including a 78-year-old grandmother got four years.
Some guy who was in there for three minutes, three minutes, got a year in jail.
These people, they're getting ready for the next protest, unhindered, collecting their money from Soros.
The attack on CUNY, and that was a picture of that, and here's a picture, the disgusting picture they're putting up, The Palestinian flag in place of the American flag.
These people should be thrown out of the United States, by the way.
They should be sent to Palestine to go fight for them.
Come on.
That's what you believe in.
If you believe in a country that rapes women and beheads children and hates America and hates Israel, go fight for them.
Don't do this.

For quite some time, I'm not sure I can remember how almost from the beginning of Biden uniformly changing the Trump policies of containing immigration, I've been warning, and so have a number of my colleagues who are of similar mind, so I'm not saying this is only me, but I've been warning that this will completely raise the stakes for a terrorist attack and will result in a terrorist attack, meaning the open border.
Remember what open border means.
Open border means that anybody can come in.
And the amount of checking and the amount of vetting that goes on is minimal.
I think, you know, one leaked out and it'll give you an idea, right?
So sometime earlier last year, I think.
They've reduced the number of questions at four.
Now, between us, Ted, and all the American people out there, wouldn't you have a little concern that China... I mean, Xi Jinping says, I want to take over the world by 2048.
I want to displace America.
I want to have a larger navy than America.
He now has it.
I want to have a larger army than America.
He's now paying for it.
I want to be the leading economy.
I even want to get rid of the dollar.
Somebody who tells you they have those ambitions, now all of a sudden you open your border completely.
You'll let anyone in.
Very little checking.
Wouldn't Xi Jinping have to be as stupid as Biden not to send people in?
Absolutely.
And you know that he's not, unfortunately.
So make yourself now a communist who wants to overthrow America.
You wouldn't be much of an adversary if you weren't taking advantage of it, right?
Right.
Or a drug dealer.
Yeah.
What kind of a drug dealer are you if you're not going to take advantage of a wide open door?
They could have, I mean, think about it.
They already have so many people.
They could send millions.
Yeah.
And so the attack on Quantico, the attack on Quantico several weeks ago, you know, is a, is a, is a, it's a warning we shouldn't even have to need.
We should have known this from the very beginning, but there's something very suspicious about it.
And therefore it just raises your concern.
And that is they won't tell you anything about it.
First of all, it took 14 or 15 days to report it.
Yeah.
Now they won't tell you.
One is definitely an illegal who just came over the border in the Biden invite him over the border program.
So he's a Biden alien.
The other is overstaying his visa.
And they met up together and they do breach Quantico saying they work for Amazon.
And Amazon delivery, quick check, turns out they weren't.
And we don't know if there was resistance or there wasn't, but they were arrested.
And that now is about 20 days ago.
Question, are they on the terrorist watch list?
No answer.
Are there ties to terrorism?
No answer.
And since September 11, the government has been rather transparent on terrorist threats, because people are concerned about it.
So there's only one reason they're holding this back, and that's because it hurts Biden, and it'll hurt him in the election, because that's all they decide by now.
What they are really worried about, and they should be worried about it, is that with the numbers of terrorists that are in this country, which their FBI director says is the largest ever, And they're people we know less about than we normally would.
Do they have an October surprise?
That's their wording, not mine.
That there might be an attack, you know, geared to really shake us up right near the election.
And the Democrats are very, very worried about that because they think, you know, that would be the coup de grace for their witless president.
To see it all as politics, though, having lived through a terrorist attack, boy, it is not, it is not all about politics.
It's about human life, and these people are absolutely despicable human beings.
I mean, this is predictable from day one.
The day he came into office, And he changed all those laws, and he did away with stay in Mexico, and he did away with this, and he's turned the border patrol into escorts at Rockefeller Center, which is what they are.
I mean, they just escort the illegals in.
It was predictable that among the group of people that would come in would be terrorists.
It's predictable.
Why do you hate America that much?
Why?
Why?

So we're gonna have a city in which people go broke gambling and walk around half-out-of-their-minds, if they aren't half-out-of-their-minds already, because it turns out that cannabis is much more dangerous to the brain than any of these yo-yos realize, maybe because they use too much cannabis.
I mean, it's kind of like self-defeating.
You use cannabis and you get dumber.
And then you make dumb decisions.
And it was a dumb decision to legalize marijuana.
It was a dumb decision and a dangerous decision, and the studies now show that marijuana is more dangerous than alcohol.
It certainly does more brain damage than alcohol.
What they relied on was it wasn't as addictive.
Well, addiction is one thing, brain damage is another.
It has a lot more to do with serious mental illness than alcoholism.
And the studies are, like, overwhelming at this point, to such an extent that Oregon is now changing its laws.
And they were the leader of, ooh, let's have all the pot we want!
I remember going into Central Park when Bloomberg was the mayor.
I like Mike mostly, but on this pot thing, he was a little potty.
And I went into the park and I lit up a cigar and the cop came over and he said, Mayor Giuliani, you're not allowed to smoke.
In the park, I said, but I can have marijuana, right?
He said, yeah, yeah, you don't get arrested for that.
I said, what happened with the cigar?
He said, I'd have to give you a ticket.
So I put out my cigar and came back home and finished it.
Imagine, imagine that.
I got the same thing in Colorado once.
I went into a store to order a cigar or to buy a cigar for, to buy some cigars for dinner.
And I had a little time and I was going to light one.
