America's Mayor Live (E303): Repercussions of the Colorado Supreme Court's Anti-Democratic Ruling

Good evening, and welcome to America's Mayor Live, and live from New York during the Christmas season, which is a very, very crowded season.
As you can see, I will tell you, I have a Some Christmas attire on because I was at the WABC Christmas party, which is the place I'm on radio at three to four every day, wabcradio.com for a very, very interesting show.
And then on Sundays, maybe the most interesting one of all, uncovering the truth from 10 to 11 with Dr. Maria.
So let's get right to Something that I guess from yesterday when I heard about it until today, right now, I haven't stopped thinking about, maybe because I'm a lawyer, maybe because I'm a mini-constitutional law expert, from having argued in the Supreme Court, argued many constitutional cases, won the award for constitutional law in law school.
I still have the book that they gave me.
The four judges that wrote that opinion raped the Constitution.
Thank you.
It was an illegal, violent ripping up, not just of the Constitution, but of a rule that holds together civilizations, called the rule of law.
Now, we decide things based on laws, not men.
I quoted for you last night the great line from A Man for All Seasons.
I'll paraphrase it.
When Sir Thomas More, St.
Thomas More, to those of us who are Catholics, St.
Thomas More tells his son-in-law who wants him to To just disobey the law without good reasons.
Ultimately, Thomas More disobeys the law for good reasons, and for that he was martyred and became a saint of the Catholic Church and is the patron saint of lawyers.
He says to his nephew, you know, Roper, this island of England is surrounded by laws.
It's surrounded by laws as it's surrounded by trees and forests.
And if you let the wind big wind that you want to embrace knock down those trees
when they come after you Roper who's going to protect you I Donald Trump has been warning us of this for five or six
years from the beginning of the time in which they began framing him I
I volunteered to be his lawyer years ago because I considered it a massive miscarriage of justice.
I get very, very angry as a former extremely successful, honest, and honorable prosecutor When innocent men are pursued, I knew he was an innocent man, and I knew he was being pursued for political reasons, and I consider that an abomination of a free government.
It has just escalated from there.
It's escalated from there because the media has embraced it.
The media has ignored it.
The media understands it.
And the media is complicit in the destruction of our rule of law.
So let's jump ahead to the decision, and I'll quickly analyze it, because I analyzed it last night, and I'm going to do a special a little bit later that'll be on for subscribers.
I'll do a short sort of technical analysis of it, so you'll be able to quickly and easily understand the legal intricacies of it, which aren't really that complicated.
But here's what happened.
For the longest time, from the time it was passed, the 14th Amendment has contained these words.
And the words were intended, and the concept was intended, so that rebels, people who had revolted against the United States of America, would not hold public office.
This was done during the Reconstruction era, where you remember it went back and forth
from being at times generous, you know, kind of Lincoln's idea.
Then Lincoln was assassinated.
Johnson, the president who succeeded him, wanted to also do it, but didn't have the political power that Lincoln had.
And also, I believe he was always suspected of being partial to the South.
Could not have certainly suspected Lincoln of that.
So those who wanted revenge against the South, took some control.
So one of the amendments they passed, of course, was the 14th Amendment, and basically it was to give due process, to make certain that former slaves, Native Americans, all had due process of law.
But it also then had two negative provisions in it, Keeping people who were rebels from holding public office.
Now, here's the language that is relevant.
It's section 3, parts of section 3, and the very, very single sentence in section 5, which is ignored by every one of the dishonest newspapers, as well as the dishonest judges.
The judges were so dishonest, for example, when they wrote up their recitation.
of what Trump did that made him responsible for the insurrection, they seem to have conveniently, as far as I can tell, not evaluated his language at the end, in which he said, go peacefully and patriotically.
In my view of the law of incitement, which is terribly close to the law of insurrection, that would virtually guarantee that you couldn't be prosecuted.
Because to be guilty of incitement, You have to almost lead the people into the riot in order to protect First Amendment rights, which allow you to lie, to get over emotional.
It doesn't allow you to create violence.
But the words have to be extraordinarily unambiguous, strong, and almost always some action has to be attached to it.
None of that applied to Trump, including his clarifying whatever misimpression there was by telling people to go peacefully and patriotically.
But here's what they are relying on in order to destroy democracy and the rule of law in America.
And take off the ballot the man who right now seems to be the choice for President of the United States, not of the crooked Democrats, but of the American people.
But the crooked Democrats really have changed this country for a country not of the people, for the people, and by the people, but of the crooked Democrats, for the crooked Democrats, and by the crooked Democrats.
Because they're in that golden circle where they can destroy emails and they can take $31 million from China and $10 million from Ukraine and they can carry guns in violation of law and it takes five years to catch up with them or they can launder money and they don't get prosecuted and Republicans get prosecuted for things that nobody ever heard of as crimes before.
So the, The prohibition here is, and I'd like to put the words up on the screen, because they're very important.
No person shall be a senator or representative in Congress, or elector of president and vice president, or hold any office, then go to the word who, having previously taken an oath, Then it's just repetitious, and you go on.
Shall have engaged in insurrection.
So those are the operative, what we call the operative words.
No person shall be a Senator, Representative in Congress, or Elector of President and Vice-President, or hold any office, civil or military, under the United States, who having previously taken an oath, shall have engaged in insurrection.
The question is, if this were meant to disqualify someone for president or vice president, why are senators and representatives mentioned but not president and vice president?
And we should not be rewriting the Constitution and putting things there that aren't there Unless we are scoundrels and dishonest people.
This does not apply to the President of the United States.
If they wanted to apply it to the President of the United States, believe me, they knew the word President.
They knew the word Vice President.
It would have come before a Senator or Representative.
And there is no good argument That you can take a catch-all phrase like, hold any office, and consider the presidency and vice presidency any office.
That's reason number one why these four judges are intellectual prostitutes.
Do not deserve the name judge.
It is not coincidental that they're all Democrats.
It is not coincidental that every one of the four trials lined up for next year, which is unheard of, done to prevent him from being president.
Every single one is a Democratic prosecutor.
And with the exception of the one in Florida, Uh, which is in a federal court.
It's held in a crooked democratic city.
These are four Democrats.
So they write the word president in there.
It's not fair.
In order to disqualify a person from running for president who was otherwise qualified at this point, looks like the choice of the people The provision would have to be precise and unambiguous.
I do not see the word president there or vice president, except for electors.
It tells me they knew how to use the word president or vice president, but they didn't use it.
Strike one.
Strike two, before we get to the insurrection part, is section five.
The Congress shall have the power to enforce by appropriate legislation the provisions of this article.
Power is not implied in the Constitution.
You don't infer power from the Constitution.
One of the most basic things about constitutional interpretation, so that it can remain a country of laws and not men, is that power is specifically granted.
Who has the power to enforce this legislation?
The Congress shall have the power to enforce, by appropriate legislation, the provisions of this article.
Where is the appropriate legislation?
It doesn't exist.
Where is there legislation where Congress says it applies to the president?
It doesn't exist.
Where is it?
It's in the warped minds of these judges who have committed legal sacrilege and raped the Constitution and finally shall have engaged in insurrection.
It doesn't say president.
Congress has provided no enforcement mechanism or included the president.
So how do you decide whether he committed insurrection?
There's nothing here that grants these judges or their courts the right to hold a trial.
And what kind of trial is it?
The trial was in total violation of due process.
They relied on rank hearsay from a highly prejudiced, completely discredited source.
The J6 committee made up, again, only of Democrats, no sanctioned Republicans, and two Republicans that despise the president so much they have to take pills to relax themselves.
I think.
And it doesn't work very well.
So they're taking their evidence from a lynch mob of highly disreputable congressmen who got caught lying about Russian collusion.
They didn't have any witnesses.
They weren't there.
The people they got the evidence from weren't there.
Finally, the people in the best place to come to a conclusion, even an unfair one of insurrection, was the special prosecutor.
Well, he's indicted about a thousand people.
You can't just decide the president engaged in insurrection.
When nobody has been charged with insurrection.
Nobody!
Who did the insurrection with him?
He hasn't been charged with insurrection.
And nobody else has been charged with insurrection.
And a thousand people have been charged.
More important than that, there's been no proof of insurrection.
No one's been convicted of it.
No one is on trial to be convicted of it.
And if you look at the facts of the case, not from the eyes of the warped, dishonest criminals on the J6 committee who tried to, by illegal means, remove a legally elected president through the Russian collusion, frame-up, or the hard drive cover-up, these are like real crimes.
These are like stealing an election crimes.
The hard drive hiding it wasn't stealing an election.
These are the people that they rely on for something that's unheard of in the law.
You convict somebody based on a report of a committee in which cross-examination wasn't allowed.
Right to counsel was regularly Quashed?
Leaking?
Was abundant?
I think they may have gotten rid of their transcripts.
They're so embarrassed of what they did.
But there was no insurrection.
Beyond everything else.
You and I know enough of the facts now to know there was no insurrection.
It just begins and ends with the fact that nobody had a weapon.
What the hell kind of insurrection was this?
With pitchforks?
Are these people crazy?
Insurrection?
I mean, the only thing they could have done that would indicate they are crazier, more evil, or more corrupt than they are, is to say it was worse than September 11th, or Pearl Harbor, or the Civil War, as some of them, as some of the Democrats have done.
And it's turning out, with the revelation of all of the film that has been released, of which 95% is still being withheld by these criminals, that this was very different than we thought.
There were an undetermined large number of FBI agents in there, and an undetermined large number of anti-Trump people in there.
The wrongdoers, the Democrats who were doing the framing, refused to give up all of the film.
And even the film that has been shown is only 5% so far, and Johnson hasn't released all of it yet.
I don't know what he's waiting for.
But the reality is, Pelosi wouldn't have been sitting on her material, which she's still sitting on, and the rest of them wouldn't, if it was going to help them.
There is absolutely no basis anywhere in the law, in life, or in this universe for a finding of insurrection.
Maybe it was a riot, or maybe it wasn't a riot, and maybe it was as much a product of entrapment as anything else by an entirely corrupt and corrupted FBI.
All of that is possible.
What is not possible is that it was an insurrection.
If this isn't reversed by the Supreme Court, this country's gone.
I mean, the head of El Salvador said that we have, you know, we, America, has one of the most corrupt legal systems in the world now.
He's right.
This doesn't stand alone, my friends.
This comes after Hillary Clinton committed every damn crime that you could imagine.
Joe Biden has had 30 years of taking millions and millions of dollars.
From the day it came out, it was as clear as the nose on your face that he was taking bribes.
When he said I never talked to my son about it?
Didn't you know he was lying?
When Hunter got $5 million from a crooked Ukrainian?
Who or what would be in Hunter's world that would be worth $5 million?
His drugs?
You've got to be a fool not to know that Biden is a massive crook.
And you don't have to just know it now.
All you have to do is take the time to go look at my podcast, which lay out a great deal of the material from the hard drive, which is conclusive, including Joe's own words in which he convicts himself.
We have had sitting in the White House for all this time, a man who could have been convicted a year before he went into the White House of not just bribery, but racketeering.
He is a 30 to 35 year, uh, habitual criminal.
And, and he is not the only one in his family.
Uh, that family, um, that family makes a mockery out of this country.
And he's also cost many, many lives because of his utter, complete incompetence.
Think of one alone.
Would there be a war in Ukraine if Trump had been elected president and they hadn't cheated?
Uh-uh.
You know there wouldn't have been.
Well, while the Biden regime is, by degrees, removing our Constitution and moving us toward a communist, fascist, or whatever you would like to call it, state, In which people are treated diametrically differently in court, depending on their situation with the regime in power.
They are also doing an excellent job of encouraging an invasion of the United States.
The border situation is nothing other than an invasion.
To change the nature of the United States of America and to destroy it as the country that we knew.
Just think of all of the preparation for it with the tearing down of statues, the rewriting of history, all of the things done to get people to hate America.
Angry words that come from Democrats about America.
Going back to Prince Obama, who began this well-trained by communists as a young man, who began this with his apology tour.
Uh, never had a good word really to say for America.
I once was castigated terribly for saying, and I really said it quite honestly, just sort of like thinking.
I said, I don't really ever have heard Obama say anything about loving America.
They always remember every president talks about loving in America.
I don't remember Obama saying, and I got accused of being a racist.
Didn't say it because he was black.
I said it because he never said he loved America.
I just said that about a white guy.
Or a yellow guy or a pink guy or a green guy or any guy who didn't talk about America if they were president.
I don't like people who don't love America, particularly if they have every reason to love America.
I don't like his wife for saying that the only good thing that ever happened here was his pathetic election.

Well, the border crisis is out of control.
A couple of weeks ago, about two weeks ago, Biden reached a record for the most illegals coming in in one day.
You should know that on Monday or Tuesday?
Monday.
On Monday, he exceeded that record.
He went to 12,600 migrants in one day, coming in illegally, mostly across the Rio Grande, lying about seeking asylum.
Of the people that come over that are really entitled to asylum, when you shake it out, it comes out to less than 10%.
That means they're 90% on the line and being told to lie.
And sometimes they don't even bother to lie because we've got evidence here of people that never even made the right statements and they just were taken in and paroled.
What happens is they come in, they say the magic words, I'm afraid to go back for political reasons, and then they're given a court date and they're let go and they come back three years from now.
And on our dime, we bust them, take them to New York, Chicago, Los Angeles.
Sometimes they complain where they are and they go someplace else.
But now the numbers are getting at invasion status.
And this should be a matter of impeachment, because he has done it to such an extent that he's violated his oath of office to execute the laws of the United States.
Nothing of what he's doing is legal.
He came up with a big, big lie with Mayorkas.
Is there anybody in that administration that's honest?
I don't know.
You know something?
You wouldn't work for Biden.
I wouldn't work for Biden.
Would you work for a crook like that?
No, absolutely not.
You've got to be dishonest to work with him.
You've got to be a fool.
You don't believe all this evidence of, like, the kid was really keeping all that money.

I mean, Mayorkas, except for the fact that I have no evidence that Mayorkas is financially corrupt the way Biden is, Mayorkas is like a piece of shit.

Well, I'm going to treat you to a couple of numbers.

What do they say?
Numbers don't lie?

And that's the reason why Biden can't pronounce numbers.

So he and Mayorkas came up with this con job this last year.

If you do that, the presumption is going to be that it's granted.

So now we've been doing it for almost a year and we're in more trouble than we were before we were doing it.
We have more people coming in illegally.
You know why?
Because they don't stick to it.
The people use the app, they come in, they're added to the illegals because nothing that says they really are entitled to asylum, they just say it.
But worse than that, large numbers, a couple hundred thousand come in ignoring the app.
They're supposed to be thrown out.
Less than 30% of them are thrown out and almost 80% of them are accepted by just saying, oh, we forgot.
And then they're stuck in New York or Chicago or... Now here are the numbers that I'm going to show you.
I want you to see this because it's, you gotta see it to understand it and why Trump has to be president.

So those top numbers, let me just move this around so I can see them too.

We go back to the, we're looking at right now, where they were going to improve things, right?
August?
August of this year, 304,000.
That was a record, by the way.
With the new program, they hit a record.
Then, look, they did even more in September.
And then a slight reduction, but again, highest ever.
This is with the new program, to cut it down.
Now, let's see how we did under Trump.
Just a little comparison here.
Under Trump, we did $420,000 in 2020.
The next year, we did $1.9 million.
The next year, $2.8 million.
And this year, the estimate is probably low at $3.2.
We did 1.9 million, the next year, 3.8 million and 2.8 million.
This year, the estimate is probably low at 3.2.
Some people think it'll be as high as 4.
We're talking about like 5, 6, 7, 8, 10 times the numbers that were coming in on the chart.

He sometimes gets in one month more people than Trump got in an entire year.
Do you realize the difference?
And do you realize that he's given away our country by America?
You cannot allow anybody that wants to walk in, in whatever numbers they want to walk in, to come in your country and expect that you're going to have a country based on shared anything.
And the people are, because of the vacuum left by the dim-witted communists in the White House and the communists around him, our immigration is being guided by the Mexican cartels.

One war is against our constitution and we're losing it.
And the other war is against our country, an invasion to take away our way of life.
And they're winning that one too.
And we have got to get serious about this.

Okay, so let's go to the map.
This is our border right here.

From here all the way up to there.
From I guess we're looking at Texas.
This is Brownsville, Texas.

It encompasses mostly Texas.
A bit of New Mexico right here.
Just this New Mexico.
A good deal of Arizona and a small part of California.
Now, recently, in their utter lack of wisdom, the Biden administration closed down some of the border points.
And you would think that that would make things easier, but no, what has happened is it's created now a backlog of legal people who are taking hours and days to come in during the Christmas season.
They cut down one here in Eagle Pass, right here, which is a big one.
They cut one down over here in Arizona and another one in Arizona and several other smaller ones.
So what's happening is the people that would come in that way legally, who work in Mexico or work in the United States or want to go shopping in America or in Mexico, they've got to go all the way out of their way.
In some cases, two hours more, which is creating chaos.
Now, what does the chaos do?
Right on the other side of the border.
I could almost slip these right down here if you wanted me to.

Oh, again, I need a couple more over here.

See these?
And over here, those are locations for the four main Mexican cartels and the 20 or so
sub-cartels, smaller cartels, the ones who were operating in the room that's left
by the big ones, the cheaper stuff that they're not going to pay attention to.
For example, Cartels for 20 years have very close relationship with the Red Chinese.
Even before fentanyl, they were doing drugs with the Chinese.
And they've made billions with the Chinese.
They are operatives of the Chinese Communist government.
Subcontractors.
They have, from the very beginning, had a close relation with ISIS, but they have a close relationship with all of the Islamic terrorist groups.
They of course have close relationship with the other drug groups that operate, still operate in Columbia, that operate in the golden, what's called the golden triangle, which is down in here.
A lot of the drugs come up from, a lot of the drugs come up that way too.
There's a, there are a couple of sea routes like this, and then land routes, which I can all, I can trace.
I have maps of all of them.
So, since there's a vacuum and we don't control the border, we let anyone in who wants to come in.
We do very little vetting.
We know very little about them because there are too many for us to process.
Look, we went from 420,000 a year to 3 million a year.
And we have basically the same Numbers, if not less.
So, we're letting anyone in who wants to come in.
Finally, when you have a crisis like this, and you start moving things around like they did, you make unapprehended entry much easier.
They call it gotaways.
But there are really three categories.
There are the people that we encounter who come in illegally.
You would think that was good we encountered.
No, no.
80% of them come through.
80% of them that came in that way are sitting next to you somewhere, probably not working, and possibly selling drugs, involved in the biggest human trafficking scheme in the world.
America now leads the world in human trafficking, particularly sex trafficking, due to Joe Biden.
We lead the world in fentanyl, completely due to Joe Biden.
The Chinese are conducting a war with us by killing our young people with fentanyl, which they bring up through Mexico.
We do nothing about it.
We don't stop them.
When they're bringing over fentanyl, they know to use the room that's created between the areas that we're patrolling.
The more we have to patrol, the more room they have, the more we're taken up with illegal people that we capture, the more time and room they have for illegal people we're never going to get to see.
Now here's the strange part of it.
There were three categories.
I told you category number one are the people that we call encounters.
The numbers I showed you were encounters.
Of those, 80% come in.
Oh, and by the way, under Trump, the number was much lower.
I'd have to get that for you.
As you imagine, he was much tougher on granting these things, because he actually applied the law.
God forbid Biden should do that.
I mean, if he doesn't do it in his personal life, why the hell would he do it for you?
So, these people come in, they get encountered, we write their names down, we know nothing else about them, and they come through.
Then we have gotaways.
These are people that we want to capture.
We actually see them, but we can't get them because we're so busy with the group that we're putting on buses and sending all over the country.
And the busier we are, right, as that number went from 400,000 to 2 million and to 3 million and to 3.5 million, We've become busier and busier and busier.
And we miss more and more people.
But we keep a record of them.
30 just got through.
50 just got through.
60 just got through.
That's roughly 50% of the people we encounter.
So if last year, what did I say?
I said that 23 is probably going to end at about 3.2 million.
Add another one million, at least, conservatively to that, to people that are gotaways.
We wrote them down somewhere, you know, 30 males just came through.
We weren't able to stop them.
Very rarely are they, basically these are, and all this stuff about families, forget it.
That's liberal horseshit.
Most of these people are military age men, particularly the ones from China.
They're almost all men who look like they could easily be spies.
Is there any reason why China wouldn't send spies to the United States?
We're inviting them.
Biden even closed down the program to throw out the spies that Trump had.
Well, I mean, China owns them.
What do you expect he's going to do?
You voted for him.
I didn't.
Could you please get rid of him this time?
Beyond the gotaways there, you never get to see them.
They weren't in the group that you got to see.
They're the ones who paid the big money.
They're the ones who are bringing in the big time fentanyl.
They're the ones that are the big time terrorists.
They're the ones who are the heads of the sex trafficking rings.
And they're giving the cartels a million dollars or $2 million.
And the cartels are guaranteeing uninterrupted entry.
And with a border that large, And a border force so overwhelmed and dispirited and demoralized and attacked by its own president and chief who falsely accused them of whipping people?
You think they forgot, Joe?
You think they forgot that you are a damn liar?
You think they have this much respect for you?
Yeah, you're the president, but you're not a man.
They know how many Americans you left behind to die in Afghanistan, you bum!
I know men and women in uniform!
They respect honor!
You have no honor!
You're a disgrace to this country!
It's an embarrassment to be an American with you as president.
The proudest thing I can say is I didn't vote for you, I work like hell to stop you from being elected, and I'm being persecuted by you and your fellow Democrats for telling the truth about you, you miserable bum.
And history will record that you are the worst president in the history of this country.
Not even going to be close.
But boy, we gotta get through the next year.
So, that's what we face.
If you want to take a look over here, you can get a little picture, just a little picture, of what it looks like on any given day at the border with these records being set.
That border, by the way, I believe is El Paso, which, just in case, before we take the map away, I love maps, I can't help it.

Gonna tell you a funny story about El Paso if I can.
I was in El Paso about 10 years ago.
It was at the time QAnon Juarez, right here, was the most dangerous city, they said, in I think in our hemisphere.
El Paso was one of the safest at the time.
Largely because the drug dealers would take their families and the big time drug dealers, and this was during the Obama administration, where things were bad, but not as bad as this.
And they all live in El Paso.
So the drug dealers, kind of like what the mafia did in their neighborhoods, the drug dealers would keep El Paso pretty damn safe.
And like their children, their daughters would go to high school in, they go to Catholic high school in El Paso, but they come from Juarez, or maybe further down.
So I went and against all advice, for security reasons and whatever, I went and gave a speech on reducing crime in, back to back, El Paso, Cuidad Juarez, I was in Juarez for about eight hours.
Took a tour with the mayor, took a tour with the police commissioner.
Had a great program.
They were like nervous I was gonna get shot.
I told them that I don't get shot.
So the day was over and I really had some very excellent, made some excellent progress.
I think with the police commissioner on things that he could do.
And we had just been enormously successful in reducing crime in Medellin, in Brazil, and he knew that.
And we were telling him, John Huvane and I were telling him, you know, what we did.
And I said to John, maybe we should have dinner with him.
So we said, you know, why don't you find a restaurant here in Juarez and we'll have dinner and then we'll go back.
He said, oh, I'm going home.
I said, okay, but you know, you could go home.
He said, yeah, I'm going home too.
Oh, don't tell anybody, but I live in El Paso.
He said, we could have dinner in El Paso.
I said, you're the police commissioner of Juarez and you live in El Paso?
He said, yeah, yeah.
And we could have dinner with the mayor.
He lives there too.
That's absolutely true.
Because Juarez was so dangerous.
Now, I will say.
That's amazing.
They did a good job for a while of cleaning up Juarez.
And a little bit with my recommendations, but I actually did more work in Colombia than Mexico.
Always had trouble in Mexico because somehow or other, I just didn't have confidence in the Mexican police.
And my reputation was on the line.
And so I would give them advice, but I wouldn't get involved in a program unless I could trust the police were going to carry it out.
And also they were going to clean up their corruption.
Yeah.
So have you taken a look at the... Yeah.
At the numbers there?
Look at that.
Look at that.
