Dennis Prager Show - John Fund: How is H.R. 1 Even Legal? Aired: 2021-03-09 Duration: 06:57 === Government Overreach in Elections (03:02) === [00:00:00] Fund is known affectionately and respectfully as the Dean of American Journalists. [00:00:05] Forty years in the profession is never seen as dangerous a bill as H.R.1. [00:00:11] It's a takeover of elections to benefit Democrats. [00:00:16] It is truly, it is third world corruption. [00:00:19] I really never thought I would use these words to describe something in America. [00:00:25] So I need to understand, John, I really... [00:00:28] When I say that, my listeners know it's not a euphemism for I just want to ask a question. [00:00:33] I don't understand how the government, the federal government, can tell states how to vote. [00:00:44] The Constitution gives the states the right to conduct elections as they wish. [00:00:51] But there is a carve-out for Congress, and this would be if there was a rogue state that prevented people from voting. [00:00:58] We had a civil rights struggle in the 1960s over that that allows Congress to override the states in an emergency, and it has only been used in emergency situations. [00:01:10] This would take that provision and expand it to the edges of the universe and basically have a federal takeover of all state election laws. [00:01:23] Would or could that be challenged in the courts? [00:01:27] It would be challenged in the courts, but the law cleverly says that any challenge to H.R. 1 must be filed with the U.S. Circuit Court of Appeals for the District of Columbia. [00:01:40] That court was packed with liberal activist Democrats by Harry Reid. [00:01:45] Six years ago, they blew up the filibuster for judges just to make sure that four liberal judges could be added to that court. [00:01:53] Almost certainly reject any constitutional challenge to H.R. 1. Then the only appeal would be to the U.S. Supreme Court. [00:02:01] And then, of course, the same forces that have intimidated some justices on that court would be brought to bear. [00:02:07] So while the U.S. Supreme Court may well strike it down, would they strike down all of it or just portions of it? [00:02:15] And can we count on them doing that, or should we stop it now? [00:02:19] We should stop it now. [00:02:22] It's extremely scary, and I don't get scared easily. [00:02:26] So give some of the worst provisions. [00:02:29] Well, it mandates that all states must allow all felons to vote. [00:02:34] It forces same-day voter registration on states, which has been shown over and over again to encourage voter fraud. [00:02:42] It limits the ability of states to talk to each other to see if people are registered in one or more state. === California's Complex Voter Registration (04:09) === [00:02:48] It prevents any cleanup of voter rolls within six months of an election, which means the dead will be fully enfranchised. [00:02:56] And look, I admire our ancestors, but I don't believe in representation without respiration. [00:03:03] And it bans states from making any laws regulating voting by mail. [00:03:08] It demands that states adopt new redistricting commissions, which often are designed in such a way as to benefit one party or another. [00:03:18] It mandates that mandatory voter registration. [00:03:24] In other words, if your name appears on any government list, Dennis, the DMV, the property tax rolls, Medicare, anything, you are automatically registered to vote. [00:03:37] Now, many people appear on more than one list for the government. [00:03:40] In fact, some appear on dozens. [00:03:42] Well, all of you would be registered. [00:03:44] Including all variations of your name, middle, initial, and everything else. [00:03:47] That would create an incredible confusion and chaos, which clever people could use to manipulate and cast votes on your behalf or many of your doppelganger parts. [00:04:03] You know, it's interesting. [00:04:04] I don't know how much you follow this, but we have a recall campaign here where I live in California. [00:04:11] It is, of course, with regard to Gavin Newsom as governor. [00:04:14] They are so strict with regard to the credibility of each vote that even though you can have the recall election with 1.5 million signatures, they try for nearly 2 million because so many are thrown out because the color of the ink was not proper, the signature was not fully there. [00:04:38] On that, they're really strict. [00:04:41] Boy, have you identified their hypocrisy. [00:04:45] I'm from California, as you know, Dennis. [00:04:48] And here's just two things you have to know about how California election law is conducted. [00:04:54] California will ignore people registering to vote if they have problems with their paperwork. [00:05:04] But they will, of course, enforce it for the recall of a Democratic governor. [00:05:07] And California is the only state in the country where it is illegal. [00:05:11] An election worker, an election official can go to jail if they ask someone for their voter ID. And will that be the national law under H.R. 1? [00:05:23] H.R. 1 is 975 pages. [00:05:27] 975 pages just on voting law? [00:05:31] Oh, I'm sorry. [00:05:31] The table of contents is 24 pages. [00:05:36] I'm going to put you on the spot. [00:05:38] Did you read it? [00:05:39] I have read summaries of it. [00:05:41] I am skimming the rest of it. [00:05:43] I do not believe, as of yet, that they make it a requirement that every state make it illegal to ask for a voter ID. But remember, the voter ID law is gutted because they basically make it meaningless. [00:05:56] Right. [00:05:57] You also mentioned... [00:05:59] The length of time. [00:06:01] We have gone from election day to election month. [00:06:05] What exactly are they trying to do? [00:06:08] Well, think about this, Dennis. [00:06:09] Everything in your life happens faster and more conveniently than it ever did. [00:06:14] I mean, you can get a package delivered by Amazon in two hours. [00:06:17] uh... [00:06:18] you can get almost anything instantly uh... [00:06:21] the internet in terms of looking up something the only thing in our life that has slowed down since you and i were younger election results Because so many people are being encouraged or compelled to vote by mail. [00:06:35] We have an election month in which people vote by mail in advance of the election, sometimes even before the debates are finished. [00:06:43] Then we have an election day where we count those people who insist on voting at the polls. [00:06:48] And then we have an election month afterwards so we can have courts fight about it and count the ballots. [00:06:55] All right, hold on to remember the California point.
