U.S. President Donald Trump is set to give his first formal State of the Union speech of his second term, and it's likely to be a long night of choreographed tension and conflict.
He will call on Democrats in Congress to reopen the Department of Homeland Security.
It's despicable that they have shut down this agency that is responsible not just for the deportations of murderers and criminals whom none of you, including Democrat politicians, would want living in your communities, but also FEMA, who is on the ground in the Northeast right now, restoring electricity and power for families who have been impacted by the blizzard.
The United States Secret Service, which of course is essential to protecting the president of the United States, they just did honorably this past weekend when an armed crazy person intruded at the president's personal property in Florida.
These are great men and women who are working around the clock to keep our homeland safe, and it's terrible that Democrat politicians have shut them down.
Zoron Momdani getting slammed for his latest proposal calling on New Yorkers to sign up to become emergency snow shovelers.
Over the weekend, he announced that anyone who wanted to shovel for the city had to show multiple forms of identification with photo IDs, copies of those forms, and even a social security card.
Critics are calling out his hypocrisy for requiring strict documentation to shovel city streets, but no idea or proof of citizenship to vote in elections.
Multiple sources tell CBS News that President Trump is growing increasingly frustrated with what aides describe as the limits on military leverage against Iran.
U.S. military has beefed up its presence in the Middle East while American officials negotiate with Tehran over its nuclear program.
Several airlines have resumed flights out of Mexico.
The State Department says Americans in several parts of Mexico, including Guadalajara and Puerto Vallarta, should continue to shelter in place.
This all stemming from the military operation over the weekend that killed notorious cartel leader El Mencho.
His death led to a battle between heavily armed Mexican security forces and cartel gunmen who set cars and buildings on fire and blocked roads in dozens of states.
Mexican authorities say 25 members of the National Guard were killed.
The man accused of shooting and killing Charlie Kirk will also be in court today.
The hearing will be held this morning online where a judge is expected to rule on a motion to dismiss the Utah County Prosecutor's Office over an alleged conflict of interest.
Before the court is defendant's motion to disqualify Utah County Attorney's Office, defendant argues that high-level prosecutor assigned to this case has a concurrent conflict of interest.
And because no efforts were made to screen him, the entire office should be disqualified.
Because defendant has not established a factual basis for a finding of conflict of interest.
His motion is respectfully denied.

Erica Kirk, of course, he saw the announcement just came out right before we went live today that Erica Kirk, yes, has been announced as one of the special guests who will be arriving to the State of the Union at the behest and invitation of President Donald J. Trump.
And he is expected to make a statement on political violence.
This is the scourge of our nation.
It is the greatest single immediate threat to everything that we are fighting for.
Because as we fight and continue to put up cultural victories and cultural wins across the board, the other side is getting more and more violent.
And I just wanted to say thank you to President Trump for honoring Erica in this way and showing that, of course, the victims of political violence, the victims of leftist violence, don't just include the immediate victim, but also the families they leave behind, Erica and the two young children.
And God bless them.
My prayers are always with them.
And of course, so glad that they are going to be there.
Also glad to see, by the way, that Team USA has just landed.
Presidential aircraft sent for them.
They've just landed at Joint Base Andrews.
We're seeing there's some live stream footage of that right now.
That's the same base, the same runway, the same airstrip where President Trump and Air Force One just were when they were there recently.
Of course, that's where the president flies out of.
That's the president's personal airport, if you look at it that way, just down the road from Washington, D.C.
So of course, Team USA and this incredible victory will be present as well at the president's invitation and behest.
We're going to talk about that in a second.
But also on the legal front, Tyler Robinson, his case just saw a huge ruling earlier today, just moments ago, where the judge in Utah ruled against Tyler Robinson's defense lawyer and their motion to strike the prosecutors from the case.
They have been shot down because that ruling was a joke.
It was desperate.
We told you it was desperate.
We told you it was a long shot move.
And the reason that they are pushing these desperate moves is they have nothing.

The golden goal for the United States for the first time since the 1980 miracle, the United States takes the gold.
The United States wins the gold medal here in the lawn.
One minute, 41 seconds into overtime.
All right, so this has led to a lot of conversation and a lot of discourse online about what does it mean to support America?
What does it mean to be on Team USA?
Team USA representing the country.
You also saw this with Alyssa Liu, and I had one of the, I think, initial posts that went really, really viral about this when she won the gold, talking about how her father was a dissident in communist China or had left communist China during the Tiananmen Square protests, which led to the massacre, and then how the Chinese government at the CCP had tried to get her to play for their team the same way they did with Eileen Gu.
Of course, she knew how much money she could make had she done that.
She refused.
She played for Team USA, she competed for Team USA.
She won the gold clearly in her own very unique way, Manic Pixie Skater Girl.
And she won, I think, the hearts of America.
She's America's sweetheart right now, there's no question.
And so, this has led to a lot of problems for the left because, of course, they bet against America and have been doing so for a decade.
Here to help make some sense of this in studio is Aaron McIntyre.

This discourse is so interesting because it's like, this is the stuff that you and I have been talking about for about a year at this point.
And it's so awkward when you try to put these things into words.
We don't really have a good vocabulary for it.
And when we try to make one, it ends up sounding like really weird and awkward.
But then something like this happens, Team USA wins, and you wave the flag and you feel good about being an American.
That's what we've been talking about the whole time, isn't it?
Yeah, what's nationalism?
Well, I know it when I see it.
There it is.
There it is.
Exactly.
Right.
And this is so funny because, as you say, the left has made their entire identity about dismantling nationalism, being embarrassed by your country.
We see the Huffington Post talking about how it should be embarrassing for you to wave the flag or if you feel bad when you see people celebrating America, it's okay.
That's just who the left are.
And hilariously, they want to talk about how this Olympics speaks to something about how we can't have immigration controls, how having a real national identity is going to keep us from winning at the Olympics.
But it's exactly the opposite.
By understanding who the American people are and what we're celebrating together, one of these Olympic games, one of these amazing victories really binds us in a way that nothing else can.
And so while the left are running around looking like losers, complaining about America dominating all these other nations, conservatives, nationalists, right-wingers, we can all just celebrate together saying, yeah, this is exactly who we are.
We're victorious people and that's what matters.
You know, and it also reminds me, by the way, of Bad Bunny, right?
Remember, he was trying to push just a couple weeks ago the last big sporting event that we had where this new sort of like globalist Mex American.
We're in the Glenn Beck studio, so I might as well say it, Mex Americanada, as Glenn used to put it.
And, you know, they were going to blend all the countries together.
And that's kind of what Bad Bunny was pushing, this notion.
You hear this, by the way, from like the woke Latinx crowd all the time, that, oh, America's a continent and we're all Americans.
It's like, no, that's not what people mean when they say America.
But of course, they were making that same argument that America is this expansive, nebulous term.
No, it's not.
No, it's not.
Are you rooting?
Were you rooting for Team USA?
That's what makes you an American.
And okay, I don't want to single anyone out here, but I'll just say there's someone that I was at an event with recently who happens to hail from Canada, although she currently lives in the United States.
And it's nothing personal, but I remember asking, oh, so, you know, which team are you rooting for?
And she's like, I was rooting for Team Canada.
I'm a Canadian.
And it's like, yeah, I totally get that.
That's where you're from.
That's your nation.
And, you know, there's winners and there's losers.
What can I say?
But that's what it's all about, right?
It's really, it is something nebulous in the sense that you can be a member of another nation regardless of where you're physically present.
You know what I'm saying?
Yeah, and that's really, I think, the test here.
Once again, the left has tried to make this.
You're exactly right.
It's a tangible test.
That's exactly what this is, which we don't usually get.
Exactly.
You really put all your chips on the table.
Who are you siding with?
You have to choose now.
And so many of these athletes we've seen are really just treating America as an economic zone.
They come here to be part of a professional sports team or to train with some of the best in the world.
But when it comes to actually representing, they want to be somewhere else.
They might want to live here, but they want to represent some other people.
And again, that is a test.
We know who you are and who you're loyal to.
You are loyal.
Well, and that's the other Chinese skier, this Eileen Gu, who she's born in the United States.
She lives in the United States.
As far as I know, she trains in the United States, and yet she competes for Team Canada, or excuse me, Team China and makes all the money.
I think she's the highest paid athlete in the world, something like $20 million a year.
She took the money and she goes and competes for Team China.
Alyssa Liu said no.
So, there is a question of nationalism there, clearly.
Yeah, when the mercenary option is there, when you have a material gain, but you turn it down because your identity is tied to the United States.
Well, I mean, that's about as good as a gut check as you're going to get.
You're putting yourself out there.
You're denying some kind of benefit by joining another team where you might be celebrated, and you're sticking with the United States because that's who you want to be identified with.
That's who you want to take the gold home to.
And that's what really matters at the end of the day.
Don't get me wrong, there are much deeper questions when it comes to nationalism.
And you and I have discussed this on a regular basis.
But again, we rarely get this really visceral demonstration of loyalty that comes in a moment like winning the gold for the United States.
And I think that's why everybody has an easy time celebrating, even if they don't care about anyone's specific political affiliation in this moment.
Right.
And especially, so people were trying, the left was trying to say, oh, well, she's kind of woke.
And her person, nobody cares.
Yeah, nobody cares.
Like, the right is not going to care about that.
Why?
Because she didn't politicize the moment.
She didn't get up there and start parnificating on politics.
She got up there and talked about skating and talked about her personal journey.
She talked about herself.
And that's it.
She didn't try to make it about some political, oh, I'm on the ice, but I'm against ice.
Like, you know, she didn't say anything ridiculous like that, like the other skater did.
And we're just not the side that's about making the personal political.
Like ultimately, we understand people are going to differ.
That's going to be what it's about.
And we can still celebrate America.
We can still celebrate our national identity and our triumphs without forcing every single athlete to adhere to some specific ideology.
We're here to celebrate America every time.
But and I'll give you the end.
And here's the flip side of that.
The flip side is, so do you remember?
So Team USA, when they win the gold in hockey, the left is cheering them.
They have the same level of acclaim until, remember, what did they do right after?
They took a phone call from Donald Trump and they were cheering Trump.
And from that moment on, when they took the call and they were yamming it up with him, by the way, this is why regular people like Trump, because you could just tell he genuinely cares about the country, loves the team, loves the excellence.
He's going on and on about the goalie and how great he is, who actually plays for a Canadian team in the professionally, but it's like, whatever.
He's an American.
So he plays for the right team at the Olympics.
He's with Winnipeg.
And what did they do?
They immediately denounced Team USA.
So once again, you see, it's the progressives who want this kind of tyrannical fealty and loyalty to their dogma, whereas conservatives, American nationalists, patriots, whatever you want to call us, we are the ones who say, no, we just want you to be on Team America.
That's really it.
Yeah, ultimately, you recognize that, you know, I'm sure not every person on the hockey team is a huge supporter of Donald Trump or voting Republican every time, but they put that aside because that's not who they are in this moment.
They are exemplars of the American spirit.
They're out there representing us.
They're showing our excellence.
They're performing on behalf of the United States.
And in that moment, the leader of the United States is there to celebrate with them.
However, they feel about a specific policy or whatever, that's pushed to the wayside.
Because in this moment, they are just, again, exemplars of the American spirit.
And Donald Trump is the leader of that country.
And in that moment, you celebrate together, no matter your differences.
It's really as simple as that.
And it shows the differences along the political dialogue.
And by the way, if you're the type of person who had a problem with waving the flag, like Huffington Post says, then guess what?
You might just be on, what do they call it?
Oh, that's right.
The wrong side of history.

So, Arn, the way we, you know, we parse these things through, it's been a decade since, you know, I'll never forget, and Trump came in so quickly on this.
I don't even really think that Hillary Clinton went down this particular brand of sort of like anti-American wokeness.
I think that really started for me 2017 with Colin Kaepernick and the kneeling for the anthem and saying that we're gonna degrade the nation in order to promote one set of politics.
Just in my mind, that's kind of where I think it started.
Like even Hillary in 2016 wasn't willing to go to that part yet.
And then all the liberals follow suit.
And then you get places like, and people are mentioning Netflix has kind of adopted this weird global woke role and other places have adopted it as well.
And it's really put them in a very bad place because it seems to me like patriotism is back on the menu.
Patriotism is in.
Loving your country is in.
And I haven't yet seen in the discourse anyone, you know, attacking the diversity of the Team USA hockey, you know, hockey team yet.
I'm sure someone will, you know, bring that out at some point.
But then, of course, you know, the response will be, well, what about the diversity of the Team USA men's basketball team?
You know, is the obvious response.
And I guess I mean to say is, is this something that bodes well for our politics if we, if can, you know, can we actually bridge the divide here and sort of come back to a more stable place where we say, okay, we are actually all proud to be Americans and we don't have to just make everything about politics first.
I think we really are in that moment.
And I think this is a predictable cycle.
Every once in a while, the left just drives too hard, too fast, and puts himself in this position.
I think we can all remember back to different things like soldiers coming back from Vietnam and being treated terribly, being called baby killers, the attack on patriotism.
We recognize that that was ugly and brutish.
And what did that usher in?
It ushered in a Reagan-esque movement, people who were proud, wanted to celebrate, wanted to succeed, wanted to see America be celebrated again.
I think people ultimately don't want to hear their leaders hate the United States.
And the Democrats learned that lesson for a while.
Like you said, people like Hillary Clinton, they would talk about parts of America they don't like or maybe we should be ashamed of.
But there was still this general idea that we were kind of on the same team and at least they were trying to kind of perfect this thing that they cared about, even if it was flawed.
Even Obama, with his famous, well, I believe Americans believe in American exceptionalism the same way the Greeks believe in Greek exceptionalism.
And, you know, even he, which is kind of a very soft way of at least making it exceptionalism relative, that even that was excoriated at the time because it was unbelievable to hear a president saying something like that.
Yeah, and so now you have this moment where Americans have watched people just continually crap on the United States, insult every aspect of it, saying it's unredeemable.
Its people are the problem.
Its systems are the problem.
The heritage, the beliefs, the traditions are the problem, and they all need to be destroyed.
And people are just sick of that.
They're tired of that.
That's why Donald Trump was such an important figure in American electoral politics.
Donald Trump made it okay to have an American identity again.
Once again, we look at it and we say, I don't know exactly what that is.
I can't nail it down immediately, but I know Donald Trump is representing it.
I know Donald Trump is proud of it.
I know Donald Trump is not ashamed of it.
And I think that's why he was so well received, especially by conservatives.
But I think even with independent voters, they just didn't want to see this anymore.
And so watching Team USA dominate why Donald Trump is in the White House is just the perfect marriage of these patriotic aspects because it's the excellence of the United States being brought together with a leader who truly respects, understands, and wants to celebrate what America is.
It's the reinvigoration of American identity across the board.

And I think he's the perfect president to preside over that moment.
And I love that it's through sport as well because this is vitalism.
This is the type of vitalism that we, you know, so many on the right have talked about, which again, it's just an awkward thing when you put it into words.
Like, oh, we must promote vitalism.
And like, BAP talks about this and BAP speaks of this and all that stuff.
And it just gets very, it's very awkward when you talk about it.
But when you see it, when you describe it, you know, when you talk about halftime shows that aren't fake and gay and actually cool ones that just have some good rock music that people like and country music, which is still the number one searched music genre in America, then it guess it turns out, guess what?
People want that.
People want to be part of that country, whatever that is.
And it is kind of nebulous and it is hard to weigh it down.
And the left always tries to say, well, you know, and they're doing the same thing right now with the List of Loo.
They'll say, well, technically, she's the daughter of an immigrant and all this.
By the way, actual refugee.
We should point that out, shouldn't we?
That her father was an actual dissident from the Chinese Communist Party.
He was accepted here because, of course, they are our enemy.
They are someone that we are against.
We support people who stand up for freedom against the CCP.
They're not economic migrants.
In fact, they probably would have made more money if they went back to China for the 2022 Beijing Olympics.
So when it all comes down to it, I think Americanism has won the day.
And Arn McIntyre, I wanted to congratulate you since we're here today because I know that you were someone who stuck your nuck out for this very early on and took a lot of crap for it, a lot of slings and arrows.
But it's back, baby.
We're so back.
I appreciate that, man.
And yeah, I only did that because I think it is so important.
It's so critical for us to understand that the question moving forward, especially as we're tackling immigration and all these other issues, is what is an American and what can we be proud of?
And so the fact that we now have this unifying moment, I think it's huge.
It's right there.

Now, yesterday we were talking about this insane level of the violence that has come out from Mexico, this cartel violence that's being knocked off right now.
I want to go live to Oscar Blue Ramirez, who's been reporting from the ground there in Mexico for Real America's Voice all about this since things have gotten hot.
Oscar, thank God that you're safe.
Thank God that you are okay.
Tell us what's the latest.
What are you hearing?
And what should we be expecting to see coming up in the next couple of days and weeks?
Well, as everybody saw, Jack, I was reporting on the ground of what was currently happening, the burning of automobiles, that these aren't considered narco blockades after the execution and the assassination of Nemesio Oseguera Cermantes.
A lot of the people were saying he got executed on the mission led by the federal government, but no, he died in the helicopter on the way to Mexico City.
That was a big thing and a big news.
And a lot of speculation were saying, was he assassinated inside of the helicopter because of the enormous extraction of information that he has, or did he die because of the confrontation?
More than 25 military men from Mexico died on this confrontation.
The head leader of the national defense was crying yesterday on a morning conference saying that it was a great effort from the Mexican military, but they could not accomplish this without the intelligence of the American government.
That is incredible information to reaffirm that the Secretary of Defense said this, that it was a collaboration with intelligence of information provided by the American government.
Now, what has happened on the day after, we reported on that same day when there was the narco blockades, more than six vehicles that they were burned in the city of Tijuana.
This violence escalated from the central parts of the country all the way to the north borders.
In Tijuana alone, the city that I'm located, more than 22 incidents.
Why are they considered incidents, Jack?
Because they were not only burning vehicles, they were burning businesses as a sign and as a message that we still have power on these areas and we are going to terrorize the citizens if we want to.
Now, on the next day, we thought that they were going to decrease because they arrested more than 20 of these agitators and these cartel members that they were burning vehicles right here in Tijuana.
They arrested 20, but they still burned three automobiles.
And this is the video that I was recording, Jack.
Look how close they are to the border wall.
And this particular, this picture right here, right here, where they burned this vehicle in front of this vehicle, there's a large camera post on the American side by the U.S. Customs and the border agents.
It means that the cartel had the boldness and the audacity to burn it in front of the camera because they know that the level of extraction of information to execute and mention was provided by the American government.
These people are completely upset of the American government collaborating with the Mexican government.
Now, after everything has evolved, this level of increasing of violence in these cities and in the central parts of the country, they just deployed breaking news.
They deployed 103 infantry men on a naval vessel right now to Puerto Vallarta.
Why Puerto Vallarta?
In Puerto Vallarta, you have thousands of American citizens that they live there and hundreds of thousands that they vacation there.
Of course, it was a huge red flag for tourism and ultimately at the end of the day for the Mexican government to protect not only the Mexican citizens, but also the American citizens that they are located here.
You see right here on the video, the vessel that just arrived with 103 infantrymen.
Talking to our connections down there in Puerto Vallarta, they have told us that you see now the military men walking on foot on every single resort area, making sure that it's highly secure and they are in high alert, completely on high alert to protect the American citizens, to protect the resort areas.
And ultimately, not only that, to provide the security and to, we have the World Cup coming up.
Jalisco is a complete disaster, Jack.
And, you know, just a kilometer away from Akron Stadium that is going to be the host of the World Cup.
They have found more than 456 bags of human remains buried by the cartel and the mass grave.
This is the cartel that is in charge of this.
Jua del Cartel Jalisco Nova Caneracion, the guy that was recently murdered.
So you have a disaster of a city of a disaster of a state.
What the president of Mexico wants is they don't want to be, you know, this possibility of having the World Cup in this place.
They don't want them to be closing or they want the possibility to have the World Cup.
So they're trying to do the best that they can to provide the security, not only for Mexican citizens, but also for American citizens on this location.
And today, still the ongoing messages from the cartel in the city of Tijuana, they have found two narco banners in public schools.
Also, they have a body that was dropped off in the main road.
Still the violence that is increasing.
The messages are still by the organized crime.
They are completely upset.
This is the head of the snake.
And a lot of people need to understand that this criminal organization, they look up to this guy, El Mencho, as it was a god.
You know, they look up to him as it was a great leader of a great criminal organization.
We need to understand that the CJNG got two times bigger, two times stronger in technology, on territory, on land, and financially because of the four years of the Biden administration.
This is why they have this enormous technology, these Mad Max vehicles that they have been on viral videos, and they have this enormous force to threaten the country of Mexico.
So when we look at this, the CJNG, do they function almost like a separate government there on the ground, which is actually in some ways a shadow government to the actual government of Mexico in these areas?
They have taken over a lot of the territory in the central parts of the country, which tells you that they have bought off a lot of corrupt politicians.
And this is one of the reasons why there's this huge speculation of El Mencho when he was captured in the helicopter that he died out of injuries or that he was, you know, his life was taken away because of the level of extraction of information.
They were controlling a lot of the territory, Jack.
They were controlling big states like Micho Can, Jalisco, Nayarid, Colima, and border towns that it was a complete surprise for us in the border town in Tijuana that is the border that is with more transit of vehicles and pedestrians of American citizens in the world.
That is the border between Tijuana and San Isidro.
We thought that this border town was controlled by the Sinaloa Cartel.
And oh, surprise, on Saturday, we saw the relentless power that this criminal organization has due to the level of technology, due to the level of intelligence that they have and the level of connections.
Just recently, one of the mayors of Intequila, Jalisco, was arrested from the same political party of the left of the president, was arrested for extortion and kidnapping and having links to the organized crime and also directly to El Mencho.
It tells you the level of corruption, but also one thing that needs to be highlighted, the American intelligence, it is like no other.
The level of extraction of information and intelligence from the American government, it is from first class.
It is, you have never seen this.
And nobody in history has pressured the Mexican government like the Trump administration that is doing right now, extracting the information of more than 50 dirty politicians in Mexico, dismantling continuously laboratories that they were making tons and tons of fentanyl and methamphetamines to cross them illegally to the United States of America, dismantling companies that they were providing illegal precursors to Lo Chapos and Los Mayos that they were trafficking into the United States, you know, extracting more than 50 plus liters of criminal cells to the United States of America.
This, you have never seen it in history.
The Mexican president, it is pinned to the wall because of the enormous pressure and the extraction of information that the American government has over the Mexican government.
And when we see this at the same time, there's also a real danger, by the way, of course, that we know about the infiltration of the cartels in so many levels, lower levels and even higher levels of both the Mexican government and in some cases, areas of the American government, mayors, governors in some cases, members of parliament, members of Congress.
There are so many issues that we see.
So this cartel issue is not just an issue for Mexico.
This is on both sides of the border, and the political corruption is 100% real.
Human Events was one of the programs that it was reporting for so many years on this.
And you were the pioneer of this, Jack, reporting on the open borders.
This was a great opportunity for the criminal organization of the CJNG to walk and have power with human trafficking, with child trafficking, with a huge amount of trafficking of drugs and illegal substances into the United States of America.
And it was not only trafficking, it was controlling the territory on these border towns.
This is why it is a national security issue.
I said it on a video where you see the pickup truck burning in front of the camera of the border patrol.
I said this is a national security issue on both sides of the aisle.
Why?
Because this criminal organization has presence in Denver, New York, Miami, Chicago, all the border towns.
So you do not know if they are just preparing for an attack.
They're really passive right now because they know the level of the military of Mexico, how serious they're taking this.
But we cannot trust.
These are terrorists, Jack.
We cannot trust what they are going to do in the next incoming days.
This week, it is going to be extremely critical.
A lot of speculation of who is the one that is going to take over the criminal organization.
We cannot say that right now because we know that they're going to be fighting among each other for the territory and who is going to be taking over this criminal organization.
Oscar, I want to say thank you so much for your willingness to put yourself out there going up against these cartels, some of the most brutal organizations on the face of the planet.
They give ISIS a run for the money the way that they're willing to go after families, the way they're willing to go after children, the things that they have done to children on tape, targeting members of the police, the National Guard there in Mexico.
So I want to say, please stay safe, whatever we can do to help provide for your safety, security.
Please make sure that we know.
I'll tell Rob whatever checks he's got to sign, he's got to sign them if you're going downtown, man.
Because if you're going out into Indian country, we got to make sure you have the backup that you need.

So we had some movement in the Tyler Robinson case and a ruling that came down.
I talked about it at the beginning of the show.
I want to make sure we get it.
Do we have that?
If we have that clip of the judge, let's play that now.
Accused of shooting and killing Charlie Kirk will also be in court today.
The hearing will be held this morning online where a judge is expected to rule on a motion to dismiss the Utah County Prosecutor's Office over an alleged conflict of interest.
Before the court has defended the motion to disqualify Utah County Attorney's Office, defendant argues that high-level prosecutor assigned to this case has a concurrent conflict of interest.
And because no efforts were made to screen him, the entire office should be disqualified.
Because defendant has not established a factual basis for a finding of conflict of interest.
His motion is respectfully denied.
All right.
So you heard it there.
This was the Tyler Robinson motion to try to strike down the prosecutors in the case.
It was always a long shot.
It was always a Hail Mary, a desperation play, a delay tactic that we've said over and over because it just looks like this defense team for Tyler Robinson is grasping at straws.
So I want to bring in now Libby Emmons, the editor-in-chief of the Postmillennial and Human Events, who was also watching this.
Libby, wanted to get your take on the ruling.
Were you surprised that Judge Graff ruled this way, that the prosecutor was in fact— and by the way, the insinuation of bias because his daughter or one of the prosecutor's daughters were there at the trial.
And that's why the charges were brought and that's why the death penalty was sought.
I mean, it's ridiculous.
They did this because it was the assassination of Charlie Kirk and an incredibly heinous act.
And I actually appreciated when the judge ruled and he sort of chided the defense team a bit there and pointed out that defense of victims is obviously a legitimate bias to have.
That is why we have prosecutions in this country.
Libby.
Yeah, I agree with you on that.
Speedy Trial Ruling00:06:25
It was really fascinating to see this ruling come down.
I was not surprised that Judge Tony Graff ruled in favor of the Utah County Prosecutor's Office.
And yes, you are correct.
I believe that the defense attorney is trying to do everything they can to delay, delay, delay this trial.
And this was just another effort to do that.
They had tried to disqualify not just the one prosecutor whose daughter was at Utah Valley on September 10th, but tried to disqualify the entire Utah County Prosecutor's Office.
And Judge Graff went through the list of reasons why that's absolutely not reasonable to do in this case.
And I appreciated that.
I thought it was very thorough the way he marked that down.
He said that prosecutors have absolutely bias against the person that they are prosecuting.
And that's part of their job.
And that's true.
Just as defense attorneys have to do everything they can to make sure that the law is applied fairly to their client.
That's what lawyers do.
That's the point of it.
But these lawyers are going on and they are trying to delay this trial is what it looks like to me.
They've brought motion after motion, trying to, you know, keep things moving at a snail's pace.
One of the more interesting moments that I thought, and it was a very short hearing today, was when Judge Graff scolded the defense attorneys for apparently not prioritizing the scheduling of this case.
And Graff said that it's his responsibility to make sure that everybody's constitutional rights are respected.
And that includes the right to a speedy trial.
And he and also Charlie's widow, Erica Kirk, has come in and said, hey, you know, you should get on this without any undue, without any undue delays here.
And yeah, so he said, you've really got to prioritize the scheduling in this.
And the defense attorneys then did have to say, okay, for the upcoming hearing, I will clear my schedule.
I was supposed to be here or there, but I'll try and get around it.
So I thought that was good too.
And it was actually one of the firmer moments that we've seen from Graf in this whole trial so far or the hearings pre-trial so far.
Yeah, and there's, you know, this is one of the biggest.
I mean, he's made some motions in the past.
He's granted defense motions in the past, by the way, when it came to restricting cameras at the Sally ports, those entrances and exits for the defendant.
He's come down, you know, on the, he's a stick there for the rules, is kind of what it seems like to me.
And which is kind of what you want a judge to be.
Obviously, he's been very strict as well with the camera operator saying, look, you know, I don't want you being too close to Tyler Robinson.
There's concerns about lip syncing, which I've or lip reading, which I've never, you know, heard of before in a case.
I remember when Kyle Rittenhouse was on trial, I mean, you could see him the entire time, or Brian Koberger, or any of these other defendants in cases where typically they are on camera.
And so, you know, one of the first instances I've heard of that, but at the same time, here saying, look, you guys need to prioritize this case.
This is a case, which he understands because think of it, their argument is incoherent because on one side, they're trying to say, oh, there's so much media scrutiny.
This is such a high-profile case.
But on the other side, they're also saying that, oh, well, you know, we've got other stuff to do and these hearings, there's just too many of them and can't really get it on the schedule.
We've got to say, so which is it?
Or is this a high-priority case or not?
And then to your point as well, Erica Kirk also made a motion, which under Utah law has this unique, this unique feature to it, where victims are able to come in and invoke a sort of more strenuous right of speedy trial that they have at the state level to say, I want to use whatever legal power I have as a victim.
And of course, the victim advocate for the estate of Charlie Kirk.
So because, of course, obviously he is not able to be there present himself because he was murdered, that Erica is speaking in lieu of Charlie.
So of course, she is his advocate officially by the court.
So that's an official standing that she has within the case.
And that will certainly come up if he is convicted.
That will come up during the death penalty phase.
Important to note.
And she has invoked this right to a speedy trial under Utah law.
That's what the judge was referring to to say, look, you know, I've got to balance this all out.
And you guys are sitting here telling me that you don't have time in your calendar for it.
You know, you're trying to push it off till May.
What about March?
What about April?
What else can we do here?
What are you really waiting for?
When, you know, Libby, we see this, that the tactics that they are spending time on are ridiculous.
Yeah, I think that that's right.
And the judge also said that he was going to hold to the May trial date for the basically the preliminary hearing in the trial to move forward.
And that's, I think, that's the arraignment, right?
Yeah, that's the arraignment.
I'm sorry.
Yeah, that's the arrangement.
And that's in May.
And he said that's pretty much fixed.
He doesn't want to delay that at all.
And so he was encouraging them to clear their calendars.
He noted that March 13th is a day that he has completely free on his bench, that he could spend the whole day going through all of these motions.
And he urged them to make themselves available for that day.
There was some discussion about whether or not that could be done via WebEx.
And presumably that will be the date when we finally learn Graf's ruling on whether or not cameras will be permitted in the courtroom.
We've seen limits on that, as you said, already, and that has been pretty extreme with camera crews being told to move back.
There is an attorney in the room for the media, representing the media's interests.
And that's something really fascinating.
I don't always follow criminal cases, but that's something I haven't seen in criminal cases.
And I think that's very fascinating to see that the media is represented to say this needs to be open.
This needs to be fair.
We all need access to what's going on here.
So ideally, March 13th, we'll find out what the ruling is on that.
