Tonight's top headlines.
President Trump's legal team has met the special master for the first time and even stated in court that they were prepared for a criminal indictment from the Biden DOJ.
We'll explain all that second.
A conservative teenager in North Dakota was run over and killed by a liberal adult driver after Biden's anti-MAGA speech.
Third, the Fifth Circuit federal court has upheld the Texas anti-censorship tech law.
We're going to break all that down.
I know it's a lot.
And then finally, the American independent quote unquote news outlet has been exposed as a conservative smear operation run by none other than Media Matters founder David Brock.

You know the old saying, a prosecutor can indict a ham sandwich if they want to.
I'm just asking, if there is such a prosecutor and they indict you, would that deter you from running for president again?
I don't think the people of the United States would stand for it.
And as you know, if a thing like that happened, I would have no prohibition against running.
You know that.
I do.
And that's what I want people to understand.
That would not take you out of the arena.
It would not.
But I think if it happened, I think you'd have problems in this country, the likes of which perhaps we've never seen before.
I don't think the people of the United States would stand for it.
What kind of problems, Mr. President?
I think they'd have big problems.
Big problems.
I just don't think they'd stand for it.
They will not.
They will not sit still and stand for this ultimate of hoaxes.
So today in Brooklyn, New York, in a federal courthouse, President Trump's legal team met with the special master the first time.
Let me walk you guys through a little bit of what all of this is because I know heads are spinning.
Here's what's going on.
This was the special master that was recommended by President Trump and his legal team because they wanted someone to go over the documents before the FBI and the DOJ were able to continue their investigation of this.
What is this?
It's a criminal investigation and they're looking for an indictment.
They want to indict President Trump.
You just heard what President Trump had to say about the possibility of an indictment.
What happened in court today?
Well, very interestingly, His lawyers positively stated that there were certain material that they didn't want to reveal, even in, right, even in this special master session, this hearing today, because if there were a potential indictment, they wanted to keep their defenses, they didn't want to have to disclose their defenses, because then the Department of Justice would know that before an indictment even took place.
So understand, his lawyers are already, and they're doing their job, right?
They're operating from the perspective that, of course, their client, the President of the United States, Donald Trump, might actually be indicted.
The issue, though, is that the question At play here was whether or not these documents were declassified.
Are they currently classified or were they declassified?
Now the special master, this guy Deary, came in and said, look, I need to know were these things declassified, Raymond Deary, were they classified or were they declassified?
President Trump's lawyers are saying, we don't want to reveal that because we might have to use that as a defense in an indictment.
But the problem then becomes, for the special master, how can he effectively review them whether or not they're considered classified or declassified?
Obviously, if they're classified, he's going to need clearance.
He's going to have to go through that process.
He would be able to receive an interim clearance just to be able to review the documents without breaking the law.
The government, from their perspective, is maintaining that the documents are classified.
However, here's what's very interesting.
Biden's DOJ has filed a motion to try to stop the documents from being introduced in front of the special master to begin with.
That's over at another appellate court, the 11th Circuit Court.
Why is this?
It seems, just from an optics perspective, with that motion, trying to block the Special Master even from reviewing the documents in the first instance, it seems as though the Department of Justice, under Biden, has something to hide.
Why don't they want the special master to view these things?
Why don't they want him to see what's going on?
Why don't they want him to look at the documents, the underlying documents here about what this entire scam, this entire charade is all about?
You're talking about indicting a former president of the United States.
We need to do things by the book.
But it sounds like that's not what they're interested in doing.
They don't even want the Special Master to review the documents.
And why?
Could it be, could it be that the Department of Justice was less than truthful in their filings when it came to that search warrant?
The Human Events was the first to report.
Whether it came to the underlying affidavit for the search warrant.
Okay, so all of The sworn statements that were made to that other judge, Judge Reinhart down in Florida.
There's so many questions here, but currently what we're seeing before us as of today, the special master wants to know were these documents classified or not?
And if they don't hear that there was a declassification, he's going to rule that they were in fact classified and more than likely going to rule that the FBI and DOJ can continue their investigation of them.

Donald Trump and the MAGA Republicans represent an extremism that threatens the very foundations of our Republic.
There's no question that the Republican Party today is dominated, driven, and intimidated by Donald Trump and the MAGA Republicans.
MAGA Republicans do not respect the Constitution.
They do not believe in the rule of law.
They do not recognize the will of the people.
They refuse to accept the results of a free election.
Democracy cannot survive when one side believes there are only two outcomes to an election.
Either they win, or they were cheated.
They promote authoritarian leaders, and they fan the flames of political violence that are a threat to our personal rights, to the pursuit of justice, to the rule of law, to the very soul of this country.
And they see their MAGA failure to stop a peaceful transfer of power after the 2020 election as preparation for the 2022 and 2024 elections.

Because this is what tyrants do.
This is what despots do.
They can't take any responsibility for their own failures and the failures of their regime.
So what do they do?
They whip up anger at a specific group of people and they blame all their own failings on that group of people.
In this case, President Biden, he does that towards MAGA Republicans, MAGA Americans.
Well, what happened next?
I'll tell you what happened next.
In North Dakota, We've got the story from Inforum, a lot of local places, Post Millennial has it up as well.
A driver has admitted to intentionally killing a teenager at a North Dakota street dance after a political dispute.
41-year-old Shannon Brandt, he was chasing an 18-year-old named Kyler Ellingson.
And Kyler Ellingson was being chased after the street dance, 2.30 in the morning.
This is way out in rural North Dakota, 120 miles northwest of Fargo, 54 miles north of Jamestown.
And Kyler, at one point, called his mother and said, can you come rescue me?
Because someone's chasing me through the city of McHenry, where the street dance has just wrapped.
Can you come, can you get me?
Can you save, can you save my life?
By the time his mother made it there, he had been killed.
Now what's even crazier than that, and I'm sure there's much more to that story, and we're gonna make sure that we get all of that story.
Because according to Post Millennial, The driver claimed to police that the reason he targeted the 18-year-old was that Ellingson was part of a, quote, Republican extremist group and had ordered others to come after him following a political disagreement.
Police also reported that the driver, Brandt, Shannon Brandt, was drunk.
They stated North Dakota Highway Patrol Captain stated we don't know of any witnesses.
Why was a 41 year old drunk at a street dance with a bunch of kids like this to begin with?
This is what's happened.
Okay.
This is where we are in our country.
The President of the United States goes out and gives an anti-MAGA speech, says, target these people.
These are the scapegoats.
These are the people that you must hate.
And then what happens?
You turn around, and a liberal kills a conservative.
It's the exact opposite of everything that Biden has warned about, it's the exact opposite of what the media tells us is going to happen.
They talk about QAnon.
They want to talk about all sorts of crazy stuff.
But guess what?
This is the type of low-level, murderous rage that's going on not only in North Dakota, but now all throughout 2020, Chaz, the burning of cities, Washington, D.C.
What's going to come next?
Freedom of speech is under attack in Texas.
There is a dangerous movement by some social media companies to silence conservative ideas and values.
This is wrong and we will not allow it in Texas.
Today I'm about to sign a law that fights back against big tech political censorship.
It prevents social media companies from banning users based upon the user's political viewpoints.
It allows Texans who are wrongfully deplatformed or restricted to be able to file a lawsuit to get back onto that social media site.
So Texas passed a law based around the ideals of upholding the freedom of speech against the censorship of the tech oligarchs.
And for the first time that we've seen a federal court at the circuit level, the appeals level, the Fifth Circuit Court, has sided with Texas and has upheld this law.
This is absolutely amazing.
This is a landmark situation, a landmark ruling for freedom of speech within the United States.
Because what does it mean, at least in the modern era?
So what it says is that according to the First Amendment, and I want to go in here to, I'll read you an actual piece.
of the fifth circuit's decision it says we turn to the first amendment's text in history which offers no support for for the platform's claimed right to censor next applying supreme court precedent we hold that the section does not regulate the platform's speech it protects other people's speech and regulates the conduct of platforms
our decision is reinforced by 47 US Congress.
Code Section 230, which reflects Congress's judgment that the platforms are not, quote, speaking when they host other people's speech.
Our decision is still further reinforced by the Common Carrier Doctrine, which vests the Texas legislature with the power to prevent the platforms for discriminating against Texas users.
What are they talking about here?
That's consumer protection laws.
There are consumer protection laws in this country and in all the states that protect common carriers.
What does this mean?
This means that the judges on this panel did not view this as the argument of, oh, well, this is like a newspaper and you can't tell a newspaper what they can and can't print.
No, no, no, no, no, no, no.
The speech is not being All right, regulated, or I should say the speech is not being emanated.
It's not being published by the platforms.
The speech comes from the users.
It's the user's speech.
But the lawyers for these and they have these, you know, net circuit and all these different net choice.
All these different associations representing Google, TikTok, Facebook, etc.
Trillion dollars in the tech industry.
They're all saying, no, no, no, no, no.
We have the freedom of speech to ban whatever we want.
That's what the First Amendment says.
The First Amendment doesn't say anything about that.
It's about your freedom of speech.
It's about our freedom of speech as the American people.
OK, so the tech bros are losing their minds over this.
Blue check Twitter, absolutely insane, and even the libertarians, because let's just say, I should say the corporate libertarians, are losing their minds.
This is from Reason Magazine.
It's a terrible ruling that misreads years of First Amendment precedents, and it's increasingly likely that the Supreme Court will have to intervene.
This is regulating large social media platforms with more than 50 million users, forbidding them from censoring any user.
There may be some exceptions, but it treats them like common carriers, ordering them against their will.
Against their will!
To serve as a communications platform for messages that they might find objectionable or violate community standards!
Oh my gosh, not community standards!
I just... Just give me a second.
I just have to think about all the community standards that are being violated right now.
They're being absolutely violated!
The standards of the community!
We're sick of it.
Guess what?
We're gonna violate all the community standards now.
Because the only standard that should exist is the First Amendment and the freedom of speech in the United States.
We're fighting back for it.
If you don't like what somebody says, you can not listen to them, you can block them, you can mute them, you can do whatever you want, but you don't have a right to censor in this country.
...is really quite ferocious.
It's when a huckster takes some lies and makes them sound precocious by saying them in Congress or a mainstream outlet.
So, disinformation's origins are slightly less atrocious.

Or when TikTok influencers say Covid can cause pain.
They're laundering disinfo and we really should take note.
And not support their lies with our wallet, voice or vote.

What does that mean?
A shadowy network of news sites is quietly pushing liberal anti-conservative propaganda in battleground states ahead of the midterm elections.
Huh?
What?
What does that mean?
Five new websites that launched in April of 22 that look like benign, totally politically independent state news outlets with local stories about Pennsylvania lakes or the Michigan Museum of Natural History Actually shows that these sites are tied to something called the American Independent.
And what are the sites called?
The Arizona Independent, the Michigan Independent, the Ohio Independent, the Pennsylvania Independent, and the Wisconsin Independent.
They have been publishing a steady stream of partisan content aimed at influencing voters without revealing their agenda.
Who is behind all this?
None other than left-wing operative David Brock, the founder of Media Matters.
Longtime Clinton World operative David Brock, yes, the latest example of mass-produced partisan news sites masquerading as local news.
That's what NewsGuard calls pink slime journalism.
Well, hold on a second.
Nina, we're doing your job for you.
You know, we did get you fired, obviously, a couple of weeks ago, and so you no longer work for the federal government, but we're doing your job for you out here.
We have found your disinformation, and it turns out that it's being pushed by none other than, well, David Brock.
And so what NewsGuard has done now, that if you have the NewsGuard rating system, it actually points out that they have now a 44.5 score out of 100, and if readers are alerted, proceed with caution.
This website fails to adhere to several basic journalistic standards.
Um, however, NewsGuard found tons of articles supporting liberals and criticizing conservatives.
Here's an example.
Arizona Republicans nominate racist venture capitalist Blake Masters.
Another one.
Whitmer's ambitious budget prioritizes education and fixing roads.
Again, 41 Republican senators break their promise to protect veterans' health.
So again, what you can see they're obviously doing, these are partisan headlines, okay?
And I'm not going to sit here and use this platform for human events to advocate for one or the other, but what I'm saying is, is that what they're doing, of course, the founder of Media Matters, the founder of American Bridge, Huge.
Clinton World Operative, David Brock, he's lying to you.
He's lying by creating fake, positive, independent, local sources.
That's not.
These are partisan, disinformation outlets, and this is what they are using their money to do.
So my question is, and I appreciate NewsGuard for doing this, my question though is, Nina, Nina, are you going to talk about David Brock or are you not?
Because maybe, just maybe, you guys are getting the money from the same place.
Oh, just a question.
