| We heard the gunfires approaching where we were. | ||
| They just started getting closer and closer and louder and louder. | ||
| And I knew we were getting gunshots that were closer to us than Where they originally started and that's when we knew we had to run. | ||
| All I know is that the bursts of shots were very quick and they didn't last long. | ||
| They were not 15 seconds long like the Mandalay Bay shooter was. | ||
| They were very short bursts and it was almost as if they just wanted to get a few shots in and then quickly get out. | ||
| Now it sounds like it's coming from farther away. | ||
| I hear gunfire over the sound of the casino, which is, you know, a lot of bells and whistles because machines going off or whatever. | ||
| There was music playing and people talking. | ||
| So it was, you know, an elevated amount of noise in the casino. | ||
| And yet I still heard these gunshots. | ||
| We hear shots coming from like Hooters, MGM area. | ||
| Over there, there were shots coming from over there and there were shots going from Mandalay Bay. | ||

| More got fired, much closer. | ||
| I would estimate it had to be within a half block of where I was. | ||
| And you guys said that there were multiple shots fired. | ||
| We were on the furthest VIP stages away from Mandalay Bay and they were ricocheting everywhere where we were. | ||
| They were firing from somewhere high and they were unloading clip after clip after clip after clip. | ||
| People are seeing their shots at Bellagio. | ||
| I wasn't there, I can't tell you, but I was at Tropicana and I did hear those shots and we ran out to the day pool area and we hid in the cabanas for 30 minutes. | ||
| So there is a shooter, you believe? | ||

| It has to be. The thing that's really shocking to me is that there are hundreds if not thousands of us who know it. | ||

| Viewers watching, and I was down there when I was evacuated, and there was nobody out there. | ||

| and we actually met up with these other guys who were also looking trying to find some information and we met up with these security guards and police officers who was active what we were doing and told us to run away and we heard gunshots from around the corner we were in the Delano right next to a walkway that connects the Mandalay Bay at the Delano and we heard gunshots from right out that hallway so we think that the police were dealing with the shooter while we were down there. It sounded like machine guns it sounded like more than one machine gun and it just didn't | ||

| We were trying to make all kinds of phone calls because When I heard the gunfire, and I've never heard anything like that, and I never in my life thought I'd ever be in anything like that. | ||

| Like I said, I don't know what happened at the other hotels, but I do know what happened at this one. | ||
| And I know that my husband, my hair, jumped on top of me. | ||
| And I was holding on to another lady because she was scared to death crying. | ||
| Because we were kind of in a line of fire running north toward Luxor, and the police officers didn't go get in this room, and then, you know, I felt like there were like these six young, I don't know, they must have been like 20, I don't know, in their early 20s, and they were crying, they were on their knees, and I got the thought of Orlando, When people get shot around you, you can hear it. | ||

| Are you going to have to look at your ancestry, your family tree, when you came here? | ||

| All right. Let's get serious here with Angus Lee, who is attorney at law. | ||
| He's been on with us before. | ||
| He's very much involved with the Joey Gibson lawsuit that's happening. | ||
| And I talked to Joey last night and today, and he said, because I asked him to come on, he said, no, you just need to have my attorney on to address this because I don't want to say anything wrong. | ||
| And he's the person to break it down. | ||
| So... Remind the audience of the lawsuit going on right now involving Joey Gibson, and let us know the latest in the developments here that are very key. | ||
| Angus Lee. Thank you, and Owen, thanks for having me. | ||
| So, if you'll recall, the prosecutor in Multnomah County announced a non-prosecution policy for people who riot during protests that he supports, that have his political viewpoint. | ||
| And we filed a federal lawsuit against the Multnomah County Prosecutor's Office, the Multnomah County Prosecutor himself, Mike Schmidt, and one of his deputy prosecutors. | ||
| And in that, what we detailed is that the continued prosecution and the initial prosecution of Mr. | ||
| Gibson and Mr. Russell Schultz is a sham prosecution, is a bad faith prosecution, and it is selective. | ||
| And so what we've done now is we filed a motion for an injunction against the state-level prosecution. | ||
| And we've had two hearings in federal court. | ||
| And as a result of the second hearing, the court has ordered expedited discovery specifically on the issue of the creation of Mike Schmidt's non-prosecution policy. | ||
| And so right now there's discovery that needs to be provided from the prosecutor's office about how that policy was created and what went into it and why it has only been applied to people other than, frankly, Joey Gibson, Russell Schultz, and other people engaged in patriotic protest. | ||
| Now, what kind of precedent, because I've never seen or heard of anything like this, can you use in a lawsuit or a case like this to prove that there's a double standard? | ||
| And where does that apply to a case like this, where you can prove that there's clearly a double standard for law enforcement or for policy enforcement? | ||
| But how do you bring that to the table? | ||
| So just generally, first, we have to all understand that selective prosecution in America is still illegal. | ||
| You can't prosecute people based on their political expression and then allow other people to Essentially do the exact same thing and or worse and not be prosecuted because the prosecutor likes what those people are saying. | ||
| And so in order to prove that kind of case, it's very complex legal issue that actually requires you to go deep into the heart of the facts of the individual case in question, in this case, Mr. | ||
| Schultz and Mr. Gibson, and compare those facts to all the other cases where the non-prosecution policy was applied. | ||
| And so that's why we're in the discovery process right now. | ||
| So where does this go from here? | ||
| What do people need to know about this? | ||
| Are there going to be other cases that look at the result of this case that could be brought up in other areas and counties where similar processes and selective enforcement is happening? | ||
| Yeah, so it's interesting. | ||
| You probably haven't seen anyone take a state-level prosecution straight into federal court in decades. | ||
| And when you look at the case law on this, really the bulk of cases where prosecutions have been challenged in federal court comes from the 70s and comes from the 60s in civil rights activity where you had a lot of prosecutors who were trying to prosecute people for their political activity. | ||
| And apparently we've kind of returned to that cycle and we're seeing that around the country. | ||
| And so we're taking that step to go into federal court and say, you don't get to prosecute people and sham prosecutions because of their expressed political viewpoint. | ||
| And we're in the early stages on that, but I'm very optimistic. | ||
| And when we prevail, that will set contemporary and current precedent that can be relied on in other jurisdictions. | ||
| How do you prove the intent here, or how deep does this go? | ||
| Because, I mean, I could use a bunch of different examples, say, you know, in California or Oregon or Nevada, where if you're standing in a parking lot singing, like having an outdoor church service, you get arrested, your church gets shut down and fined, but if you're Black Lives Matter, which is an official organization, they have fundraising, they're allowed to go out on the streets and have their events, and I've not seen one Black Lives Matter event be brought into court for not abiding by shutdown or masks or social distancing or anything like | ||
| that. | ||
| So I mean, how do you prove that political intent when bringing this to a federal judge and then say it goes through? | ||
| What does the judge then say when he sees this happening all across the country? | ||
| So there's two questions there. | ||
| What does the judge say when they see it happening all across the country? | ||
| And I don't think your federal trial level judge is going to address the systemic issue with prosecutors across the country. | ||
| The judge is going to strictly look at what you present in the record in your case. | ||
| And if you recall, the last time I was on here, we were talking about the selective prosecution in Vancouver, Washington, which was right north of Portland. | ||
| And in that case, What we had done is we had made tremendous public records requests and we had found out that there had been, I think it was 15,000 complaints of non-compliance with the governor's proclamation, and yet they were only prosecuting, the only person they were prosecuting was my client who had thrown a rally with Patriot Prayer. | ||
| And so when we were able to show, look, there's 15,000 complaints over on this side and nobody's being prosecuted, Yet you prosecute this one person who just so happened to take part in a patriotism rally. | ||
| It became very clear. | ||
| And when we presented the motion in that case to dismiss for selective prosecution, it was so powerful that the prosecution essentially walked away from the case completely and dismissed the case with prejudice just a couple of days before the hearing on that motion. | ||
| So we didn't have to get to federal court there. | ||
| But the way you prove selective prosecution and bad faith prosecution is one, you got to look deep into the facts of the case. | ||
| So that's the lawyer's job. | ||
| And two, you've got to do a detailed analysis of the whole universe of potential cases. | ||
| And that means going beyond the normal discovery that you would get in any criminal case and making lots of public records requests and reviewing those records so that you can do a side by side analysis. | ||
| That's a big part of it. So who's really on the hook here? | ||
| Because we know how they like to try to skirt blame. | ||
| I mean, who is going to be looked at when this case gets to trial? | ||
| So there's two levels here that will be at issue. | ||
| One is the initial charging decision, whether or not we can establish that that was a selective and sham prosecution, and then also the selective non-application of the policy, the non-prosecution policy. | ||
| And the defendants in that federal case are the Portland Located prosecutor Mike Schmidt for Multnomah County and his trial prosecutor who's specifically handling the case. | ||
| Now, this is not a lawsuit for damages where they would have to pay. | ||
| It is a lawsuit for an injunction because prosecutors have so much immunity. | ||
| The mechanism here is simply to get the federal court to step in and say you have to end any sham prosecution or selective prosecution. | ||
| Okay, this has been very heavy on the legalese here with Angus Lee. | ||
| When we come back, I want to talk about real-world application and why this case is so important for us to follow and see what happens here because it could set a precedent potentially for other people to look into similar cases. | ||

| What do people need to be on the lookout for here? | ||
| So, here's the thing. | ||
| The fundamental promise of our nation is that our government will not punish us for speaking our mind about political issues and speaking our mind publicly. | ||
| That's the bedrock promise of our country. | ||
| And when prosecutors engage in a pattern and practice of prosecuting people who engage in legal activity While turning a blind eye to people who engage in illegal activity, | ||
| because of how the prosecutor agrees with one group or the other, they are completely undermining that bedrock principle of a free democratic republic, and it cannot be allowed. | ||
| And so when somebody is being prosecuted simply because of their speech, While the prosecutor is allowing actual criminal activity to occur that promotes that prosecutor's viewpoint, The people have to come forward, they have to seek federal redress, and they have to say, we have a right to be free of this oppression. | ||
| And here's the thing, if people don't do that, and if prosecutors are allowed to prosecute based on political viewpoint, then we do not have a right to express ourselves, and we are not a free people. | ||
| That's the point. Now, I see this happening I see this happening to, frankly, friends of mine. | ||
| Yeah, Joey Gibson, Roger Stone, myself even, I would argue, with some of the things that I've had to endure. | ||
| Now, I mean, aside from the political issues at hand... | ||
| Usually this would be something that would be a national debate. | ||
| There'd be national stir. | ||
| I mean, people should be getting Joey on for interviews, you on for interviews. | ||
| I mean, because you just laid it out. | ||
| This is the bedrock of our civilization, the bedrock of free speech, what we're supposed to be guaranteed by God through our Constitution. | ||
| Are you surprised at the lack of outrage here? | ||
| Are you surprised at the lack of initiative to get this case some coverage so that we could ensure our ability of free speech with confidence? | ||
| Well, I would have been surprised maybe five or six years ago in a lack of mainstream media coverage over suppression of someone's free speech. | ||
| But having watched Mainstream media absolutely implode over the last several years. | ||
| It's abundantly clear that the bulk of mainstream media no longer cares about independent voices. | ||
| They no longer care about the First Amendment right of the individual. | ||
| And frankly, it appears to me that most of mainstream media does not appreciate the individual person's Freedom of expression under the First Amendment because the mainstream media actually hopes to maintain a monopoly on speech. | ||
| They want to be the biggest and loudest voice, and they don't want any competition from somebody who has a good message but only has a smartphone and a Twitter account. | ||
| And so mainstream media is no longer a friend of the First Amendment, and it's a really sad, sad thing to see. | ||
| You know, when you were talking the legalese of this case in the last segment, you brought up some of the research and study that you were doing into this, some of the application or precedent, and you mentioned 60s and 70s civil rights, civil liberties cases. | ||
| And back then, I mean, you didn't really get into the history there, but I'm imagining that was more, you know, leftist liberal stuff. | ||
| That was kind of when the leftists, the liberals, anti-war, the peaceniks people, the hippies, if you will, you know, were out on the streets doing their things. | ||
| And And they had a lot of results in their favor. | ||
| Now it's kind of... | ||
| I mean, I think it's fair to say... | ||
| I mean, you don't really... | ||
| You're not even necessarily taking a side on the issue dealing with the case. | ||
| But to me, it's... | ||
| I mean, most of these cases that... | ||
| Let's say you had 100 of these cases across the United States. | ||
| 99 of them would be against a conservative, a Christian, like Joey Gibson. | ||
| Do you see the same response though from the historical aspect of this from the 60s and the 70s when a lot of the cases that set the precedent for this that you were researching into, do you see the same kind of care or application in the real world as you do in the year 2020 when this is happening again? | ||
| I guess what I'm asking is, you know, then people, there were obviously legal cases. | ||
| I mean, the media covered it. Now it's still the same thing, but there doesn't seem to be much of an outrage. | ||
| There doesn't seem to be much of a concern. | ||
| Yeah, definitely from the media and from prosecutors, they just don't seem to be that interested in it. | ||
| And really, especially when you look at the left and the way that they used to advocate for free speech. | ||
| Now they don't advocate for free speech. | ||
| They advocated for free speech when they wanted to say things that were hurtful to our country. | ||
| And that's their right to do under the First Amendment. | ||
| Now they're against free speech when people want to say things that are helpful to our country. | ||
| So you have to really ask yourself if the left has actually ever really been about the individual rights Of a person to speak, or if really they've just been more interested in saying things negative about our country. | ||
| And unfortunately, that effect on the left is lingering over. | ||
| And so, you know, you can't find college professor, excuse me, law school professors who would normally write on this topic to cover it. | ||
| Because they cannot, they don't have the courage to even defend Mr. | ||
| Gibson's First Amendment rights because they are so afraid of the political and personal and social backlash that they will get. | ||
| That's the way it seems to me. | ||
| Final minute and a half here. | ||
| What do we need to know or what do you want people to know about this case as it moves forward and how can we follow it? | ||
| Well, obviously, I'm going to be posting updates on Twitter, and so I'm happy to come back here anytime we have an update. | ||
| There's a discovery order in place, and we will be receiving a tremendous amount of discovery from the defendants in a couple of weeks, and we're looking forward to that. | ||
| But the biggest thing here is that We are taking a stand for the First Amendment, and that is not just for Mr. | ||
| Gibson. It is for anyone who has an unpopular viewpoint and who wants to express that viewpoint without fear of prosecution. | ||
| And that's really the most important thing to have in this country, is the ability to say what you believe without being prosecuted because of what you believe. | ||
| Well, this is going to be great. | ||
| I'm so happy that you've taken this mantle and Joey Gibson as well and you two combining your efforts now. | ||
