Police, peaceful protesters, violent protesters, everything. | ||
Innocent bystanders, just, you know, when you have riots, you're going to have random death. | ||
And that's what we've had. | ||
Most of it even politically motivated, whether it's against a police officer or just somebody who's a bystander and then says, no, I'm not going to kneel for Black Lives Matter or, hey, I like Trump, and then they get killed. | ||
Or, hey, I own this business. | ||
Boom, brick upside the head. | ||
So understand... The reason why, because, you know, we see it and we know it, but I have to speak this out. | ||
It's kind of like an exercise of learning and understanding and comprehension. | ||
Like, they know when you say something, you have a certain amount. | ||
It's like when you hear something, a certain amount of memory retention. | ||

The Democrats and the mainstream media are in such control of their herds that they can pick and choose things that they get upset about, and then they can turn up the heat to decide how upset they should be. | ||

Lots of big cities. Where guys break into a car shop. | ||

As he lays on the ground protecting his family, taking bullets? | ||
Nobody will shed a tear. | ||
Nobody will care. You can see him in the bottom right, takes his three children, throws them on the ground, and puts his body all on top of them. | ||
As these men try to rob a car shop, and he gets shot as he's hovering over his kids, boom, takes it right to the hip. | ||
Barely even flinches, too. So, I mean, but nobody cares about that because the media won't cover this, the media won't say his name, the media won't point out this violence. | ||
And if you want to get down to the identity politics level, it's because it's a black-on-black crime, and that's just the choice they make. | ||
Police on black crime, they're going to turn up the heat. | ||
White on black crime, they're going to turn up the heat. | ||
And so they've turned up the heat to such a level now, they've been able to get full-on riots and violence in any city, anytime they want. | ||
Now, When it comes to the situation in Louisville, why are they so mad? | ||
Well, you've got Black Lives Matter out there. | ||
You've got Ben Crump out there. | ||
You've got all these black people out there. | ||
And what are they saying? Racism, racism, systematic racism, police racism, institutional racism. | ||
But wait a second. Breonna Taylor was behind a closed door. | ||
So even if you think that the cops in this situation were bad for firing back inside the house, do they have x-ray vision? | ||
Does x-ray vision identify race? | ||
Are we talking about super police here? | ||
No, that's ridiculous. | ||
So to even insinuate that this was a racially motivated event shows the level of ignorance, shows the level of deception, shows the level of the herd mentality here. | ||
They can't think, they don't want to think, and if you ask them to think, they get mad. | ||
Which adds to the already anger that they've been, has been uploaded into them by the media and the Democrat Party. | ||
So all day, systemic racism, police racism. | ||
Again, Breonna Taylor could have been white, could have been Asian, could have been Mexican, could have been an alien from Mars. | ||
The cops can't see through doors. | ||

Whether you have a police badge on or not, whether you have body armor on or not, you have an instinct of self-defense. | ||

And I have to make the conscious decision. | ||
Do I round up security, round up a crew, and then go to this event I mean, you know, shot, pretty good shot that I'm going to get a solid five-minute viral clip that won't be allowed to go viral, but we could air it here just to, again, show you. And I know how it would go. | ||
I'd say, hey, what happened to Breonna Taylor? | ||
Oh, she was murdered by police because she's black. | ||
Well, do you realize that her boyfriend fired first? | ||
No, he didn't. Do you realize that the police knocked on the door and said who they were? | ||
No, they didn't. And then the police documents come out. | ||
And someday down the road, the police body cam footage will come out, too. | ||
And it'll prove all of it. | ||
The documents are already out, and it won't even matter. | ||
And I'll say, but how can it be a racist event if the police don't even know that Breonna Taylor's in the house, let alone what skin color she might be? | ||
And then they'll get violent, and then I'll get assaulted, and then security will move in, and then we'll have to be evacuated from the scene. | ||
So I just make measurement. Do I want to do that? | ||
Do I want to take time out of everyone's data just to do that when I know that's how it's going to go? | ||
Or do I invest my time in other projects? | ||
And that's where it's come for me. | ||
But that's the level of ignorance. | ||
That's the level of deception. | ||
And the textbook definition of terrorism is threatening violence to get a political ends. | ||
Well, what is this? They're threatening violence because they don't even know what they want. | ||
So that's what's so hard about this. | ||
That's why yesterday when I was saying it's good that Don Lemon is saying they want to burn this to the ground. | ||
It's good that they're telling us because I can't intellectually battle somebody that doesn't even know what they stand for. | ||

Now, if they say, hey, I want to police reform, then I can say, well, let's talk about law reform. | ||
Let's talk about ending the war on drugs. | ||
Well, then they just get mad at me. Because at the end of the day, folks, these are hate-filled leftists that are racists. | ||

These are people that live in misery. | ||
These are people who just want to see you suffer. | ||

And so the Breonna Taylor rioters move in, destroy the patio furniture, destroy the outside structure because, you know, this is what you do. | ||

We feel bad for these people because... | ||

In fact, animals at least have a semblance of justification in their head. | ||

When you target a restaurant because somebody got shot by a police officer, Again, where's the level there? | ||
Where's the parallel? Where's the connection? | ||
There is none. It's insanity. | ||

And less and less are Americans going to feel any pity for people who take part in these things. | ||

And then when you try to inform them, they just get more upset. | ||

Some people get into it on the streets and somebody almost pulls a gun and shoots a guy because he has a message for them telling them, hey, Breonna Taylor, you know, the officer didn't even know she was in the room or what color her skin would be, let alone. | ||
It doesn't matter. | ||
The media told them that the system hates them. | ||
The media told them the system is keeping them down. | ||
The media told them the system is racist. | ||
Obama amplified it. | ||
The Democrats justified it. | ||
And so now they target innocent restaurants that have absolutely nothing to do with the police shooting at all. | ||
Why? Because they can, because they're filled with hatred, because they're rioting. | ||
And here's the other thing, I guess, because why else would you go target a restaurant unless you assume it's owned by a white person or a police officer? | ||

It looks like they've just cropped a photo of the TV into this single shot that somebody got a Biden because let me just tell you something and The crew can attest to this folks you look at the lighting That TV has different lighting on it the image on the screen has different lighting on it than every other piece of equipment there I mean I could have professional photographers come in here and break this down I'm not gonna spend that much time on it, but but this photo looks doctored that looks like totally photoshopped | ||
And why did it take him? What was it 48 hours to respond to this? | ||

And who the Supreme Court for him to nominate to to replace RGB because the if you like lockdowns if you like forced vaccines if you like for sterilizations if you like the police being able to break down your door and arrest you in front of your child with no probable cause | ||
if you favor corporations over the individual, if you favor the government over the individual, if you favor institutional corruption, if you favor covering up for corrupt prosecutors, corrupt politicians, and corrupt police, Then the person that you want is Amy Coney Barrett. | ||
Barrett comes from the old money South. | ||
She's being pushed by the same kind of people who pushed people like Fauci onto Trump, who pushed people like Burks onto Trump, who pushed people like Tillerson and Mattis and Coates onto Trump. | ||
All people, people like Bolton under Trump, the same crowd is pushing him to try to get Barrett on the bench because she would be a fifth vote for the lockdowns, a fifth vote for forced vaccines, a fifth vote for things like detention camps. | ||
The line of decisions that she cited favorably, she was wrote one of the, was co-authored one of the worst We're good to go. | ||
And so she is an incredibly dangerous stealth threat to anyone who believes in constitutional liberty, to anyone who does not want authoritarianism from the left or the right on the bench. | ||
It is critically important to get the message out to President Trump because there is massive pressure from the corporate establishment and the conservative establishment in Washington to get to sneak her onto the bench by misleading President Trump about her true bona fides. | ||
Bonafides that show she belongs nowhere near the Supreme Court. | ||
She would be one of the worst appointees in the history of the Supreme Court. | ||
So that I think as much as anything is the standout. | ||
The most pro-lockdown jurist that's on the list for Trump to consider in the country by far. | ||
Bad on the First Amendment. | ||
Bad on the Second Amendment. | ||
Bad on the Fourth Amendment. Bad on the Fifth Amendment. | ||
Bad on the Sixth Amendment. | ||
As a prominent antitrust lawyer noted, he couldn't find amongst her hundreds of cases a single case where she had ever sided with a consumer or an employee or an ordinary person against big corporate America, big tech, big business, the George Soros, Bill Gates, the David Kochs of the world. | ||
So if you want someone to stand up to big banks, if you want someone up to stand up to big business, if you want someone to stand up to state incursion and intrusion upon our liberty, someone to stand up to the deep state, then it is critical, essential, and fundamental to get the message out that Barrett is a no-go for President Trump. | ||
And here's what I see happening. | ||
I think she's clearly the frontrunner for whatever reason, probably the reasons that you just mentioned. | ||
And what I see, though, is the headlines, and I think it's designed this way, whether intentionally or not, it's just our human response, so it could be used against us. | ||
I see the headline like this. | ||
This is Amy Coney Barrett, the potential RBG replacement who hates your uterus. | ||
Oh, wow. Amy Coney Barrett is a pro-birther. | ||
Oh, wow, that's bad to be pro-birth now. | ||
I don't know if you knew that, Bob, but being pro-birth is now an attack. | ||
Everybody was born, but, you know, be anti-birth is somehow a good thing. | ||
Who needs to stay away from the SCOTUS? I see the headlines attacking her about her Catholic faith. | ||
Ironically enough, in a 24-hour window after they were praising Joe Biden for his Catholic faith. | ||
These people, they'll flip-flop on anything, but I see this and I think, hmm, is this something that could be intentionally used against Trump's base to make us love Amy Coney Barrett because they're projecting so much hate onto her? | ||
Or is it just naturally they're just hating her because she is pro-life and seemingly the lead candidate? | ||
So, you know, that's the kind of stuff that makes me worry. | ||
Who do you think Trump should be considering? | ||
If these are the big things to talk about, considering the lockdown, the forced vaccinations, is there somebody on that list that stands out to you that would be pro-America, pro-freedom on these issues that are going to be at the forefront coming up soon? | ||
Well, if it was up to me, Trump would have a much more expansive list. | ||
The problem is the president has delegated his judicial decision making to the Federalist Society and the Heritage Institution. | ||
So the net effect of that, it's also why you won't hear conservative lawyers criticize Barrett publicly. | ||
People like Harvey Dillon will hint at it, other people will hint at it, but they won't publicly criticize him because they don't want to be on the receiving end of an attack by the Federalist Society and the Heritage Institution, as I have been for the last week when I came out critical of Barrett. | ||
I think what you're going to see is two different things happening. | ||
Part of it is you have this big gap between the secular left, the Hollywood left, and what I would call aspects of the religious right that are authoritarian-oriented, your Opus Dei types within the Catholic Church. | ||
And neither one understands Middle America. | ||
And Middle America is sort of going to be stuck between these two groups screaming at each other. | ||
And neither one reflects what ordinary Middle America is concerned with. | ||
The reality is that Barrett is part of a religious sect that has Opus Dei overtones to it. | ||
I'll give credit. Her backers are doing a good job of saying any criticism of her is anti-Catholic or anti-religious. | ||
It isn't. It's the fact that she's tied to authoritarian-oriented groups that's raising problems. | ||
Not her ties to the Catholic Church. | ||
It's her writing articles saying judges should favor the Catholic Church over their duties as a judge so much that they should recuse from the bench if there's a conflict. | ||
Well, yeah, I was going to say, didn't she say she would recuse herself on a pro-life issue or a pro-choice issue because of her faith? | ||
That's the reasonable inference. | ||
What she did is she wrote an article that said if any judge, there's any conflict between what the church's doctrine, and by the way, she had a very broad, expansive interpretation of that that sounded an awful lot like whatever the pope says, you as a judge can't disagree with, and that your ethical duty, rather than having a conflict between the law and the court, is to recuse. | ||
So people are like, how is that not going to compel her to recuse if she's on the Supreme Court in a Roe v. | ||
Wade case? How is that not going to raise issues in that regard? | ||
And she only slightly dodged the issue. | ||
She's also part of a group called People for Praise, which has some Opus Dei overtones to it. | ||
People can research Opus Dei. | ||
It's more of an elite authoritarian group within the sort of old Catholic authoritarian tradition. | ||
And it's a charismatic group that a lot of mainstream Catholics have issues with because there's a lot of speaking in tongues and other activity. | ||
She's made statements to the effect that her job as a lawyer is to bring in the kingdom of God. | ||
And the way it sounds doesn't sound like necessarily reflecting principles of Jesus. | ||
It sounds more like the Catholic Church from the 15th century. | ||
And I think that's the concern. | ||
The church that her father was a deacon at had problems with child abusers that were priests at the parish they were at. | ||
She comes from old money, French aristocracy. | ||
So there's just one red flag after the other, after the other. | ||
Basically, you're saying she comes into the Supreme Court covered in swamp material. | ||
Completely. She comes from the wrong side of the religious conservative equation. | ||
She comes from the authoritarian side, not the freedom of expression side, not the populist side, not the independent side, not let's have the government out of the church's business lives, but more in the let's have the church run your life side. | ||
And the group that she's part of is connected, used the word handmaiden up until the handmaiden tale came out. | ||
So it's just a lot of concerns. | ||
I think politically it would backfire for the president because I think it would scare a lot of independent working class voters in the north who are religiously conservative but don't want the church to run their life. | ||
So really he needs to go with a hardcore constitutionalist more than anything. | ||
Absolutely. And there's two choices within the – if he wants to go the woman route, I think he should open it up and not limit it to that. | ||
But let's say he feels pressure to do that. | ||
Either Lagoa from Florida, who's a smart but reasonable conservative, who's been more on the constitutional side during her tenure as a Florida state judge and federal judge. | ||
Or a judge rushing who's very young but has fantastic decisions out of the Fourth Circuit during the same time frame. | ||
Let's hone in on that when we come back. | ||
We're going to a break now. Let's hone in on the two names that have just been floated up by Bob Barnes here. | ||
I want to hear why he thinks they're the best choice. | ||
And I hope that this gets to the White House because we can't make the wrong decision with this judge, folks. | ||

He was going into the names, the individuals he think would be best for the Supreme Court nomination. | ||
Of course, Trump has perhaps handicapped himself or hemmed himself into picking a woman for whatever reason. | ||
I don't know why he would do that unless he already knew who he was gonna pick. | ||
But you were getting into the names of the two women you think would be much more suited for this position and don't come with nearly the baggage or worry that Coney Barrett comes with. | ||
So once again, just tell us those two individuals and why you think they would be the right pick. | ||
Unlike Barrett, who I think is another stealth Supreme Court coup attempt against the president, the president's agenda, and the president's people, would be a fifth vote that could screw him on the election, a fifth vote that could screw all of us on the lockdown, on forced vaccines, on the government being able to suspend core liberties on detention camps, you name it. | ||
By contrast, Judge Lagoa out of Florida and a judge rushing on the Fourth Circuit Court of Appeals, both of them have much better records and do not come with that baggage. | ||
Judge Lagoa has a great human interest story. | ||
Came from the daughter of Cuban immigrants. | ||
This is somebody who personally knows and grew up with the risk of the state having too much control and having too much power. | ||
Her constitutional conservatism is rooted in real life experience opposing communism because her mother and father had to flee it for their lives. | ||
So she is someone who understands it personally, intimately, intricately, yet is very intelligent. | ||
She went off, she was a top law review, top law school graduate, took a risk When she was in the private sector, by coming to the battle of Elian Gonzalez, when a lot of people said, don't get involved, she decided to represent Elian Gonzalez and the interests related to that pro bono. | ||
So she was willing to take personal professional risk for core constitutional liberties of underdog individuals And in her in her personal professional life only briefly worked for the government Didn't do any court clerkships and we work the Federalist Society networking DC swamp crowd She stayed true to her principles and true to her parents She was on the federal bench for almost a dozen. I mean the state bench in Florida for almost a dozen years Established a record so consistently constitutionally | ||
conservative that she is loved across the conservative spectrum in the state of Florida where everybody vouches for it. | ||
Let me just ask you this real quick to get your political analysis on that situation. | ||
How much does that influence an election? | ||
If Trump nominates someone with that type of reputation in Florida, because you see what the Democrats are trying to do to steal Florida. | ||
LeBron James pays $100,000 to get ex-cons to vote. | ||
Bloomberg just paid off $16 million in fines to get 32,000 felons to vote in Florida. | ||
So they're going for Florida. | ||
Is there political leverage there? | ||
Is there political weight there with that nominee? | ||
If Trump picks Lagoa, Florida's in the bag, and Biden might as well stay in his basement and not visit the state a single time. | ||
Did they put a lid on Biden today, by the way? | ||
I mean, it is in the late afternoon here. | ||
Biden may have had a lid on him by 10 a.m. | ||
like yesterday. Yeah, no doubt. | ||
I mean, I don't know if you've seen that cartoon that has him being constantly shocked by his wife anytime he talks. | ||
But I think there's a shock collar somewhere in his back. | ||
So the nature of that is definitely an issue with him. | ||
But yes, Lagoa is a fantastic choice politically, very popular in the state of Florida, extremely popular with Cuban Americans. | ||
She'd be the first ever Cuban American Supreme Court justice. | ||
Their pride would be off the charts. | ||
And you have someone that's a loyal anti-communist. | ||
So other groups like that, Venezuelans, Some Mexican-Americans, some Asians like Filipinos and Vietnamese that have familiarity with the history of communism. | ||
All of it would relate to her story and her family story. | ||
So it would help Trump tremendously. | ||
It would lock up Florida and help him in Arizona, help him in Nevada, and the rest. | ||
And it's a good story across the country. | ||
So not only does it not come with all the baggage or the risk of Barrett, it comes with a lot of upside. | ||
Now, Judge Rushing, by contrast, is much younger. | ||
So that's the risk. | ||
She's 38 years old, but she's a brilliant mind. | ||
She comes from the constitutional school. | ||
She's written a dozen great opinions while she's been on the bench, protecting constitutional rights and liberties, willing to question prosecutors, willing to question police, willing to question corrupt politicians, willing to challenge the state, willing to protect the individual against big business or big government when they go AWOL. So she too would be a fantastic choice. | ||
But from a political perspective, the best choice would be Lagoa. | ||
Lagoa would help put Florida in the pocket for President Trump, and that puts him a long way to winning in 2020. | ||
She's also much more likely to win nominations so that she'll be on the bench by the time election litigation reaches the Supreme Court. | ||
And if that were to happen, that would tremendously help the president because it would mean the Supreme Court would back him up in the key election litigation that is definitely coming. | ||
You know, I will kind of play off this headline just to show you how crazed the left is right now about this SCOTUS nominee. | ||

Tax fraud. Some other fake claims. | ||
So, I mean, these are their real quivers. | ||
But, I mean, politically speaking, they can't stop this. | ||
I mean, if Trump nominates somebody and he gets the votes, there is nothing they can do to stop it. | ||
No, I agree. I think the only risk is that someone like Barrett might not get nominated. | ||
If she were to get nominated, I would find that even riskier because, again, I think she's a stealth candidate to give Roberts another vote. | ||
If you look at what Robert said about RGB, I believe yesterday or today, he said that he was gonna make sure and that her decisions, quote, steer the court for decades against Berg's decisions. | ||
So I mean, that's how scary, and I think Robert's people are heavily backing Barrett. | ||
The same people that backed Robert's backed Robert's. | ||
So I believe that Trump will get his nomination through if he picks someone like Lagoa without a doubt. | ||
There's risk with Barrett that either if she goes through easily, she's a stealth candidate to undermine him, or that she may fail because of certain controversial decisions she's made on constitutional issues that will upset a wide range, not only half of Trump's base, but many independent swing voters. | ||
So Lagoa is the much safer, much smarter, much sager political choice. | ||
Rushing would be a great Supreme Court justice choice. | ||
Barrett is dangerous at every single level of analysis you look at. | ||
Particularly if you care about core constitutional freedoms and if you care about President Trump winning re-election and making sure the Supreme Court has his back, not is trying to knife his back come election day and election time. | ||
Well, there you go. I hope this gets to the White House. | ||
You've certainly made the case. | ||
And I think, too, I mean, you have to also, because Trump definitely does this, it's like in chess, weigh the enemy's moves after he makes his. | ||

We therefore urge Congress to make these necessary reforms to Section 230 and begin to hold online platforms accountable, both when they unlawfully censor speech and when they knowingly facilitate criminal activity online. | ||
Well, boy, I mean, that literally travels. | ||
I mean, that's literally the leftist modus operandi on social media right now, allowing Antifa or even pedophile networks have been caught using social media to operate and run their networks But then also censoring conservatives and Trump supporters. | ||
So what do you make of the statement? | ||
What do you make of the proposed legislation? | ||
If you've seen it yet, we know Section 230 is a problem. | ||
What do you make of this coming out of the Justice Department, Bob Barnes? | ||
Well, I was at a dinner last week with Attorney General Barr, where he made his presentation about how the lockdown is the greatest civil liberties violation since slavery. | ||
Hear, hear! Exactly. | ||
Absolutely right. He made an email. | ||
It was a fantastic speech. | ||
Two thirds of the speech I could have written for him 10 years ago, because I've been making the same arguments myself for many, many years. | ||
And he's a very nice guy in person. | ||
I still have doubts about the Durham investigation because he needed to send in someone like Gene Hackman from Mississippi Burning, and I think instead he sent in Barney Fyfe from Mayberry. | ||
But we'll see how that goes. | ||
I might have made that comment in his direction while I was there. | ||
But nice guy, very sincere, very straightforward, and he did preview that this was coming. | ||
Now, my argument to him and to Senator Hawley is to highlight and focus on using Section 230 as a carrot and a stick. | ||
To say, hey, Big Tech, we'll allow you to continue to have immunity from suit as long as you comply with the First Amendment of the United States Constitution and do not interfere in elections unduly. | ||
And part of that is recommended in legislation. | ||
I think it could be a little simpler, a little bit cleaner, a little bit neater, but it's in the right direction. | ||
And that's an important first step. | ||
And Senator Hawley originally had some complicated legislation. | ||
He's come back to the proposal that I talked about with him three years ago. | ||
So I think they are starting to—we need a legislative solution because the courts are closed, because they interpret Section 230 to preclude any suit against big tech for almost anything, even though yesterday they're all sued in a massive class action, because it turned out, as Alex and you have been reporting for years— It was disclosed this late summer that, in fact, Facebook and Snapchat and Instagram, particularly Facebook and Instagram, were illicitly spying on people, including in their bedroom. | ||
They were turning on their smartphones in secret and spying on people en masse, even though they told people they weren't. | ||
They found that out because Apple disclosed some underlying technology to developers so they could see what was happening, and that's what unveiled it and unmasked it. | ||
But right now, that lawsuit has some risk because of the scope and scale of Section 230 immunity. | ||
So it needs to change, and this is a critical move, and credit on this one, to Attorney General Barr for moving forward. | ||
In some cases, he's been a lot of talk and not a lot of walk. | ||
This is a situation where he's actually matched his talk with his walk. | ||
It's a substantive proposal. | ||
It's a meaningful proposal. | ||
It's a proposal that it needs to pass, though, frankly, there needs to be a change in who's in control in the House and partially the Senate in terms of some constituencies in order for this to actually have a meaningful chance. | ||
And, of course, President Trump has to win reelection. | ||
And it even re-relates to the potential Supreme Court nominees, whereas people like Lagoa and Rushing have pushed back on big tech monopolies. | ||
Barrett is just the opposite. | ||
As a Matt Stroller, a major antitrust guy who's big on breaking up big tech, big on exposing big tech, he comes from the left, but he comes at it from a perspective that big tech is a great antitrust threat to freedom and liberty economically and politically in America, notes that if Barrett is on the bench, Barrett may gut any of these reforms, may strike them down as unconstitutional. | ||
Remember the Koch Institute and Reason Magazine and these libertarian groups backed by Koch Foundation are big pro big tech. | ||
They're one of the biggest reasons we haven't had any legislative reform come out of Congress. | ||
And if they can sneak in a stealth candidate that could be a third coup against the president by getting them under the Supreme Court, a big tech supporter, then the legislative change may not even happen. | ||
That's why in order for this legislative change to happen, in order for the president to get re-elected, in order for these lockdowns to end, in order for these lockdowns to never come back, or forced vaccines or forced sterilizations or anything like it, that is why Barrett is probably the number one decision the president will make between now and Election Day, that will shape the future of American freedom, American liberty, and his own re-election. | ||
So it's a good move in the right direction, but it's a move that will only have meaning and consequence depending on what Supreme Court choice the president picks and what the election outcome is. | ||
But getting back to the behavior and activity of big tech, I kind of look at this and I'm like, you're giving them a bailout opportunity, really. | ||
It's kind of like in the Wolf of Wall Street when they basically offer him to cut a deal and he can pretty much keep all the wealth he gets and he ends up saying, screw you. | ||
I mean, to me, that's kind of the same thing here. | ||
I mean, they're basically giving big tech an out. | ||
But in a way, I mean, if Big Tech balks at this, could they come back around for a criminal investigation? | ||
Because again, we know about the illegal spying. | ||
We know about the colluding with China. | ||
Is this just kind of like, hey, look, here's an opportunity. | ||
Here's an opportunity. You can come clean. | ||
You can fix this now. | ||
Or you can balk at it. | ||
You know what? Maybe we will have a criminal investigation of you. | ||
Well, I think twofold. I think it's a step in the right direction, but it's not the ultimate solution. | ||
So the ultimate solution is to follow this up with antitrust action. | ||
We need to break up big tech. | ||
And big tech is like the big trust of the 19th century. | ||
The big railroads, the big oil companies, the big monopolies who are depriving both our economy of entrepreneurial engine and our politics of clean, fair, transparent, honest little de-democratic government. | ||
And Big Tech is the greatest threat to that, maybe even a greater threat than the Big Trust were, maybe the greatest threat in American history. | ||
And so this is a step in the right direction to at least provide some degree of access to the courts for relief and remedy by stripping them of Section 230 immunity unless they comply with the First Amendment. | ||
But it is only a first step. | ||
The ultimate progress and process has to also include and incorporate a meaningful antitrust civil and criminal investigations to bring meaningful consequence to the multiple violations of our rights that big tech engages in on a routine and regular basis. | ||
Let's get more into that on the other side, and from the historical legal perspective, you know, because... | ||
I mean, in a way, you look at this and you think, well, this is kind of all unprecedented here with what we're dealing with with big tech and social media, but is it really that unprecedented? | ||
We're going to get Bob Barnes' legal take on that when we come back because, yeah, we have had antitrust before, folks, so there is some precedent here, but it could be different. | ||
We'll find out. Oh, boy. | ||

He just told you his thoughts on Bill Barr's latest comments as far as Section 230 is concerned. | ||
But I want to hone in on a couple more things here. | ||
And I've got two questions for you, and maybe you want to answer the first one first, because it's kind of light and easy, and then the second one. | ||
But my question is, as we've seen John Solomon get suspended from Twitter today, it may be a permaban, I don't know. | ||
Of course, Solomon, regular Fox News guest, he's been covering the real Russian collusion with Joe Biden. | ||
He's been covering Spygate with the treason of Obama. | ||
And so, is this a sign? | ||
Is the D.C. establishment, in particular the conservatives obviously, are they finally realizing how serious this is when their accounts start getting taken down? | ||
Because, you know, that's kind of been a little bit of the D.C. arrogance. | ||
And, you know, I mean, folks, let's just call it what it is, you know. | ||
Infowars, Alex Jones, Owen Troyer, they don't care. | ||
They thumb their nose at us. | ||
But, oh, the DC-ites start getting hit. | ||
Oh, maybe now they have an issue. | ||
And maybe you can handle that kind of quickly. | ||
But then the other one, you know, Josh Howley has been repeating this over and over and over again. | ||
His solution to the big tech censorship is letting people sue big tech. | ||
Letting them sue big tech. So your take is, are the D.C. establishment conservatives finally getting it now that it's not just Alex Jones, but them getting censored? | ||
And what do you think about Josh Hawley saying, look, we need to find a way to let people sue big tech when they get censored? | ||
If the conservatives were smart, they would be focused on big tech censorship. | ||
But the fact they have not rallied to the cause of Alex Jones and Infowars was a big warning sign. | ||
And the problem is this. | ||
There's not a think tank or institution in Washington that does not have ties to big tech in some meaningful manner. | ||
So the problem is they don't want big tech censorship to occur. | ||
But at the same time, they don't want to take on big tech censorship because the big donor class, like the Koch brothers, like Reason.com, like the so-called libertarians, constantly back them because they've been corrupted by big tech influence. | ||
When I first started raising this issue three years ago, bringing lawsuits, trying to find access to the courts, the courts were closed, the courts wouldn't listen. | ||
Use Section 230 as the excuse and the pretext. | ||
That's where I started lobbying everyone I could in D.C. to take meaningful action, and luckily there were some people who were open to it, like Senator Hawley, to his great credit, when he won in 2018. | ||
He was one of the first people to listen at the CPAC convention in early 2019. | ||
But there are many who still won't. | ||
The corruption of the conservative establishment, what Michelle Malkin calls Khan Inc., is very corrosive on the ability to have meaningful reform coming out of the Washington legislative branches. | ||
I agree with Senator Hawley that you should open up the floodgates to suit by changing Section 230 to making it a carrot and stick combination. | ||
I don't want a government regulatory agency controlling big tech because that always ends up getting captured by big tech. | ||
And working against the people. | ||
This is my old argument with my old client, Ralph Nader. | ||
You create new government agencies, all that happens is the big boys use them as power over the little guy and ends up causing the very harm you were trying to preclude and prevent in the first place. | ||
So if we want to change that, the way to do so is to open up the courts To individuals being able to sue by changing Section 230 with a carrot and stick effect, whereby if they want to keep any immunity, they have to comply with the First Amendment. | ||
And when they don't, you can sue them and get attorney's fees for it. | ||
That's some of the proposal that Senator Hawley's discussing, part of the proposal coming out of the Justice Department today. | ||
That's a great first step. | ||
But it can only be a first step. | ||
We need state attorney generals to keep their word. | ||
We need Attorney General Barr to keep his word. | ||
We need to see major civil and criminal action against the antitrust monopolists that Facebook, Google, Twitter are and remain and continue to be. | ||
I mean, the president made a great deal in terms of pushing against TikTok and not allowing foreign control of social media monopolies, but we need to go forward and not have social media monopolies in the domestic United States that are violating our antitrust laws in the same way the big monopolist of the 19th century did. | ||
You know, because I agree with Howley, and I'd like to see this happen, but, you know, I think that the problem that we run into here is, you know, say someone like myself, you know, I have very little interest in litigation. | ||
You know, I don't want to get involved in it. | ||
But I've been banned off all the big tech platforms. | ||
Now, I could sit here, and I could value out, and I could say, okay, let's say... | ||
You know, conservatively, what's a year? | ||
Let's say I get a million views a year across the spectrum here. | ||
Let's say I get a million views a year on YouTube, okay? | ||
Now, I could find out the value of that. | ||
I could find out the monetization value. | ||
I could find out the value of other such things. | ||
I could put a number on that. | ||
I can obviously put a number on attorney's fees. | ||
But, you know, how do you make it How do you make the window of opportunity bigger? | ||
Or how do you make sure that the door stays open so that there's actually a motivation for me or I have some sort of confidence behind me that if I do get involved in litigation on what to me are open-shut cases, I come in with some confidence that, hey, I'm going to be able to win this and they can't just send their big law people after me and have me shut down. | ||
I guess the question is, is there any way you can kind of make this You know, open a bigger window for people to sue. | ||
It's because it's not just about suing. | ||
I mean, you can sue them right now. | ||
It's how do you make it so that you can have victory? | ||
The key is if they would remove and change Section 230 immunity, then you could do two things. | ||
One, you could bring a class action because of the monetization of people's personal value is what all the money comes from. | ||
It's how Facebook makes its money. | ||
It's how Twitter makes its money. | ||
It's how Google makes its money is monetizing your personal information. | ||
And you should have a right to sue because they've monetized that under false pretenses. | ||
They've committed consumer fraud. | ||
They've been unjustly enriched. | ||
And there's a theory called disgorgement, which means that big tech should have to disgorge all of the profits obtained from misleading people into utilizing their services, such as promising them privacy protection that they reneged on and promising them free speech protection. | ||
Remember, Twitter said they were going to be the free speech wing of the free speech party. | ||
And they did that in order to induce the public to rely and depend upon them, which had the effect of monetizing the value of Twitter, that mass joining, the Alex Joneses of the world joining Twitter, the Alex Joneses of the world putting up content on YouTube is what gave them their value in the first place. | ||
And they have taken that value, pocketed the profits, then used the power to censor those they dislike and independent dissidents and members of the free press. | ||
And we could get major value if Section 230 would change. | ||
Right now, the biggest hindrance is Section 230. | ||
Now, the second hindrance would be if Trump put someone like Barrett on the bench who would strike down any laws that try to regulate big tech as unconstitutional, then we would be doubly screwed. | ||
But that's why a combination of legislative reform and making sure the president picks the right Supreme Court choices is essential and fundamental to making sure the public square returns to the public square rather than the private corporate monopoly that it is currently, which is involving and profiting for itself And using that control and monopoly over the public square to censor and squelch independent members of the free press and free speech on behalf of ordinary individuals. | ||
Quickly, Bob, in the last two minutes, forced vaccines, forced masks, we're seeing it come down the pipeline now. | ||
Does the government have the right to force, vaccinate, or mask you? | ||
Does a corporation have the right to force, mask, or vaccinate you? | ||
We're looking at bringing suits in all those contexts. | ||
And it's the reason why I focus so much on Barrett. | ||
If Barrett is on the Supreme Court, then our chances to resist a forced vaccine or forced mask rules are gone. | ||
Because she will approve it because she already has. | ||
In my view, the Constitution does not permit or allow them to force you to wear a mask. | ||
Well, hold on a second. Hold on. Not in your view. | ||
Literally in the Constitution. | ||
I mean, that's not your view. | ||
That's totally... | ||
A plain textualist, originalist view. | ||
We had seven epidemics between the time of the Revolution and the U.S. Constitution. | ||
They didn't put any emergency exception into the Constitution. | ||
That was in the Weimar Republic's Constitution that birthed Nazi Germany because they used that emergency exception to establish it. | ||
So we don't have an emergency exception in the U.S. Constitution. | ||
George Washington and our founders were intimately familiar with pandemics, and there is no virus exception. | ||
There's no pandemic exception. | ||
There's no emergency exception. | ||
We do not have medical Sharia law under the United States Constitution so that they can determine what you can wear on your face or not wear on your face. | ||
We do not have forced vaccination provisions so they can stick animal parts into your body against your will. | ||
None of these things are constitutional. | ||
They're directly contrary and contradictory to both the plain text of the Constitution and to the founding principles as articulated by the people who helped establish our Constitution in the first place, which was not just the founders, but was every Boston fisherman, every backcountry farmer, every ordinary, ordinary person who made sure the Bill of Rights protected all our rights. | ||
So we need to do so because these laws are deeply unconstitutional. | ||
As the Pennsylvania judge said, they crossed a line that they could not cross. | ||
And that is why we need to make sure that Amy Coney Barrett gets nowhere near the United States Supreme Court. | ||
