♪♪ ♪♪ Acting Director of National Intelligence threatened to resign if he couldn't speak freely before Congress on whistleblower complaint.
Now, my understanding of this, of course, is from the Washington Post, so they'll spin it, make anything look bad about Trump.
My understanding is that It's kind of like what they try to do with Roger Stone.
They say, oh, we can only have closed-door hearings.
That way they can lie about him, manipulate him, and destroy him, and he gets no public speech.
And he even gets gagged.
So, to me, I think that's what the Director of National Intelligence is trying to avoid, is to just say, hey, wait a second, I'll testify publicly and put all this on record so that you guys can't lie and manipulate it by doing a closed-door hearing.
So, ladies and gentlemen, today we had that hearing with Joseph Maguire, and it went exactly as I thought it would.
And so much so that the president tweeted out afterwards, you had Adam Schiff, little Adam Schiff, making things up whole cloth from the transcript that wasn't there.
And this is in a congressional hearing that his committee is chairing.
And if this would have been done behind closed doors, they would have gotten away with the whole thing.
But because they had to do it publicly in front of America, on television, everyone saw what the Democrats were engaged in.
Everybody saw little Adam Schiff with a D. President tweeted it out today, little with a D. We told you that.
It's not good, folks.
There's a reason that little bug-eyed pest is up there like a total fraud.
And I'm sitting there and I'm watching this and I'm like...

But it's beyond just the emperor's up there naked.

So they're constantly moving the goalposts.
They're constantly making new things up.
They're constantly holding press conferences.
They're constantly picking a new target.
They're constantly picking a new narrative.
They're constantly engaging in lies and deception.
And then they give you the reanimated husk of Nancy Pelosi to tell you that, oh, we're going to file an impeachment inquiry based on all the information that I haven't seen.
Oh. And so this is the test.
That America faces part two.
It's like the second part of your semester and we're about to have the final and the midterm was 2016.
And now the final is going to be 2020.
Now I have actually, I have had many moments, days, segments where I have come off as what people think is anti-Trump.
No, I'm just being critical of the president.
But there is no doubt heading into 2020 what the test for America is.
Do you want a corrupt shadow group, which can be labeled as the Democrat Party or the Deep State in modern nomenclature, do you want a shadow group of bullies and terrorists and liars and Who have now had 86 different reasons Trump could be impeached.

Think about this. They held three years of investigations for Trump-Russia collusion.
Three years. They got nothing.
Couldn't impeach the president on that.

From an unknown source, a third party of information, and they are moving for impeachment within a week of that release?

So America has a choice for 2020.
Do we want a president that stands up for America?
Do we want a president that is going to stand up for America in the face of globalism?
Do we want a president that is going to Just be the president and not be a total phony liar?
And isn't in this group of corrupt politicians?

So it's going to be even more pathetic.
But when you see everything the Democrats are doing right now to try to get Trump out, and it's not just the Democrats, But they'll wear the mask.
They'll be the face of impeachment.
It'll be Pelosi. It'll be Schiff.

I'm going to talk about this with Robert Barnes, because he's informed with this as anyone else.
Because he said it yesterday, but we should really bear down on this.
Ukraine... has been used as a center of corruption for so long.
That's why there's so much, as Robert Barnes said yesterday, money laundering, political laundering, weapons laundering, it goes through Ukraine because it's been so corrupt for so long.
But Trump, now working with the new president of Ukraine, Under the parameters of legislation signed by Bill Clinton and proposed by Joe Biden.
Yeah, that's right. See, they thought writing that legislation would sit them pretty to rig prosecutions in the future with Ukraine and the United States.
Another reason why they did a lot of their illegal activity there.
They had it rigged in the books.
Uh-oh. But now we have the presidency.
And not you, Biden.
No, not you, Clinton.
Trump has it, and he's using it against you.
And you are scared.
You are scared to your very core, because you know at the dirt bottom of this, you were all involved with Jeffrey Epstein.
You were all involved with Russiagate.
You were all involved with UkraineGate.
All of you.
And who knows what else you were involved in, making $100 million while you were in office, Nancy Pelosi?
Who knows what else you're involved in, little Adam Schiff who looked like you just sucked the essence out of an entire group of preschool kids, you demon?
Who knows what else these people are really up to?
But it ain't political, folks.
There is something dark and sinister beneath this group of corrupt individuals.

We're going to break it all down and tell you about why Ukraine was a center point for corruption.
Always a pleasure to have Robert Barnes in studio.
Yesterday, we got into some of the litigation that will be ongoing where Infowars is going to have to Look at the Young Turks and others to say, hey, you're not going to lie about us and get away with it.
We'll see your ass in court.
But today, I want to get into some other stuff with Bob because this whole impeachment thing has really gone nuclear, quite frankly.
And at this moment, I think we would both agree.
I expect the Democrats to impeach Donald Trump.
And I think all they need...
Is to flip two or three votes in the Senate.
I think they can do that too with Romney and a few other neocon Republicans.
And so we're sitting here, we're reviewing that.
But I want to get into something that we both kind of had a revelation on when it came to crown strike in Ukraine.
The laundering of information.
The harboring of classified emails.
The laundering of money, the exchange of influence all going through Ukraine, and how there was a bill signed, proposed by Biden, signed into law by Bill Clinton, which you can explain, that deals with the United States and Ukraine having to work together dealing with prosecutions, which we both figured, well, they thought they'd always have the Ukraine president, they'd always have the U.S. president, so they'd have control over Over any criminal proceedings there.
They can launder money and information, classified information, have CrowdStrike as the, you know, the hub of all of it over there in Ukraine, and they're getting away with all of it.
That's probably where Trump said, and that's the thing too, so let's get into this Ukraine as a front for all this corruption.
Trump said, hmm, because he was joking in the campaign, said, oh, maybe the Russians have it.
He said, well, maybe those emails, the 33,000 emails are in Ukraine.
Actually, they probably are.
They probably are in Ukraine.

There's no doubt.
I mean, what happened is Ukraine is sort of opens the door to deep state corruption and deep state collusion at a degree to which we were talking about yesterday, just sort of at a broad scale level.
But now the sort of minute details have come out that prove it and substantiate it even further.
First, you have the company that Hunter Biden, Joe Biden's son, was receiving that lucrative contract, $50,000 a month contract, for no justifiable reason that any independent third party expert could justify or verify.
Or substantiate the basis for.
At that same, one of the other key board of directors was a Mitt Romney ally, a Mitt Romney National Security Advisor, a guy with longtime ties and allegiances to the CIA and the intelligence community in the United States, was also on that board.
So what you had was what looked like a deep state front operation for laundering and funneling funds out of the Ukraine for the self-enrichment and self-empowerment of corrupt elites in the United States and Ukraine.
And so what the president was actually exposing was deep state corruption, deep state collusion, and it appears they are the ones behind this actual impeachment effort.
Today, there's been further confirmation of that.
The whistleblower has been identified by Breitbart and others as it appears to be a CIA agent assigned to the White House.
So it's the CIA clearly running it.
So it's the CIA, and he conspired with a lawyer who apparently is representing him, who publicly has said he's representing him, is also an ex-CIA spook, who is a longtime political ally of, guess who, ex-CIA director under Obama, John Brennan.

And let's remember, too, they're on record saying we're going to put spies in the White House.

Yes, exactly. I mean, James Comey bragged about it.
James Comey bragged about the things he could get away with that he would not be able to get away with in another administration because of the loose architecture.
Remember, this is why they took Flynn out first.
They targeted Flynn because Flynn was the guy who had the intelligence support, the military support, the national security support, who knew the white hats in the CIA, the white hats in the NSA, the white hats in the military.
So basically, because if you really try to think about this intellectually, it's like We're good to go.
It would support the president's independent agenda, not the deep state agenda.
To give an example, I had a high-ranking Trump ally contact me and wouldn't even contact me over regular email or phone.
He had a beard or sort of a cutout contact me first and say he needed to reach me.
Created a separate special Signal account.
By the way, for all those people out there, Signal is the most secure app in the world.
For any app, if you want to communicate by cell phone technology or other mobile technology, Signal is legit.
And it was ultimately confirmed when this individual was one of the top people involved in national security in the country who knew all about cyber control, who wanted to communicate with me about representing or giving legal advice to a high-ranking military individual who was under potential investigation related to General Flynn.
And so these communicated to me by signal and found out about it.
And the person who he wanted me to help was someone who had an impeccable 30-year pedigree who Mueller in the deep state was putting under microscopic investigation solely because Flynn had listed, here's who the White Hats are.
So all the Black Hats not only wanted to take out Flynn, but they waited until Flynn identified who the White Hats are and targeted all the White Hats.
So the... That's why they took them out.
This is another deep state coup attempt.
They planted a CIA spy in the White House to spy on the president, conspired with Brennan's allies and Democratic lawyers on the outside to coordinate and create a fake whistleblower complaint that then led to Schiff today doing a fake transcript from the stand that was a lie and a libel against the president of the United States.
That's unbelievable. And you had Pelosi just now confirm that the Intelligence Committee is going to be running the impeachment effort.
The Intelligence Committee has no supervision, oversight supervision over the president for impeachment purposes.
That should be the Judiciary Committee.
It's always been the Judiciary Committee.

I've got clips of Chuck Schumer, Nancy Pelosi.
They even say, like, Pelosi, we played yesterday.
It's like, well, I haven't read the transcript.
I mean, I'm trying not to curse right now.
But it's like, I mean, you know.
And then Chuck Schumer's like, well, you know, we don't know the basis yet, but we're going to find it out.

They've been told by the deep state to do this.
And that's the reason why Pelosi, who's seen the polling, seen the focus groups that say the American people have no interest, no desire, no want for an impeachment of any kind.
They see impeachment as an impeachment of them, the American people, their right to vote, their right to control elections, their right to determine and dictate who the president of the United States is going to be.
And they know that, so why are they doing it?
Why are they doing something that's so politically unpopular?
Why are they doing something that now 60% of the predicted betting markets say will happen, impeachment will happen, President Trump will face a removal trial?
It's because this is the intelligence community, the deep state coup, part two, going again after the president, after Mueller's efforts failed.
They're now doing it using the Democrats as the face, the Democrats as the beard, the Democrats as the mask of what is really an intelligence operation, Well, and I was saying that, too.

Alex was saying part three today.
I guess if it was part three, it'd be the illegal spying by Obama would be one.
Right. And then you'd have Russiagate two, Ukrainegate three.

Well, you had sort of the illicit spying was not yet a coup because he was just a candidate.
Right. So I think what Alex is saying is it's sort of deep state investigation or attempts to undermine the president, part three.
That's true. But in terms of a coup attempt, it's part two because this is the second time since he's been elected.

Well, here's why I am now believing that the Democrats will impeach Trump.
The whistleblower complaint into impeachment just shows that they don't care.
They're moving to impeach. They've already decided it.
Whatever it takes, they're going all in.
They're going for impeachment. Doesn't matter.
They had three years of Russian investigation.
They got nothing. No impeachment.
They had one week from a hearsay third-party source over intelligence that got released to the public, and they impeach over that.
That, to me, says, nope, they're going for impeachment.

They sent a blanket diamond and said, please sign here, and Pelosi was happy to do that.

Yeah, yeah, yeah. First, you've got to territorialize the moon, and then we'll move to Greenland, which is probably less inhabitable, or less habitable than the moon, potentially.
All joking aside, though, for real, they've been using Ukraine as a hub of corruption, laundering, political laundering.
robert barnes
I mean, there's been human trafficking, drug trafficking, all kinds of criminal operations, a proxy war between the European Union and Russia, the effort of the U.S. to use it as a money laundering technique, involve neo-Nazis in their operation, those with an actual Nazi legacy.
The CIA ties to the Nazis in Ukraine date to the 1940s.
It's one of our longest establishment, ongoing relationships with any Nazi party or Nazi members between the CIA and foreign governments.
And so it goes to the core of it, what the scale of it wasn't revealed until today.
When the board of directors of the same business entity and the same business corporation, laundering funds to the Bidens out of Ukraine, turned out to be a major ex-CIA related official with deep ties to the deep state, with alignments with Mitt Romney, actually served as Mitt Romney's key national security advisor in his 2012 presidential campaign.
He ended up being implicated.
You have an ex-CIA agent, or actually current CIA agent, who turned assigned to the White House, or turns out to be the illicit leaker, using his CIA role at the White House to spy on President Trump, using ex-CIA spies, who now operate as lawyers on the outside, who are allied with John Brennan, now using Adam Schiff at the Intelligence Committee, likely pre-scooped and pre-arranged this whole fake memo, fake whistleblower story, with Adam Schiff, dating all the way back to August.
The Intelligence Committee now running the impeachment effort, when the Intelligence Committee has no business running an impeachment effort, never has.
The Intelligence Committees are mostly a form of a post-1970s committees, didn't even exist before then.
They're supposed to regulate the Intelligence Community, and instead they're subservient to the Intelligence Committee.
That's why you see Senator Burr in such a deferential role in the Senate Intelligence Committee on the Republican side.
So it's no coincidence.
This is a deep state intelligence community, rogue agents within the intelligence community, coup attempt against the elected president of the United States.
It's part three in terms of Spygate to Russiagate to Ukrainegate in terms of their deep state coup attempts against the president.
But it's deep state coup part two in the sense that it's Robert Mueller part two.
Now as Adam Shifty Schiff, the intelligence committee, runs the operation instead.

Now, let me ask you this.
As it comes out today that the whistleblower was CIA, if you read more into it, it's kind of unclear when he was in the White House at the CIA. In fact, it almost sounds like he wasn't with the CIA at the time of Trump's presidency, so that makes me think, is it John Brennan?
But do you even believe that it was former CIA? Because they could just make up anything.
I mean, they could just throw anything out there just to try to control the whole narrative.
robert barnes
It has the fingerprints of a CIA operation, or at least ex-CIA operation.
So you have ex-CIA officials that are involved with Biden, that are involved with Romney, that are involved with the Ukrainian...

Because Brendan still has his security clearance, does he not?
robert barnes
Still does, absolutely, and he has deep ties.

And he could be tapping everyone's phone.
robert barnes
There are people, the CIA, for people's sort of historical preface for this, go back to the 1970s.
Look at what happened when the Church Committee started investigating the CIA, started outing CIA rogue operatives, started outing MKUltra, outing the various assassination attempts around the world, outing the U.S.'s role in overthrowing foreign governments.
That's why we passed a law to prohibit that going forward.
I actually had a lunch meeting with the CIA Director James Woolsey in the 1990s at the CIA in which he explained how the CIA planned to circumvent those rules on a regular basis.
So the CIA has deep institutional operatives that are continually, that are sort of Bureaucratic administrative officials but with the power of the deep state behind it.
Deep state meaning dual state in that they're administrative bureaucratic people who are unelected, not appointed by elected officials, but deep state because they have the power of the intelligence apparatus and law enforcement and national security and spying technologies and techniques that others don't.
This memo read like a CIA memo because they have information from the OMB. How do they get information concerning what the Office of Management and Budget is doing?
That was not publicly disclosed.
They had access to transcripts of phone calls and phone conversations between the President of the United States and the President of a foreign nation.
They have access to what inter-office communications were taking place with the Attorney General of the United States.
So the only way in which they could have access to all of that is it's either NSA or it's CIA. It's NSA because the NSA is monitoring those conversations and communications on a regular basis or it's CIA. It's style of written.
It's written like a CIA memo because it's speculative.
It's hearsay riddled, but it makes it sound authoritative and informative.

Well, and I wonder, too, I mean, an investigation needs to be done into this, I think, from Trump's perspective, because we know that they were illegally spying on him before he became president.
Yes. While he was president.
Yes. How do we know that this isn't just more illegal spying?
robert barnes
This is clear evidence of illegal spying.
The only way in which they could have this information and intel is if they were continually spying on him.
So they are constantly spying on him.
I mean, if I was the president in the Oval Office, I'd have the radio on in the background.
I'd try to communicate as much outside as possible.
Because it's clear, I think he knows that they're spying on him regularly and routinely.
That's why he was confident and he wasn't worried or concerned about this transcript.

And he even said that in a tweet.
He said, I know y'all are spying on me, paraphrasing.
robert barnes
Exactly. And that's what he's like.
He's like, I don't care. I mean, to his credit, he's got cojones the size of Mexico.
He's got a backbone that's really made of Pittsburgh steel.
So that has allowed him to continue to march forward.
But his real power is still the audience.
His real power is still his base.
His real power is still the American people.
It's they're only willing to go forward to the degree they think they can get one over on the American people.
So you have fake Nate Silver out there who's never been gold, always finishes second when it comes to political analysis and political betting.
Too scared to even bet me in the political markets.
I've offered him that about a dozen times.
If this guy would put his money where his mouth is, you could at least have some respect for him.
He's not. He's a total wuss.
But he's out there today saying...

No, go ahead. Because... That's just kind of a microcosm of all of them right now.
They never want to debate, but Nate Silver's like, he's the big odds.
He has the numbers, and it's because I think he predicted one election one time or so?

All he got right was 2012, and he got it right for all the wrong reasons.

And 2012 was the easiest election to predict.
I wasn't even involved with politics, and I remember hearing people talk about it.
I was like, oh, it's Obama by a landslide.
They're like, well, you don't know that. I'm like, he's incumbent.
He's got the media behind him.
robert barnes
Exactly. No party.
I bet a lot of money on Obama.
Would have made more money but for Nate sort of boosting Obama.
But his reasons for boosting Obama were completely wrong.
So it's like someone who bets a sports game and who tells you, oh, so-and-so's going to win because they're going to run the ball all over him.
And then they get out there and they win because the other team has four fumbles, but they can't run the ball, right?

So they run for two yards, pass for 900.

Exactly. They had a bad prediction that happened that they got a coincidental lucky outcome.
So Obama was going to win re-election for a while for the same reasons Trump is going to win re-election.
Even if there's a sort of popular hashtag now that's going out there that's saying, you remove, we re-elect.

And I think they should have transparency for that.

And additionally, I demand transparency from Democrats.
Who went to Ukraine and attempted to force the new president, who I met and is an outstanding person who just met.

And we were discussing this before we went to the last break, how basically we both believe that the president is going to be impeached at this point.
And let me just be clear too, because there's a lot of people freaking out about myself, about Drudge, and some of the other conservative commentary out there, or just general commentary.
They think, oh my gosh, Drudge has turned on Trump.
Well, that's not how I see it.
And if Drudge wanted to do that, fine, but that's not how I see it.
Drudge, I picked up on this a couple months ago, I talked about it on the War Room, how Drudge is highlighting fake news now to blow the fake news up now to add to the hysteria, add to the hype, so that when it all comes back around, he'll be there again to shed I see what Drudge is doing was a Paul Revere-like warning call that this is real, this is serious, this is significant.

Not because the president did anything wrong, but because the deep state is willing and ready and able to double down on taking out the elected president of the United States.
That's what he's been trying to scream at people.
Indirectly by how he's red flagged these headlines.
He's saying, look, this is real.
This is happening. This is who's behind this.

And it looks now like they may have been trying to recreate Louis Libby Part 2.
The modern day deep state operatives are not the most sophisticated group.
They have a lot of power, but they're a lot like John Brennan and James Clapper.
They lie and sort of Ridiculous ways at times.
They perjure themselves routinely and regularly.
They get caught in their deceptions rather easily.
They tend to repeat the past or try to replicate the template from the past.
They're like poor screenwriters writing a fifth version of a movie that failed after the second reboot.
So that's who they are.
It looks like they try to recreate Louis Libby.
So what happened with Louis Libby is Vice President Cheney's chief of staff leaked that a person who was associated with someone attacking W's plans to go into Iraq.
That Victoria Plume was, in fact, an ex-CIA agent, an undercover CIA agent.
That was a federal crime.
That led to Patrick Fitzgerald's appointment as special counsel, led to the indictment of Louis Libby, the chief of staff for Vice President Cheney.
They may have been trying to get Trump to do the same thing, knowing how Trump likes to attack those who try to undermine him improperly or inappropriately.
Notice Trump was very, very careful.
He kept hinting at what might be out there.
He said, I think they'll be surprised at who this whistleblower is, who they're connected to, what they're about.

Which we don't know. They're saying CIA, the lawyer for the whistleblower denies it, who you were pointing out in the break, also speaks Ukraine.

He speaks spook and he speaks Ukrainian.
He's connected to both very deeply.

The New York Times is saying it's a CIA operative.
That this whistleblower is.
So it's not just Breitbart now.
It's the New York Times confirming it.
And given the president's very careful comments that we just showed just at the beginning at the top of this episode, at the top of this aspect of the show, shows he's being deliberately careful.
He's saying, please pay attention to who this whistleblower is, but I'm not going to do anything to potentially out that individual as being a CIA rogue operative, knowing that that's how they nailed Louis Libby.
So I think that is smart and intelligent of the president.
He knows exactly what's going on.
He's going to double down just like the deep state is doubling down.
And he depends on the support of the ordinary people rallying to his cause and his base to make sure that he's not able to be taken out by the deep state.
Because that's the only thing preventing them from removing the president is the power of re-election of the president.
That's the only thing that's scaring them at this point.

That forces Trump, I think, politically for his own benefit, for the benefit of America, to have to release everything.
I would release transcripts of Obama's calls, Biden's calls, release transcripts of everything, declassify everything from the FISA memos, declassify everything from the spying on the Obama administration.
I mean, I would just go all out.

John Brennan. I mean, that's who this guy is.
His lawyer is a John Brennan ally.

His lawyer He speaks Ukrainian, according to various third-party sources.
His lawyer has deep ties to the whole Brennan-CIA apparatus.
So this reads like Brennan-Spygate, Part 2, Deep State Coup, Part 2.
It's the same sort of structure, the same sort of apparatus.
The memorandum that's written that this whistleblower supposedly crafts and drafts reads like the steel dossier.
It reels like the steel dossier, the sequel.
That's all it is. It's another setup, another plant job, another frame-up of the President of the United States.
That's why Adam Schiff had to go up there and do a fake transcript this morning.
He lied to the American people.
He said that here's what this transcript, here's what happened in this conversation.
And he relays a bunch of things that never happened in the conversation that are in fact directly contradicted and refuted by the actual real transcript.
That's why the president released it before Schiff could get up there and make up a fictional fabricated transcript.

And then the hearing happened today, and it was just the full display of the Democrats, just the full display of Adam Schiff and his bug eyes and how they're just—it's all a Get Trump campaign.

Jones didn't appear in court today, but the families did as the free speech case against the controversial conspiracy theorists took another twisted turn.
Fox 61's Matt Caron live outside of the state Supreme Court with an update.
Matt. Well, today, Alex Jones' attorney, Norm Pattis, argued that Bridgeport trial judge Barbara Bellis' decision to sanction Jones for his recent comments was unwarranted.

The state's highest court heard arguments in the defamation lawsuit brought by Sandy Hook family members against conspiracy theorist Alex Jones, who for years said the school massacre was a hoax.
Alex Jones speaks in the vein of conspiracy theorists, as conspiracy theorists have spoken in this country since the founding.
Thursday's arguments centering around alleged threats Jones made on his InfoWars internet broadcast against Sandy Hook family attorney Chris Maddy.
We addressed it by enhancing some security around our office.
There was no threat here.
Chris Maddy's no wallflower.
Whatever we've had to deal with, either me personally or as a firm, pales in comparison to the abuse that he unleashed on the people standing behind me.
Those Sandy Hook family members declined to speak.
Inside the court, Maddie's counterpart, Joshua Koskov's spirited exchange with Justice Steven Ecker.
This case is a loaded case.
Your firm brought the case against a known conspiracy theorist with a big microphone.
And you knew that when you did that, you were getting into a war.
The court is implying that we have to accept that if you want to bring a case against somebody that you believe is worthy of bringing a case against and it has done an injustice to you, you better think twice because you have to accept that we, as the court, are going to treat that person differently because you got what you asked for.
And that is the implication.
And in fact, a court should do the opposite.
Jones made his comments following the discovery that child porn was attached to emails sent from Jones to Sandy Hook family attorneys as part of the evidence discovery process.
...was responsible for that child pornography.
He'd like to see that person's head on a pike.
That is hyperbole.
Now, the justices made no ruling today, but the trial court judge did previously rule that Jones and Pattis stonewalled the court and the defense by not producing evidence documents and handing them over.
Pattis, meanwhile, is arguing that they did produce 57,000 emails.

Well, I mean, the big news today was that no matter what the ultimate court decision procedurally, that every Connecticut Supreme Court justice asked meaningful, important, serious questions challenging and questioning what happened in the trial court, making clear that the First Amendment protects the right of everybody,
including people who may be parties to a lawsuit, that you do not lose your First Amendment rights solely because you are sued, you do not lose your First Amendment rights as part of the free press, I think?
A court has no inherent authority to violate the First Amendment to the United States Constitution.
And as we will be playing later in the hour, there are clips of justices from the Connecticut Supreme Court making that precise point.
That if a part of a motive of a decision, even if it's a mixed motive, if that motive is in part to violate someone's First Amendment rights, that requires the Connecticut Supreme Court to overturn that or at least make clear that that part of the decision is legally wrong.
So that no matter what happens, I mean, the case itself is sort of a distraction in many respects, as you point out.
That's not going to be the lasting legal legacy of this case.
The lasting legal legacy of this case is how the case is litigated on First Amendment grounds, what new First Amendment rights are being protected for an independent free press in America, what free speech rights are being protected for people just because they happen to be commenting on a court, just because they happen to be commenting on ongoing court proceedings, just because they happen to be commenting on litigation.
I've received a range of death threats.
I received bomb threats that the FBI is still investigating because of my pro bono representation of the Covington kids.
What I didn't do is go begging to a court to stop anybody from saying bad things about me because I'm willing to be a stand-up lawyer, not be a whiner who tries to seek the misuse and abuse of judicial power like the Costco firm did in that case.
So what we do and what we want, and no one was calling for any bad thing to happen to any of the lawyers or law firm.
Nor is anyone calling for it now, to be clear.
We want them to lose in court.
We want them to lose with the judges.
We want them to lose with the jury.
We don't want them to be allowed to violate First Amendment rights.
They're freely and fully entitled to pursue their political and legal agendas they see fit.
But what they're not allowed to do is ask any court to seek to misuse and abuse its power to suppress and censor speech, which is precisely what they did in this case, and it's what the Connecticut Supreme Court questioned them on today.

I know that they're just doing that to lie and to get their political agenda.
And so let's just say someone decided to get up in front of a Supreme Court and said...
Infowars and Alex Jones is encouraging people to go to houses and get violent and intimidate people.
That's just an inherent lie.

It's a complete fabrication.
And that is why they have not produced one incident of actually ever occurring.
That's a total public myth.
It's a total lie spread by those out there.
And it's part of an ongoing campaign of libels and lies that the press is engaged in on a routine and regular basis to misrepresent, misportray, misperceive.
And that's why what this was about today was about no matter the consequence on the case, the case is secondary.
This is about a much bigger issue.
This is where Alex Jones is the tip of the spear for everybody's First Amendment rights.
Everybody is Alex Jones when it comes to this.
There's a lot of people that have problems with what other lawyers have done.
It is very important that we have forthright public discussion, as the U.S. Supreme Court made clear in a range of cases cited by Norm Pattis today, who made excellent, effective advocacy.
People can go online and listen to the whole hearing if they wish, and made clear that, as a clip of a play later discloses, where Norm Pattis is talking about he often disagrees with Alex Jones.
He often has different opinions than Alex Jones.
But he would much rather be standing with Alex Jones' free speech rights than have any official actor, any governmental actor, suppress, censor speech, punish speech merely because that speech happens to concern another lawyer, happens to concern ongoing litigation.
If the judge wanted to issue a gag order, she could if it was a constitutional one.
So there was no gag order in this case, nor could there have been constitutionally within the scope that the other lawyers are talking about.
They didn't even ask for it because they've been playing to the press every five seconds.
So the idea that we should be silent about these cases, we should not discuss major constitutional issues, Merely because somebody is a lawyer, merely because somebody is a litigant or because someone has been sued, being sued does not deprive you of your First Amendment rights.
You should be respectful about your criticism of other people, but the First Amendment doesn't require respectful criticism.
It only requires that the criticism not be a true threat, that you're not allowed to falsify information in certain ways.
But it's otherwise protected speech.
And if you think somebody defamed you, the remedy is to sue them.
The remedy is not to ask the court to interfere in a different case and prevent them from having their legal remedy against a different party.
So hopefully there was many hopeful signs today from the very thoughtful and thorough questions of the Connecticut Supreme Court that went right to the heart and soul of the real issue.
The real meat and potatoes of the issue.
Which this is not about that case.
This is about First Amendment rights of ordinary people when they happen to be sued in the case.
This is about the First Amendment rights of the free press when they happen to be a defendant in the case.
Do they lose their First Amendment rights at the courtroom door?
Does the fact that there's a case pending in a court mean they no longer have free speech outside of that court?
Does the fact that a case is pending in court mean they no longer have free press outside of that court?
Because what that would encourage is a disturbing pattern.
Well, what happened is people would deliberately sue people and sue members of the press, particularly the independent press, with the intention of silencing them, saying, hey, you know what?
I've sued you. So now you can't talk about anything concerning me, concerning the case, concerning any issue even related to the case, concerning lawyers in the case, concerning law firm involvement in the case.
This would be a protection for corrupt lawyers because who's going to recognize and spot Corrupt lawyers more than other lawyers in a case.
I'm not accusing the Costco firm of being corrupt, but the speech rights implicated here would endanger the ability to expose corrupt lawyers in other cases.
That's why it must be for years, I've argued this with judges all across the country, and said, look, it's important that parties be able to freely communicate because that gives confidence to the judiciary.
What gives faith to our judiciary is we know that the people closest to them are meaningfully observing them, meaningly reviewing them, and meaningfully reporting them.
If they do something wrong or incorrect in their opinion.
When we start silencing and suppressing and punishing speech, we endanger democracy and we impair the integrity of the judiciary.
We make our legal system look bad.
We make our judges afraid of public discussion, afraid of public discourse.
We don't want the message to be out there to say, hey, us lawyers need special protection judges.
Don't let the other side say anything bad.
People have done... The U.S. Attorney's offices have launched false criminal investigations concerning me.
They've launched false civil audits concerning me.
I've been subject to every kind of wrongful persecution, retaliation any lawyer has in this country.
I don't go running to courthouses begging for special protection.
That's part of, you want to get into the ring, be willing to get into the ring.
So that isn't to justify and exculpate everything that's ever been said, but what it does mean is speech is a broad and wide protection.
The lawyers should not be running to courts asking for special protection just because they're lawyers.
Lawyers impose special obligation on us as lawyers, not special protection from speech by outsiders.
Even people we sue have free speech rights.
And that is what the Costco firm apparently did not learn.
And so hopefully the Connecticut Supreme Court asked important questions today.
Nobody wants anything bad to happen to anyone connecting to the case whatsoever.
What we do want is a free speech and free press that's broadly fully protected.
And that's what this is about.
This isn't about even the lawyers involved in the matter.
This is about free speech and free press for everybody, establishing important precedents.
This is Alex Jones being the tip of the spear to protect everyone's rights in America.

All right. Robert Barnes in studio.
Break down some of these clips, some of this content that we saw or that we will now see from the case in Connecticut today.

So we have seven justices up on the Connecticut Supreme Court.
Four of them recently ruled against the gun company in a Sandy Hook related case.
Controversial opinion. There are three dissenting justices.
Very thorough and thoughtful questions by all of the justices.
A lot of them are perceived as having liberal or democratic political allegiances or alliances, and none of them are known as Alex Jones fans or supporters.
But they did understand the importance and significance of the First Amendment questions being asked here.
How important that is for a free press, how important that is for free speech, that the free courts require also the free press and free speech be respected by both the litigants, the lawyers, and the courts in the process.
So we'll go to this first key, and this is one of the key questions that's recurrent throughout the process that each of the justices is asking some variation of, and this will be a simple, succinct version of that question.
And so let's go to clip number one, and you're going to have one of the justices asking Talking about the key issue, doesn't this issue involve protected speech?

Let's go to clip one. But if we were to find that Mr.
Jones' statements were protected speech, could we even get there?

So you hear that? If we were to find that Mr.
Jones were protected speech, could we even get there?
Could we even allow what happened here?
Could we authorize this? Could we approve this?
Could we be seen as signing off on something that has never been done before?
A court using its power in Connecticut to censor someone and suppress someone and punish someone and their legal remedies in a court case because of their outside-the-courtroom speech.
And in fact, there are famous cases involving this.
A famous case years ago in the 1940s, Bridges, that went all the way up to the U.S. Supreme Court.
You can Google Bridges, United States Supreme Court, free speech, find out all about it.
And there a court had issued an injunction, or was going to issue an injunction against the labor union being able to strike.
And one of the litigants, one of the head members of the union, Mr.
Bridges said screw that court we're not gonna do that and so that court said hey that's absolutely inappropriate I have inherent authority under the court system to not let you do that and so I'm not gonna let you do that I'm gonna punish you accordingly. It goes all the way up to the United States Supreme Court and the United States Supreme Court said no court in America has the inherent inherent authority to violate the First Amendment to the United States Constitution.
The foundation of the Bill of Rights, the fountain of American liberty, is the First Amendment to the United States Constitution.
That case was discussed today by the Connecticut Supreme Court, and that case is one of the cases being referenced in the question being asked.
So let's go to another question by another justice of the Supreme Court.
Remember, there's seven members of the Connecticut State Supreme Court, all of them today asking thorough and thoughtful, important First Amendment questions about the ramifications and implication of this case going far beyond just the case itself, going far beyond Alex Jones.
Going to the core First Amendment rights of every American, every member of the free press, every American's free speech rights, every person's rights to comment on the court system or the lawyers, even if they happen to be sued in the case.
In fact, they are often the best people to comment on what's happening in a case.
They are the closest observers to a case.
So let's go to clip number two.
And here the court is asking, if you have a judge violating someone's constitutional rights, why doesn't that taint everything?
Taint everything that's happening.
And these aren't my words.
Those are the court's words. Let's go to clip number two.

If you have a mixed motive for something, then why would you separate that motive out if you have somebody abusing a person's constitutional rights?
In this case, a court judge, why doesn't that taint everything?
robert barnes
Have you heard that? If you have a, in this case, a judge abusing someone's constitutional rights, those rights being Alex Jones' constitutional rights, why doesn't that taint everything that's happening at that trial court proceeding?
That's the question of a Connecticut Supreme Court justice.
A justice widely perceived as not being an ideological or political ally of Alex Jones of the political right, but a justice who understands the value, significance, importance, and consequence of the First Amendment implications of this case.
That is an important question, a key question, a critical question, and it is the question in this case.
Whatever the court decides on other procedural or technical grounds, Whether some other way to affirm or approve what the trial court did, it is critical for First Amendment rights that this court enforce those First Amendment rights by saying what happened at the trial court proceeding in regarding the speech was wrong.
Let's go to another clip where another justice is asking the same question on the same variation.
And what they're talking about is mixed motives.
So a lot of people hear about mixed motives in employer civil rights cases.
That's where an employer is like, well, I don't like this person because of their race.
I don't like this person because of their gender.
I don't like this person for some impermissible reason.
But, you know, they're also incompetent.
They're also bad at their job.
They also made a mistake. So even though part of the reason why I'm firing them is because of the color of their skin or their race or their ancestry or their religion or their gender, or because they didn't go along with sexual harassment or something else, I'm also going to fire them.
I have a legitimate motive, too, because heck, they did screw something up.
And what the courts have always said is we cannot allow those cases, we cannot allow an employer to do that.
That's still impermissible, invidious discrimination against the civil rights laws of America.
That even if you have a legitimate reason, if an illegitimate reason, in the words of the other Connecticut Supreme Court justice, taints the decision-making process, it is important not to allow, authorize, or approve that action.
So the logic of Mr.
Norm Pattis, the counsel for Infowars, and Mr.
Jones in the case, as he very effectively and advocately and passionately argued today, is that in a mixed motive situation, we cannot approve or authorize, least of all a judge, doing such illicit actions in conduct.
So let's go to clip number three, where the court talks about the problems of an unconstitutional motive.

And so when there are two reasons, in a mixed motive analysis, I think under Mount Healthy in those cases, if the unconstitutional motive is in there, then you lose.

Here you hear it. If the unconstitutional motive is in there, you lose.
He's referring to the people challenging or trying to get the trial court to approve.
He's telling the firm that's trying to get the sanction order authorized and approved, you lose if there was any unconstitutional motive that was any part of the process.
That's the right legal analysis.
Another thorough and thoughtful question by seven justices today, all of whom communicated thorough and thoughtful questions in the oral argument concerning the case about this important issue, precedent-setting issue of free speech in this country, free thought in this country, free press in this country, including in the context of the legal system, including in the context of disputes within the courthouse when the speech is made outside the courthouse.
So let's go to another clip.
And here's Norm Pattis disclosing and sort of summarizing what the core issue is at the end of the case, at the end of the oral argument, where Norm is explaining that he often disagrees with Mr.
Jones. He has strongly different opinions than Mr.
Jones. We're good to go.
The ability to be an effective advocate for anybody, for any idea, in the courthouse of ideas, in the public marketplace of ideas, is to have fully protected free speech.
And that the far greater threat is not someone with whom you disagree, but is any actor of the state, any officious action, which is just a fancy phraseology for official action, is officious action, which you'll hear him use a reference to in his dialogue and his speech in the quote coming up.
is a far greater threat to free speech and free thought and free press for everybody in America.
So let's go to clip number four and hear Mr.
Pattis speak in his zealous advocacy for the First Amendment today in the Connecticut Supreme Court in a case brought by Alex Jones.

In practical terms, what did you really lose here by this sanction?
A lot. Enormous expense and aggravation.
And now we get to go through the discovery gauntlet all again against claims that we think are fundamentally frivolous.
The claim is that Mr.
Jones' speech caused others to act.
To intimidate the Sandy Hook families.
That issue, the proximate cause issue there, is not worth the time it takes to litigate.
They raised this unusual cut book claim that you can silence a person who says what you don't like because he sells products independent of any relationship of the speech to product.
That case is not worth the time it takes to litigate.
There is nothing about this case that has merit.
And I don't know why Mr.
Jones should be required to undergo the expense of this litigation when his view is, and I share it, the stated objective here is to silence a man who is, quote, notoriously bad.
I mean, what was that? This is an attempt to silence speech, which is exactly what the legislative history and Representative Tong's remarks said the anti-slap provision was for.
Mr. Jones is unpopular, but he says things I often disagree with.
Prior to getting involved in this case, I never paid much attention to him.
I look at him now. I don't always agree, but I would rather have him at my side in almost any circumstance than an officious intermedaler who's going to tell me I'm notoriously bad because they don't like what I say.

And that's what he means. And what he means by officious intermeddler is the state government actor, someone, in this case, a courtroom, a courthouse, a court using its power, as the trial court did, to suppress, censor, and punish speech.
That's what's so dangerous.
The court's opinion, and we're not questioning and criticizing the court itself, we're criticizing the opinion, we're criticizing the action, we're criticizing the officious intermeddler who's interfering and impairing free speech and free press in America.
That's what the Supreme Court petition was all about.
The Connecticut Supreme Court almost never takes these kind of cases.
And yet here they did. They took this rare, extraordinary, exceptional action because they recognized the constitutional consequence of this case.
That if this is allowed to be affirmed, if this is allowed to be upheld, If this sanction is approved of under the terms promoted and propagated by the court and by the advocates and by members of the press concerning it, then nobody has any free speech or free press when it comes to any ongoing court proceeding in America, particularly those who have been sued.
You can sue someone into censorship, sue someone into denial, into suppression of their First Amendment fundamental rights and liberties.
That's why this case is so critical, so essential, so fundamental to First Amendment rights and liberties to this country.
And that's why Alex Jones is willing to be the front of it, willing to be the face of it, willing to be the brunt of it, taking all the hits for everyone else, as he's been doing for the better part of two decades as a leading member of the independent free press in this country.
So that is why this case is so consequential.
You'll see members of the media try to drag it into something else, try to talk about discovery disputes, try to talk about Sandy Hook.
Try to talk about anything.
Try to talk about the lawyers involved.
Try to talk about some of the politicians involved.
That's not what the case is about.
This case is about the First Amendment.
Does it apply to people who've been sued?
Does it apply even when you make statements that other lawyers don't like?
Does it apply even if the court is the one that's taking the action that suppresses, censors, or punishes speech?
And because it has to.
If it doesn't, then we've created a truck-sized loophole that would gut the First Amendment freedoms in this country for both free press and free speech for all Americans.
That is why the case is so fundamental, so critical, so essential.
And the decisions that come out of this court case are going to be important.
But just the critical questions the court was willing to ask today is a great step forward for the protection of the First Amendment in the United States.
States, they showed a thoughtful court, a thorough court, a competent court willing able to recognize the importance and significance and consequence of their decisions and actions and how precarious this precedent may be if allowed to stand.

You know here's what is probably gonna happen too.
It won't even matter the result of this.
It could be total victory for free speech and Alex Jones here.
And I'll still hear the numbnuts coming up to me say, Alex Jones and Sandy Hook and lost his kids and threatened people.
And it's just like, oh, gee.
Because they won't report on this.
They'll report on... Alex Jones sued by Sandy Hook families, and then that's all they'll report on, and then they'll never report on the result.

There will be continued efforts by the press and the politicians to lie and libel Alex Jones, and that's why we're seeking remedy by suing the Young Turks who did so, seeking remedy by suing Brianna Wu, have letters out that more lawsuits will be coming,
including against Market Watch if they don't correct within the next 30 days, including against other Market Watch is a subdivision of Dow Jones, which is a We're good to go.
A hundred years from now, a lawyer will be citing the questions these judges asked.
A lawyer will be saying, hey, you cannot do this.
And maybe it'll be some small person, some little small newspaper operation in a small town somewhere in rural America.
Maybe it'll be some little person who's been sued who doesn't have a lot of means, doesn't have a lot of resources, but they've heard about Alex Jones, and they've heard about the First Amendment, and they've heard about his Connecticut court, and they can get these public records from right online, and they can cite to them themselves.
Maybe they're representing themselves.
And they can say, Alex Jones, in this case, established, listen to these judges' questions.
Listen to these justices' questions.
Many of them Democratic judges.
Not politically aligned with Alex Jones.
They're not big, prominent supporters of Alex Jones.
These are independent, thoughtful justices saying, hey, this is First Amendment rights.
Asking, but if we were to find that this was protected speech, doesn't that resolve the issue?
Asking, if a judge violated someone's constitutional rights, why doesn't that taint everything?
Asking, when there are two reasons in a mixed motive analysis, if the unconstitutional motive is there, then you, the unconstitutional actor, lose.
So that is the importance of these questions.
These questions will last long before they can continue to smear Alex Jones all they want.
We will fight back in the court of public opinion.
We will fight back in the courts of law.
We will fight back in the courts of appeals.
We will fight back in the Supreme Courts of the country, including the Supreme Court of the United States.
But it is the audience that Their rights are going to be protected because of the willingness and readiness of Alex Jones to be the front of this, and that is why their critical support of InfoWars is the fuel that protects against all of this, is the fuel that energizes it.
