MyronGainesX - D4vd Faces Death Penalty, US-Iran Ceasefire On Brink, Postwall 33 Yr Old 304 Cope Aired: 2026-04-21 Duration: 44:00 === Building The Prosecution Case (06:28) === [00:00:00] So, obviously, as you guys can see here, this is the worst crime that you could commit, right? [00:00:04] Because number one, the girl is underage. [00:00:07] Number two, not only is she underage, but she was murdered. [00:00:10] And then they're claiming that she was murdered by being lured and then being killed. [00:00:15] And then they're claiming that it was a kill for financial gain because apparently she might have had some information that might, you know, put him in a weird spot and he can, you know, get his career messed up, blah, blah, blah. [00:00:27] Right? [00:00:27] That's kind of the gist of it. [00:00:32] So that's what they're claiming. [00:00:34] And we're going to see what some more of the evidence is. [00:00:36] I didn't watch this full press conference, guys. [00:00:38] I was going to watch the full one last night. [00:00:40] Well, yesterday when it came out, I was going to watch it, but I said, you know what? [00:00:43] Let me go on and watch it live with the squad. [00:00:46] So you guys are getting the first raw reaction here. [00:00:50] As we will show in a court of law, and what I also want to make sure about that the understanding of these charges is clear, is my description of these charges is not evidence that we are going to present in court. [00:01:03] These charges, in fact, will not be evidence in the court. [00:01:07] Evidence will be the witness testimony, the documents, and different types of admissible testimony that we will admit into court in the prosecution and if it leads to the eventual trial of Mr. Burke to convince a jury of 12 people beyond a reasonable doubt that each and every one of these charges is true, as well as the special allegations and circumstances that have been alleged. [00:01:36] Okay. [00:01:36] First of all, we suspected that David would be charged with murder after that was what he was arrested for. [00:01:42] That mugshot is crazy. [00:01:44] I ain't gonna lie. [00:01:45] And in other court documents that came out a couple months ago, we know that he was being investigated for murder. [00:01:50] But first degree murder with special circumstances, lying in wait to kill, murder. [00:01:56] Yeah, and that explains why it probably took them so long to go after him, is because they were trying to make a case. [00:02:02] Obviously, this guy's a large music artist. [00:02:06] What's his net worth? [00:02:07] Let's see here. [00:02:16] Two to three million. [00:02:17] What? [00:02:20] It's got to be higher than that. [00:02:22] It's got to be higher than that. [00:02:23] Either way, the point is that he has the ability to hire good lawyers, right? [00:02:27] And whenever people have the ability to hire good lawyers, you got to come in with your T's crossed and your I's dotted, especially for the state. [00:02:34] So that's what's going on right now. [00:02:41] Can't fuck up. [00:02:46] Especially granted, given who the victim is. [00:02:48] You know what I mean? [00:02:48] I mean, we're talking about an innocent 14 year old girl here, a child. [00:02:52] So they got to cross their T's and dot their I's. [00:02:54] That's why it took them a while. [00:02:55] And just so you guys know, also, the DA's office, man, like, I don't know how to sound like an asshole or whatever, but a lot of times these niggas are retarded. [00:03:03] And what I mean by this is, is like, they're just not as, they don't have their T's crossed in their I's, dotted like the feds do. [00:03:09] Okay? [00:03:10] They take every case, every case. [00:03:13] And Los Angeles. [00:03:15] Right? [00:03:15] Is a busy docket. [00:03:17] Very busy. [00:03:19] So they have lots of cases. [00:03:21] They don't have the privilege that the feds have, where the average AUSA has maybe 10 or 15 cases. [00:03:27] Right? [00:03:28] So these prosecutors have hundreds of cases. [00:03:32] Everything from a disorderly conduct all the way to a murder one. [00:03:38] Right? [00:03:40] Some of these DAs literally have like a crazy caseload. [00:03:44] So since they have a crazy caseload, You know, they can't win them all. [00:03:50] And also with the DA's office, DA's office isn't like the feds where they don't care if they lose. [00:03:56] The feds care if they lose. [00:03:57] DA's office doesn't. [00:03:59] This is part of an investigation, murdering for financial gain, and now facing the possibility of the death penalty, even though it's my understanding there is a moratorium on executions in California. [00:04:10] That is a huge deal. [00:04:12] And in a minute, we're going to get to the reasons the DA believes the evidence. [00:04:17] Yeah, David, let's see how old this nigga is. [00:04:22] He was 14 at the time. [00:04:25] Yeah, he was 20 at the time. [00:04:26] So, yeah, like, completely unacceptable. [00:04:29] You can't be with a 14 year old as a 20 year old. [00:04:32] Even Romeo and Juliet laws are not going to cover that. [00:04:34] You know what I mean? [00:04:35] In California, Adrian Kazan is 18. [00:04:37] So, he, bro, is cooked. [00:04:38] And I was wondering why they never charged him with that. [00:04:40] Cause I was like, okay, you might not have him on murder, but can't you guys get him on like, you know, statutory rape or something? [00:04:45] Like, but I guess they don't need to. [00:04:49] I mean, yeah, I guess, you know, Now they are. [00:04:54] Shows that. [00:04:55] But what you're seeing are different alternative theories on how to prove the murder charge here. [00:05:00] And clearly, they believe David is at the center, that David is the one responsible. [00:05:06] He might have not been the one that killed her, but he probably put some people to do it, though. [00:05:12] That bro probably put some people in to do it, man, unfortunately. [00:05:16] Clear, he is innocent until proven guilty. [00:05:19] And we don't know the exact evidence that the prosecution is going to produce. [00:05:23] But also, the sex charges. [00:05:25] This is something we have talked about before. [00:05:28] Yeah, I was wondering why it took so long, too. [00:05:30] Dee Fisher, the private investigator who has been representing the owner of the property where David had reportedly been staying at in the Hollywood Hills, reportedly near where the Tesla was found, he has been saying for months that David could already be charged with sex crimes. [00:05:45] That aside from the alleged murder, there's evidence that David was allegedly having a relationship with a minor. [00:05:51] Yeah. [00:05:52] Yeah, 100%. [00:05:54] 100%. [00:05:57] And you heard Nathan Hockman say continuous, meaning more than one time over a period of time. [00:06:04] And you're going to hear later when Hockman talks about digital evidence. [00:06:08] Are we suggesting here text messages showing this relationship? [00:06:13] Photos? [00:06:15] Videos? [00:06:16] Witness statements of those around the two, maybe? [00:06:18] And I'll tell you what this is the part of the press conference where Hockman talks more about the alleged crimes and he goes into the different theories. [00:06:26] Again, lying in wait, murdering a witness. [00:06:28] Take a look. === Digital Evidence And Timing (14:54) === [00:06:29] On April 23rd, 2025, as been alleged by the complaint, Celeste, a 14-year-old at that time, went to Mr. Burke's house in the Hollywood Hills. [00:06:42] She was never heard from again. [00:06:45] On September 8th, 2025, as alleged in the complaint, Mr. Burke, excuse me, Ms. Celeste remains her dismembered and decomposed were found in two bags inside of a front trunk of a car registered to Mr. Burke. [00:07:10] Thereafter began an investigation. [00:07:14] The investigation was to determine who killed, who murdered Celeste months and months before. [00:07:22] That investigation was carried out in unison and in partnership between the LAPD's Robbery Homicide Division And the district attorney's office. [00:07:32] At every point in the investigation, through the arrest and the filing of charges, the LAPD and the district attorney's office have worked in lockstep. [00:07:43] There's been no disagreements amongst these entities in deciding how to proceed with this case, ultimately leading to these charges. [00:07:51] You know what I think? [00:07:52] I think they didn't arrest him. [00:07:53] The reason I think why they arrested him without any paperwork, guys, if I had to put my hat on here, is they probably tried to get him to give a statement. [00:08:01] Right, see what they can get and then update their complaint with a statement. [00:08:07] Had he given one, but obviously he said, Fuck no, I'm not talking to y'all. [00:08:10] He probably lured up from the beginning. [00:08:12] So when they arrested him, he already knew not to talk. [00:08:16] But that's the only thing I could think of is because I'm like in my head, like, why didn't they just, you know, file a paperwork immediately? [00:08:22] But that's the only thing I could think of is like maybe they want to get a statement from him and, you know, add that to their criminal complaint, which we have right here. [00:08:30] But is there no affidavit attached to it? [00:08:32] Dude, this is why I hate the state, bro. [00:08:35] Like, the state is so fucking retarded. [00:08:37] It's like, do we not have an affidavit for this shit, man? [00:08:44] Like, bro. [00:08:50] Yeah, nothing. [00:08:52] See, this is why federal cases are just so much cleaner, bro. [00:08:56] They're so much fucking cleaner. [00:08:58] Because it's like, I know exactly what to look for, you know, but with the state, it's like retarded. [00:09:02] Like, they kind of just, it's like the Wild West. [00:09:05] Charges today. [00:09:08] So, what you have as well with these charges is that, again, there are three sets of charges that have been brought the first degree murder with special circumstances, the 187. [00:09:18] And again, those special circumstances are lying in wait. [00:09:23] That Celeste went to Mr. Burke's home on the night of April 23rd, 2025, as alleged in the complaint at his invitation, and again, was not heard from again. [00:09:37] The second is a special circumstance being that this murder was committed for financial gain. [00:09:44] As the evidence will show in court, the financial gain was for Mr. Burke to maintain his very lucrative musical career that Celeste was threatening. [00:09:57] On that particular. [00:09:58] Maybe she was threatening to go to the cops that they were fucking. [00:10:02] That's probably what it was, chat. [00:10:07] That's what I'm thinking. [00:10:10] I slow to appreciate you. [00:10:12] Because that would have cooked him. [00:10:17] That would have cooked him. [00:10:19] So that might be what it was. [00:10:25] What made him say, I'm going to. [00:10:28] Because the way. [00:10:29] Also, guys, she was killed viciously. [00:10:33] Okay. [00:10:34] She was killed viciously. [00:10:36] From what I understand, they couldn't even really get a full on autopsy, but obviously they dismembered the body, bro. [00:10:44] They dismembered the body, chat. [00:10:50] The third charge, in addition to lying in wait and for financial gain, is murdering a witness to an investigation. [00:10:58] In this particular case, as the evidence will come out in court, the witness to the investigation was Celeste. [00:11:07] And the investigation was into the lewd and lascivious. [00:11:11] There you go. [00:11:12] There you go. [00:11:13] So, more than likely, they might have had like a falling out, and she said, I'm going to go to the police. [00:11:20] And say that we had a relationship and you're going to go to jail and it's going to ruin your music career. [00:11:27] There's your motive. [00:11:30] There's your motive right there. [00:11:33] Sexual acts committed by Mr. Burke. [00:11:36] It is the subject of count two. [00:11:38] And that's why they had to charge everything at once. [00:11:40] Because in my head, I was like, yo, if you guys, like, why are you guys trying to, like, because in my head, I was like, okay, when they found the body, right? [00:11:47] When they found the body in his car, I was like, okay. [00:11:52] This doesn't look good. [00:11:53] This is murder. [00:11:55] But then I was like, but hold on. [00:11:56] This girl's 14 years old. [00:11:58] Like, you guys can get it. [00:11:59] Like, we don't even need the murder. [00:12:00] Like, y'all can just get him on sexual assault or grape in this case. [00:12:04] Excuse me, statutory, you know, grape. [00:12:07] She's a minor. [00:12:08] He's cooked, right? [00:12:12] And I remember because originally they were like, oh, he's not a subject of this investigation. [00:12:15] He's not a subject of a murder investigation. [00:12:17] He's not the target of this murder investigation. [00:12:19] He was the whole time. [00:12:20] It's just that they were probably trying to hide that. [00:12:22] So that they can go ahead and try to, you know, get some more information. [00:12:25] You know, they don't want witnesses not cooperating and shit like that. [00:12:28] So they probably lied about that. [00:12:30] But, um, but yeah, now it's making sense why they're charging it all together now. [00:12:37] Took them forever, but they needed the statutory grape to prove the motive for the murder. [00:12:48] This complaint with Celeste while she was under 14 years old. [00:12:54] Wow. [00:12:55] So it seems a fair interpretation would be she allegedly goes to this house, this property, that David, you know, they're going to be saying allegedly lured her there, got her there, invited her there. [00:13:07] And either he allegedly wanted her there because he planned to kill her, again, if the allegations are true, these are the allegations put forward, but that she was what? [00:13:15] Planning on going public or telling someone about their relationship? [00:13:19] Planning to go to authorities about this relationship? [00:13:22] I don't know. [00:13:23] But that this was essentially going to risk. [00:13:25] Yeah, and they wouldn't need to prove anything, honestly, or she wouldn't need to really prove much. [00:13:29] All she would need to do is prove that they have some type of romantic relationship, and bro is cooked. [00:13:36] So that's your motive right there. [00:13:38] You know, you're a 20 year old musician. [00:13:43] You got all this money. [00:13:45] You're famous. [00:13:47] You know, you get arrested for statutory rape. [00:13:50] That's a rap for you. [00:13:54] So there's your motive right there. [00:13:59] Now, do I think he's stupid enough to do it himself? [00:14:01] Probably not. [00:14:02] I'm gonna assume he probably hired some people to do it. [00:14:06] But those niggas are retarded because they put the body in his car. [00:14:12] So, yeah. [00:14:16] His career. [00:14:16] So he allegedly kills her to keep her quiet, make sure his album, his endorsements, his tour wouldn't be affected. [00:14:22] I'm wondering. [00:14:23] Yeah, that makes sense, man. [00:14:25] That's a career ender. [00:14:28] That's a career ender. [00:14:30] So that makes 100% sense why he would do it. [00:14:33] I'm wondering if that's going to be the argument. [00:14:35] I wonder if that's going to be the theory. [00:14:36] That's 100% going to be the. [00:14:38] I think that's what the prosecution is going to. [00:14:42] That is the. [00:14:45] The timeline and the narrative that the prosecution is going to go with, more than likely. [00:14:49] That's how they're going to build a case, is what I predict. [00:14:53] The case, and I assume that. [00:14:55] Because you need a motive. [00:14:56] For first degree murder, like there's more standards, right? [00:14:58] It's like murder two, murder three, manslaughter shit. [00:15:01] You don't really need like clear cut motive like that, right? [00:15:08] But when it comes to murder one, like you got to be airtight, it's got to be deliberate. [00:15:14] It's got to be premeditated. [00:15:17] There's got to be a motive. [00:15:18] There's got to be some level of sophistication to a degree, right? [00:15:26] Murder one is the worst of the worst, right? [00:15:31] So they're going to have to come all the way, the state. [00:15:35] Like they're going to have to really prove all of that. [00:15:38] So that's what I predict is because David's probably going to go to trial. [00:15:42] He got nothing to lose, honestly. [00:15:44] This is a capital murder case, right? [00:15:47] He's cooked either way. [00:15:49] If he pleads guilty, he's going to go to jail for life, right? [00:15:52] I doubt the state is even going to give him a plea deal that's worth it. [00:15:57] If anything, they'll tell him, all right, we'll take the death penalty off the table. [00:16:02] But he's going to go to prison for life, right? [00:16:07] So he's going to go to trial, is what I think. [00:16:12] I think he's going to go to trial. [00:16:14] And then in trial, that's going to put the burden on. [00:16:18] The prosecution. [00:16:21] And the prosecution is going to have to basically prove that not only did he kill her, but he had a motive to kill her and it was premeditated and these other elements that they're trying to articulate, right? [00:16:31] Like lying and waiting, all this other stuff. [00:16:36] So that's what they're going to need to do. [00:16:40] And they're going to have to have that ready for the trial because he's 100% going to go to trial. [00:16:45] I'd be shocked if he took a deal. [00:16:48] I'd be shocked if he took a deal because if he takes a deal, They're still going to get him for murder one more than likely. [00:16:55] He's going to get life in prison. [00:16:57] This is a minor. [00:16:58] This is a 14 year old girl. [00:16:59] And then this is a huge case. [00:17:01] So, ain't no way that they're going to give him like a murder two or some other shit now, man. [00:17:05] Bro's going to go to jail for life. [00:17:07] So, he's going to go to trial. [00:17:09] I don't see like him taking a deal. [00:17:13] Because either way, his life is ruined. [00:17:14] So, he's got to fight it. [00:17:19] It's going to be the argument. [00:17:20] Now, how will they prove that? [00:17:21] How will they prove that intent? [00:17:24] Based on the circumstances and timing of this alleged killing, text messages, witness statements. [00:17:29] We shot. [00:17:30] I mean, all these pictures in itself is like, you know, you can make an argument like, come on, man. [00:17:34] Who takes. [00:17:35] This is obviously a very intimate photo. [00:17:37] Like, who takes photos like this with someone they're not seeing, right? [00:17:39] And this girl's a minor. [00:17:40] So that in itself is bad. [00:17:42] She probably. [00:17:42] She probably threatened to go to the police with like videos and shit, bro. [00:17:47] That's what made. [00:17:48] That's probably what drove this guy to the edge to do this shit. [00:17:52] Disgusting. [00:17:53] But she probably had like some of this stuff, like them kissing or whatever on camera and stuff like that. [00:17:59] So, you know. [00:18:07] So that's why I think made him say, you know, made him say, like, okay. [00:18:13] And that's all they need. [00:18:16] That's all they would need, by the way, to convict him for that. [00:18:20] Where her parents are at? [00:18:21] I don't know. [00:18:25] Yeah, maybe, yeah, maybe tapes. [00:18:27] Yeah. [00:18:27] God forbid. [00:18:29] God forbid, but yeah. [00:18:31] She clearly had proof of some kind. [00:18:34] That's why he had to take her out in this vicious manner. [00:18:37] Fucking evil, bro. [00:18:40] Hey, but again, different theories here. [00:18:43] And remember, I just go back to this and I don't know. [00:18:45] Horrible parents, bro. [00:18:46] Horrible fucking parents. [00:18:49] That's why you got to take, man, you got to watch your daughters like hawks, bro. [00:18:52] Horrible, man. [00:18:53] Horrible, horrible. [00:18:55] This little girl's life got taken from her, like fucking around with this dumbass nigga. [00:18:59] Like, where were her parents, man? [00:19:04] Her family failed her. [00:19:05] I agree. [00:19:07] Jury, it was reported by certain outlets that this record executive had testified. [00:19:15] I mean, again, allegedly, what do the people around David know? [00:19:19] What were they told? [00:19:21] What did they communicate to him about his career, about his finances? [00:19:25] Just things I'm thinking about right now. [00:19:28] And then we go into where Hockman talks about Celeste's family. [00:19:31] I had the chance to meet with some of the family members of Celeste, and their grief is incalculable. [00:19:40] As to what happened to their daughter. [00:19:43] What they have demanded, what we have assured them that the district attorney's office working with LAPD would give them. [00:19:51] Is the idea, is the proof beyond. [00:19:54] Yeah, but where the hell were the parents, bro? [00:19:56] Like, a lot of this is on them, dude. [00:20:00] You know what I mean? [00:20:01] A lot of this is on them, dude. [00:20:03] Like, what the fuck, man? [00:20:09] Why the fuck would anyone in their right mind. [00:20:11] Even go near a minor, let alone get a. [00:20:12] Yeah, I know. [00:20:13] Retarded, bro. [00:20:14] And he's a rapper. [00:20:15] Like, nigga, you got money. [00:20:15] What are you doing? [00:20:16] Get with some of age girls. [00:20:18] What an idiot. [00:20:21] David's lawyers came with a not guilty plea. [00:20:23] Of course. [00:20:25] Being, yeah, being a, yeah. [00:20:28] Yeah, yeah, yeah. [00:20:29] A pedo in jail is not good. [00:20:30] Yep. [00:20:30] My favorite sound effect of all time is the chimp sound. [00:20:33] Yep. [00:20:33] That nigga guilty. [00:20:34] All right. [00:20:35] Spinning Elbow says, this guy I worked with served 30 years as a Marine and said, Iran doesn't control the straight. [00:20:41] We do. [00:20:41] And basically, that we. [00:20:42] Wiped Iran out, and the straight isn't the reason for the higher fuel price, and that is because of investors. [00:20:46] Yeah, that dude's an idiot, dude. [00:20:49] Tell that nigga, bro, shut up. [00:20:51] Talk to him. [00:20:51] Just shut up. [00:20:52] Punch. [00:20:52] He's a fucking dumbass. [00:20:54] Iran doesn't control the straight. [00:20:55] What the fuck is this, bro? [00:21:02] Bro, we're sitting at almost $100 for a barrel of oil, bro. [00:21:08] Brent is sitting at $99.05, bro. [00:21:11] Come on, man. [00:21:12] This nigga's a retard. [00:21:20] You don't mind? [00:21:21] Do you see that this guy killed eight children in Louisiana yesterday? === Coordination For Justice (14:41) === [00:21:23] Link here. [00:21:23] Yeah, I could cover this too, actually. [00:21:25] Yeah, I can cover this too. [00:21:26] Yeah, this was nuts. [00:21:27] I'll cover this after the David one. [00:21:30] District Attorney has. [00:21:33] This afternoon. [00:21:35] Yeah, that show is crazy too. [00:21:37] California is too cucked to give a Be the Black death penalty. [00:21:42] We'll see, bro. [00:21:42] It's a minor. [00:21:43] LAS death penalty? [00:21:44] Yeah, they do. [00:21:45] They just never use it. [00:21:46] California does, though. [00:21:46] Yeah. [00:21:51] A reasonable doubt on who killed their daughter, on how their daughter was killed, when their daughter was killed. [00:22:01] Hey, if you guys are watching on YouTube, smash that fucking like button. [00:22:04] I'm going to get off here soon and we're going to go to. [00:22:06] Kick and bring that killer to justice. [00:22:11] That killer that we have now charged is David Anthony Burke. [00:22:16] Now, at one point, Nathan Hockman brings on LAPD Chief of Police Jim McDonald, who not only talks more about the investigation, but all quick word, guys, from our sponsor Ninjas, before we get into the LA comment here. [00:22:38] All right, here's a little inside scoop that many creators are talking about behind the scenes. [00:22:41] It's actually one of the reasons I'm using Rumble. [00:22:43] They made a way to super chat creators so we get paid immediately and without any fees. [00:22:46] YouTube and Twitch take up to 50% fees when you tip creators. [00:22:49] This method takes none. [00:22:50] That's right, the platform takes zero fees. [00:22:51] They keep nearly 100% of whatever you guys send me. [00:22:53] You can super chat with Bitcoin, Tether, USD, or even Tether Gold, stable coins. [00:22:57] The tip will show up directly on the Rumble chat, which I'll do my best to read. [00:23:01] All you need to do is download the Rumble wallets on the App Store and send the wallets to your favorite creators. [00:23:06] You go to wallet.rumble.com, or you can download the app directly from the App Stores. [00:23:10] Again, wallet.rumble.com. [00:23:12] Seriously, what an amazing way to get rid of the middleman and help the creator economy. [00:23:15] Shout out to Rumble for making this disruptive technology. [00:23:18] As you guys know, fuck YouTube and fuck Twitch. [00:23:21] So, anyway, back to Schedule E programming. [00:23:26] All right. [00:23:27] Let's get back to it. [00:23:29] Also, addresses the frustration the public has had with law enforcement regarding this case and a lack of. [00:23:35] Yeah, because they found a body, if you guys remember, September of last year. [00:23:37] So that's why people were like, yo, what the fuck? [00:23:39] Like, you guys found the body in September of last year and you niggas are just making the arrest now, a year later. [00:23:45] Yeah, they're trying to cross their T's and dot their I's, obviously. [00:23:49] Like I told you guys before, Murder One is serious, bro. [00:23:51] The burner proof is very high for Murder One. [00:23:54] Comments or transparency. [00:23:56] Throughout the seven month investigation, this department has faced criticism for how we handled the case and for our decision not to provide details. [00:24:06] I want to be clear about something. [00:24:08] My duty is not to fuel speculation, it's to deliver justice. [00:24:12] And that requires patience and discipline on everybody's part. [00:24:17] Yeah, I think that's a big reason why they kept saying that he's not a subject of the murder. [00:24:23] When they found it, they kept trying to downplay it, and people were pissed off. [00:24:26] Like, bro, what do you mean he's not the subject of the murder? [00:24:28] This nigga, like, what are you talking about? [00:24:30] Like, the body was found in his Tesla, chopped up. [00:24:33] What do you mean? [00:24:34] So, obviously, the LAPD got a lot of heat for it, but I get it. [00:24:40] They didn't want it to be too much of a media spectacle and ruin the integrity of the case. [00:24:46] And then also, if they said that, oh, yeah, he's the target of our investigation. [00:24:49] Like, people aren't going to cooperate, bro. [00:24:51] You know what I mean? [00:24:52] Like, the music industry is very small. [00:24:55] So, they wanted people to cooperate. [00:24:56] That's why they kind of downplayed it as well. [00:24:58] The investigation was driven by a single purpose to secure justice for Celeste Rivas and for those who loved her. [00:25:06] We had to be certain that nothing we did or said would ever jeopardize this case. [00:25:13] Ms. Rivas was a reported runaway from Riverside County. [00:25:17] During the course of our investigation, she ran away. [00:25:20] Okay. [00:25:21] Detectives learned that she had been involved in a sexual relationship with Mr. Burke. [00:25:26] Boom, they got him. [00:25:27] They got that nigga, man, just on that alone. [00:25:31] She was a minor and he was an adult. [00:25:34] On April 23, 2025, Ms. Rivas arrived at Mr. Burke's home in the Hollywood Hills. [00:25:41] That's the last time she was known to be alive. [00:25:45] On September 8, 2025, Ms. Rivas' dismembered and badly decomposed body was discovered in the front trunk of Mr. Burke's impounded Tesla. [00:25:56] From that moment forward, our investigators face an extraordinarily difficult and complex case. [00:26:02] The condition of her remains delayed the medical examiner's ability to be able to determine cause of death. [00:26:09] Yeah, guys, she was, and I really, you know, rest in peace to this child. [00:26:14] Her body was very badly decomposed when they found her, Chad. [00:26:17] She had been there for months and it was warm, right? [00:26:21] So the stench is what kind of got people to say, hey, what's going on here? [00:26:29] The substantial amount of time that passed between her death. [00:26:32] And the discovery meant that crucial evidence had degraded or disappeared. [00:26:38] And as detectives work. [00:26:39] Yeah, I don't even know if they were able to get like a clean cause of death chat, to be honest with y'all. [00:26:44] I don't even know if they were able to get it. [00:26:49] To uncover the truth, they also had to sift through and debunk a great deal of false information circulating publicly. [00:26:57] These challenges were real and they required patience, precision, and an unwavering commitment to the facts. [00:27:06] Despite these obstacles and despite intense public pressure, our Robbery Homicide Division detectives remained steadfast in their duty. [00:27:14] Yeah, so LAPD kind of weird. [00:27:15] They have robbery homicide combined in like one big unit. [00:27:23] They recovered and analyzed a substantial amount of digital and forensic evidence. [00:27:28] They stayed focused, disciplined, and committed to uncovering the truth. [00:27:33] Their work in close collaboration with the district attorney's office has brought us to this moment today. [00:27:40] I want to thank the district attorney and his team, as always, for their partnership. [00:27:44] This case demanded coordination. [00:27:46] Yeah, that's why I knew it was bullshit when they said, oh, yo, they're arresting him to put pressure on the DA's office. [00:27:51] I was like, bro, hell no. [00:27:52] They're working very closely with the DA's office. [00:27:54] This is a big sexy case for them. [00:27:55] You got a musician getting charged with murder one. [00:28:00] Like, bro, come on, man. [00:28:02] Like, what are you talking about, dude? [00:28:05] Persistence and a shared commitment to justice. [00:28:08] And that makes sense. [00:28:09] He's not wrong. [00:28:10] You don't want to say too much that could jeopardize a case, give a criminal defendant ammunition to say the investigation was tainted or the prosecution is tainted or that you had blinders on and we're only looking at one person without looking at exculpatory evidence. [00:28:24] But you also have more about cause of death, right? [00:28:26] Which hasn't been publicly released because of a court order. [00:28:29] The medical examiner's records have been sealed. [00:28:32] In fact, Hochman took questions about a lot of things and he took questions about this. [00:28:36] And he talked about how details of the allegations regarding the special circumstances they're going to be produced in court. [00:28:41] He didn't talk so much about it, but he did talk a little bit more about the coroner's report. [00:28:46] So, with respect to the coroner's report, we will be seeking quite quickly to provide an order to the court that now allows the coroner to release that report to the public. [00:28:57] So, once that report is released and we will see what the coroner's finding or conclusion is, that's going to be a piece of the puzzle. [00:29:05] I mean, I hate to say this, but again, it's tough to think about. [00:29:07] Sorry, Chad. [00:29:08] About the cause of death and how you analyze that when you're dealing with reportedly dismembered and decomposed remains. [00:29:15] So, could they be able to determine, let's say, asphyxiation or poisoning or blunt force trauma or a gunshot wound? [00:29:22] And I don't even want to think about it. [00:29:24] There's speculation that she was stabbed, but. [00:29:30] But was the cause of death the alleged dismemberment? [00:29:34] By the way, you heard the defense. [00:29:35] Oh, I hope not, dude. [00:29:37] I hope not. [00:29:39] I hope not, dude. [00:29:41] That would be fucking evil. [00:29:43] Dismembering someone's life? [00:29:45] Are you serious? [00:29:48] Where were the parents, bro? [00:29:51] You know, there's a reason why I don't even. [00:29:53] Were her parents at the press conference? [00:29:54] Probably not. [00:29:55] Fucking scumbags. [00:29:58] How do you let your daughter run away, bro? [00:29:59] What the fuck is wrong with you? [00:30:02] He's not the cause of death. [00:30:04] Is that because they have their own interpretation of what the cause of death could be? [00:30:09] Is this going to be a battle of medical experts? [00:30:12] Or are they going to point the finger at somebody else and say that person is the cause of Celeste's death? [00:30:17] And Hockman was asked, why did it take so long to make an arrest here, given, again, the body was allegedly found in David's car? [00:30:25] And you look at the state. [00:30:27] Yeah, and there's what was. [00:30:31] Alpha Parasite, this one, they got to take accountability. [00:30:34] This is why we need the WBNN. [00:30:35] Yep. [00:30:35] Teslas have cameras literally all around them that record evil when the car's parked and off. [00:30:40] I wonder if they have that footage of him slashing a body in there. [00:30:44] They probably do, or people that helped them. [00:30:46] Kron's one pot. [00:30:47] Myers, they also have records of Dave ordering incinerator chainsaws at his Hollywood home. [00:30:51] No way. [00:30:54] Kron's pot, send me that info. [00:30:57] How do you know that? [00:31:02] Your mind, what the fuck are they doing in India? [00:31:07] This nigga could be singing in jail like R. Kelly now facing death. [00:31:13] Yeah, yeah, Kron's one putt. [00:31:15] Give me that link to that. [00:31:19] Proof that he sent a Saint Chad to his house at a Hollywood home. [00:31:24] Of Celeste. [00:31:25] I think the police chief got it right. [00:31:28] That in a situation where you don't have an eyewitness account or we can't point to a video that shows. the killer killing someone, you have to go through the very rigorous and thorough investigation to look at all the digital and forensic evidence. [00:31:43] You have to speak with witnesses, often who are cooperative and some who are not cooperative, in order to obtain all the information necessary to decide who did what, when, how, and what their mental state was at the time. [00:31:57] That is what we've been doing over the last, between September 8th, roughly, and today when we bring these charges on April 20th. [00:32:06] So, again, it's a type of case that you want to make sure you get maximum information. [00:32:11] And by the way, if there's anyone out there that has material information about this particular murder or any other actions taken by Mr. Burke, please come forward to the Los Angeles Police Department, come forward to the LA County DA's office, and report that information. [00:32:30] So, it gives us an idea of the evidence, maybe lack of evidence. [00:32:34] You talk about a smoking gun, that one thing. [00:32:36] No, totality of the evidence, all of the evidence, not one thing. [00:32:41] Some cooperative and non cooperative witnesses. [00:32:44] Is anyone working under an immunity agreement to provide testimony? [00:32:47] I was going to say, there's got to be some people in his circle, more than likely, that are getting some type of immunity or some kind of deal for this. [00:32:58] Because he didn't do this himself, bro. [00:33:02] He did not do this himself. [00:33:06] Testimony? [00:33:06] We talked so much before about Neil Langston, David's purported friend, how he was arrested in Montana for allegedly failing to appear as a witness, seemingly in this case. [00:33:16] What was it? [00:33:16] In front of the grand jury? [00:33:17] TMZ had reported that he had only testified for 30 to 40 minutes. [00:33:21] If that's the case, was he uncooperative? [00:33:24] Is he a witness? [00:33:25] I can't say for sure. [00:33:26] Neil Langston did not. [00:33:27] Yeah, he couldn't have done it himself. [00:33:29] The other thing, too, is that if I'm not mistaken, when I read somewhere, like David's phones didn't match up with the path. [00:33:39] That the Tesla was driven, which leads me to believe that someone else dealt with disposing of the body. [00:33:50] Now, you can make the argument, right? [00:33:53] Maybe the driver didn't know what they were driving. [00:33:55] They just knew, hey, take this car over here, park it over here. [00:33:58] I'm going to pick it up later, some bullshit like that. [00:34:01] You can make that argument too. [00:34:03] Yeah, I know this Chinese nigga. [00:34:07] But, yeah, we don't know. [00:34:10] We don't know. [00:34:13] Come up today. [00:34:14] Now, according to Hockman, the investigation is ongoing. [00:34:17] They believe they have a strong case because of the totality of the evidence that was obtained by the LAPD robbery homicide unit. [00:34:23] They talk about the work that the DA's office has done. [00:34:26] They believe they can prove it. [00:34:27] You know, it's bad when robbery and homicide are combined. [00:34:30] That should tell you something. [00:34:31] That tells me that LA, a lot of robberies end up becoming homicides. [00:34:37] So they just had to combine that shit, bro. [00:34:39] Like, that's how you know it was bad. [00:34:45] These charges, the special allegations, the special circumstances. [00:34:49] And this is where Nathan Hockman discusses whether. [00:34:52] How are the sound effects, by the way, chat? [00:34:54] They should not be loud. [00:34:55] The sound effects should be a lot better. [00:34:57] Give me ones if the sound effects are better. [00:34:59] Give me twos if they should be louder. [00:35:01] Give me ones if the sound effects are good. [00:35:03] Give me twos if they should be louder. [00:35:04] Two for louder sound effects, one if they're good. [00:35:09] I lowered the volume on them so they shouldn't blow your eardrums out no more. [00:35:16] All right, damn. [00:35:17] All ones, pretty much. [00:35:19] I only saw like one or two. [00:35:22] Here, I'll play a sound effect for you guys. [00:35:30] Thank you. [00:35:31] Come again. [00:35:32] Thank you. [00:35:33] Come again. [00:35:35] So, yeah, they're pretty low as you guys can see. [00:35:37] Thank you. [00:35:37] Come again. [00:35:44] Yeah. [00:35:47] So I've lowered a lot of them. [00:35:52] Right? [00:35:58] You know what? [00:35:59] I got to turn that one up at least. [00:36:01] We got to make Frieza laugh. [00:36:02] Oh, no, that's Max for Frieza. [00:36:04] Okay. === Physical Evidence Confirmed (03:09) === [00:36:05] Anyone else will be charged. [00:36:07] Is it possible that you will be arresting other people within his circle? [00:36:11] And did he act alone in this death? [00:36:12] Ooh, good question. [00:36:13] Let's see what they say. [00:36:15] Again, with respect to whether or not there's any other individuals or we're going to take any other actions, you will know about them if we do, but at this point, I'm not commenting. [00:36:23] Do you believe that you know how she was killed beyond it being homicide? [00:36:28] The actual cause of death? [00:36:29] The coroner's report. [00:36:31] Will be released shortly. [00:36:33] Because it is not currently released, I'm not going to be commenting on that. [00:36:36] But what's been determined? [00:36:37] Not that you won't say what it was, but has it been determined how she was killed beyond it being homicide? [00:36:43] The coroner has made a determination on how Celeste died, and at the point that the coroner's report becomes public, we'll be able to comment on it. [00:36:52] Was there a specific breakthrough last week? [00:36:54] All right, we're going to let me look here if the coroner's report is out. [00:36:58] Is there physical evidence that ties David to this murder? [00:37:02] There is physical evidence and there is. [00:37:05] Forensic and digital evidence that we intend to present in court to prove these charges beyond a reasonable doubt. [00:37:12] Only a couple more questions. [00:37:13] Without your investigation and just to his question, are you able to tell us exactly what the smoking gun is? [00:37:21] And also, if you can address the issue of his visit to Santa Barbara and that, how does it connect with the murder? [00:37:28] So, with respect to the actual details of the evidence we're going to be presenting in court, I'm not going to do that today. [00:37:35] As far as the concept of a smoking gun, The smoking gun is the totality of the evidence that we're going to bring to prove any case, whether it's this case or any case, beyond a reasonable doubt. [00:37:51] An investigation is ongoing. [00:37:55] If information comes forward with respect to any additional crimes, we will certainly investigate it. [00:38:02] One more. [00:38:02] There's been so much discussion about the difficulties in this case. [00:38:05] The team talked about it as well. [00:38:07] What makes you confident you can prove these outcomes? [00:38:10] Okay, he said, What makes you confident you can prove this? [00:38:11] Sorry, guys, they're talking so goddamn low. [00:38:15] What makes us confident is the totality of the evidence that has been obtained by the LAPD robbery homicide. [00:38:23] By the work that the district attorney's office has done, that has led us to the point where we believe we can prove each and every one of these three charges and the special circumstances and the special allegation beyond a reasonable doubt. [00:38:37] So I guess it's possible someone else could be arrested or charged. [00:38:41] Interesting, interesting, interesting. [00:38:44] Here, let's see. [00:38:45] We got. [00:38:47] So this comes from Blackie Speaks. [00:38:51] I don't know, maybe if someone refuses to cooperate, refuses. [00:38:54] To provide testimony, we will continue to stay on top of this case wherever it will go. [00:38:59] Thank you so much for joining us here on Sidebar. [00:39:02] As always, please subscribe on YouTube, Apple Podcasts, Spotify, wherever you should get your podcasts. [00:39:08] You can also check us out on NBC's Peacock as well. [00:39:18] So let's see if they So, all right, let's see here. [00:39:41] Discover the body investigation autopsy. [00:39:43] Okay. [00:39:44] As a result, results determined which were deemed deferred to remain pending as of. [00:39:48] Okay. [00:39:50] Medicals, Andrews office led by chief medical, blah, blah, blah. [00:39:53] Criticized order. [00:39:58] Okay, so it doesn't look like they still let it out, man. [00:40:07] Yeah, it seems like they didn't let it out yet, which is interesting. [00:40:13] People have already heard about the story. [00:40:15] Popular singer David, spelled D4VD, was arrested in connection with the death of 14 year old Celeste Rivas Hernandez. [00:40:21] But what's come out since then changes everything the motive, the timeline, and what happened the last night Celeste was ever seen when David invited her to his home in the Hollywood Hills, and she never came back. [00:40:34] Celeste, a 14 year old at that time, Went to Mr. Burks. [00:40:40] Hey guys, I'm going to end the YouTube stream here in a second. [00:40:43] So get ready to come on over to Kick My Ninjas. [00:40:46] Okay. [00:40:50] So I'm going to drop the Kick link for you guys. [00:40:53] There's no ads on Kick, by the way, guys. [00:40:54] Kick is way better than YouTube. [00:40:56] Way better. [00:40:57] And we don't have to worry about censoring ourselves. [00:41:00] So come on over, guys, to Kick. [00:41:03] We're going to continue this stuff over there. [00:41:05] Also, we're going to be breaking down the ceasefire. [00:41:09] With our boy Donald Trump.
