The suspect stated the victim walked up to him, stating he wanted to fight the suspected.
Stated they began to fight verbally and then escalated to physical.
The victim stated he doesn't know who the victim is and never seen him before.
When asked if he wanted to press charges, he stated no.
Eunice then spoke to the victim who stated he was told by the suspect to come fight him via Instagram.
When Eunice arrived at the victim's home, victim's phone shows, oh my god, this fucking cop is terrible at writing.
The victim messaging the suspect to fight him.
The victim then stated he went to the gym, incident location, to confront the suspect.
The victim stated they got into a robo fight, which was escalated.
It's a physical.
The victim was stated, was stating that he was hit.

And, you know, he claimed that it was self-defense.
But I think, you know, when you invite people over to fight, I mean, that's one thing if it's a one-on-one.
You know, I think we wouldn't be in this situation if it was a one-on-one fight because the monster would have probably never pressed charges on him.
But for the fact of the weapon and the excessive force, all the friends jumping in like cowards, in my opinion.
I think that's why the situation is where it is.

Now, at this point, in the state of Florida, guys, there are self-defense laws.
Stand your ground, okay?
And here it is, basically.
And a highly publicized move, the Florida legislator enacted in 2005.
What was popularly known as the standard ground law?
We talked about the standard ground law, by the way, guys, when it came to Trayvon Martin.
That's how Zimmerman was able to get off.
This law is outlined in section 776.012 and 776.013.
Florida statutes expand the scope of the self-defense claim traditionally available in a criminal case by eliminating the general of duty to retreat imposed at common law, presuming legal justification for the use of force in a person's dwelling, residence, or vehicle, and offering immunity from prosecution for individuals who resort to force within parameters of the statute, right?
So the big one here, guys, that you guys got to know is like, there's no duty to retreat, okay?
So you can, literally, that's where the stand-your-ground thing comes in.
You can defense yourself, you can defend yourself and you don't have to run, right?
Now, and it's the Florida self-defense law, all right?
These laws apply in situations where a person reasonably believes they are in imminent danger of death or great bodily harm.
Now, when this seven-foot individual walks up to Wes and shoves him, you can make the claim that he fears imminent danger or threat, right?
So what is allowed under Florida self-defense laws?
Not deadly force, deadly force, no duty to retreat.
A person has no duty to retreat before using force in self-defense.
And again, if you're lawfully there, which it's a gym, it's a public location.
Wes Watson is lawfully there.
The guy comes up to him, instigates a fight, and shoves Wes.
So Wes is 100% within his right to defend himself.
Now, that self-defense is finite.
And what I mean by that is, once there's no longer danger, you can't continue to pummel the guy.

Now, if you're at a gym sitting at a bench with your buddies and some seven-foot fucking monster comes up to you and pushes you, the average person would believe that they are in imminent danger.

But once the individual is incapacitated and no longer able to defend himself, the self-defense bar, let's just say like the thing of self-defense is like an energy bar, right?

Once the danger goes down and you keep attacking, well, you start losing life very quickly, right?
Your justification for using the violence goes down as the level of threat goes down, okay?
So your violence, your level of violence and retaliation needs to be directly proportional to the level of danger that you're facing.

Because when they say reasonable, what that basically means is, would a reasonable person of sound mind behave in that way given they were in that circumstance?
This is typically the use of force doctrine that they use in the United States.
This is why like when police get in shootings, right?
They say it was a reasonable use of force given the circumstances and facts known to the officer at the time.
Remember, guys, use of force almost never deals with 2020 hindsight.

It deals with what were the facts known to the individual at the time where the violence was conducted, right?

But if you threaten to go to trial, that might make them more likely to come to the table.

Because going to trial is not the same as getting a plea deal, Chad.
Going to trial costs the county money, costs the city money.
You're going to have to bring in those detectives to testify.
You're going to have to bring in that police officer to testify.
You're going to have to bring in a witness to testify.
And this witness, me just guessing, if someone is dumb enough to show up and start a fight at elevation, more than likely doesn't have a lot of credibility.
