I'm Chief Robert Gordon, New Mexico State Police.
On February 4th, 2021, New Mexico State Police Officer, Darian Jarrett, stationed in Deming, New Mexico, was assisting homeland security investigations.
Now, you guys are probably wondering, yo, what's going on here, Martin?
HSI, your agency was involved.
Yes, we have a big presence on the southwest border, guys.
Big presence there.
The officers were initiated a traffic stop on a white Chevrolet pickup on Interstate 10 eastbound near Mile Marker 101, east of Deming, New Mexico.
And Deming, New Mexico, down the middle of nowhere, You can see Interstate Highway 10 cuts right through it.
It is not too far from the border, right?
Which obviously is going to be huge drug trafficking.
But here it is right here.
It's a city of Luna County, New Mexico, United States, 60 miles west of Las Cruces, 35 miles north of the Mexican border.
So not far whatsoever from the border.
The population was 14,750 as of 2020 census.

So this is standard, especially like in rural highways like this, guys, where, you know, they used to teach them to walk up to the driver's side, but now they tell them to go on the other side for obvious reasons, right?
Because someone might hit you on the side of the road.
A lot of people drive drunk like idiots.
Can't tell you how many times I've seen troopers literally get smacked as they're doing a traffic stop by some weirdo.
So now traffic stops are very dangerous, guys, for obvious reasons, right?
You know, like you don't know who the individual is.
You don't know what they have on their car, etc.
Obviously, you make hundreds, if not thousands, of these over a career, so you get used to it, but it's still always dangerous, right?
And in this case, this was in the middle of an operation with Homeland Screen Vestigations, which we're going to talk about here.

He doesn't want him to keep sitting in his car.

Yeah, NLETs, which is going to allow him to get the data on the car and the driver's license from the state level.

That's what he's probably going to do.

Yeah, so clearly the guy's nervous.
And this guy's a multiple-time convicted felon.
Just so you guys know, this guy's a drug trafficker as well.
That's why he's a little bit on edge.
And I gotta tell you guys this from me being on the job.
Drug traffickers are always nervous because they know that their days of, you know, are always numbered, quite frankly.
You got the police after you, you got other criminals after you trying to rip you off.
You got to make your drug payments back whenever, and he's right there on the border.
So more than likely, he's very close to the source.
He's dealing with some very dangerous people.
So he's clearly on edge here, right?
And this guy's been in jail in and out multiple times, multiple time convicted felon.
HSI had done an operation with him with some methane, with some methane pills.
And they were doing this traffic stop here to bust to collect, I guess they had him on surveillance.
And they were doing this traffic stop kind of as like a T-stop just to probably identify and make sure it's really him in the car or get some other intel.
I'm not sure exactly why.
Maybe we'll figure that out.
Why they did it.
But the point is that this guy was on HSI's radar, HSI Deming office, for drug trafficking.
Here's the point.
He'll show me the picture right away,'cause I got the paperwork I gotta do, you know?
So now he gets out the car without him telling him to do that.

You know, they literally, this is like the worst scenario that you can have in law enforcement, guys.
literally the worst scenario you can have um i don't even want to really rewind it but i want to kind of show you guys the moment where this guy decided he was going to do something right so So.

So he has to take the gun off him.
Now, at this point, the guy is probably nervous because the guy knows, yo, I'm a convicted felon.
I can't have a gun.
I'm going to go to jail.

So I think that's where he made the decision.

So at this point, the guy's getting probably nervous.
He doesn't know what he's going to do.
He's like, oh, am I going to cooperate?

Because at this point, he knows the jig is up.

He knows more than likely he's going to go to jail.
He can't have a gun and he has one on him.

So he asked him to come to his car.

This is where I think he puts one in the chamber here.

Then he just starts shooting at him.

So, and that's gotta be the moment right there.
Like, this is fucking devastating to see.

Then obviously you're at close range.

Then he shot him in the head.
One last time.
Then he speeds off.
During the traffic stop, the driver identified as Omar Felix Cueva, 39 years of age.
Fired at least one shot at New Mexico State Police Officer Darien Jared.
Officer Jarrett was struck and killed by gunfire.
An HSI agent arrived on scene and notified New Mexico State Dispatch that our officer was down.

So what happened was the guy was supposed to make the traffic stop and these guys were behind because obviously they're in an unmarked unit.
They don't want to make it too obvious.

Ended up going down really bad.

I just had a car pulled over and the person shot him.

Officer Darian Jared began his career as a transportation inspector with the Mexico Department of Public Safety.
He was certified as a law enforcement officer in December of 2014 and worked with the former Motor Transportation Division of the New Mexico Department of Public Safety.
In July 2015, he was sworn in as a New Mexico State Police Officer where he bravely served until he's only been on the job for about five or six years at that point.
Officer Jared leaves behind three small children and he was expecting his fourth child this year.
This is my command.

He's 32 years old.
When he died, he was like 30.

And we want you to understand that we're here to honor Officer Darian Jarrett.
Officer Darien Jarrett went out there today and was serving his state, his community, the best way he knew how.
And I love him for that.
And everyone that's here loves him for that.
And I want you guys to understand that as we get through this.
But these officers lay their lives out online every day for each and every one of us.
Yeah, I see some of you guys are saying, yo, is it routine for them to be by themselves a lot?

The state trooper, yeah, you work alone a lot, guys, especially in rural areas like that, with big interstate highways.
Yeah, it's very common to work alone.
Very, very common.
Right, and this is horrible that, you know, the man had a family too.

People forget that these people are regular humans that have jobs, that have children, have families.
The state and the local law enforcement agencies, a New Mexico State Police Officer located in Cueva Traveling East, near State 10, near mile marker 116.
Cueva pulled over at the exit and fired New Mexico State Police officers.
So now they're chasing him, right?
Because obviously the guy killed the fucking trooper.
Turn fire.
Our pursuit was initiated as Cueva continued to evade officers traveling east on Interstate 10.

Minutes after Omar Cueva shot and killed New Mexico State Police Officer Darian Jarrett along Interstate 10, he called an undercover agent with Homeland Security Investigation to tell him he had been pulled over by the police.
Cueva told the agent he did not give them a chance and still wanted to meet up to sell the agent five pounds of methamphetamine.
So they had him under surveillance because they were supposed to do a drug deal later on, right?
And what they wanted to do, I guess, was do a traffic stop, see who was with him, identify any other individuals, right?
And then, you know, let him kind of go on his way.
The trooper was more going to let him walk, guys, so that he can go do the drug deal.
But, granted, the fact that the guy had a gun, that made things a lot trickier, right?
But yeah, so Cueva had been talking with an undercover HSI agent the whole time.
So he called him right after he shot the cop.
But he still wanted to meet up to give to sell the agent five pounds of meth.
Well, the agent received word that an officer had been killed.
Okay, and Ranking Agent Wayside told State Police Investigators he knew there was a plan to have state police pull over Cueva between Deming and Las Cruces if the opportunity.

And this is common, guys.
When you're doing a drug trafficking deal, a drug deal like this, like this is called a controlled buy, right?
And when you do a controlled buy, right, you're going to monitor the bad guy from when they leave their house all the way up until he meets with the undercover to do the deal.
Why?
Because throughout the entire process, right, the person is going to be meeting with people, making phone calls.
He's going to be going to places.
So you might be able to identify co-conspirators, whether it's a source of supply, a stash house, another vehicle, other people.
Like, you're going to be able to identify a bunch of things.
So they had the drug deal set for today, and they were monitoring him the whole time.
And then what happened was they wanted the trooper to stop him, right?
To get him or anyone else in the vehicle identified and then let him go.
But granted, obviously Cuevo doesn't know he's being watched by the police.
So he thinks it's a real traffic stop.
So what does he do?
He's like, damn, I got a gun.
The cop saw that I got a gun.
This is a real traffic stop.
I'm going to shoot.
Because I'm going to go to jail.
I'm a convicted felon.
Right?
So they obviously fucked this one up with this operation for sure.
Very unfortunate.
If the opportunity came.
If not, the 39-year-old would have been busted by multiple HSI agents and armored vehicles when he met up to sell the meth.
So they were going to bust them later after the deal was done.
Agents told state police investigators they knew.
All right, guys, I'm going to get my face off the screen a little bit so I can just give you guys commentary.
Because there's text that's coming up on the screen, so I don't want to block it for you guys.
Cueva was armed and had told them he was not going back to jail.
According to New Mexico State Police Incident reports, HSI agent Hector Huerta, an acting supervisor for the Deming office, told investigators that a few weeks before the shooting, a confidential informant tipped them off to Cueva and how he wanted to sell a large amount of narcotics.
He said that on January 28th, an undercover HSI agent met Cueva at a truck stop in Las Cruces and bought a pound of methamphetamine and 4,000 fentanyl pills.
That's a lot.
So obviously this guy, he's dead.
For him to get that volume of drugs means it's connected.
So obviously it's going to be someone that's going to be of interest to the feds.
Pound of meth, half a kilo, roughly.
During this transaction, Mr. Cueva was acting paranoid, took a photo of surveillance.
Drug traffickers are always paranoid, chat.
Very paranoid.
A lot of times they do the drugs themselves.
Now, this is common, right?
You do an undercover operation.
You see the bad guy has a gun, right?
Obviously, that makes things dangerous.
So, hey, why don't I just buy the gun from this bad guy, right?
Why don't I pick it up?

Cueva said he could meet to sell the five pounds of meth on February 4th, and HSI chose state police officer Leonel Palomaris, the canine officer, to make a high-risk stop and gave him full disclosure on everything they knew about Cueva.
So now you guys are going to see we're going to get into the he says, she says stuff here soon.
Meanwhile, HSI sent out a be on the lookout advisory on February 2nd.

*music* Investigators learned through HSI that there were two plans of action for the February 4th operation.
The first involved Officer Palomaris pulling Cueva over with a group of HSI agents and an armored SUV ready to act as a quick reaction force.
If state police officers were unable to locate Cueva along I-10 and he reached the meeting place in Las Cruces, the undercover agent would give a signal when he confirmed the meth was there and tactical agents would move in to arrest Cueva.
On February 4th, HSI held a 45-minute briefing in Las Cruces at 10.30 a.m.

He's going to show everyone what he looks like.

Or, you know, friendly fire incident.
Or if your informant won't be there, but you're going to show a picture of your informant to everybody there, right?
And you're going to go over the radio channels, what the goal of the operation is, who's going to be where, who's going to be staged where, the closest hospital, the radio frequencies that you're going to use, all that stuff is there.
The other agencies that are going to be involved in the takedown or the operation, you're going to give them radios, right?
Because let's say when I used to work with DEA all the time, right?
DEA uses different radios than HSI does.
So I would make sure I give them the HSI radios so they can be on comms with all of us, right?
So the briefing is where everyone is there that's involved in our operation.
We all know what each other looks like.
We all know what everybody's wearing.
We all know what cars they have, right?
We all know what frequencies we're supposed to do, and everyone has a job, right?
So if you're not there at the briefing, you can't participate in the goddamn operation.
So this was a big fucking L that the trooper was not at the briefing, right?
Now, you're going to see here there's a discrepancy.
Some places are saying, oh, the guy knew that Cuevo was dangerous.
Others are going to say, oh, they didn't know Cuevo was dangerous.
What I will say is this: if he had gone to the briefing like he was supposed to, he would have known he was dangerous and you would have been a little bit more cautious.
Because you could tell he didn't get nervous until he saw the gun.
The trooper didn't really get like high alert until he saw the gun, which he should have been high alert the whole time.

I questioned Agent Huerta on why on his ops plan stated this was not a high-risk operation.
Agent Huerta said it was an oversight on his part.

Palamaris said at first, HSI told him Cueva was in an SUV with his family.
Then he was in a truck and alone.
As they waited to make the stop, Halamaris told his partner he did not have a good feeling about the traffic stop, and the two began rehearsing how they would make the stop.
If they saw a firearm, a felony stop would immediately be executed.
And a felony stop, guys, is where they're at their cars and the bad guys in their car and they're staying behind their door like this.
They don't even walk up to the car.

At 11:25 a.m., HSI agent Matthew Rodriguez sent out a text message saying that four officers were staged at mile markers 102 and 132.
At 11:59 a.m., Rodriguez sent another text that another officer, Jarrett, was at mile marker 98.

In minutes, Rodriguez sent a text that the officer pulled over Cueva and Mile Marker 102.
Two HSI agents were traveling westbound in an armored vehicle when they saw the traffic stop and wondered where the officer's backup was.
Okay, so it seems like the trooper was supposed to have backup, but he didn't.
They stopped 200 yards away and watched as a dark silhouette fell to the ground next to the truck.
At first, and the reason why they stood back, guys, is because they didn't want to burn it, right?
They wanted it to, you know, you got to let the guy do the traffic stop, make it as natural as possible.
But the guy didn't have his backup and you ended up getting shot.
They assumed Jarrett had taken Cueva.
This is a failure on the state police, HSI, everybody, man.
To the ground until they saw Cueva's truck pull away.
HSI agent Garrett Olson told investigators he asked Rodriguez if Officer Jarrett was part of the operation, and Rodriguez replied he did not know because he only spoke with Sergeant Madrid, who had details on Cueva.
Olson said that after the shooting, he wondered if Jarrett knew how dangerous this traffic stop could be.
And the HSI special agent in charge, after viewing Jarrett's dash cam video, was concerned that Jarrett did not have all the information with reference to HSI's knowledge of it.

Palomaris said they were waiting to make the traffic stop when they were advised HSI had reached out to Sergeant Madrid and soon after they had heard Jarrett make a traffic stop over the radio.
Minutes later, reports came through that an officer was down.
Sergeant Madrid told investigators he got the bolo on February 2nd of a man coming from Tucson with a load of fentanyl and a gun in the truck and it was put out to the guys to be on the lookout.
Madrid said there was no briefing on criminal history on Cueva.
It's the common stuff we do every day, he said of the traffic stop.
He said he yep, get really complacent.
That's the number one thing that kills cops, guys, is complacency.

Told Jarrett to keep an eye out for a red Honda Civic or white pickup truck with a headache rack, reminding Jarrett of the bolo and saying, remember, this guy is supposed to be carrying a gun.
Madrid said Rodriguez messaged him pictures of vehicles leaving Cueva's home and asked him if he had anyone available.
Madrid told investigators he replied that he did, and he relayed any further messages from Rodriguez to Jarrett, but never gave Rodriguez Jarrett's number.
Madrid said he guessed Officer Jarrett had spotted the truck and the next thing he knew, he was running out to the scene after Jarrett was shot.

Madrid told the investigator.

The undercover HSI agent told investigators that Cueva called him after the traffic stop and told him he had been pulled over by the police but did not give them a chance.

During the pursuit, other New Mexico State Police officers actually utilized tire deflation devices near the Pataco exit, Interstate 10, near Mile Post 135 by Las Cruces, New Mexico.

As soon as he would fire, you know, I would move out of the way again.
He was continued.
He would stick his hand out that little window, aim at me, and fire some more.
So I was like, fuck, you know, I got hurried and hit this guy.
So I waited for him to turn around and look straight again, pay attention to the roadway.
So I started getting up on him, but he wouldn't give me the chance.
He would turn around and start firing.
And then once we started getting closer to the motel exit, I was like, you know, I can't do it now because there's too many officers.
I know I remember, I don't remember who else was there, but I remember Joaquin being there for my department.
So I got it back off.
I remember getting on the radio and saying, hey, we're approaching you, Joaquin.
And I don't think I hit the brakes or anything.
I think I just let off on the gas, just so I can give him time to deploy the stopstick.
And I saw the suspect pretty much riding in between both lanes.
And he ran over the spike strip.
And I just remember, I'm pretty sure I moved to the right side of the roadway, trying to avoid the spike strip.
And the suspect fired some more rounds at me.
And I just remember looking down at my dash, and my dash was flashing.
And it was saying zero PSI, like on the left front tire.
So I'm like, shit, I got a fucking tire that's blowing.
Oh, shit, you're in a tire.
So I just remember just checking my steering.
To me, my car felt good.
It didn't feel like it was damaged or there was a tire other.
Maybe the dash is fucked up or something.
He ran over the spike strips.
As soon as he passed, that's when I saw my light flashing, but then I just heard a shitload of gunshots.
And I saw there was a bunch of officers on the left side.
I don't know if it was State Police or Gaso, but I heard a bunch of gunshots.
And I heard a real distinct sound, like it was hitting something.
So I'm like, oh man, I think they got him.
And it sounded like my car got hit too as soon as I passed.
I remember hearing two different sounds.
They sounded different than the ones that were hitting him.
And that's when I saw him slumped over.
I was like, oh, my God, this guy got fucking hit or whatever.
So I got on the radio, started telling the people on the radio that he was slumped over.
But then I realized, you know, he's still driving straight.
It's not drifting to one side or anything.
I was like, maybe he's not hit.
So I was just watching and paying attention to see what he's doing.
So I told myself, you know, like, it's time to go in for the pit.
But then we were like at a curve and I was like, no, this isn't a good spot.
And if I do the pit, there's way too much traffic right here.
I'm going to put like too many people in danger or whatever.
So I just hesitated a few more seconds.
And as soon as we came clear from where all those people were at, I saw him pop back up.
He's back to driving.
He's no longer firing at me.
So I said, screw it.
Gunned it, went in for the pit on the driver's side of the car.
But since his tires were blown, from what I remember, it was like the two rear that were blown.
I don't know about the front.
So I knew, I told myself, you're going to have to give it a little bit more steering to cause his vehicle to lose traction because, you know, if your suspect vehicles like on tires, it breaks traction pretty easy, especially at those speeds.
The faster you're going, the easier the pit is.
So I was like, no, I got to do a little bit more steering.
So, you know, my car.
And as you guys know, when you're driving fast, like, literally, when you're driving fast, going like this just a little bit moves the car a lot, right?
The faster you're going.
So it doesn't take much to knock the car off course.
Car's kind of low.
His in a pickup truck that kind of gains a little.
They're probably going, you know, at speeds of 80 to 100 easily.

If I continue going this way, you know, it's a chance for him to start firing at me.
So I let off, let him straighten out, and I kind of tricked him.
I kind of stayed right there, like if I was going to go back in for a pit.
And then I just, I shot off to the right side and I went in for the pit on the uh on the passenger side.
So now I was like, all right, I'm going to put a little bit more steering into it.
And sure enough, the truck breaks traction.
It's doing exactly what it's supposed to be doing.
And for me, it was like a huge relief.
I was like, all right, you know, I'm fucking stopping this guy.
You know, it's time to get ready.
I just remember telling myself, have your seatbelt off.
As soon as the car like slows down, just jump the fuck out and get out of the car.
So his vehicle spinning, it's almost coming to a complete stop.
Like the way I teach pit and academy is we're supposed to pass the suspect and we're actually supposed to be ahead.
There's no way I can do that.
I'll be like way behind the power curve.
I'll lose like a second or two like passing him.
By the time I get out, I got to face the other way.
So I was like, no, I got to stay here.
So I just remember jerking the wheel to the right and kind of like getting closer to him, you know, instead of being like so far away.
So I just like jumped out.
I was like, I got the fucking hit on him.
I'm going to be faster.
And then as soon as I put in park, he was already right there.
So I was like, what the fuck?
I'm supposed to have to hit on this guy or to jump on this guy.
But he's got me beat.
And I'm like, nah, I'm getting the fuck out.

I don't remember like unholstering.
I just remember like having my gun.
I fire.
And I guess that's when I get hit because I just remember, I remember falling.
As soon as I fell, man, I was like, man, I'm fucked.

But then they kind of shifted over to where my left front tire is.
So I was like, all right, you know, that's a good sign because he's no longer coming at me.
So I was like, I think you got to get the fuck up, man.
So I just remember popping up.
And as soon as I popped up, I don't know if I was still kneeling or all the way up, but I can see him.
So I just started shooting.
And I saw him, it looked like I hit him.
Because I just remember him crunching down.
And then he turned from me.
And he started running back towards his truck.
So all I can see was his head.
They say this is the bed of the pickup truck.
All I saw was his head, and then all of a sudden he just dropped.
I was like, no, I gotta go get him.
You know, this is the fight to this guy.
So I kind of just came around the corner, took my time a little bit.
Remember seeing his legs move and I saw the gun on the ground.
I don't remember if he was holding it, but I just remember seeing the gun.
So I just kept firing, and that's when my handgun was already empty.
The slide was locked to the rear.
