I'm Chief Robert Gordon from the Mexico State Police on February 4th, 2021, and the Mexico State Police Officer, Darien Jarrett, stationed in Mexico in Deming, New Mexico, was assisting Homeland Secur investigations.
Now, you guys are probably wondering, yo, what's going on here?
Myron, what HSI, your agency was involved.
Yes, we have a big presence on the southwest border, guys.
Big presence there.
The officer was initiated a traffic stop on a white Chevrolet pickup on Interstate 10 eastbound near mile marker 101, east of Deming, New Mexico, and Deming, New Mexico.
Down the middle, nowhere.
You can see Interstate Highway 10, cuts right through it.
It is not too far from the border.
Right?
Which obviously is gonna be huge drug trafficking.
But here it is right here.
It's a uh city in Luna County, New Mexico, United States, 60 miles west of Las Cruces, 35 miles north of the Mexican border, so not far whatsoever from the border.
The population was 14,750 as of 2020 census.
I don't know what the hell.

So this is standard, especially like in rural highways like this, guys, where um, you know, they used to teach them to walk up to the driver's side, but now they tell them to go on the uh other side for obvious reasons, right?
Because someone might hit you on the side of the road.
A lot of people drive drunk like idiots.
Can't tell you how many times I've seen troopers literally get smacked as they're doing a traffic stop uh by some weirdo.

Now traffic stops are very dangerous, guys, for obvious reasons, right?
You know, like you don't know who the individual is, you don't know what they have on their car, etc.
Obviously, you make hundreds if not thousands of these over a career, so you get used to it, but it's still always dangerous.

Um, and in this case, this was in the middle of an uh for an operation with homeland screen vessel, which we're gonna talk about here.

Alright, so I'm assuming he probably pulled them out of the car at this point, guys, because he's a little nervous.
Um he doesn't want him to keep sitting in his car.

Grab the phone and come with me to my vehicle so I can get the return and then I can make sure that everything's good.

Now, what he's gonna do more than likely, chat, is he's gonna run him through something called law uh uh an NLET, okay?
Not l uh national law enforcement telecommunication national law enforcement telecommunications, yeah, NLETS, which is going to um allow him to get the data on the car and the driver's license from the state level.

Um that's what he's probably gonna do.
Check it and make sure the registration and everything is good to go.

And this guy's a multiple time convicted felon.
Just so you guys know, this guy's a drug trafficker as well.
That's why he's a little bit on edge, and I guess tell you guys this from me being on the job.
Drug traffickers are always nervous because they know that their days of uh, you know, are always numbered, quite frankly.
You got the police after you, you got other criminals after you trying to rip you off.
You gotta make your drug payments back whenever and he's right there on the border, so more than likely he's very close to the source.
He's dealing with some very dangerous people.
So he's clearly on edge here, right?
And this guy's been in jail in and out multiple times, multiple time convicted felon.
HSI had done an operation with him with some uh meth and uh with with some meth and I think pills.
And they were doing this traffic stop here to bust uh to uh collect uh I guess they had him on surveillance.
And they were doing this traffic stop kind of as like a a T stop just to probably identify and make sure it's really him in the car or get some other intel.
I'm not sure exactly why.
Maybe we'll figure that out why they did it.
But the point is that this guy was on HSI's radar, HSI deming office uh for drug trafficking is the point.

So now he gets out the car without him telling him to do that.

So for my safety.
So he has to take the gun off him.
Now at this point, the guy is probably nervous because the guy knows, yo, I'm a convicted felon, I can't have a gun, I'm gonna go to jail.

So I think that's where he made the decision.
I'm not I'm not going away.

So at this point, the guy's getting probably nervous.
He doesn't know what he's gonna do.

He can't have a gun, and he has one on him.

So we asked him to come to his car.

This is where I think he puts one in the chamber here.

Then he just starts shooting at him.

So that and that's gotta be the moment right there.
Like, this is fucking devastating to see.

Boom, shoots once, probably hit him.

Then obviously you're at close range.
And this is uh uh AR, so that that's gonna go through that vest.
Can't even get his gun out.
Then he shot him in the head.
one last time Then he speeds off.
During the traffic stop, the driver identified as Omar Felix Cueva, 39 years of age.
Fire at least one shot at the Mexico State Police Officer Darien Jarrett.
Officer Jarrett was struck and killed by gunfire.
An HSI agent arrived on scene and notified the Mexico State dispatch that our officer was down.

So what happened was the tra the guy was supposed to make the traffic stop, and these guys were behind, because obviously they're in an unmarked unit.
They don't want to make it too obvious.

Ended up uh going down really bad.

I uh just had a car pulled over and uh shot him in the head.
He's dead shot in the head.

Uh we're just west of the Kila exit on I 10.
Uh it's it's a New Mexico State Leaf vehicles.
An unmarked law enforcement vehicle.

Um by one set of no, I'm I just walked up.
I'm flipping him over now.

They were trying to make it look routine, guys.

And this is a long highway, guys.
This highway takes you from Los Angeles all the way to Jacksonville.

They've had him under surveillance the whole time.

Officer Darian Jarrett began his career as a transportation inspector with the Mexico Department of Public Safety.
He was certified as a law enforcement officer in December of 2014 and worked with the worked with the former Mortal Transportation Division of the New Mexico Department of Public Safety.
In July 2015, he was sworn as a New Mexico State Police Officer.
Where he bravely served until He's only been on the job for about five or six years at that point.
Officer Jarrett leaves behind three small children.
And he was expecting his fourth child this year.
This is my commit- Yeah, only nine only dude.
This guy was younger than me.
He's 32 years old.
When he died, it was like uh 30 or just as I have loved you.
29, actually.
Greater love has no one than this.
That one lay down his life for his friends.
And we want you to understand that we're here to honor honor Officer Darren Jarrett.
Officer Darian Jarrett went out there today and was serving his state, his community, uh the best way he knew how.
And um, I love him for that.
And everyone that's here loves him for that.
I want you guys to understand that as we get through this.
But these officers lay their lives out on line every day for each and whatever one of us.
Yeah, uh, I see some of you guys are saying, yo, is it routine for them to be by themselves a lot?
Yeah, guys, the state trooper, um, yeah, you're you work alone a lot, guys, especially on in rural areas like that, uh, with big interstate highways, yeah.
It's very common to work alone.

People forget that these people are regular humans that have jobs and have children and have families.

The state and the local law enforcement agencies.
A New Mexico State Police Officer located Quaba traveling east on your state 10, near Mallmark of 116.
Quavo pulled over at the exit and fired New Mexico State Police officers.
The officers So now they're chasing him, right?
Because obviously uh the guy killed the fucking trooper.

A pursuit was initiated as Cueva continued to evade officers traveling east on Interstate 10.

You know, five All right, so now they're gonna talk about uh the age I involvement.
Minutes after Omar Queva shot and killed New Mexico State Police Officer Darien Jarrett along Interstate 10.
He called an undercover agent with Homeland Security investigation to tell him he had been pulled over by the police.
Queva told the agent he did not give them a chance and still wanted to meet up to sell the agent five pounds of methamphetamine.
So they had him under surveillance because they were supposed to do a drug deal later on, right?
And what they wanted to do, I guess, was do a traffic stop, see who was with him, identify any other individuals, right?
And then, you know, let him kind of go on his way.
That the the trooper was gonna more uh gonna let him walk, guys, so that he can go do the drug deal.
Um, but granted, the fact that the guy had a gun, that made things a lot trickier, right?
But yeah, so Queva had been talking with an undercover HSI agent the whole time, so he called him right after he shot the cop.
I mean, meanwhile.
But he still wanted to meet up to give uh to sell the agent five pounds of meth.
Well, the agent received word that an officer had been killed.
Uh okay, a ranking agent told state police investigators he knew there was a plan to have, say, police pull over Queva between Deming and Las Cruces if the opportunity.
The ranking agent with HSI told state police investigators he knew there was a plan to have state police pull over Queva between Deming and Las Cruces.
And this is common, guys.
When you're doing uh drug trafficking deal, uh a drug a drug deal like this, like uh what this is called a under a controlled buy, right?
And when you do a control by, right, you're gonna monitor the bad guy from when they leave their house all the way up until he meets with the undercover to do the deal.
Why?
Because throughout the entire process, right?
The person is going to be meeting with people, uh making phone calls, he's gonna be going to places, so you might be able to identify co-conspirators, whether it's a source of supply, a stash house, um, another vehicle, other people, like you're gonna be able to identify a bunch of things.
So they had the drug deal set for today, and they were monitoring him the whole time.
And then what happened was they had the they wanted the trooper to stop him, right?
To get him or anyone else in the vehicle identified, and then let him go.
But granted, obviously Cuevo doesn't know he's being watched by the police, so he thinks it's a real traffic stop.
So what does he do?
He's like, damn, I got a gun.
The cops saw that I got a gun.
This is a real traffic stop, I'm gonna shoot.
Because I'm gonna go to jail.
I'm a convicted felon.
Right?
So they honestly fucked this one up.
Um with this operation for sure.
Very unfortunate.
If the opportunity came, if not, the 39-year-old would have been busted by multiple HSI agents and armored vehicles when he met up to sell the math.
So they were gonna bust them later after the deal was done.
Agents told state police investigators they knew.
All right, guys, I'm gonna get my face off the screen a little bit so I could just give you guys commentary.
Because there's text that's coming up on the screen, so I don't want to block it for you guys.
Cueva was armed and had told them he was not going back to jail.
According to New Mexico State Police Incident reports, HSI agent Hector Huerta, an acting supervisor for the deming office, told investigators that a few weeks before the shooting, a confidential informant tipped them off to Queva and how he wanted to sell a large amount of narcotics.
He said that on January 28th, an undercover HSI agent met Queva at a truck stop in Las Cruces and bought a pound of methamphetamine and 4,000 fentanyl pills.
That's a lot.
So obviously this guy uh he's he's dead.
It's for him to get that volume of drugs means it's connected.
So obviously there's gonna be someone that's gonna be of interest to the feds.
Pound of meth, half a kilo roughly.
During this transaction, Mr. Quava was acting paranoid, took a photo of surveillance.
Drug traffickers are always paranoid, chat.
Very paranoid.
A lot of times they do the drugs themselves.
...vehicles and was armed with a fully loaded AK-47 rifle, the report states.
The undercover agent tried to buy the rifle from Quava, but he declined, saying it was for protection as he had.
Now, this is common, right?
You do undercover operation, you see the bad guy has a gun, right?
Obviously that makes things dangerous.
So, hey, why why don't I just buy the gun from this bad guy, right?
Why don't I pick it up?

Queva said he could meet to sell the five pounds of meth on February 4th, and HSI chose state police officer Leonel Palomares, the canine officer, to make a high-risk stop and gave him full disclosure on everything they knew about Cueva.

Meanwhile, HSI sent out a be on the lookout advisory on February 2nd as Queen.

End Investigators learned through HSI that there were two plans of action for the February 4th operation.
The first involved Officer Palomares pulling Queva over with a group of HSI agents and an armored SUV ready to act as a quick reaction force.
If state police officers were unable to locate Quavo along I-10 and he reached the meeting place in Las Cruces, the undercover agent would give a signal when he confirmed the meth was there and tactical agents would move in to arrest Queva.
On February 4th, HSI held a 45-minute briefing in Las Cruces at 1030 a.m.
The plan was to monitor Cuevas home until he was seen leaving.
The vehicle description would be sent out, and Palomares, who was on board and another state police unit would make the traffic stop.
No state police officers were.

If you have undercover agent or an informant, you're gonna have pictures of the other the undercover agent is gonna be there, he's gonna show everyone what he looks like.
So there's no blue on blue, right?
Or, you know, friendly fire incident.
Or if you're your informant won't be there, but you're gonna show a picture of your informant to everybody there, right?
And you're gonna go over the radio channels, what the goal of the operation is, who's gonna be where, who's gonna be staged where, the closest hospital, the radio frequencies that you're gonna use, all that stuff is there.
The other agencies that are gonna be involved in the um takedown or the operation, you're gonna give them radios, right?
Because let's say when I used to work with DEA all the time, right?
DEA uses different radios than HSI does.
So I would make sure I gave Them the uh HSI radios.
So they can be on comms with all of us, right?
So the briefing is where everyone is there that's involved in our operation, we all know what each other looks like, we all know what everybody's wearing, we all know what cars they have, right?
Um we all know what frequencies were supposed to do, and everyone has a job, right?
So if you're not there at the briefing, you can't participate in the goddamn operation.
So this was a big fucking L that the trooper was not at the uh uh the briefing.

Now you're gonna see here there's a discrepancy that some places are saying, oh, the guy they they knew that Cueva was dangerous, other ones are gonna say, oh, they didn't know Cueva was dangerous.
What I will say is this.
If he had gone to the briefing like he was supposed to, he would have known he was dangerous, and you would have been a little bit more um cautious.
Because you could tell he didn't get nervous until he saw the gun.
The trooper didn't really get like high alert until he saw the gun, which he should have been high alert the whole time.

I questioned Agent Huerta on why on his ops plan stated this was not a high-risk operation.
Agent Huerta said it was an oversight on his part.
But yeah, you gotta share that information all the time.
If anyone is like dangerous, criminal history, all that shit.

Based on everything they had planned for this operation, it was a very sloppy man.
Indeed, a high risk, one investigator wrote.
Palomares said at first HSI told him Cueva was in an SUV with his family.
Then he was in a truck and alone.
As they waited to make the stop, Halamares told his partner he did not have a good feeling about the traffic stop, and the two began rehearsing how they would make the stop.
If they saw a firearm, a felony stop would immediately be executed.
And a felony stop, guys, is where they're at their cars and the bad guys in their car, and they're staying behind their their door like this.
They don't even walk up to the car.
That's what a felony stop is.

At 1125 a.m., HSI agent Matthew Rodriguez sent out a text message saying that four officers were staged at mile markers 102 and 132.
At 11:59 a.m., Rodriguez sent another text that another officer, Jarrett, was at mile marker 98.
Within Jared's one, I got shot.
In minutes, Rodriguez sent a text that the officer pulled over Cueva and mile marker 102.
Two HSI agents were traveling westbound in an armored vehicle when they saw the traffic stop and wondered where the officer's backup was.
OK, so it seems like the trooper was supposed to have backup, but he didn't.
They stopped 200 yards away and watched as a dark silhouette fell to the ground next to the truck.
And the reason why they stood back, guys, is because they didn't want to burn it, right?
That the they wanted it to, you know, you gotta let the guy do the traffic stop, let make it as natural as possible, but the guy didn't have his backup and you ended up getting shot.
They assumed Jarrett had taken Cueva.
This is a failure on the state police, HSI, everybody, man.
Took ground until they saw Cuevas truck pull away.
HSI agent Garrett Olson told investigators he asked Rodriguez if Officer Jarrett was part of the operation, and Rodriguez replied he did not know because he only spoke with Sergeant Madrid, who had details on Cueva.
Olsen said that after the shooting, he wondered if Jarrett knew how dangerous this traffic stop could be, and the HSI special agent in charge, after viewing Jarrett's dash cam video, was concerned that Jared did not have all the information with reference to HSI's knowledge of it.

Palomares said they were waiting to make the traffic stop when they were advised HSI had reached out to Sergeant Madrid and soon after they had heard Jarrett make a traffic stop over the radio.
Minutes later reports came through that an officer was down.
Sergeant Madrid told investigators he got the bolo on February 2nd of a man coming from Tucson with a load of fentanyl and a gun in the truck, and it was put out to the guys to be on the lookout.
Madrid said there was no briefing on criminal history on Cueva.
It's the common stuff we do every day, he said of the traffic stop.
He said he took it.

Madrid told investigators he replied that he did, and he relayed any further messages from Rodriguez to Jarrett, but never gave Rodriguez Jarrett's number.
Madrid said he guessed officer Jarrett had spotted the truck, and the next thing he knew he was running out to the scene after Jarrett was shot.

He's continued, he would uh stick his his hand out that little window, aim at me and fire some more.
So I was like, fuck.
You know, I got ripped and hit this guy.
So I waited for him to turn around and like look straight again, you know, pay attention to the roadway.
So I started getting up on them, but you know, he wouldn't give me the chance, he would turn around and start firing.
And then once we started getting closer to the motel exit, I was like, you know, I can't do it now because there's too many officers.
I know uh I remember I don't remember who else was there, but I remember Joaquin being there uh for my department.
So they I gotta back off.
I remember getting on the radio and saying, hey, uh, you know, we're we're approaching you, Joaquin.
And uh I don't think I hit the brakes or anything.
I think I just let off on the gas, you know, just so I can give him time to deploy the stop stick.
And I saw the suspect like pretty much like riding in between both lanes, and he ran over the spike strip.
And uh I just remember I'm pretty sure I moved to the the right side of the roadway, trying to avoid the spike strip.
And uh the suspect uh fired some more rounds at me.
And I just remember looking down at my dash, and uh my dash was flashing, and it was saying zero PSI, like on the left front tire.

So like shit, I got a fucking tire that's blowing.

So I just remember like just checking my steering.
Like to me, my car felt good.
It didn't feel like it was damaged or built the tire other maybe the the dash is fucked up or something.
He ran over the spike strips as soon as he passed.
You know, that's when I saw my light flashing, but then I just heard a shitload of gunshots.
And I saw there was a bunch of officers on the left side.
I don't know if it was uh state police or gas over, but I heard a bunch of gunshots.
And I heard like a ruled like distinct sound, like it was hitting something.
So I think that got him.
And it sounded like my car got hit too as soon as I passed.
Like I remember hearing like two different sounds.
It sounded different than the ones that were hitting him.
And uh that's when I saw him slumped over.
I was like, oh my god, this guy got fucking hit or whatever.
So I got on the radio, started telling you people on the radio that uh that he was slumped over.
But then I realized like, you know, he's still like driving straight, you know, it's not like drifting to one side or anything.
I was like, maybe he's not hit.
So I was just just watching and paying attention to see what he's doing.
So I told myself, you know, like it's time to go in for the pit, but then we were like at a curve, and I was like, no, this isn't this isn't a good spot.
You know, if I do the pit, there's way too much traffic right here.
I'm gonna put like too many people in danger or whatever.
So I just I hesitated a few more seconds, and as soon as we clear uh clear out from where all those people were at I saw him pop back up, he's back to driving, he's not no longer firing at me, so I said, screw it.
Gunned it, went in for the pit on the uh on the on the driver's side of the car.
But since his tires were blown, like from what I remember, it was like the two rear that were blown, I don't know about the front.
So I knew I told myself you're gonna have to give it a little bit more steering uh to cause his vehicle to to lose traction because you know if you're suspect vehicles like on tires, it breaks traction pretty easy, especially at those speeds, the faster you're going, the easier the the pit is.
So I was like, no, I gotta do a little bit more steering.
So uh, you know, my as you guys know when you're driving fast, like literally when you're driving fast out going like this just a little bit moves the car a lot, right?
The faster you're going.
So it doesn't take much to knock the car off course.
They're probably going at you know, at speeds of 80 to 100 easily.

So I let off, let him straighten out, and I kinda tricked him, I kinda stayed right there.
Like if I was gonna go back in for a pit, and then I just I shot off to the right side and I went in for the pit on the uh on the passenger side.
So on that one's like, alright, I'm gonna put a little bit more steering into it.
And sure enough, the the truck breaks traction, it's doing exactly what it's supposed to be doing.
And for me it was like a huge relief.
I was like, alright, you know, I'm fucking stopping this guy.
You know, it's it's time to get ready.
I just remember like telling myself, have your seatbelt off.
As soon as the car like slows down, just jump the fuck out and get out of the car.
So his vehicle spinning, it's almost coming to a complete stop.

Because I just remember him like like crunching down, and then he turned for me, and then he like started running back towards his truck.

So I was like, I got freaked out.

So I started taking steps back and I tried to go holster my gun again, and I couldn't.
I just remember like holding on to it because I didn't want to drop it like just in case I gotta get into like another shooting or say I don't I don't know if there was like anybody else in the car.
I just remember looking at his like driver uh seat.
I I never checked the passenger side.
So I had I just kept it here like just in case I I gotta shoot again, I'll be ready.
My mind already told myself, you know, I have uh another magazine in there.
I tried getting on the police radio, but I don't know if your radio is the same, but we when we press ours, there's like a little beep, and then you can start talking.
I kept pressing it.
No beep was coming out.
I was getting pissed off.
Someone had told him, you know, I'm injured.
And uh I don't I don't think I even had my police radio, to tell you the truth.
I don't remember turning it on or anything.
