So we're going to go ahead, guys, and introduce you guys to who R. Kelly is.
You know, some of you guys may not know who this guy is.
He's probably before a lot of your guys' time.
So yeah.
So we got here.
Here he is.
Robert Sylvester Kelly, born January 8th, 1967, is an American singer, songwriter, record producer, and convicted sex offender.
As recording artist, Kelly was credited with helping to redefine R B and hip-hop, earning nicknames such as the King of RB, the King of Pop Soul, and the Pied Piper of RB, which is kind of funny because, you know, they would use the Pied Piper to refer to him getting girls that are young.
He is known for his extensive discography of hits spanning three decades.
He sold over 75 million records worldwide, which made him the most successful male RB artist of the 90s and one of the world's best-selling music artists.
He won three Grammy Awards for his song, I Believe I Can Fly.
He has written, produced, and remixed songs, singles, and albums for several artists, including Michael Jackson's You Are Not Alone, for which he was nominated for a Grammy.
Throughout his career, Kelly has been repeatedly accused of sexual abuse with young adults and minors.
He faced multiple civil suits and was indicted by criminal courts in Chicago, New York, Illinois, and Minnesota.
He repeatedly denied the charges in 1994.
He illegally married his underage protege, Aaliyah, in 2002.
He was indicted, but eventually acquitted on 21 counts of making child pornography.
So I know you guys are probably wondering: wait, hold on, hold on.
Who's Aaliyah?

Okay, Aaliyah Dana Hewen, uh, or Houghton, uh, known uh, monomymanously as Aaliyah, was an American singer, actress, dancer, and model.
She has been credited for helping to redefine contemporary RB hip hop and hip-hop, earning her the nickname as the princess of RB and queen of urban pop.
Um, born in Brooklyn, but raised in Detroit, she first gained recognition at the age of 10 when she appeared on the television show Star Search and performed in concert alongside Gladys Knight at the age of 12.
Aaliyah signed with Jive Records and her uncle Barry Hankerson's back uh blackground records, and that's when she met R. Kelly guys when she was 12.
Hankerson introduced her to R. Kelly, who became her mentor, as well as lead songwriter and producer of her debut album, Age Ain't Nothing But a Number.
Oh man, that did not that aged perfectly, I guess, in a terrible way, right?
Like, holy shit, okay.
Um, the album sold 3 million copies in the United States and was certified double platinum by the recording industry associates, RIAA.
After allegations of an illegal marriage with R. Kelly, Aaliyah ended her contract with Jive and signed with Atlantic Records.
And this, guys, is the marriage certificate right here that everyone is talking about.

Robert S. Kelly of Chicago in the county of Cook and the state of Illinois of the age of 27 and Aaliyah D. Houghton of Chicago and the county of Cook and the age of Illinois of the age of 18 years old.
When in reality, guys, when this happened in 94, I think she was actually 15, if I'm not mistaken.
She was born 1979, 1979.
My math sucks.
I think she was 15.
But yeah, 1994 minus 1979.

So, you know, and Aaliyah, you know, is a legend also in the RB space, guys.
But she passed away in 2001.
And I remember it was an airplane crash.
I remember when the news broke back then.
I was 11 back then.
So anyway.
So anyway, let's go back to R. Kelly.
Where were we?
So yeah, this is the marriage.
That was the marriage certificate.
Not a good look for him getting married to her.
Okay.
So in January 2019, a lifetime television docuseries, Surviving R. Kelly, helped resurface the scandal.
Under pressure from the mute R. Kelly movement, RCA records terminated Kelly's contract with the label.
In 2019, several jurisdictions built criminal cases against Kelly, and grand juries brought indictments in both federal and state courts.
And for some of you guys that are wondering, this is the documentary that they're talking about right here, Surviving R. Kelly.
Oh, hold on.

This is it right here: Surviving R. Kelly in this documentary series on the tangled history of allegations against musician R. Kelly women give detailed accounts of sexual and mental abuse.
Now, I'm going to reserve my thoughts on this documentary to the end, and we'll go over the facts.
But there's some things here that we could definitely discuss when it comes to this documentary because I did watch some of it.
Denise, you watched the whole thing, right?
What was your take on it?
Well, my take on it is you watched all the episodes, right?
Yeah, he, yes, he did.
He did try to get with a lot of minors, but he also was with a lot of women of age.
It was just all about, from what I've seen, is all about how much he can control them.
So I feel that if he was able to control, my conclusion is if he was able to control somebody and they were able to listen to him and do what he said, that was his like girlfriend.
He always had more than one.
I think he owned like two houses.
Okay.
And in each house, he always had like girls in their own room.
And apparently, from what these women are saying, it sounds like he was really mean.
Like he deprived them of food, deprived them of God damn.
Yeah.
Yeah.
I saw some of that.
I was like, holy shit.
And he obviously denied all these allegations, guys, that he was like denying girls of food and everything else like that or telling them when they can piss and all the other stuff.
It's a little sensationalized.
We don't know if it's, you know, if it's 100%, but there's a bunch of witnesses, man.
So it looks like, you know, when you have 40 plus witnesses all giving a very similar story, corroborating each other, you know, it's very difficult to defeat that, you know, being objective here.
But I'll give my personal opinion at the end.

Under pressure from, okay, so in 2021, the United States Attorney of the Eastern District of New York tried and won the first criminal conviction against Kelly for a sex offense with the jury finding Kelly guilty on a total of nine criminal counts, including violations of the Mann Act and racketeering.
On June 29, 2022, Kelly was sentenced to 30 years in prison.
Kelly continues to challenge his New York conviction.
He actually sued them as well because they put him on a suicide watch and he's suing them for doing that.
As of June 22, Kelly is scheduled to face another federal trial in the Northern District of Illinois alongside his former employees.
The indictment alleges Kelly both produced child sexual abuse material and conspired with employees to corruptly win his 2008 acquittal.
The trial is scheduled to begin August 15th, 2022.
So R. Kelly.
Talk about a fall from Grace, my friends.
He went from one of the best RB.
I remember back when they used to call him the king of RB.
I remember when he had the hits, you know, Ignition, Hotel.
He dominated the 90s.
You know, I remember vividly watching Space Jam as a kid back in, you know, I think Space Jam, when did it come out?
Like 94 or 95 or something like that?

It's still a classic.
And that was the lead soundtrack.

I was still living in New York City back then.
So, so yeah, I remember that was like the lead thing.

You know, it used to be a thing back then, like having your song on a big movie as a soundtrack.
But, you know, times have changed.
Record labels have changed.
Selling music has changed.
You know, nowadays, like if you didn't go platinum back then with discs, they looked at you like you were a bum.
You know what I mean?
Like you weren't like a top-tier artist.
Nowadays, it's normal to like sell 10, 20, 30,000 units.
And it's like, wow, to me.
So, I mean, the record, the record industry has changed significantly.

And that's the argument that his defense made.

They were able to convict him.

Yeah, so Kelly, guys, just so you know, he went to Kenwood High School in Chicago, and there was a McDonald's in that area as well.
And he would always be there when he was starting to blow up in the 90s, recruiting girls, you know, that were high school age, which is very stupid.

Kelly once again settles out of court with former Epics Records intern, Tracy Sampson, another person that came forward as a witness.
You accused him of beginning a sex relationship with her when she was 17.
And then February 2002, as Kelly prepares to perform at the Winter Olympics, the Chicago Sun-Times reports on a video sent to them, allegedly showing Kelly engaging in sex, urinating on an underage girl.
And that's where all the jokes come from with, I'm going to pee on you.

And then there was rumors also that Kelly wanted to get his brother to take responsibility and say that he was the guy in the video doing it.

So 2002, Kelly pays an undisclosed amount to Patrice Jones, who claims the singer impregnated her when she was 16, who claims to be the singer, forced her to have an abortion.

They dropped the charges, but she still sued him civilly back in, I think, 04, 05.
And he settled.
He gave her an undisclosed amount of money.
Why?
Because you don't want to deal with the fucking headaches, man.
And then going to trial, right?
It's going to, sometimes it costs more money to go to trial than it does to just pay the settlement and be done with it.
So this is why people settle, man.
Most civil cases do end in civil.
They don't end in litigation.
They end in settlement.

So he got charged, guys, on this child pornography stuff, right?

And he was acquitted.
They're going to retry him August 15th for that in Chicago federally now.
Now, that presents the potential issue of double jeopardy, which I'm going to play here.
This attorney kind of breaks it down pretty well.
Now, what is double jeopardy, guys?
Double jeopardy is essentially you can't be tried for the same crime twice.
So the state charged him with possession of child pornography, failed.
He was acquitted.
Now the feds have pretty much taken the case, and now they're going to charge him with the same thing.
So his defense might be able to actually present something here to get him off on these charges on a double jeopardy defense.
So let's go ahead and see what this attorney has to say.

These were very heavy sentences, but this has been a bad two days for the rich and famous.
Miss Maxwell yesterday and R. Kelly today are both in effect sentence.
Yes, Ghelane Maxwell got 20 years, guys, and R. Kelly got 30 years.
Sentenced to life in prison.
And the size of R. Kelly's sentence, which exceeded the amount that the government was demanding, didn't really come as a surprise to me, given the fact that he, unusually enough, he was convicted of violations of the racketeering statute, what we commonly call the RICO statute, which cat.
And you guys, you guys have been watching me for a while now.
You pretty much know where RICO is.
RICO is an effective way to target criminal organizations and charge everyone under the same umbrella.
You get stiffer sentencing, you get stiffer penalties, and it's easier to charge.
And on top of that, a lot of the times, you're able to beat the statute of limitations.
Why?
Because if you're able to show, because you guys can see a lot of these crimes happened 20, 30 years ago, but they're able to bring it back and attack and charge him because under racketeering, all they need to show is that there's a pattern of criminal activity occurring over a period of time.
And then, bam, they can get over the statute of limitations.
Barries enormous penalties.
So it was no surprise to me.
So, Paul, as you pointed out, prosecutors were asking for 25 years.
The judge issued a higher sentence than that.
Why do you think that the prosecution didn't ask for a higher sentence, considering what you said?
And how often does that happen that the judge exceeds the prosecution's recommendations?
It does happen fairly frequently.
You have to remember that judges sit there through the entire trial.
They are except for rules.
And just so you guys know, the reason why he got 30 years is because he didn't plead guilty.
He went to trial, guys.
When you go to trial, all right, what's going to happen is the government, and I can tell you guys this from personal experience.
Nobody else on YouTube could tell you all this.
I've prepared for a federal criminal trial before.
Okay.
And I'll break this case down for y'all.
But long story short, I had a case one time where we caught this human smuggler.
He got caught smuggling a bunch of aliens into the United States and he put the aliens in danger.
And he was facing quite a bit of time.
And this was like his third time getting arrested for this offense.
So he said, fuck it.
I'm going to trial.
So he goes to trial, right?
If he had just pled guilty, he would have got significantly less time because he would have got a plea bargain.
And most cases, guys, especially in the federal system, are pretty much settled through a plea bargain where the guy says, all right, I'll plead guilty.
I'll give a statement of my guilt.
And in exchange for the government not having to waste time and money preparing for trial, I will get a lesser sentence.
This guy decided to go to trial.
Let me tell you guys what happens when you go to fucking trial.
As the case agent, you essentially become the prosecutor's bitch.
All right.
I'm going to say it.
I don't give a fuck.
It is the truth.
Once you go to trial, it's your job to gather all the evidence, gather all the witnesses, corral everyone up, get all the agents that were involved in search warrants, whatever it may be.
You're going to go and get them all ready and bring them to U.S. attorney's office, have the attorney, you know, prep everyone up, you know, have all the documents ready, help them with discovery, all that stuff.
Okay.
You have to arm the prosecutor with everything they need to win the trial.
Okay.
Because when you go to trial, all right, now you have to prove in front of a jury through due process and everything else like that, that this person is not just guilty, but they're guilty beyond a reasonable doubt, which is a very high burden to prove.
Okay.
So when you're there, you're responsible for making sure that AUSA has everything they need.
Because remember, guys, AUSAs don't really have arrest authority like that.
You know, they're considered a law enforcement officer of the United States to a degree, but they don't really go out and interview people and gather witnesses.
That's the agent's job.
So you have to go do that stuff.
So the fact that Kelly, right, R. Kelly went to trial, they had to prepare 30 years worth of evidence against him.
And then on top of that, he never admitted to any of the crimes.
He never gave an apology.
He denied everything.
So the government looks at it like, okay, you're not going to admit guilt.
You're not going to plea bargain.
You're going to make us go through the process of trial and proving you wrong.
Well, guess what?
Now you're going to feel the full force of the U.S. government and you're going to go ahead and get as much time as possible.
That is more than likely why the judge gave him more time, okay, than what the prosecutors wanted.

We're talking about R. Kelly here and his charges.
And judges do have, even in the federal courts, much more so in the state courts, judges do have discretion to exceed what we call the sentencing guidelines.
And this particular judge is not known as a harsh sentencer, but she's a very attentive judge.
And she must have formed some very distinct reactions to and the government had like 40 witnesses against him, guys.
It was pretty bad, which is why it's very difficult to believe him, you know.
Kelly's demeanor, his constant substitution of lawyers.
I think that tended to cut against him.
But again, okay, why would that cut against him?
Because anytime the defendant goes ahead and gets other attorneys or whatever, it pushes the entire judicial process back, guys.
Okay.
So he's delaying, right, due process.
And obviously, to keep a case going and prepare for trial and everything else like that, guys, it costs money.
You got to fly these witnesses.
Like it's a logistical nightmare, guys, from the case agent perspective and the U.S. attorney's office perspective to have a case like this where you got to fly in 40 plus witnesses who are all over the fucking country, maybe the world.
You got to put them up in hotels.
You got to pay for their food.
It's extremely labor intensive to do this.
Okay.
You got to protect them, all this stuff.
So it is not easy to go to trial.
And then with someone like R. Kelly, where this is going to get a lot of media attention, it becomes an even bigger spectacle.
Okay.
So they got to pay the Federal Protective Services quite a bit of money.
The marshals are on high alert because when you have a big case like this, it's very expensive to fund it.
Again, the basic principle would be that she, she, the judge in the Kelly case, was applying that driving force of the racketeering statute, which was not an element in Ms. Maxwell's sentencing yesterday.
Well, Kelly.
Yes.
And that is why for all you guys that are saying, yo, America's racist or whatever, why did Ghelaine Maxwell get less time than R. Kelly?
The reason why she got less time, guys, is because R. Kelly, they got him under RICO, guys.
When you go under RICO, it's going to be a very bad time for you, my friends.
This is the law.
The RICO statute, guys, is the same law that's put pretty much the entire La Cosa Nostra, mafia, blood gangs, Casanova, 6ix9ine, the mafia, a lot of these gangs that you guys are seeing getting like sweeping indictments on.
These are all RICO cases.
RICO does not fuck around.
They're extremely difficult to do from the case agent perspective to get them approved.
You got to get it approved through the U.S. Department of Justice.
But once you get it approved, man, you're going to serve a lot of time if they convict you of it.
Kelly has replaced his legal team since he was convicted.
He is now represented by the same attorney who helped get Bill Cosby's conviction overturned.
What does that suggest, Paul?
You got Bill Cosby's attorney?
Well, this strategy seems to be all over the place.
If you look at the docket sheet, which is publicly available, Kelly has substituted attorneys with great frequency.
He has a right to do that.
He does.
Certainly, if he believes that by bringing in new lawyers at this late date, just before the sentencing, he's throwing a Hail Mary pass because the record is already set.
The sentencing memoranda of both sides were already submitted, and the judge had probably already made her decision.
Certainly, Kelly is going to appeal.
Certainly, Ms. Maxwell will appeal.
But the unfortunate part for both of them is that convictions in federal court are very infrequently reversed.
I'm speaking in federal court, Paul Kelly.
That's true.
Very rare.
Separate federal trials.
For child pornography.
Okay, so this is the second case that I told you guys.
So he got convicted in New York City, right?
In Brooklyn.
And this courthouse, actually, guys, that's the courthouse in Brooklyn.
I've been there before.
I arrested someone one time.
And I arrested him in New York.
I arrested him in LaGuardia Airport.
And I'm going to break this case down.
I got some footage for y'all, too, that I'll show you guys.
It was really cool.
But when you arrest him in LaGuardia Airport, that falls into the Eastern District of New York.
And I went ahead and took him to court.
We indicted him out of Miami, but he was in LaGuardia trying to flee the country.
We caught him at the airport right at the terminal.
And obviously, when you arrest him, you have to bring him in front of a judge within 24 to 72 hours.
So I actually took him to this courthouse right here in Brooklyn.
It's right by the Brooklyn Bridge.
It's a very nice area.
And I presented him in front of the judge to get his charges right to him.
So this is a nice courthouse here.
I've been here myself.
And obstruction charges there now.

So now we're going to go into the second case now in August, guys, that he's going to go to trial for the child pornography charges in Chicago.
So another district indicted him for child pornography out there.
It's expected to start in August.
Is today's sentencing going to impact that trial at all?
It's an open question to me, quite frankly, Tanya.
And I don't want to get overly technical.
Kelly was acquitted.
The answer is no, it can't affect him.
You cannot use other charges from another district against him as evidence.
So the answer to that is no.
But he's going to get into what his defense team should do.
Remember, this guy's a defense attorney.
So he just, you know, my man just dodged that question like a fucking ninja by a state court on the charges for which he is now going to be tried in the federal court in Illinois.
So number one, I would have the issue as his lawyer of whether or not he was facing double jeopardy.
In effect, being tried, tried twice for the same offense.
And it may well be that given the sentence here in New York against Kelly, the proceeding in federal court in Illinois, in Chicago, may well disappear.
I'm not making that prediction, but that does often happen.
Interesting.

Yeah, I'm actually very intrigued as to how they were able to put this case against him as well, knowing that he beat the case in Illinois.
But there are rumors that he paid off jurors and all this other stuff.
So if that was the case, they might be able to bring those charges against against him.
The situation and stuff like that.
Does R. Kelly have a route for an appeal?
Do you see a basis for that, given the facts of the case?
Well, he has.
He actually has.
I'll put aside the pornographic element of all of this, which is horrendous.
But as a technical matter, and I don't want to hack in the weeds, I think he may have a stronger basis for an appeal of the racketeering conviction, because essential to establishing a racketeering conviction are a few elements.
But in order to do that, you as the government have to show that the victim was damaged in his or her business or property.
And it seems to me from the start, a glaring omission here has been the lack of an impact.
Well, I don't doubt the suffering of these young women and now grown women.
This is an interesting point that he's about to bring up here, guys.
So let's brace ourselves for this one.
Also, I got to stop it so that no get hit with any type of copyright from CBS.
CBS does a lot of things wrong, but when they interview people like this, this is when it can be a little bit better because at least like they're bringing in someone that's like an expert and he can give an opinion.
And this guy, he's pretty accurate with what he's saying, you know, as a defense attorney.
But significantly omitted from the proof was what were the money damages sustained by the victims.
And Kelly may have a fairly strong argument along those lines, in which case the substance.
And what he means by that, guys, is you need to be able to articulate damages that you had.
So, like, for example, when they indicted the mafia, right?
And they were able to get them for loan sharking and extortion, all the other stuff.
They were able to establish from witnesses and businesses and all these other entities: yo, the mafia ripped me off for $10,000 every month.
I had to pay them in extortion fees, or they were running gambling rackets where they were making this amount of money, or they were loan sharking me this amount of money, which loan sharking is basically giving you a loan on an extremely high interest rate, you know, maybe 50%, lend you a thousand.
All right, motherfucker, if you don't bring my fucking money by tomorrow, you're gonna be sleeping with the fishes, 50% interest household, like some type of shit like that, right?
Um, so it's all tangible because it's related to money.
In this situation, it's a little bit more ambiguous because he's bringing girls in, banging them under the potential, you know, the potential that they'll be his girlfriend or maybe get a record deal or whatever.
It's it's extremely unclear where the damages are with them.
Obviously, there's emotional damage, right?
Of course, right, as you would say, Chris's favorite sound effect emotional damage, but it's very difficult to be able to articulate that in a tangible fashion.
Okay, that does not mean that the victims are less credible.
That does not mean that the victims did not deal with trauma.
It's just very difficult to judge that from the RICO perspective.
Because with the RICO charts, a lot of the times you need to establish damages.
And a lot of the time, that comes from some type of monetary amount.
That's why it was so easy to go after the mafia because when they were running the labor rackets and everything else like that, they were able to easily show that the mafia was making this amount of money.
They're extorting this amount.
They were loan sharking on this amount of interest, this amount of much money, blah, blah, blah, all that other stuff.
Because with the mafia, the money had to be made.
Once the money was made, it would be kicked up to the boss, under boss, all the way up to the top guy.
And there was a money chain, right?
But here, with this situation, it's not as clear-cut and defined.
Substance wouldn't be reversed, but the case might well be sent back for the government to have another try at establishing that critical element of loss, of monetary or financial loss.

including sexual exploitation of children, forced labor, and the Man Act violations involving the coercion and transportation of women and girls in interstate commerce engaging to engage in sexual activity and illegal sexual activity.
The verdict followed six weeks of trial before United States District Judge Ann M. Donnelly.
So, guys, just so you guys know, for some of you guys that are wondering, yo, why did how were the feds able to pick this shit up?
The reason why, guys, is because the violations involving the coercion and transportation of women and girls in interstate commerce.

This is what gives the feds jurisdiction to go ahead and take over these types of investigations.
Once he started using the phone to get girls to come and hang out with him, or you know, using people to recruit the girls or whatever, and having them travel state lines and everything else like that, boom, now the feds can come in and uh do the investigation.
And we know when the feds come, it's going to be a bad time for you, more than likely.

But to figure out which agency actually did the investigation, it's the first person that makes the announcement.
So, in this case, it was HSI New York that did the case.
These are the same guys that did the 6ix9ine case as well, HSI New York.
And then today's guilty verdict forever brands R. Kelly as a predator who used his fame and fortune to prey on the young, the vulnerable, and the voiceless for his own sexual gratification, stating, uh, stated acting U.S. attorney Cassoulis, a predator who used his inner circle to ensnare underage teenage girls and young women and men for decades in a sordid web of sexual abuse, exploitation, and degradation.
Yes, he did actually abuse a man as well, a boy, allegedly, guys, uh, according to the indictment in the trial.
The victims in this case, your voices were heard, and justice was finally served.
We hope that today's verdict brings some measure of comfort and closure to the victims.
Ms. Kusulis also thanked U.S. Attorney's Office for the Northern District of Illinois and the Cook County State Attorney's Office for their assurance assistance with the case.

As proven at trial for nearly three decades, Kelly was the leader of criminal enterprise of a criminal enterprise, the enterprise, consisting of himself and an entourage of individuals who served as managers, bodyguards, accountants, drivers, personal sentence, assistants, and runners for the defendant.
As a leader of the enterprise, Kelly used his fame to recruit women and girls to engage in illegal sexual activity with him.
Kelly identified these girls and women at concerts and then directed members of the enterprise to escort them backstage following his musical performances.
Kelly exchanged contact information with girls and women so that he and other members of the enterprise could arrange travel and lodging for them to visit Kelly and engage in the charged illegal sexual conduct.

But he had to do it with young girls, which is why he's suffering the consequences that he's facing now.
The evidence at trial included the testimony of 45 government witnesses.

Like, holy including more than 10 victims, five of whom are named in the superseding indictment.
Not to mention, guys, the government had a bunch of people that were on his staff that testified against him.
OK, people that work for him, his own family, his accountant, all these people testified against Kelly that he was basically running an organization to conceal his criminal activity, which is why they were able to come at him for the racketeering and saying it was an enterprise.

So text messages, video and audio recordings, photographs, phone and travel records, DNA evidence and expert witnesses.
Kelly issued rules that many of his sexual partners were required to follow, including that the women and girls were to call him daddy.
They were not permitted to leave their homes or their rooms to eat or visit the bathroom without receiving his permission.
They were required to wear baggy clothes when not accompanying Kelly to an event, and they were directed to keep their heads down and not look at or speak to other men.
Kelly also isolated the women and girls from their friends and family and made them dependent on him for their financial well-being.
He required the victims to engage in sex with him and others and recorded many of the sexual encounters.

So here are the charges, guys.
And what I'm going to do is I'm going to pull up this indictment for you guys real fast.
But we're going to read it from the DOJ thing because it outlines a lot clearer.
But I'm going to just for educational purposes, I'm going to show you guys what a federal indictment looks like.
So this is out of the Eastern United States District Court, Eastern District of New York, United States of America against R. Kelly.
Now, the Enterprise, the defendant, Robert Sylvester Kelly, also known as R. Kelly, and individuals who served as managers, bodyguards, drivers, and personal assistants and runners for Kelly, as well as members of Kelly's entourage, comprised, and enterprise.
Now, why the hell are they referring to R. Kelly's organization as an enterprise?
The reason why they're referring to it as an enterprise, guys, is because this is critical for racketeering statutes.
Remember, they're not necessarily just charging him with sex trafficking.
They're charging him with sex trafficking under the premise that it's under RICO, okay, the racketeering act, okay?
The enterprise consisted of an ongoing organization whose members function as a continuing unit for a common purpose of achieving the objectives of the enterprise, okay?
The purpose of the enterprise were to promote R. Kelly's music and the R. Kelly brand and to recruit women and girls to engage in legal sexual activity with Kelly.
But it promotes R. Kelly's music and the R. Kelly brand.
The members of the enterprise expected to receive financial opportunities and personal benefits, including increased power and status within the enterprise, okay?
So like I told you all before, he promised he sold these girls a dream.
And in connection with the enterprise, Kelly and other members of the enterprise traveled throughout the United States and abroad to perform at concert venues to promote the R. Kelly brand and to recruit women and girls to engage.
In sexual activity with Kelly.
Bam, right there is how the feds got him.
He was using, right, the girls and traveling interstate and doing all this extra shit.
And that's what gave the feds jurisdiction.
When Kelly attended and performed at concerts and other events, Kelly and or members of the enterprise on Kelly's behalf invited women and girls backstage and to other events following Kelly's live performances.
Let me enlarge this for y'all a little bit so you guys can see it better on your TV screens.
These women and girls were often offered wristbands that signified that they were authorized to attend an event.
There, Kelly relied upon members of the enterprise to ensure that only those authorized to attend were allowed at the event and to manage the flow of women and girls who were directly interacting with Kelly.
When Kelly identified a woman or a girl who he wished to see again, he either gave his contact information to the woman or girl or obtained her contact information or relied upon members of the enterprise to do so.
Well, I don't know.
Following these events, Kelly communicated with certain of these women and girls by telephone, including the use of traditional telephone calls, text messages, eye messages, and FaceTime.
As part of this communication, Kelly often requested that the girls, that the women and girls provide them with photographs of themselves.
Okay.
Again, guys, when you use phones, text messages, FaceTime, all that stuff, what does it do?
It triggers interstate commerce.
Gotcha, bitch.
Kelly and other members of the enterprise also arranged for the women and girls to travel to see Kelly on occasion, including at concerts throughout the United States and related events.
To facilitate their travel, Kelly directed the women and girls to contact a member of the enterprise who then arranged for travel for the women and girls.
When the women and girls arrived at the lodging, which was typically selected by a member of the enterprise, a member of the enterprise usually provided them with instructions.
In addition, members of the enterprise took steps to ensure that the women and girls did not interact with other women and girls whom Kelly planned to see.
So, guys, let's also deal with this elephant in the room.
A big part of the reason why a lot of these people cooperated with the government was to not be prosecuted themselves for assisting R. Kelly in doing these criminal activities.
Okay.
So they cooperated with the government to avoid prosecution as well.
You know, we got to call a spade a fucking spade.
Members of the enterprise then arranged for the women and girls to attend his concerts and position them such that Kelly could see them during his concerts.
Kelly, and you guys are wondering, well, why are they putting all this stuff in this indictment?
The reason, guys, is because they're establishing that it's an enterprise step one, and then step two, that the enterprise affects interstate commerce.
That's why they're talking about using phones.
That's why they're talking about travel.
That's why they're talking about him providing them lodging.
That's why they're talking about members of the enterprise giving them instructions.
All this, okay, creates a picture that we have a sophisticated criminal organization that is committing criminal activity while simultaneously, okay, affecting interstate commerce, which now gives the feds jurisdiction.
So the beginning part of this indictment is giving the feds venue.

In addition, members of the enterprise took steps to ensure that the women and girls did not interact with other women and girls whom Kelly planned to see.
Members of the enterprise then arranged for the women and girls to attend his concert and position them such that Kelly could see them during his concerts.
Okay, also, I want to mention this part right here.
This is very important, okay, guys, because the girls all gave very similar testimonies and stories, even though they don't necessarily know each other, which actually made Kelly look a lot more guilty.
Because if you got a bunch of girls from different places and they're all giving a very similar story, right?
Hey, I wasn't permitted to eat at this time, or he made me call him daddy, or he made me do this, or whatever.
And a bunch of girls are able to corroborate the same set of facts without knowing each other.
What does that do?
That, my friends, is a clue that more than likely your witnesses are telling the truth.
When I had a confidential informants, right, you can't necessarily go off of a confidential informant's word alone.
You need to be able to corroborate it.
So, what I would do, right, when I was in witnesses, cooperating defendants, confidential informants, they're all the same because they're providing you information, okay?
However, when you're getting this information, you have to be able to corroborate it through other people.
So, it would be common where I would interview a confidential informant, I would debrief him.
Then, after I debrief him, I would talk with law enforcement officers.
I would talk with other witnesses.
I would talk with the criminal himself sometimes, etc.
And they would confirm certain things that the informant would say or other witnesses would say.
And what you do is you extrapolate, okay, the truth from all these separate interviews from separate people that don't necessarily know each other.
Okay, that is how you build credibility in witnesses, informants, and cooperating defendants.
You never get the story just from them.
You get the story from multiple people and that they're able to confirm certain facts, okay, that all of them experienced or saw themselves.
That adds another layer of credibility to that person's testimony, okay?

Over the course of decades, he made these recordings and other recordings of sexually explicit conduct using VHS video cameras, Canon and camcorders, iPhones, and iPads.

What is probably what it looks like to me because I'm noticing a trend here that a bunch that they're in a couple of the different counts.
As to Jane Doe number four, he slapped her, choked her, and spit on her before demanding she give him oral sex.
As to Jane Doe number five, over a period of years, he spanked her, viciously assaulted her, confined her for periods of days, and otherwise manipulated her to ensure that she would perform for him sexually, including with other women and a man.
As to Jane Doe number six, he forced her to give him oral sex.
When he did that, there was a gun within Kelly's reach.

Similarly, between September 2015 and October 2015, Kelly transported Jane Doe number five, who was then 17 years old from New York City to Oakland, California for the purpose of illegal sexual activity, and she was too young to consent to sex in California.

So it was passed in June 1910 and named after Illinois Congressman James R. Mann invoked in the Commerce Clause to felonize the use of interstate or foreign commerce to transport women for immoral purposes.
The act was aimed at prostitution, immorality, and human trafficking.
Congress appointed a commission of in 1907 to investigate into the problem of immigrant prostitutes.
It was alleged that immigrant women were brought to America for sexual slavery and immigrant men lured American girls into prostitution or white slavery.
The committees believed that no girl would enter prostitution unless drugged or held captive.
This led to public outrage, which eventually resulted in the enactment of the man act.
So here's the thing.
Now, does every pimp get charged with the man act, guys?
No, because a lot of the times they're able to establish that the girls wanted to be prostitutes, which is why human trafficking is very difficult to prove, guys.

However, it's easy to prove human trafficking if the girl is underage, okay?
