So we're gonna go ahead, guys, and introduce you guys to who R. Kelly is.
You know, some of you guys may not know who this guy is.
He's probably before a lot of your guys' time.
So uh yeah.
So we got uh here, here he is.
Robert Sylvester Kelly, born January 8th, 1967, is an American singer, songwriter, record producer, and convicted sex offender.
As a recording artist, Kelly was credited with helping to redefine RB and hip hop, earning nicknames such as the King of RB, the King of Pop Soul, and the Pied Piper of RB, which is kind of funny because you know they would use the Pied Piper to refer to him getting girls that are young.
Uh he is known for his extensive disography of hits spanning three decades.
He sold over 75 million records worldwide, which made him the most successful male RB artist of the 90s and one of the world's best-selling music artists.
He won three Grammy Awards for his song I Believe I Can Fly.
He was written, he has written, produced, and remixed songs, singles, and albums for several artists, including Michael Jackson's You Are Not Alone, for which he was nominated for a Grammy.
Throughout his career, Kelly has been repeatedly accused of sexual abuse with young adults and minors.
He faced multiple civil suits and was indicted by criminal courts in Chicago, New York, Illinois, and Minnesota.
He repeatedly denied the charges in 1994.
He illegally married his underage protege, Aaliyah in 2002.
He was indicted, but eventually acquitted on 21 counts of making child pornography.
So I know you guys are probably wondering.

Okay, Aliah Dana Hutton, uh, or Hawton, uh, known uh monominously as Aaliyah, was an American singer, actress, dancer, and model.
She has been credited for helping to redefine contemporary RB hip hop and hip-hop, earning her the nickname as the princess of RB and Queen of Urban Pop.
Um, born in Brooklyn but raised in Detroit, she first gained recognition at the age of 10.
When she appeared on the television show Star Search and performed in concert alongside Gladys Knight at the age of 12, Aaliyah signed with Drive Records and her uncle Barry Hankerson's back uh Blackground Records.
And that's when she met R. Kelly, guys, when she was 12.
Hankerson introduced her to R. Kelly, who became her mentor as well as lead songwriter and producer of her debut album, Age ain't nothing but a number.
Oh man, that did not that aged perfectly, I guess, in a terrible way, right?
Like, holy shit.

Um the album sold three million copies in the United States and was certified double platinum by the recording industry associates R IAA after allegations of an illegal marriage with R. Kelly, Aliyah ended her contract with Jive and signed with Atlantic Records.
And this guy is the marriage certificate right here that everyone is talking about.
Um I'm gonna share a screen with y'all real fast.

Um you can see her Mare's license greetings uh to any person legally authorized to solemnize a marriage, September 6, 1994.
Robert S. Kelly of Chicago and the county of Cook and the state of Illinois of the age of 27 and Aaliyah D. Hawton of Chicago and the county of Cook and the age of Illinois of the age of 18 years old.
When in reality, guys, when this happened in 94, I think she was actually 15, if I'm not mistaken.
She was born uh 1979.
1979, my math sucks.
I think she was 15, but uh yeah, 1994 minus 1979.

I failed algebra a bunch of times 15.
I was right.
I was right there with you.

Um, you know, and Aaliyah, you know, is a legend also in the RB space, guys.
Um, but she passed away in 2001, and I remember it was an airplane crash.
I remember when the news broke uh back then.
I was 11 back then.
So um anyway, um, so anyway, let's go back to R. Kelly.
Uh where were we?
So yeah, this is the man that was the marriage certificate.
Not a good look for him getting married to her.
Okay.
So in January 2019, a lifetime television docuseries, Surviving R. Kelly, helped resurface the scandal under pressure from the Mute R. Kelly movement, RCA records terminated Kelly's contract with that label.
In 2019, several jurisdictions built criminal cases against Kelly, and grand jury's brought indictments in both federal and state courts.
And for some of you guys that are wondering, this is the this is the documentary that they're talking about.
Um right here, Surviving R. Kelly.
Um, oh, hold on, my bad.
Let me share a screen with y'all.
This is it right here, Surviving R. Kelly in this documentary series on the tangled history of allegations against musician, R. Kelly women give detailed accounts of sexual and mental abuse.
Now, I'm gonna reserve my thoughts on this documentary uh to the end, and we'll go over the facts.
Um, but there um there's there's there's some things here that we could definitely discuss when it comes to this documentary because I did watch some of it.
Uh Denise, you watched the whole thing, right?
What was your what was your take on it?
Well, my take on it is um because you watched it, you watched all the episodes, right?
Yeah, he he yes, he did um he did try to get with a lot of minors, but he Also was with a lot of women of age.
Um, it was just all about from what I've seen is uh all about how much he can control them.
So I feel that if he was able to control my conclusion is if he was able to control somebody and they were able to listen to him and do what he said.
Um that was his like girlfriend.
He always had more than one.
Um I think he owned like two houses.
Okay.
Uh and in each house he always had like girls in in their own room.
And apparently it's from what these women are saying, it sounds like he was really mean.
Okay.
Like he deprived them of food, deprived them of goddamn.
Yeah.
Yeah, I saw some of that.
I was like, holy shit.
And and he obviously denied all these allegations, guys that he was like denying girls of food and everything else like that, or telling them when they can piss and all the other stuff.
It's it's it's a little sensationalized.
We don't know uh if it's you know if it's 100%.
But there's a bunch of witnesses, man.
So it it looks like you know, when you have 40 plus witnesses all giving a very similar story, corroborating each other.
Uh, you know, it's very difficult to to defeat that, you know, being objective here.
Um, but I'll give my personal opinion at the end.
Okay, so um, so let's continue on.
Uh under pressure from okay, so in two in 2021, uh the United States attorney of the Eastern District of New York tried and won the first criminal conviction against Kelly for a sex offense with the jury finding Kelly guilty on a total of nine criminal counts, including violations of the man act and racketeering on June 29, 2022, Kelly was sentenced to 30 years in prison.
Kelly continues to challenge his New York conviction.
He actually sued them as well because they put him on uh suicide watch.
Um and he's suing them for doing that.
Um as of June 22, Kelly is scheduled to face another federal trial in a northern district of Illinois alongside his former employees.
The indictment alleges Kelly both produced child sexual abuse material and conspired with employees to corruptly win his 2008 acquittal.
The trial is scheduled to begin August 15th, 2022.
So R. Kelly.
Talk about a fall from grace, my friends.
Uh, you he went from one of the best RB.
I remember back when they used to call him the king of RB.
I remember when he had the hits, you know, ignition hotel in the night.
He dominated the 90s.
You know, I remember vividly um watching Space Jam as a kid.
Uh back in, you know, I think Space Jam, when did it come out?
Like 94, 95 or something like that.
Yeah.
Um still a classic.
And that was that was the the like lead soundtrack.

Uh 2020, the original 96.
Okay.
And I remember uh that being like one of the lead songs on there.
Um, and you know, and this is back when like movie soundtracks actually mattered.
But nowadays, like movie soundtracks, no one gives a fuck.
Like it's like, okay, you your song was featured in the movie.
Who gives a shit?
Yeah, because I remember they used to sell soundtrack albums.
You remember those days?
Yeah, no, and in McDonald's, they had the cups, everything with Space Job.
It was like really big deal.
Yeah, it was it was huge, you know what I mean?
And you get the little toy and all that other stuff.
Remember, got the Tasmanian Devil.
Because in 96, I was six, guys.
I was still living in New York City back then.
So yeah, I remember that was like the lead thing.
But yeah, you know, soundtracks nowadays don't don't mean shit.
You know, it used to be a thing back then, like having your song on a big movie as a soundtrack, but you know, times have changed, record record labels have changed, selling music has changed.
Um, you know, nowadays, like if you didn't go platinum back then with discs, they looked at you like you were a bum.
You know what I mean?
Like you weren't like a top-tier artist.
Nowadays, you can it's normal to like sell 10, 20, 30,000 units, and it's like wild to me.
So I mean, um the record the um the record industry has changed significantly.
Um but yeah, anyway, that's basic j for y'all.
So I've hit some of these chats real quick before we get into the the criminal case here.

Um, but I it didn't it didn't work.
That uh they were able to convict him.

And then Kelly pays off Tiffany Hawkins, one of the people that testified against him, who alleges the singer engaged in a three-year sexual relationship with her in 1991.
When she was 15 and you was 24.

Kelly once again settles out of court with former Epics Records intern, Tracy Sampson, another person that came forward as a witness.
You accused him of sexual beginning a sexual relationship with her when she was 17.
And then February 2002, as Kelly prepares to for perform at the winter Olympics, the Chicago uh Sun Times reports on a video sent to them, allegedly showing Kelly engaging in sex, urinating on an underage girl.
And that's where all the jokes come from with I'm gonna pee on you.

Um, so 2002, Kelly pays an undisclosed amount to Patrice Jones, who claims the singer impregnated her when she was 16, who claims to be the singer, forced her to have an abortion.

You know, Kelly again settles out of court with a woman who accuses a singer of filming her during sex without her consent.

So I don't know why he's saying that, trying to say, you know, people assume that you're guilty when you settle.

They're gonna retry him August 15th for that in Chicago federally now.
Now that presents the potential issue of double jeopardy, which I'm gonna play here.
This attorney kind of breaks it down pretty well.
Now, what is double jeopardy, guys?
Double jeopardy is essentially you can't be um tried for the same crime twice.
So the state charged him with possession of child pornography, failed, he was acquitted.
Now the feds have pretty much taken the case, and now they're going to charge him with the same thing.
So his defense might be able to actually um present something here to get him off on these charges uh on a double jeopardy defense.
So let's go ahead and see um what this attorney has to say.
Reaction to this, are you surprised?
I'm not at all surprised.
Uh these were these were very heavy sentences.
But this is this has been a bad two days for the rich and famous Miss Maxwell yesterday and R. Kelly today are both in effect sentences.
Yes, Ghlaine Maxwell got 20 years, guys, and R. Kelly got 30 years.
Sentence to life in prison.
And uh this the size of uh R. Kelly's uh sentence, which exceeded the amount that the government was demanding, didn't really come as a surprise to me, given the fact that he unusually enough, he was convicted of uh violations of the racketeering statute, what we commonly call the RICO statute, which is and you guys, you guys have been watching me for a while now.
You pretty much know where Rico is.
Rico is an effective way to target criminal organizations and charge everyone under the same umbrella.
You get stiffer sentence sentencing, you get stiffer penalties, and um it's easier to charge.
And on top of that, a lot of the times um you you're able to beat the statute of limitations.
Why?
Because if you're able to show, because you guys can see a lot of these crimes happened 20, 30 years ago, but they're able to bring it back and attack and uh charge him because under racketeering, all they need to show is that there's a pattern of criminal activity occurring over a period of time, and then bam, they can get over the statute of limitations.
There is uh enormous penalties, so it was no surprise to me.
So, Paul, as you pointed out, prosecution uh prosecutors were asking for uh 25 years, the judge issued a higher sentence than that.
Why do you think that the prosecution didn't ask for a higher sentence, considering what you said, and how often does that happen that the judge exceeds the prosecution's recommendations?
Uh it it does happen fairly frequently.
You have to remember that judges sit there through the entire trial.
They are except for rule.
And just so you guys know, the reason why he got 30 years is because he didn't plead guilty.
He went to trial, guys.
When you go to trial, all right, what's gonna happen is the the government and I can tell you guys this from personal experience nobody else on YouTube could tell y'all this I've prepared for a federal criminal trial before okay and I'll break this case down for y'all but long story short I had a case one time where we caught this human smuggler he got caught uh smuggling a bunch of aliens into the United States and he put the aliens in in danger and he was facing quite a bit of time and this was like his third time getting arrested for this offense so he said fuck it I'm going to trial so he goes to trial right if he had
just pled guilty he would have got significantly less less time because he would have got a plea bargain and most cases guys especially in the federal system are pretty much settled through a plea bargain where the guy says all right I'll plead guilty I'll give a statement of my guilt and in exchange for the government not having to waste time and money preparing for trial I will get a lesser sentence this guy decided to go to trial.
Let me tell you guys what happens when you go to fucking trial as the case agent you essentially become the prosecutor's bitch.
All right I'm gonna say it I'll give fuck it is the truth once you go to trial it's your job to gather all the evidence gather all the witnesses corral everyone up get all the agents that were involved in search warrants whatever it may be you're gonna go and get them all ready and bring them to U.S. attorney's office have the attorney you know prep everyone up you know have all the documents ready help them with discover all that stuff okay you have to arm the prosecutor with everything they need to win the trial okay because when you go to trial
all right now you have to prove in front of a jury through due process and everything else like that that this person is not just guilty but they're they're guilty beyond a reasonable doubt which is a very high burden to prove okay so when you're there you're responsible for making sure that AUSA has everything they need because remember guys AUSAs don't really have arrest authority like that.
You know they're considered a law enforcement officer of the United States to a degree but they don't really go out and interview people and gather witnesses that's the agent's job so you have to go do that stuff.
So the fact that uh Kelly right R. Kelly went to trial they had to prepare 30 years worth of evidence against him and then on top of that he never admitted to any of the crimes he never gave an apology he denied everything so the government looks at it like okay you're not gonna admit guilt you're not gonna plea bargain you're gonna make us go through the process of trial and proving you wrong well guess what now you're gonna feel the full force of the U.S. government and you're going to go ahead and get as much time as possible that is

Judges do have, even in the federal courts, much more so in the state courts, judges do have discretion to exceed what we call the sentencing guidelines.
And this particular judge is not known as a harsh sentencer, but she's a very attentive judge.
And she must have formed some very distinct reactions to this.
And the government had like 40 witnesses against them, guys.
It was pretty bad.
which is why it's very difficult to believe him you know Kelly's demeanor uh his constant substitution of lawyers I think that tended to cut against him and but again okay why would that cut against him because any time the defendant goes ahead and gets other attorneys or whatever, it pushes the entire judicial process back, guys.
Okay.
So he's delaying, right?
Due process.
And obviously, to keep a case going and prepare for trial and everything else like that, guys, it costs money.
You got to fly these witnesses like it's a logistical nightmare, guys, from the case agent perspective and the U.S. attorney's office perspective to have a case like this where you got to fly in 40 plus def um witnesses who are all over the fucking uh country, maybe the world.
You got to put them up in hotels, you got to pay for their food.
It's extremely labor intensive to do this.
Okay, you got to protect them, all this stuff.
So it is not easy to go to trial.
And then with someone like R. Kelly, where this is going to get a lot of media attention, it becomes an even bigger spectacle.
Okay.
So they got to pay um the Federal Protective Services quite a bit of money.
The Marshals are on high alert because when it you have a big case like this, it's very expensive to uh to fund it.
Again, the the the basic principle would be that she she, the judge in the Kelly case, was applying that driving force of the racketeering statute, which was not an ailment in Ms. Maxwell sentencing yesterday.
Well, Kelly.
Yes, and that is why for all you guys that are saying, yo, America's racist or whatever.
Why did Ghlain Maxwell get less time than R. Kelly?
The reason why she got less time, guys, is because with R. Kelly, they got him under Rico, guys.
When you go under Rico, you're is gonna be a very bad time for you, my friends.
This is the law.
The RICO law statute, guys, is the same law that's put pretty much the entire Locosa Nostra Mafia, blood gangs, um Casanova 6'9, uh the mafia, uh, a lot of these gangs that you guys are seeing getting like uh sweeping indictments on, these are all Rico cases.
Rico does not fuck around, they're extremely difficult to do from the case agent perspective to get them approved.
You got to get it approved through U.S. Department of Justice.
But once you get it approved, man, you're going to serve a lot of time if they convict you of it.
He has replaced his legal team since he was convicted.
He is now represented by the same attorney who helped get Bill Cosby's conviction overturned.
What does that suggest, Paul?
Yeah, Bill Cosby's attorney.
Well, this strategy seems to be all over the place.
If you look at the uh docket sheet, which is publicly available, Kelly has uh substituted attorneys with great frequency.
He has a right to do that.
Uh he does uh certainly if he's if he believes that by bringing in new lawyers at this late date, before just before the sentencing, he's uh throwing a Hail Mary pass because the record is already set.
The sentencing memoranda of both sides were already submitted, and the judge had probably already made her decision.
Certainly, Kelly is going to appeal.
Certainly, Ms. Maxwell will appeal.
Uh, but the the unfortunate part for both of them is that uh convictions in federal court are very infrequently reversed.
And speaking of federal court, Paul Kelly is true, very rare.
Feds don't lose Chicago for child pornography.
Okay, so this is the second case that I told you guys.
So he got he got convicted in New York City, right?
In Brooklyn, and this courthouse actually, guys, that's the courthouse in Brooklyn.
I've been there before.
I arrested someone one time.
Um I arrested him in in New York.
I arrested him in LaGuardia Airport.
And I'm gonna break this case down.
I got some footage for y'all too that I'll show you guys.
It was really cool.
But um, when you arrest him in LaGuardia Airport, that falls into the Eastern District of New York, and um I went ahead and took him to court.
We indicted him out of Miami, but he was in the guardia trying to flee the country.
We caught him at the airport right at the terminal.
And um, obviously, when you arrest him, you have to bring him in front of a judge within uh 24 to 72 hours.
Uh so I actually took him to this courthouse right here in Brooklyn.
It's right by the Brooklyn Bridge, it's a very nice area.
Um, and I and I presented him for in front of the judge to get his charges right to him.
So uh this is a nice courthouse here.
I've been here myself.
And obstruction charges there now.

So another district indicted him for child pornography out there.
It's expected to start in August.
Is today's sentencing going to impact that trial at all?
Uh it's it's an open question to me for quite frankly, Tanya.
And I don't want to get overly technical.
Kelly was acquitted.
But the answer is no, it's can't affect him.
You cannot use other charges from another district against him as evidence.
So the answer to that is no.
But he's gonna get into uh what his defense team should do.
Remember, this guy's a defense attorney, so he just you know that my man just dodged that question like a fucking ninja.
By a state court on the charges for which he is now going to be tried in the federal court in Illinois.
So number one, I would have the issue as his lawyer of whether or not he was facing double jeopardy.
In fact, being tried, tried twice for the same offense.
And it it it may well be that given given the sentence here in New York against Kelly, uh the sent the proceeding in federal court in Illinois in Chicago, may well disappear.
Uh I'm not making that prediction, but that does often happen.
Interesting.
Back um on Yeah, I'm actually very um intrigued as to how they were able to put this case against him as well, knowing that he beat um the case in Illinois.
But there are rumors that he paid off jurors and all this other stuff.
So if that was the case, um they might be able to bring those charges against against him.
The um situation and stuff like that.
Does R. Kelly have a route for an appeal?
Do you see a basis for that given the facts of the case?
Well, he has he actually has uh I'll I'll put aside the the pornographic element of all of this, which is horrendous.
But as a technical matter, and I don't want to, you know, hack in the weeds, uh, I think he may have a stronger basis for an appeal of the racketeering conviction, because essential to establishing a vac the racketeering conviction are a few elements.
But in order to do that, you the you as the government have to show that the victim was damaged in his or her business or property.
And it seems to me from the start, uh a glaring omission here has been the lack of an impact.
Well, I don't doubt the I don't doubt the the suffering of these young women and now grown women.
This is an interesting point that he's about to bring up here, guys.
So let's uh let's brace ourselves for this one.
Also, I gotta stop it so they don't hit hit with any type of copyright from uh CBS.
CBS does a lot of things wrong, but when they interview people like this, this is when it can be a little bit better, because at least like they're bringing in someone that's like an expert and he can give an opinion.
Um, and this guy he's pretty accurate with what he's saying, you know, as defense attorney.
But uh uh significantly omitted from the proof was what were the money damages sustained by uh the victims.
And I don't uh they the Kelly may have a fairly strong argument along those lines, in which case he the the substance And what he means by that, guys is you need to be able to articulate damages that you had.
So, like for example, when they indicted the mafia, right?
And they were able to get them for loan sharking and uh, you know, extortion, all the other stuff, they were able to establish from witnesses and businesses and all these other entities, yo, the mafia ripped me off for $10,000 every month.
I had to pay them an extortion fees, or they were running gambling rackets where they were making this amount of money, Or they were loan sharking me this amount of money, which loan sharking is basically giving you a loan on an extremely high interest rate, you know, maybe 50%, lend you a thousand.
All right, motherfucker, if you don't bring my fucking money by tomorrow, you're gonna be sleeping with the fishes, 50% interest asshole, like some type of shit like that, right?
Um, so it's all tangible because it's related to money.
In this situation, it's a little bit more ambiguous because he's bringing girls in, banging them under the potential, you know, the potential that they'll be his girlfriend or maybe get a record deal or whatever.
It's it's extremely unclear where the damages are with them.
Obviously, there's emotional damage, right?

But it's very difficult to be able to articulate that in a tangible fashion.

That does not mean that the victims did not deal with um with trauma.

Because with the Rico charts, a lot of the times, you need you need to establish damages, and a lot of the time that comes from some type of monetary amount.
That's why it was so easy to go after the mafia, because when they were running a labor rackets and everything else like that, they were able to easily show that the mafia was making this amount of money, they're extorting this amount, they were loan sharking on this amount of interest, this amount of much money, blah, blah, blah, all that other stuff.
Because with the mafia, the money had to be made.
Once the money was made, it would be kicked up to the boss, underboss, all the way up to the top guy.
And it would, there was a money chain, right?
But here with this situation, it's not as clear-cut and defined.
For the government to have another try at establishing that critical element of loss of uh of monetary or financial loss.

The verdict followed six weeks of trial before United States District Judge Ann M. Donnelly.

The reason why, guys, is because the violations involving the coordinated transportation of women and girls in interstate commerce.

And then today's guilty verdict forever brands R. Kelly is a predator who used his fame and fortune to prey on the young, the vulnerable, and the voiceless for his own sexual gratification, stating uh stated acting U.S. attorney Casulis, a predator who used his inner circle to ensnare underage teenage girls and young women and men for decades in a sore did web of sexual abuse, exploitation, and degradation.
Yes, he did actually abuse a man as well, uh uh a boy, allegedly, guys.
Uh, according to the indictment and the trial.
The victims in this case, your voices were heard, and justice was finally served.
We hope that today's verdict brings some measure of comfort and disclosure to the victims.

As a leader of the enterprise, Kelly used his fame to recruit women and girls to engage in illegal sexual activity with him.
Kelly identified these girls and women at concerts and then directed members of the enterprise to escort them backstage following his musical performances.
Kelly exchanged contact information with girls and women so that he and other members of the enterprise could arrange travel and lodging for them to visit Kelly and engage in the charged illegal sexual conduct.

they were not permitted to leave their homes or to uh their rooms to eat or visit the bathroom without receiving his permission they were required to wear baggy clothes when not accompanying Kelly to an event and they were directed to keep their heads down and not look at or speak to other men.
Kelly also isolated the women and girls from their friends and family and made them dependent on him for their financial well-being.
He required the victims to engage in sex with him and others and recorded many of the sexual encounters.

And what I'm going to do is I'm going to pull up this indictment for you guys real fast.
But we're going to read it from the DOJ thing because it outlines a lot clearer.

United States district court eastern district of New York uh you know United States of America against um R. Kelly now the enterprise the defendant Robert Sylvester Kelly also known as R. Kelly and individuals who served as managers bodyguards drivers and personal assistants and runners for Kelly as well as members of Kelly's authorized comprise and enterprise now why the hell are they referring to R. Kelly's organization as an enterprise the reason why they're referring to as an enterprise guys is because this is critical for racketeering statutes remember they're not necessarily just charging him with sex trafficking they're charging him with sex trafficking
under the premise that it's under Rico okay the racketeering act okay the enterprise consisted of ongoing org of uh constitute an ongoing organization whose members function as a continuing unit for a common purpose of achieving the objectives of the enterprise okay the purpose of the enterprise were to promote our Kelly's music and that our Kelly brand and to recruit women and girls to engage in legal sexual activity with Kelly but promoting Kelly R. Kelly's music and the R. Kelly brand the members of the enterprise expected to receive financial opportunities
and personal benefits including increased power and status within the enterprise okay so like I told y'all before he promised he sold these girls a dream and in connection with the enterprise Kelly and other members of the enterprise traveled throughout the United States and abroad to perform at concert venues to promote the R. Kelly brand and to recruit women and girls to engage with in sexual activity with Kelly bam right there is how the feds gotcha bitch got him he was using right the girls and traveling interstate and doing all this extra shit and that's what gave the feds jurisdiction when Kelly attended and
performed at concerts and other events, Kelly and or members of the Enterprise on Kelly's behalf invited women and girls backstage and to other events following Kelly's live performances.

These women and girls were often offered wristbands that signified that they were authorized to attend an event.
There, Kelly relied upon members of the Enterprise to ensure that only those authorized to attend were allowed at the event and to manage the flow of women and girls who were directly interacting with Kelly.
When Kelly identified a woman or a girl who he wished to see again, He either gave his contact information to the woman or girl or obtained her contact information or relied upon members of the enterprise to do so following these events Kelly communicated with certain uh with certain of these women and girls by telephone including the use of traditional telephone calls text messages eye messages and face time as part of this communication Kelly often requested that the girls that the women girls provide him with photographs of themselves.
Okay.
Again, guys, when you use phones, text messages, FaceTime, all that stuff.
What does it do?
It triggers interstate commerce.
Gotcha, bitch.
Kelly and other members of the enterprise also arranged for the women and girls to travel to see Kelly on occasion, including at concerts throughout the United States and related events.
To facilitate their travel, Kelly directed the women and girls to contact a member of the enterprise who then arranged for travel for the women and girls.
When the women and girls arrived at the lodging, which was typically selected by a member of the enterprise, a member of the enterprise usually provided them with instructions.
In addition, members of the enterprise took steps to ensure that the women and girls did not interact with other women and girls whom Kelly planned to see.
So guys, let's also deal with this elephant in the room.
A big part of the reason why a lot of these people cooperated with the government was to not be prosecuted themselves for assisting R. Kelly in doing these criminal activities.

So they cooperated with the government to avoid prosecution as well.
You know, we got to call a spade a fucking spade.
Members of the Enterprise then arranged for the women and girls to attend this concerts and position them such that Kelly could see them during his concerts.
Kelly prom uh and and you guys are wondering, well, why are they putting all this stuff in this indictment?
The reason, guys, is because they're establishing that it's an enterprise step one, and then step two, that the enterprise affects interstate commerce.
That's why they're talking about using phones.
That's why they're talking about travel.
That's why they're talking about him providing them lodging.
That's why they're talking about members of the enterprise giving them instructions.
All this, okay, creates a picture that we have a sophisticated criminal organization that is committing committing criminal activity while simultaneously, okay, affecting interstate commerce, which now gives the feds jurisdiction.
So the beginning part of this indictment is giving the feds venue.

Um in addition, members of the enterprise took steps to ensure that the women and girls deny interact with other members women and girls whom Kelly planned to see.
Members of the enterprise then arranged for the women and girls to attend his concert and position them such that Kelly could see them during his concert.

This is very important, okay, guys, because the girls all gave very similar testimonies and stories, even though they don't necessarily know each other, which actually made Kelly look a lot more guilty.
Because if you got a bunch of girls from different places and they're all giving a very similar story, right?
Hey, I wasn't permitted to eat at this time, or he made me call him daddy, or he made me do this, or whatever.
And a bunch of girls are able to corroborate the same set of facts without knowing each other.
What does that do?
That, my friends, is a clue that more than likely your witnesses are telling the truth.
When I had a confidential informants, right?
You can't necessarily go off of a confidential informant's word alone.
You need to be able to corroborate it.
So what I would do, right?
When I was in witnesses, cooperating defendants, um, confidential informants, they're all the same because they're providing you information.
Okay.
However, when you're getting this information, you have to be able to corroborate it through other people.
So it would be common where I would interview a confidential informant, I would debrief him.
Then after I debrief him, I would talk with law enforcement officers, I would talk with other witnesses, I would talk with um uh the the criminal himself sometimes, etc.
And they would confirm certain things that the informant would say or other witnesses would say.
And what you do is you extrapolate, okay, the truth from all these separate interviews from separate people that don't necessarily know each other.
Okay.
That is how you build credibility in witnesses, informants, and cooperating defendants.
You never get the story just from them.
You get the story from multiple people, and if they're able to confirm certain facts, okay, that all of them experienced or saw themselves.
That adds another layer of credibility to that person's testimony.

Kelly, of course, Jane Doe number two, Jane Doe number four, Jane Doe number five to engage in sexual explicit conduct for the purpose of producing video recordings over the course of decades.
He made these recordings and other recordings of sexually explicit conduct using VHS video cameras, canon camp quarters, iPhones, and iPads.

So these three witnesses right here, Jane 4, 5, and 6 are probably the government's best witnesses.
Um is probably what it looks like to me because I'm trying to noticing a trend here that a bunch that they're in a couple of the different counts.
Uh as a Jane Doe number four, he slapped her, choked her, and spit on her before demanding she give him oral sex.
As a Jane Doe number five, over a period of years he spanked her, viciously assaulted her, confined her for periods of days, and otherwise manipulated her to ensure that she would perform for him sexually, including with other women and a man.
As to Jane Doe number six, he forced her to give him oral sex.
When he did that, there was a gun within Kelly's reach.

Between May 2009 and January 2010, Kelly regularly spoke with Jane Doe number four over the telephone to arrange for Jane Doe number four to come to his residence in Olympia Fields for the purpose of illegal sexual activity, which was illegal because Jane Doe 4 was too young to consent to sex in Illinois.

Uh similarly, between September 2015 and October 2015, Kelly transported Jane Doe number five, who was then 17 years old from New York City to Oakland, California for the purpose of illegal sexual activity, and she was too young to consent to sex in California.

So it was passed in uh June 1910 and named after Illinois Congressman James R. Mann invoked in the Commerce Clause to felonize the use of interstate or foreign commerce to transport women for immoral purposes.
The act was aimed at prostitution immorality and human trafficking.
Congress appointed a commission of in 1907 to investigate into the problem of immigrant prostitutes.
It was alleged that immigrant women were brought to America for sexual slavery and immigrant women lured American girls into prostitution or white slavery.
The committees believed that no girl would enter prostitution unless drugged or held captive.
This led to public outrage, which eventually resulted in the enactment of the man act.
So here's the thing.
Now, does every pimp get charged with the man act guys?
No, because a lot of the times they're able to establish that the girls wanted to be prostitutes, which is why human trafficking is very difficult to prove, guys.

Then they also got him with Man Act Transportation Joe Jane Doe 5, which is one of them, okay, which happened on October 30th, 2015.
Um, and that was 18 USC 242.
All right, and here's the judge right here signing the judgments, all right.
Um, and then these are all the charges that they hit him, and additional counts of conviction, man act coercion and enticement, uh man act coercion of a minor, uh, man act transportation of a minor, man act transportation, Jane Doe Six, Man Act coercion and enticement, man act transportation, man, man act uh coercion enticement.
If you guys look here, um, these were all fairly recent these charges.
So, why were they able to bring up all these old things from the 90s?
Well, like I told you guys before, they were able to establish that there was a pattern of racketeering activity for 30 Years.
Okay, so that's how they're able to get around statute limitations and use uh older shit to show a pattern of activity.
So um the defendant is hereby committed to the custody of the Federal Bureau of Prisons to be imprisoned for a total term of 360 months on count one, 10 years on counts two, six, and eight, twenty years, and on counts three, four, five, seven, and nine and nine, all counts to run concurrently, okay.
Which luckily for him, it's uh concurrently, which means they all run at the same time.
Otherwise, he would have had to have way more time.
So these are the standards and conditions of supervision, okay?
Because you can get five years, special conditions of supervision, criminal monetary penalties.
He's got to pay 100,000 in restitution or a fine, sorry, 100,000 in fines, okay.
