Alright, welcome everyone to this special Brighteon.com interview.
It's audio only, no cameras today, because we have a very important guest with a breaking news update.
I'm Mike Adams, of course, founder of Brighteon.com.
I've been a fan for many years, and so have you probably, of Brian Festa at WeThePatriotsUSA.org.
And Brian Festa, who is just a powerhouse of legal action to defend liberty and freedom for Americans and people all over the world in different ways.
He joins us now with an update.
Welcome, Brian Festa.
It's an honor to have you on today.
Hi, Mike.
It's an honor to be here, as always.
And yes, yesterday we had a huge filing.
I'm not sure exactly when this will be put out.
So yesterday was Thursday, December 19th.
We had a very big legal filing that we were anticipating for a while now, and it finally dropped.
That was Mirella Ramirez, an Oakland, California, kindergarten teacher that we are defending because she was fired from her job for refusing to use preferred pronouns in the classroom.
Now, this is kindergarten, Mike.
We're talking about five and six-year-olds.
Okay, five and six-year-olds.
She's told her five-year-old female student she has to start now referring to as a boy.
And she says, no.
She said, listen, I'm Catholic.
It's against my religion.
I'm a devout Catholic.
It violates the Christian faith to be participating in any way in gender transition.
And you are participating.
Because if you're referring to a girl as a boy, you're affirming that.
You're acknowledging that that is true.
And that's absolutely a violation.
I agree with her, but that's absolutely a violation of the Christian faith and Catholic faith.
And really, most world religions that I can think of, it's a violation of.
Right, and it also forces the teacher to play along with what I would consider to be a child's mental illness.
Which will lead to long-term consequences of mental illness typically associated with things like suicide, self-harm, or violence against others.
So why should a teacher be forced to go along with a child's mental illness?
We're right.
And you know what?
At five years old, I'm not even going to call it a mental illness.
Because at five years old, boys can think they're going to turn into girls and girls think they're going to turn into boys.
They don't know the difference.
Their brains aren't anywhere close to being developed.
When teenagers, young adults, yes, I definitely start referring to that as mental illness.
But five-year-olds, I mean, they think, oh, I can be, I'm going to pretend to be a doggie today.
You know what I mean?
Right, right.
I'm a unicorn and I have imaginary friends.
Yeah.
They don't even know what's going on.
They can't consent to anything adult.
We don't let children consent to things like sex, alcohol use, any kind of smoking, anything like that.
Obviously, we don't do that.
Why don't we do that?
Because children can't consent.
They don't have a developed brain enough.
And now, actually, we know from science that your brain isn't fully developed, actually, until age 25. So you're talking about a five-year-old child that in any other circumstance we say they can't consent to adult things, but we're going to say they can consent to gender transition and gender mutilation surgery and hormone therapy.
Psychiatrists involved.
We are absolutely at the ready to defend you.
But this case isn't even really about transgenderism and whether we agree with it or not.
That's not what this case is about.
This case is about free speech and religious freedom.
Yes.
Because Morella had the right to refuse.
The Oakland, California...
Big surprise, right?
The Oakland, California public schools is a state actor, is a government actor.
And they're therefore bound by everything in the Constitution, including the Bill of Rights, which includes, of course, the First Amendment.
And they compelled Morella's speech.
They said, you have to say these things in the classroom.
By the way, not for nothing, but it was a dual immersion classroom.
So it means it was English and Spanish because Morella is Hispanic.
She was teaching kids both English and Spanish.
So in Spanish, it's not just proper names that have to be genderized, I should say, whatever the word is for it.
I'm not a linguist, but you have to assign gender to nouns, even.
Yeah, so it gets very confusing now if everything, because when something is possessive of that person, you have to refer to it also using those gender-specific suffixes and whatnot and prefixes.
So it gets very, very confusing now, but that's a side issue.
The main issue was she said, I'm not I'm not going to start referring to her by a different proper name.
I'm not going to give her the pass to the boy's bathroom, which was an issue as well that came up during her disciplinary proceedings, is that, you know, the girl wanted to use the boy's bathroom.
And obviously Morell is against that as well.
So there's a whole host.
It's a 30-page complaint.
There was a very long story here, but the long story short is they refused to accommodate her.
She would have been willing to work with the district to accommodate her religious beliefs, but every accommodation they offered her was something that would have still violated her religious beliefs because it still, in some way, required her to You know, affirm that this child was transitioning and the government just can't do that.
The government is not allowed to do that.
Yeah, and you said something.
I mean, this is extraordinary.
I'm so glad that you have filed this and I really want to encourage people to support you.
Because your organization, it lives off donations.

But you said something really important.
You said that the state compelled her speech.
So this isn't simply about censorship, where you're not allowed to say something.
This is requiring...
A person to speak in a certain way in order to appease the requirements of the state, which are contradictory to both the teacher's religious beliefs, but also contradictory to biological facts and reality.
So that is especially disturbing that it is now compelled speech, because obviously it brings up the question, what else could the state command someone to say, right?
Right.
I mean, that's what's very scary about it.
Censorship is equally scary, but it's very scary when the government says you have to say certain words a certain way even.
Think about it the other way, because I was asked in the last interview I did on this topic, I was asked about What would you say to all the people on the other side who say, oh, you just hate trans people?
You know, all the people on, obviously, the progressive left, you just hate trans people, you're, you know, homophobe, whatever they say.
You know, they lump everything into one category and into one bucket.
I would say, how would you feel if the government told you to say things that you disagreed with, such as maybe you don't agree with a lot of Christian beliefs?
You don't agree with so-called conservative beliefs.
What if you worked for a school and you were a teacher and they said you had to teach those things to the children in your class.
You had to start teaching them Christian theology and things like that.
Would you want the right to oppose that and to reject that?
It's the same thing here.
So...
Everyone who opposes this and thinks that we're hate mongers or whatever you're going to call us, stop and think for a moment what this case is really about.
There's nothing in there, by the way, that says we hate trans people.
There's no hate speech in that lawsuit.
It's all about free speech and your right to be free from compulsory speech at the hands of government actors.
That's something everybody would be behind.
So, exactly.
But let me demonstrate this, right?
So, suppose it were flipped around.
Suppose that America—suppose that a Christian authoritarian overlay swept across America, and the state of California commanded all its teachers to refer to children as child of Jesus— Right?
Like, hello Mary, child of Jesus.
Like, if the state compelled the teacher to do that, you and I both would still oppose that.
For the same reasons, right?
Absolutely.
No one can be compelled, even if it's something that I agree with.
Yeah, exactly.
Right.
Even if it's something that I personally agree with myself as a Christian and a Catholic as well, even if it's something that aligns with my faith, I would still file a lawsuit on behalf of a teacher who didn't want to be compelled to have to say certain things in the classroom because that's what this is about.
Right.
It's not just a classroom.
It's anywhere.
Even if you don't work for the government, if you're just in the public square, if you're just, you know, standing on your soapbox in the public square and you want to be able to say certain things, you're first amount right.
You have a right to do that.
You're not disturbing the peace.
You're not, you know, blasting loud music at midnight or something.
You know, you're just making statements like you should be allowed to, right?
Yeah.
If the government told you you're not allowed to, or said, you have to say certain things.
Okay, you can exercise your First Amendment rights, but you also have to say this.
Here's some note cards.
You have to say this when you get out there in the public square.
They could literally, if this is allowed to stand, there will be precedent that the government would be allowed to do this.
Now, I'm not afraid of that, because I... I feel very strongly the Supreme Court would never make such a ruling, would never say the government is the right to compel, because all of the jurisprudence up to now has consistently said the government cannot compel that kind of speech.
So I'm not worried about that.
But my point is, if we get this precedent, what it will do is it will empower teachers who are the first line of defense in our classrooms.
So what you will with public school, many of the people that follow us, I think that, you know, you should even have your kids in public school and I can see that point of view.
Some people really don't have a choice or feel they don't have a choice or for whatever reason they want their kids in certain public schools.
The point is they should have the choice and have their kids free from dangerous indoctrination and the teachers are the first line of defense.
So the majority of teachers, I believe, in the United States of America do not support gender transition of children.
Yes.
But they're too afraid to speak out because they'll lose their jobs.
But if we have a precedent now, either from the Ninth Circuit, which is the largest circuit court in the United States that has the widest jurisdiction, or the Supreme Court of the United States, even better, that says teachers are protected if they want to refuse to implement that curriculum in their classroom, if they want to refuse to speak certain words Then they'll be empowered.
You'll have all these teachers now in all 50 states fighting back and saying, I'm not going to do it.
I'm protected by the Supreme Court's decision in, you know, Ramirez versus Oakland Public School District.
And can you imagine that?
You now have precedent in the books that no teacher has to implement something that violates their religious beliefs.
That would include, by the way, certain CRT curriculum, DEI, LGBTQ. I mean, the list goes on and on.
Because if we have a precedent that says teachers don't have to implement it if it violates their religious beliefs, that can apply very broadly.
And now we have teachers standing up and fighting back where the parents aren't.
Because remember, these people are alone with your kids for seven hours a day.
The parents can stay at school board meetings, but that's not as good as having teachers fighting back.
But importantly also, you're not saying that this teacher has a problem with the curriculum or the teaching materials.
In my opinion, this is part of the curriculum, though.
This is part of...
Because they are trying to teach these kids.
Mike, when you're in a classroom, if my child is in a classroom next to other children, and you're standing up there and calling Sally...
Now, Michael.
I'm going to call Sally Michael now.
And all the kids see that and say, you have to call Sally Michael too.
Okay, so everyone in the classroom now has to use male pronouns and preferred pronouns and proper names to refer to this child.
You have now taught a lesson.
You have taught the children now.
True, true.
And that's a form of religion, because what you're teaching them is an opposite, a directly opposite religious belief from my own religious belief that I'm teaching my child that's in that classroom, and most other parents probably are teaching their children in that classroom.
But the state is basically, I think it's a state-sponsored religion.
I actually think it's an establishment clause violation as well.
We'll get to that later.
Interesting.
She has an EEOC complaint as well that we filed on behalf of her.
That's not in court yet.
That's a religious discrimination complaint.
And the establishment clause is going to come into play there because you're basically forcing an opposing religious belief on the children, a state-sponsored religious belief.
Okay.
Now, this is just one case of many.
You have gone to battle for so many people who I would say have been wrongfully fired from their jobs or coerced into all sorts of things in hospitals regarding vaccines, regarding employment.
Here we are at the end of 2024, essentially.
Can you just give us just what are the three biggest cases that we, the Patriots USA, has taken on this year, whether or not they've been resolved yet, but just give us a little overview of kind of what you have done this year.
Well, this year and in the past 12 months, I'll say as well, yeah, I mean, even going back into late last year, I guess is what I'm trying to say.
One of the biggest cases we had on your show, actually, it was highlighted twice on your show, was the Guidry case from Missouri.
Oh, yeah.
Which was very dear to your heart because you have a connection to Missouri, obviously.
And they had, Paul and Amanda Guidry had their four children medically kidnapped by the state.
alternative medical treatment.
And that case is still ongoing, by the way.
So that's not actually an old case.
Yes, we did win a victory for them and got the children back in the home in 2023.
But that case isn't over yet because now we have new litigation to get them off the child abuse registry.
They never should have been there because they were never convicted of any child abuse or It was just, you know, an accusation by the state of Missouri.
And the children were ripped out of the home, including their youngest, a six-year-old boy with autism, who's nonverbal, and was shipped around to four different foster homes in those six weeks.
But we were racing into court, battling to get him back home.
We got him back home within six weeks, which is lightning speed, actually.
When kids are medically kidnapped, it takes months or even years sometimes to get them back into the custody of their parents.
And we did it in six weeks.
So we'll do that in any state, by the way.
We've already been contacted.
I can't reveal details yet, because we haven't filed anything, and it's not official that we're going to be filing this, but a parent, a mom from Ohio.
So these are two supposedly red or reddish states where this is happening, which makes it even scarier.
A mom from Ohio was reported just because she didn't want to use the formula that the doctor was recommended.
She was doing breastfeeding only for her newborn.
And the doctor made an accusation that the child was malnourished.
He wasn't.
She was under the care of another pediatrician.
She said, well, I'm not going to go to your practice anymore.
Because she didn't show up to her next appointment with that pediatrician, he reported her to the state.
CPS came in, took her child away.
But she was under the care of another pediatrician who was more holistic-minded and supportive of her breastfeeding.
But she said she was desperate.
When the state came out to her door, she said, listen, listen, I'll do what you want.
Fine, I'll give them the formula.
Even though she didn't want to.
She was so scared to lose a baby.
They said, nope, too late for that.
They took the child away.
And so that's another one that we're working on.
Again, I can't release the names yet or everything, but we don't do this in any state.
And medical kidnapping is so important because it's a scourge in America right now.
People don't realize how big and widespread the problem is.
It's happening in every state.
I don't care whether it's a red state, a swing state, a blue state.
It's happening everywhere.
So that's one big case.

So you mentioned one big case there that you worked on in 2024. What are the other couple of cases that come to mind?
Yeah, so another case, the case that's still ongoing right now, and it's related to the other case that was just taken up by the Supreme Court.
They just announced that they're granting review in the TikTok ban lawsuit.
And so we have a lawsuit fighting the TikTok ban as well, and that is with Bobby Kennedy Jr. as one of our co-plaintiffs.
We the Patriots USA is a plaintiff, and Kristen Megan Kelly, you may be familiar with, I think you do know her, from Megan.
I've interviewed her too.
Yeah, yeah.
She also has a pretty big following on TikTok.
And so the three of us together, joined forces, although it was completely funded by We the Patriots USA, and our lead attorney is leading the charge on this, that is a case right now that we are...
We're at the D.C. Court of Appeals.
The other case was filed a little bit before ours, so unfortunately we are not consolidated with that case at the Supreme Court.
We have slightly different legal claims still alleging a violation of the First Amendment.
And I think that's so important, again, for free speech rights, because even if you hate the TikTok platform, even if you think there's a lot of dangerous stuff on there that shouldn't be out there, when the government says, again, this is the opposite of the Murrow Ramirez case in Oakland, right?
When the government says, now you can't say certain things, You can't have a platform because you're sharing too much truth.
You have a social media platform that we love, Brighteon.

There's people on the other side of these issues that don't want you saying the things you're saying.

You have a right to say it.
This is America.
You have a right to share information publicly.
Truth and knowledge is power, and they know that.

And yes, it is important work, but I always say your work is equally important, if not more important.
The reason I say that is because...
Information and, again, sharing the truth is the first step in changing things, in improving our lives, protecting our freedoms in America here, protecting our country.
I mean, what happened?
What's the most famous story that we hear out of the American Revolution, at least for me, that comes to mind, is one if I land, two if I sea.
Yep.
That's right.
I was thinking of that, too.
What was that?
That was the sharing of information.
That was the code, right?
That part of you are riding around telling everybody, when you see those lights, you all know how they're coming, how the British are coming.
And we all learned that, or we should have learned that.
I'm also thinking, how about Thomas Paine?
Common sense, right?
The written word.
Yes, yes, absolutely.
And, well, 100%.
You know, all of these things, we think of all of these writings, when we think of the history of our country, you know, Uncle Tom's Cat, and you can go on and on and on.
You think of all the great treatises that were written throughout the American history, and again, it's It's writing, or it's the spoken word, it's communication that really affects change and saves and builds our nation.
So, you know, if we only have the mainstream media propaganda mouthpiece of the government, which is all it is, if that's all we have, we're in big trouble.
And the founders knew it.
And that's why they wrote this into the very First Amendment of the Bill of Rights.
They said, we better protect free speech.
You know, above all, it's that and religious liberty, of course.
The right assembly, the freedom of the press.
All those things involve communication, though.
Almost all of them.
Religious liberty doesn't necessarily.
But the other ones, they're all involved communication.
Read that First Amendment.
It's almost all about communication, sharing of information.
That's right.
So we need this, and that's why it's so important to have channels like Brighteon and the other ones out there.
Rumble, I know you've had a Rumble channel, too, for a long time.
Yes.
You know, we absolutely need these alternative platforms because, listen, we're still censored.
Meta, Facebook, whatever.
X, Elon's running it, but guess what?
And if he ever hears this, you know, I know it's hard to get his attention for anyone to get his attention, not named Donald Trump.
If Elon's ever listening to this, please help us because my co-founder, Don Jolly, president of We The Patriots USA, she's tried three times now since Elon's been in charge to get an account up and running back on X, and she's been booted each time.
She's banned.
She's still banned.
Even you've been let back on.
Even you have been.
You're one of the most banned people in America.
Well, I'm still shadow banned on X, by the way.
I mean, they throttle my account.
So they still play this game where they let you back on, but then they don't let you have much reach, right?
And they still ban links to Brighttown.com, which is why we sued X. I mean, that lawsuit is pending right now.
And Meta, too, right?
And Meta, and Google, and the Department of Defense, and a bunch of other NGOs, some of which are being shut down now, so I don't know what's going to happen there.
And any time I used to try to share natural news, too, I remember the first time that ever happened to me, I couldn't believe it.
I'd never seen any other website that it did this for.
And I couldn't even put the link in there.
I'm like, not even in the comments.
I said, so we had to put spaces between it and tell people to cut and paste all of your links.
That's ridiculous.
No, but this is what we've all suffered through.
And thanks to organizations like yours, the tide is turning, Brian.
We are pushing back.
The regime lost the election.
It doesn't mean that Trump is perfect or that everything is going to be utopia.
No.
This is the beginning of the opportunity to fight back using the rule of law.
And freedom of speech and the spreading of good ideas.
It's just the beginning, though.
We're going to have to earn this.
We're going to have to take this territory yard by yard, foot by foot here to take back our freedoms, our First Amendment, our Second Amendment, our Fourth and Fifth Amendments.
All of it is just the beginning.
Yes, absolutely.
And you wanted a third lawsuit.
I'll throw the Mirella Ramirez one that we just talked about.
We're doing that, by the way, in conjunction with the great Harmeet Dillon.
She is actually our local counsel in that case.
We're the lead counsel, and our phenomenal attorney Cameron Accenture.
Who's just been nominated by President Trump for a senior position in the Justice Department.
Her firm is our local counsel.
So we've got some heavy hitters in there, you know, from Bobby Kennedy, Harmeet Dillon.
But you know what?
Which was the case that I said I was most proud of in the last year?
It wasn't about any of them.
Not that I don't love them, but it was Paul and Amanda Guidry.
Just average, everyday Americans who had their children taken away by the state and we stood up for them.
That actually is at the top of my list of cases in the last year because it's so vitally important and so many of us are just parents.
Everyone can relate to that, right?
Anyone who's ever had children Having your child stolen from you, and me as a parent of an autistic child as well as vaccine injured, that really hit home for me because I thought of my child.
If they had tried to take him away from me, I mean, I don't even want to tell you what would have happened.
But it was just like, you know, absolutely.
The fact that we got him back home in six weeks and all the children back home, I'm just so proud of that.
And we have to get them off the child abuse registry because that is a crime too, right there, because their reputations are ruined.
When something's online like that, that you were labeled a child abuser by the state, that's not going away.
The state should pay major damages to these people.
Well, absolutely.
And there's so many cases of that.
We've seen the weaponization of government and agencies against the people.
And this has happened at the federal level and the state, and as you've seen also sometimes the county level, right?
This has got to stop.
The pushback is exactly what you're doing.
That's what your organization is all about.
