[00:01:32] As a constitutional scholar and somebody who loves juridical and legislative overreach, I love when legislatures pass a law that they think makes sense and then later on they realize, what have I done? [00:01:47] There was a statute years ago that said it's unlawful to sleep in public. [00:01:51] So that means, what, if you nod off at a bus stop, you're arrested? [00:01:56] There was one that said it's unlawful to loiter or prowl for the purposes of inducing various forms of prohibited sexual behavior, prostitution and the like. === Misrepresentation Matters (05:56) === [00:02:08] To loiter or prowl with the purpose of inducing. [00:02:13] What does that even mean? [00:02:15] And by the way, it was done because there were a bunch of women standing in the corner wearing Daisy Dukes and waving at cars. [00:02:20] And they were going to, what, pass waving? [00:02:22] You can't wave at somebody in order to induce somebody? [00:02:26] It sounds terrific. [00:02:28] I represented a woman one time who was charged with throwing broken glass. [00:02:33] Not throwing a bottle that broke, but throwing broken glass. [00:02:37] You've got to break the glass first and then throw it. [00:02:39] I mean, it's nuts! [00:02:40] Well, let's meet my new favorite person I want to... [00:02:43] Put all my efforts behind him. [00:02:45] Terrell Patel. [00:02:47] Indian American County Commissioner candidate and 30-year-old policy expert Terrell Patel was detained recently by the Texas Rangers on the grounds of, get this, online impersonation and identity misrepresentation. [00:03:03] The Fort Bend County DA's Public Integrity Division put Mr. Patel in the who's gal. [00:03:12] Probing complaints against the Precinct 3 commissioner candidate in collaboration with the Texas Rangers because they said he, as per Texas election code, he violated a case of third degree online impersonation and Class A misrepresentation of identity. [00:03:29] Now, let me just stop right there. [00:03:32] Third degree online misrepresentation? [00:03:36] Let's jump right to it, kids. [00:03:39] Dating sites. [00:03:42] Misrepresentation. [00:03:44] Catfishing. [00:03:46] Misrepresentation. [00:03:47] Putting the wrong picture of you. [00:03:50] Misrepresentation. [00:03:50] Using filters. [00:03:53] Misrepresentation. [00:03:55] I saw a picture recently, not too long ago, somebody used a filter. [00:03:59] I swear to God, this individual must have lost 50 pounds. [00:04:04] 50! [00:04:05] You might say, 50! [00:04:08] I mean, who's that? [00:04:10] That so-and-so. [00:04:11] What? [00:04:12] Now, if I'm trying to put my photo up in order to engage you in some type of amorous activity, is that not misrepresentation? [00:04:23] Isn't the whole purpose of online and advertising lying? [00:04:28] We have the best pizza. [00:04:30] You've tried the rest. [00:04:31] Now try the best. [00:04:32] Is it the best? [00:04:33] Well, they call it in law puffery. [00:04:36] It's all lies. [00:04:38] When Joe Biden walks out and pretends to be lucid, it's a lie. [00:04:43] When people edit and again, filters! [00:04:50] Filters! [00:04:52] The other day, one of the funniest pictures I ever saw was a friend of mine sent me a photo of his wife. [00:05:00] She used filters. [00:05:02] And I don't know what this particular filter application was, but since he was in this kind of like this dual... [00:05:07] A selfie? [00:05:09] He looked Asian! [00:05:11] So I asked my wife, did so-and-so, did he get some work done? [00:05:16] What do you mean? [00:05:16] I said, well, he's a little blepharoplasty or something? [00:05:22] A little epicanthus? [00:05:24] Why? [00:05:25] Well, he's looking... [00:05:26] And it was her filter, but it made him look Asian. [00:05:32] I mean, isn't that misrepresentation? [00:05:37] Everything is misrepresentation. [00:05:39] The internet is misrepresentation. [00:05:41] It's a lie. [00:05:42] And wait until AI comes into this. [00:05:47] We're actually in a world right now, we're in a world where we're actually looking to prosecute people for deep fakes. [00:05:59] Images, pictures that we know are fake. [00:06:02] That nobody confuses them with being authentic. [00:06:04] We know they're fake. [00:06:06] And we want to charge somebody with publishing a fake picture or using somebody's voice. [00:06:13] Whatever happened to impersonation? [00:06:15] Is Rich Little going to be looking at something? [00:06:18] Doing a hard time? [00:06:19] Cracking rocks upstate? [00:06:20] Has anybody ever thought about this? [00:06:23] Has anybody ever really considered the idea of what these great statutes mean and how by its very nature It's very nature. [00:06:37] The internet is fictional, fictive, ersatz, phony, fugazi, synthetic. [00:06:43] It's not real. [00:06:45] It's camouflaged. [00:06:46] It's not real. [00:06:47] Nothing's real. [00:06:49] The promises of these candidates. [00:06:51] So yeah, it's terrible what this guy did. [00:06:54] He set up a fake account and basically said terrible things about himself. [00:07:00] He blasphemed himself. [00:07:02] He libeled himself. [00:07:04] He set up fake, allegedly, internet or social media accounts, to blast him, to make fun of him. [00:07:11] He libeled himself, and we're charging him because it wasn't real. [00:07:16] It wasn't some fake or some anonymous person. [00:07:20] He libeled himself in order to lie to you, along with the other lies of people who run for office. [00:07:28] Now, I know this may have sounded great to the great people of the great state of Texas, but this is the most stupid law I've ever heard in my life! [00:07:35] Because everything that we're doing, everything that is about us, everything that is quintessentially and prototypically and archetypically American is a lie! [00:07:43] Especially when it comes to politics. [00:07:45] It's all mendacity. [00:07:48] It's illusion. [00:07:50] It's the misrepresentation of fact with the intent to deceive. [00:07:54] What do you think?
