[00:06:34] Was this a Fourth Amendment violation? [00:06:35] Well, Scalia, I believe, answered correctly, was a unanimous decision. [00:06:40] But his reasoning was different. [00:06:42] He said it was a violation because they went on the property. [00:06:48] They went on the property, trespassed, in order to put this thing on there. [00:06:55] That's the issue. [00:06:56] That's the issue. [00:06:59] It was fascinating. [00:07:01] But, they kept saying, but wait a minute. [00:07:06] Where was the violation? [00:07:09] Was the violation going onto the property? [00:07:13] Trespassing? [00:07:15] Violating the curtilage area around it to stick this device? [00:07:19] Or, was it the data that was gained? [00:07:22] Where you're going? [00:07:24] And some people then suggested that, well, there's no reasonable expectation of privacy. [00:07:30] I could follow you. [00:07:32] I could follow you behind your car, but this is a tracking device. [00:07:36] At the time, nobody knew what this was. [00:07:37] What do you mean it's a tracking device? [00:07:41] Yeah, but it's his data. [00:07:44] What do you mean it's his data? [00:07:45] It's where he goes. [00:07:46] That's his data. [00:07:48] That's the issue. [00:07:50] That's the significant issue of this. [00:07:55] This is the part which is fascinating. [00:07:57] You hear data, metadata, the information that you provide, that you have on you at any time. [00:08:05] Your car, your equipment, your car. [00:08:09] If I... [00:08:10] Right now on your car, you probably have something... [00:08:12] Here we have this thing called the EasyPass. [00:08:14] You can probably have the name for it. [00:08:16] It's that little tracking device. [00:08:17] That device that goes through tolls and things. [00:08:20] It's pretty handy, except that it keeps track. [00:08:24] Of every place you go. [00:08:26] Now wait a minute. [00:08:27] You don't need that device. [00:08:30] That device goes up to a cloud or someplace else and you're billed accordingly. [00:08:35] Because you have that device on there. [00:08:38] Well, do you realize that when you put that on your car, you don't have an expectation of privacy to that particular data? [00:08:48] Do you? [00:08:49] No. [00:08:51] Well, what is it that I don't know? [00:08:55] It's, where is the data? [00:08:58] Where is it? [00:08:58] Is it on your car? [00:08:59] Is it you? [00:09:00] And what is the data? [00:09:01] Where do you go? [00:09:02] Sometimes, by the way, those easy passes, very interesting, they've saved people's lives. [00:09:08] They've actually saved lives in that they have provided an alibi, perhaps, in the case of a murder case. [00:09:17] You say, oh, you were in Cincinnati? [00:09:23] So, this data, so when you go back to the phone or the whatever, don't you realize that most of what you have anyway isn't on that computer? [00:09:32] It's in a cloud! [00:09:44] But more important than that, in some states, they still have this invasion of privacy. [00:09:51] As a tort, as a civil charge, the fact that you're invading my privacy and you're exposing pictures, well, I mean, who owns things? [00:10:06] See, this is a weird concept. [00:10:08] I'll give you another example. [00:10:11] There have been these cases called revenge Porn. [00:10:17] It's the wrong term, but somebody takes a picture of somebody else. [00:10:21] Let's say it's a nude picture. [00:10:24] And then later on, they use the reveal of that to either embarrass or get something or whatever it is. [00:10:32] Well, the question that was asked by a lot of people is, who owns that? [00:10:37] Who owns that picture? [00:10:40] I do. [00:10:41] I took it, theoretically. [00:10:44] So I can use it whatever I want. [00:10:47] But you're extorting money from... [00:10:49] No, I'm not. [00:10:50] I mean, theoretically I am, but no, I'm not. [00:10:53] Am I? [00:10:55] It's embarrassing, but I've got it. [00:10:59] Didn't people like...
