Need to Know News (16 September 2022) with Joe Olson and Maryam Henein

This is Jim Fetzer, Madison, Wisconsin, joined today by Joe Olson in Houston and Marion Hennane in Florida.
We're very pleased to bring you the latest news you need to know.
We begin with the developments of a special master appointed to review documents from Mar-a-Lago, where the DOJ requests to resume the criminal probe has been rejected.
I believe the judge in this case has been very responsible.
A Brooklyn-based federal judge has been selected to review the materials seized at Paralago.
Raymond Deary, put forth as a possible candidate by Trump, the DOJ nominated to, Trump nominated to, and the DOJ also agreed to Deary.
U.S.
District Judge Aline Cannon rejected the DOJ bid to resume its criminal investigation into criminal documents.
An intelligence community review of the docs has been paused since last week when she ordered the criminal investigation to stop for the moment.
DOG contends the two reviews can't be separated and plans to appeal.
I believe it will be to no purpose whatsoever.
She gave the special master a deadline of November 30th, which means that it will end after the midterm congressional elections virtually guaranteeing that we'll move slowly for the next two months unless a higher court intervenes.
She rejected the DOJ bid to resume the criminal probe, explaining she was unconvinced that pausing the review of the docks would cause irreparable harm.
The department argued that the intel assessment of national security risks, which Cannon previously said could go forward, was being impeded by the whole she'd put on the criminal probe's use of the docks.
But, she replied, first, There has been no actual suggestion by the government of any identifiable emergency or imminent disclosure of classified information arising from plaintiffs' allegedly unlawful retention of the seized property.
Instead, and unfortunately, the unwarranted disclosures that float in the background have been leaked to the media after the underlying seizure, implying, therefore, the FBI and the DOJ were responsible She also rejected the argument that the intel assessment could not be decoupled from the criminal probe.
While it may be easier for the government's criminal investigative work to proceed in tandem with the security assessments, the DOJ had not convinced her that they were being thereby impeded.
Pointing to examples prosecutors offered of how national security would rely on the criminal probe's work, she observed, prosecutors do not firmly maintain that the described processes are inextricably intertwined, instead rely heavily on hypothetical scenarios and generalized explanations that do not establish irreparable injury.
Trump filed the lawsuit, of course, where prosecutors are investigating at least three potential crimes—violation of the Espionage Act, illegal handling of government records, and obstruction of justice—none of which hold any water.
I believe the real objective is to try to ferret out evidence of involvement in the alternative elector slate, which it now appears they're focusing on as under the 14th Amendment, a justification to claim he sought to overthrow the government by means of the slate of alternative electors.
Bear in mind, none of this is going to hold any water in court.
In fact, anything they get from this seizure is going to be inadmissible at court because the warrant was too broad, covering the entire four years of his administration.
But they know that.
They're doing this for public relations and to give the Democrats a cause to move against Trump, to preclude him from running again in 2024.
Because they're scared shitless he's going to clean their clock again as he did in 2016 and 2020.
During this search, investigators seized more than 100 documents marked as classified, which of course does not mean they were still classified documents.
When the FBI traveled back in June to Mar-a-Lago, one of the lawyers signed a certification occurring the subpoena had been complied with.
That was a subpoena back from May.
In his filings, he insisted his constitutional riots have been trampled upon.
I think there's no doubt about it.
Cannon previously said she didn't agree the judicially authorized search amount to a callous disregard of his rights, but the fact that the subpoena was far too broad meant it was unconstitutional.
She ought to have seized upon it, but I think rather instead relied upon moving forward with a special master, which is completely appropriate.
According to her order, Cannon thought it was necessary to bolster public trust in the search by appointing the special master, and that he faced an increasing risk of reputational harm if an indictment were to be wrongfully brought against him.
He claimed on Hugh Hewitt's show of late that he declassified the government documents that he'd taken, and he had a standing order that any documents he took with him home for work were declassified.
Her order also raised doubts that all the documents with classification markings were also classified.
The court does not find it appropriate to accept the government's conclusions on these important disputed issues without further review by a neutral third party in an expedited and orderly fashion, she said, referring to the DOJ's assertion that docs are presumably classified and that Trump could not possibly had a possessory interest in any of them.
I believe she's acting highly appropriately.
I applaud her.
Joe, your thoughts?
Yes.
Well, we have several different problems with the Justice Department.
We've got the fact that Denchinko was a paid operative the whole time he was swearing out false statements for FISA warrants that the DOJ rubber stamped and kicked down the road over and over and over.
So they got that little issue to solve.
And then, you know, Oh, Biden has the enormous problem with 50, at this point, at least, Trump affiliates that they've been either busting down the doors or subpoenaing them.
And then they did that little sham thing with Mike Lindell.
So, you know, this is desperate acts by really desperate and very ugly people.
It's just a shame that, you know, with the news media, They're being exposed on virtually every hand, every single day.
for absolutely the horrible human beings that they are.
But hopefully in the next six weeks, they will prove unequivocally what kind of human beings they are, and we can at least start to reverse this terrible nightmare that we've got in the way of political corruption in this country.

Let me pause to just find out what this is.
Miriam, your thoughts? - Yeah.
My thoughts are that this is all political theater.
What they're banking on is flashy headlines, and then the mainstream doesn't really pay attention to what's going on, forms their opinion, and then they let it Just devolve and the truth is lost.
Regardless, I think that what happened with the FBI raid has further galvanized people who support Trump.
So it's all about divide and conquer and they are dividing.
And I think the more heat that Trump gets, the more that his base loves him, which arguably is what they want.
I mean, this guy is the biggest figure that you love to hate, right?
They need Trump.
Frankly, I don't know who other than DeSantis would even have a chance of becoming president.
So I'm curious to see how this unfolds.
I do think that with the November elections, It's going to swing back, at least have more balance with there'll be a red wave and then further the divide for 2024.
I agree with that, presuming that we have the opportunity to actually hold an election because I think they're going to try to forestall it.
Meanwhile, in my opinion, Texas and Florida made brilliant moves escalating the flights, buses that move migrants.
Republican governors are escalating their partisan tactics, sending migrants to Democrat strongholds.
We have the governor of Texas sending thousands of migrants on buses to New York, Chicago, and Washington, D.C.
The latest subprime move, including two flights to Martha's Vineyard paid for by Florida, reached a new level of political theater.
Upon arrival, where former President Barack Obama, Bill Clinton, Hillary, Oprah have homes.
The migrants, who are predominantly from Venezuela, were provided with meals, shelter, health care, and information where to find work.
But it was all a ruse, as we'll find.
They got them off the island as quickly as possible.
A vacation in an island south of Boston whose huge round residents include many blue-collar workers appeared to absorb the dozen without a major hitch, but as we'll see, that was merely a sham.
Elizabeth Fulkarelli, chief executive of the non-profit Martha's Vineyard Community Services, was raffling up work when she saw 48 Venezuelan with luggage and backpacks approach her office with red folders brochures for her organization.
They were told they would have a job, they'd have housing.
She said it was scrambled.
Her shelter posed a huge challenge.
Migrants played soccer, hung out in small groups on the porch of their temporary shelter while meeting visiting attorneys.
Wellwisher dropped off donations.
The president of the League of United Latin American Citizens, Domingo Garcia, said some of the migrants were a trick.
In allegation the AP has not confirmed that officials in Texas and Arizona have denied, Florida Governor DeSantis said the flights to Martha's Vineyard were an effort to transport illegals to sanctuary destinations, where the Florida legislature has earmarked 12 mil to transport unauthorized aliens out of state.
His office didn't ask a question about where they boarded planes.
A Massachusetts state senator said the flight originated in San Antonio, but it sat down in Crestview, Florida, in Charlotte, North Carolina, before landing at Martha's Vineyard.
So I believe the plane was Chartered out of San Antonio, picked up the migrants in Crestview, and then proceeded on to Martha's Vineyard.
The two buses of migrants arrived Thursday outside of Harris's residence at the United States Naval Observatory with more than 100 migrants from Colombia, Cuba, Guyana, Nicaragua, Panama, and Venezuela.
The Biden-Harris admin continues ignoring and denying the historic crisis at our southern border, which has endangered and overwhelmed Texas communities for almost two years, said the Texas Governor Abbott, who has poured billions into making border security a signature issue.
Governor Gavin Newsom of California, who is a truly gruesome individual who's been wrecking California and who has publicly feuded with DeSantis and Abbott, asked the DOJ to investigate whether transporting migrants across straight lines and political props broke the law.
I believe in it.
He was sent a letter to the attorney general, Merrick Garland, which Merrick Garland may have suggested he send to him.
I think this is a sham.
Transporting families, including children, across state lines under false pretenses is morally reprehensible, but it may also be illegal.
Why would it be morally reprehensible to send them to sanctuary cities and states?
I mean, that's just ridiculous.
Without mentioning them by name, he suggests that the federal government could bring charges of kidnapping and civil rights conspiracy.
This is lunatic!
After migrants seeking asylum, they spend time at a custom and border facility and are then generally released into the U.S.
Republicans say Biden's policy encouraged migrants to vanish into the U.S.
Democrats argue the Trump policy of having them wait in Mexico is inhumane.
I can see no warrant whatsoever for regarding that as inhumane.
White House Press Secretary Jean-Pierre said federal officials were not told in advance that they were being sent to versus vineyard into Washington, D.C. in an attempt to play on emotions.
We're talking about children.
We're talking about families who are promised a home, promised a job, put on a bus and driven to a place they do not know, calling the governor's action a cruel, premeditated political stunt.
But any foreigner coming into the United States is going to a place they do not know.
And who in the world could be promising them a home, a job and all that, because we don't have that kind of guarantee for American citizens, which just reflects the absurdity of the position, which is destroying the United States as a nation.
Abbott has bused 7,900 migrants to Washington since April, sent 2,200 to New York, 300 to Chicago.
The Arizona governor has bused more than 1,800 to Washington since May.
They have to sign up and volunteer for the trips.
DeSantis has taken it to a new level using planes and choosing Martha's Vineyard, whose harbor towns are home to about 15,000 people less prepared than New York or Washington.
Texas and Florida have infuriated officials in those destinations.
President Biden is facing the same challenge that dogged his predecessor, except that Trump did something about it.
He built a wall.
He secured the border, which Biden has not done.
Authorities stopped migrants crossing from Mexico about 2 million times from October through July, up from 50% from a year ago.
Many are released to pursue their immigration cases because U.S.
authorities have struggled to expel them.
To their countries under a pandemic era rule that denies them a chance to seek asylum, where Republicans have celebrated the latest delivery of migrants from the border states.
Welcome to being a state on the southern border, Massachusetts, tweeted DeSantis spokesman Jeremy Redford and Stephen Miller.
A chief architect of Trump's immigration policy said, bringing a few million migrants to Martha's Vineyard should transform the island, about 15,000, into a modern Edom.

Charlie Crist, former governor who's turned Democrat, said the Santa's history and the migrants inhumanely.
But that's completely ridiculous.
Talia Inlander, Deputy Director of UCLA's Center for Immigration Law and Policy, said the Flights to Martha's Vineyard appear to violate Florida law that they be limited to unauthorized aliens.
These folks are not unauthorized, she claims.
Well, what the hell are they?
They are here illegally.
I don't think that represents authorization.

Yes, well it's amazing that it's not a crime when they do it.
Here's from the bronxnews12.com website.
Nearly 2,500 unaccompanied minors have been brought to Long Island and Queens since June of 2021, and this was published in October of 2021.
So in four and a half months, the FJB administration imports 2,500 unaccompanied minors to New England, and that's not a problem.
It's just when 50 of them show up in front of Oh, Harris's house, or 50 of them show up on, you know, Martha's Vineyard's little 90% white enclave liberal mecca, then all of a sudden it's a problem.
Well, deal with it.
We've been dealing with 2 million of them so far here in Texas.

Unexpected migrant strain.
What's the carrying capacity of Martha's Vineyard?
Carrying capacity, of course, is the amount of population that can be sustained for an indefinite period of time, given the resources available in that terrain.
We found ourselves asking a question when the island off Cape Cod announced it was experiencing a humanitarian crisis after 50 people arrived there seeking shelter.
They were reportedly migrants, some of whom may be refugees from Venezuela's communist dictatorship, who had reportedly been flown to Martha's Vineyard on a plane by Florida Governor Ron DeSantis.
The Ombuds officials announced this resident, town, and community-based non-profit group has sprung into action to provide food, shelter, health care, and other amenities.
They noted two emergency shelters had been established in case further arrivals occur.
Let us hope.
Here's the immediate release.
They talked about their humanitarian response, trying to put a good face on it.
So the question becomes, How much capacity does Martha's Vineyard have to shelter refugees?
Census data shows around 17,000 year-long residents, 14,600 homes on the island.
Assume each home had four bedrooms, each bedroom could sleep three.
That would bring the island's sleep capacity to 175,200 beds.
175,200 beds, 158,200 of those would be unoccupied.
If anything, this underestimates the sleeping capacity During the summer, for example, it regularly houses 200,000 at a time, if you really pack people in.
Allowing for sleeping in living rooms and libraries and dining rooms and studies, you could easily house 400,000.
Of course, there's a lot of available land in the vineyard that could be converted into housing for refugees.
With a current population of about 194 persons per square mile.
That's around the density of Indiana, Georgia, and North Carolina.
If we were to raise it to that of Washington, D.C., which has 11,295 per square mile, we could fit in nearly a million newcomers.
That would still leave plenty of room on the island.
Manhattan, after all, is 69,648 people per square mile.
By our calculation, that leaves Martha's Vineyard with room for about 6 million refugees.
Barack Obama owns a 29-acre estate with seven bedrooms and 8.5 bathrooms, could not be reached for comment.
His house features a private beach that could become the official welcome point for ferries bringing in the new arrival.
Perhaps a former president could even be persuaded to greet the hostess embarking with an aloha and a lay in the tradition of his native state.
Meanwhile, Martha's Vineyard migrants are being shipped to Joint Base Cape Cod.
They wasted no time getting them off of the island.
Migrants flown to Martha's Vineyard by Florida Governor Ron DeSantis are being transported to Joint Base Cape Cod.
Massachusetts Governor Charlie Baker's admin released details to provide shelter and humanitarian support for the migrants.
Added, National Guard will be activated as part of the effort.
Buses have arrived to transport the migrants from Martha's Vineyard.
I just spoke with two men who travel together.
They don't know where they're headed, but we're told it would be somewhere safe and with more room, said NBC Channel 10 in Boston.
DeSantis sent a pair of flights with the illegal sub-Inyart in the latest move to get Democrat-run areas away from the southern border to bear some responsibility for Biden's open border policies.
Baker's administration said shelter and humanitarian support will be provided at JBCC for the approximately 50 Venezuelan migrants who arrived this week.
Massachusetts Emergency Management is coordinating effort with state and local officials to ensure access to food, shelter, and essential services.
The admin's press release also said Baker planned to activate up to 125 members of the Massachusetts National Guard as part of the effort.
The governor's office accepts to move the migrants because the Martha's Vineyard communities are not equipped to provide sustainable accommodation.
Look how that contradicts what we just found about the carrying capacity for Martha's Vineyard.
They just don't want them there.
JBCC has historically housed and cared for displaced individuals, including Louisiana resident fleeing Hurricane Katrina, as well as alternative care medical for mass residents during the COVID pandemic.
Migrants and families will be housed in dormitory-style spaces with separate for individuals and families.
No families will be separated.
Joe, they couldn't act fast enough to get him off the island.

Of course, the whole thing's a political gamut to destroy the red states who have changed the demographics to affect the voting in swing states that benefit the Democrats.
And get this, Joe Biden signed a secret order that could rig the 2022 election.
They're going all out.
Polls show Democrats are likely to lose at least their majority in the House.
I think it's going to be much worse.
Democrats, however, have an ace up their sleeve because Biden signed a secret order to rig the election.
It's the responsibility of the federal government to expand access to and education about voter registration and election information and to combat misinformation in order to enable all eligible Americans to participate in our democracy, the order states.
What he really means, of course, when he says that, is the government will censor administration critics.
A lawsuit from the Attorneys General of Missouri and Louisiana show Biden pressured tech companies to censor individuals who raised doubt about COVID policies in the Vax.
Biden's executive order contains many of the same themes and policy priorities Democrats included in their federal election takeover bill that conservatives argue would end the practice of competitive elections in America and cement a permanent Democratic Party majority, which of course is the outcome they want.
The order mandated Using federal agencies to promote voter registration, using federal agencies to inform Americans about voting, using federal agent website, the state voter registration website, providing voter registration and vote by mail applications, using approved nonpartisan third-party organization to register voters at federal agencies, Using identification documents issued by the agency to help people register to vote.
Providing more multilingual services to potential voters.
How can you vote in America if you can't even speak English?
Giving public employees time off to vote in federal, state, local, tribal, and territorial elections.
And promoting voter registration for federal prisoners.
What makes this EO especially worrisome is that the Biden DOJ is refusing to release the 15 pages of documents outlining how they plan to put this executive order into action.
If that ain't illegal, I can't imagine what is.
That raises concerns.
This EO is really a Democrat Party get-out-the-vote initiative, which it clearly is.
Republicans saw how Zuckbox, Facebook founder Mike Zuckerberg privately funding election in key states, actually funded Democrat turnout in the 2020 election.
He has pulled back for the 2022 under a microscope.
But until Biden comes clean and is fully transparent about what his executive order entails, it raises suspicions, which I affirm are obviously well-founded.
Biden is planning to use the machinery of government to boost Democrat chances of victory in November.

Yeah, well, if you didn't believe in the Uniparty before, you certainly got to believe in it now because you're not hearing a peep out of the RINO division of the Uniparty about any of these issues that are happening.
You know, it's really ridiculous.
We have a few MAGA candidates and a few key races that are standing up and actually articulating what's going on, but the vast majority of the, quote, GOP are just grand old party, you know, get along, go along.
They could care less.
It's tragic that we don't have more of an outcry across at least the conservative part of the political spectrum.
We got absolutely nothing, you know.
And there's media outlets where you could get your message out, even if the mainstream won't cover you.
Other than Marjorie Taylor Greene, I don't, Kerry Lake, I don't have too many heroes on the whole political horizon at all.
Yeah, I get it, Joe.
This is just outrageous.

Again, when you're playing both sides, you can have the good guys say things or make positive advances because you know that the bad guys are just going to undo all the good that's been done.
I mean, case in point, whatever Trump did for the nation that helped, well, that's gone to hell.

During a rousing Labor Day speech in Pittsburgh, Biden falsely claimed he was very engaged in the civil rights movement in the 1960s, a bogus story he's repeated so many times that advisers have had to gently remind him that he's not telling the truth.
Even CNN and the New York Times have called BS on Biden's repeatedly debunked claim to civil rights fame.
I got very engaged in, in my case, the civil rights movement, and as a kid I worked a lot in the movement, and I got deeply involved in the Democrat Party, because the Democrat Party in Delaware was a Southern Democrat Party then, he did during his speech on Monday.

Alex Jones and InfoWars were sanctioned just minutes into the second damage trial.
It started Tuesday in Connecticut.
Judge Bellis issued a ruling that he and InfoWars cannot argue they didn't make considerable profits from covering the shooting because they didn't hand over Google analytic data concerning the traffic of InfoWars to the plaintiffs.
He and others appearing on InfoWars, according to this report, falsely claimed for several years that the massacre was a hoax.
Jones has said he no longer believes that.
Toward the end of last year, he and InfoWars were found liable by default in a number of civil cases in Connecticut and Texas.
The ruling means this trial, like the one previous in Texas, are only meant to decide how large the damages will be.
A first trial, included other plaintiffs, found the defendant should pay $49.3 million damages.
The trial in Connecticut ate families who lost family members and an FBI agent who responded.
Before the jury entered the courtroom, plaintiff's lawyer, Ellen Sterling, requested the judge approve sanctions against Jones and Infowars.
Arguing they found a spreadsheet of Google Analytics listing traffic until June of 2019, despite defendants' claim no such document existed.

Sterling said the sequence of misconduct was profoundly disturbing and should lead to significant sanctions.
Norm Padas, an attorney for Mr. Jones and Infowars, said he was not happy the data hadn't been turned over.
He argued it was irrelevant.
Claiming there was no evidence showing InfoWars had allowed the numbers to impact its coverage on the air.
Judge Bellis said InfoWars showed a stunningly cavalier attitude with respect to their discovery obligations.
InfoWars had consistently engaged in dilatory and obstructive discovery practices, she said, adding this prompted the default judgment.
Notice here again, these various trials have been decided by stipulation, by default, by agreement, or in my case, by an absurd summary judgment procedure that allows a judge, based upon his own subjective judgment of what's reasonable or not, to based upon his own subjective judgment of what's reasonable or not, to destroy disputed facts, to make it permissible to go ahead and issue a ruling when there are massive disputed facts, but he simply makes them as though they did not exist, which has led me to appeal
